I congratulate the right hon. Member for Kingston and Surbiton (Sir Edward Davey) on arranging the debate. I want to make a couple of points because the debate is timely, given the approach of the autumn Budget in a couple of weeks’ time.

In the west midlands, our police force has lost £145 million in real terms from its budget since 2010. That has resulted in a loss of 2,000 police officers and a further loss of a considerable number of civilian non-uniformed policing staff. Crime in the region is up 14% in the latest figures, and some crimes are up by more than that. Burglary is up 31% and car crime by a similar amount, all at a time when the country is having to cope with a significant terrorism threat, which requires significant police resources.

The effect of all that is obvious, deep and profound. If people do not feel safe in their community, on their streets or in their homes, they are not free to go about their lives. Fear of crime destroys liberty. Nor does it apply equally: lower-income communities and people on lower incomes suffer the most, because they do not have the options available to some wealthier citizens. They cannot live in a gated community. They do not have the option sometimes of moving to a more expensive property, perhaps in an area with lower crime levels. Crime is therefore an issue not just of safety but of liberty and of equality, too. That is why we should be deeply concerned at the juxtaposition of falling police numbers and rising crime, which is what the country now faces.

I want to stress my support for what the right hon. Gentleman has just said. It is an argument that is not heard enough that policing and police resourcing is an issue about social justice and freedom. We have to make that argument, because whether it is the newspapers, the House or the establishment, there is not an understanding of the significance of extra police in our communities for the poorest and most vulnerable in our communities.

I wholeheartedly agree with the right hon. Gentleman. As I said, this is an issue of liberty and it is an issue of equality, too. I want to make an obvious political point. Let us imagine the roles were reversed here and we had a Labour Government presiding over a huge cut in police numbers and a significant rise in crime. Do we honestly think that Conservative Members would be saying, “It’s got nothing to do with police numbers”? I do not think so. I know that opposition can do strange things to a political party and the conclusions it sometimes reaches, but so too can government make Government Members—particularly Back-Bench Members—end up defending the indefensible.

It is simply indefensible to continue with police cuts after what we have had in the past seven years, in the light of both the terrorism threat and now the recorded crime figures showing the rises that I have set out in the west midlands. I want to use today to make my appeal to the Minister to consult with the Chancellor, to say, “Enough is enough.” Cuts in policing have gone too far. They are affecting people’s liberties, and it is an issue of equality, too. We want to see fair funding for police forces right around the country so that we can give the community both the visible presence and the real protection against crime that they deserve.

I will return to that.

We invest strategically from the centre. We have a system of 43 individual police forces. It makes sense to have a strategic investment capability to invest in things that can have an impact across the system, and we must continue to invest in innovation, not least given the context we are dealing with. The settlement at the moment is flat cash for all police forces. We recognise, as I have said publicly, that demand has grown and is changing. We are also extremely sensitive to the strain that the police are under. This is a can-do organisation that is saying, “We are very concerned about stretch and sustainability.” I have heard that directly from police commissioners and cops.

My hon. Friend raises such an important point. He is absolutely right that we will always make sure that we combat human trafficking and the misery and abuse that go with it. I work closely with my European counterparts to make sure that we share information. Our National Crime Agency carefully tracks serious organised crime groups, and Europol works with us and other European partners to make sure that we work across Europe to guard against the terrible damage done by these people.

The Home Secretary is a good person, so I am not here to make a personal attack on her, but what signal does she think this sends to the world in the wake of President Trump’s announcement last week, albeit in a different context? There are always those who say that we should look after our own, that charity begins at home—“Britain first”, “America first”, “France first” and so on. Does she want us to be aligned with that sentiment or a different one?

We are not saying that we are closing the door and pulling up the drawbridge. I urge the right hon. Gentleman and hon. Members on both sides of the House not to fall into the trap of suggesting that we are not a country that welcomes refugees. We are stepping up to our obligations and supporting the most vulnerable with money and refugee programmes. I do not recognise the comparison he is making, and I hope that other Members share my position.

Further to the question of the right hon. and learned Member for Beaconsfield (Mr Grieve), the Prime Minister said in her speech yesterday that we will not be hanging on to “bits” of the EU. Europol is an EU agency and the European arrest warrant is an EU crime and safety measure. Is not a reasonable—in fact, the only—interpretation of the Prime Minister’s speech about not hanging on to bits of the EU that we will no longer participate in either of those?

It is worth the right hon. Gentleman looking at the Europol website that the right hon. Member for Delyn (Mr Hanson) mentioned. He will see that there are associate members of Europol that are not members of the European Union, such as the United States. I also point out that Europol existed as a non-EU institution before the EU was involved with it. Therefore, it is important to recognise that we will look to develop a unique and bespoke position for the country.

The hon. Gentleman makes a very significant point about the importance of the European arrest warrant, which has provided all the benefits he ably describes. I am confident that we will maintain the same level of arrangements we have had with our colleagues in Europe. Keeping citizens safe is absolutely the first priority of the Government. The former Home Secretary, now Prime Minister, made huge strides in closer relationships with our colleagues in Europe, keeping citizens here and in Europe safe. As she outlined yesterday, although we are leaving the European Union, we are not leaving Europe. We are determined to work very closely with our colleagues in Europe to ensure that we can share information and data, so that we can continue to provide effective ways in which to enable our law enforcement officers to bear down on terrorists.

I thank the Minister for that reply, but how is it consistent with the Prime Minister’s statement yesterday that we will not take part in any bits of the EU? The European arrest warrant is a European Union measure, so how can we possibly stay part of it after the Prime Minister’s speech yesterday?

I thank my right hon. Friend for the question, and I can reassure him that we are already engaged with the people who are running the Olympics in Brazil to make sure that we make the games as safe as possible. Our London Olympics team went over to ensure that that was the case. We think we have substantial expertise here, and we are happy to share it, particularly where there are large events such as the Olympics.

I welcome the Home Secretary to her new post. Terrorism is aptly named, as it thinks up new and more awful ways of committing mass murder. What discussions has she had with the intelligence and security services about unconventional weapons being used in terrorism? Given that Nice is a provincial city in France, can she tell me honestly that my constituents in Wolverhampton enjoy the same level of protection against terrorism as people living in London?

I am here to reassure the right hon. Gentleman and his constituents that we are doing all we can to ensure that they and all of our constituents are kept safe, and we will always keep particular incidents under review to make sure that we can give people as much certainty as possible. One thing we are particularly focused on is large crowds and big events, and the Security Service and the police will be monitoring and reviewing particular events, or places of large gatherings, to ensure that we keep people safe.

My hon. Friend is absolutely right, and those powers are necessary for our police and security services. That is why we will be putting the Investigatory Powers Bill through the House, because it includes powers to ensure that those whose job it is to keep us safe have what they need to do that job.

The first duty of a Government or any political leader is to protect their citizens. The global list of atrocities that the Home Secretary cited shows that this is a worldwide jihadist ideology, the fight against which we cannot opt out of in the hope that if we leave them alone, they will leave us alone. I implore her to make this battle not just one of critical public safety, but also about the values that my right hon. Friend the Member for Knowsley (Mr Howarth) spoke about, such as democracy, human rights, equality between men and women, and the freedoms that we enjoy in this country and in others.

I absolutely agree with the right hon. Gentleman. This is not something that we can walk away from, and we cannot say that if we do nothing we will be safe and secure. We must fight this ideology and these terrorists, and ensure that the values that underpin our society, which the terrorists are attacking and trying to destroy, are maintained. That is one reason why the Government have looked not just at counter-terrorism, but also at our counter-extremism strategy. We want to work with communities across the United Kingdom to promote the values that underpin what makes this country such a great place to live in—values that are shared across the United Kingdom and across all communities.

The Government have of course increased the requirements for those coming into the United Kingdom to be able to speak and understand English. My hon. Friend mentions the role of women, and I share his view that it is important that we hear female voices from the Muslim community. I commend Sara Khan, who has once again stood up and spoken about that issue. In the latter part of last year I attended an inspirational event that she held as part of the #MakingAStand campaign that she was running with Muslim women around the country, saying that they wished to take a stand against those who were trying to radicalise young people in the Muslim community.

Will the Home Secretary join me in rejecting the new imperialism that we hear after incidents such as this, which seeks to condemn the killings but somehow excuse the actions by blaming ourselves—in this case by saying that the cartoons in Charlie Hebdo were somehow unnecessarily provocative? Does she not agree that we cannot continue to absolve those engaged in terrorism of their responsibility, and that we must agree that responsibility for those actions lies squarely with those who kill innocent people?

The only people responsible for a terrorist attack are the terrorists themselves. They are criminals, and we should never let anybody forget that.

I beg to move, That the Bill be now read a Second time.

The threat that we face from terrorism is serious, and it is growing. The Security Service believes that since the attacks on 7 July 2005, about 40 terrorist plots have been disrupted. It is thanks to the hard work and dedication of our security and intelligence services, the police, and our allies overseas that almost all those plots have been thwarted, and countless lives have been saved. I am sure that the whole House will want to join me in paying tribute to those men and women, whose work so often goes unreported and unrecognised as they strive to keep us safe.

Today, however, the threat from terrorism is becoming ever-more complex and diverse. Last year we saw the first terrorist-related deaths in Great Britain since 2005: Fusilier Lee Rigby was brutally murdered by Islamist extremists, and Mohammed Saleem, an 82-year-old Muslim from Birmingham, was stabbed to death by a far-right extremist who then tried to bomb mosques in Walsall, Wolverhampton and Tipton.

ISIL and its western fighters represent a clear danger. This summer, partly in response to that threat, the independent joint terrorism analysis centre raised the threat level for international terrorism from “substantial” to “severe”. That means that JTAC considers a terrorist attack to be “highly likely”. We face the very serious prospect that British nationals who have fought with terrorist groups in Syria and Iraq will seek to radicalise others, or carry out attacks here. We have already seen the appalling murder of four civilians outside the Jewish Museum in Brussels, and the recent attack on the Canadian Parliament was a shocking reminder that we are all targets for these terrorist organisations and those whom they inspire.

However, ISIL is not the only threat that we face. There are further threats related to Islamist extremism, and there are threats from far-right and Northern Ireland-related terrorism, among others. Just last week, a report from the Intelligence and Security Committee on the intelligence relating to the murder of Lee Rigby highlighted the real, and potentially very dangerous, capability gaps that exist for the security and intelligence agencies—and when our security and intelligence agencies tell us that the threat that we face is now more dangerous than at any time before or since 9/11, we must act.

We are engaged in a struggle against terrorism which is being fought on many fronts and in many forms, so our response must be comprehensive, coherent and effective. Since April 2010, in Great Britain, more than 800 people have been arrested for terrorism-related offences, more than 210 have been charged, and more than 140 have been successfully prosecuted. Only last week, Mohammed and Hamza Nawaz became the first Britons to be jailed for terrorist training in Syria, and we have outlawed groups linked to terrorist attacks in Syria, Iraq and Egypt.

We have protected the budgets for counter-terrorism policing and for the security and intelligence agencies, and, as the Prime Minister announced last week, we have made an additional £130 million available over the next two years to help us tackle the increasing terrorist threat. We have replaced control orders, which had been whittled down by the courts, with terrorism prevention and investigation measures, or TPIMs. We have strengthened the criteria governing the use of the royal prerogative, which allows the Government to cancel British passports to disrupt the travel of people planning to engage in terrorist-related activity overseas. I have used that enhanced power 29 times since April 2013.

The Home Secretary referred to the Government decision to replace control orders. One of the decisions she made when she did that was to remove the relocation powers within control orders. That was a decision of choice, not one forced on her by the courts. This Bill reverses that judgment to get rid of relocation powers. Will she now admit that it was a grave error to put the public at increased risk as a result of a political deal within the coalition, and that the fact that she is now legislating to reverse those changes shows that it was a grave error of judgment?

I would say two things to the right hon. Gentleman. First, as I have just been outlining, we face today a different threat background from that we faced in recent years. Also, if he looks carefully at the Bill, he will see that we are not simply reintroducing a power of relocation into the TPIMs. We have taken on board the recommendations of the independent reviewer of counter-terrorism legislation, David Anderson QC, who did propose the reintroduction of relocation, but who also proposed a number of other changes to TPIMs, which we are introducing, including the raising of the threshold for the introduction of TPIMs from “reasonable suspicion” to “the balance of probabilities”.

We have worked hard to make it easier to get rid of undesirable foreign nationals, including terrorists and terror suspects. We have changed the law to make it clear to the courts that article 8 of the European convention on human rights, the right to respect for a family life, is qualified and not an absolute right. We have significantly reformed the Prevent pillar of the counter-terrorism strategy so that it is tackles the ideology behind the threat, and we are working with the internet industry to remove terrorist material hosted in the UK or overseas. Since December last year, the counter-terrorism internet referral unit has secured the removal of over 46,000 items that encouraged or glorified acts of terrorism.

The emergency legislation that Parliament approved in the summer ensured that two important capabilities, communications data and interception, were not eroded further. Both of these capabilities are absolutely crucial to the investigation of those involved in terrorist activity.

I do support the proposals, because they came out of David Anderson’s report about changes to the TPIMs regime. He looked at the evidence and came up with sensible recommendations. However, I warn the hon. Gentleman against playing party politics on this issue, because that is what got the coalition into trouble in the first place. The reason the coalition removed relocation orders was that it wanted to make party political points, rather than look at the evidence. That is why it has had to do a U-turn: it has finally had to look at the evidence. I caution him about doing the same again.

The Home Secretary said in her speech both that we were engaged in a generational struggle and that the security situation had changed markedly in the past couple of years, justifying the U-turn that part 2 of the Bill represents. Are those statements not contradictory? It is true that we are engaged in a generational struggle. It would be better for the Home Secretary to apologise for the grave error of judgment that put the public at risk than to pretend that the situation has changed radically.

My right hon. Friend is right that the threat level is the same now as it was when the Home Secretary came into office. There have been ongoing threats to our security and liberty for many years, and it was not increased threat that led either Ibrahim Magag or Mohammed Ahmed Mohamed to abscond when their relocation orders were revoked. It was the lack of a relocation order and the weakening of the counter-terrorism powers.

Counter-terrorism policy is always difficult. There will always be things that Governments find challenging, and there will be times when they get the balance wrong. However, we should look at the evidence together. The Home Secretary and the Government failed to look at the evidence about relocation powers, and they failed to listen to the advice of the security experts. They have had to do so now not because the security threat has changed but because TPIMs simply did not work. It is right that they should be strengthened now and that powers should be restored.

There are two other puzzling things about the Home Secretary’s measures on TPIMs. The first relates to the point that my right hon. Friend the Member for Salford and Eccles made about the 200-mile limit: what is the difference between someone being 205 miles away and someone being 195 miles away? More puzzling is the measure that the Government are introducing to prevent people on a TPIM from having access to a firearm. That seems extremely sensible—we would not want any terror suspect to have access to a firearm—but how could any of them have had such access before? That raises the question whether either the gun licensing regime or the TPIMs regime is considerably weaker than we thought. We hope that some clarity will be provided in Committee on why that measure is needed. We will clearly support it, but it is a puzzle that existing powers are not strong enough to ensure that that sensible restriction is in place.

The next challenge is how to deal with the new and growing problem of British citizens leaving to join the conflict overseas, where they may become involved in awful crimes and barbarism, be further radicalised and become a threat to this country. We need new measures to prevent people from going. Removing people’s passports through the royal prerogative is understandably not a swift process, and sometimes faster action is needed. If troubled parents ring the police because they are worried that a son or daughter has left to join ISIS and taken their passport with them, the police need to be able to move quickly. We therefore agree that temporary powers are needed.

The lack of judicial oversight is a concern. As the Bill stands, the police will be able to seize a passport based on their own judgment of reasonable suspicion, and there will be no judicial oversight for 14 days. Even then, a magistrate will look only at whether the police are continuing to investigate, not at whether there was reasonable suspicion in the first place. The power to seize a passport is important, but that means that it is also important that it is not abused.

My right hon. Friend is absolutely right. He is right to draw attention to the excellent work the Department for Communities and Local Government has been doing under the leadership of my right hon. Friend, the Secretary of State. Indeed, my right hon. Friend, the noble Baroness Warsi has been doing very important work to bring communities together, particularly faith communities, to share their experiences and increase understanding between them. That is a vital part of the integration work that I would have hoped we all, across the Chamber, accept is necessary. We should support it wherever we see it.

While we are on the subject of extremism, will the Home Secretary update the House on the whereabouts of the two control order suspects who escaped following her decision, and the Prime Minister’s decision, to remove the relocation power in the previous regime, which had prevented abscondences for many years? Does she know where those suspects are, and do they still pose a threat to the public?

The Home Secretary has sought to blame the courts for chipping away at the previous regime, but she cannot escape the fact that it was a deliberate decision by her and her Government to increase the freedoms of these terror suspects by granting them access to technology and removing the relocation power. The former independent reviewer of terrorism legislation, Lord Carlile, said today that the lack of a relocation power was

“always going to be a vulnerability in the way TPIMs operate”.

In the wake of this latest absconsion, will she now reconsider the sunset clause in relation to the remaining TPIMs? If not, will she acknowledge that, as a result of a deliberate political decision by her Government, the rest of the suspects will be released on to the streets without supervision in a few months’ time?

I will make two comments in response to the right hon. Gentleman’s question. First, he knows full well that when TPIMs were introduced, this Government increased the funding available to the police and the Security Service for surveillance to the tune of tens of millions of pounds a year. I pointed this out in an earlier response to the shadow Home Secretary. Secondly, he referred to time limits but, as I have said, 43 people were on control orders and all of them have now exited those controls.
