Commons ChamberSome people might feel that this place can be a tad old fashioned, but the Bill makes the system that was abolished in 2011 seem almost progressive. It is not just the restoration of the previous prerogative powers; it is using statute to move to a system with even less accountability for the Executive.
Another chance is being grabbed by this Government, with all their centralising tendencies, to cut the checks and balances of Parliament and abandon any pretence of the separation of powers. There will be no role for parliamentarians, no role for the courts and no attempt to set out the kind of circumstances where the Queen could refuse a Dissolution request, such as the Lascelles principles. As a democrat, I believe it is right that an unelected monarch should not get involved. But even at that, this is such a bad position to be put in to have to overrule the bad decisions of Government. Apart from anything else, I am sure she would be too busy if she tried to deal with the bad decisions of this current Government. There is no longer a role for MPs, no place for the courts and the Queen is left as the last check. The type of circumstances where that might apply should at least be set out, rather than the business being done by a nod or a wink.
There were clearly problems with the Fixed-term Parliaments Act and I have some sympathy with the arguments to get rid of it. Most democracies can sensibly manage fixed terms, it has to be said, including the far more modern and efficient Parliament in Scotland. The approach makes perhaps for less democratic theatre, but for better long-term planning and more sensible Government decisions, which I am sure the public would welcome. However, five years is a very long time in this place. The Government party is usually chock-a-block with power-hungry schemers keen to get the knives out on their own side as quickly as possible. The official Opposition are usually far too busy chewing their own tail to bother with distractions such as actually opposing the Government. Elections can offer a temporary relief from the pain of listening to the baying mobs on the green Benches and offer a vague hope to the electorate that something better is on the horizon. It is little wonder that, outside wartime, no Parliament in the past 100 years has lasted the five-year distance.
There may be issues with the fixed-term legislation, but that does not mean we should simply throw the baby out with the bath water and give all the power to this Prime Minister to choose when and if it suits. The interests of the nations this Parliament is supposed to serve should come before the whim or ego of anyone, man or woman. It is not so much the principle of the Bill—perhaps even the most questionable clauses can be justified—but the alarm bells that are set off, as my hon. Friend the Member for Argyll and Bute (Brendan O'Hara) indicated earlier, when we look at the bigger picture: the behaviour about which all democrats should be concerned, whether it is the Government challenged on their lack of accountability or transparency, or the knee-jerk response to strip power away from those who challenge them. We saw that when the Prime Minister removed the Whip from those who simply disagreed with him—loyal Conservatives every one of them. We saw it when they illegally prorogued Parliament and in the Miller-Cherry case established by the Supreme Court. Now we see it in the ouster clause making it clear that any potential questioning of the Executive through the courts will no longer be tolerated. No wonder we on the SNP Benches are suspicious of the Government’s motives. This comes at a time when there is a systematic weakening of judicial review under way and the public are having their fundamental rights to protest curbed.
We have seen evidence of the same worrying approach to challenge when it comes to the Electoral Commission. The UK Government seem determined to strip powers from the watchdog that oversees elections and ensures the integrity and transparency of party election finance. Given the very real threats to our democracy from systematic disinformation and the election-changing influences of dark money, it is very clear that this independence is needed more now than ever before, rather than being watered down. Yet at this fragile time for our structures, the Government are choosing to remove the Electoral Commission’s powers to prosecute.
It might be a coincidence, and I am certainly willing to hear arguments for that case, but that proposal was brought forward just shortly after an investigation into donors who helped the current Prime Minister to buy wallpaper. It might just be chance, or it might not be—who knows? When these things are all added together, it leads to a perception that backs up the case to give us real suspicion as to the motives behind this Bill. Then we look at the issues around those who happen to be friends or have donated money—the donors and colleagues. Perhaps the Government could do a bit more to restore trust and faith in democracy than simply taking more power into the Executive. There are unanswered questions that still sit and fester and give no confidence to the public.
Where we are just now, it seems that this Government have given up on democracy altogether. It looks as though a stash of cash and a vested interest or two, or the right school tie, is what is needed to get into the corridors of power, and it stinks. As an excuse for bypassing democracy, the Prime Minister says that he wants to “get things done”, but so do many people around the world whom this place would often seriously challenge. Getting things right might take a little bit more time, but it stops the cronyism, corruption and rotting at the heart of any democratic structure.
The problems that caused the paralysis in 2019 were not the fault of the Fixed-term Parliaments Act; they were the fault of an intransigent Government. It is like a bad workperson blaming their tools. We may have left the EU, but the tricky questions were still there to be dealt with. They were pushed away for another day because the answers could not be found. Brexit was just steamrollered through without a care for the consequences, which continue to manifest themselves in ordinary lives even today. No doubt when things get too difficult we will see a familiar picture of another Tory leader running for the hills with their and their cronies’ wealth secured and the important numbers in their pockets in case they want to take up expensive lobbying jobs. Meanwhile, we still do not know how to square the circle of having no trade border with the EU, while having secured the right to dump all the EU’s standards for trade. Nor are we getting the chance to scrutinise properly decisions taken in rushed, desperate-looking trade deals with countries such as Australia that will change the face of farming in this country.
While I agree that there needs to be change to the electoral processes, the changes need to be in the opposite direction to that taken by this Government. We need greater openness, more transparency, more power for Parliament and independent watchdogs, including the judiciary, and more chances to hold the Executive to account. It is ironic that the Government accuse my party of being obsessed with the constitution when in reality they have been endlessly tinkering with the constitutional structures since coming to power. We in the SNP have a cause to improve active participation of all citizens in Scotland, and active engagement with the electorate has got to be a part of that process. That is a long campaign that I certainly have no issues with, because actually engaging with the electorate gives a better understanding and makes sure that all can be better informed.
Elements of this Bill are just a small but symbolic part of the centralising tendencies that continue to dominate under the opaque nature of this Government. If this is the route that Westminster wishes to take, I and my colleagues in the SNP cannot stand by and watch as the Government continue to attack and undermine democracy. I recognise that both the Conservative and Labour parties had the intention to repeal the Fixed-term Parliaments Act in their manifestos, but that does not mean at any cost. As the Government travel further from democracy, we will stand as defenders of that democracy and respect the democratic decisions of the people we represent. The Scottish Government and the Scottish Parliament have a clear mandate for a referendum on the future of our country, to take place during this electoral term, and if the Fixed-term Parliaments Act is repealed in this way, that could come sooner than expected.

We have not lost opportunities to Europe’s markets through Brexit.

Commons ChamberMy hon. Friend never gets it wrong, and he is right. It is there in the withdrawal agreement and in the protocol that we accept the acquis in a specific number of areas in Northern Ireland. That is part of the withdrawal agreement, which was signed before the general election, and which many, though not all, Members of this House supported. It was also in the Conservative manifesto. Of course there were understandable concerns that the way in which the protocol applied would mean that we would face tariffs and other restrictions. The agreement that we have concluded means that that will not be the case. The UK will leave and Northern Ireland will be capable of benefiting from trade deals that we do as a result of Brexit; it will also be outside the common agricultural policy and it will benefit from the Australian-style points-based immigration system that applies across the UK.
While the Minister is telling Northern Ireland that it can have the best of both worlds, he is using the same reasoning to tell Scotland, “Shut up and get back in your box,” all the while claiming that any negative impacts are not Brexit-related. Perhaps he has now become the Government’s very own Bart Simpson, causing chaos in presenting their agenda regardless of cost while claiming, “I didn’t do it. Nobody saw me do it. You can’t prove anything.”
The Simpsons character I most remembered was Groundskeeper Willie, because he is an Aberdonian. [Interruption.] I am not sure what his position is on independence, but as jannies go, he is certainly one of the best. To the hon. Gentleman’s point, Scotland does have the best of both worlds. It has a devolved Administration in Holyrood and representation by great MPs such as himself here in Westminster.

The Prime Minister has outlined his ambition for a space control to secure space launch capability from the UK, but concerns have been raised by some in the UK-based space industry about the recently published US-UK technology safeguards agreement, which has not yet been scrutinised by this place. What guarantee can the Prime Minister give the UK-based industry that it will be central to any space programme, and will he meet me to discuss this in more detail?
The hon. Gentleman raises an important and interesting issue. I will do my best to ensure that his concerns are addressed and that the House is able to look at all the technology safeguard measures that we are putting in place. That is obviously right.

Commons ChamberI can certainly confirm that we are going ahead with Northern Powerhouse Rail. In addition, I can tell my hon. Friend that Cheadle will receive at least £500,000 from the towns fund to support the local high street and the local community.
I am grateful to the hon. Gentleman. I think that he is raising the 1983 miners’ strike—or the early 1980s at any rate. I would be obliged to him if he could send me further particulars of his concerns, which I will do my best to address.

Commons ChamberMy right hon. Friend is absolutely right about the vital importance of childcare. We also need to ensure that the flexible working practices that have developed during this covid crisis are available to both women and men following the crisis. We are making sure that educational settings are open as soon as possible. More than 90% of nursery schools and colleges were open on 4 June, and I am working very closely with the Secretary of State for Education and his Ministers to ensure that we reform childcare and make more places available.
No one should face discrimination. Individual Departments and their Ministers must take account of the equality impact of their policies, and I can assure the House that my ministerial colleagues take this very seriously. Across the whole of Government, we have already taken significant steps to tackle the sorts of concerns raised by the Black Lives Matter movement, including continuing to act on the Lammy report, working to improve trust between citizens and police forces and ensuring that record numbers of ethnic minority people continue to go to university.
Over the past two weeks, we have heard members of the Government, including the Prime Minister, repeat that black lives matter, yet their policies fail to reflect that. The Unity Project’s report presented the Home Office with evidence that the “no recourse to public funds” policy discriminates against black British children and leaves them growing up in poverty. What steps can the Minister take to protect black, Asian and minority ethnic groups, and black people in particular, against further discrimination to ensure that the UK Government’s words are matched by their actions?
I thank the hon. Gentleman for his question. The issue of no recourse to public funds has been raised multiple times, and the Government are doing many things to tackle situations in which people who may not necessarily have been able to access public funds are able to do so. For example, the Government are ensuring that anyone who needs NHS treatment is not being charged, and programmes such as the coronavirus job retention scheme are available to people who have no recourse to public funds.

Commons ChamberI want to start by echoing a number of comments in commending the Chancellor on what was not an easy position to find himself in, only elevated to the role a couple of weeks ago and having to compose a Budget in the face of the coronavirus and the fast-moving changes coming off the back of it, topped off with the fact that it is debatable how much say he had in it—Dominic Cummings has done a grand job in pulling this together at such short notice.
There is a limit to the levers that can be pulled to prevent the economic damage that we are braced for from this viral outbreak. Preparations to save people’s lives must clearly be the first priority in any situation, but coronavirus is not the only crisis looming. There are many others of an entirely self-inflicted nature for which this Government are very poorly prepared. The good news is that they can be stopped by some simple changes of policy direction, and we on the SNP Benches are always happy to offer suggestions for a better way forward.
I want to begin with the areas that this Budget has been silent on or has missed. Certainly, the first and foremost of these for my constituents in Midlothian who have been in contact with me is this: what about the WASPI women? They are still waiting for justice, having lost years of expected pension without sufficient warning from the Government at the time. The SNP has previously demonstrated how the promise to the 1950s women could be honoured, and at a far lower price tag than pet projects such as HS2, where endless billions have been found to dig the Government deeper into the hole they have created. To borrow a phrase from the Chancellor, “Come on, Chancellor, just get it done!”
The Tories claim to be the party of business, but I suspect their interests lie more with the multi-millionaires and the multinationals, for this Budget does nothing for the small businesses that are the lifeblood of my constituency of Midlothian. Life is being made more and more difficult by ill thought out policies such as the IR35 reforms, which could badly damage or close down the businesses of contractors and freelancers.
While I welcome some of the steps outlined to tackle more of the promoters of tax schemes, as usual the little guys and gals are merely collateral damage. They are left out of pocket, while those who seek to avoid paying their dues will no doubt carry on with impunity. We do not even need to look for evidence of this, as we know that so far not one single promoter of a loan charge scheme has been prosecuted, while countless individuals, who were simply following the advice and guidance available at the time, are left ruined.
As if that was not enough, there is the ongoing drama of the blind Brexit alley the Government have led us down. We have had industry experts across a whole range of sectors in Scotland—hospitality, tourism, food and farming, health and social care, manufacturing—all lining up to say how devastating the new immigration plans will be. What sort of Government would deliberately and wilfully fly in the face of all the evidence, and take measures that will drive down economic growth? They are certainly not a Government I would vote for.
While some Conservative Members would describe the immigration proposals as their most popular policy, it is certainly not in my country. The Scottish Government have offered the sensible, evidence-based solution of a Scottish visa, which could protect the economy from this vandalism, while allowing the rest of the UK to continue to shoot itself in the foot if it so chooses. It is disappointing that the Government have refused even to give this plan respectful consideration. Scotland is fed up with having damaging Tory policies inflicted on it against our democratic will. Even Scottish Tories, by all accounts, are fed up with it.
We are also fed up with having promises made and promises swiftly dropped, the defence estate review being just another example. In 2013, we were told by Philip Hammond that we would get more than our fair share—that Scotland would get its fair share of military bases, with a promise of 12,500 personnel by 2020. Instead, the numbers have dropped from 10,600 in 2013 to 9,680 now. We also have no surface warships or bases in Scotland, despite 60% of maritime territory being in Scottish waters, and eight Scottish bases are confirmed for closure, including the Glencorse barracks at Penicuik in my constituency. It cannot be right that there is no money for the personnel and the bases that we need, while £2.26 billion is wasted annually on Trident—that immoral, useless virility symbol, which a majority of the Scottish people do not want on our shores. It is time the Government took the decision to rid us of these weapons of mass destruction and to scrap the £200 billion replacement plans, rather than the continued nuclear willy waving.
This Government had a real opportunity today to set out an agenda for change. This was an opportunity to look to support those who need a little extra help, to reach out and give a helping hand to the most vulnerable in our communities and to recognise that, after a decade of Tory austerity, we need to invest to grow the economy. But, sadly, as is too often the way with Tory Governments over the years, they look for a way to abandon the rest of us and look out for their own. Perhaps this explains why Scotland has resoundingly rejected their ideological position consistently, in election after election, for almost 70 years.
To conclude, while we must do all we can to prepare for coronavirus, there are many more threats to the wellbeing of the Scottish people and our economy, and they are coming from the skewed policy priorities of this UK Government. When a Government refuse to listen and impose policies that are against the best interests of the people they are supposed to serve, it is time for change, and it is time for Scotland to choose our own path.

Commons ChamberI am absolutely confident that the hon. Lady is a close reader of all parliamentary questions that are answered in this House, and she will know that we have already answered that question on the record. Those who are elected to office will be able to serve their full term, including those elected before 2020. As I say, I am repeating my answer to an earlier parliamentary questions so the House is clear that EU citizens will be able to vote and stand in the May elections.
The code of conduct for special advisers clearly outlines the standards of behaviour and conduct required of special advisers throughout their appointment. Where it may be suspected that an individual has failed to meet those standards, agreed disciplinary processes are carried out in line with the terms of the model contract for special advisers.
The code of conduct says that special advisers must not involve themselves with controversy. After calling for weirdos, misfits and “PJ Masks”, Dominic Cummings hired someone who has promoted eugenics. How is that acceptable?
There is little to add to what the Prime Minister said on this matter yesterday, which is that those views of Mr Sabisky have no place in this Government. Mr Sabisky has left the employment of the Government, and I do not think there is more to be said on the matter other than that they are not my views either.
Next week, we will start negotiations with the EU on our future relationship, and I will shortly make a statement to the House on our approach. Whatever the outcome of the negotiations, the transition period will end at the end of this year. We are working closely with businesses and border groups on preparations for the end of the transition period, and I will be meeting representatives from our ports, freight and haulage sectors later today.
I take this opportunity to welcome to the Front Bench my strengthened and hugely talented ministerial team. I look forward to working with them to deliver on our priorities in the months ahead: overseeing the transition period, strengthening the integrity of our precious Union, ensuring that our constitution is fit for the 21st century, and reforming our civil service and public sector in line with the people’s priorities.
The SNP Scottish Government’s groundbreaking legislation ensures that everyone who chooses to make their home in Scotland, including refugees and EU citizens, can vote. That follows up on the enabling of votes at 16, which the Government here continue to oppose. Will the Minister now look to follow the lead of the Scottish Government and Scottish Parliament towards a more inclusive democracy, or have this Government given up entirely on democracy?
I am grateful to the hon. Gentleman for outlining the approach to the franchise that the Scottish Government take, but one of the most important lessons that democracy teaches us is that we must respect votes. Of course, Scotland voted to remain part of the United Kingdom in the referendum in 2014, and I am afraid his party still refuses to acknowledge the legitimacy of that referendum.

I can tell him that there will be a decision on HS2 very shortly, if he can just contain his impatience a little bit longer.
Nothing in withdrawal from the EU stops UK students being able to pursue their hopes, their dreams around the whole of the European Union, and we will ensure that that is the case.

Commons ChamberThe Prime Minister told us that Brexit meant Brexit. Now that the Scottish Parliament has voted for a second Scottish independence referendum, will she realise and acknowledge that Scotref means Scotref, and agree to any section 30 application?
If we are to make a success of Brexit, we will all need to pull together at this time to ensure that we get the best possible deal for the United Kingdom. Of course, Scotland voted in September 2014 to remain a member of the United Kingdom.
