Commons ChamberI am very grateful to the hon. and gallant Gentleman, and I completely agree with his analysis. It is absolutely right that we take this opportunity to pay tribute to those who served, and of course in particular to those who sacrificed.
While, of course, we will never forget those who fell in the service of our country, we should also tonight remember the 5,791 members of our armed forces who were injured in the course of their service on Telic. Some recovered quickly and fully, returning to service. Others, however, still live with their injuries. Some are physical and visible, but others sustained mental injuries that are less visible, but no less severe. We must support them all, because we owe them a debt of gratitude—a debt of gratitude that must be paid in full. So it is vital that, in this place, we work together for injured veterans of Telic, and of all conflicts, to ensure that we do right by them.
It is absolutely right that we reflect tonight, 20 years on, on the courage, hardship and loss of those who served, and in particular the families that lost loved ones who did not come home. The Iraq war still casts a long shadow over so many lives, and on decisions being made today. History will continue to review why it happened, but the truth of what happened—the experiences of those who stepped forward—will always endure. The legacy of Iraq should not lock us into inaction; it must spur us to look our recent past in the eye, learn from it and be better. It is our sombre duty never to forget and to commemorate milestones such as this, as, after every conflict, time can be the greatest unraveller of our collective memory. Time is also a privilege of the living, and out of reach for the 179 who fell in Iraq. They have taken their place in a long line of others who came before and follow after them—the fallen. While we grow old, they cannot, and while we remember, they cannot, so we will remember them today, 20 years on, and forever more. Thank you for your service.

Commons ChamberWith the leave of the House, I will briefly respond to what has been an extremely useful and constructive debate, at the end of what, according to any metric, has been quite a long week in this place.
There have been some outstanding contributions from Members today. Everyone who spoke added real value to the debate, and I am incredibly grateful to all of them. I also thank the EHRC, the TUC, the Royal College of Midwives, Unison, the Fawcett Society and the Chartered Institute of Personnel and Development, not just for their invaluable support for the Bill but for the important work that they do. Let me, in particular, thank the Minister, who has been remarkably helpful, as was the previous Minister, as was the shadow Minister, and as have been the officials at the Department for Business, Energy and Industrial Strategy, the Clerks, and my very small team in Parliament, Richard Mitchell and Alex Foy, for all the hard work that has gone into the Bill.
As I have said, this has been an extremely useful debate. A huge number of important points have been made—too many to mention. I think it has been acknowledged that the Bill is timely. We all know that our constituents are facing a cost of living crisis, so this is the right moment at which to introduce such legislation. We should of course recognise the pain and suffering of those who have had to endure the hardship of unfair dismissal.
There has been general agreement on the fact that raising a family is a difficult, though important, job, but it is made much more difficult when people have to face discrimination in the workplace. I pay tribute to all who have been fighting that discrimination, including the extraordinary women who are fighting for justice in the courts. I also pay tribute to organisations such as Pregnant Then Screwed and Maternity Action for their dedicated work to protect and enhance the rights of pregnant women.
Whatever happens today, it will still be too late for Emily, Natasha and Sarah, but, as the Minister rightly said a moment ago, their contribution to this process has been incredibly valuable. I hope that they, and all the other people who have been affected, will take some comfort from knowing that they have contributed to—hopefully—a change in the law that will help to give more than 50,000 women a year the security of returning to their job after taking maternity leave. I ask the House to support the Bill.

It is a pleasure to follow the hon. Member for Basildon and Billericay (Mr Baron). I should declare an interest, as a veteran of Operation Banner.
I will speak as briefly as I can, because I want to give as many other Members as possible an opportunity to speak. Let me begin by saying that the Bill is one of the most controversial pieces of legislation that I have been asked to consider during my time in the House. I do not doubt the sincerity of the Government’s intentions, and I completely understand how complex and difficult this issue is, but if passed in its current form the Bill will mean that those who are guilty of kidnap, torture and murder will never see the inside of a courtroom or a prison, or even, for that matter, be subject to a proper investigation. Indeed, they will not even need to say sorry to be granted immunity for their crimes.
Members have rightly focused today on the impact that the Bill will have on victims. As has already been observed, many of the victims were members of our armed forces, and it is this cohort on whose behalf I want to speak, very briefly, this evening. I know that many of their loved ones and comrades will be watching this with great interest. They will know that 722 UK service personnel were killed in paramilitary attacks while serving on Operation Banner. A freedom of information request to the PSNI from the Centre for Military Justice just this month revealed that it still had 202 unsolved cases of victims who were members of the armed forces and a further 23 cases where the victim was a veteran. That is 225 unsolved alleged murders where the victim was someone who had stepped forward and put themselves in harm’s way to serve our country. Behind every one of those 225 cases is a story of enduring pain caused by the absence of truth and justice.
One of those stories began on 11 August 1971 outside the Corpus Christi church in west Belfast, when a joiner by the name of John McKerr fell to the ground after being shot by a single bullet to the head. John’s family only found out he had been hurt from a newspaper report the following day after he failed to return home from work. He was labelled a member of the IRA. A little over a week later he died of his injuries in hospital, becoming one of the 10 victims of the Ballymurphy massacre. For half a century, John’s family were forced to live under a cloud not just of distress but of deception.
On 11 May last year, Mrs Justice Keegan published the findings of her inquest into the Ballymurphy killings, confirming what John’s loved ones had always known to be true: John was unarmed and not doing anything that could have caused a threat. He had no associations with the IRA. In fact, John had lost his right hand while serving in the British Army in the second world war. His daughter said:
“The only thing he belonged to was the British Legion.”
In the words of the coroner:
“He was an entirely innocent man who was indiscriminately shot on the street.”
The inquest at least removed the stain on John’s character, but it is worth noting that under the Government’s proposals, inquests will be brought to an end, meaning that others will not have the same access to the truth as John’s loved ones. After more than 50 years, the McKerr family still do not know who was responsible for his murder. John sacrificed so that we could be free, but he was shot in the head and left in the street to die. The response of the institution he once proudly served was to tarnish him as a terrorist. John McKerr’s family told the inquest that their objective was not punishment but truth. It is in that spirit that I urge the Minister to consider the merits of amendment 115, about which there has been much debate, and also amendment 111. Strengthening reviews in line with the standards set by Operation Kenova will at least provide the families of members of the armed forces killed during the troubles with a degree of truth and justice.
There is deep unease in the service community about the Government’s proposals, not least from the family of Private Tony Harrison, a soldier from 3 Para who was brutally murdered by the IRA in front of his fiancée and his fiancée’s family. One of those involved has admitted his involvement, but no one directly responsible for his killing has been investigated. We owe John McKerr, Tony Harrison and all those who perished a debt. We can start to repay that debt by giving their families the dignity of knowing what happened to their loved ones. As it stands, the Bill will not afford them any comfort. It will only compound their misery, and for that reason I cannot support it.

Commons ChamberIt is a pleasure to be called to speak in this debate, Mr Deputy Speaker, and I am pleased that other hon. Members intend to make a contribution.
The Government talk a lot about levelling up and there can be few more important elements of that agenda than transport. It is critical if we want to grow our national economy or cut our national carbon emissions. It is critical if we want to heal the growing inequality, division and disillusionment that are tearing at the fabric of our country. However, this is not just an agenda for the north; it is an agenda for the whole of the UK—one we should be able to collaborate on constructively, no matter what our party. But it is also an agenda that demands action, not words. The change we need will not come with half measures.
Of course, right now, all our transport is reeling from the impact of covid, so the first ask of Government is to ensure that support is sustained until passenger numbers and confidence recover. Cutting back too soon would force urgent cuts to services, needlessly deepening the hole that we need to climb out of. I know that the Minister takes these matters very seriously, and I am sure—and certainly hope—that he agrees that any such cuts would be very short-sighted.
However, our goal has to be so much more than survival, and nowhere is there more potential or more need for ambition than with our buses. They have suffered from decades of ideological neglect—a perfect example of free market fundamentalism—but they are the backbone of our public transport and the most realistic place to look for the quick results we need on decarbonisation, congestion and inclusion. The only appropriate ambition for our buses is a truly world-class service, and that is what I am working to achieve in South Yorkshire. That ambition means a rapid shift to a zero carbon fleet. It means affordable, flexible fares. It means routes and frequencies that genuinely serve all our communities, and it means buses integrated into a coherent regional system, with seamless connections across every mode. If the Netherlands can do it, why cannot we? If we build a system that works, people will use it, but that, of course, needs funding.
I am genuinely pleased that we now have a national bus strategy. It is a welcome recognition of the utter failure of deregulation but, so far, it is long on aspiration and short on detail, with no clarity yet over how 85% of the promised £3 billion will be spent, or how much of it will reach places such as South Yorkshire. The Government’s ZEBRA—zero emission bus regional area—funding for electric buses similarly sounds great, but it is a competitive pot that will cover only a handful of areas across the whole country. Central revenue funding for bus services was slashed by almost 20% between 2009 and 2018 and is an unbelievable 15 times lower per head in Sheffield than it is in London. Three billion pounds sounds quite a lot, but it is a fraction of what is needed to repair the damage. If the Government are serious about change, we need to have adequate, long-term and reliable funding.
The issue with buses is not just funding, but structure and ownership. Deregulation has been disastrous, so the Government must give Mayors and local government leaders not just the freedom, but the support to make bolder changes, such as moving to franchising, if that is needed, in order to have the control, integration and value for money that a world-class service demands.
We need a similar ambition for our trams. Supertram is a great, zero-emission success in Sheffield but, after 30 years, it needs funding for renewal and improvements such as extending our groundbreaking tram-train services. Meanwhile, there is enormous untapped potential for similar systems in other northern regions such as West Yorkshire.
Active travel must be another central priority for northern transport. It helps people to live healthier lives, supports more pleasant and connected communities and gets cars off the road. It reduces carbon emissions and other air pollution, and is accessible to people on lower incomes. That is why, in South Yorkshire, we are investing more than £100 million in it over the next two years and are working with the Government to do still more. But we need that sort of investment right across the north. We also need to electrify all road transport, not just our buses. The Government have a critical role in encouraging a wide network of charging points, but the rate of installation is currently just a fifth of what it needs to be to meet the UK’s climate goals. The modest means available betray the grand aspiration.
The role of central Government is especially critical in rail. High Speed 2 has dominated much of that debate but, for me, faster rail journeys to London are a distinctly secondary contribution to levelling up. My first priority is transport within my region—the sort that gets people to work and the shops every day—and then the transport between the cities and towns of the north, especially Northern Powerhouse Rail. HS2 makes sense because it promises to enable those things but, if it undermines them instead, it deeply compromises its claim to be part of levelling up.
Like other northern leaders, I am hugely concerned that the Government are considering delaying or cutting corners with NPR, or combining it with the trans-Pennine upgrade to help pay for HS2. The Minister has been supportive in the past and I hope that he will reassure me today that that is not the case.
Equally concerning is the possibility that HS2 East through Sheffield and Leeds could be postponed. Not only would that make HS2 meaningless in terms of levelling up for a huge swathe of the north, including some of its most deprived areas, but it would jeopardise NPR and local transport investment around Sheffield. It would be the worst of all worlds.
Therefore, if the Government are serious about HS2 being a project for the north, they should build phase 2 in its entirety, on time, while doing the same for NPR, Midlands Engine Rail and other supporting works. That might sound like quite a lot to ask, but having embarked on HS2 with a promise that it would not come at the cost of northern regional rail renewal, the Government cannot now propose half measures.
The full impact of HS2 and NPR is more than a decade away, so the Government can and must move decisively to level up northern rail now. Across the region, there are smaller-scale investments that can have an outsized impact. We have set out the case for early investment in midland main line electrification up to Sheffield and the work between Sheffield and Clayton Junction to deliver an HS2 and NPR-ready section within 10 years. I hope that the Minister will agree that that should be prioritised, irrespective of when HS2 East goes ahead.
The works to improve the Manchester central corridor will have benefits across the north of England. A rail link from Doncaster Sheffield Airport would unlock the huge potential of GatewayEast. Simply getting on with the endlessly delayed electrification of our existing lines would give a major boost not just to decarbonisation, but to simplified rail operations and high-skilled jobs. Instead, we are left fighting service reductions, like the potential suspension of direct trains from Sheffield to Manchester Airport. The lack of a direct link to a major airport 45 miles away is just not compatible with any serious ambition for our railways.
Amid all the talk of renewal, the Government are cutting Network Rail’s enhancement budget by £1 billion and have slashed the operating budget for Transport for the North. The just published Williams review is a welcome, if so far incomplete, admission of the failures of privatisation and the need for a single strategic body for rail. However, it still runs the risk of putting profits ahead of passengers and leaves major questions unanswered, notably on the structure of our railways and decarbonisation.
Over the decade to 2019, the north received barely 40% of the per capita public spending on transport that went to London. That is a huge gap to make up, but it is not just about the money; it is also about how things are done. To succeed, transformation needs to happen in partnership with—and where possible, led by—local government. We need stronger local and regional devolution, including a northern transport budget and an end to piecemeal competitive funding pots, so that we can plan for the long term and reshape our transport systems as a coherent whole.
We need a transport strategy defined not just by greater investment but by a compelling vision for the sort of society we want to build in the north and beyond, with liveable communities, affordable transport and a rapid and just transition from fossil fuels. With the greatest respect to the Minister, whose sincerity and hard work I have seen on countless occasions, I do not believe that the Government yet have that vision. I want to acknowledge, though, the positive moves they have made, not least the providing of emergency covid support, and I am grateful for the investment that we have been able to secure in South Yorkshire recently. But if you have committed yourself to transformation, there are no prizes for good work at the margins. The Government’s talk about levelling up conceals a much meaner reality. From HS2 to TfN to buses, the investment does not yet match the fundamental change that I think we all want to see.
To conclude, the transformation of northern transport is the right goal. Our economy demands it, our environment demands it, our people demand it and basic fairness demands it. I want to work together with the Minister and the Government to ensure that we achieve it, but that means that words alone will not do. Promises alone will not do. A low-balled, scattergun investment will not do. If the Government talk about transformation, they need to act like they mean it.

Commons ChamberOur withdrawal from the EU, the rise of China and the threat posed by Russia has meant that the strategic context in which our armed forces operate has shifted hugely in the decade since I left. The professionalism, resilience and adaptability of those who still serve has not. The Defence Command Paper rightly describes our servicemen and women as “our finest asset”. It is therefore incongruous for the Government to be stripping back the British Army to a level not seen for 300 years.
While the number of service personnel is set to reduce, it appears that what they are expected to achieve will not. The integrated review does not suggest that we will draw down on any of our commitments. The UK will remain the leading European partner in NATO and maintain our responsibilities in the middle east and Africa, while at the same time expanding our role in the Indo-Pacific. In my experience, trying to do more with less rarely works. When the Prime Minister pledged to maintain the size of our armed forces, he was right to do so. We are now being told that size no longer matters because the threat has changed, but as I put to the Secretary of State last month, if the threat has changed so much, so quickly, what is to say that it will not change again? In response, I was told that any future proposals to increase manning would be supported, but of course, it is not that simple.
Retaining talent is far easier and more inexpensive than recruiting it—a principle that is especially true when applied to our service personnel. We would do well to remember that technology evolves; the one thing that remains constant is people. We should also remember that our people are among the very best in the world. They are our ultimate insurance policy. Recent history is littered with examples, from Vietnam to Afghanistan, when technological superiority did not bring about success. Kit and equipment will never be an adequate substitute for strategy and leadership.
To conclude, following the collapse of the Soviet Union, leaders and experts predicted a new period of global peace and prosperity that never materialised. Thirty years on, the world is now more complex, more dangerous and more unpredictable. No one can say with any confidence what it will look like in another 30 years. We live in uncertain times. There are no easy answers, only difficult questions, but now more than ever, Britain must aspire to show leadership. Cutting the one thing that, above all else, gives us our edge—our people—will be to the detriment of our national security and our standing in the world. This decision is short-sighted—

Thank you, Mr Deputy Speaker. It is a pleasure to be called in this debate—and hopefully to be heard.
From tomorrow, as we have heard, changes to the organ donation system following the implementation of the Organ Donation (Deemed Consent) Act 2019, more commonly known as Max and Keira’s law, come into effect. This means that every adult in England will be considered to be a donor unless they opt out or are excluded. This new law has the potential to save hundreds of lives every year. For all those desperately waiting for a transplant, the efficacy of these changes is literally a matter of life and death. We owe it to them to ensure that it is a success.
I would like briefly to pay tribute to the constructive spirit in which the Government approached the Bill from the outset, and to all those without whom the campaign to change the law would not have succeeded. First and foremost, my friend and former colleague Geoffrey Robinson, formerly of this parish, showed real leadership in promoting the Bill from the outset. The former Health Minister, the hon. Member for Thurrock (Jackie Doyle-Price), was brilliant throughout the passage of the Bill, as were the right hon. Members for Maidenhead (Mrs May) and for South West Surrey (Jeremy Hunt), my right hon. Friend the Member for Islington North (Jeremy Corbyn), the current Secretary of State, and Lord Hunt of Kings Heath. Alison Phillips, the editor of the Daily Mirror, and her fantastic team also championed this cause and very helpfully raised public awareness. Kidney Care UK provided outstanding support during the campaign and continues to provide outstanding support to ensure that Max and Keira’s law will be a success.
Most of all, though, I would like to thank Max Johnson, his mother Emma, and the family of Keira Ball. For those who may not be familiar with it, as stories go there are few more powerful than Max and Keira’s. Keira Ball was nine years old when, tragically, she died. Despite the unimaginable grief, Keira’s parents bravely and selflessly chose to donate her organs, including her heart, to a young boy, Max Johnson, who was in urgent need of a transplant. Max recovered from his operation and has been a tireless champion of the new opt-out system for organ donation. Tomorrow will be a very special day for many people, but for Max it will be especially poignant.
I am extremely proud to have worked with Geoffrey and with others to take Max and Keira’s law through Parliament. I would like briefly to reflect on the reasons I believe that it is so important. First and foremost, this law is about saving lives. We are all, I know, extremely grateful for the outstanding job that NHS Blood and Transplant does. In the year to this April, there were 3,763 organ transplants from deceased donors, in addition to 970 living donations. Yet despite the incredible efforts made, demand for organs heavily outweighs supply. Last year, as the Minister reflected on, more than 400 people died while waiting for a transplant and hundreds more were suspended from the waiting list after becoming too ill to undergo the operation they so desperately needed. There are currently about 5,000 people in the UK who, just like Max was, are living under a cloud of uncertainty, waiting and hoping for an operation that will save their life.
One of the many devastating knock-on consequences of the coronavirus crisis is the impact it has had on those in need of an organ transplant. Operations have been postponed and the number of people dying while waiting for a transplant has sharply risen. The coronavirus is putting huge extra strain on a system already under pressure.
As well as offering hope to families, I believe that Max and Keira’s law will also benefit society by helping to bring people together. The decision that Keira’s parents took was an act of compassion that represents the best of humanity—a lesson in solidarity from which we can all learn. We must be mindful, however, that the new organ donation system will not in itself be a silver- bullet solution. We all still need to play our part. We know that this law will improve the consent rate. The devolved Government in Wales introduced their opt-out system in December 2015. The result was stark: Wales now has the highest consent rate of any UK nation at 77%, up from 58% five years ago.
However, if we are going to make a success of the new system, NHS Blood and Transplant will require additional capacity to deal with an increase in donors. That means that the Government must ensure that our NHS trusts have the resources they need to perform the operations, to support the donors and their families, and to care for the patients after their transplants.
This also includes the medical staff, so they understand the new system and encourage bereaved families to talk, understand and support their loved one’s wishes. The Government must also maintain their support for the public awareness campaign, so that the changes are widely understood and everybody knows that the choice to donate is still yours to make. Donors should know that they will be treated with dignity and respect, and the family of the deceased will still be involved.
I am very aware of the Department of Health and Social Care’s work, including with the National Black, Asian and Minority Ethnic Transplant Alliance and the launch of the community investment scheme, but it is essential that we continue to direct our efforts into BAME communities, which are often most affected. Nearly a third of those on the active transplant list are from black, Asian or ethnic minority backgrounds, and it is members of that community who also wait longer for operations. Improving education and raising awareness is important so that everyone has an equal chance, regardless of their ethnicity, of having a life-saving transplant.
We also all have a responsibility to record our choice on the NHS’s organ donor register and, crucially, to tell our loved ones what our intentions are. The coronavirus has left thousands of families in mourning, shattered our economy and upended our entire way of life. Good news is in short supply, but the implementation of Max and Keira’s law affords us a rare glimmer of hope—the hope that more lives will be saved and the hope that we, too, can act with decency and empathy, even in the worst of times. Thank you to all those who made it happen.

Commons ChamberIn South Yorkshire, where I am also the Mayor, the coronavirus has infected more than 4,500 people and, tragically, killed 576 people. My thoughts are with all of those who have suffered and lost, and those who are doing so much to keep our people safe and our society functioning. I will always seek to work constructively with the Government, but we do have a duty to test their policies and to hold them to account. One of their most crucial tasks is to keep the confidence of the British people, and without clarity, we will fail. So I have four immediate concerns.
The first is that “Stay alert” is vague compared with “Stay at home”. I am glad that the Prime Minister provided more detail today, but many people will still be confused, and confusion risks contagion. Secondly, we cannot ask people to go back to work if they cannot get there safely. Social distancing means much lower capacity on our public transport systems, and a switch to cars would mean instant gridlock. That means that getting people to walk and cycle is central to easing the lockdown. To be fair, the Government seem to understand that, but we urgently need to translate that into action together.
Thirdly, we cannot force people back to an unsafe workplace. The Government must monitor and support businesses to implement rigorous protective measures, in close collaboration with employees and unions. Until that is done, those workers should remain furloughed. Fourthly, the Government must be careful not to create suspicion, justified or not, that they are motivated by any concern other than fighting the disease. Things such as testing targets that are met just on the one day needed to avoid negative headlines inevitably undermine that vital public trust; this is no time for politics as usual. So the Government must be utterly transparent about the data, the advice they are getting and the compromises they are choosing. There must be a clear line between the science and the political decisions based on it. That applies right across the UK, and the Sheffield City Region Combined Authority has led in supporting and informing local communities and businesses, in getting them the help they need and in championing their concerns at Westminster. We have kept our businesses and our light rail system running. We have lined up our local industries to supply PPE to the NHS, and we are developing a recovery plan that truly reflects local needs, but the Government must bring us in to the heart of their response, and fund and empower us accordingly.
Finally, that response must also serve a wider purpose, We clearly need massive—[Inaudible.] This is the moment for a green new deal, for fixing our crumbling infrastructure and for addressing the unacceptable inequality between our regions and nations. History will not forgive us if, as after 2008, we make such sacrifices only to see inequality grow and the planet burn ever warmer. For all our sakes, the legacy we aim for now must not be a return to the status quo; it must be a national renewal.
