Answered by Andrew Gwynne My Rt hon. Friend, the Secretary of State for Health and Social Care has been discussing the new United Kingdom-wide Tobacco and Vapes Bill with Neil Gray, the Cabinet Secretary for Health and Social Care for Scotland, and will send formal correspondence prior to its introduction. As the bill covers the whole of the UK, the Department will stay in close contact with all our devolved government counterparts, throughout the passage of the bill. Department officials have engaged frequently with officials from Public Health Scotland, and the rest of the devolved governments, to help shape and develop proposals for new legislation. Each of the devolved governments, including the Scottish Government, are in support of a new and strengthened bill, and the benefits it will provide to the health of our nations. Once the bill has been introduced to the UK Parliament, the devolved governments will seek consent motions from their respective legislatures, including the Scottish Parliament. |

Answered by Gray, Neil - Cabinet Secretary for Health and Social Care The Scottish Government welcomes Audit Scotland’s report and has asked the Collaborative Response and Assurance Group (CRAG), which is co-chaired by the Scottish Government and COSLA, to come together to consider the recommendations as a whole and to develop a partnership approach to addressing them. We remain committed to reforming the Adults with Incapacity (Scotland) Act 2000, which will play a critical role in embedding this recommendation in future. The Audit Scotland report was discussed at the CRAG meeting held on 12 January with a sub-group due to meet in coming days to review all the recommendations. As such, we are not yet at a point where it is possible to provide specific deadlines or a definitive timeline for when the Group will conclude its consideration of the recommendations and report back. However, the Scottish Government will provide an update to Parliament when the Group is in a position to do so. |

As part of my consideration, I will also have a keen interest in any outcome of the judicial review ongoing in England. I did write to the MAPs Programme Board to commit to using the Leng Review as a framework for future discussions. Given this, and the agreement to a four-nations approach to the work, the views of Scotland are actively being considered through new structures that have been established by the Department of Health and Social Care and NHS England. This includes Scottish representation on a newly established Clinical Advisory Panel. |

Answered by Gray, Neil - Cabinet Secretary for Health and Social Care Scottish Government remain engaged with Health and Social Care Partnerships (HSCPs) following the insolvency of NRS Healthcare, however ultimately decision making around procurement is the responsibility of local services. Through this engagement we know that HSCPs are taking immediate steps to mitigate any disruption and ensure continuity of service delivery, this includes continuing to work with the equipment providers included in their contractual framework and by entering new contractual arrangements with other suppliers. The National Equipment and Adaptations Network provides HSCPs with a platform to discuss mitigations and share lessons learned at a national level. |

It is for Public Health Scotland (PHS) to collect outpatient, inpatient and day case activity data from hospital administrative systems. PHS publishes official statistics on cross boundary flow quarterly within its Stage of Treatment Waiting Times publications. This includes inpatient, day case, and new outpatient data. The most recent publication that includes cross boundary flow data can be accessed here: Stage of treatment waiting times - Inpatients, day cases and new outpatients 28 October 2025 - NHS waiting times - stage of treatment - Publications - Public Health Scotland. PHS’s annual Acute Hospital Activity and NHS Beds Information report includes information on cross boundary flow. Costs associated with patient travel, accommodation, subsistence and funded patient escorts are managed locally by individual NHS boards and are funded from their respective budgets. The Scottish Government does not hold this information centrally and there is currently no intention to standardise national reporting on these measures. Similarly, there are no current plans to nationalise reporting on the use of remote consultation platforms, including Near Me. The Scottish Government’s approach reflects the principle of local accountability for service delivery and associated costs. NHS boards are responsible for managing patient transfers and related expenses within their allocated budgets. National reporting is focused on treatment activity and waiting times, which are published by PHS to ensure transparency and consistency. |
