Tobacco and Vapes Bill
Asked by: Tracy Gilbert (Labour - Edinburgh North and Leith)
Thursday 25th July 2024

Question to the Department of Health and Social Care:

To ask the Secretary of State for Health and Social Care, what discussions he has had with the Scottish Government on the Tobacco and Vapes Bill.

Answered by Andrew Gwynne

My Rt hon. Friend, the Secretary of State for Health and Social Care has been discussing the new United Kingdom-wide Tobacco and Vapes Bill with Neil Gray, the Cabinet Secretary for Health and Social Care for Scotland, and will send formal correspondence prior to its introduction. As the bill covers the whole of the UK, the Department will stay in close contact with all our devolved government counterparts, throughout the passage of the bill.

Department officials have engaged frequently with officials from Public Health Scotland, and the rest of the devolved governments, to help shape and develop proposals for new legislation. Each of the devolved governments, including the Scottish Government, are in support of a new and strengthened bill, and the benefits it will provide to the health of our nations. Once the bill has been introduced to the UK Parliament, the devolved governments will seek consent motions from their respective legislatures, including the Scottish Parliament.

Question

To ask the Scottish Government, further to the answer to question S6W-42932 by Neil Gray on 21 January 2026, what it expects the accelerated timeline of the national rollout of MyCare.scot to be.

Answered by Gray, Neil - Cabinet Secretary for Health and Social Care

MyCare.scot remains on track for whole-population rollout from April 2026, with the national plan (published September 2025) setting the strategic direction. Timelines may adjust based on evidence from the initial NHS Lanarkshire launch, with further details on national scaling to follow in Spring 2026.

Question

To ask the Scottish Government, further to the answer to question S6W-42935 by Neil Gray on 20 January 2026, what timeline it has given to the Collaborative Response and Assurance group to consider the recommendations and report back to it.

Answered by Gray, Neil - Cabinet Secretary for Health and Social Care

The Scottish Government welcomes Audit Scotland’s report and has asked the Collaborative Response and Assurance Group (CRAG), which is co-chaired by the Scottish Government and COSLA, to come together to consider the recommendations as a whole and to develop a partnership approach to addressing them. We remain committed to reforming the Adults with Incapacity (Scotland) Act 2000, which will play a critical role in embedding this recommendation in future.

The Audit Scotland report was discussed at the CRAG meeting held on 12 January with a sub-group due to meet in coming days to review all the recommendations. As such, we are not yet at a point where it is possible to provide specific deadlines or a definitive timeline for when the Group will conclude its consideration of the recommendations and report back. However, the Scottish Government will provide an update to Parliament when the Group is in a position to do so.

Question

To ask the Scottish Government, further to the answer to question S6W-42936 by Neil Gray on 20 January 2026, what form this work is taking, and what the timeline is for completion.

Answered by Gray, Neil - Cabinet Secretary for Health and Social Care

The Scottish Government welcomes Audit Scotland’s report and has asked the Collaborative Response and Assurance Group, which is co-c-haired by the Scottish Government and COSLA, to come together to consider the recommendations as a whole and to develop a partnership approach to addressing them. The Scottish Government has begun this work and is engaging with key partners to discuss the delivery of Powers of Attorney and Guardianship processes.

This work is still at an early stage. As such, the form that the Group’s work will ultimately take, and the timescales for its completion, have not yet been determined. The Scottish Government will provide further updates as this work progresses.

Question

To ask the Scottish Government, further to the answer to question S6W-40575 by Neil Gray on 23 September 2025, whether it can now confirm what its position is regarding the recommendations in the independent review of the anaesthesia associate (AA) and physician associate (PA) roles in England.

Answered by Gray, Neil - Cabinet Secretary for Health and Social Care

The Scottish Government is continuing to consider the recommendations from the independent review of the AA and PA roles in England, and I await further policy and legal advice before reaching a formal position. As part of my consideration, I will also have a keen interest in any outcome of the judicial review ongoing in England.

I did write to the MAPs Programme Board to commit to using the Leng Review as a framework for future discussions. Given this, and the agreement to a four-nations approach to the work, the views of Scotland are actively being considered through new structures that have been established by the Department of Health and Social Care and NHS England. This includes Scottish representation on a newly established Clinical Advisory Panel.

Question

To ask the Scottish Government, further to the answer to question S6W-42209 by Neil Gray on 5 December 2025, what action has been taken by Health and Social Care Partnerships (HSCPs) to mitigate any disruption to the supply chain in the medium to longer term, and whether there has there been any evaluation of lessons learned as a result of the collapse of NRS Healthcare Limited.

Answered by Gray, Neil - Cabinet Secretary for Health and Social Care

Scottish Government remain engaged with Health and Social Care Partnerships (HSCPs) following the insolvency of NRS Healthcare, however ultimately decision making around procurement is the responsibility of local services.

Through this engagement we know that HSCPs are taking immediate steps to mitigate any disruption and ensure continuity of service delivery, this includes continuing to work with the equipment providers included in their contractual framework and by entering new contractual arrangements with other suppliers.

The National Equipment and Adaptations Network provides HSCPs with a platform to discuss mitigations and share lessons learned at a national level.

Scottish Government Equipment and adaptations: guidance on provision - gov.scot in 2023 and expects all Integration Authorities to take steps to implement this guidance.

The revised Good Practice Guide on Providing Community Equipment was created to support and assist local community equipment services to effectively develop, deliver, manage, and monitor their services. Decisions on how the guide is utilised is the responsibility of Integration Authorities.

S6W-42411
Asked by: Lumsden, Douglas (Scottish Conservative and Unionist Party - North East Scotland)
Tuesday 16th December 2025

Question

To ask the Scottish Government, further to the answers to questions S6W-41875, S6W-41876, S6W-41877, S6W-41879, S6W-41880, S6W-41882 and S6W-41884 by Neil Gray on 1 December 2025, what information it currently collects from NHS boards on patients who travel outwith their home board area to receive secondary or tertiary care, and whether it plans to introduce standardised national reporting on (a) patient numbers, (b) travel, accommodation and subsistence costs, (c) the use of remote consultation alternatives such as Near Me and (d) funded patient escorts, and what the reasons are for its position on this matter.

Answered by Gray, Neil - Cabinet Secretary for Health and Social Care

The Scottish Government does not collect patient data directly. It is for Public Health Scotland (PHS) to collect outpatient, inpatient and day case activity data from hospital administrative systems.

PHS publishes official statistics on cross boundary flow quarterly within its Stage of Treatment Waiting Times publications. This includes inpatient, day case, and new outpatient data. The most recent publication that includes cross boundary flow data can be accessed here: Stage of treatment waiting times - Inpatients, day cases and new outpatients 28 October 2025 - NHS waiting times - stage of treatment - Publications - Public Health Scotland.

PHS’s annual Acute Hospital Activity and NHS Beds Information report includes information on cross boundary flow. The latest publication covers the period between 1 April 2024 and 31 March 2025 and can be found here: Acute Hospital Activity and NHS Beds Information (Annual) - Publications - Public Health Scotland.

Costs associated with patient travel, accommodation, subsistence and funded patient escorts are managed locally by individual NHS boards and are funded from their respective budgets. The Scottish Government does not hold this information centrally and there is currently no intention to standardise national reporting on these measures.

Similarly, there are no current plans to nationalise reporting on the use of remote consultation platforms, including Near Me.

The Scottish Government’s approach reflects the principle of local accountability for service delivery and associated costs. NHS boards are responsible for managing patient transfers and related expenses within their allocated budgets. National reporting is focused on treatment activity and waiting times, which are published by PHS to ensure transparency and consistency.

Jackie Baillie (S6M-20731) That the Parliament is concerned that the Scottish Government is unable to state clearly that the ventilation and water systems at the Queen Elizabeth University Hospital have been validated as meeting required safety requirements; recognises that thousands of patients are treated safely and expertly cared for by NHS staff in the hospital every year; welcomes the establishment of a Safety and Public Confidence Oversight Group, and calls on the Scottish Government to set out by what date it intends to carry out the risk assessment of the hospital’s ventilation system, as recommended by the inquiry, what mitigations are currently in place to ensure that the water is safe to use, how it intends to protect at-risk patients in areas that have not been validated, and when this validation will be carried out and the documentation shared with whistleblowers and infection control. Further details available for S6M-20731 Neil Gray (S6M-20731.1) As an amendment to motion S6M-20731 in the name of Jackie Baillie (Safety of the Queen Elizabeth University Hospital), leave out from “is concerned” to end and insert “agrees that whistleblowers in Scotland’s NHS must be protected and supported; notes that NHS Assure was the body created in 2021 to improve risk management and safety in Scotland’s NHS estate; further notes that both Healthcare Improvement Scotland and independent experts have commented on the procedures now in place to ensure the safety of hospital for patients and staff; welcomes the creation of a Safety and Public Confidence Oversight Group, which will look at specific issues, including in relation to the built environment and validation; further welcomes that this group will be co-chaired by Sir Lewis Ritchie to provide additional scrutiny; agrees that Parliament must be kept updated of this group’s work, and further agrees that the chair of the independent inquiry must be given the time and space to come to his conclusions without political interference.” Further details available for S6M-20731.1 Dr Sandesh Gulhane (S6M-20731.2)  As an amendment to motion S6M-20731 in the name of Jackie Baillie (Safety of the Queen Elizabeth University Hospital), leave out from “welcomes” to “Group” and insert “expresses concern that the Safety and Public Confidence Oversight Group will be run by NHS Greater Glasgow and Clyde, in light of the lack of confidence that victims have in the NHS board; calls on the Chief Executive of NHS Greater Glasgow and Clyde to therefore stand down as co-chair of the group; urges the Scottish Government to work with the Patient Safety Commissioner to immediately strengthen protections for NHS whistleblowers; condemns the Scottish Government for its failure to tackle a culture of secrecy and denial across the NHS; admonishes the former health secretary, Shona Robison, for breaking her pledge to carry out an independent safety audit prior to the opening of the hospital; requests that Fiona McQueen appear before the Scottish Parliament to account for her reported actions in dismissing the complaints of victims”. Scottish Labour Party Debate: The Role of Political Decision Making in NHS Scandals - Main Chamber
Anas Sarwar (S6M-20561) That the Parliament condemns the culture of secrecy and cover-up that has hidden the truth from patients, families and campaigners and denied them justice in many NHS scandals in Scotland in recent years; recognises that, as the Scottish Hospitals Inquiry draws to a close, many serious questions remain regarding the decision-making process and the role of the Scottish Government; considers that political decision making should be considered by the inquiry, and calls for the Scottish Ministers to authorise the immediate full disclosure and preservation of all communications connected to the contaminated water and inadequate ventilation system and the premature opening of the Queen Elizabeth University Hospital, as well as any subsequent communications relating to the handling of the infection and its cover-up. Further details available for S6M-20561 Neil Gray (S6M-20561.1) As an amendment to motion S6M-20561 in the name of Anas Sarwar (The Role of Political Decision Making in NHS Scandals), leave out from “condemns” to end and insert “pays tribute to the brave patients, families and whistleblowers who have campaigned tirelessly for justice in the Scottish Hospitals Inquiry; recognises the pain, trauma and grief faced by patients and their families at the heart of this inquiry, and notes that the inquiry was established in 2019 to ensure that every individual impacted is able to get the truth that they deserve; notes the fundamental importance of the independence of inquiries, which are enshrined in legislation, under the control of an independent chair, and which operate transparently, reaching conclusions that are not to be influenced by ministers or other vested interests, and agrees, therefore, that the independent Scottish Hospitals Inquiry Chair must be given the time and space to consider all the available evidence.” Further details available for S6M-20561.1 Brian Whittle (S6M-20561.2) As an amendment to motion S6M-20561 in the name of Anas Sarwar (The Role of Political Decision Making in NHS Scandals), insert at end “; notes with concern the impact on patients, staff and others resulting from the ongoing questions about the safety of the Queen Elizabeth University Hospital; calls on the Scottish Government to provide clear and explicit guarantees to the public that any issues raised by patients, families and whistleblowers are listened to and fully investigated; believes that the repeated lack of candour by both NHS boards and the Scottish Government in respect of the Queen Elizabeth University Hospital and other scandals is unacceptable; further believes that this lack of openness has placed a greater burden on patients, families and NHS staff and contributed to a growing loss of public trust, and calls, therefore, on Nicola Sturgeon to request to make a personal statement, with questions and answers, to the Scottish Parliament, given her role as Cabinet Secretary for Health and First Minister during the construction and opening of the Queen Elizabeth University Hospital.” Further details available for S6M-20561.2 Gillian Mackay (S6M-20561.3) As an amendment to motion S6M-20561 in the name of Anas Sarwar (The Role of Political Decision Making in NHS Scandals), insert at end "; acknowledges that recent revelations surrounding the Queen Elizabeth University Hospital will have been distressing for patients, their families and staff; understands that this could create uncertainty and fear regarding the safety of Scotland's hospitals and negatively impact staff morale; recognises that patient privacy has to be given the greatest consideration in the publication of any materials, and calls for the Scottish Government to outline how it will urgently restore confidence into the services delivered by NHS Greater Glasgow and Clyde."
