Commons ChamberMy right hon. and learned Friend, the former Attorney General, raises a very important point. We want to do everything we can to encourage charitable giving. I will look closely at the case he mentions, and raise it with the Cabinet Office and Orlando Fraser KC, the distinguished chair of the Charity Commission, who is doing such a good job.
There are businesses in York that have not been able to trade for over four months because of flooding. The flood recovery framework precludes them from getting funds, whereas those in the Tory shires are able to access funds. Will the Minister meet me to discuss the fact that businesses in my constituency cannot get funding? Let us find a way forward so that they do not miss out.

Commons ChamberI actually agree that commonhold is the ideal form of tenure, but there are certain technical questions about when commonhold can apply, not least if a building also has commercial uses on the lower floors.
When we come to clause 27, will the Secretary of State clarify whether “best value” applies to leaseholders or to freeholders? It certainly seems that leaseholders do not get best value when testing what additionalities and enhancements are put into their schemes.
Broadly on the whole question of insurance, I am due to meet the chair, Baroness Morgan of Cotes, and the chief executive of the Association of British Insurers later this week to address not just that question but some other related questions.
I won’t at this stage.
I freely admit that this Bill does not go as far as some in the House and elsewhere would like. Strong arguments have been made about how property agents can be better regulated and Lord Best in another place has made arguments that I find incredibly persuasive—so why not legislate for them now? Well, as I mentioned earlier, this Bill has many clauses, deals with technical aspects of property law, requires close scrutiny and is likely to face a lobbying exercise from deep-pocketed interests outside attempting to derail it. Legislating to give effect to Lord Best’s proposals and to set up a new regulator—I am always a wee bit wary about setting up new quangos but on this occasion he makes a good case—would require significant additional legislative time of a kind we simply do not have in the lifetime of this Parliament. There are changes we are making overall in order to deal with some of the abuses for which managing agents are responsible, but there is still some unfinished business. I happily grant that, and there are organisations like FirstPort, which many of us will be familiar with from our work as constituency MPs, that require some gentle direction towards behaving in a better fashion.

Commons ChamberAbsolutely. Again and again, we find that Labour-run local authorities, despite their much-vaunted relationship with trade unions, are incapable of resolving these disputes. Whether in Birmingham or Warrington, Labour must do better, otherwise working people suffer.
On public services, City of York Council area comes 152 out of 152 when it comes to public funding. As a result, services are now having to be cut in the area, as the council has £55 million less than when we last had a Labour Government. How will the Secretary of State ensure that fair funding stretches across all public services when looking at the new funding formula?
We are absolutely committed to making sure that local authorities receive the resources they need. Having had conversations with the leader of City of York Council, I appreciate the constraints under which it is operating, and we hope to be able to say more in the local government finance settlement.

Friend, who is a brilliant advocate for his constituents, that we face a need for economy across the board and, funnily enough, as Opposition MPs have reminded us, the council tax base is often broader in areas that are relatively more prosperous such as those that he represents. Of course, I recognise the strains and pressures faced by his constituents. However, at a time when belts are having to be tightened everywhere, although it is a terrible thing to say, I actually feel sorrier for some people not in Christchurch but in other parts of the country because the relatively wealthy and the relatively older in our country already have it relatively better.
Since I met the Secretary of State, the pace of short-term holiday lets in my constituency has exploded, with the flipping of private rented homes and the hoovering up of homes to purchase meaning that people in my constituency have nowhere to live. When will he bring forward legislation to license short-term holiday lets? Will he support my private Member’s Bill, which aims to do that?
The hon. Lady raises an important issue also raised by Members from North Devon, North Norfolk and elsewhere. Through the Levelling-up and Regeneration Bill and other measures, in co-operation with the Department for Digital, Culture, Media and Sport, we are looking at what we can do to alleviate some of the pressures that her constituents and others face.

Commons ChamberI am grateful to the hon. Gentleman for raising that case. The housing and planning Minister, my right hon. and learned Friend the Member for South East Cambridgeshire (Lucy Frazer), is a former Justice Minister; I know that she and the Under-Secretary of State, my hon. Friend the Member for Kensington (Felicity Buchan), appreciate the importance of the issue. I hope that we will be able to make progress.
This must be a moment of epiphany. The scale of the problem—damp, cold, overcrowded housing or no housing at all for my constituents and constituents across the country— needs to be addressed by an action plan from every housing provider with a timeline for when the necessary reparation will be made, but there also needs to be a deep dive into the skills available to perform this reparation, because that too is a challenge.
The hon. Lady has made an important point, which gives me the opportunity to say two things. First, we do need professionalism within the sector overall, and that is one of the matters that will be considered in the Social Housing (Regulation) Bill. Secondly, as the hon. Lady rightly said and as so many other Members have pointed out, this individual tragedy is reflective of a broader set of problems in the housing sector. Those problems, as we have discussed, have been exacerbated by the nature of the housing stock that we have in this country—its age and its condition—but that is no excuse for not taking action.
I think—and I hope this reflects the mood of the House—that we have reached a point at which we all recognise that, thanks to this tragedy and thanks to the campaigning of Members on both sides of the House, as well as the campaigning of individuals outside such as Kwajo Tweneboa, Daniel Hewitt and Vicky Spratt, we now know that we need to tackle these questions with a greater degree of urgency than ever before.

Commons ChamberI cannot comment on a specific planning application for reasons that the hon. Gentleman knows well, but I appreciate the strength of his point and will ask the Minister for Housing to engage with him more closely on both that specific issue and the broader policy points that he raised.
As the Secretary of State knows, York also has a Liberal Democrat-run council, and the challenge we have is that the council is not building the tenure of housing that my local residents can afford either to rent or to buy. So how will this legislation really shift the dial on affordability?
I have a lot of sympathy for the hon. Lady and the situation in which she finds herself. I know that she is a doughty champion for York—it is a beautiful city, and a potential home for the House of Lords if it does not want to move to Stoke—and that York needs the right type of housing and commercial investment. I look forward to working with her and with Homes England, and also to consider what we can do in the Bill to deal with some of the consequences of some of her constituents foolishly having voted for Liberal Democrats at the local level.

Commons ChamberMy hon. Friend brilliantly encapsulates the challenge. The innovation accelerator will bring together representatives from the private sector—from business—as well as those in the outstanding universities that, as he rightly points out, are a feature of the west midlands in order to ensure that its manufacturing strengths can be leveraged more effectively. I look forward to working with him and others to achieve that.
The broken housing market is the bigger driver of inequality across York, with the boom in second homes and holiday lets. Therefore, the aspiration of the people of York is being denied. Rather than throwing us dead cats with the House of Lords, will the Secretary of State throw us a proper agenda to address the housing crisis in York?
Three important points. First, the hon. Lady is absolutely right that there are things we need to do to tackle the housing market, in particular the second homes issue. It is complex, as she understands, but there is more that needs to be done. Secondly, I hope she will support the proposed mayoral deal for York and North Yorkshire, which I think will give some of the powers necessary to deal with the problems she mentioned. Thirdly, the House of Lords in York, or for that matter Glasgow, would be a great thing.

At the danger of establishing a treacly consensus right from the very beginning, may I say that I entirely agreed with the first part of his question? As for the second part, I certainly welcome that direction of travel.
Today, York has been voted Britain’s most popular city. However, if we get planning wrong, we will embed inequality into our city. The governance structures over projects such as York Central are currently in the wrong place, so they will not deliver for the people in my city. Will the Secretary of State meet me to discuss York Central, as I have met many of his Ministers, so that we get the governance structures right for the future?

Commons ChamberThat is very good advice from the hon. Gentleman. He, like me, believes that brevity is the soul of wit.
Will the right hon. Gentleman give us a definition of “democratic” in view of the fact that when it comes to calling general elections, this legislation will move power from this democratically elected Chamber to royal prerogative?
Well, it gives power to the people. Fundamentally, all of us sit here at the pleasure of and at the disposal of our electorates. As we saw from the addled Parliament—or the paralysed Parliament or whatever you want to call the Parliament of 2017 to 2019—parliamentarians were actually frustrating the will of the people, in attempting to overturn Brexit and in attempting to sustain in power a Government who needed to seek confidence from the electorate and for the maintenance of their programme. For that reason, we are restoring power to the people, which had been taken away by the FTPA.
The points made by the hon. Member for Rhondda (Chris Bryant) are nearly always good ones, but on this occasion it is wrong. Ultimately, the decision about whether it is right to call an election and whether the Prime Minister and the Administration should return to power rightly rests with the people. During the course of the 2017-19 Parliament, parliamentarians sought to frustrate the Prime Minister seeking an election, and when that election eventually occurred, we saw that an appropriate decision was taken by the voters.
We also saw during the 2017-19 Parliament the reputation of Parliament—much to my regret—diminished in the eyes of the public because of its failure both to deliver on the original Brexit vote and to allow Government to carry on their business. In making sure that we return to a situation where we do not have the Fixed-term Parliaments Act, we are keeping faith with democracy. We are also keeping faith with the basis on which this Government were elected and, indeed, on which the Opposition argued for office.
The reality is that Government hold privileged information. In the light of the economic challenge coming down the path, surely the Bill is simply a cut-and-run Bill to allow the Government to call an early general election before they have to deal with that crisis.
I completely disagree. Looking at the broad economic situation that we face and what may happen in future, we have a well-informed and judicious electorate that will make a judgment whenever an election is called about the fitness of this Government to be returned to office or, indeed, the readiness of the Opposition or any other party to assume office, as has been seen in the past.
When Governments have sought to cut and run—when they have sought to manipulate the electoral timetable to their advantage—they have been punished. It was the case not just in 1974 with Edward Heath but in the early 1920s with Stanley Baldwin, when he sought to cut and run using the formidable advantage that he had—the support of press barons and the wealthy. Nevertheless, we saw the return of the very first Labour Government under Ramsay MacDonald, supported for all too brief a period by the Liberals of that time.

Commons ChamberOn 12 May, the Prime Minister confirmed to the House that a public inquiry into covid-19 would be established on a statutory basis with full formal powers. It will begin its work in spring 2022, and further details will be set out in due course.
First, may I pass on my condolences to the hon. Member for the sad loss of members of his family? I know that the whole House will want to pass on sympathies and condolences. So many people have lost those dear to them. That is why it is so important that, at the inquiry, we ensure that the voices of victims are heard and their questions are answered properly and fully.
The healing will not start until the public inquiry begins. Yesterday’s Select Committees’ damning evidence clearly caused significant pain to grieving families. They need answers now—they need to know whether decisions by this Government could have avoided the death of their loved ones, and that includes 396 families in my city of York. Does the Minister understand why the commencement of the public inquiry must not be delayed until next year, especially following yesterday’s evidence? Will he bring it forward and ensure that bereaved families not only are consulted on the scope of the inquiry but have their questions answered?

Commons ChamberAs the Chancellor of the Duchy of Lancaster, naturally, my heart is always in the north-west of England. However, I am delighted that more civil service jobs will be moving to York. I am also delighted that other Departments have made their own announcements about the relocation of senior positions in our civil service, with the Ministry of Housing, Communities and Local Government announcing plans to create a second headquarters in Wolverhampton, the Treasury creating an economic campus in Darlington, alongside the Department for International Trade, and, of course, DIT has established trade and investment hubs in Scotland, Wales and Northern Ireland. The Cabinet Office has also announced that our second headquarters will be located in Glasgow, with 500 officials to be located there, and the Foreign, Commonwealth and Development Office has established a joint headquarters in east Kilbride with 1,000 new roles relocating to Scotland.
First came the promise on the House of Lords, then it was the northern Government hub, then some Cabinet Office jobs, with hopes raised and then dashed in York—one of the worst hit economies from covid-19, yet one of the best connected northern cities, with a brownfield site adjacent to the station and full of people eager to serve. Will the Chancellor of the Duchy of Lancaster set out the framework within which his Government determine which locations are recipients of central Government jobs, resources and projects across the piece, so that we can all understand whether transparency or cronyism is driving this Government? And exactly how many jobs will York get?
Transparency drives everything that the Government do—that and a commitment to levelling up and ensuring that our Union is stronger. That is why we are moving jobs to Glasgow, a beautiful city that, sadly, has not flourished as it might have done under the Scottish Government’s stewardship over the course of the last 14 years. It is also why we are moving jobs to York, the city that the hon. Lady so ably represents alongside my hon. Friend the Member for York Outer (Julian Sturdy). We will be increasing the number of Cabinet Office jobs in York by 50% in the coming months, and it is not just the Cabinet Office; other Government jobs will be coming to York as well, because, as she rightly points out, its transport connectivity, its historical connections and its potential for brownfield renovation all make it a superb site for investment.

Commons ChamberThe nature of our new relationship with the EU outside the single market means that there are practical and procedural changes to which businesses and citizens must adjust. I can announce today that the Government are launching a £20 million SME Brexit support fund to help small businesses adjust to new customs rules of origin and VAT rules when trading with the EU.
The institutional framework within the UK-EU trade and co-operation agreement provides the UK with an opportunity to rebuild its relationship with the EU, including through a civil society forum. Can the Chancellor of the Duchy of Lancaster say what progress has been made on establishing the civil society forum and when he expects it to meet? Will he commit today to a significant majority of participants coming from charities, social enterprises and trade unions, in the light of the central role they play in our society?
The hon. Lady is right that the civil society forum is one of a number of ways in which the UK and the EU can work together in the interests of all. She makes a very important point about the importance of involving not just the third sector but trade union participants in that work, which gives me an opportunity to thank the millions of trade unionists across the country who have contributed so much to our response to the pandemic.

As I mentioned earlier, I will be meeting businesses this afternoon to make sure we provide all the support necessary for businesses, in York and elsewhere. The hon. Lady makes an important point about working together, but she prefaced her remarks by reflecting on the length of time from the referendum to the conclusion of the transition period, which would have been shorter had her party been committed to implementing the results of the referendum. I commend to her the words of the hon. Members for Hemsworth (Jon Trickett) and for Wansbeck (Ian Lavery)—wise men indeed.

Commons ChamberOperation Yellowhammer highlights that HGVs could be delayed by two and a half days at the border, and although we have heard about medicines and foods and disruption to business, we have not heard about the impact that that will have on lorry drivers. Clearly, there is such inadequate planning that it will be very disruptive to recruitment into the sector, and to the lives of people who work in that industry. What additional steps have the Government taken to support the staff working in the sector?
Again, I stress that we have taken steps to contact hauliers, not just in the UK but in the EU, in order to ensure that they and traders are ready to export; that should significantly reduce the risk of any delays. There are facilities in Kent to ensure that, should there be queueing of any kind, those who are caught in those queues who are hauliers can get the services they need.

Friend raises a very important point, but we have to consider not just high animal welfare standards and appropriate consumer information, but the sensitivities and traditions of our religious communities. Given the increase that we have seen in expressions of hostility towards religious minorities in this country, this is an area that requires handling with great care, but he is absolutely right to say that we do need to look at ways in which we can improve animal welfare at every stage in the life of the animals with whom we share this planet.
Page 33 of the national flood resilience review highlights how natural upper catchment management must be part of the next comprehensive spending review. How will the Minister ensure that upper catchment management is a major feature of that impending spending review, so that we can particularly protect York with catchment management on the River Ouse and the River Foss?

Commons ChamberI am grateful to my hon. Friend for raising this issue. We are consulting at the moment on how we can improve food labelling to ensure that we can provide consumers with greater choice, but it is also important to bear in mind that freedom of religious worship and practice is a core virtue of the United Kingdom. Although I believe very strongly in improving animal welfare standards, I also believe that we should show appropriate respect towards those individuals, from whatever faith background, who want to ensure that the meat they eat is prepared in accordance with their religious traditions.
The recent floods in York brought back into sharp focus the serious gaps that still exist in resilience planning and in the insurance market. What is the Secretary of State doing to advance that, and will he meet me to talk about these serious issues?

Commons ChamberLast Friday I visited Askham Bryan agricultural college in York. It says that the new exam framework does not work because assessment of, for instance, the felling of trees cannot be done in the tight window of the spring, and the harvest cannot be brought in during the spring either. Will the Secretary of State make representations to the Education Secretary about broadening the scope within which assessments can take place?
I am grateful to the hon. Lady for raising that important point, which I will indeed put to the Education Secretary.
