Again, I offer my sympathy to the hon. Gentleman and his staff who have faced this intimidation and graffiti. Members across the House stand fully in solidarity with him. He is right that it is vital that we work to ensure that the real issues are dealt with and that we say and demonstrate that we are not influenced by intimidation, violence or extra-parliamentary action. What we do is in the interests of the people he represents, and I look forward to working with him, his party colleagues and others to make sure that we resolve these questions.
The action taken last week follows the EU’s track record of a lack of understanding of the sensitivities in Northern Ireland. We saw it during the Brexit process, with the EU’s intransigence about not providing the then Prime Minister, my right hon. Friend the Member for Maidenhead (Mrs May), with an exit mechanism to the backstop, and we saw it again in the run-up to the protocol, with the EU ignoring our requests for trusted-trader schemes and other flexibilities.
I urge my right hon. Friend to take this discussion out of the purely technical discussions around the Northern Ireland protocol and transform it into a more strategic discussion with the EU. What does the EU need in return from the UK on other fronts to resolve these issues in the long term, and what does the EU need to do to give confidence, particularly to Unionists across Northern Ireland, that it understands that the Good Friday agreement and the protocol are matters of a joint duty of care for both the EU and the UK?
My right hon. Friend is absolutely spot on and makes the central point. People in Northern Ireland will have heard, during the whole Brexit process, professions of care and concern from EU politicians about Northern Ireland. Some of those were sincere, but the way in which the Commission has behaved in the course of the past week is of deep concern. I should say that I absolutely exempt Vice-President Maroš Šefčovič from this: he completely understands the need to make sure that we have a pragmatic resolution to this problem. But not every European politician understands the situation in Northern Ireland anything like as well as my right hon. Friend does, and we do need to make sure that we have a resolution that recognises Northern Ireland’s integral place in the UK, while also ensuring that we have the best possible relationship with all our neighbours.

I am grateful to the hon. Lady for all the points that she raises; they are all legitimate. It is important, of course, to recognise that some of the problems that were identified in the very first few days of the operation of the protocol have been addressed. As I mentioned, Andrew Opie of the British Retail Consortium explained to the FREU Committee earlier today that the supply of goods to supermarket shelves is now pretty much as normal. It is also important to recall that, as the Prime Minister stated earlier, no trucks have been turned away and that we now have normal traffic for this time of year. But the hon. Lady is right to say that there are and will remain challenges that it is the Government’s responsibility to address.
The hon. Lady asked specifically about engagement with the trader support service. As I mentioned earlier, more than 25,000 businesses have engaged with TSS, but there is more that the Government must do to ensure that all businesses are acquainted with the new procedures that the protocol requires and that our departure from the European Union requires when it comes to trade across the short straits.
The hon. Lady is absolutely right: the protocol should impact as little as possible on the lives of the citizens of Northern Ireland. That is why I will be working not just with businesses and representatives in Northern Ireland, but through the Joint Committee to ensure that we have a pragmatic approach towards grace periods and the operation of the protocol, because we want to make sure that the citizens of Northern Ireland, who are integrally part of the United Kingdom, are valued in the same way as her own constituents and mine are by everyone in this House.
I welcome my right hon. Friend’s remarks. I particularly welcome the confidence that he is planning to give to UK businesses to continue to trade in Northern Ireland—a fantastic base for their products and services. Will he confirm that the protocol is a joint UK-EU responsibility and, in that light, will he look at setting up immediately the joint working group, beneath the Joint Committee, and also use his negotiating talents and the relationships that he built up last year in completing the protocol to make 2021 a grace period for supermarkets in Northern Ireland? I think the EU will be up for that deal, so let us make it happen.
I am grateful to my right hon. Friend. No one has better negotiating skills than him. We remember that it is almost a year to the day since the “New Decade, New Approach” agreement was concluded, which restored democratic government to Northern Ireland. That was secured thanks to his leadership as a superb former Secretary of State for Northern Ireland.
My right hon. Friend is absolutely right that the protocol is a joint responsibility and I will be talking to my colleagues in the Commission as well as to representatives of the Government in Dublin to ensure that we do everything possible to smooth life for citizens of Northern Ireland. He is absolutely right: it is a wonderful place in which to live and to do business, and in this year of all years we must do everything possible to support the citizens of Northern Ireland.

Commons ChamberI welcome the agreement and thank my right hon. Friend and his civil service team for getting us to this stage, but may I urge him to spend some time with the Protestant Unionist loyalist community, who have retained concerns about the detail? I suggest that Mikala’s Kitchen on the Shankill Road is the best place for that engagement. Could he also now spend some time with the nationalist community, unaligned voters and passionate supporters of the European Union in Northern Ireland to demonstrate to them that the practical approach that he and the EU have taken on the protocol can now be replicated on issues such as climate change, health, jobs and the future of all people across the island of Ireland?
My right hon. Friend is absolutely right: there is more work to do. I always enjoy any opportunity to be in Northern Ireland with my right hon. Friend the Secretary of State for Northern Ireland. My right hon. Friend the Member for Skipton and Ripon (Julian Smith) was an outstanding Secretary of State for Northern Ireland, and he makes a series of very important points that I take completely to heart.

Commons ChamberSeconds out, round one, I am tempted to reply. The hon. Gentleman knows that I have great affection and respect for him. Indeed, it was his questioning in the Select Committee that helped to elucidate some of the opportunities that leaving the European Union can bring. The customs expert Lars Karlsson, who spoke before the Committee, said:
“It is a great opportunity because part of the UK’s strategy and global vision for trade opens up a totally new industry here”,
which can be more efficient and bring additional benefits to British business. It is important of course to be aware of the challenges, but also the opportunities.
With so many of our small and UK-wide businesses struggling to survive following the covid crisis, the idea of adding additional friction and cost to the trading relationship with their biggest market is deeply problematic and worrying. My right hon. Friend has worked extremely hard for the country over the past few months, but I urge him to do everything he can to ensure that the UK gets a deal with minimal tariffs and minimum friction.
I again thank my right hon. Friend for the role that he played in reconstituting the Northern Ireland Executive earlier this year, which of course has made the whole process of agreeing the approach towards the Northern Ireland protocol and safeguarding the rights of Northern Ireland citizens significantly easier. We should all be grateful for his leadership in that role, which helped advance the cause of peace. On the specific point about securing a comprehensive free trade agreement with the European Union, I am completely with him. I think that it would be better, as the hon. Member for Leeds West (Rachel Reeves) also mentioned, for us to have the zero-tariff, zero-quota approach that we can secure through a comprehensive FTA, but I should add that whether or not we secure that FTA, many of the steps that I have outlined today will be required by business as “no regrets” steps anyway.

Commons ChamberNo, I do not accept that. The primacy of the interests of Northern Ireland’s businesses and indeed the primacy of Northern Ireland’s people is at the heart of our approach to implementing the protocol. The Good Friday agreement depends on consent across Northern Ireland, from Unionist, from nationalist and from non-aligned individuals. We want to ensure that their interests come first through the light-touch approach that we propose.
I welcome the Command Paper, but we now, as my right hon. Friend has said, need quickly to reassure the Unionist grassroots on their fears about the exact nature of the processes referred to, and nationalist and non-aligned voters who have serious concerns about leaving the EU. Above all, on business, I am not sure that we have got seven months. Businesses in Northern Ireland, as in the rest of the UK, have got their backs against the wall with covid. Please, please will my right hon. Friend use all his energy to work with them on exactly what they will need and a constructive approach with the EU to getting a practical solution?
Yes. I am very grateful to my right hon. Friend—we would not have able to make progress in this way if it had not been for him and the “New Decade, New Approach” document, which he was responsible for bringing to life in the Northern Ireland Executive, which he helped restore. He is absolutely right: we have got to get cracking. That is why I hope that we will have positive engagement from the EU as well as the positive engagement that we will have with Northern Ireland’s businesses.

Commons ChamberI pointed out that three schools had been the subject of concern for the Education Funding Agency and others, and as I pointed out to the hon. Member for Brighton, Pavilion (Caroline Lucas), the overwhelming majority of schools put forward for approval were turned down. Something like 17% of the lowest-scoring schools were approved, but no school that has subsequently caused concern to the EFA or anyone else was approved against the advice of officials.
T9. I thank the Secretary of State for listening to North Yorkshire MPs about the sparsity factor in the schools formula. Will he meet me about Upper Wharfedale school, deep in the Yorkshire dales, which is suffering from cuts in bus services for out-of-catchment parents and high demand for special educational needs places?
I would be delighted to meet my hon. Friend to discuss that school and its students.

Commons ChamberIt is designed to do exactly that. Some students are written off prematurely and it is assumed—often because of their background or as a result of poor early primary education—that they cannot cope with formal learning, but more students can cope than is currently acknowledged. However, I absolutely agree with the hon. Lady that it is very important that we make sure students of all abilities are supported. That is what our new accountability system will do, and it is also what the changes to special educational needs provision in the Children and Families Bill being brought forward by the Under-Secretary, my hon. Friend the Member for Crewe and Nantwich (Mr Timpson), will do.
Will the Secretary of State confirm that he will not be swayed from his obsessive, relentless, brilliant and, frankly, ballsy approach to preparing British children for the fire and fury of the global competitive race?
Absolutely. As I said earlier, my approach is always to argue strongly for radical change and then to make sure that where that radical change is right, it is implemented, consolidated and agreed, and where that radical change may just occasionally be a step too far, then to acknowledge that we only make progress in this life by recognising when to cut our losses.

Commons Chamber10. What recent representations he has received on the English baccalaureate; and if he will make a statement.
That is a very well made argument from the hon. Lady, and I sympathise with the case that she makes. It is important to appreciate that the English baccalaureate does not and need not take up the entire teaching time in any school day or week. The reason why it is constructed as it is, with just the five areas that we are familiar with, is to ensure time in the school week for other activities, such as art and design, music, physical education—everything that helps to build a truly rounded young person. There is no need to alter the English baccalaureate for schools to offer a truly rounded and stretching curriculum, and I would love to be able to work with her to ensure that the schools in her constituency appreciate that.
Schools across Skipton and Ripon are delighted about the E-bac, but there is concern about religious education. Are there any plans in the near or medium term to review the decision to exclude RE from the E-bac?
I know that a number of schools and hon. Members have pressed for additional subjects in the English baccalaureate, but the reason why religious education is not included is that it is a compulsory subject at all stages in the national curriculum to the age of 16. The reason why it is not included in the humanities section of the English baccalaureate is specifically so that we can drive up the take-up of history and geography, which are currently not compulsory after the age of 14.
