Commons ChamberAs a former Chief Secretary to the Treasury, I think the suggestion that the way the SNP allocates its Barnett consequentials gives farmers funding certainty is a somewhat bold claim. The point with Brexit is that we can tailor our response to the needs of our farmers, whether through specific legislation such as that on gene editing to develop disease and drought-resistant crops, our procurement legislation so that we better leverage our public sector procurement and our labelling legislation so that we can support British producers, as well as through schemes such as the SFI, which is the most popular ever run by DEFRA, with more than 20,000 farmers now signed up.
In the past, flooding from the Lady brook and Micker brook, which run through Bramhall, Cheadle Hulme and Cheadle to join the River Mersey, has caused devastation to homes and families. Does my hon. Friend agree that joint working across the region is part of the solution? Will he continue his support for the upper Mersey catchment partnership working?
My hon. Friend has raised that specific case with me before. I am more than happy to meet her to have those conversations at speed, because I know just how valuable projects such as flood alleviation schemes are to her constituents in better protecting more homes.
The Chair of the Select Committee is tempting me to step on the firm territory of the Lord Chancellor, as he well knows. He also knows, because he and I have discussed this many times, that the Lord Chancellor and I speak several times a week about our concerns about the shortage of counsel in the criminal sphere in particular. However, I would say gently to my hon. and learned Friend that I do not think money is the only reason why it is not always attractive to prosecute RASSO case after RASSO case. They are draining cases to be involved in, and they are listed very tightly at the moment because of the pandemic backlogs, as he mentioned. That leads to tensions with listings and with the judiciary, which can make it very difficult to do this area of work relentlessly. I have nothing but praise for the barristers who are engaged in it.
Close and collaborative work across the criminal justice system is key to securing justice for victims, holding offenders to account and keeping the public safe. The police and the CPS have invested heavily in new ways of working, including through the national operating model for rape prosecutions, with the result that the police and the CPS work more closely together at an earlier stage in prosecutions.
During a recent visit to Greater Manchester police’s divisional headquarters in Stockport I heard that there can be significant delays between sending a case to the CPS and receiving a charging decision back. To solve that, it was suggested that having CPS staff based inside the station would speed up the process and improve communication. What consideration has my hon. and learned Friend given to a CPS presence in police stations, and will he work with me and Stockport division to facilitate a trial?
I thank my hon. Friend for raising this extremely pertinent point. She is right to emphasise the importance of early co-operation between the police and the CPS. At a visit last month to Charing Cross police station I considered precisely that point. There is a buddy system there, with CPS lawyers working with police officers, which is improving case file quality. We are actively exploring how to ensure closer early working with the CPS and the police, and I will look at Stockport with her.

Commons ChamberI do not recognise the figures that the hon. Lady quotes. In this spending review, the DEFRA budget increased by more than £4 billion, and the Environment Agency is being more active than ever before in enforcing the regulations on our water quality.
I want to see clean water in the Ladybrook, the Micker brook and all the streams that feed into the great River Mersey. United Utilities is responsible for our waste water and sewage discharges. It is consulting on its plan to spend up to £18 billion on the water quality and discharges in our area. I am asking my Cheadle constituency to join that consultation. Will the Minister join me in encouraging everybody to play their part and make their voices heard?
My hon. Friend is absolutely right that addressing that long-standing issue will be a combined effort with everyone working together. It is really important that everyone engages in ensuring that we get the right solutions in every situation to address the problem and reduce the amount of sewage being discharged as quickly as possible.

Commons ChamberI am pleased that my right hon. Friend has given me the chance to say that we on the Front Bench—every single one of the Ministers and the Secretary of State—are absolutely committed to nature-friendly farming, and there will be schemes through the new environmental land management system that will reward it. The sustainable farming incentive will support approaches to farm husbandry that will help the environment. That might include propagating integrated pest management and actions to improve soil health and water quality. Local nature recovery will pay for actions that support local nature recovery and deliver local environmental priorities, with farmers potentially collaborating. Finally, landscape recovery will support much wider landscape-scale and ecosystem recovery through long-term change of land use and projects. Internationally, that work continues with our Darwin initiative and many more things, and we will bring all those into COP26.
Apologies, Mr Speaker. Work to establish the Office for Environmental Protection continues at pace. We have appointed the chair and interim CEO, with non-executive directors to follow, and the headquarters will be in Worcester.
Lockdown has highlighted the importance of our environment, with the positive effects of good air quality, access to green spaces and connecting with nature for our health and wellbeing. Will the Secretary of State elaborate on the remit of the new independent regulator and on what the interim Office for Environmental Protection will be able to do to maintain those important protections, as we seek to enhance and protect our natural environment?
My hon. Friend makes an important point. The interim OEP will be able to produce an independent assessment of the Government’s progress towards their 25-year environment plan and receive complaints about failures of public authorities to comply with environmental law. It will take decisions on operational matters such as recruitment, accommodation and facilities; develop the OEP strategy, including its enforcement policy; and determine approaches to how the OEP will form and operate.

Commons ChamberOur £2.6 billion of investment in flood defences up to 2021 has a very strong emphasis on ensuring that our transport networks are more resilient. I would also emphasise that on those matters and many others we are keen to work with the devolved Administrations to the mutual benefit of all our citizens.
Many of my constituents who were flooded last year watch severe weather warnings with dread, expecting to be flooded again every time they see them, and many of them have not been able to apply successfully for Flood Re insurance or for resilience funding. What can the Department do to communicate to councils the importance of working with the people affected—the victims of flooding—to enable them to access this resilience funding?
I would certainly encourage all local authorities to engage with residents affected by flooding in particular areas and with the various schemes that are available.

Commons ChamberI am grateful for the hon. Lady’s valuable advice. She is right: when it comes to dealing with air quality, we need to deal with ammonia emissions. We have a number of policies that we will implement as part of our environment Bill.
The River Mersey, which originates in Stockport and flows through my constituency on its journey to Liverpool, has been named and shamed by Greenpeace as proportionately more polluted than the great Pacific garbage patch. That follows a University of Manchester study showing that microplastics in the river bed sediment were higher than in any other environment. What work is the Department doing to address the issue of microplastics entering the waterways, and what pressure is being put on the industry to address it?
I grew up in Liverpool, and it is sad to hear that terrible statistic revealed by Greenpeace. I think it is fair to say that the Government have already taken action by reducing microplastics from certain cosmetic products and rinse-off products. We will do more by taking forward the ban on plastic straws and other single-use plastic items. We will continue to work with the water industry on what more we can do about filtration, so that we keep plastics out of the rivers.

Commons ChamberThe report was published only yesterday, so we need to consider it and will then reply. Only this week, we launched the clean air strategy, which was recommended by the World Health Organisation as something for other countries around the world to follow. We are going through with a new Agriculture Bill and Fisheries Bill. We are preparing an environment Bill. These are all examples of action, which the House has asked for, on issues such as clean air. There is also what we are doing with our local nature recovery networks, and we are doing all sorts of things to try to improve biodiversity. The hon. Lady will be aware of our commitment to make sure that we achieve a target of 30% marine protected areas around the world by 2030, and we will be launching our final decision on marine conservation zones shortly. So frankly, this Government are acting to make the environment a better place.
It really matters that we work with local authorities to make sure that we improve air quality as quickly as possible. There are broader issues with particulate matter and similar, but we are still behind on nitrogen dioxide. The Greater Manchester area is late in presenting its plan to the Department, and we are continuing to work with it. Where there are those sorts of measures—not a congestion zone but a charging zone for more polluting vehicles—we will work on, and try to fund in the best way we can, the measures needed to mitigate that.

Commons ChamberMy hon. Friend makes a very important point. Government Members are clear that we should leave the European Union and that there are opportunities for our fishing industry. The disaster for the Scottish fishing industry would be if we were not to deliver Brexit and leave the European Union, thereby throwing away those opportunities.
We recently strengthened the Environment Agency’s powers to tackle problem waste sites and we allocated an extra £30 million for waste enforcement in last year’s Budget. We have also consulted on tightening the permitting and exemptions regime to improve the waste sector’s performance. Later this year, we will publish a resources and waste strategy that will set out our wider approach.
I welcome the new powers given to the Environment Agency. Will my hon. Friend confirm that those new powers will enable it to curb effectively the rise of waste sites, which continue to break the law and blight our communities?
Yes, I can confirm to my hon. Friend that the new powers will enable the Environment Agency to do that. For example, they give the Environment Agency the power to lock gates and physically close down problem sites, and to require all waste to be removed from a site at which there are problems. We are also going to introduce tougher standards for those who hold licences.
