I am very grateful to the right hon. Gentleman for his constructive tone as he eloquently makes his case. I note the narrative that he has advanced. The Government are considering judgment very carefully, as you would expect, Mr Speaker, and we are taking legal advice. I can reconfirm, as the Prime Minister said yesterday, that the Government intend to appeal the judgment.

We have consistently made it clear that the rights commitments in the Belfast/Good Friday agreement should be interpreted as they were always intended, and not expanded to cover reserved issues, such as illegal migration. We are equally clear that immigration is a reserved matter that has always been applied uniformly across the UK. We do not accept that the Good Friday agreement should be read so creatively as to extend to matters such as tackling illegal migration, which is a UK-wide issue and not in any way related to the original intention of the Good Friday agreement.

On the specific point about the common travel area, all immigration legislation provides a UK-wide framework for legal and illegal migration. We continue to have a constructive working relationship with the Irish Government when it comes to ensuring that abuse of the common travel area is robustly and appropriately tackled. On the specific point about asserting Parliament’s sovereign will around these matters, I would argue that the recent Safety of Rwanda Act clearly asserts Parliament’s sovereign will. While the latest judgment relates to the IMA, we are committed to appealing it.

This case, together with the case a few months ago about the Northern Ireland Troubles (Legacy and Reconciliation) Act 2023, have a common theme: the applicability of article 2 of the Windsor framework and the direct application of EU law. What are the Government going to do about that? Will they seek to expedite the appeal directly to the Supreme Court? It seems to me this is a fundamental issue that need resolving. Further, will they seek further clarification, either from the Joint Committee on the Northern Ireland protocol or by other means, to clarify the situation and protect non-devolved matters from being dealt with in this way?

I am always grateful to my right hon. and learned Friend for his contribution. He speaks with real authority, given his professional background, his role in this House, and his former position as a distinguished Secretary of State and Lord Chancellor. He will recognise that the court will make its final order in two weeks, when an appeal can be brought. He made a number of observations, on which Ministers will reflect when taking decisions, but as I have said, and as the Prime Minister has made very clear, it is our intention to appeal this judgment. We think that it is right and proper to take all steps necessary to defend our position.

With permission, I would like to make a statement on immigration.

The Government are committed to reducing immigration—both legal and illegal—into the United Kingdom. Legal immigration has risen in recent years in part because we have extended the hand of friendship to people fleeing conflict and persecution in Ukraine, Hong Kong and Afghanistan. That was the right thing to do. But another factor has been the numbers of overseas students and workers and their dependants rising to unsustainable levels. The steps that the Secretary of State for the Home Department, my right hon. Friend the Member for Braintree (James Cleverly) announced last year to cut net migration will mean that around 300,000 people who would have been eligible to come to the UK will now not be.

We have restricted most students from bringing dependent family members, increased the salary that most skilled worker migrants need to earn in order to obtain a visa by nearly 50% to £38,700, stopped overseas care workers bringing dependent family members with them, raised the minimum income for family visas to ensure that people are supported financially, and scrapped the 20% going rate salary discount for shortage occupations and replaced the shortage occupation list with a new immigration salary discount list. The latest estimates from the Office for National Statistics show that net migration in the year to June 2023 was 672,000, 73,000 lower than it was six months earlier. The figures are provisional and we need to go further, but these are encouraging signs.

The latest statistics show that the numbers applying for skilled worker, health and care and study visas in the first three months of 2024 were down by 24% on the same period last year. We removed, from 1 January, the right of students starting courses—other than those on postgraduate research programmes and Government-funded scholarships—to bring dependants to the UK via the student visa route. The number of applications for student dependant visas has fallen by 80% since our changes came into force. From 11 March 2024, we have stopped overseas care workers bringing family dependants here, and have required social care firms in England to be registered with the Care Quality Commission to sponsor visas. In the year ending September 2023, an estimated 120,000 dependants came here via that route. In the first three months of 2024, the number of applications for health and care visas was down by 28%—and this is just the start; most of our changes have only just come into force.

Meanwhile, we remain committed to stopping the boats. Following Royal Assent for the Safety of Rwanda (Asylum and Immigration) Act 2024 and the ratification of our treaty with Rwanda, we can operationalise our plan to relocate illegal migrants to Rwanda. Rwanda is a safe country that has repeatedly shown its ability to offer asylum seekers a chance to build new and prosperous lives. It has a strong and successful track record of resettling people, hosting more than 135,000 refugees, and it stands ready to accept thousands more who want to rebuild their lives and who cannot stay in the UK. Once flights begin, we will have added another vital deterrent to crack down on the people-smuggling gangs who treat human beings as cargo. The first illegal migrants set to be removed to Rwanda have now been detained, following a series of nationwide operations this week. Operational teams within the Home Office have been working apace to detain, safely and swiftly, individuals who are in scope for relocation to Rwanda, with more activity due to be carried out in the coming weeks. This action is a key part of the plan to deliver flights to Rwanda in the next few weeks.

We have made solid progress in stopping the boats, although we need to finish the job. The number of small boat arrivals fell by more than a third in 2023, and our work with international partners prevented more than 26,000 crossings last year as well as helping to dismantle 82 organised crime groups since July 2020. Our new agreement with Albania has cut Albanian small boat arrivals by more than 90%, and we recently signed a groundbreaking deal with Frontex—the European Border and Coast Guard Agency—which marked another crucial step in the securing of our borders. An initial cohort in the thousands of suitable cases for removal to Rwanda has been identified and placed on immigration bail, with strict reporting conditions. We have a range of measures in place to ensure that we remain in contact with individuals, including both face-to-face and digital reporting, and Immigration Enforcement has a range of powers to trace and locate any individuals who abscond, as well as a dedicated team of tracing officers who work with the police, other Government agencies and commercial companies to help trace individuals and bring them back into contact. It would, of course, be inappropriate for me to comment further on operational activity.

Immigration has enriched this country beyond measure, but it needs to be sustainable and it needs to be fair. Legal immigration should be focused on helping those in genuine need, and on ensuring that our economy has the skills that it needs in order to flourish. It is simply not right for those who can afford to pay gangsters to jump ahead of those who would play by the rules, and whose need is greater. No one needs to flee to the UK from a safe country such as France. Both illegal immigration and unsustainable legal migration place intolerable burdens on communities, and over time they will undermine support for immigration in general, which would be a tragedy. That is why this Government have a plan, which we are putting into action. There is further to go, but we are seeing its positive impact already. I commend this statement to the House.

My hon. Friend will appreciate that I cannot go into the granularity of the operational work that is ongoing to ensure that we can deliver on this policy, but I can say that an initial cohort of suitable cases of around 2,000 people has been identified for removal, and they have been placed on immigration bail with strict reporting conditions.

For those outside that group, there is still a wide range of tools to maintain contact with them. That includes, as I said earlier, face-to-face and digital reporting, and many individuals also reside within Home Office accommodation. The Minister for Countering Illegal Migration, my right hon. and learned Friend the Member for Mid Dorset and North Poole (Michael Tomlinson) leads on this work and he is confident of the whereabouts, once the decision to detain is made, and this is just one of the cohorts of people who may be eligible for removal to Rwanda. The policy is clear and we are getting on and operationalising it. That includes detaining people for the purposes of relocation.

My right hon. Friend is a distinguished former Home Office Minister who had responsibilities in the immigration space, and I would argue that a lot of the measures that we have announced, and that are now all in flight, build on the earlier efforts of colleagues such as him. He is absolutely right that the policies are balanced and measured and that they deliver on the legitimate aim of wanting to reduce inflows of legal migration into our country, to ensure fairness, to ensure that the model is sustainable and to ensure that people who come here are able to be properly supported. I think that that is something that the British people strongly support, and I entirely share his sentiments.

I will not give a running commentary on ongoing litigation, but I can say that we are supporting British nationals with dependants in Gaza to get those individuals out of Gaza safely, working in collaboration with Foreign Office colleagues. There are also marked differences at play here. Of course, the right of return is fundamental as part of efforts towards a two-state solution, and other factors are at play in responding to the Ukrainian situation. The dynamic is very different, which directly affects the relationship we have with the Ukrainian Government, particularly in respect of the ability to carry out checks on individuals.

Since our last Home Office questions, the list of Government failures on immigration has continued to grow relentlessly: 30,000 asylum seekers stuck in limbo, unable to be processed due to the Prime Minister’s legislative fiasco; 250 visas awarded to a care home that does not actually exist; net migration trebled; and criminals free to fly into our country undetected on private jets. Having just sacked the independent inspector of borders and immigration, is the Home Secretary sitting on 15 different reports by the inspector because he is checking for typos, or is it because he is utterly terrified of what those reports will tell us about this Government’s shambolic and failing immigration system?

Let me answer that point very directly: having given proper consideration to those reports, we will be responding to them. As I said in the House last week, we will do so very soon. The shadow Minister mentioned the Government trying to dodge scrutiny. When it comes to the general aviation report, for example, it was our officials who asked the inspector to take it forward. Far from dodging scrutiny, we have invited it in that area. We will respond properly and thoroughly to that report in exactly the way that I undertook to do last week.

My right hon. Friend summarises the situation neatly. There will continue to be an in-country opportunity for people to apply to extend their visas. Through the Homes for Ukraine scheme, Ukrainians will still be able to come to the UK to access the sanctuary that we proudly support. We have seen communities across the country doing an enormous amount of positive, welcome work to support that national effort. Any suggestion that that will not be the case moving forward is wrong—it is deliberate scaremongering and people should stop it.

I know that my hon. Friend cares deeply about providing that sanctuary for our Ukrainian friends, as do I, colleagues across Government and, I would argue, Members across this House. We are all incredibly moved by what we have seen in our communities, with people rallying behind those Ukrainians to support them and to provide that warm welcome. We will continue to sustain that effort, which we do in partnership with the Ukrainian Government; we regularly discuss these matters with them. Of course, we will continue to sustain that sanctuary for the duration of this invasion. We are firmly on the side of the Ukrainians in winning this war.

The Government’s position is clear: the changes that we are introducing are the right thing. The numbers of dependents we are seeing coming is disproportionate. There will be an opportunity, through the review of the composition of the immigration salary list in the second phase, and through the call for evidence, for exactly those debates to be had and for those views to be made known.

As I have said, the key principle behind the Bill is to help us to bring to an end the egregious crossings of the channel organised by evil criminal gangs. It will help us to ensure that there is greater control of our borders and that there are not these in-flows into the system, which have undoubtedly had the consequence of our needing to respond to that challenge through the opening of hotels. That is precisely what we are trying to put a stop to.

I am always happy to meet colleagues to discuss such issues. It is fair to say that the Chancellor of the Exchequer has put a real emphasis on this policy area in his previous spending announcements; no doubt he will have heard the hon. Lady’s comments in advance of the upcoming autumn statement. When we consider initiatives such as Work Well—our work in respect of occupational health and the consultations on that—we see that a lot of effort and energy have gone into recognising that retention is just as important as job starts.

Through the White Paper reforms, we have advocated for a number of tests and trials, including one that focuses specifically on better capturing fluctuating conditions. I would be keen to have conversations with her about that. The Government are committed to working with charities and those that are interested, including disabled people, to ensure we get those reforms right.

Like the hon. Gentleman, I am passionate about the positive difference that Access to Work makes in terms of opening up employment opportunities for people. He will be aware of the passports that we have introduced to help better understand people’s needs and passporting that between jobs and between, for example, education and employment. I refer him back to the steps that we have taken to see improvement in the journey times, but we will continue to work tirelessly to make sure that people get the Access to Work help as quickly as possible.

With permission, Mr Speaker, I will make a statement on the progress of delivery of cost of living support.

The Government understand the pressures that households face in the current climate. We are all familiar with the global factors that are the root causes of costs being higher, including President Putin’s illegal war in Ukraine and the aftermath of the pandemic. We are committed to delivering on our priority to halve inflation, which will help ease those pressures for everyone and raise living standards.

Alongside that important work, we continue to implement our wide-ranging and significant package of cost of living measures to support the most vulnerable during 2023 and 2024. We have increased benefits and state pensions by 10.1%, and increased the benefit cap by the same amount so that more people are helped by the uprating. For low-paid workers, we have increased the national living wage by 9.7% to £10.42 an hour. That represents an increase of more than £1,600 to the gross annual earnings of a full-time worker on the national living wage. That increase, and the increases we made to the national minimum wage in April, have given a pay rise to about 2.9 million workers.

To help parents, we are undertaking a significant expansion of childcare, including a rise, later this month, of nearly 50% in the maximum amount of childcare payments for people on universal credit. For the most vulnerable, the £842 million extension of our household support fund into 2023-24 means that councils across England can continue to help families with the cost of groceries, bills and other essentials. Taking into account the extra money that we have provided through Barnett funding for Scotland, Wales and Northern Ireland, who can decide how they allocate that money, we have committed an extra £1 billion. That is on top of what we have provided since October 2021, and brings total funding to £2.5 billion.

With energy bills being one of families’ biggest worries, the energy price guarantee will also remain in place as a safety net until the end of March 2024, should energy prices increase significantly during that period. Since that energy bills support began in October 2022, the Government have covered about half of a typical household energy bill this past winter, and by the end of June will have saved a typical household around £1,500. We are also building on and extending the one-off cash payments we provided during 2022-23 that saw us make more than 30 million cost of living payments, including a £150 disability cost of living payment to 6 million people, up to £650 for more than 8 million households on means-tested benefits, and an additional £300 on top of the winter fuel payment for more than 8 million pensioner households. Those payments put hundreds of pounds directly, and at pace, into the pockets of millions of people.

However, we recognise that cost of living pressures continue, particularly for the most vulnerable households. That is why we continue to provide targeted support to help those most impacted by rising prices throughout this financial year, including more support for people on means-tested benefits such as universal credit, with up to three cost of living payments totalling up to £900. The Government have already delivered the first £301 payment to 8.3 million households—support worth £2.5 billion. The two further payments of £300 and £299 will be made in the autumn and the spring, and pensioner households will get an additional £300 on top of their annual winter fuel payment this winter, as they did last year.

I am pleased to be able to confirm to the House that from today, to help with the additional costs that disabled people face, more than 6 million people across the UK on eligible extra-costs disability benefits will start to receive a £150 disability cost of living payment. Those cash payments, which we estimate will be worth around £1 billion, will be automatically transferred into people’s bank accounts, with those eligible for the support not needing to take any action. By the end of Monday 26 June, we plan to have made 99% of payments to those already eligible—that is millions of payments being made in just seven days. Most remaining already eligible people will receive their payment by 4 July. We estimate that nearly 60% of individuals who receive an extra-costs disability benefit will also receive the means-tested benefit cost of living payment, and more than 85% will receive either of, or both, the means-tested pensioner payments.

This Government will always protect the most vulnerable, but we are also helping to improve living standards for everyone by getting more people into, and progressing in, better-paid jobs. That is the surest and most sustainable way to raise incomes and grow the economy. The number of people in employment has increased to a record high, but by removing the barriers that stop people from working, we are reducing the number of people who are economically inactive—those who are neither working nor actively looking for work. It is encouraging that last week’s labour market statistics show a further fall in inactivity of 140,000, or 0.4%, on the quarter.

We are tackling inflation to help to manage the cost of living for all households and providing extra targeted support for those that need it. The disability cost of living payments, landing in millions of bank accounts from today as part of our wider support package, underline our commitment to supporting disabled people. That is reflected in how we are stepping up our employment support for disabled people and people with health conditions; ensuring people can access the right support at the right time and have a better overall experience when applying for and receiving health and disability benefits; and transforming the health and disability benefits system so that it focuses on what people can do, rather than on what they cannot. It is also reflected in the fact that we expect to spend over £78 billion in 2023-24 on benefits to support disabled people and those with health conditions, which is 3.1% of GDP.

With the Government’s significant package of cost of living support, worth over £94 billion in 2022-23 and 2023-24, we are ensuring that those most in need are protected from the worst impacts of rising prices, putting more pounds in people’s pockets and providing some peace of mind to the most vulnerable in society.

I am hugely appreciative that my hon. Friend extended that invitation for me to come along and visit the Belgravia Waitrose branch. It was incredibly inspiring to see that dedicated team, who are part of the wider customer service family within that business, achieving so much and providing brilliant service to their customers. It demonstrates that not only is it right for businesses to engage in disability employment, but it has had a great impact on those employees and on the community as a whole. That demonstrates what can be achieved with the right Government support, working with businesses to increase those opportunities and support people.

I commend my hon. Friend for the work she does on the ground in her constituency, working constructively with the jobcentre and employers to help facilitate employment opportunities. I am really excited about the opportunities universal support will bring. We know from existing schemes that where people are supported in taking and then retaining roles, it is hugely powerful and effective in bettering their health and employment outcomes. That is precisely what we are doing through universal support with those 50,000 opportunities. I am excited to work with my hon. Friend on implementing that in her area, and I would of course be delighted to visit and see more of what is going on on the ground.

My right hon. Friend speaks with passion and authority on these issues, and he has a wealth of experience of delivering meaningful change in the welfare system that has improved the lives of millions of people. This is the next chapter—the next step in that journey—and one thing I know for sure is that I shall want to draw on my right hon. Friend’s experience and expertise and hear his ideas about how we can get this right. Like him, I am excited about the opportunities that universal support can provide in matching people to roles and supporting retention, with all the wraparound care and support that goes with that. There is a great deal of best practice from which we can learn. I was in Tower Hamlets yesterday, and saw a fantastic example involving NHS talking therapies. I want to ensure that more people are able to engage with that sort of support.

I thank my hon. Friend for raising this point. The experience he describes illustrates the troubling and worrying times for families when a diagnosis of cancer comes through. We are committed to ensuring that people can access financial support, through the personal independence payment and other benefits for which they are eligible, in a timely manner. We are seeing a gradual improvement on PIP claims, with the latest statistics showing that the average end-to-end journey has steadily reduced from 26 weeks in August 2021 to 18 weeks at the end of July 2022. However, I am not complacent on this; digitisation clearly plays an important part and we are going to go further.

My hon. Friend absolutely hits the nail on the head in explaining why our new plan for immigration is so important, and we are determined to deliver on it. It is a comprehensive package of reform, including the Rwanda proposals, and we are going to get on and deliver on it. The Prime Minister has said that we will work through these issues, and that is precisely what we are now doing.

My hon. Friend speaks with great authority and experience on these issues and is absolutely right that the status quo is not tenable; we cannot continue as we are, with people making dangerous crossings of the channel organised by evil criminal gangs who take people’s money and have no regard for whether they get here safely. That is why this has to stop, and we believe the partnership with Rwanda is an important part of the solution. On the specific point about the monitoring arrangements, I hope to be able to set those out to the House soon.

I congratulate the hon. Member for Cumbernauld, Kilsyth and Kirkintilloch East (Stuart C. McDonald) on getting the urgent question, but I will not congratulate him on the language that he used, or the shadow Home Secretary on the language that she used. Mixing up the difference between smugglers and traffickers shows little knowledge of the subject.

We hear that a number of the people who were to be on the flight to Rwanda tomorrow have somehow—miraculously—got some leftie lawyer to intervene and stop it. May I suggest to the Minister that instead of booking 50 people on to each flight to Rwanda, he books 250 people so that, when half the people are stopped from travelling, we would still have a full flight? Come on—get on and send them.

Foreign criminals who abuse our hospitality by committing serious and violent crimes such as murder and rape should be in no doubt of this Government’s determination to deport them. The British people have shown repeatedly at the ballot box that they want an immigration system that is firm and fair. Our new plan for immigration, underpinned by the Nationality and Borders Act 2022, is the first major reform of the system in decades. With that Act now law, we are getting on with the job and operationalising the plan.

It is this Conservative Government who are delivering on the will of the British people. Making our streets safer is our priority. That is why we introduced the new Police, Crime, Sentencing and Courts Act 2022, giving the police the powers they need to crack down on violent criminals. It is also why, despite the challenges of covid, we stepped up the removal of criminals who have no right to be here. Since January 2019, over 10,000 foreign national offenders have been removed from the United Kingdom. In the last month alone, flights have left to Albania, Romania, Poland and Lithuania and now, this morning, to Jamaica—a flight I expect to land while I am on my feet.

It was under a Labour Government that the UK Borders Act 2007 was introduced and passed requiring a deportation order to be made where a foreign national has been convicted of an offence in the UK and sentenced to 12 months or more, unless an exception applies. We apply that law, but it is Labour MPs who now howl, time and again imploring us to halt the removal of dangerous foreign criminals from our streets with letters, questions to Parliament and campaigns on Twitter. We have even seen members of the shadow Cabinet defending criminals, with no consideration for the victims or their loved ones. Too often, Opposition MPs are ignoring the law-abiding majority and, by extension, standing on the side of criminals, including paedophiles, murderers and rapists.

Let me set out some facts of the flight that departed this morning, because I know this is of real interest to many Members of this House. First, the offences committed by individuals on the flight include rape of a minor, sexual assault against children, firearms offences, dealing and importing controlled drugs, and other violent crimes such as actual bodily harm. Between them, these individuals had a combined total of 58 convictions for 127 offences. These are extremely serious offences, which have a real and lasting impact on victims and communities. They are not minor matters, as some would have people believe.

Secondly, the flight to Jamaica makes up just 1% of total enforced returns in the year ending September 2021. Criminals who have no right to be in the United Kingdom are regularly removed to countries across the world, and we will continue to do this to keep our citizens safe. Public safety is non-negotiable. However, many more criminals could have left the UK today. What we have seen over the last 24 hours is more last-minute claims facilitated by specialist immigration law firms, as well as representations from Opposition MPs to prevent this flight from leaving.

It is no surprise that the Opposition voted against our Nationality and Borders Bill precisely because it seeks to address the merry-go-round of last-minute claims and to speed up the removal of dangerous criminals. Labour Members fought tooth and nail to prevent that Bill from becoming law, and votes have consequences. Convicted criminals guilty of heinous crimes, including manslaughter, rape, robbery, child sex offences, drug offences and violent crime, and persistent offenders remain in our country; had the legislation been passed more quickly, with Opposition support, those individuals might have been removed from the UK today. They remain here, and it is a stain on our country that they do. However, I assure the British people that we are taking action, and things are changing as we get on with delivering our reforms.

I make no apology for removing criminals who have abused our hospitality, broken our laws, and have no right to be here. I make no apology for doing everything in my power to make our streets safer and stand on the side of actual victims. We stand with the British people. It is time that the Opposition tried that as well.

My hon. Friend and constituency neighbour speaks with great authority on these matters, and I know the view that people in Northamptonshire take on this. I have been on a removal flight to Poland a few months ago, which was a useful experience for me to understand the end-to-end process. I am grateful for his support for the Nationality and Borders Act 2022, which introduces the one-stop processes and priority removal notices that should enable us to break this cycle of endless dither and delay, and constant appeals and claims, so that those individuals are removed from our country more quickly. His constituents can be assured that we are getting on with delivering this.

It is fair to say that there are significant costs associated with these removal operations. As I say, with scheduled flights more readily available in the period ahead relative to the last two years of covid, I hope that it will be easier to facilitate removals from our country more cost-effectively. As a Government, we spend millions of pounds a year dealing with this, but it is right and proper that those with no right to be here and those who commit serious offences on our streets do not remain in the United Kingdom. That is an obligation that we will continue to live up to. As I say, we live up to the requirements of the law on that, as is right and proper, but I will certainly take away my hon. Friend’s wider point and gladly share any information that I can about specific costings.

I am grateful to my hon. Friend for his question. What I can say for the House’s benefit is that, on homeworking, it is fair to say that, as in society as a whole, business as a whole and Government, we are seeing staff returning to the office to work. Of course, people’s working arrangements are in accordance with the approach taken within the Government to these matters. There is the expedited process after 10 weeks for individuals who require it, where passport applications have not been processed within that timeframe. As I have said, 98.6% of passports are renewed within the 10-week timeframe. If he has specifics that he would particularly like to raise with Ministers so that we can take those away and look into them, we will very happily do so.

I am always grateful for the constructive way in which the hon. Gentleman approaches these matters. Calls are charged at the local rate. I set out for the House the steps being taken to boost capacity in Her Majesty’s Passport Office but also in relation to the contractors that we work with to deliver these services. It is also the case that, after 10 weeks of proof of travel, within two weeks, the upgrade is free, should that be required. Again, I go back to the fact that 98.6% of passports are renewed within the 10-week timeframe and more than 90% are processed in just six weeks. However, it is right, in terms of the remainder, that we make the interventions we are making to improve matters. We want to see the best service possible delivered and that is precisely what those interventions seek to do.

There was quite a lot there, Mr Speaker, and I think that if I were to answer all of that, I would be at real risk of incurring your wrath. Two million passports were issued in March and April alone. The hon. Gentleman is a canny parliamentarian who took the opportunity to raise this issue in business questions. He will have noted from my earlier responses the steps that we have been taking in that period to address this issue. We will see that work through. This is all about bolstering capacity and resource, but if he would like us to look at specific cases, I am very happy for him to share them with us so we can perhaps understand where he thinks the issues are.

Mr Speaker, may I begin by joining in, on behalf of the Home Office, your tribute to PC Keith Palmer, who lost his life five years ago today? All of us who were in the House will never forget that day. It was an enormous tragedy; he died in the line of service, protecting our democracy and the people in this place. We will be forever grateful to him and his family, and our thoughts are very much with them today, and with everybody caught up in that terrible tragedy on Westminster bridge.

This country has a long and proud tradition of providing sanctuary to those in need. The British people are generous and compassionate, and we only have to look around us to see that compassion in action right now. I think I speak for the whole House in thanking everyone stepping up to support people fleeing the conflicts in Afghanistan and Ukraine.

This Bill is about delivering a long-term solution to the long-term problems that have beset the asylum system over decades. It has three central objectives: to make the system fairer and more effective so we can better protect and support those in genuine need; to deter illegal entry, breaking the business model of evil criminal trafficking; and to make it easier to remove those with no right to be here.

The reforms we are introducing through this Bill have been debated at length both in this House and the other place, and I want to put on record my thanks to all Members for the rigour with which they have scrutinised the measures we have proposed. I also want to say that as the Bill has progressed through Parliament, this Government have been listening carefully to the questions and concerns raised not only by Members but by the many organisations, communities and individuals who have been carefully following its progress.

We have amended the Bill to clarify that new measures to tackle people smugglers will not criminalise those acting under the direction of Her Majesty’s Coastguard. We have also introduced an amendment to resolve the lawful residence issue that has troubled many individuals with indefinite leave to remain under the EU settlement scheme and who wish to naturalise but have not previously held comprehensive sickness insurance.

In response to the appalling situation in Ukraine, we have added new powers to enable us to impose visa penalties on countries posing a threat to international peace and security or whose actions lead, or are likely to lead, to armed conflict or a breach of humanitarian law. We have also announced an expansion of the Hong Kong British national overseas route, which will enable individuals aged 18 or over who were born on or after 1 July 1997 and have at least one BNO parent to apply to the route independently.

Before going further, I would like to say something more about the situation in Ukraine, in particular the calls we have heard in respect of unaccompanied children. We of course recognise the deeply troubling circumstances faced by all Ukrainians who are caught up in this conflict, and we of course acknowledge calls for support to Ukrainian orphans and unaccompanied children. However, the UK cannot act unilaterally on such matters, and the views of affected Governments must be taken into account. The Ukrainian Government have been clear that children must not be taken into care without the prior agreement of their authorities; we cannot simply transfer unaccompanied minors to the UK without first securing their authorisation. It may be in the best interests of many children to remain in the region given that it is common for those labelled as orphans by the media who are in the Ukrainian care system to have living parents, and ultimately their Government, whom they are not fleeing, should have the final say on these matters.

We are working urgently, however, with the authorities in Ukraine and Poland to secure the final agreements needed to bring to the UK a group of over 50 Ukrainian children, known as the Dnipro kids, who have escaped the brutal war and are currently in Poland. I recognise that many Members are following that issue closely and have a keen interest in it, and Home Office Ministers will keep the House updated. This is a complex case, and it is absolutely right that we wait for the appropriate checks and written permissions before bringing these children to the UK. The Home Secretary and her counterparts in the Ukrainian, Polish and Scottish Governments are united in their determination to ensure these children get the right support and the care they need.

However, I remind the House that our Ukraine family scheme also provides an immediate pathway for those Ukrainians, including unaccompanied children subject to safeguarding checks, with family already settled in the UK to come to our country. We would expect most children to apply in family groups, such as a parent with a child, but I can assure colleagues that this scheme is designed to allow as many people as possible to come to the UK and to give them immediate access to the support they need. We must do nothing less.

Returning to the Bill, Members will have seen that many amendments were proposed and agreed to during its passage through the other place, including some proposed by the Government. The Government have carefully considered each of the non-Government amendments, and I would like to explain what we have concluded and why. But before doing so, I would like to offer an apology to the House for the late publication of the updated explanatory notes. Manuscript copies of the updated notes have been distributed, but I accept that they should have been published online on Friday, and I am sorry that this did not happen—for that discourtesy I genuinely am apologetic, Mr Speaker.

On amendment 1, relating to access to British overseas territories citizenship and British citizenship for Chagossians, I again place on record my sympathy with the Chagossians for how they were treated in the 1960s and 1970s. I also want to place on record my admiration for the way in which Members from across the House have championed their cause, in particular my hon. Friend the Member for Crawley (Henry Smith), who has been a consistent and tireless advocate on this issue for many years; he has run an exceptional campaign. We have listened carefully to the concerns raised in both Houses and in the Chagossian community on the difficulties faced by Chagossians in accessing British nationality. These difficulties have arisen from the unique historical treatment of those who were removed from the British Indian Ocean Territory in the 1960s and 1970s and the limited recognition of those circumstances in British nationality law. Given that, the Government have concluded it would be appropriate to take action in this Bill, consistent with our other measures designed to correct historical unfairness in nationality law, and will put forward an amendment as such. This will mean there is a new route to British nationality for direct descendants of the Chagossians removed from the British Indian Ocean Territory. In doing that, we are satisfied that the Chagossian diaspora is unique and we are not setting a precedent that would undermine the general principles governing the acquisition of British citizenship by descent. Further details will follow in due course, and I want again to say a huge “Well done and congratulations” to my hon. Friend for helping us to bring about this important change.

I know, not least because he chaired the Nationality and Borders Bill Committee, that he understands and appreciates the pressures that the Department and Government are currently experiencing in relation to the small boat challenge.

I appreciate that the current pressures are real and challenging for our staff on the ground, and we must be responsive to the issues and challenges they face in going about their work. Of course, this issue has come about directly in response to the high numbers of crossings we have seen, which have been so vivid, and about which I know people across our country are concerned. Safety is very much at the forefront of our consideration, not just for the arrivals, but for our staff in the way I have alluded.

My right hon. Friend has raised a number of points that I want to pick up in responding. It is fair to say that consultation is ongoing—I make the point again that we are having to respond to these challenges at pace—including with local authorities, the NHS, him as the constituency Member of Parliament and the police, for example. We have had to move at pace, and the most recent inspection confirms how important it is that we take the steps we are proposing. As I say, my officials spoke about our plans with local political leaders, their officials and the local police at the first opportunity, and they will continue to do so. I welcome their constructive engagement so far.

My right hon. Friend asked when activities at this facility will start. We are planning to have potential overspill facilities in place over the next few days. In terms of volumes, we will keep that under review. At the moment, we are assessing the capacity and capabilities of the site and what is appropriate to it, and there will of course be times when the site is empty, when crossings are not happening. He asked who will go there. This is an overspill site for Tug Haven and initial processing. We would expect men, women and children to go there as necessary, but for a maximum of five days. We will manage unaccompanied asylum-seeking children separately under the existing arrangements with social services.

My right hon. Friend asked whether this is a permanent arrangement. We will keep our use of the Manston site under review, but we expect to continue to use it for some time. He has suggested some alternatives. If he would like to share those details with me, I would be happy to take that away and look at what he is suggesting, but I go back to the key point in all of this, which is that the Government’s objective is to end these channel crossings. That is the objective we continue to work towards, and it is what the British people expect. We have a comprehensive plan of action—I have set it out many times in this House—for how we achieve that. Of course, getting that right means that there would not then be the need for facilities such as the one he has concerns about.

My hon. Friend is, of course, absolutely right. It is particularly staggering that in Committee the shadow Minister, the hon. Member for Enfield, Southgate (Bambos Charalambous), condemned the record of the previous Labour Government, who used to argue that people should not be making crossings of this sort, and that they should claim asylum in the first safe country that they reach. That is exactly what should happen.

I am grateful to the hon. Gentleman for his question. We are working across Government on these matters. I know that engagement is going on through the Foreign, Commonwealth and Development Office with the authorities that he describes. We have a proud record and tradition in this country of providing sanctuary to those who find themselves in desperate circumstances. That absolutely continues to be the case. That is a firm commitment of this Government and it is perfectly in line with this country’s proud traditions. People across our country would expect us to continue to do that, and that is exactly what we will do.
