“failed to take all appropriate measures to address grave and systematic violations of the human rights of persons with disabilities and has failed to eliminate the root causes of inequality and discrimination.”
With those damning findings in mind, will the Minister confirm whether an equality impact on the proposed welfare reforms has been carried out, and if so, can we expect it to be made public?

Commons ChamberWith permission, Mr Speaker, I will briefly pay tribute to my constituent Henry Wuga, whose funeral took place earlier today. Henry, who came to Glasgow on the Kindertransport, was a truly remarkable man. He and his late wife Ingrid made an enormous contribution to Scotland and the world through their work as holocaust educators. His legacy is truly immense, and I am sure that the House will join me in sending our thoughts to Henry’s family. May his memory be a blessing.
The increase in antisemitism and Islamophobia is eye-watering. It should be of serious concern to us all. Urgent action is needed on both fronts, and community cohesion and dialogue must be a priority. In recent months, there has been a 335% increase in Islamophobic hate cases in the UK. None the less, and despite our just having had the International Day to Combat Islamophobia, the UK Government have not convened the anti-Muslim hatred working group in more than four years. Now that the next anti-Muslim hatred adviser has quit over extremist threats, we need concrete answers. When will the Government take tackling Islamophobia seriously?

Commons ChamberThat right to flexible working would particularly benefit workers with caring responsibilities, most of whom are women, but unfortunately the UK Government’s response to the results of their consultation on flexible working simply does not go far enough to provide some of the real practical support needed by many people with such responsibilities. Last week Nikki Pound of the TUC told the Women and Equalities Committee that one in three requests for flexible working were denied by employers. What steps are the UK Government taking to give real support to workers with caring responsibilities and ensure that flexible working is a day-one right by default?

Commons ChamberThe risk of perpetuating inequality and the problems that arise from solely automated decision making are well accepted both in recruitment and, as we heard earlier, in the challenges for disabled people in accessing employment, but also in other contexts such as immigration and welfare benefits. However, the UK Government’s Data Protection and Digital Information Bill is liberalising the use of artificial intelligence in decision making and reducing the rights of people to appeal those decisions. Does the Minister understand that it is increasingly important to make sure that we mitigate risks such as encoded bias? What is the specific plan to do that?

Commons ChamberThe UK Government’s “Inclusive Britain update report” acknowledges the value of measuring the ethnicity pay gap and the Government have published guidance for employers noting that employers can use ethnicity pay gap calculations to consider evidence-based actions to address any unfair disparities. Despite that, the UK Government will not legislate to mandate reporting. Since employment law is a reserved matter, will the Minister urge her Government to do the right thing and mandate ethnicity pay gap reporting, or urge the devolution of employment law to Scotland so that the Scottish Government can?

Commons ChamberThe UK Government recently published statistics showing a 35% gender pension gap in private pensions, and recent research by the TUC suggests that more than one in 10 women are in jobs where their employers did not have to enter them into a workplace pension compared with fewer than one in 20 men. According to calculations from the Prospect union, the income gap between men and women in retirement is therefore now 40.5%, which is more than twice the level of the gender pay gap. What action is the Department taking with Cabinet colleagues to close that shameful gap?

Commons ChamberAccording to the Fawcett Society, the UK Government lag behind other European countries in making companies act to close the gender pay gap and they have failed to introduce mandatory reporting of pay differences based on ethnicity. If the UK Government are serious about driving down pay inequality, why will they not require employers to set out action plans to improve gender equality and why will they not mandate intersectional ethnicity pay gap reporting? If they are not serious and they continue to refuse to act, will they devolve employment law to Scotland so that we can do it ourselves?

Commons ChamberAs I highlighted to the Leader of the House last week, the gender pay gap between women and men currently sits at nearly 15%. We know that women are not a homogenous group, so that gap will vary further based on intersecting characteristics, including ethnicity and disability status. Will the Minister, in line with the theme for this International Women’s Day, embrace equity by mandating gender pay gap reporting and action plans for all employers, as well as introducing ethnicity and disability pay gap reporting requirements?

Commons ChamberThis week, the UK Government rejected outright five recommendations of the Women and Equalities Committee on menopause and the workplace, and they are not committing to any new work in response to the report. The Chair of the Committee, the right hon. Member for Romsey and Southampton North (Caroline Nokes), described the Government’s progress as “glacial” and their response as “complacent”. She pointed out the missed opportunity to protect vast numbers of talented and experienced women from leaving the workforce. Will the Minister change tack? Will she commit finally to acting on menopause and the workplace? If she will not, will she commit to look again at why devolving employment law in Scotland matters so much, so that we can do that work?

It is important that we show tolerance and, more importantly, that we show respect to each other. Nothing should inflame the tensions that will already be running high. I thank the hon. Member for raising that point with me. I say to all Members: please, think long and hard before you speak, because messages that you give in this House can be reflected in a way that I do not wish to see.

Member for South West Norfolk (Elizabeth Truss)—the most recent former Prime Minister—described conversion therapy as an “abhorrent practice” in the ministerial foreword to the Government’s consultation on banning conversion therapy. Some 11% of trans people in the UK report having been subjected to that so-called therapy by their own families, and those individuals who are subjected to the practice are significantly more likely to have attempted suicide than their peers. I am disappointed in what I have heard, which seems like more kicking into the long grass. Does the right hon. Lady understand that conversion therapy is abhorrent? If so, why will her Government not commit to preventing this harm to trans people by banning the practice for everyone?

Yesterday, the Prime Minister was asked six different times to apologise for the disaster of the Tory mini-Budget and the financial crisis it caused, and all six times, he refused to say sorry. This morning, people are waking up to the news that this Christmas, they will be hit with the worst inflation in 41 years, so will the Deputy Prime Minister stand up today and do what his boss would not? Will he say sorry?

Commons ChamberThis Tory Government have committed to introducing an employment Bill at least 20 times, but it is nowhere to be seen. Meanwhile, labour market inequalities become all the more acute, especially in the cost of living crisis. The Minister could tell us that she will fix the sick pay system, introduce the day one right to flexible working, improve parental leave and pay and strengthen protections against pregnancy and maternity discrimination, but her Government are making a choice not to do those things. That is a real contrast with the Scottish Government’s recent “Building a New Scotland” paper, which sets out how an independent Scotland would deliver fair working practices. Why do this Tory Government support inequality in the workplace?

Commons ChamberToday, Scotland’s First Minister set out an optimistic, ambitious and credible economic plan for Scotland’s future—a leader who spent over an hour setting out and answering questions on the positive case for our country’s independence. That is in stark contrast to a Prime Minister hiding in Downing Street, terrified to answer for the mess she has made—the mess that will cause so much harm to all our constituents. Mr Speaker, I am going to keep this short and to the point. Can the Leader of the House tell us: where on earth is the Prime Minister? If she does not even have the backbone to show up here today, is there really any point in her showing up here again? Surely, time’s up. She needs to go and let the people decide.

The SNP condemns the Iranian regime’s violent crackdown on protesters, particularly women, in the strongest possible terms. We are deeply concerned by the regime’s vow to crack down further “with no leniency”, which appears to be an ominous indication of further mistreatment.
The bravery of Iranian citizens, especially Iranian women, is inspiring, and we stand in full solidarity with them. We wish to hear the UK Government explicitly recognise the death of Mahsa Amini as femicide. I am also keen to understand how they intend to go forward with international partners, for instance in calling for an independent investigation and raising the mistreatment and killing of protesters at UN level.
We would welcome clarity on how the UK Government are able to support the free flow of information to help to protect protesters—particularly women—and on what plans are in place to support ethnic minorities such as Kurds amid this regime crackdown.

They report that one in six UK households is suffering serious financial difficulties, and the situation is getting worse. Many households have reduced the quality of the food they eat, sold possessions or cancelled insurance to help them to cope. Single parents, disabled people and larger families are among the worst affected. What steps does the Chancellor of the Duchy of Lancaster intend to take to tackle the price rises that are driving this inequality and poverty?

The reality is that the UK Government are pushing communities down, not levelling them up. Will the Minister ask the Chancellor to follow the example of the Scottish Government and provide families with the support they need to get through the Tory cost of living crisis?

I am grateful to the right hon. Member for Chingford and Woodford Green (Sir Iain Duncan Smith) for securing this urgent question. The direction of travel and the stifling of democracy in Hong Kong is obviously deeply concerning and something we should all deplore. Human Rights Watch said of Cardinal Zen’s arrest:
“Arresting a 90-year-old cardinal for his peaceful activities has to be a shocking new low for Hong Kong, illustrating the city’s free fall in human rights in the past two years.”
That is correct. Rather than colluding with foreign forces, which is what they have been accused of doing, those arrested have simply helped the people of Hong Kong in the face of an increasing crackdown and autocracy.
Will the Minister pledge to the House that every possible diplomatic avenue will be explored to try to secure the urgent release of these four individuals, alongside other pro-democracy campaigners? Will he clarify what diplomatic discussions the UK Government have had on the situation in Hong Kong, and further outline the strategy to try to influence the situation? Finally, will he tell us more about the UK Government’s assessment of the likely impact on democracy of John Lee’s appointment?

Commons ChamberI would like to add my best wishes to the hon. Member for Bridgend (Dr Wallis). The Scottish Government are clear about the need to act to end conversion practices in Scotland. They have established an expert advisory group to inform their approach to banning this abhorrent practice. The group will include people with personal experience of conversion practice, representatives from LGBTI organisations, faith communities, mental health professionals and academics; it will meet for the first time tomorrow and complete its work by the summer, reflecting the Scottish Government’s recognition of the urgency of the issue. Given that the UK Government’s consultation on their proposed ban ended on 4 February, can the Minister confirm that the UK Government’s approach will be taken forward on a similarly inclusive and urgent basis?

Commons ChamberMaternity Action has recently highlighted that
“over the past decade the value of the basic rate of maternity, paternity and parental pay has also declined relative to women’s median weekly earnings, from 42% in 2012, to just 37% from April this year.”
Of course, new parents now also face a Tory cost of living crisis. There is overwhelming evidence for the value of supporting the youngest members of our society and the families who care for them, so will the Minister urge her colleagues to match reality to the rhetoric, introduce the long-awaited employment Bill and take the steps necessary to support parental leave and pay to better support new parents?

Commons ChamberCovid forced short-term modifications to working practices, which demonstrate that change is possible, but proactive steps are needed to secure long-term improvements in flexible working to support the work and caring responsibilities of women in particular. Does the Minister agree that flexibility should be available from day one of a new job rather than being a possibility six months in, will she ensure that the forthcoming employment Bill provides for that, and will she confirm that that Bill will be in the Queen’s Speech?

Commons ChamberThat is just not the case. We know that we cannot trust a word that the Prime Minister says on this. He told us that there was no threat to the Erasmus scheme, but he clearly will not match EU levels of support. And it is not just us saying it; his own Scottish colleague, the hon. Member for West Aberdeenshire and Kincardine (Andrew Bowie), told the BBC last week that young people will not benefit from Brexit. The Government have saddled a generation with tuition fee debt, and are now closing the door on Erasmus. It is no wonder that students are choosing the SNP and independence for a prosperous future. Prime Minister, will you think again, do the right thing, engage with our EU friends and rejoin Erasmus?

Commons ChamberThank you, Mr Deputy Speaker, for calling me to take part in this important debate. It has been interesting listening to the contributions of other hon. Members and, in particular, to the excellent speech made by my hon. Friend the Member for Glasgow South West (Chris Stephens). I hope to make a contribution from a slightly different perspective from that of some of my colleagues today.
Before being elected to this place, I spent all my career working in human resource management. In the interests of transparency, I should say that I am a member of the Chartered Institute of Personnel and Development. I worked for many years in a job where I sat as part of the management side in negotiations with trade unions, so I come to this debate with an outlook developed at least partly as a result of my professional background. I am contributing as someone who has had to make difficult decisions when dealing with challenging employment issues, including collective redundancy negotiations and industrial action.
I also come here, however, as someone who knows that the most challenging situations and all the difficult discussions were entirely more productive and more effective, and carried more weight, because they were dealt with in partnership with trade unions. I did not always agree with my trade union counterparts, and they certainly did not always agree with me, but that is surely the point: sometimes there will be different perspectives, and that is entirely healthy and appropriate. It is clear that when tough decisions have to be made, communication is the key to an effective and productive workplace culture. We do need to accept, however, that occasionally we will not agree, no matter how much discussion we have had—that is a fact of life—and no Bill will make employers and staff agree on everything.
What this Bill will do is: ensure that any disagreement is squashed by management, without any constructive dialogue; render any dialogue that there is futile; and ensure that the important and constructive voices of staff are lost, drowned in a welter of arguments about minutiae of process or brushed aside. This Bill is a recipe for turning disagreement into conflict, and for escalating a short-term problem into a fundamental break in relationships in the workplace. Interfering in the employment relationship with this restrictive and provocative Bill is a backward step. It appears to be driven more by ideology, and by malice towards trade unions and their members, than by any desire to improve industrial relations.
We have already heard about the leading academics in industrial relations who wrote to the newspapers describing the proposals as “draconian” and “perverse”. They recognise the positive contributions of unions to performance, improvement and innovation in the workplace, and they decry the Government’s proposals as undermining the ability of unions to protect terms and conditions, and leading to the loss of employee voice. They are right to point out that this Bill will also have an impact on those who are not members of trade unions. They say that
“it will feed into the labour market by increasing endemic low pay and insecure terms and conditions of employment among non-unionised workers.”
Even the Chancellor is now persuaded that low pay is a problem that we have to grapple with, so we must wonder why the Government are so keen to introduce this Bill. If they were serious about looking at the relationships between employees and their representatives, they would focus on how to engage and involve employees and unions in increasing productivity, through fairer and supportive rights for workers. If we look at the current levels of industrial action, as summarised by the Library, we see that it is difficult to fathom what reasons, other than ideological ones, the Government can possibly have for seeking to make these changes. The Government sell themselves as being interested in productivity and business, but these proposals run entirely contrary to that ethos. The Bill introduces unnecessary new and complex bureaucracy: it will increase costs for unions and employers, as legal disputes develop; and it undermines social justice. If this Bill is passed, and I sincerely hope that it is not—
