Commons ChamberI am grateful to my hon. Friend for that intervention. I do think there is a trust issue. I hope that that can improve. The letter to President Tusk was an example of that because, having supposedly taken no deal off the table, the only extension that was asked for was one in the event that the meaningful vote failed, rather than if it went through. That left the prospect, but for what the European Council decided last Thursday, of no deal this Friday going back on the table, just a week after we thought we had taken it off the table.
So we do need to get into Wednesday. We need to have an intense discussion about how the votes on Wednesday are to be taken and see whether we can reach a consensus about that, reach a majority and find where that lies. We need to consider the credible options. Labour has long advocated a close economic relationship, including a customs union and single market alignment, but we have also made clear our support for a public vote as a lock on any deal that the Prime Minister passes. The Leader of the Opposition and I have met colleagues to discuss these proposals and the other ideas that have been put forward by other colleagues. What we need to do now is to agree the process for having a proper debate and to look at those and other credible options.
Does the right hon. and learned Gentleman agree that there is a difference between the people’s vote/public vote option and the others? The others relate to a substantive route forward on Brexit. A public vote is a way of ensuring that there is a broad consensus and the public are behind whatever consensus this House may find favour with.
That is a very important intervention. Obviously, discussions will take place in the next two days, but the basic proposition that the House needs to decide the substance of any deal it might be able to support—and, arguably, to look at the process around it separately—is important, because some of these options are not like-for-like options, in that some are about substance and some are about process. It would be perfectly possible to make the argument that, if there is to be a deal, it ought to be what we consider to be the least damaging deal. We could have an argument about what that looks like. Equally, it would be possible to say that, whatever deal there was at the end of that exercise, it ought to be subject to the lock or safeguard of some sort of confirmation vote. I do not know. I am not anticipating how the votes would go, but I can see that one of those decisions is about the substance of the issue and the second is about the process. We are going to have to grapple with that before Wednesday.

Commons ChamberI absolutely agree. The right hon. Gentleman has probably—like me—been having those conversations with lawyers, officials and politicians across the 27 EU countries. All three of those views have been expressed to me by officials and politicians, including the view that, if it were necessary to go beyond June for an agreed purpose, that could be possible without our being involved in EU elections. I do not pretend for a moment that there are not legal implications, and I do not pretend for a moment that it would be easy, but I do know that this is a discussion that could be had.
I strongly agree with what the right hon. and learned Gentleman is saying. Does this not underline the fact that continuing to delay a decision because the Government are not getting the answer that they want, and their own delay of crucial votes, means that we have a tendency to be overtaken by events? We clearly do not like the prospect of European Union elections, but other events may intervene to complicate the House’s ability to make decisions. We should get on with the process that will unblock the gridlock, so that we can move things forward and move our country forward.
I agree with the right hon. Lady. One of the frustrations is that we are now faced with arguments from the Government that the period of time for an extension must be really short for various reasons, yet they ran away from the vote on 10 December. We could have known on 11 December that this deal was never going to go through. We would then have had three and a half months left on the clock before we even got to any question of an extension, and then another three months, even on the Government’s own analysis, to try to sort the problem out. Yet here we are, with 15 days to go, having this discussion about an extension in the worst of circumstances, and we are doing it for one reason. That is that the deal that was signed on 25 November and that could have been put to the vote on 11 December was pulled. Not one word of that agreement has ever changed. All that has happened is that we have been waiting for three-plus months to vote again on the same proposition. We cannot waste another week doing the same thing next week.
This is an important debate, but I think that most members of the public who are listening to it or watching it are probably losing the will to live, as I am. Yet again Parliament has confronted a long-term issue, on this occasion Brexit, and has failed to find a long-term path forward. I think that the only difference with Brexit is that there was a deadline for it, and today we are discussing the fact that that deadline is about to be missed, because we are simply not prepared for a departure on 29 March.
There is gridlock in this place, and we must find a way through it. I am sorry to say that while I think there may be a consensus here, I also think that the steps the Government have taken to keep bringing back so-called meaningful votes have actively got in the way of Parliament’s finding a consensus on a way forward. Ministers need to understand that there is no point in calling those votes meaningful any more, because they are actually meaningless.
Although we are on different sides of the argument, I have great respect for my right hon. Friend, but does she not remember that the “meaningful votes” considerations were inserted in the legislation not at the will of the Government but at the will of Back Benchers, and that the House agreed to the 29 March deadline across all parties? Now, for some reason, some of those Members do not want to agree to it.
Indeed, and the purpose of the meaningful vote was to ensure that Parliament could give its assent to a path forward, which was a very sensible step.
The original deadline of 29 March was part of the outcome of the Lancaster House speech, in which the Prime Minister said, “We will have agreed a future partnership by the end of the two-year article 50 process.” That, of course, has not happened. The speech also set out for the first time the Government’s position that no deal was better than a bad deal—“no deal”, in that context, referring to a future partnership. We are effectively leaving with no deal, and that is one of the reasons we have reached the point today of having to discuss the fact that we still cannot find a route forward, although we absolutely need to. After last night, it is clear that there is little appetite in the House for leaving with what I would now call a double no deal—in other words, no future partnership, and no agreement on how we even withdraw from the European Union itself.
A meaningful vote 3.0 is, as I have said, an oxymoron in the context of the votes that the Government plan to bring forward. Yet again, it will risk Parliament failing on a long-term issue, because achieving consensus on one vote at one moment does not achieve real consensus. It is a fake consensus that will simply unravel, again disappointing the public, who want to see us get behind a real route forward. The Government now need to understand that their deal is simply not popular, either here in this House, for very valid reasons, or with the public.
I appreciate the right hon. Lady allowing me an intervention. The repeating of meaningful votes seems somewhat ironic, in that Parliament can vote repeatedly on the same deal yet the British public cannot do so, but let us gloss over that for a moment. Does this not do a disservice to Parliament? Surely the 52:48 referendum result and the disastrous 2017 general election result are the only reasons needed to prove that this Government are in office but not in power, as we saw again last night. This House has a job to do, but we are being deprived of our ability to do that job for our constituents and to be involved in finding a solution.
I agree that we need collectively to find a way forward. Party politics and both Front Benches have got in the way of our doing that. In the context of the steps we now need to take, I agree that we need to have votes on the alternative proposals—common market 2.0, Malthouse or whatever—so that we can test whether there is consensus behind any of them, but those votes should be free votes. Brexit is not about party politics. The party machine constantly whipping votes does not serve our country or this vitally important issue well, and it is getting in the way of the House genuinely finding out whether we can agree on anything apart from the fact that we do not like the Prime Minister’s deal.
I personally think that the way to achieve this is to recognise that there is a spectrum of opinion in this House. People hold their views in totally good faith. They represent very different communities and they themselves have different views on Brexit. This is perhaps one of those naturally binary and quite divisive topics, and we have to confront that fact. That is why I do not think we will reach a conclusion on this gridlock. We have to stop circling around the issue. Ministers now need to show some leadership and unblock a route forward with parliamentarians in this place.
Frankly, I would be happy for people to pick from a spectrum of very different outcomes for this country’s path forward. The reality is that we had a referendum about leaving the European Union, not about where we were going to go. We cannot agree on what people think the destination should be, and we therefore need almost to finish off the referendum. We need to go back to the people with a further one to find out where they actually want to go. That is the choice. We will end up with a public vote on Brexit. It is a question of whether it will be a general election, which I do not think will resolve the issues that this House continues to grapple with, or a public vote on Brexit—the actual issue at hand, on which we desperately need to find a direction for our country.
If an extension allows us the space to finally come up with a strategy for a route forward, it will have been worth it purely for that. From my perspective, it should be the shortest possible extension that will give the House the space to do that. It should not be an open-ended extension that would simply give us the chance to go round in circles, achieving nothing and destroying investment in this country.

My right hon. Friend the Member for Loughborough said that there is no point in discussing the political declaration. She said that all we need to do is vote for the withdrawal agreement, and discussions on the political declaration will come later. We in this House must get real about what the meaningful vote and the withdrawal agreement mean two to three steps down the line.
My hon. Friend is making a very powerful point. It is easy to forget that when the Prime Minister set out in her Lancaster House speech the many tests and criteria that she felt we needed for a successful Brexit, one of them was to have a future partnership agreed over the course of the two-year article 50 period. As he will know, that was the first time that she mentioned the phrase “No deal is better than a bad deal”, but no deal in that context reflected the future partnership agreement, not just the withdrawal agreement.

Commons ChamberI will deal with the earlier intervention. It was put to me earlier that we should not adopt that course because of the social unrest that it might cause. There are a number of answers to that. First, this comes at a stage when we are trying to prevent no deal, and I do not think that no deal is going to be orderly and smooth; I think it is going to lead to huge problems up and down the country. Secondly, I think it important for us not to exaggerate social disorder, because to do so can encourage social disorder, and I am really worried about that. I am not suggesting for one minute that that was what the hon. Member for North Down (Lady Hermon) was doing—I take her interventions very seriously, as she knows—but I do not think we should casually say that there will be social disorder.
The third thing I want to say is this. I have been in this place for less than four years, but the idea that we would not take the right next step as a matter of principle because we thought that there might be social disorder is a very slippery slope.
Does the right hon. and learned Gentleman agree that if a Parliament simply guessed what version or outcome of Brexit people wanted, brought it about and then hoped that it was the right one for the British people, that would not be a pragmatic, sensible, sustainable or democratically acceptable way of proceeding?
I am grateful for the right hon. Lady’s intervention for two reasons. First, I have been very hard on the Prime Minister, I think justifiably, for the fact that she set out the red lines without any discussion about them in Parliament, or even, I understand, in the Cabinet. It was her almost personal interpretation of the referendum. In my view, many interpretations could have been applied to it, but that was not one of them.
The second reason is important. I am not sure that getting a deal that is not really liked through the House at the last minute is going to settle anything. If, on a sweaty night in March, a measure goes through that no one really likes, the idea that that constitutes closure is very worrying. Of course, we are building up the expectation that if a deal goes through, that will be it, Brexit will be settled and it will all be over. We will still be in the foothills, because all that will happen after that will be the negotiations on the future relationship, which is so thin at the moment.

Commons ChamberI say to the right hon. Gentleman yet again that he talks about firmly ruling out a no-deal option and there are only two alternatives to no deal: one is to revoke article 50 and stay in the European Union, which we will not do, and the other is to agree a deal. If he wants to take no deal off the table, I hope that when the deal is back, he will vote for that deal.
It is abundantly clear just from listening to the questions today that there is not a consensus in this House and that we do face gridlock. We have now run down the clock, and rather than wasting more time repeating votes that we have already had and that this House has already expressed its will on—for example, on no deal and on the Government’s deal and the withdrawal agreement—is it not now time that we all put our effort into recognising the gridlock and taking responsibility for deciding how we get out of it? I do not believe that it is going to change and we can keep on going round in circles, with all the damage that that does to businesses and jobs, or we can confront it, decision it and find a route forward for Britain.
Obviously, I recognise that my right hon. Friend feels very strongly about these issues. I want to see us able to deliver on the result of the referendum and to do that in what I believe is the best way for this country, which is to leave with a deal. That is what we will be working on. She talks about decision points. There will be a decision point for this House in a meaningful vote, looking at the changes that have been agreed with the European Union, and at that stage, I hope that every Member of this House will recognise the need to respect the result of the referendum in 2016 and to leave the European Union with a deal.

Commons ChamberI thank the hon. Lady for her question. She has raised an important point about the timetable, which was mentioned by my right hon. and learned Friend the Member for Beaconsfield (Mr Grieve). As I said, the 21 days in the Constitutional Reform and Governance Act 2010 are normally there because there has not been an opportunity for the House to see the nature of the agreement that it is considering. In this case, of course, the House would already have had an opportunity to approve the agreement. We are looking for changes in the agreement, but the vast majority of the agreement will not be changed in the discussions that we are having with the European Union, and the House has already been able to look at that as part of the meaningful vote. I am sure that, when a meaningful vote has been agreed on in this House, every Member will want to ensure that they are able to operate on a timetable that enables us to leave at the end of the two-year period, which was agreed by this House when we triggered article 50.
The Prime Minister is driving this House towards two options that the British people do not want. We have already voted in this House against having a no-deal departure, and we have also already massively voted against her own prime ministerial deal with Brussels. She has simply turned this exercise now into one of cobbling together enough support to win a vote in this House when, actually, we deserve so much more than that. It is not just about getting the ERG on board, or getting enough Labour MPs to switch sides, but about getting the British people on board for the future that lies ahead. That takes more than just votes here, more than just the results of grubby backroom deals. Is it not time to recognise that the only responsible action ahead of us is to go back to the people and get their seal of approval?
I have responded to questions of that ilk from my right hon. Friend on a number of occasions, and I have not changed my opinion. It is important that this House recognises that, having given the choice to the British people as to whether to leave or to stay in the European Union and having received the choice of the British people, we should respect that choice and deliver on it, and that is what we are doing.

Commons ChamberThe right hon. Gentleman raises a number of issues. He talked about the Belfast agreement. As I said in my statement, this Government will not reopen the Belfast agreement. I have never considered doing that and I would not do it. We remain committed to the Belfast agreement and to maintaining our commitments under it.
The right hon. Gentleman talked about the question of no deal and running down the clock. We are not running down the clock. I brought to the House a deal that had been negotiated with the European Union, and the House has rejected that. I say once again to the right hon. Gentleman, as I did earlier to the Leader of the Opposition and to other Members, that it is very simple: he cannot wish away no deal. Either we stay in the European Union or we have a deal. I believe that it is right for us to leave the European Union because that was what people voted for in the referendum in 2016. If somebody does not want no deal, they have to be willing to agree a deal. The point about sitting down and talking with people across this House is to identify those issues on which it will be possible for us to make changes such that we can secure support around this House.
I thank the right hon. Gentleman for his comments about the announcement we made today about the fees for applications for citizens. I commend my hon. Friends the Members for South Leicestershire (Alberto Costa) and for Bexhill and Battle (Huw Merriman) and my right hon. Friend the Member for Chesham and Amersham (Dame Cheryl Gillan), but the issue was also raised by other Members across this House.
Finally, I will say to the right hon. Gentleman, as I have said before and will continue to say, that for the Scottish National party to stand up and say that the best economic future for Scotland is to be outside the United Kingdom is to fly—[Hon. Members: “Hooray!”] Well, I have to say to every one of those Members who is cheering that thought that that is to fly in the face of economic reality, because the reality is—[Hon. Members: “Hooray!”]
I wonder whether the Prime Minister and, indeed, the Leader of the Opposition recognise that with just two months to go, the past week has shown that party politics and Westminster will not deliver a resolution on Brexit, because party politics is not the same as Brexit—it is separate from party politics—so the situation will not change and the House will not find a route forward. The Prime Minister talks about social cohesion, but surely the most divisive thing to do would be for Members to vote through her deal knowing that our communities simply do not want it. Is it not time for us all to be honest about the fact that Parliament has run out of road? We have been debating for two and a half years; we could debate for another two and a half years and we still would not reach a resolution on Brexit. The only people who can do that now, surely, are the British people.
I recognise the passion with which my right hon. Friend is campaigning on this particular issue, but she is assuming that it is not possible to reach an agreement that will secure the support of the House. The purpose of what we are doing at the moment in talking with parties and Back Benchers across this House is to find those issues—I have indicated issues in my statement—on which we can move and on which we can then find that support across the House. I believe it is right for us to continue to work for a deal to leave the European Union on 29 March, and for us to do so with a deal that has secured the support of this House.

Commons ChamberI will support the Government today. This is absolutely no time for a self-serving general election called by the Labour party. What the British public now need the House to do is focus our efforts on finding a route to follow on Brexit.
The challenge of Brexit is not about whether it is Labour or Conservative; the challenge is precisely that Brexit is above party politics, and that is one of the principal reasons why the House has faced so many difficulties in trying to find a route on which people can coalesce. The British electorate have grown steadily more and more tired of some of the dysfunctional party politics that they see in our country, which too often prioritises short-term, press-release politics playing to its core base, irrespective of whether that reflects the position of the British public. Politicians should be able to work across parties if necessary to make the long-term decisions and deliver on the ground for the future generations of the British people.
I may have had my criticisms of my own Government and their strategy on Brexit. I think it was wrong to disenfranchise the 48%, and tactically inept then to disenfranchise the 52% by not delivering the Brexit for which they clearly felt that they were voting. However, all that we have seen from the Opposition is, as one of their own said yesterday, dither and delay. I think that many people, when they look back on this time in our history, will feel that both Front-Bench teams failed to rise to the challenge of delivering Brexit and a route forward.
The reality that we must all understand is that party politics will not solve Brexit. Every single minute that we spend in the Chamber today debating whether or not we should have a party-political general election is a minute lost, when we could have been talking about what kind of consensus there is in the House for some sort of route forward on Brexit—and all the time the clock is ticking down. The big question that we must all ask, and answer, is “How do we, as a Parliament, chart a route?” What I would say to Ministers, and to the Prime Minister in particular, is that this is not her Brexit process. The process on Brexit belongs to all of us. It belongs to our communities, and we must now work together to find a path forward.
That has two clear implications. First, it is now imperative for the Prime Minister not just to talk to the House and to parties, but to listen to what MPs are saying. Secondly, however, she needs to go beyond that and allow the House to vote on the different and clear options that lie ahead, just as we were able to have a meaningful vote last night on her deal. That, ultimately, is how we find out whether there is a consensus on anything.
Many Members clearly feel that delivering on Brexit now means that, if necessary, we should depart with no deal. We should have a proper vote on that to test the will of the House. Others feel that a different version of a soft Brexit—they may call it Norway, Common Market or 2.0—is now the route on which we could find consensus. The House should be allowed to vote on that. Talks will not ultimately clarify the position, but they will risk wasting time that we simply do not have.
I believe that in the end, if it turns out that there is gridlock in this place and that, very much like the British public, we find it hard to coalesce on a single route for which we can vote, we have to go back to people and ask them—not through a party-political election that will not fundamentally deliver—the question to which we need an answer: which of these three routes forward do they want? Do they want the Prime Minister’s deal? The House might have got it wrong and the people want that deal, in which case they should be able to vote it through. Do they want a hard Brexit—getting on with it, leaving on WTO terms? If that is what they want, they should be able to have that. Or do they think the existing deal is the best one we have got? We do not know. This House will not find a route forward, and therefore we should have the confidence to allow the people their say.

Commons ChamberThe hon. Gentleman raises an important issue about people with motor neurone disease. I note his point and will inquire about these issues with the Department for Work and Pensions. I will look into the issue and respond to the hon. Gentleman in writing.
The Prime Minister is sending Parliament off for a two-week break at the very moment that we have a Brexit crisis and no decisions. Our communities want us here, representing them in Parliament. If we are not even back until 7 January, how can she possibly say that we are doing our job? Is not the message to the British people, “Crisis? What crisis?”
We are in a very simple situation, as I am sure my right hon. Friend understands. Members across the House raised some concerns specifically in relation to the Northern Ireland backstop in the withdrawal agreement. We are having further discussions with the European Union on that matter to achieve the political and legal assurances that will assuage those concerns, and then we will bring the vote back to this House.

Commons ChamberWhat I am asking for is to ensure that we can deal with the concerns expressed by the right hon. Gentleman and other Members of the House about whether the backstop could or would be indefinite. There are two ways to deal with that. The first is to put in place arrangements to ensure that the backstop is not triggered in the first place, and the second is to ensure that if it is triggered, it is only temporary. As I said in my statement, I am seeking further political and legal assurances in relation to those issues, which can be achieved in a number of ways.
As others have said, on Thursday it will be 100 days until Britain leaves the European Union. At the moment, we have no deal and no plan B. This is a constitutional crisis because this House is not being allowed to express its will on behalf of our communities, who around the country are telling us that they reject this deal. That is why MPs want to be able to vote against it.
It is pointless criticising Members who are coming up with other solutions, whether it is a second referendum or Canada or Norway-style deals. We as a Parliament are trying to find a solution to the political cul-de-sac and mess that we find this country in. It was clear back in the summer that the Prime Minister’s deal was not going to succeed. She is now not only not listening; she is not allowing debate. This is totally unacceptable. Will she agree to bring the vote before the House before Christmas, so that she can reflect on the outcome over the Christmas break and then lead us?
I know that my right hon. Friend and I have different opinions on the issue of a second referendum. I have indicated when the vote will be brought back to the House. It will be necessary for the usual channels to agree what the business motion would be and how many days of debate would be available. We are not trying to stop debate. I am trying to—[Interruption.] I am recognising and reflecting to the European Union the concerns expressed in this House and seeking ways in which we can ensure that Members have sufficient confidence that those concerns have been addressed.
