Commons ChamberFirst, on the detention of Nazanin Zaghari-Ratcliffe, obviously, our thoughts remain with her and her family, and she has faced unacceptable treatment during her three years in jail. Our position is very clear: she was on holiday, visiting her relations. The right hon. Gentleman asks me to raise the issue, and I have raised it on a number of occasions directly with President Rouhani. The Foreign Secretary has continued to raise it with Iranian Ministers as well, and of course it was raised when my right hon. Friend the Minister for the Middle East was in Tehran over the weekend. It was possible to engage on this issue of those of our citizens who are detained. As I am sure the right hon. Gentleman knows, one of the issues here is the fact that the Iranian Government do not recognise dual nationality, and that is one of the issues behind this question of the detention of British citizens.
As regards the wider issues, at a time of increased regional tension and a crucial period for the future of the nuclear deal, it was right that my right hon. Friend the Minister for the Middle East was able to further engage with the Government of Iran about the UK’s long-held concerns over Iran’s destabilising activity and the danger it poses to the region. He was able to reiterate our assessment that Iran almost certainly bears responsibility for recent attacks on tankers in the Gulf of Oman and that such activity needs to stop, to allow the immediate de-escalation of these rising tensions. He was also clear that the UK will continue to play its full part, alongside international partners, to find diplomatic solutions to reduce the current tensions.
The right hon. Gentleman then went on to discuss the issue of no deal and these various points. The Chancellor of the Duchy of Lancaster pointed out yesterday that the implementation period is set out in part 4 of the withdrawal agreement. If we leave without a deal, there is no withdrawal agreement and therefore no implementation period. But the right hon. Gentleman again invited me to take no deal off the table and to do things to stop no deal. I am afraid that I will repeat to him what I have said to him on many occasions standing at this Dispatch Box, which is simply that he had three opportunities to take no deal off the table and he rejected every single one of them.
Given the welcome, strong statements by the European Council about Russia’s behaviour, does the Prime Minister share my concern about Russia’s possible readmission to full voting membership of the Council of Europe? Does she agree that it sends entirely the wrong message, coming just days after the filing of charges against Russian military officers for the downing of MH17, and when Russia remains in illegal occupation of Crimea?
My right hon. Friend has spoken up on the illegal annexation of Crimea on a number of occasions. We do not and will never recognise Russia’s illegal annexation of Crimea. As my right hon. Friend will be aware, there has been this difference in Russia’s position in the Council of Europe. Russia has not been paying its contributions to the Council of Europe, but its membership of that body is one of the few ways available to the international community to hold Russia to account for its human rights violations.

Commons ChamberI am sure the whole House will recognise the concerns of Harriet and her family. We want to ensure that patients have access to the most effective and innovative medicines, but obviously at a price that represents value to the NHS. NHS England has proposed its best ever offer for a drug. This offer is the largest ever commitment of its kind in the 70-year history of the NHS, and would guarantee immediate and expanded access both to Orkambi and the drug Kalydeco for patients who need it. We have been closely following the discussions, and the Secretary of State for Health and Social Care has offered a meeting with the global chief executive officer of Vertex, NHS England and the National Institute for Health and Care Excellence in an effort to move the situation forward for the benefit of patients.
Is my right hon. Friend aware that five years ago today Russian special forces seized the Government building in Crimea and raised the Russian flag? Will she confirm that the UK Government remain committed to the restoration of Ukrainian sovereignty over Crimea, and will she look at strengthening sanctions against Russia until that can be achieved?
I am happy to give my right hon. Friend that confirmation. This was an illegal annexation of Crimea by Russia, and we have been doing everything we can to ensure that the appropriate sanctions are imposed that will have an impact. We have been one of the voices around the EU Council table that has been advocating the roll-over of sanctions at every stage and ensuring that, as we look at the actions of Russia here and elsewhere, we enhance those sanctions and rightfully put pressure on those who are responsible.

Commons ChamberThe hon. Lady says yes to that. I have to say to her that it would not be respecting the result of the referendum, and that 80% of the votes cast in the last general election were for parties that said they would respect it.
Does my right hon. Friend agree that the whole history of the European Union has shown that time and again, when there are intractable disputes, agreement is obtained, often late at night, with about an hour to go before the clock runs out? Will she therefore stick to her deadline, and will she impress on the European Union that there is a majority in the House for her agreement if the necessary changes to the backstop can be made?
I thank my right hon. Friend for drawing attention to that issue in relation to the European Union. We are indeed in the process of those talks with the European Union, and have made clear to it that—as the vote in the House showed—there is support for a withdrawal agreement provided that we can see those necessary changes in relation to the backstop.

Commons ChamberThe hon. Gentleman could not be more wrong. It is this Government who are ensuring that by 2020 the funding available to support—[Hon. Members: “Now!”] The funding we are putting into further education is providing the best life chances for young people going into further education. It is this Government who are taking steps to ensure that young people can take up the opportunities that are right for them. For too long in this country, the assumption has been that the only way to get on in life is to go to university, and other ways, such as apprenticeships and further education colleges, have not been similarly respected. It is this Government who are ensuring respect for further education, and for technical education as well.
My right hon. Friend raises a very important issue. I certainly agree about the important role a free press and journalists play in our democracies, and I thank him for raising an issue that I know is important to him and many Members across the House. Sadly, as he says, 80 journalists we killed in 2018; 348 are currently in prison and 60 are being held hostage around the world. We are deeply concerned because, as he said, these numbers have risen on the previous year. That is why in 2019 we are placing our resources behind the cause of media freedom. We are helping to train journalists around the world, such as in Venezuela, where we have seen an authoritarian Government suppress their critics, and this year we plan to host an international conference in London on media freedom to bring together countries that believe in this cause and to mobilise an international consensus behind the protection of journalists. This is an important issue, and the Government are putting their weight behind it.

Commons ChamberThere is an important issue relating to some of the behaviour that we have seen. Members of this House have been victims of it, but others also have been on the receiving end of aggressive behaviour because they appear to hold a different view from those held by other people. It is important that we are able to have our debates on these issues—not just in the House, but in public—with dignity and respect. Yes, people will want to put their positions passionately, but there must be respect for the right of others to hold a different view, and to hold that view equally passionately. However, I also believe it is important, when the House has given a decision to the British people in a referendum, that we deliver on that.
I thank my right hon. Friend for listening to concerns expressed by a number of Conservative Members and for her recognition that there must be changes in the backstop, but will she also confirm that the aspects of our future relationship set out in the political declaration, which also cause some concern, are not legally binding, and can be addressed and changed in the course of the subsequent negotiation?
The political declaration sets out the framework for the negotiations in the future, but that has to be negotiated into legal text and, as I am sure my right hon. Friend knows, there are elements within that text which have not identified absolutely a particular position. In response to an earlier question, I referred to the balance between checks at borders and regulatory alignment. That is obviously a matter for the future negotiations.

Commons ChamberWe have been putting more money into our health service: we are going to give the health service the biggest cash boost in its history and a long-term plan that ensures the sustainability of the health service. In the eight years that I have been in government, under both the coalition and this Conservative Government, we have seen 3.3 million jobs being created across our country; that is good for the right hon. Gentleman’s constituents and good for constituents elsewhere.
My right hon. Friend said in her statement that alternative arrangements making use of technology could be put in place that would render the backstop unnecessary. Will she therefore incorporate those arrangements and go back to the EU and ask for a free trade agreement along the lines that Michel Barnier proposed and said was the only way to ensure her red lines were not breached, and which would deliver on what the British people voted for?
The alternative arrangements are specifically referenced in the withdrawal agreement, and of course what we are looking for, and have set out in the political declaration and the proposals the Government have put forward, is indeed a wide-ranging free trade area; it is just a better one than the EU was proposing to us.

Commons ChamberWe recognise the significance of climate change, but—the hon. Lady referenced a quote from David Attenborough—we also recognise the importance of action in other areas, such as the protection of species around the world. That is why we held a conference here in October on the international wildlife trade, which is another aspect of the future of our world. As for energy sources, we believe in having a mixed economy, but we are of course a member of the Powering Past Coal Alliance and we are encouraging others to become members.
I thank my right hon. Friend for the Government’s support for Ukraine in the face of increased Russian aggression. Will she look at ways of stepping up pressure on Russia to release not just the 24 sailors, but the 68 other Ukrainian political prisoners held in occupied Crimea and in Russia, and to cease the blockade of Berdyansk and Mariupol in the sea of Azov?

Commons ChamberWe will be putting extra investment of £394 million a week into our national health service. The funding from that will come from a number of sources, but we will be able to use the Brexit dividend on priorities such as the NHS and other public services.
My right hon. Friend said that one of the benefits of leaving the EU is the ability to sign trade agreements with third countries, but what realistic prospect is there for that while we remain within the customs union and even after that, when we have pledged to maintain
“deep regulatory and customs cooperation”
covering goods—probably the very goods that people want to sell to us?
We will be able to sign free trade arrangements with the rest of the world, and we already have significant interest from various parts of the world. I take my right hon. Friend’s point about our proposal on frictionless trade with a commitment—subject to a parliamentary lock—in relation to the common rulebook on goods and agricultural products. Of course, many of those rules are international standards; they are not just EU-related standards, but standards that our manufacturers would abide by in any case. That is a key issue. We want to have good trade relations and agreements not only with countries in the rest of the world, but with the EU.

Commons ChamberThe 95% relates to the withdrawal agreement. We have agreed much of the structure and scope of the future partnership. Staying in the European Medicines Agency is one of the proposals we put forward as part of the plan that came out after the Chequers meeting, our proposals for the future. That is part of the future partnership, not the withdrawal agreement.
Does my right hon. Friend appreciate the frustration felt by many of my constituents and others that it is now over two years since the referendum and we have agreed that we will not regain control of our laws, borders and money for over four years after the referendum? Does she understand that for many of them and us that is already too long?
I absolutely understand. Some people have said to me that we should not have triggered article 50 when we did. I think it was important that we triggered it when we did. We took time to prepare, but then triggered it precisely in order to get this process into place. My right hon. Friend will know the process within article 50 is for two years. That is why we will leave the EU on 29 March 2019. What we are working to ensure is that we get the future relationship in place at the end of that implementation period, an implementation period that I believe was right and necessary to negotiate to ensure that for both citizens and businesses there were not two cliff-edges in the changed relationship with the EU, but we have a smooth and orderly withdrawal and movement into the future partnership.

Commons ChamberAs I said in response to the question this afternoon from the hon. Lady’s party leader, the right hon. Member for Ross, Skye and Lochaber (Ian Blackford), the Home Office and the Business Department have been working on this issue in relation to SLPs; they have been looking at some of these areas of abuse. We have as a general point stepped up our ability to deal with economic crime through the establishment within the National Crime Agency of the national economic crime centre, and we are continuing to build up that ability to deal with economic crime. I am sure the Minister for Security and Economic Crime will be happy to speak to the right hon. Gentleman as leader of the Scottish National party here about the action being taken and the work being done. There is an intention to legislate in this area, but obviously we need to ensure we get this right; SLPs are not the only issue raised in this regard and we need to look at a range of abuses.
My right hon. Friend has set out very powerful evidence that a British citizen died on British soil as a direct result of a Russian assassination, but she will be aware that there have been a number of other deaths in Britain in the past few years of Russian citizens or of people with close connections with Russia. Can she say whether those cases are now being actively re-examined?
My right hon. Friend is absolutely right to raise that issue. There have been a number of cases—the number of 13 or 14 comes into my head—and they have indeed been reconsidered by the police, who have looked at all the evidence in relation to those matters. I understand that a letter will shortly be going to the Chairman of the Home Affairs Committee setting out the outcome of that, but I understand that there is no cause for further consideration of those cases.

Commons ChamberI welcome my right hon. Friend’s support for Ukraine and the recognition of the potential threat of Nord Stream 2. Will she confirm that there is absolutely no question of any NATO member country recognising the illegal annexation of the Crimean peninsula by the Russian Federation?
We are very clear—as was, I think, everybody around that table—that an illegal annexation took place. Significant support was shown for Ukraine around that table. There are of course requirements on Ukraine and Georgia for their potential future membership of NATO, but we look forward to working with them to help them to meet those requirements.

Commons ChamberOf course it is important that people are able to have their appeals heard in a timely fashion. My right hon. Friend the Work and Pensions Secretary is looking at exactly this issue to see what can be done in the tribunal system to ensure that people get a more timely result.
Will my right hon. Friend join me in welcoming the Speaker of the Ukrainian Parliament, Mr Andriy Parubiy, to Westminster—although I suspect that he is utterly mystified by the events that took place 10 minutes ago? Will she take this opportunity to reaffirm the support of the UK for Ukraine, which is in the frontline against Russian aggression? Does she share the concern of Ukraine, along with Lithuania and Poland, about the strategic threat of the Nord Stream 2 Russian gas pipeline?
I am very happy to reaffirm the United Kingdom’s commitment to and support for Ukraine. Only a matter of weeks ago, I was pleased to be able to have a further conversation with President Poroshenko about the support that we are able to give to Ukraine, and about the work we are doing with Ukraine on the reforms that are being put through. Also, as I mentioned in response to a previous question, it is important that the European Union should maintain the sanctions on Russia, because the Minsk agreements have not been put in place and fully implemented. We need to continue to show the Russians that we do not accept what they have done in Ukraine.

Commons ChamberFirst of all, the right hon. Gentleman is absolutely right: there is a strong tradition in the Labour party of recognising the importance of acting in the national interest and acting when our national security is under threat. We have seen that from Governments of all complexions over the years. In relation to the point about international activity and the deeds that we need to take, it is right—we will be continuing to talk. We have been speaking to our allies, even before this event took place, about the ways in which we could deal with and address some of the activities and actions that Russia is taking across the continent of Europe and elsewhere, but we will of course redouble those efforts now.
Does my right hon. Friend agree that one of our best assets against Russian disinformation and propaganda is the BBC World Service, and will she consider ways of extending its reach, perhaps by incorporating world television? Does she also agree that we need to be very careful not to give any pretext, however unjustified, for the Russians to take action against the BBC and other free media outlets?
I would hope that the Russian state would be prepared to accept the importance of the free media, but sadly, from one or two things we heard last night, it seems that that might not be the case. My right hon. Friend is right, however, that the broadcasting of the BBC World Service is an important element of the UK’s reach and an important outlet for those who believe in democracy, the rule of law and free speech and expression.

Commons ChamberThe right hon. Gentleman is absolutely right. It is the Russian state we are challenging in relation to this particular act that has taken place on UK soil, not the Russian people.
Is it not increasingly clear that we are engaged in hybrid warfare with Russia that includes disinformation, political interference, cyber-attacks and now very possibly this act of attempted murder? In considering how to respond, will my right hon. Friend also look at what additional help we might give to the people of Ukraine, who are the frontline in resisting Russian aggression and expansionism?
I thank my right hon. Friend for his comments. He is absolutely right: we need to look across the diverse nature of the threat that we face and the actions that we are taking. We have already been taking a number of actions in support of Ukraine. That is also an important part of our deliberations and of our response.

Commons ChamberThe intention of the implementation period is, as far as possible, to ensure that there is not a cliff edge so that people are able to operate on the same basis as they do at the moment as they put in place the necessary changes leading up to the future partnership. Of course, that implementation period, which is now going to be looked at by the EU27, will be part of future negotiations.
Does my right hon. Friend agree with the Committee on Exiting the European Union that it would be in the best interests of both sides if we could conduct the negotiations on the divorce settlement in parallel with those on our new relationship? Does she therefore agree further that any flexibility on the size of our exit payment must be linked to flexibility in other areas to be negotiated?
I, and the Government, have been very clear that the whole question of the financial settlement cannot be finally settled until we know what the future partnership will be. It is not that we are going to sign up to a deal and then negotiate what that future partnership will be, so once the formal negotiations on the future of the trade relationship, and of course the security relationship, have started, there will continue to be negotiations on issues which were initially identified as being in phase 1.

Commons ChamberMy right hon. Friend the Minister for Immigration will be meeting some MEPs later today to talk about the proposals we have put forward. I have been in discussions with President Tajani about the possibility of my going over to speak to the European Parliament, and we are looking at the basis and a timetable on which that should happen.
Does my right hon. Friend agree that one of the principal reasons why the British people voted to leave the EU was to reassert the supremacy of this Parliament and the UK courts? Will she confirm that, when we do leave, that will be the position for all citizens resident in the UK, no matter from where they came?
Yes, I can confirm that. One of the key differences between the proposals we have put forward and those of the European Union is that it wants the European Court of Justice to continue to have jurisdiction over EU citizens, even after we have left the European Union. I think people were very clear that they did not want the ECJ to have jurisdiction here in the UK. I believe that we have fine courts in this country. They will be able to uphold EU citizens’ rights, just as they uphold UK citizens’ rights.

Commons ChamberAs my right hon. Friend knows, more than 10,000 Ukrainian servicemen have been killed since the beginning of the Russian-backed conflict, and progress on Minsk appears to have stalled. Does she agree that, as signatories to the Budapest memorandum, we have a special responsibility? Will she look into what further pressure we can put on Russia, and also what additional assistance we can give the people of Ukraine?
We do consider what more we can do. My right hon. Friend the Defence Secretary announced recently that we would undertake an extension of the training of Ukrainian forces, and my right hon. Friend the Foreign Secretary is looking into whether there are other ways in which we can ensure that the Minsk agreement is implemented in full. However, I think it important for us also to work through the European Union, and to put the pressure of the EU behind the process.

Gentleman is right to raise the issue of the appalling atrocities that are taking place in Aleppo, and it is right that we, along with our international allies, should be doing all that we can to try to bring this to a stop. He will recognise that the issue of who hosts sporting events is not in the Government’s remit. What is in the Government’s remit and what we are doing, as I say, is working with our international allies to put more pressure on Russia to stop the appalling atrocities—the appalling attacks—that are taking place in Aleppo. What we want to see is an agreement for a political transition to a Syria without President Assad.
My right hon. Friend will, of course, be waiting in anticipation for my right hon. Friend the Chancellor’s autumn statement, but he is absolutely right that, as we look at improving productivity in this country and as we look to the economy of the future, the provision of superfast broadband and those new technological opportunities for people is absolutely a crucial part of that, and that is something that this Government recognise and will act on.

Commons ChamberI thank the right hon. Gentleman for his remarks. As he says, he established the Macpherson inquiry and was in office when it published its report. At the time, there were some very concerning issues regarding the way the murder was investigated, both originally and later on, and the attitude, which the Macpherson inquiry looked into, of the Metropolitan police. He is right that we should be very concerned if information was deliberately withheld from those who should have been given it, which is why I asked Mark Ellison to look specifically at the issue of the information that was given to the Macpherson inquiry. The remit of Operation Herne, now under Chief Constable Creedon, includes looking at reporting mechanisms within the SDS, and at how information was disseminated.
Is the Home Secretary aware of the growing concern regarding the actions of the police in some instances and the inactions of the police in others? Can she comment on the reports at the weekend that the police have uncovered widespread use of private investigators to hack telephones not just by journalists, but by lawyers’ firms and other corporations? Can she say why it appears that the police thought it right to tell Lord Justice Leveson about that, but not pursue any action against those who committed criminal offences?
My hon. Friend will be well aware that decisions on whether the police investigate individuals and alleged offences are an operational matter for the police, and that it is for the police, with the Crown Prosecution Service, to decide whether those investigations lead to charges and prosecution. However, I recognise the degree of concern that he raises. Phone hacking by some aspects of the press has caused disquiet in this House for some time. Suggestions that it could have been more widespread are, of course, equally worrying.

Commons ChamberI thank the right hon. Gentleman and, indeed, I see this as a development of the IPCC. Its role over the years has been changing and this is a necessary and important development. Dame Anne Owers has done an excellent job since becoming chairman of the IPCC. The role is changing slightly from the one she first came to, but she is addressing it with great distinction and commitment, as one would expect from her. Indeed, in her time overseeing prisons she built up a reputation for herself and her independence, and it is good that we have somebody with that reputation as chair of the IPCC.
On the transfer of services, the point is that work will be transferring from professional standards departments to the IPCC, so it therefore makes sense to transfer resources. We are not talking about not having professional standards departments at all, and a discussion will be had with forces about the level of that transfer and where the boundary appropriately falls.
Does my right hon. Friend agree that one of the great unanswered questions in the sorry saga of phone hacking is how although the police had evidence taken from Glenn Mulcaire in 2006 that suggested widespread lawbreaking was taking place, not only was nothing done about it, but it was denied that such evidence existed? That matter was intended to be examined by Lord Justice Leveson in part 2 of his inquiry. Will the Home Secretary confirm that an investigation will still take place to answer those questions?
My understanding is that that will indeed be part of the second part that will take place, but as my hon. Friend knows, there has always been a question about what can be done. A great deal was done by Lord Justice Leveson on issues that he needed to consider at the time of other police investigations. Of course, those police investigations are still continuing.

Commons ChamberAs I said earlier, I believe that the police should be able to investigate every allegation and to chase evidence as far as it takes them without fear or favour. When a conflict of interest arises—if the Metropolitan police feel there is a conflict of interest—that should be made transparent and that is why I believe I should have been told earlier. However, I say to the right hon. Gentleman that the Metropolitan police did not make the appointment of Neil Wallis known to previous Home Secretaries—notably previous Labour Home Secretaries—either.
Does my right hon. Friend accept that some of the biggest questions during the whole of the phone-hacking saga relate to the failures on the part of the police to investigate, as well as to what has been going on in newsrooms, particularly why the police appeared never to interview a single journalist who was named as a client of Steve Whittamore in the Motorman case and why they did nothing to look at the enormous amounts of material seized from Glenn Mulcaire? Does she agree that it would be unsatisfactory if these matters could not be looked at until the beginning of the second part of the judicial review? Will she consider inviting the IPCC to begin examining these questions now?
My hon. Friend makes an important point. As he says, part of the inquiry that is led by Lord Justice Leveson will involve looking at the first investigation by the Metropolitan police. It is not impossible for it to start doing some work while the current investigation is going on, but that would have to be done carefully in order not to jeopardise the current investigation. I am sure that we all want to see a proper investigation and a proper inquiry with answers about what happened in that first police investigation and about why matters were not taken forward in a way that people now feel they should have been. We also want to ensure that the current investigation is not in any way prejudiced by that work because we want people who have been guilty of criminal offences to be brought to book.

Commons ChamberI say two things to the hon. Gentleman. First, he says that there is new evidence. As far as I can see, allegations have been made in a newspaper. The Metropolitan police have made it clear that if there is fresh evidence, they will consider it. Secondly, as Home Secretary I consider it appropriate that the Government take the view that it is for the Metropolitan police to decide what is the right course of action on an operational matter. As I said in response to the urgent question, it is appropriate for this Government to wait for the outcome.
As the Home Secretary indicated, the Culture, Media and Sport Committee spent a considerable time examining this matter in the previous Parliament. We reported our conclusions to the House and we stand by them. We certainly found it very difficult to believe that Clive Goodman was the only member of the News of the World newsroom who was aware that phone hacking had been carried out by Glenn Mulcaire, but we found no evidence to suggest that the then editor knew of it. If there is credible new evidence, that would obviously be a matter for the police, but perhaps the Home Secretary could give an assurance that the Select Committee will be informed of the outcome of any investigation.
I am grateful to my hon. Friend for his intervention. It is helpful of him to put before the House what happened in the Select Committee inquiry on the matter. As I have said, it is for the Metropolitan police to consider fresh evidence, if any comes forward, and I am sure that the Select Committee will be kept informed of any developments.

Commons ChamberDoes the Home Secretary accept that the vast majority of those in this country who enjoy shooting will share her dismay at the events in Cumbria and will want to send their condolences, too? I very much welcome her statement that she will resist calls for a knee-jerk response to these incidents and will bear in mind the interests of the many thoroughly responsible shooters who wish to continue to enjoy their sport.
I do indeed accept that, as my hon. Friend says, there are many responsible shooters in the UK who will have been as appalled by these events in Cumbria yesterday as everybody else was. As I indicated in my previous answer, it is right that we should have an opportunity to consider these issues, but we should do so only when we have the full facts—when the police have been able to investigate and we know as much as we can about the events that took place in Cumbria. We must not leap to conclusions before we have those facts.
