It is a pleasure as always to serve under your chairmanship, Dame Maria. I am grateful to the hon. Member for Lancaster and Fleetwood (Cat Smith) for moving the motion and agreeing to the debate in her role as Chair of the Petitions Committee—it is very much appreciated. I also thank the 116,391 people who signed the petition, including 189 of my Shipley constituents, which helped secure this important debate.
In preparing for today’s debate, I looked back at the contributions made in April when another petition on this topic was debated here in Westminster Hall, as the hon. Member mentioned in her opening remarks. I have to say that I was disappointed by some of the rhetoric, when valid concerns were dismissed as an “overreaction and hysteria”. It is clear that this is—quite rightly, in my opinion—an important issue for the public. We can see that that is the case from not just the full Gallery, but the large numbers signing the petitions.
So what are we dealing with here? We have two international legal instruments, both designed to increase the WHO’s authority in managing health emergencies. The first concerns the amendments to the existing International Health Regulations 2005—the IHR—and the second is the World Health Organisation’s new pandemic treaty, which would support the bureaucracy and financing of the expanded IHR. Both instruments are designed to transfer decision-making powers to the World Health Organisation, with the admirable aim, no doubt, of improving how the world prevents and better prepares for disease outbreaks. However, in practice, what is being proposed could have a huge and detrimental impact on all parts of society and on our sovereignty. If the IHR amendments go through, countries will have undertaken to follow recommendations, not merely consider them: it is proposed to remove the word “non-binding” from article 1, while the regulations in article 42 are to be
“initiated and completed without delay”
by member states. Therefore, we can only assume that the intention behind the amendments is for them to be binding under international law.
I do not wish to over-egg the nature of the proposals, but I cannot help but be concerned by the thought of removing the word “non-binding”. There is much in the existing IHR that would suspend fundamental human and bioethical rights, such as requirements for vaccinations and medical examinations, and implementing quarantine or other health measures for suspect persons—in other words, mandates and lockdowns. It is all there in black and white under article 18. We may have become only too mindful of the harms of lockdowns, and I am sure that hon. Members will be aware of the latest findings published by the Centre for Social Justice about the harms caused by lockdowns. That is not to mention the non-existent science used to enforce wearing a face mask—the covid inquiry has also uncovered the fact that that was based on absolutely no science whatsoever.
At the debate in April, we were told by the then Minister that it is “simply not the case” that
“the instrument will undermine UK sovereignty and give WHO powers over national public health measures”.—[Official Report, 17 April 2023; Vol. 731, c. 34WH.]
I think it is worth revisiting this question, because I am not clear how national and parliamentary sovereignty can be upheld if the proposals are agreed. I draw attention to draft new article 13A, which calls for member states to
“undertake to follow WHO’s recommendations”
and to recognise the World Health Organisation not as an organisation under the control of countries, but rather as the
“coordinating authority of international public health response during public health Emergency of International Concern”.
Does my hon. Friend share my concern about the lack of accountability? We are having an extensive and public examination of the Government’s response to covid, but there is no comparable examination of the important decisions and advice that the WHO offered to the whole world, and it probably had more influence.
My right hon. Friend is, as ever, absolutely right. We should all be concerned about that and concerned that we do not end up falling into the same problems as we have had in the past, being in a position where there is nothing we can do about it and sleepwalking into a disaster.
We are talking about a top-down approach to global public health hardwired into international law. At the top of that top-down approach we have our single source of truth on all things pandemic: the World Health Organisation’s director general, who it appears will have the sole authority to decide when and where these regulations will be deployed. Let us not forget that the director general is appointed by an opaque, non-democratic process—and I think that is being rather generous.
Rather worryingly, in their response to this petition the Government have said they are
“supporting the process of agreeing targeted amendments of the IHR as a means of strengthening preparedness for and response to future health emergencies; including through increasing compliance and implementation of the IHR”.
They have also previously said that they support
“a new legally-binding instrument”
—that certainly sounds like a threat to parliamentary sovereignty to me. Will the Minister commit today to laying those plans before Parliament so they can be properly debated, and if I had my way, robustly rejected?
It is also vital to take a step back and understand what is driving this pandemic preparedness agenda. At a recent meeting of the all-party parliamentary group on pandemic response and recovery, Dr David Bell gave a briefing on how the World Health Organisation, with the backing of the World Bank, says these amendments are the only way to prepare for future pandemics that it says are getting more frequent, and where there is more risk from zoonotic—animal to human—spread. The reality is that the WHO’s figures do not tell the whole story. When we take into account population growth, significant natural pandemics are rare events. We also have to take into account that there has been a huge expansion of tests and genome sequencing over the last few decades. The invention of polymerase chain reaction testing, for example, has had a massive impact on the detection rate of those outbreaks that the World Health Organisation is now using to justify its agenda.
Since the Spanish flu over 100 years ago, we have only had two pandemics above the average yearly seasonal influenza mortality rates, thanks to antibiotics and advances in modern medical care. We hear a lot about disease outbreaks that actually have low mortality burdens when compared to other public health threats: for example, in 2003, SARS-CoV-1—severe acute respiratory syndrome —had the equivalent disease burden of about five hours of tuberculosis. Funnily enough, in its 2019 pandemic influenza recommendations, the World Health Organisation itself could find no evidence that serious zoonotic pandemics were increasing. What is undoubtedly increasing are the eye-watering costs of managing pandemics, with vast sums of taxpayer money being wasted on poorly conceived initiatives, such as locking down the economy for two years.
It seems to me that the World Health Organisation has no need to rush any of this—we have time to reassess and get it right—and it seems I am not the only one to think that. In recent weeks, we have seen signs that some countries, including Estonia, Slovakia and New Zealand, are looking to question the proposals. It is not clear if any member states have submitted formal notices to reject them and opt out, but New Zealand does appear to have lodged a reservation to allow the incoming Government more time to consider whether the amendments are consistent with a national interest test required by New Zealand law. That is entirely sensible, and I would like to see our own Government take a pause to apply some critical thinking to this situation before blindly supporting the World Health Organisation’s installation as our new global public health power.
It is absolutely essential that the Government make a clear and unambiguous promise that they will neither support nor abide by anything that in any way undermines our national sovereignty. We have not spent so many years battling to get out of the frying pan of the EU to jump straight back into the fire with the equally unaccountable, undemocratic and hopeless World Health Organisation.

Let me summarise the situation by saying that what we have learned today is that the Opposition have no intention of honouring what we thought was a pledge and what they say was not a pledge. Labour does not want to retire the student debt. It does not have a clue how to do it, and it even admits that £100 billion is too big a sum to raise in this Finance Bill to honour that pledge.
My right hon. Friend is being a bit unkind to the Labour Opposition, because they have given us some indication of how they would go about raising the money that they need for their fantasy policies. They have told us that they would adopt the policies that were used in Venezuela. Was my right hon. Friend as surprised as I was when the shadow Minister mentioned how appalled he was at the rate of inflation, given that he wants to adopt the policies of Venezuela? Perhaps my right hon. Friend can tell us what those policies led to in Venezuela.
I have written and spoken about that in other contexts. I fear that I might be straying a bit far from the strict words of the Finance Bill, but my hon. Friend tempts me. I do remember that the leadership of the Labour party was full of praise for the two last leaders of Venezuela, but we now know that that very expensive experiment has ended in terrible tears with a lot of civil dispute, an inability to buy simple foods in shops, complete chaos in getting in basic supplies, a country near bankruptcy, having run out of foreign exchange, and a country that cannot even run its own oil resources properly because it does not know how to invest, to balance its budget and to run finance prudently. It is very sad that the Labour party backed this particular wrong horse. It is even more bizarre that it will not now distance itself from it and admit that the experiment failed badly. However, it does tell us something very interesting.
When the Venezuela experiment began, it was great. The Government gave more money to the poor, which was extremely popular. In the first instance, the policy just about worked—people had a bit more money to spend—but shortly the Government ran out of other people’s money to spend and they ran out of borrowing capability. Instead of helping the poor, they crushed the poor. Instead of making a prosperous economy, they bombed the economy and they are now all much worse off as a result of their policy of generosity.
I am grateful that the Government understand that we need to have a prosperous and growing economy and to run our finances sensibly in order to pay for the attractive programmes for better public services and to create less inequality of income by giving more money to those who, through misfortune or for other reasons, cannot earn as much as others.

Commons ChamberI never said that there is a conspiracy, and I have not suggested that there is one figure in the BBC who holds that view; I think that most people in the BBC hold that view, and I think that it is quite spontaneous. I think that in some cases they are not even aware that they are doing it. I note that many Members, including on the Opposition Benches, are nodding their heads wisely. They, too, have heard such interviews. It now seems almost a statutory requirement in what should be interviews on general business subjects to regard those people as having a unique insight into our future in the European Union, ascribing to them supernatural powers that apparently the millions of other voters in the country do not share, asking them to dictate the future. I think that the referendum is a democratic process and that everyone’s vote is of equal weight and value. It is a conversation for the whole country. I am not against business people joining in, because I am a democrat, and they have voices; I just think that it is a bit odd that our leading broadcaster wants to turn every business interview into a political interview.
I am charitable to the BBC and do not think that it sets out to be biased in its coverage. The problem—I am not entirely sure how my right hon. Friend will tackle this point—is that it sets out to talk only to people from the same metropolitan set, and they all have the same opinions. The people in the BBC need to get out more and discover that across the country there are opinions different from those of that narrow band of people. How does he think they can address that? It is not conscious bias; they just need to get out more.
My hon. Friend make his comments in his own inimitable way. That is not quite what I was trying to say, or how I was going to say it, but this is a free country and it is wonderful to hear him contribute to the debate.
I am just trying, in the brief few moments that you have kindly allowed me, Mr Speaker, to extend the conversation from this great Chamber to the BBC and to say to it, “We all want you to be part of this big family conversation in the run-up to the referendum, but you have a unique responsibility, because you are charged with independence, fairness and balance. We trust that you will be especially careful, because many people have very passionate views on both sides of the argument, and that always creates more tensions and difficulties for broadcasters.”
Of course coming out of the EU will have an impact on the conduct of the public sector in Britain, as well as on the private sector. It will change who makes the laws and how the budgets are run, for example. If we did not have to send £11 billion a year to the EU to be spent elsewhere, we would have more scope to have better social work and tax cuts in the United Kingdom. I think that would be extremely good news. Why are public service workers not asked whether they would rather see some of that money spent on their preferred public service than sent to be spent elsewhere in the European Union? That line of questioning would be just as interesting as the one trotted out each time for business people: “Will your business come to an end if the British people dare to vote for democracy?”
Is not the point that the BBC tries to show that every business wants to remain in the European Union, when the fact is that many businesses want to leave the EU? The BBC always seems to be able to find businesses that want to stay in, but never seems to be able to look at the website of Business for Britain, which has more than 1,000 businesses that are quite happy to be outside the European Union.
That is a good point. The other constitutional point I would make about businesses is that in an entrepreneurial business where the entrepreneur-owner-manager owns 51% or more of the shares, of course they speak for business, so if they say, “I want to stay in,” or, “I want us to pull out,” that is not only their view but the view of the whole business. I can understand that and it is very interesting, but quite often the people being interviewed are executives with very few shares in very large companies, who have not cleared their view through a shareholder meeting or some other constitutional process. The BBC wishes to give the impression that that is the view of all the members of the company, whereas in fact it is just the opinion of an executive. It is interesting, and the executive may be quite powerful, but he does not necessarily speak for the company, and that is never stressed in the exchanges.

Commons ChamberWill my hon. Friend give me some idea of how much damage might be done to the industry during a two-year phase?
My right hon. Friend makes a good point. The Minister argued that two years was very short. In two years’ time, the whole industry could have upped sticks and gone abroad. It may well be that my two-year sunset clause is too long. I will happily be chastised for that, but I thought it was important that we put a line in the sand. I thought that two years would give us a reasonable time to see how the legislation worked with different tournaments and different music events. It is ample time for people to consider the effects. If those people who are in favour of the Lords amendments are so confident in their arguments, they have nothing to fear from a sunset clause. If everything is fine and dandy and none of my fears comes to fruition, the Government will happily reintroduce the legislation and it will sail through because it has been shown to have worked. They do not like the sunset clause because they know that the point I am making is the real agenda behind this Bill, and they do not want to be rumbled.
Once the Bill is on the statute book, the Government think that that will be it and nobody will bother or have the courage to revisit it, and I suspect that they are right. That is why I have tabled my amendment. I understand that there may be some difficulty in having a vote on it, even though it is sensible, and I am sorry that the Government have refused to accept it. This is an unfair and unnecessary intrusion into the free market. Who knows what consequences will flow from this legislation? I shall urge my colleagues to do what they have done twice in recent times already, and vote down the Lords amendment. I shall be interested to see how many of my colleagues vote for something that they have happily voted against in recent weeks and how, as a general election is coming, they will justify their action to their constituents. I shall happily be able to tell my constituents that I stuck to my guns, that I did not change my mind and that that is why I do not want to be in coalition with these wishy-washy Liberal Democrats any more.

Commons ChamberMy hon. Friend makes a very good point, which drives a coach and horses through the hon. Lady’s amendment. People could sell a ticket to an event along with a scarf or a hat and say that they are charging x amount for the hat and the face value for the price of the ticket. That would get around the hon. Lady’s amendment quite easily and make the whole thing complete nonsense.
There is a more serious problem than the one my hon. Friend has just described. I do not think people will be selling houses or hats with tickets, but there are hospitality packages. Companies that offer hospitality with an event normally have to pre-buy tickets so that they can get the person into the ground before they can provide the hospitality. There is a cross-pricing issue.
My right hon. Friend is absolutely right. The point is that people could easily get round the law by selling other things with the ticket to ensure they do not breach the terms of the amendment. They could charge different amounts for the various things being sold as a package. It would be complete nonsense.
As I mentioned, the OFT decided that the current regime worked in the consumer’s best interest. [Interruption.] My hon. Friend the Member for North East Cambridgeshire (Stephen Barclay) keeps chuntering from the sidelines. If he wants to make a speech, I am sure that you, Mr Deputy Speaker, will look on him favourably.

Commons ChamberAbsolutely, and again I am grateful to my hon. Friend. The situation makes the Government’s position on these matters unjustifiable and completely ridiculous. If the Government do not support all this, why on earth are we in this situation? If we are in this situation because the Minister is utterly powerless to do anything about it because he has no influence whatsoever, I hope he will admit that. When our referendum comes, in 2017 or thereabouts, it will be another argument for why we should leave the European Union.
Does my hon. Friend agree that the whole idea of an EU quango to lecture member states on how we should behave on human rights is nonsense? This is a group of democratic states, so surely it is the job of the Parliaments of the individual member states to decide on and uphold the human rights in their countries, rather than to be instructed by EU quangos.
My right hon. Friend, as ever, is absolutely right. We certainly need no lectures from other countries in the EU about how to protect people’s freedoms; this country has a far better track record than member states of the EU will ever have. I suspect that the Minister will be trying to defend the indefensible, but it is a sad state of affairs when it appears that we in this House are powerless to do anything about these sorts of bureaucracies. We all know what happens with these types of bureaucracies: they grow and grow, and they empire build. They will grow their influence and they will try to do things that they are not supposed to do—things they were not set up to do. They will grow the number of staff and grow their budget, and it appears from what I have heard so far that we are utterly powerless to do anything about it. If the Minister can give me some comfort that we can and will do something about it, fair enough, but it seems to me that either the Government approve of all this nonsense, which would be a terrible state of affairs, or we are powerless to do anything about it, which in my view is equally unacceptable. I look forward to the Minister explaining which it is, but whichever it is, my hon. Friend the Member for Christchurch is right to draw the matter to the attention of the Committee and to pursue his amendment, which I support with gusto.
