The hon. Gentleman seemed to be opting out and opting in all over the place there. The problem with the opt-out that he wanted is that, by the time we have opted back in to the main measures, it will not really be there at all. Here is what the Prime Minister said about these measures. He described the European arrest warrant as “highly objectionable” and the Home Secretary’s package, which is before us today, as a massive “transfer of powers”.

The Home Secretary said that it was

“the first time in the history of our membership of the European Union that we have taken such a set of powers back from Brussels.”

She described it as

“something that should be celebrated by anybody who cares about national sovereignty, democracy and the role of this place in making the laws of our country.”—[Official Report, 15 July 2013; Vol. 566, c. 770.]

So what does she want us to celebrate today? The truth is that the Home Secretary now wants us to opt back into the important measures again—thank goodness. Finally she has listened to reason. I was delighted to hear her list many of the cases in which the European arrest warrant has been used—rightly used—and needed; in fact, they were many of the examples that Labour Members were putting to her 12 months ago when she was refusing to listen. Finally, she has listened to the police, who have said that many of the measures, if we opt out and stay out of them, would let criminals run free. She has listened to the victims who feared that they would be denied justice. Finally, she has listened on cases such as that of Jason McKay, who was extradited from Poland within two weeks for murdering his partner. Under the old extradition arrangements, it would have taken several years to get him back to face justice for a murdered woman. So yes, she has rightly done a U-turn on the European arrest warrant, joint investigation teams, Schengen information sharing and co-operation over online child abuse.

The Home Secretary is right to admit that we cannot go back to the days when it took 10 years to extradite a terror suspect to France, or when it took 11 years to get Ronnie Knight back from the costa del crime. She is right to support the deportation of thousands of foreign suspects to their home countries to face charges. I agree that co-operation is needed in a whole series of different areas. We are glad, too, that the Home Secretary has accepted the need for the exchange of criminal records, Eurojust, the co-operation to protect personal data and measures on football hooliganism. We cannot go back to the days when foreign criminal gangs were untouchable and criminals were able to seek sanctuary on the continent. I am glad that the Home Secretary has decided to ignore her Back-Bench colleagues and the Fresh Start group and to listen instead to Labour, the Liberal Democrats, the police and victims of crime.

What is left that the Home Secretary wants us to remain opted out from? What is the massive transfer of powers—the historic transfer, the repatriation—that the Home Secretary wants us to celebrate today? We will not be signed up to some joint proceedings on driving licences, but they are not in force and are out of date. We will not be signed up to a directory on international organised crime, but it was closed down two years ago. We will not sign up to the guidance on the payment of informers, but we will carry on following it. We will not sign up to guidelines on working with other countries on drug trafficking, but we will carry on doing that anyway. We will not sign up to measures on cybercrime and mutual legal assistance, because they have all been superseded by other measures to which we have signed up instead. We will not sign up to minimum standards on bribery, but we will still meet them because the Bribery Act 2010 is still in place. We will not sign up to measures to tackle racism, but we will still meet them because we have hate crime legislation in place. We will not sign up to measures on accession, because they never applied to us in the first place. And we will not sign up to receive a directory of specialist counter-terrorism officers, but someone will probably send it to us in the post.

That is it. That is the historic transfer of powers that the Home Secretary boasted about—the great liberation from Europe and the great cause for celebration that she promised us when we last debated these matters. We have the power not to do a whole series of things we plan to carry on doing anyway, the power not to follow guidance we already follow, the power not to take action we already take, the power not to meet standards we already meet, the power not to do things that everyone else has already stopped doing and the power not to do a whole series of things we want to do anyway. This is her historic moment. She said it would be a first in the history of our membership of the EU; she wanted it to be her Churchill moment. Churchill? Only if it is the nodding dog in the back of the car.

This is a political charade. Now that we are playing charades, will the Home Secretary at least reassure us that she is not doing any lasting damage? Can she assure us that, for the sake of a few opt-outs, the warrants will not be lost?

Does the right hon. Lady not understand that if we opt back in to many of the big and serious measures we are discussing, a future Home Secretary in this House would be impotent in large areas of criminal justice?

I must say that I am baffled that the right hon. Gentleman could consider a bit of guidance on this and a bit of a directory on that to be a huge, powerful thing in relation to criminal justice—[Interruption.] Oh, he is talking about the European arrest warrant. On that point, I think that he and I simply disagree. He would like us not to be able swiftly to deport foreign suspects to their home country to stand charge. He would like us not to be able swiftly to bring back to this country those who are suspected of serious crimes and need to face justice. Before we had the European arrest warrant, we waited years to get back the people we needed to have charged with serious crimes.

Of course I do not want to deny us that right, but I want us to have that right in a way that is accountable to this Parliament and in ways that we can amend.

Unfortunately, the right hon. Gentleman wants us to sign huge numbers of different extradition treaties when the extradition treaties and arrangements we had before the European arrest warrant took years. I do not think that that is fair on the victims of crime who want to see justice done.

Before I get into the substance of the arguments on the matter before us, I would like to refer to the letter that the Chairmen of the European Scrutiny Committee, the Home Affairs Committee and the Justice Committee received yesterday. It is addressed to each of us and it comes from the Secretary of State for Justice and the Home Secretary. It begins by saying that they would like to express their gratitude for the continued work of our Committees with regard to the 2014 opt-out decision. It then says:

“We have noted and considered your joint report. We deeply regret your collective view that the Government’s engagement has not been satisfactory on this matter. However, our view on the Government’s engagement with Parliament has not changed.”

There we have it. The letter goes on to say:

“As you will know, we intend to hold a general debate on Government time on 7 April”—

that is today. The letter continues:

“For the avoidance of doubt, we reaffirm our commitment to hold a second vote in both Houses of Parliament before making a formal application to rejoin any measures.”

However, it may be noted that that does not state that the second vote would take place before the negotiations have been finalised. I will come on to that in my subsequent remarks.

The difficulty that we face is that this matter has, to a very considerable extent, been a poor substitute for the debate that the European Scrutiny, Home Affairs and Justice Committees requested. This is the first time ever that all members of three independent, all-party Select Committees have unanimously agreed to a joint report on an unprecedented scale. The debate would give Parliament a genuine say and vote in determining which measures the Government should seek to rejoin before—I repeat, before—embarking on negotiations with the Commission and Council.

The motion that we are invited to support today merely refers to the consideration of the United Kingdom’s

“2014 justice and home affairs opt-out decision.”

That decision was considered in Parliament last July, when the Government secured a majority for their recommendation to exercise the UK’s block opt-out of around 130 pre-Lisbon police and criminal justice measures. The real question for us now, surely, is what the Government—a coalition Government who are largely taking account of considerations on EU matters which have been pushed forward by members of the Liberal Democrat party—will do about the 35 matters that are now up for rejoining.

The Prime Minister formally notified the Council of the UK’s decision to exercise the block opt-out on 24 July 2013. All the measures subject to that block opt-out will, as a result, cease to apply to the United Kingdom on 1 December 2014, unless, crucially, the United Kingdom submits a formal application to rejoin some of them.

Command Paper 8671, which was published merely a matter of days before the debate last July, includes a list of 35 measures that the Government say they seek to rejoin. I have to say, without prejudice to my differences of opinion with the shadow Home Secretary, that some of the cases that she put forward demonstrate that the issues are, in many instances, not quite as substantial as some might have imagined.

The motion that the Government wanted the House to approve last July would have endorsed the Government’s recommendation to enter into formal negotiations with the Commission and the Council on the list of the 35 measures, pre-empting any further consideration of the content and significance of those measures by the House and its Select Committees.

The Home Secretary came to the Floor of the House and I said at the time that I thought she was making the problem considerably worse by what she was saying. My intervention as Chairman of the European Scrutiny Committee, together with the Chairmen of the Home Affairs and Justice Committees, ensured that the House had the opportunity to consider the matter further, and was informed by the reports that all three Committees undertook to produce.

The need for further detailed consideration by Parliament cannot be doubted. The report by my Committee concluded that the list of measures was “incoherent”, and that it bore all the hallmarks of coalition politics rather than a serious analysis of the merits of each measure, or a careful balancing of the benefits of participation in extremely sensitive areas affecting fairness, liberty and justice, which are and should be accorded to individual United Kingdom citizens, and that the benefits of that participation should be set against the risks associated with accepting the jurisdiction of the European Court of Justice.

Indeed, and not only that. Those people are no longer able to have recourse to our courts system in the same way that they would have done because the European Court of Justice, once it has made an adjudication and a judgment, binds our Supreme Court. Moreover, under section 3 of the European Communities Act 1972, it also binds this Parliament. That is why, with respect to the charter of fundamental rights, we said in a report that we published only last week that the situation was so serious. We voluntarily entered into the Act in 1972, and I emphasise the word “voluntarily” because what is entered into voluntarily can be adjusted later. Those two features led us to conclude, in respect of the conflict on the perception of the charter of fundamental rights, that the then Prime Minister, who specifically stated on 27 June 2007 that it was absolutely clear that the charter of fundamental rights was an opt-out, was wrong. Furthermore, he was not only wrong but, in effect, contradicted by the Attorney-General of the time when he gave evidence to us only a few weeks ago.

The consequence of this, which is extremely serious, is that we have an Act of Parliament that is covered in confusion, with some judges saying one thing and other judges saying another. As there is no doubt that the charter applies to the United Kingdom, the only way of dealing with this is not, with respect to my right hon. Friend the Secretary of State for Justice, by having another legal challenge, as he proposes, but by amending the 1972 Act, because the situation is so serious that we have to bring in primary legislation in order to get it right in the interests of the people of this country. All the rights contained in the charter overlap with rights of the sort that people in this country, as citizens of the United Kingdom, would expect to be accorded to them. These are the kinds of matters that arise in respect of what we are considering as a result of the whole question of the 35 measures.

I do not think so. The driving force behind the arguments being made by the Conservative part of the coalition from the Back Benches is based on objective analysis in the interests of democracy, transparency and accountability in Parliament. Mr Farage cannot deliver anything, because he does not have one Member of Parliament. He cannot change one word of legislation—he can do nothing about any of this. I know that the situation is uncomfortable for the Secretaries of State at this moment in time, but I know for a fact that they will agree emphatically that the United Kingdom Independence party can achieve absolutely nothing. They know perfectly well that Conservative Back Benchers can achieve something. As in relation to many other European matters, Conservative Back Benchers can, by doing what we are doing now—working towards, we hope, a listening Government and listening Secretaries of State—achieve the results that we need, in the interests of the country as a whole. I hope that that answers the hon. Gentleman’s very useful question.

Let us be in no doubt about that, as my right hon. Friend and distinguished colleague says—and more power to his elbow.

Let us for a moment return to first principles and remind ourselves why the United Kingdom, alone among member states, has a block opt-out. In this context, it is worth remembering that we do not of course have a written constitution, and that gives us flexibility, unlike every other member state. We are not therefore insular or isolationist in taking such a view; as I know both Secretaries of State will appreciate, we are exercising our democratic right to express our views in a free forum—this House of Commons, to which we are elected to represent our constituents—and, as Chairmen of three significant Select Committees, we have worked together on an all-party basis to agree a view on a matter of such importance.

United Kingdom Governments of all political persuasions have been wary of extending the full jurisdiction of the European Court of Justice to EU police and criminal justice measures—that has been true of Governments of all parties—because they have recognised that conferring primacy on a court beyond the jurisdiction of the United Kingdom, and of our Supreme Court and of this Parliament, is a very profound and grave constitutional step.

Whatever views may be expressed in the debate—some will perhaps advocate opting back in to a far wider range of measures, while others will say, “None at all”; and when it comes to the vote, there may be splits and fragmentations in political parties on both sides of the House—I say to the Secretaries of State that surely we can all agree on the significance of the negotiations on which the Government are about to embark and the vital need for Parliament to have a genuine say and vote at the right time, before the negotiations have been concluded, on a matter of profound practical and constitutional significance, which bears very heavily on the liberty of the subject. What matters now is not what we have opted out of, but what measures we propose to rejoin. I ask my right hon. Friends to consider this very carefully: this is the time for the Government to think again.

On the basis of the leaks and information about the discussions that come through to us in various shapes and forms, I have referred to what has been happening in many countries throughout the European Union, and I understand that very little headway has been made in negotiations so far. My right hon. Friend the Home Secretary shakes her head. Perhaps she would like to get up and tell us that everything is going fine.

I trust that today’s debate will cause the Government to think again and allow Parliament to vote on these important measures before the negotiations are concluded. This matter of principle needs to be settled not after the horse has bolted, but now, so I tell my right hon. Friends that this is the moment. This serious matter is of grave concern to many of our citizens, and this is the time to think again.

It is a pleasure to follow the Chairman of the European Scrutiny Committee, the hon. Member for Stone (Mr Cash). I thank the Government for allowing us the opportunity to have this debate today, and I thank the Home Secretary for the way in which she began the process of constructing a dialogue with Parliament. The Chairs of the three Select Committees—myself, the right hon. Member for Berwick-upon-Tweed (Sir Alan Beith) and the Chairman of the European Scrutiny Committee—met the Home Secretary when the process began, and we agreed what I thought was a timetable to enable Parliament to express its views on these important matters.

Both Parliament and the Government stuck to that timetable. The Home Secretary wanted parliamentary scrutiny through the Select Committees by the end of October. We did our best to ensure that our reports were agreed by then, and we presented our reports to the Government with the expectation—although I accept that there was no promise—that Parliament would be able to vote on the measures before the Government began their negotiations. The Home Secretary has strongly expressed her feeling that Parliament needs to vote on something. In other words, let her get on with the negotiations, let us see where we go, let us look at the direction of travel and, once the package is ready, Members may determine whether they support it.

The personalities of the three Select Committees, not just their members but their Chairs, are quite different. They are not people we can get together and expect agreement from on every word of every report, but all three Committees, and all three Chairs, agreed unanimously that Parliament should not only debate the matter but vote on it.

Only the usual suspects are here today, with the exception of my right hon. Friend the Member for Tooting (Sadiq Khan), who has taken time off from preparing for the London marathon next week to attend this marathon session. I suspect that if there was a vote at the end of these proceedings, we would have had a much better attendance and Members on both sides of the House would have come forward to express their views.

The Government have said that the three Select Committees have deliberated and produced reports. The hon. Member for Esher and Walton (Mr Raab) tabled 125 questions, so he ranks alongside the Select Committees as far as scrutiny is concerned. That is probably enough to enable the Government to know the direction of travel and to complete the negotiations, but I do not think it is enough, and neither does the Home Affairs Committee. We feel that a vote today would have been the best way to give the Home Secretary the mandate that she needs to go to the Council of Ministers and to other European Justice and Home Affairs meetings to discuss the measures that she does or does not want to opt into. I am sure she is a very strong negotiator. She is before the Home Affairs Committee tomorrow, and I am sure she will put up a robust performance, as she always does, but she would have given an even better performance before the Council of Ministers and her various European colleagues if she had had the backing of the whole House.

I was concerned to read the note that was recently issued by the current presidency of the Council of Ministers, to which I referred in my intervention on the Home Secretary. Statewatch has published what it says is a note from Greece, which currently holds the presidency:

“Due to national procedures with the UK Parliament, the Presidency is of the understanding that the UK Government would need to finalise its position on the re-opting list by June 2014, so that these national internal procedures can take place before the UK parliament’s summer recess. Therefore, it would be appropriate that the list of acts which will be subject to re-opting in be ‘politically’ agreed by June.”

Of course, that is not a note from the Cabinet or a leak from the Home Office. It comes, apparently, from the presidency. Perhaps there is a misunderstanding about the way in which we work. The Home Secretary has said today that she will get her list ready by December and that Parliament will then have an opportunity to vote. Given that Parliament is not usually given a great deal of time to deliberate such matters, I imagine that once the measures have been agreed, there will not be a huge amount of notice before Members come to the House and vote on these issues.

The Minister for Europe, in a written ministerial statement on 20 January, said:

“I hope that today I have conveyed to the House not only the Government’s full commitment to holding a vote on the 2014 decision in this House and the other place,”—

that has been re-emphasised by the Home Secretary today—

“but the importance that we will accord to Parliament in the process leading up to that vote.”

If there was a need to know the view of Parliament, it is contained in the joint report. The three Committees decided that the best course of action would be to have a good debate on the Floor and for individual Members to decide, in their own way, what they wished to vote on. I am quite certain that when this matter comes before the House, I will vote in a different way from some members of the Home Affairs Committee, because we have not taken a view on every single measure. One point that we have put before the House is that we think it vital, even if the Government decide to put the whole package before the House, that we have a vote on the European arrest warrant.

I do not believe that we have got it right with the changes to the European arrest warrant that the Home Secretary has announced. I support the European arrest warrant. I think, for the reasons given by both Front Benchers, that it is a vital tool when dealing with people who have committed terrible crimes. The Home Secretary mentioned one case in which somebody had stabbed someone 86 times. Of course it is right that we have a quick power that enables us to ask a colleague in the European Union to hand over someone who is suspected of committing a crime of that seriousness, and that that person should arrive as soon as possible. The shadow Home Secretary is absolutely right to support the European arrest warrant.

However, time and again Members of this House have raised worries, including in evidence to the Home Affairs Committee, that the European arrest warrant has not been used very well in a number of cases. The hon. Member for Enfield North (Nick de Bois) has spoken about the Andrew Symeou case. The Select Committee heard evidence from the constituent of the hon. Member for South Dorset (Richard Drax), Michael Turner, who was extradited to Hungary and incarcerated for month after month, but never faced any charges. We were therefore very concerned about the practicalities of what was proposed.

The Home Secretary said in her evidence to the Home Affairs Committee that she felt that she had made the changes that were necessary to deal with the concerns of Members of this House through the proportionality test. However, the evidence given by a number of individuals, some of whom were from Germany, indicated that that was not enough to protect a citizen who was the subject of a European arrest warrant that was issued for frivolous reasons.

I thank the right hon. Gentleman for the work that he is doing. Like him, I think that it is fundamental that the House has a vote on the European arrest warrant. It is a very flawed device. My big worry is that it is this House that must be the fount of our liberties and our criminal justice, not a foreign court.

That is a very important point. We need to be able to debate these issues and vote on them. The European arrest warrant is one such example.

The Government estimate that the unit cost of executing an incoming European arrest warrant in the United Kingdom is approximately £20,000. If we round up the 999 requests that were received in 2011, the estimated cost was £20 million. Some of the figures are extraordinary. Poland issued 3,809 arrest warrants. I had promised not to mention the arrest warrant issued for the man accused of stealing a wheelbarrow but cannot resist. Another example was a warrant for a man who absconded from a Polish prison while on day release. There was another warrant for someone alleged to have been involved in a minor drug offence. Another man subject to a warrant had given false details on an application for a £200 bank loan that, in fact, had already been paid off. They were all the subject of a European arrest warrant—there were 3,809 arrest warrants from Poland alone.

The number of surrenders from all countries to those 3,809 arrest warrants was 930. The UK issued 205 arrest warrants—we have a better surrenders record at 99. Germany issued 2,138 arrest warrants and had 855 surrenders. The total number of European arrest warrants received by member states is higher. Germany received 14,034 requests under the European arrest warrant scheme, the UK received 6,760, and Poland received only 296.

I travelled to Poland and met officials. I asked prosecutors why Poland kept issuing European arrest warrants for crimes that would not be regarded as very serious in our country—we would certainly not issue the EAW for such crimes. The prosecutors were very open, saying that issuing warrants was required by the law. If a judge issues a European arrest warrant in Poland, the Polish police are obliged to execute it, telephone the authorities in the UK, Germany or another country, and ensure that the warrants are executed. They were looking at ways in which they could limit the issuing of warrants. A much better use of the Home Secretary’s time would be to negotiate with some of those countries and tell them that they would make their cause much easier for us to follow, and make the European arrest warrant easier for us to defend, if they did something about their domestic law, as we have done. I am saying not that we are a model, but that we are doing extremely well in using the arrest warrants only for the most serious cases—those that the Home Secretary and shadow Home Secretary have described.

I would have liked the opportunity to vote on the Europol regulations. As the House knows, 3,600 internationally active organised crime gangs operate in Europe. We need Europol. We have a British head of Europol— Rob Wainwright. He was re-appointed by the Home Secretary and appointed by the previous Government. Mr Wainwright does an excellent job. We need to be in Europol and need to opt back in to that arrangement. That would enable us to be part of trying to deal with those very serious issues occurring all over Europe.

There are other examples, such as the measures dealing with the criminal records information system. We need to share such information but cannot at the moment because of the issues we are discussing. Members of the House would have liked the opportunity to discuss those matters and vote on them.

Although we will not be allowed a vote in the House tonight, I hope the Home Secretary will look again at the reports of the three Select Committees and allow hon. Members a vote as soon as possible. I hope that, when she winds up the debate, she will tell us whether the timetable set by the presidency is the right one—should we make our decisions politically by June, before the recess, and vote on them in December?—because that will give the House a clearer view as to how to proceed.

My hon. Friend makes an important point. The UN raised with us how important it was that the countries providing the greatest support and generosity to Syria as neighbours should not feel that other countries across the world had turned their backs. That was one of the most important reasons for being part of the support for the programme. I will come later to her point about the UN programme, which is particularly important.

Will the Leader of the Opposition use his good offices with the French President? It seems that the French contribution to overseas aid has been tiny compared with the UK’s, and France is surely in a good position to help.

As I have just said, the three party leaders jointly called on countries across the world to do more on aid, and it is right that we should continue to do so. France has signed up to the UN programme to take around 500 refugees and provide assistance for the most vulnerable people in the region, which is also right. We want countries across the world to work with the UN and international organisations to provide assistance to those who are most desperate.

As the UN has made clear, some of the most vulnerable refugees are struggling to cope and survive in the camps. It told us about women who have been badly raped and abused, and who are at risk of further abuse in the camps. There are children with no one to look after them whose parents have been killed and relatives lost, and those who have been tortured and are still enduring terrible mental and physical distress. We need to provide help now for those people as a matter of our common humanity.

What is the prognosis, assuming that the House agrees with the Minister’s sensible view tonight, for getting the EU to drop this interference and let us do what we want?

It would be helpful if this House passed a reasoned opinion, and there was certainly support in the other place in a debate earlier this evening. I know that other member states have similar views, whether or not they are in favour of the Commission’s proposals, on the justification for this particular legal base. I am hopeful that good sense will emerge as a consequence.

The hon. Lady makes an important point. The Republic of Ireland has said it will not be opting into the new Eurojust measure at this point in time because of concerns it has. That underlines that the UK is not in any way isolated on this matter. There are genuine and real concerns about the Eurojust measure, in large measure because of the interconnection with the EPPO. Various Parliaments around the EU do not support this measure, as shown by the yellow card having been issued in relation to the EPPO proposal.

I am grateful to the Minister for being so clear in identifying real problems with both proposals, and I urge him to dig in. We do not want these changes and I am glad he is standing up for us.

I am grateful to my right hon. Friend for the support he offers for the Government position. We have clearly set out genuine and real issues in relation to both these measures challenging some of the fundamental principles and aspects of our criminal justice system.

We also have concerns about the risks of reducing member states’ influence under the proposal’s revised governance arrangements. For example, the Commission has proposed the creation of an executive board with a very narrow composition, including the Commission itself, that would, among other things,

“prepare the decisions to be adopted by the College”—

the college being the body on which all member state national members of Eurojust sit. Moreover, the Commission has not proposed the creation of a management board along the lines of that which oversees Europol, which we think is better suited to effective governance of such agencies. In short, the proposal’s governance arrangements are unsound.

Fundamentally, we do not consider that the new Eurojust proposal is even needed at this time. The current legislation is still undergoing a peer evaluation which will not complete until next year, and the Commission has not put forward a convincing case as to why the new proposal is needed. There is not even a specific impact assessment from the Commission for its Eurojust proposal.

Clearly, I am not in government, so I am not in a position to have such conversations, but it is important that the Opposition raise questions about what the Government have been talking to their EU partners about and whether they have been able to form any of the alliances that other hon. Members have mentioned to get the best possible way forward.

As I just said, we are interested in trying to deal with crimes such as human trafficking, financial fraud and the serious organised crimes that go across borders, which are not about what is happening in the UK but are Europe-wide and global. We should make sure that we have procedures in place to ensure co-operation where it is useful.

The three main aims of the reforms are, as we understand it, to increase democratic accountability to member states’ legislatures; to increase efficiency through more streamlined management structures; and to improve EU member states’ effectiveness in the increasingly globalised fight against organised crime. All are laudable aims with which I am sure we all agree. Equally laudable is the aim of increasing our effectiveness in tackling cross-border crime. The Government’s current objections can be divided into those that need working through, which we recognise, and those that, I suggest, appear to be spurious.

The major change, and the one that we recognise poses the biggest challenge, is the appointment of the national member. Under the proposed reform, member states will second a national member—a prosecutor, judge or police officer—to work full time at Eurojust. Member states will grant national members the power to fulfil the task conferred on them by the Eurojust regulation. That means national members, once appointed, will bear responsibility for ensuring that their member states co-operate with Eurojust, including through legal assistance, information exchanges, liaising with international bodies and assisting in joint investigation teams. National members, working with other competent authorities from member states, will also:

“a) order investigative measures;

b) authorise and coordinate controlled deliveries in the Member State in accordance with national legislation.”

The Opposition accept that the appointment of national members represents a big step up for the role of Eurojust. We fully recognise that it is not acceptable for the national member to be in a position of oversight over the UK criminal justice system. I reiterate that we do not support any move to cede prosecuting powers to the EU, either to the EPPO or through some mechanism of Eurojust. However, we would like to see the Government attempt to reconcile those proposals with the current set-up in our criminal justice system.

The Government appear concerned that, as currently formulated, the proposals could allow Eurojust to order investigations, or even prosecutions, that duplicate efforts already under way in the UK. Prosecutions in the UK of course require the consent of the Director of Public Prosecutions, while investigation of most of the crimes listed in annex 1 are the responsibility of the newly formed National Crime Agency. Perhaps the Minister will explain what work is being done to look at the possibility of drawing the national member from one of those bodies and work on the basis of a memorandum of understanding to ensure that the UK retains sovereignty over our systems while improving cross-border co-operation. As has been mentioned, special arrangements will need to be put in place for Scotland.

First, the right hon. Lady is not right to say that checks were suspended. That is not what the report says. As she will know, there is a layered approach at Calais. Checks are done by Border Force officers, and searching by the port authorities also takes place, using equipment supplied by us. We also have contractors, who were absolutely excellent and very successful when I visited in the summer. The day I was there, one of our contractors with detector dogs had that morning found 24 people attempting to enter—[Interruption.] Well, with the greatest respect, I know that labradors are intelligent, but I do not think that that labrador was aware that a Minister was arriving to observe the search for clandestine immigrants. I believe that that level of performance is sustained every day. [Interruption.] The hon. Member for Rhondda (Chris Bryant) has not had a great summer for well-researched thought-through speeches, as everyone in the House is well aware. Perhaps it would be welcome if we heard a little less from him. It is not the case that checks were suspended, even if Border Force officers were dealing with queues. Freight searching was still being carried out, both by our contractors and by the port authorities.

The shadow Home Secretary also referred to the decision not to fingerprint clandestines. I remind her that that decision was actually taken by the former Government of whom she was a member. It was taken early in 2010, which, if I remember rightly, was before the last general election. As I said in response to the chief inspector’s report, that is something that we are reviewing to see whether the decision remains sensible.

On the issue of a culture of fear, all I can say is that I have visited a number of our ports—both airports and seaports—and our juxtaposed controls and, in my experience, the officers I met were, as I said in my statement, dedicated staff. I did not find any reticence on the part of officers in either saying what they were good at or stating where they thought there were issues. They raised their concerns directly with Ministers, and my experience was also the experience of the director-general. I say simply, then, that what the right hon. Lady mentioned was not my experience.

I think I have dealt with the shadow Home Secretary’s point about leadership, as we have now appointed a permanent director-general who, in his capacity as Second Sea Lord, has a record of achievement from outside the Department. I believe that he has already started to lead the organisation in a very powerful way.

Finally, the right hon. Lady made a last throwaway remark about our pilot of publicity on vans. I would point out here that most of the public support the tough stance we have taken on illegal immigration and that the majority of voters of all parties—72% of the public—support the vans. They want to see our tough approach continue and they do not want the weak approach of the Labour party.

I would like to thank the Minister for a very visible improvement in the performance of the Border Agency over the last year or so, and urge him to work with his staff to ensure that ever-higher standards are achieved by promptly and courteously allowing the legal people in and by ensuring that we find all the illegals at the first point of entry.

I am grateful to my right hon. Friend. I know from a conversation we had that he has seen the work that our border officers do in our juxtaposed controls, where attempted illegal entries are prevented from even getting to the United Kingdom. He makes a good point, too, about the rest of the UK Border Agency after the agency’s split into the two component parts of UK visas and immigration and immigration enforcement. It is doing exactly what my right hon. Friend said, which is to welcome those who come to Britain to contribute—skilled workers and students, for example—while deterring those who do not and ensuring that those who overstay their welcome are removed from the country.

My hon. Friend raises a very important and valid point. It is our intention––and we expect to be able––to work with the European Commission in order to ensure that the transition period for any measures that we want to opt back into is as smooth and as short as possible. It is clear that the Commission will not start properly to look at those transition arrangements until we are clear that we are going to opt out and then try to opt back in.

An opt-out from all the measures would be very popular on the Conservative side in this House and outside. That is what we want to do, because we do not trust Europe to boss us around and take our democracy from us. Why not vote for the opt-out today and then vote on any possible opt-back-ins after the consultation and consideration at a later day?

Does the shadow Home Secretary accept that if we opt in to a fundamental measure such as the European arrest warrant, some future Home Secretary could find an ECJ judgment that fundamentally went against the view of this House and that Home Secretary’s ability to conduct criminal justice properly, and they would be unable to do anything about it?

The right hon. Gentleman is right to say that opting into the EAW does mean it will be subject to the ECJ, but I have to say to him that the importance of the EAW, not only to our crime-fighting and to British police forces, but to victims is so immense that it would be highly irresponsible, against the national interest and against the interests of victims of crime to opt out of it. I understand his views, and it is important that he should have the opportunity to express them, but I just disagree with him on this matter, given the serious cases we have seen. About 900 suspected foreign criminals are extradited to other European countries each year as a result of the EAW being in place. Without the EAW it would take far longer to be able to send back the suspected criminals who ought to be returned, be it to their home country or to the countries in which they are alleged to have committed serious crimes, in order to be tried and to face justice.

Today’s debate should be about the very future of the United Kingdom’s democracy. I and many of my right hon. and hon. Friends believe that one of the great duties of a state is to settle on a fair and strong criminal law and to ensure that the crime-fighting resources are put in to maintain that law. We also believe that, in an increasingly global world of criminal activity, those functions can be properly discharged by the Home Secretary in Cabinet and by the police forces of our country only if we have proper co-operation and collaboration arrangements with other countries abroad. We need those co-operation arrangements, not just with other European countries in the European Union or the few countries in Europe not in the European Union, but with every country around the world. I am pleased to say that thanks to successive Governments and Home Secretaries we do have in place a set of pretty good arrangements with the major countries, and we have demonstrated our ability to negotiate successful arrangements for extradition and mutual crime fighting with those countries that are not in the European Union and to find ways of doing that with countries in the European Union.

Let me make it clear at the outset that those of us who do not wish to opt back in to European criminal justice measures are no more soft on crime than anyone else in the House. We believe that there can be an alternative way of ensuring proper co-operation and collaboration with France, Germany and the other leading European Union countries, just as we have those successful co-operation arrangements with countries that are outside the European Union.

Our objection to any of these measures, including the European arrest warrant, is not necessarily about the measure itself, and certainly not its purpose, but about the way in which the institutional structure is developed to back up the measure. We are trying to protect our democracy, this Parliament and future Home Secretaries from the event that the European Court of Justice, once we have opted into any of these measures, can use that opt-in as a device for making good criminal law in Brussels and in the Court that this House and the British people might fundamentally disagree with.

The right hon. Gentleman talks about alternatives to some of these measures. Is he aware of the formal evidence given by the police, who said that alternatives to the European arrest warrant

“would result in fewer extraditions, longer delays, higher costs, more offenders evading justice and increased risk to public safety”?

Does he accept that that is the police’s advice?

Of course we can find police and others who take the hon. Gentleman’s view, but I think that it is putting very different weights in the balance. He is giving us an immediate topical problem of view, and I am giving him something fundamental about a national democratic state and the future good government of our country. When I weigh those in the balance, there is no issue for me; of course we must protect our national democracy and then work away at any imperfections there might be in the cross-border arrangements because we have put democracy first.

If the right hon. Gentleman is challenging the fundamental idea of an international arrest warrant operating among the 28 member states, is my maths correct that he would have to replace it with 784 bilateral extradition treaties, and that is just on one of these justice and home affairs measures?

My maths tells me that there are far fewer countries in the European Union than in the rest of the world, and we manage to have pretty good arrangements with the rest of the world. I have every confidence in the ability of the current and future Home Secretaries to restore our bilateral arrangements with the other 27 members of the European Union just as surely as we have bilateral arrangements with most of the other 200 countries in the world. The hon. Gentleman will remember that there was a time before this country was in the European Union, and certainly before we were in this current set of criminal justice arrangements, when we had perfectly good working relationships. I am sure that he and I would have liked them to be improved—one can always improve and make progress—but he should not be so defeatist about the ability of our Ministers and civil servants to defend Britain’s interests and come up with a good answer.

The right hon. Gentleman suggests that it would be perfectly fine to abandon the European arrest warrant and rely on bilateral arrangements because we have such wonderful arrangements with so many other countries in the world. The Russian Federation, for instance, is covered by the previous version of the EAW, the European convention on extradition, but we have not managed to get Mr Lugovoy back, have we?

To find a country where there is a problem does not disprove my case. My case is that if there is good will—[Interruption.] The hon. Member for Rhondda (Chris Bryant) seems about to allege that all members of the European Union cannot be trusted and that we can do a deal only with the Commission. I have more faith in France and Germany than he does. I think that it would be in France’s and Germany’s interests, should Britain opt out of the European arrest warrant, to put in place really good arrangements, because they will want them to operate for them in Britain just as surely as Britain needs the arrangements to operate in France and Germany. As someone who does not like centralised European government arrangements, I find that I am often warm-hearted towards, and supportive of, the French and Germans and believe that we can make very good arrangements with them because it is in our mutual interests to do so. It is the rapid pro-Europeans who so dislike our French and German partners that they say that it all has to be bound up in central European government because we cannot trust France and Germany to come to a sensible arrangement with us over these important matters.

What is it about our country that these people do not like? What is it about our national democracy that they wish to tear down? A previous Government negotiated in good faith the third pillar arrangements for criminal justice. The idea of the third pillar was that, yes, we wanted enhanced co-operation and collaboration with our nearest neighbours, and of course I accept that there are more likely to be issues with France, Belgium and Holland, because they are very close, than with countries in Asia, so there is a reason for enhanced collaboration. We worked out a system in which we could have better procedures, enhanced collaboration and more co-operation, based on the mutual agreement of the states involved, not based on an independent united states of Europe Government, which is emerging as a result of this and other exercises but not from an independent court where there is no democratic accountability to the British people.

In recent months, we have had case after case from the European Court of Human Rights that this country and the British people have deeply disliked. There is very little we can do about that. If we give further enhanced powers to the European Court of Justice, we will have another series of such decisions from the European Court of Justice that we do not like. All major political parties will have to go to the electorate, shrug their shoulders and say, “We can do nothing about it. We still expect our salaries and to sit in the Parliament of the United Kingdom, but don’t expect us to revise this. We no longer run the criminal law and can no longer change the law in the way you want or expect. That is now settled in Brussels. Even your MEPs probably won’t be able to sort it out because the European Court of Justice is supreme above all elected officials and can provide the motor for making decisions on these crucial matters.”

The case before us today is very simple. Those who vote for opt-ins vote for European centralised justice and for the uncertainty of the European Court of Justice, which will in due course make decisions that the British people and their elected representatives cannot tolerate. Those who vote for opt-ins vote because they do not like this country’s democracy and they vote themselves out of a job.

Those of us who vote for the opt-out, and nothing but the opt-out, vote for the reverse. We vote for the House to take the responsibility. We vote to trust successive Home Secretaries. We vote to trust the judgment of the British people to judge their Governments and Home Secretaries, elect those who do a good job and throw out of office those who do a bad job. That is a true democratic system.

I do not want to live in a country where criminal justice has been transferred to independent experts abroad whom we cannot sack or influence. I do not want to go to my electors and say, “As a result of the vote we have had tonight and what happened subsequently, another major power of this country’s democracy has been seceded to the European Union in perpetuity in such a way that we can never get it back.”

It is a simple issue. I urge the House to vote for the opt-outs and against the opt-ins.

I take a strong view on these matters not only in respect of the importance of scrutiny as a matter of principle, but because, as I have said so often, this House should make the decisions. We should not have them imposed upon us.

I note that we have three senior Committee Chairmen, all of different parties, supporting it, and I think I heard those on the Labour Front Bench implying that they, too, supported it. Can my hon. Friend say whether this is now the view of the House?

I am very grateful that the right hon. Lady is so attentive. Why does she not understand that what we want is to have democratic accountability to the British people through this House of Commons? We want these things done by agreement between our country and the European Union, but not under European law. Her party gave away 138 vetoes over crucial policy areas, which makes it very difficult to govern this country democratically.

I wonder whether the right hon. Gentleman is really aware of the detailed implications of what he has said. He is arguing for a huge number of different bureaucratic arrangements with every country, whether on extradition or on legal frameworks. Let me give him an example of how the current framework operates. James Hurley, who was convicted of killing a police officer and escaped from custody, was returned two years ago under a European arrest warrant, and is now back in a British prison.

My hon. Friend is correct that we have extradition treaties with other countries that are not members of the European Union, and we had extradition arrangements before the European arrest warrant came into place. However, as I set out earlier, we will look at each measure to determine whether it contributes to public safety and security, whether practical co-operation is underpinned by it and whether there would be a detrimental impact on such co-operation if it was pursued by other means. I think that those are entirely sensible principles on which to base the proposals that the Government will bring forward in due course.

Will the Home Secretary also take into account the impact that all these things have on British democracy? Some of us are deeply worried that Ministers do not have enough powers and cannot be accountable to this House because they can be trumped by perverse European Court of Justice judgments.

May I say in response to the shadow Home Secretary’s first question that she should perhaps listen to what she herself said in her statement? She said that SIAC had suggested that there should be a change to a number of aspects of Jordanian law and/or a change to the obligations on the prosecutor. It is such a change to the obligations on the prosecutor that is in the mutual legal assistance agreement that I have signed with Jordan and that has been laid before both Houses of Parliament, and that will therefore deal with that particular issue.

The right hon. Lady asked about the failure to appeal to the European Court. She has raised that issue before and I have answered her before. She seems to think that I should have appealed to the Grand Chamber of the European Court, but that would have jeopardised the Government’s wider deportation with assurances programme and risked the blockage of many other deportation cases. She should also look at what she has previously said on this issue. What she is saying today is not what she was saying last year. In this House, on 17 April last year, she said of me:

“I welcome the assurances that she has obtained from Jordan. Previous agreements were in place, but she was right to pursue further assurances.”

If she thought we should have appealed to the Grand Chamber, why did she think that we needed to pursue those assurances? If that is not clear, she should also remember what else she said:

“We understand, too, that the Home Secretary believes it is too risky to appeal to the Grand Chamber. I understand she would have had legal advice on that, and I do not want her to pursue an unwise and risky process”.

The right hon. Lady asked about the relationship with the European Court of Human Rights in Strasbourg. The House will know that it is my clear view that we need to fix that relationship and that all options, including leaving the convention altogether, should be on the table. The Prime Minister is looking at all options, and that is the only sensible thing to do.

There are a number of questions for the right hon. Lady. She talked about why this did not happen sooner, and we have heard all sorts of claims from the shadow Home Secretary and the shadow Immigration Minister about what I have said. A year ago, I said in this House:

“hon. Members must be aware that”

what I was announcing at that time

“does not necessarily mean that he”—

Abu Qatada—

“will be on a plane to Jordan within days. There is still a potential avenue of appeal to the Special Immigration Appeals Commission court, and beyond. That appeal process could take many months”.—[Official Report, 17 April 2012; Vol. 543, c. 175-6.]

I have to tell the right hon. Lady that simply repeating something and wanting it to be true does not make it true; she should look at what was actually said here.

Finally, the right hon. Lady herself has to answer some questions. Does she support what the Government have done? [Interruption.] The right hon. Lady says she wants a vote. I am asking her very clearly whether she believes that the Government have taken the right course of action in what we have done. Beyond that, will the Opposition support what we want to do, which is to strip out appeal rights for foreign nationals, or not? Will we have a cross-party agreement that we need to deal with the issue of the length of time deportations take? We could do that by taking out layers of appeal. Perhaps even more significantly, will the Opposition agree with us that we need to sort out our human rights laws, which were passed by their Government?

This mutual legal assistance agreement with Jordan has clauses within it that, as I say, address the issue raised by the SIAC court and the European Court about Abu Qatada. I hope that the right hon. Lady will support the Government—not just on this case, but in sorting out our human rights laws and our processes of deportation.

Given the way in which successive British Governments have been made to look impotent by the European convention and regime, when will my right hon. Friend bring proposals before this House to ensure that the will of Parliament and of the overwhelming majority of the British people can be upheld, common sense applied and justice delivered in these difficult cases?

My right hon. Friend will have to wait and see what we intend and are able to bring to this House. I have already indicated that I intend to address some of these issues in a new immigration Bill if parliamentary time allows for it.

I have taken this decision after, as I have said, the most careful consideration of all the material—medical and other—that has been available to me. Having considered that material, I took the decision announced to the House this afternoon. The right hon. Gentleman mentioned video-conferencing. The American Government have made it clear that undertaking such video-conferences would not be possible under their constitution. Cybercrime is an issue, obviously, but he hints at the question of whether someone should physically be tried in the UK or prosecuted and tried in another country, be it the United States or elsewhere. Of course, the introduction of the forum bar will offer a transparent process whereby people will see how decisions are taken on whether it is right for someone who is subject to an extradition request to be tried here in the UK or in the US.

I warmly welcome the Home Secretary’s wish to improve our extradition arrangements. Does she accept that many of us in this House feel that the US-UK arrangements were unfair to the UK and that the European arrest warrant is unfair to the UK? We look to her to reform to give Britain and her people a better deal.

I thank my right hon. Friend for his comment. As I said in my statement, I think that the UK-US treaty is, as Sir Scott Baker found, broadly sound. It is important that we have a robust treaty on extradition with the United States and that we ensure that extradition can take place both ways across the Atlantic. As I have said, there are a number of ways in which we need to change how we operate so that people can see that the extradition arrangements are fair and can take comfort and have confidence in them. The British people need to have confidence in our extradition arrangements.

I am grateful for the Home Secretary’s statement and I fully support opting out of the whole lot. Will she make sure that, were we to want to co-operate with our partners in certain areas in future, that will not be done by a route that prevents us from changing our minds or prevents Parliament from being sovereign?

As my right hon. Friend knows, this Government have done more than any other to address the issue of the balance of our relationship with the European Union. It is right that we should have the opportunity to opt out from these measures and that we should look seriously at measures that we might wish to opt into. Obviously, that will take time and involve a considerable amount of discussion and negotiation with the European Commission and other member states.
