I congratulate the hon. Member for Upper Bann (Carla Lockhart) on securing the debate, and on the very powerful and poignant speech she delivered to the House this evening. Her comments on the brutal murder of William Heenan will have struck a chord with all who have heard the debate tonight. The loss and impact on his son Sammy Heenan, and on the rest of the family, is lifelong. I am sure that all in this House would wish to convey our deepest and sincerest condolences for his and their loss, and for all the pain that they continue to suffer. 

Certainly, as a former Secretary of State for Northern Ireland, I have met too many who continue to suffer that pain and that loss. We still collectively need to do much more to be able to look to Northern Ireland’s future with a positive sense of the amazing place that it is and the incredible people there who make it such a special place, while equally knowing that the legacy of the troubles and of the past still runs very deep and knowing the pain that it continues to cause. Therefore I understand and hear that sense of the need for us to be able to look to a future beyond all of those troubling issues.

I speak as the Security Minister, and therefore look to these issues of national security across all parts of our United Kingdom. I was struck by the emphasis that the hon. Lady gave to issues relating to this House, which brought to mind the response that she received from the Leader of the House recently during business questions when she highlighted this point. The Leader of the House underlined that very clear message, saying:

“We should remember and commemorate those who were killed”,—[Official Report, 26 November 2020; Vol. 684, c. 993.]

drawing to mind the shields within this House to remember Airey Neave and Ian Gow, and stating that commemorating those who committed murder is absolutely not what we as a House should do. I understand that it is in that sense that the hon. Member for Upper Bann approaches all of this.

I want to look at the work that we do as a Government across the United Kingdom, and I am sure that the hon. Lady would join me in recognising the work that happens here and now. What do I mean by that? I mean the work of the Police Service of Northern Ireland, MI5 and others, who work tirelessly to keep people safe and have our full support for the immense contribution they make on a daily basis. I commend all those who, sometimes quietly, sometimes out of sight, help to deliver safety and security for the public in Northern Ireland and Great Britain. That ongoing work by the police and MI5 means that most people in Northern Ireland, mercifully, are not directly affected by the severe terrorist threat that endures.

It remains unacceptable that, decades on from the Good Friday agreement, there are still groups who are using and hiding bombs and bullets in residential areas, putting their own agendas above the rights of the community who want to live and thrive in peace. Where terrorism, paramilitary-style attacks and attacks on the community endure, so, too, will our efforts to tackle them. We will always do everything in our power to ensure they do not succeed.

I take this opportunity to commend the recent successes of Operation Arbacia, an ongoing Police Service of Northern Ireland-led operation into the activities of the New IRA, which has involved collaboration with partners such as MI5, Police Scotland, An Garda Síochána and the Metropolitan Police Service. In August, the Police Service of Northern Ireland arrested 10 people, all of whom have now been charged with a range of terrorism offences under the Terrorism Act 2006. Violent dissident republicans cause substantial harm to communities and the fabric of society. These arrests, I believe, are a welcome step in maintaining peace in Northern Ireland and keeping people safe from criminality and violence.

We have robust UK-wide legislation to counter the threat of terrorism and protect the public. The legislative framework was established in the Terrorism Act 2000; it was updated and strengthened in the post-9/11 era, again more recently to respond to the threat connected with the Syrian conflict and individuals travelling from this country to join terrorist groups, and then again following the attacks in the UK in 2017. Our framework provides a coherent approach, including an ideology-neutral definition of terrorism, which determines the scope of other terrorism powers and offences.

On the particular issue raised in this debate today, the Government are clear that statements that encourage or glorify terrorism are unacceptable and that individuals who make such statements should be liable for prosecution. It is an offence under section 1 of the Terrorism Act 2006 for an individual to intentionally encourage members of the public to engage in terrorism or be reckless as to whether their statements will encourage it. That applies whether or not any person is in fact encouraged or induced to engage in terrorism as a result of the individual’s statements.

The Counter-Terrorism and Border Security Act 2019 updated the section 1 encouragement offence in three ways: closing a gap that existed whereby the offence would not necessarily be committed in a case where someone radicalised or sought to encourage a child or vulnerable adult to carry out an act of terrorism; ensuring extra-territorial jurisdiction applies fully to the encouragement of any act of terrorism, meaning that a person may be prosecuted in the UK for conduct that took place outside the UK that would have been unlawful had it taken place here; and increasing the maximum penalty available following a conviction from seven to 15 years’ imprisonment to reflect the seriousness of the offence. That is an appropriately broad offence of encouragement, which also covers the glorification of terrorism and ensures that perpetrators can be prosecuted appropriately.

In addition, our counter-terrorism legislative framework includes the separate offence under section 12 of the Terrorism Act 2000 of inviting support for a proscribed organisation. The 2019 Act extended the offence by making it clear that it is illegal to make statements in support of a terrorist organisation or to be reckless as to whether others will be encouraged to support the organisation.

I am always mindful of the Minister’s exceptional contribution when he was the Secretary of State for Northern Ireland, and I thank him for that. The council that represents my area is Ards and North Down Borough Council. It wanted to name a leisure grounds and playground after Blair Mayne, who is a hero of the second world war. It was called in because of the legal process in Northern Ireland, yet Newry, Mourne and Down District Council was able to name its play park, where children play, after a convicted terrorist who died by his own hand in the Maze. Is that right? Is that council not accountable under what the Minister has said, and can it not be made to change that name and remove it?

I appreciate and respect the point that the hon. Gentleman makes. He will understand that I am not familiar with all the circumstances or indeed whether it would be appropriate for me as a Minister to try to determine what a particular community would do, but obviously he makes an important point on how we reflect on the issue of building strong communities and looking beyond division and that sense of difference. Indeed, we should not be looking backward to the issues of the past, but looking forward to what I believe can be a positive, outward-looking, exciting future for Northern Ireland and all the young people who have not been touched directly by those issues of the past that sadly still, through family and through the impact of things such as paramilitarism and separation, touch Northern Ireland in this way.

The hon. Lady sits on the ISC, and I commend the Committee and the comments of its Chair earlier in relation to these really important issues. The hon. Lady is right to highlight how the increased use of the internet as a result of covid-19 has brought into focus the need for us to remain vigilant of terrorists seeking to exploit the situation. We are working closely with tech companies to ensure that preventing terrorists’ use of their platforms continues to be a priority and that companies are responding quickly to any emerging threats. We need to focus on the issue of end-to-end encryption, which intentionally blinds tech companies’ access to content and would have a disastrous impact on public safety. That is why we ask them to find solutions that put the public’s safety first, and they must not turn a blind eye to this problem.

I thank the Minister for what he has said. Last weekend, the papers in Northern Ireland reported that dissident republicans had a very large bomb, and intelligence agencies indicated that they were trying to find it. For our police to effectively prevent and respond to terrorist attacks, they need to have all the funding and resources required. Can he confirm that the £90 million funding boost that this Government delivered for our counter-terrorism police this year ensures that our regional forces have the capabilities to mount a swift and effective response to any terrorist attack and that additional funding is making its way to Northern Ireland as we deal with our additional threats of the home-grown variety—dissident republicans?

It will not surprise the hon. Gentleman to know of my focus on issues of Northern Ireland’s security, given the incredible and positive time that I had experiencing the wonderful people of Northern Ireland. We remain very conscious and vigilant of the threat. As he will understand, I will not comment on issues of intelligence, but I can assure him that we take a co-ordinated and resolute approach, which plays into the consideration of funding, to ensure that all parts of our United Kingdom are safe and secure.

Thank you for calling me to speak on this matter, Madam Deputy Speaker. There is a little more frightening than a raging fire, as it is then that we truly understand the little we are able to do in our human state. We are so thankful for those in the fire service, who use their expertise and training, yet, ultimately, lay their lives on the line every time they answer the call. Others have said it, but I want to put on record my thanks to them for all they do and have done.

The Grenfell tragedy had repercussions for all of the United Kingdom of Great Britain and Northern Ireland, so although it happened on the mainland, and although this legislation is for England and Wales, I wanted to make a brief contribution to ask that the lessons learned are shared with Northern Ireland. When the Grenfell tragedy took place, the Northern Ireland Assembly and the bodies with responsibility for this area right away checked all their high-rise flats to see whether the danger that there was on the mainland was or was not apparent in Northern Ireland. Some steps were taken right away. I know it is a devolved matter, but I wish to mention something at the end that the Minister might take on board, and it relates to what we have learned in Northern Ireland.

This Bill is a devolved matter for Northern Ireland, so my comments will be brief. It is clear that the improvements in this Bill to create greater fire safety must be considered UK-wide. My colleagues in the Northern Ireland Assembly have taken seriously the lessons that we have learned from the absolute tragedy at Grenfell. I take this opportunity once again to remind all the families involved that our thoughts remain with them as they try to rebuild their lives. I do not think there is anybody anywhere in the whole of the United Kingdom of Great Britain and Northern Ireland or further afield who was not touched by what happened, as we watched the tragedy unfold.

I echo other hon. Members’ comments about the danger of electric goods, and in particular about the need to have them checked so that they meet the standards that we have in the United Kingdom, which are some of the highest in the world. The hon. Member for Southend West (Sir David Amess), who represents that great city of Southend, has been an excellent, outstanding spokesperson on this matter, along with our former colleague and friend, Jim Fitzpatrick. I remember him fondly; he, I and the hon. Member for Southend West shared many debates in that other great place, Westminster Hall, on electrical safety and other things. We had some very good and enjoyable times. One thing that was outlined was the opportunity for people to buy online goods that may not meet the standards. I am sure the Minister will say how the Government are addressing those issues for online purchases, which I believe need to be checked.

I welcome the remediation programme, supported by £1.6 billion of Government funding, to remove unsafe cladding from high-rise residential buildings, and the commitment of £20 million of funding to enable fire and rescue services to review or inspect all high-rise multi-occupied residential buildings by the end of 2021, but it is clear that more needs to be done. Right hon. and hon. Members from both sides of the House have said that, and hopefully the Minister will be able to say what other steps the Government are looking at to try to make improvements.

I do not want to be alarmist, but the Northern Ireland Assembly’s inquiries into safety standards raised not just the issue of cladding—the Northern Ireland Housing Executive carried out those risk assessments, because cladding is its responsibility—but concerns about reports that 63% of Northern Ireland Housing Executive wall cavity insulation may be defective. There was some concern that the cavity wall insulation could in some way lead to worse fires and could be a conduit, allowing fires to go through buildings. I do not expect an answer from the Minister today if he has not got one, but I know that he always follows up, and we thank him for that, so perhaps that could be looked at. We are awaiting more information, but that raises a pertinent issue. I believe that it must be absolutely clear in any legislation that it is the building owner’s responsibility to make safe not simply the outside of the walls but the inner cavities. I would appreciate it if the Minister could clarify how that is legislated for in this Bill.

Has the Minister had any discussions with other regions of the United Kingdom of Great Britain and Northern Ireland about a UK-wide approach to this issue? I often say in this House that lessons learned in England and Wales can and must be shared with the devolved Administrations—the Northern Ireland Assembly and the Scottish Parliament. This debate is not about that, but none the less it is important that we share things. We can learn from each other in this great United Kingdom of Great Britain and Northern Ireland. If things are learned in Northern Ireland, they should be shared with the rest of the United Kingdom. If they are learned in England and Wales, they should be shared with us in Northern Ireland, and with Scotland. An improvement can be made UK-wide so that all the people of this great nation of the United Kingdom of Great Britain and Northern Ireland can benefit.

It is a privilege to respond to this debate. It is the first time I have had the chance to speak physically in this Chamber since March, so it is a great pleasure to be here tonight to respond to what has been a passionate, well-informed and very serious debate on issues that touch on concerns that we share across this Chamber. Like others, I very much underline our recognition of the context of the Bill: the Grenfell Tower fire and the need to ensure that people feel safe and are safe in their homes. I pay tribute to the community of Grenfell—Grenfell United and more broadly—on their determination to seek justice and change, and I recognise the responsibilities we hold to them in following through on that.

The Minister will be familiar with the four horsemen of the apocalypse; I believe that Russia is one of those horsemen and a real danger to the free world. Will the Minister further outline what lessons we have learned from the report that will help us to counteract the very real presence of Russian interference, especially in social media? How do we balance safety with our inalienable right to hold and express our political opinions?

The hon. Gentleman wrapped a few questions into that contribution. The point is that we are taking this issue forward in relation to our legislation on online harms and working with social media and other companies to ensure that information is valid and we do not have that sense of disinformation. We are being vigilant against the threats that are posed.

First, I thank the Minister for bringing this order to the House, which is really important. There is rightly a focus on ISIS terrorism here in the United Kingdom, on the mainland, but there is also a rise in right-wing terrorism. He mentioned the attacks in Germany, but here on the UK mainland, there are indications of a rise in right-wing extremism. These groups may masquerade as different organisations and try to transform or transmute into something else, and the proscription of the SKD is very important. Has the Minister, or perhaps the Minister for Crime and Policing, had an opportunity to have talks with the Police Service of Northern Ireland? It is a yes/no question; we do not need the detail.

I look forward to maintaining the contact with the PSNI that I enjoyed while holding other responsibilities, and I know the importance of focusing on security in Northern Ireland. Equally, I will take this opportunity to underline, in relation to the prevention work for those involved in terrorism, that we are committed to the independent review of Prevent, and this important work will go ahead. We will be running a full and open recruitment process to appoint the next reviewer, and further details will be announced shortly.

Yes, I wholeheartedly agree. I think there probably is a method in place for doing that already. I believe there is—I know it is done in different ways in this House and outside this House—and I know that the Minister’s role as a former Secretary of State for Northern Ireland gives him a real insight into what happens in Northern Ireland.

I wanted to ask that question because my understanding is that there is a growth in right-wing extremism in the Province, probably masquerading under the proscribed organisations already there. I know it is very important, so could I, for the record, gently refer to the IRA dissident threat? It is still very clearly there for police officers and prison officers, with booby-traps under their cars. A large bomb, destined for the Larne ferry, was found and thwarted by the police and intelligence officers—and a real biggie that would have been for the IRA. Again, however, it shows that police forces are on top of that. It is very clear to me that this is a salient reminder that IRA terrorists and IRA dissidents in particular are just as dangerous in the United Kingdom, as indeed are ISIS terrorists.

The Minister referred to going for the assets. I welcome his comment, but could we have a bit more detail, if possible, for the record? It is so important that the assets of such organisations are targeted and focused on in order to take away the money and the opportunity that they quite clearly have. In Northern Ireland, paramilitary groups are involved in drug dealing, trafficking, protection rackets and all of those things. Again, I understand that the close contacts between paramilitary and right-wing organisations in Northern Ireland and those on the mainland involve all the spheres of fundraising that they are trying to use.

I can absolutely give the hon. Gentleman reassurance on the issue of tracking terrorists’ finance and assets. Proscription actually aids this, which is why we have brought this order before the House today.

I just want to assure the hon. Member for Feltham and Heston (Seema Malhotra) that my door is open to all Members across the House on issues relating to how we can brief and give updates. I very much remain open to all colleagues who wish to come and talk to me and, if they have concerns, to draw them to my attention.

Again, I thank the Minister for the confirmation he has given.

I have one wee thing to say on the assets issue. Very often, paramilitary groups or criminal groups turn some of their ill-gotten gains and money into businesses that are legitimate, and they may even pay tax. However, the issue of the moneys to create those assets and those money-making opportunities needs to be addressed. For a company taking on the assets, if we destroy the money-making capabilities, we destroy the organisation that is trying to succeed.

I want to raise a last point with the Minister in relation to the contact he has very clearly said he has with the PSNI. May I ask what contact there has been with the Garda Síochána? I am ever mindful that the person in charge down there is a former police officer from the PSNI, with a good pedigree, and I think the relationship should be strong. Again, would the Minister confirm that that is the situation?

I really welcome what the Minister has put forward tonight, and I am reassured by what he has said. For us back home in Northern Ireland, including in my constituency, and all the other people across the world who wish to build a future that is free of terrorism, the comments the Minister has made are reassuring. They reassure me personally, and I hope they reassure my constituents as well.

It is good to see you restored your place, Mr Deputy Speaker, and a particular privilege to take part in today’s debate on the Gracious Speech, with a particular focus on our precious NHS. It is also good to see the emphasis in the Government’s programme on funding, innovative medicines, safety and mental health, so that we can improve the services that our NHS delivers and improve the lives of those who needs its care.

The timing of today’s debate has some particular poignancy for me. I was struck by the comments of my right hon. Friend the Member for South West Surrey (Jeremy Hunt) about the ups and downs of politics. It is almost exactly two years to the day that I had surgery to remove the top part of my right lung and the cancerous tumour contained within it, but I am pleased to say that, in the immortal lyrics of Sir Elton John, “I’m still standing.” [Hon. Members: “Hear, hear.”] I count my blessings each day, and today provides me with a further opportunity to pay tribute to the incredible people in our NHS who saved my life and continue to save the lives of countless people up and down the country every single day.

I have learned so much over the past two years, and I am determined to use my experiences to act as an advocate for change, especially for less survivable cancers such as lung cancer. I have been heartened by the encouragement of colleagues across the House—even the colleague who upon my return to the Members’ Tea Room after surgery said, “Didn’t expect to see you back.” To this day, I am quite sure that the omission of the words “so speedily” was simply an unconscious oversight.

Over half of us will get cancer at some stage in our lives. That is why we need to be more open about and change the nature of the conversation around the disease. For many people, cancer is becoming the treatment of a chronic condition, and more and more people are living well with or beyond cancer.

I thank the right hon. Gentleman for giving way. I was pleased to see him back after his operation, and he is making a clear case on cancer-related issues. Just this week, I met representatives from the Teenage Cancer Trust who indicated that, for young people and teenagers, cancer is not just about the operation and other physical activities, but mental anxiety, too. The Government have set aside money to ensure that that anxiety is addressed, but only 61% of such services are taken up in hospitals and just 40% of the available assistance and help is taken up afterwards. I am sure that the Government response will be positive, but does he agree that now is the time to address those shortcomings for those who experience mental health anxiety due to cancer?

I commend the hon. Gentleman for his point about mental health issues and some of the stresses and strains, and there is a need for greater focus and attention on teenage cancer patients. That leads me on to my next point, which is about the need to overcome the fear that a diagnosis can bring. I know what that can feel like. Early diagnosis and speedier treatment are key, not least to reduce the worry and sleepless nights that result from knowing something is wrong by getting something done about it. It is great that the NHS long-term plan recognises that. By 2028, the plan commits to improving cancer survival dramatically, increasing the proportion of cancers diagnosed early from a half to three quarters. That is why the NHS Funding Bill, with its commitment to an extra £33.9 billion a year for the NHS, is especially important.

There is, however, a question around how we turn the increased investment and that intent into the reality of improved outcomes. That is why we need to focus on what I term the “SAS”: better screening for the disease, greater awareness of the disease, and a breaking of the stigma attached to the disease. By doing that, we can make a real step change. I welcome the introduction of the targeted lung cancer screening programme, which I championed, and which is being rolled out as we speak. I commend the charities and the regular campaign events to highlight the symptoms and, yes, the importance of getting things checked out—especially for us blokes, who can be pretty rubbish at actually going to the doctors and doing something about it. The stigmas are linked to that, and we need to talk about the big C, because it is the disease that dare not speak its name. False judgments can be made, especially with something like lung cancer, because people may make wrongful assumptions that it must be perhaps the sufferer’s fault as they must have smoked. However, as one leading clinician said so effectively and succinctly at a recent conference I attended, “If you have got lungs, you can get lung cancer.”

All this needs to be looked at in context. We need the right workforce in place with the right equipment and the right systems and processes to back it all up. I welcome the Government’s commitment to increased investment in CT scanners and to increasing the overall number of nurses, but we need to recognise the particular role of specialist nurses and the incredible difference that they make. I look forward to the publication of Baroness Harding’s workforce planning review, and I hope that it sees this special group of nurses strengthened and supported and that their numbers will be increased.

There can be no doubt about the pressures that exist within the system and the increasing demands that our NHS has to meet, but the overwhelming experience of most people who use and rely on our NHS is positive, with a real appreciation of just how special it is. We need to continue to stand up for it, to champion it and to be positive about what more it can achieve. I have every confidence that we will and, in doing so, that we will help improve the lives of the people it serves and the people we are privileged to serve as Members of this House.

I do, in short. Modular building is an essential part of our work to get speedier build out, to ensure diversification of materials, and to get skills for people. It has been good to see how housing associations and the private sector are starting to embrace it. There is more to do, but I recognise my hon. Friend’s point.

The hon. Gentleman will know that housing is devolved in Northern Ireland, but I recognise the absence of an Executive and therefore the need to be able to respond to such local issues. However, our policy in relation to England is clear: we want to see diversification and we want to see that local authorities are able to meet the needs of their communities.

I hope the hon. Lady will be assured about the responsibilities that we contemplate through the creation of this duty, which include firmly assessing the need and demand for accommodation-based support for all victims and their children, working on strategies for the provision of support and making commissioning decisions to sit alongside those. We envisage that step-by-step approach as part of the statutory duty, to assess the needs in a particular area and commission accordingly.

I thank the Secretary of State for his statement. I am aware that this duty applies to England, but over the years some of my constituents have fled to England because of domestic abuse, and people have come to our constituency from England because of domestic abuse. Can the Secretary of State reassure me that co-operation with devolved government and local councils in Northern Ireland will continue and that lessons will be learned from how we have successfully handled cases of domestic abuse in Northern Ireland?

I commend what the hon. Gentleman says. I know from my ministerial experience the incredible work and support services that are provided in Northern Ireland. We have set out the relevant notional allocations for the east midlands. I hear what sounds like an interesting and ambitious plan that my hon. Friend has for her constituency, but it must be taken to the next phase and the bid must come together, and I am sure that that will involve working with the local enterprise partnership.

I thank the Secretary of State for the commitment that he has shown. He said that Northern Ireland would benefit from the stronger towns fund. My constituency contains four major towns: Newtownards, Cumber, Ballynahinch and Saintfield. Those four strong towns would like to make themselves stronger. When will that happen? When can they apply for these moneys?

The hon. Gentleman makes an important point: this is not just about my Department, but Departments across Whitehall. A ministerial group involving the key Departments meets and is focused on taking the action needed.

It is shocking that, according to today’s figures, the average age of someone dying on the streets or as a consequence of homelessness is 44—younger than the hon. Gentleman or I am. That is stark: it underlines the chronic health issues that may be involved—drugs, alcohol and other issues, too—and the need for us to act.

I thank the Secretary of State for his answers so far and his commitment to addressing homelessness. Some 8 million people are only one pay cheque away from losing their homes. Does he agree that we must recognise that being homeless does not involve only those who are unemployed or who have mental health issues? Some people may become homeless because of the removal of their overtime or a cut to their working hours. How does he intend to help those on the brink of homelessness?

I appreciate the situation in Northern Ireland and the support and accommodation available there. There are different pictures in different parts of our United Kingdom. Part of this is about ensuring we have a strong economy, creating jobs and growth and the prosperity agenda that sits behind all this, so we can and will look forward to the future positively. Equally, I come back to the point, particularly in relation to England and Wales, about longer tenancies and security in tenancies. That is why I am reflecting carefully on the consultation we carried out a few months back.

I can confirm to my hon. Friend that we will publish a prospectus in the summer inviting ambitious, locally supported proposals for high-quality new garden communities at scale. We are keen to assist as many as we can in locations where there is sufficient demand for housing, and I look forward to continuing that conversation with her and others.

The Government intend to consult on strengthening building regulations’ energy efficiency requirements where it is cost-effective, affordable, safe and practical to do so. We do not provide energy efficiency grants. Developers should bear the costs, which is why we need to ensure that the proposals are cost-effective and do not compromise housing viability.

Do you know what, Mr Deputy Speaker? I certainly do hear the frustration and cynicism among the public in Northern Ireland that the hon. Lady will have heard. They want to see a Government just getting on with the job of serving them. I do hear that, and I know there is huge frustration—I sense there is frustration on both sides of the House—at being in this position.

We could take steps towards saying, in essence, “Okay, we will move straight to direct rule,” or something similar, but I profoundly think that that is not the right way to approach this issue. Ultimately, this is about seeking space within which the parties can reach an accommodation and an agreement. Yes, this is difficult. For all the time that all those involved have spent on this, it has been hugely challenging to bridge the gaps. Doing so still remains possible, but it is certainly difficult.

We will continue to keep available to us a range of options for supporting the process and galvanising the parties to achieve the positive outcome that we all earnestly want. Equally, the hon. Lady rightly makes the point that this cannot just continue—I hear that message from the House very clearly—and there is a need for Northern Ireland to be able to make decisions. It is worth all of us putting in all our efforts to see whether we can get a positive solution so that the parties are able to find a space in which to work together and get on with the job. I encourage everyone with any influence to get behind that work.

I thank the Secretary of State very much for his statement, and for the industrious energy and commitment he has brought to the talks process, which we much appreciate.

Northern Ireland community groups—Home-Start and other charities—need, as a matter of urgency, to know whether they will receive funding. Who will make such funding decisions, as Westminster cannot be expected to micromanage, and someone needs to send out a message about the state of play across the Province? Similarly, what will happen with the funding for the NHS and infrastructure projects that Northern Ireland should be provided with as a matter of urgency? The projects that will receive most of that funding have been waiting patiently, but the situation is becoming increasingly difficult. I urge the Secretary of State do something about finance most quickly.

Financial decisions will remain with the Northern Ireland civil service. I take the hon. Gentleman’s point about voluntary and community sector organisations, and I have raised that with the Northern Ireland civil service. I am seeking to provide as much certainty and assurance as possible, because I know just how important those organisations are in delivering services across Northern Ireland, and I pay tribute to all groups that do such an incredible job.

The hon. Gentleman points to decisions on infrastructure, and we would obviously like other public sector reforms. It is for the Northern Ireland civil service to do that work at this point. If possible, we obviously then want a devolved Government to move in and take those decisions, but if that is not possible, we will need further careful reflection on the next steps.

I say to the right hon. Gentleman that there are a number of issues that would clearly benefit from having an Executive with local decision making by locally elected politicians. He highlights the issue of Bombardier. While this is a commercial matter, as he knows, the UK Government are working tirelessly to safeguard Bombardier’s operations and its highly skilled workforce in Belfast. I remain in close contact with the Business Secretary. He has had extensive engagement with Boeing, Bombardier and the Canadian and US Governments, and the right hon. Gentleman knows about the Prime Minister’s engagement, too.

The people of Northern Ireland need a fully functioning Executive where strategic decisions can be made in the interests of the whole community. That is clearly in line with what they voted for in the Assembly election in March and that is the appropriate means to ensure local accountability and accessibility for all the people of Northern Ireland.

I thank the Secretary of State for his response. We have Departments that have been rudderless since March, which is six months ago. The accountability that comes with an elected Minister is sadly lacking. If Sinn Féin continues to hold this Government and the people of Northern Ireland to ransom, will the Secretary of State step in to ensure that proper political oversight is provided for each Department, to ensure that accountability and accessibility are back on the cards, and how does he see that taking place?

The hon. Gentleman knows that time is running short. There is the lack of a budget in Northern Ireland and that cannot continue for much longer. The more we head into October the bigger the challenges will be. He makes a point about accountability. Obviously, as the UK Government we have a primary responsibility in respect of political stability in Northern Ireland, but I note the point he makes about responses from Departments within the Northern Ireland civil service and I will certainly raise that with David Sterling.

Dealing with the current situation is a question of resolving the outstanding obstacles that have led to this impasse. Ultimately, the two parties need to come together to achieve the outcome that we all earnestly want to see, and I do not believe that the escalation that the hon. Lady suggests is the appropriate way to achieve that. We will continue to keep matters under review, but there are other ways in which we can provide intensification and encourage an inclusive approach. That is why I will continue to hold discussions with the parties and support them to bring that about.

I commend the Secretary of State for his strength of character and his leadership in the talks. Sinn Féin’s irresponsible actions have left Northern Ireland without an agreed budget, and staff of Departments and the Northern Ireland Assembly are in a precarious predicament when it comes to job security. There are also concerns in the community and voluntary sectors. If Sinn Féin continues to block the formation of the Executive, will the Secretary of State undertake to consult closely Members of this House who attend and participate in the Assembly about such decisions, and will he ensure that adequate funding is in place to deliver for the people of Northern Ireland?

I earnestly want to see a positive outcome from the current situation—the return of an inclusive devolved Executive, in which the principal parties deliver for Northern Ireland. I still believe that that outcome can be achieved but, as I indicated in my statement, the UK Government take their responsibility for governance and political stability hugely seriously. We will take all necessary actions, and we will continue to consult colleagues here and elsewhere about how that work is taken forward.

I welcome the hon. Gentleman’s support for our work to ensure the return of stable devolved government. I do not, though, recognise his characterisation of what the Prime Minister has said. She has set out a bold, positive vision of what this country can and will be outside the European Union, but yes, of course, there is a negotiation to come. We have, of course, had initial dialogue and discussion with the Irish Government on how we get the best possible outcome for Northern Ireland. That was reflected in what the Prime Minister said today about the common travel area and strengthening the Union. That is precisely the approach we will take.

Would the Secretary of State care to outline what exactly people will be voting for if Sinn Féin refuse to work with the Democratic Unionist party, set impossible criteria, or ask for impossible concessions? How is the Secretary of State ensuring that Sinn Féin are not calling the shots, if I can use that pun, when it comes to who is elected to the Government of Northern Ireland, and that the electorate know that their vote will not be ignored because of the petty machinations of a party that simply wants its own way and does not like being challenged by a strong DUP team?

Ultimately, the election will be about the future direction of Northern Ireland. As we are in a democracy, I am sure the issues will be debated to and fro in the coming weeks—that is absolutely the whole point of the political and democratic system that we operate under. So much is at stake here. As I said yesterday, I encourage people to take part and vote in the election.

That is the way in which the Chancellor has been approaching his announcements about support post the departure from the EU, ensuring that we do have such a UK-wide approach, and indeed his preparations for his autumn statement. The approach will be to support the UK, with Northern Ireland being a core part of that.

I have already highlighted the work of the joint agency taskforce. It is a question of all the law enforcement agencies working together to identify the organised criminal groups. That is precisely the activity that is intended. Equally, I recognise the work that the National Crime Agency does more broadly, which absolutely helps to support this.

In Northern Ireland recently, incidents have increased and severe violence has been used at cross-border posts. Organised crime gangs and criminal networks outside of the islands are involved. Does the Minister recognise that the increase in crime needs to be top of the agenda in any forthcoming Brexit talks?

As I have already indicated, I do see the whole issue of safety and security as a priority. That requires good working relationships between the PSNI and the Garda Siochana. I had a meeting with Deputy Chief Constable Drew Harris in Belfast earlier this week to discuss those very issues, and this certainly is a matter that I regard as a priority in moving forward with my role.

I will leave it to the hon. Gentleman to make the case for having a visa system for all EU nationals, which is what he appears to be suggesting. The Government have a clear approach to controlling migration from outside the EU through our skills-based visas and through other routes, as well as to dealing with the pressures that we have highlighted, with economic competitiveness and with draws such as the welfare system.

With discrepancies of 1.2 million national insurance numbers being reported, and with EU immigration increasing, it has become harder to tell whether new arrivals will stay for just a few months or for more than a year. This means that passengers from the EU who want to live permanently in Britain might have been incorrectly designated as visitors. What has been done to ensure that people coming from the EU are correctly identified, particularly in these difficult times when accurate figures are vital and being transparent is key to creating trust among the British people?

I agree with the hon. Gentleman’s point about the need for clarity and certainty in relation to the numbers. We have looked to the Office for National Statistics, which operates independently of me, of the Home Office and of other Government Departments, to give us that clarity. It has judged that the international passenger survey is the best and most appropriate measure for that, and it continues to review, as it does from time to time, how best to ensure that it captures effective data from its interviews and how those data are extrapolated to produce its quarterly numbers.

With the leave of the House, Madam Deputy Speaker, I will respond briefly to some of the points that have been raised during the debate.

Organised immigration crime is an important issue. It is worth underlining that in recent months we have developed a 90-member-strong organised immigration taskforce which has had a strong focus on the crime networks operating in some source countries and at transit points, including the Mediterranean, as well as the UK border and in France. We have disrupted more than 600 organised crime groups this year, and our taskforce will be expanded to a 100-strong team. Access to and sharing of data is vital to joint efforts to combat the criminal gangs. In the Government’s view, it is essential that enhanced data sharing, including with Europol, forms part of the EU’s response.

The Chair of the European Scrutiny Committee, my hon. Friend the Member for Stone (Sir William Cash), asked about the Government’s priorities for action by the EU. I have written to the Committee on this previously, but to underline the position, we have highlighted four points: first, how EU money is spent on tackling problems at source in transit countries; secondly, an increased focus on fighting organised crime, with better joining up between member states; thirdly, dealing with economic migration regarding those who enter the EU without effective controls staying without consequence, where the issue of claims of refugee status not made out needs to be addressed more firmly; and fourthly, a stronger coherence between upstream development work and the return of economic migrants.

My hon. Friend highlighted the issue of Dublin. We strongly support the Dublin regulations. We believe that an applicant’s asylum claim made in the EU should be dealt with by the member state most responsible for their presence in the EU. We are aware, however, that the Commission is reviewing the Dublin regulations with a view to bringing forward a new measure next spring. We are co-operating with that review, but we believe that the long-standing principles at the heart of the Dublin system are the right ones, and that it would be a major error to replace them with completely different, untried and untested measures.

In respect of the operations in the Mediterranean and Operation Sophia, we are in phase 2, which is the high seas operation. The House will no doubt be updated, through reports of EU Council of Ministers meetings, should there be further progress, which we look to. This is very much focused on the situation in Libya. We welcome the support from a broad range of Libyans from across the political spectrum in recognising the urgency of creating a long-awaited Government of national accord, and urge all political actors to sign on 16 December. The Rome ministerial meeting of 13 December demonstrated unified international support for the UN-led effort to establish a Government of national accord in Libya. We continue to support that and to see it as a priority for moving forward.

The EU-Turkey action plan covers most of our priority areas, including controlling the flow of migrants to the EU from Turkey. It is about improving education, health and labour rights for Syrian refugees in Turkey to address the potential push factors for further migration. It is important to stress that Turkey is accepting the return of some failed asylum seekers and tackling smuggling networks. The agreed action plan incentivises Turkey to do more on border management. It does not guarantee visa liberalisation in relation to Turkey, and the UK does not have to offer a reciprocal visa concession. It is important to underline and stress that.

In an earlier intervention, I mentioned the human rights abuses taking place in Turkey. Has the Minister had any discussions with his ministerial colleagues about that matter? It is clear to me and many other Members that those human rights abuses have not stopped; indeed, they are continuing.

I underline to the hon. Gentleman that, although we support Turkey’s EU accession process and are working on it closely with Turkey, EU member states and the European institutions, the accession process recognises that Turkey needs to do more to meet EU standards through continuing reform, particularly in the area of fundamental rights and the rule of law. Active and credible accession negotiations remain the best way for Turkey to make further progress.

We have touched on the hotspots issue. The UK stands ready to support, through the European Asylum Support Office and others, and to ensure that the appropriate support mechanisms are in place.

Our position on the migration crisis is practical, pragmatic and focused on the need for a concerted humanitarian response for those who need our protection; ensuring the sustainability of EU asylum systems; pursuing effective co-operation with EU partners; combating illegal migration and those who profit from it; and protecting our security. That is where the Government’s focus remains, and I urge the House to support our motion.

That this House takes note of European Union Documents No. 8961/15, a European Agenda on Migration, No. 9345/15, EU Action Plan against migrant smuggling, unnumbered Document, a Council Decision on a European Union military operation in the Southern Central Mediterranean (EUNAVFOR Med), unnumbered Document, a Council Decision to launch EUNAVFOR Med, and a Draft Action Plan on Stepping up EU-Turkey cooperation on support of refugees and migration management in view of the situation in Syria and Iraq; and supports the Government’s aim of working with the EU and Member States and other international partners to develop a coherent and sustainable approach to addressing current migratory pressures, focused on shorter and longer term actions to break the business model of people smugglers and traffickers, to break the link between rescue at sea and permanent settlement in the EU, and to address the root causes of migrants’ journeys.

Yes, the first update is due in August. We are providing quarterly updates on that basis, in that regular pattern. The right hon. Has there been any discussion with the devolved Assemblies in Northern Ireland, Scotland and Wales, to see whether they can contribute to the resettlement of the refugees, at least in the short term? I am keen to know whether that is so. If there has not been such a discussion, I am keen that there should be.

Of course. I am keen to support more local authorities signing up to the scheme. Across the UK, a number of local authorities have already indicated their willingness and we are in discussions with others that have expressed an interest. Obviously, the scheme is based on vulnerability, including women and children at risk, medical needs and survivors of torture and violence.

The primary issue is to ensure that there are rigorous measures in place for new applicants coming to this country, with interviews supporting the testing regime, so that we have an additional step to give a sense of reassurance. The point at issue is the student visa system created by the previous Labour Government, and the fact that a number of people who have been identified as being caught up in that sit on the Labour Benches means that a great deal of the responsibility lies there.

I welcome the Minister’s statement. Education visas are worth £10 billion to the economy, and we need to retain that contribution. However, Migration Watch UK says that up to 60% of students do not return to their own country when their visa expires. In 2012 the number was 50,000. What action is the Department taking to deal with those students who seem, at least on paper, to go missing? What contact does he have with the devolved Assemblies, particularly the Northern Ireland Assembly, to address the issue?

One step that we have taken is to create Immigration Enforcement as a separate command within the Home Office, to have that rigorous focus on pursuing those who should not be here. We are also working with the university sector to see how it can continue to play its part in ensuring that students leave at the end of their studies. We will, as part of that, have discussions with the devolved Administrations and others to ensure that we continue the work and have the rigorous system that we all want.

With the leave of the House, Mr Speaker, may I thank right hon. and hon. Members for their contributions in this short debate? Let me be clear that our recommendation in the motion is about participation in a future measure governing Europol; it has no impact on our current participation in Europol, which does benefit our law enforcement agencies. That point was made by everyone who has contributed to this debate: the Chair of the Select Committee, the right hon. Member for Leicester East (Keith Vaz); and my hon. Friends the Members for Stroud (Neil Carmichael), for Cambridge (Dr Huppert), for Northampton North (Michael Ellis) and for Cheltenham (Martin Horwood). That highlights the issues at hand in respect of the benefits that accrue from our current relationship.

I underline the fact that nothing that the Government have proposed reduces our commitment to tackle cross-border crime. However, we cannot risk the operational independence of our law enforcement agencies, and we need to ensure appropriate safeguards within the text so that that does not happen. I say very clearly to right hon. and hon. Members that we will play an active role in negotiations to ensure that we achieve our negotiating aims, which will allow us to opt in post-adoption. In response to the challenge from the right hon. Member for Leicester East, we consider that it is possible to achieve key negotiating objectives, even when we have not opted into a proposal before the negotiations. We have already done that on a number of measures, and we are clear about the influence that can be applied, and that is precisely what we will do. As I said, we consulted a number of our operational colleagues across the UK when considering the proposal. They all agree about the value of Europol as it currently operates, but not at any cost.

In Northern Ireland, we face a particular threat from dissident republicans. What assurance can the Minister give me as the MP for Strangford that we will not lose the ability, through Europol, to address the threat of terrorism at home and globally, because dissident republicans have contacts in other countries?

If the hon. Gentleman had been here to hear my opening speech, he would know that we have discussed our approach with the Police Service of Northern Ireland as well as other operational partners across the UK. While we are not seeking to opt in at this stage, we wish to negotiate and seek to influence so that we are in a position to opt in post-adoption, with the red lines.

The hon. Gentleman should accept that the information- sharing provisions in the EU document could put our national security at risk by virtue of the fact that we would not be able to control the information provided to Europol, which is precisely why we have sought to take this approach, with national security in mind. The law enforcement community shares our concerns about the risks that would be posed if we were directly tasked by Europol to undertake operations or to provide increased amounts of information to it without the necessary safeguards.

It is not the case that as a result of the approach that we have taken we have given up our seat at the table. We shall continue to play a full part in negotiations, attending the discussions and working with member states that share our concerns to seek to deliver a text that we can rejoin. Ultimately, this is a political decision for the Government, with appropriate scrutiny from Parliament. That is why we will consult and listen to the views of our law enforcement partners across the UK, but ultimately this a decision for Government and Parliament, which is why the motion is framed in this way.

Opting in at this stage poses too great a risk to our security and the autonomy of our law enforcement agencies, but once the text has been negotiated we intend to opt in if we secure the changes set out in the motion, and we will consult Parliament before doing so. Our position on the proposal is sensible and pragmatic, reflecting the need for effective co-operation and the importance of protecting our sovereignty and security. I urge the House to support the Government motion.

I acknowledge the Select Committee’s interest. Indeed, I gave evidence to the Committee, and I remember the questions that the right hon. Gentleman asked me during the evidence sessions. The matter is being considered, in relation to the Select Committee’s report and in the context of the recommendation made by the independent reviewer. All I can say is that we will make a further announcement in due course. Unfortunately, I cannot give the right hon. Gentleman a more specific answer now, but I acknowledge the point that he is making, and we will respond to the points made by the Select Committee and by the independent reviewer shortly.

We recognise that proscription is a tough but necessary power. Its effect is that the proscribed organisation is outlawed and unable to operate in the United Kingdom. Proscription makes it a criminal offence for a person to belong to, or invite support for, the proscribed organisation. It is also a criminal offence to arrange a meeting in support of the organisation, or to wear clothing or carry articles in public that could arouse reasonable suspicion that an individual was a member or supporter of the relevant organisation.

Given the wide-ranging impact of proscription, the Home Secretary exercises her power to proscribe an organisation only after thoroughly reviewing all the available relevant information and evidence on that organisation. Having carefully considered all the evidence, she firmly believes that IM is involved in terrorism. Hon. Members will appreciate that I am unable to go into much detail, but I am able to give them the following information. IM is a terrorist organisation based in India. It emerged in 2007. It uses violence in its attempts to achieve its stated objectives of creating an Islamic state in India and of implementing sharia law there.

The organisation has frequently perpetrated attacks on civilian targets, such as markets, with the intention of maximising casualties. In May 2008, for example, a spate of bomb detonations in the city of Jaipur killed 63, and in September last year an explosion outside the high court in Delhi reportedly killed 12 and injured 65. IM has sought to incite sectarian hatred in India by deliberately targeting Hindu places of worship. An example of that was an attack on a prayer ceremony in Varanasi, which killed a child, in December 2010.

I understand and wholeheartedly support the reason for proscribing the organisation here, but is it proscribed in India as well?

Yes, the organisation is proscribed in India and in several other countries, including the United States and New Zealand. The proscription here will align the UK with the emerging international consensus.

It is important, in the context of this order, to state that the group is also known to target areas popular with tourists. A shooting incident in Old Delhi wounded two Taiwanese tourists in September 2010, and there was an unsuccessful attempt to detonate an explosive device at the scene. The organisation has also publicly threatened to attack British tourists, so it clearly poses a threat to British nationals in India.
