Commons ChamberOf course we will look at all courts with maintenance issues, but in reality record investment in magistrates courts has been secured in this spending review. We have increased the sentencing powers of the magistrates courts from six to 12 months, and we are further supporting the practitioners who serve those courts with the measures we have announced today.
Sir Christopher Bellamy’s review of criminal legal aid was based on two overriding principles: that remuneration of criminal lawyers should be such as to attract the right legal talent that the system requires, and that there should be equality of arms so that the resources available to defence are broadly similar to those available to prosecution. Does my right hon. Friend agree that those are the right principles for civil legal aid as well as criminal legal aid?
The criminal legal aid system is different from the civil legal aid system, but the overarching principles and the need to ensure access to justice are common to both. That is why under the means test review we have ensured not only that 3.5 million more people will have access to criminal legal aid in the magistrates courts, but that 2 million more will have access to civil legal aid, which I hope addresses my hon. Friend’s concern.

Commons ChamberI share the hon. Lady’s passion and her commitment to the role that ODA plays in our soft power abroad. I gently remind her that, at 0.5%, we will still be on the 2019 figures and the second biggest ODA spender. I just ask her, as we ask all the other parties and all hon. Members, whether she can explain how else she would deal with the financial emergency that we now face, because I have not heard a peep of other positive, credible alternatives from the Lib Dems, let alone from the Labour Benches.
One of the most shocking parts of the Chancellor’s statement yesterday was that we will borrow £396 billion this year alone, with a further £369 billion to come by 2023. Given the truly parlous state of our public finances, does my right hon. Friend agree that the temporary cut to our foreign aid budget, deeply regrettable as it is, is a necessary reflection of our altered circumstances and is needed, frankly, to keep our aid spending in line with our taxpayers’ priorities?
As the Chancellor said at the Dispatch Box yesterday, and notwithstanding the regret and the financial pressures, it would be difficult to justify to our constituents, with all that they are going through and all that they expect of what we do domestically, if we were not looking at every area, including this area, to try and see our way through. However, as he rightly said, it is temporary, and we will get back to 0.7% when the financial conditions allow.

Commons ChamberWe obviously have the integrated review, and we have the work of ICAI and of course the Select Committee. So, ultimately, a combination of external scrutiny and the parliamentary scrutiny of this House will, I am sure, hold us to account. We do not shrink from that; we welcome it.
World Bank data shows that over the past 20 years, the percentage of world trade taken up by developing countries has increased from 33% to 48%, and during that process has halved extreme poverty around the world. Given that stunning success for capitalism, will my right hon. Friend take advantage of the merger to refocus our efforts to stimulate international trade with the United Kingdom?
My hon. and learned Friend is absolutely right. I spoke to the president of the World Bank yesterday and I totally accept his case. One of the reasons that our vision for a truly global Britain will tilt, if you like, to the Indo-Pacific region is the scope for using liberal free trade, not just to benefit the businesses, the workers and the consumers of this country, but to lift living standards around the world. Of course, that could have no greater impact than in Africa, where we will combine a more liberal approach to free trade than, I venture, they would get from the EU—an approach to business investment with integrity, which I think is necessary, given some of the reports we have of Russian and Chinese investment, coupled with our development and our “force for good” agenda, which I think shows the triple whammy of the impact that this new merger can deliver.

Commons ChamberThe hon. Gentleman is absolutely right. As I have said, we respect China as a leading member of the international community and as a permanent member of the Security Council, with not just rights but the obligations that go with that, The commitment to international human rights law reflected under the UN charter of customary international law is incredibly important. We raised this issue with the Chinese Government—I raised it with my Chinese opposite number in Beijing. We have also raised, for the first time, the issue in relation to Xinjiang and Hong Kong in the UN Human Rights Council in Geneva.
When the Communist party of China decided to breach the Sino-British Joint Declaration, it knew that it put at risk extradition treaties from countries that value the rule of law. Does my right hon. Friend agree that, while we continue to welcome China’s development as a leading economic power, the rules-based international system protects us all and must be defended?
My hon. Friend is absolutely right. The UK has a strong reputation as a promoter and guardian of the international rule of law, and that is a good guide or lodestar for our relationship with China. That is why not only has the UK grounded our response to China in relation to Hong Kong in the obligations freely assumed by the Chinese Government reflected in the joint declaration, but other countries are doing the same.

Friend’s explanation of the Government’s position and his recognition of the growing list of acts of intimidation, authoritarianism and expansionism by the Communist party of China. Is this announcement an individual response to an isolated incident or part of a wider reappraisal of our foreign policy towards China? Does he think that the long-applied and hopeful policy of positive engagement with China is not having the desired outcome? If so, how should this approach change?
I certainly agree that there are huge challenges in engagement with China across a whole suite of issues, from cyber through to intellectual property theft and of course the people of Hong Kong. We have said throughout that we are not seeking to contain China as a matter of dogmatic strategy; we are seeking to engage with it. There are also opportunities in the relationship—on trade and on climate change, with some of the green technology it is capable of innovating as well as in relation to its role as a major emitter—and we want to engage to accentuate those opportunities and mitigate the risks involved. The issue with Hong Kong is different. It is a point of principle and relates to the historic ties to which Members on both sides of the House have referred. That is why we have set out such detail. We will stand by this relationship and continue to seek to engage, as difficult as it may be, but we will also be clear that if China flouts international law, or those wider values and principles that we hold dear, we will stand up and act. Equally, we will defend the key equities that we have in this country, whether in relation to intellectual property theft or telecoms.
