I am grateful to my hon. Friend for giving me the opportunity to respond to that point. The independence of the judiciary is at the heart of our system and a long-standing part of it. It is as important, if not more important, than it has ever been that we reiterate that and support those institutions. As I was saying a moment ago, this is a big part of what our nation is about, and in the years ahead, after we have left the European Union, one of the most important institutions to us will be our independent judiciary. It is a large part of what the UK is about and of how we should project ourselves around the rest of the world.

My right hon. Friend is making a strong case. Perhaps this is for another time, but in the context of having a strong, independent judiciary, will he look again at the rather arbitrary cap of the age of 70 for magistrates? We have many really qualified people who wish to contribute to the independent justice system of this country but who are prevented from doing so simply because of their age.

I am grateful to my hon. Friend for making that point, although he takes me away a little from the terms of the Bill. I realise that there is a debate about that matter, and there are arguments either way about the current age limit. I have certainly received representations calling for an increase on the current age of 70, and we continue to look closely at those arguments. I believe that there has to be an age limit, and it is a question of judgment as to what it should be. I would be delighted to discuss this with my hon. Friend in the Tea Room if the opportunity to do so should arise.

In the recent Budget, the Chancellor announced an extra £52 million for the MOJ to be spent in the course of this year. The figures to which the hon. Gentleman has referred are in the 2015 spending review. At the time of the 2017 general election, when the Labour party proposed spending that would increase Government debt by a trillion pounds, there was nothing there for the MOJ. Let us remember that next time the hon. Gentleman stands up and rants about spending on the MOJ.

A firework factory explosion in my constituency killed two members of the public and there was a criminal conviction as a result. The widow of one of those people applied to the criminal injuries compensation scheme, but was refused. Will my hon. Friend look at the scope of the scheme to ensure that such injuries are included in future?

When the charter of fundamental rights was brought in, the argument was made at the time that it was essentially replicating rights set out elsewhere in other parts of EU treaties. To the extent that that fundamentally changes matters, there is certainly a debate to be had about it.

It is absolutely right that we provide legal certainty for businesses, families and individuals as we leave the European Union. That is why, as the Prime Minister said in her speech on Friday, part of our future partnership with the EU will be to have effective reciprocal arrangements with the EU to deal with cross-border legal disputes in civil and family matters. The best way to deliver that co-operation is with a close and comprehensive agreement between the UK and the EU that sets out coherent common rules.

I thank the Secretary of State for that answer. Leaving the EU is likely to lead to additional workload for the UK legal system. What additional resources have been made available to his Department and to the legal and courts system more generally to ensure that they are fully prepared?

My hon. Friend is right that we should be prepared. He will be aware that the Treasury has made another £3 billion of extra funding available to Departments for 2018 to 2020. We are in discussion with the Treasury about the allocation for the justice system, and we hope to agree it soon.

Does that mean, therefore, that the Government would accept an amendment on Report that put on the face of the Bill that there would be a vote, as is stated in the written statement, on a resolution in both Houses of Parliament that would cover the withdrawal agreement and the terms of our future relationship? Is that what the Minister is saying?

What I am saying is that my hon. Friend has had an assurance, given by me at the Dispatch Box, that I hope addresses his concern. If hon. That is a good point, which had not occurred to me. The hon. Gentleman has made a good case for being on the Bill Committee, and that is up to me. The Bill Committee may be growing, however, so we may have to persuade the Government Whips; I have found that if one talks nicely to Government Whips, they are sometimes helpful. We might want to bring Committee or Report to the Floor of the House so that everyone can consider the proposals.

The second thing the Bill does is mirror, in clause 2, the provisions in part 12 of the Criminal Justice Act 2003. That Act made any offence aggravated when it was based on hostility to the victim’s race, religion, sexual orientation, disability or transgender nature. That statutory definition of aggravated offences built on the Crime and Disorder Act 1998, which stipulated that certain offences would attract longer sentences if they were racially or religiously motivated. So clause 2 of my Bill will put an assault perpetrated against an emergency worker on a legal par with a hate crime, and I think that that is the appropriate way to go. It means that the court must state, in open court, that the crime is so aggravated and must treat as an aggravating factor the fact that the offence was committed in such a way.

Clause 3 defines an emergency worker. Thanks to a glitch, I think the definition is not quite right, and we will want to improve it in Committee.

I am surprised that the hon. Gentleman thought that, but I am most grateful to him for giving way and for all the work that he has done on this incredibly important Bill. On a point of definition, we could consider in Committee the inclusion of minor injuries units as well as urgent treatment centres and emergency departments. Aside from the nature of the injuries treated at each one, the public do not see much difference between those three types of emergency unit.

The hon. Gentleman makes a good point. I would prefer the inclusion of an additional subsection, which I think would meet his point. It would state that the Bill covered a person employed for the purpose of providing, or engaged to provide, healthcare services within the meaning of section 64 of the Health and Social Care Act 2012, subsection—I cannot read the little number. I agree that it is something that we need to address.

As always, it is an honour to speak after the hon. Member for Cardiff South and Penarth (Stephen Doughty).

We are debating the Second Reading of the European Union (Withdrawal) Bill, and I will be supporting it, but of course it is only half the story. The Government quite rightly want a smooth exit in terms of the laws that we will have on day one after leaving the EU, but the other side is that we need a smooth transition into the state that we will be in after EU withdrawal. We are nowhere near that at the moment, and the Government need to do some rethinking.

As many people have said, this Bill needs improving. It is certainly not perfect. I will not go into the details, but clearly clauses 7 and 9 are going to need much more circumscription around their powers. In particular, with regard to clause 9, we need a reference to approval of the final deal by Parliament.

I agree with all the colleagues on both sides of the House who have talked about the need to have some kind of efficient mechanism for dealing with the vast volume of legislation that is going to come forward, whether it is called triage or some other such name. This House is going to have to get used to debating an awful lot of legislation in future. We rightly say that we are repatriating the discussion, debating and approval of legislation from Europe in future, but after we leave we will still have to take note of, and in some cases bring into our own law, European legislation. Otherwise, we will simply not be able to trade in certain extremely important areas such as financial services, to name but one.

Therefore, we might as well get used to such detailed scrutiny of legislation as we go through this Bill. That is why I believe that eight days may not be enough. I am prepared to vote for the programme motion, but I echo very many colleagues in saying that we may need to revise that if the Government see that there is not enough time to scrutinise the Bill within those eight days of eight hours each.

I cannot understand why the Government have decided to make an exception for the charter of fundamental rights in clause 5. If we are going to take over legislation in full and have a smooth exit, let us take it all over. If we want to revise it or get rid of it later, we have said that we will do that. There are many ways in which we can make the charter of fundamental rights fit for purpose. Indeed, I remember working closely with my right hon. Friend the Secretary of State for Exiting the European Union to frustrate a previous Government’s attempts to pull out of a different Bill of Rights, the European convention on human rights, so I hope that he will have great sympathy with what I have to say.

Finally, let me return to the question of withdrawal. We are trying to leave in as smooth a way as possible, and we have to try to accede to the post-EU situation in as smooth a way as possible. I thought about this long and hard as a member of the Exiting the European Union Committee in the last Parliament; I am honoured to be on that Committee in this Parliament as well. I can see very little alternative to—in fact, I would welcome—accession to the European Free Trade Association. I think that that would be an extremely good and smooth way to transition out of the EU and into what we will have afterwards. The Government are rightly concerned about having a smooth exit with all the law in place when we leave, so they have an equal responsibility to ensure that our entry into the post EU membership situation is as smooth as possible. I urge them to make that their No. 1 priority, and to say that joining the EFTA, which has numerous forms of membership, is the best way.

My right hon. Friend is absolutely right. We need to ensure that prisons are not only places of safety but places of reform. We are wasting a huge amount of talent at the moment, and we are also presiding over problems in society, with a £15 billion bill for the crimes that ex-offenders go on to commit. We have a progressive agenda, and it is also important to prevent there being more victims of crime.

A year ago, the dear son of my friend and Stafford councillor Ann Edgeller was murdered in Dartmoor prison. Will the Secretary of State or the prisons Minister meet me to discuss the way in which these welcome reforms could ensure that this kind of tragedy does not happen again?

The hon. Lady is absolutely right to draw attention to those past failures by G4S, but I would stress that there are prisons and other facilities run by G4S that do meet a high and exacting standard. Although it is understandable that criticism of G4S will be heard again in the light of these allegations, and that it will become more intense if the allegations are sustained, it is nevertheless important that we take a step back and recognise that it is also the nature of our youth justice system that needs to change.

On Friday I attended the packed and moving funeral of the son of one of my constituents. His death in custody is currently under investigation. Will my right hon. Friend join me and my constituent in campaigning together for our young people, and indeed all people, in prison to be better looked after?

I know just how closely my hon. Friend has taken this case to heart. Both the conversations he has had with me and the correspondence he has had with the Department are testament to the fact that he has been moved by the case and is determined to see reform as a result. I can only say that I will do everything I can to ensure that families do not have to live with the tragedy with which the family he so ably represents have had to live.

I absolutely agree—that is a very good point. May I single out for praise the John Lewis Partnership, which does such a fantastic job in helping people from a variety of backgrounds to be all they can be? I stress that there are other organisations, such as Greggs the bakers and, of course, Timpson, the shoe and key repair firm. John Timpson’s leadership in providing ex-offenders with a second chance is exemplary.

Given that 12% of the prison population are sex offenders, including many in the prison in Stafford, what specific rehabilitation work is being done for sex offenders?

The excellent work that is done in Stafford prison is close to my hon. Friend’s heart, and he is absolutely right. We need to make use of the most sophisticated means that psychologists can devise to help people to tackle the problems that led them to offend. I had the opportunity earlier this week to talk to the psychologist in charge of that work at the National Offender Management Service, and to guarantee her all support in the weeks and months ahead in dealing with those terrible crimes.

I reiterate the comments made by my hon. Friend the Member for Gloucester (Richard Graham)—it is a pleasure to serve under your chairmanship, Mr Williams.

I want to indicate from the outset that, although the debate is short, if anyone has not had an opportunity to contribute so far, I am happy to take interventions. My hon. Friend was very generous in taking interventions, but it is absolutely right that colleagues who have been present from the start of the debate and want to contribute should be able to do so.

As my hon. Friend mentioned, I approach the issue of police widows’ pensions not only as a former uniformed guardsman but as a former firefighter. I served alongside the police on many occasions—some of those situations were very dangerous and the police put their lives in danger—as well as with the other emergency services. My hon. Friend touched on the fact that, through its devolved powers, Northern Ireland has already acceded to the widows’ requests. I was the Northern Ireland Minister at the time and, although that matter is devolved, I can assure Members that I was lobbied very heavily in Northern Ireland. I hope that I was part of that decision.

Before I took on ministerial responsibilities for policing fairly recently, I was at the Department for Work and Pensions. My Parliamentary Private Secretary, my hon. Friend the Member for Winchester (Steve Brine), who is sitting behind me but is not allowed to speak because of protocol, was already lobbying me. We were already discussing the matter before fate decided that I was going to be the Minister with responsibility for policing in England and Wales.

I pay tribute to my hon. Friends the Members for Gloucester and for Winchester for their campaigns on behalf of not only their constituents but the constituents of Members from both sides of the House. I thank colleagues for writing to me—some of them many times; some because they wanted to know the exact position—and I congratulate the campaigners on their online petition, which is growing daily.

I am most grateful to my hon. Friend the Member for Gloucester (Richard Graham) for securing this debate. Does the Minister accept that, in many cases, such as that of my constituent, Mrs Penn, who has taken the issue up with me at a surgery, people are supporting the campaign on behalf of others? The pension might not be hugely necessary for them financially, but they are supporting the campaign on behalf of their colleagues for whom it is. I very much commend the public-spirited nature of the petition. It is about not only those who need the pension—we fully respect their needs—but those who are doing it on behalf of others.

I completely agree with my hon. Friend. The compassion that has been shown in the correspondence is remarkable. If people who are campaigning on other issues could look at how this campaign has been conducted, they might find that their campaigns receive not dissimilar support from across the House.

On a negative point, I want to take issue slightly with my hon. Friend the Member for Gloucester on the similarity to military covenant decisions. Perhaps I would do, as a former guardsman, but I was also part and parcel of the drafting of the military covenant in opposition. In my correspondence to colleagues, I have said that there is a difference, including because of deployment. Thank goodness most of our troops are now home from Iraq and Afghanistan, although some brave people are still out there assisting in training, but British armed forces are still deployed around the world—indeed, the hon. Member for Bridgend (Mrs Moon) has been with me on trips to those places. British servicemen and their families are in Cyprus, the Falklands and other parts of the world, and such deployment is not of their choice.

The police use mutual aid. In Northern Ireland, we had to run the G8 summit at Lough Erne. We could not have done it without other forces in Great Britain helping us, but all those personnel volunteered. I am not saying that everyone volunteers in every case, but there is a difference between deployment under the military covenant and police deployment. That does not take away from the argument—the “compelling” argument, to repeat the word that I have used in correspondence since I have been the Minister with responsibility for policing—in the cases that we are discussing.

My hon. Friend the Member for Gloucester mentioned that there was scepticism, to say the least, because no matter what colour of Government are in office, when people talk about “retrospective”, the Treasury has jitters galore. The important thing now, however, since we acknowledged that the case was compelling and the Home Secretary and I asked our officials to look into things, is that the Treasury as well as the Home Office is involved. Home Office and Treasury officials are working together, which is very important, because we must ensure that any decision we make is not only right, but one without a huge impact on other aspects that might lead, for example, to people claiming judicial review of other schemes.

I come to the subject in a personal way. In my constituency, PC Frank Mason, who was off duty, walking his dog and minding his own business, saw a bank robbery taking place. He intervened and was murdered. Frank, like all police officers, was a warranted officer. In other words, when he was off duty he was really still on duty—he could be called in and his warrant was with him all the time. That is where the difference is and why the Home Secretary and I describe the argument as so compelling.

A full-time police officer in a force in England and Wales—I acknowledge the point made by the hon. Member for Bridgend and am as proud of being responsible for the police in Wales as I am for those in England, while those responsible in the other two devolved Administrations are also surely paying attention to the debate and the campaign—has a warrant in the service of the Queen and so is still responsible when off duty. Different terminologies can be used, but that is what I feel—police officers are still serving their community even when off duty. That puts pressures and responsibilities on them.

Recently, I raised the issue with the people from the Police Federation—no slight to them, but I raised it when they came to see me and it was not on their agenda, although they had lots of other things to talk about. I specifically wanted to talk about this, however, and I said, “We need to narrow down what we are talking about here.” What does “an officer on duty” mean? Is an officer on duty only when they are on shift, or could it mean someone in a similar situation to Frank Mason, who was assisting the public when off duty? I am adamant that, if a scheme comes through and if we make the changes, there should be help in cases of the likes of Frank Mason’s—should his widow so wish. If off-duty police officers were driving to work and were involved in a road traffic collision, I am afraid that I do not think that that would be a similar case, because they are not on duty. There is a difference, which I think most people would accept—the federation, too, accepted that point.

We are now at an important stage. We are analysing the implications in cost terms and any impact on other schemes that might be affected. For example, three months ago we did the right thing for the armed forces and now that case is being used for the police, so we have to be careful about whether what we do has implications for other schemes. The compelling case that has been put forward by colleagues today, as well as by others, and the nature, tone and empathy of the campaign, have been enormously helpful to me as a Minister and to the Home Secretary, enabling us to acknowledge the “compelling” case—the first time such language has been used.
