Commons ChamberThis is an incredibly important point, and it is why control of immigration is so important. We are a generous country. We have demonstrated that generosity time and time again, whether it be towards the Ugandan Asians, people from west Africa, people from Hong Kong or people from Ukraine. We are rightly proud, but it is also important that we prove that we are thoughtful about the implications for those who live here, whether they have lived here for decades, for years, or for generations. That is why it is right that we have put forward these proposals, which are carefully calibrated to support our economy and our health and social care needs, but also to bring down those figures.
The net migration figure is now 672,000—three times the level at the 2019 general election, when the Conservatives promised to reduce it. Does the Home Secretary concede that the Tories have failed miserably on immigration policy, along with a whole host of other policies, and that that is why their time is now well and truly up?

Commons ChamberI remind the hon. Lady and the House that we have people on the ground. My staff are in danger in Gaza. They choose to put their lives at risk in an incredibly dangerous part of the world in order to give me direct insight into the realities on the ground. I urge her to be a bit more thoughtful with regard to the danger that my UK-based diplomats and locally engaged staff put themselves in.
The truth is that I have received nothing that gives me any indication that Hamas or the other terrorist groups operating in Gaza would respect a ceasefire. I respect the UN Secretary-General’s call for a ceasefire. We would all love to see the bloodshed cease, but we have to be realistic about the fact that Hamas, like the other terrorist organisations in Gaza, have demonstrated over and again a complete callousness towards human life, whether Israeli or Palestinian.
After all the decades of suffering, injustice and occupation endured by the Palestinian people, this terrorism and the scenes of death and destruction at Al-Ahli Arab Hospital are truly heart-wrenching. Those responsible must be held to account, international law must be adhered to and there should be no collective punishment of the Palestinian people. Will the Secretary of State advise the House how he feels peace can be obtained, and of his efforts to urgently deliver food, water, medicines and other aid to blockaded Gaza?
The hon. Gentleman and the House will have heard the detailed explanation that I gave in answer to the initial question of the right hon. Member for Tottenham (Mr Lammy). We work relentlessly with the countries neighbouring Israel and Gaza. I will travel to Egypt once again to try to facilitate humanitarian support, and we will work with those countries that are able to influence the leadership in Gaza. We will not rest. We will continue to do everything we can to alleviate this terrible humanitarian situation. The hon. Gentleman asked what is the best thing to do for peace. A good starting point would be terrorists not firing rockets from densely populated areas into Israel.

Commons ChamberMy hon. Friend is absolutely right that the situation over the weekend makes the command and control of the Russian forces less effective. I assure him and the House that we have never been distracted from our primary goal, which is to support the Ukrainians financially and militarily so that they can press home their counter-offensive, and we will continue to do exactly that.
Media reports over the weekend suggested that President Putin decided to flee Moscow and relocate to St Petersburg when he learned of Prigozhin’s and Wagner’s advance towards Moscow. That, of course, is in stark contract to President Zelensky, who bravely remained in Kyiv when faced with a full-scale Russian invasion. What assessment has the Foreign Secretary made of those reports and their veracity?
The hon. Gentleman makes an incredibly important point about the personal courage that President Zelensky demonstrated at a point in time when Russian tanks were advancing on Kyiv. I have had the pleasure of meeting him on a couple of occasions, and it is a genuine privilege to do so.
We of course look at a wide range of open-source reporting. Much of that reporting is speculative, and much turns out to be inaccurate; we attempt to sift as much as we can, but it is difficult to get a clear picture of the events on the ground. As such, what we tend to do—as the hon. Gentleman will understand—is work on a range of potential scenarios and plan around the most credible and likely of them.

Commons ChamberWe enjoy a strong series of bilateral relations with EU member states and a strong relationship with the EU at the corporate level. However, I repeat that NATO is the foundation stone for the Euro-Atlantic defence structure. I have had that conversation with many Foreign Ministers from EU countries, and they agree. That is why we are committed to strengthening NATO and why at the Vilnius summit we aspire to have Sweden as a full member. However, we also need to progress the modernisation process for NATO to ensure that it continues to be fit for the future. That will be our aim. NATO is what keeps us safe in the Euro-Atlantic area.

Commons ChamberSince the last set of oral questions, we have evacuated British nationals from Sudan, and we are pushing both multilaterally and bilaterally for a lasting peace settlement. I want to reassure the House that this does not detract from our ongoing support to Ukraine in its self-defence against the brutal invasion by Russia. I delivered a major speech on how the UK will engage with China, and I visited our Pacific partners and attended meetings of NATO and G7 foreign ministers. My right hon. Friend the Minister for Africa delivered a keynote speech on our international development policy, and other Ministers in the Department have visited allies across Europe, Africa, South and North America and the middle east, including key visits to Bosnia-Herzegovina, Cameroon, Azerbaijan, Australia, Guatemala, the World Bank in Washington and The Hague.
Under the new Israeli coalition Government, which contains far-right elements, violence against Palestinians has escalated, including Israeli forces attacking Muslim worshippers at the al-Aqsa mosque and attacks against Palestinian Christians at the Church of the Holy Sepulchre. We must condemn all forms of violence, including the devastating murder of three British Jewish citizens, but does the Secretary of State agree that the cycle of violence will not end and there will be no prospect of a lasting peace if the occupying forces are busy building more illegal settlements and trying to evict and oppress an entire people?
I am not sure the hon. Gentleman was in his place during my earlier response, but our position on settlement demolitions is long-standing. We believe they are illegal under international law and undermine the best possible chances of a sustainable, peaceful two-state solution.

Commons ChamberWe are looking very closely at the evidence that is being compiled. While we have not made a formal designation, I can assure the right hon. Gentleman, and other right hon. and hon. Members across the House, that we will ensure that those who are responsible for atrocities, whether in the field or right up to the desk of Vladimir Putin himself, will be held accountable.
I thank the Foreign Secretary and welcome the Government’s move to freeze the assets of Russians engaged in supporting the Putin regime. The EU has already set out a plan for how it will move frozen assets into a rebuilding programme for Ukraine. Our good friends and allies, the Canadians, have also set out in legislation how they will be doing that. What is causing the delay with respect to the UK? Why have we dithered while others have acted?
The hon. Gentleman is mistaken in his assessment of how far forward other countries are in this situation. We are all looking at how we can ensure—I will make reference to this later in my speech—that the people responsible for the damage will ultimately pay for the damage. The facts are that he is wrong about how far forward other nations are. On Canada, I discussed the issue with Foreign Minister Joly on my recent visit. We have a similar legal system and it is testing the legal parameters. We will, of course, learn from its experience.

In March, the former head of the National Cyber Security Centre said that the Government have been confused in their approach to China. After the failed policies of the so-called golden era, the subsequent persecution of Uyghur Muslims in Xinjiang, the persecution of Buddhists and other minorities, the suppression of democracy and free speech in Hong Kong, the military aggression against its neighbours and now this state-sponsored cyber-attack on Microsoft Exchange servers, when will the Government finally lay out a consistent approach to dealing with China?
I have made the points that the UK Government recognise the significance of China on the world stage, that we want China to be a responsible actor, that we recognise that China will engage in trade and investment with countries around the world and that we seek to influence China to be a better player on the world stage. This is best done in conjunction with international partners, which is why the attribution statement yesterday was so important, with an unprecedented number of countries—39—working together to attribute responsibility. As I said, that is the foundation stone upon which other actions may well be taken in the future.

Commons ChamberThe nub of this issue, having visited both Israel and Palestine, is a colonial-era mindset of a gradual land grab: the forcible eviction of people from their homes; the building of illegal settlements; the extreme and shameless violation of human rights and international law; and the sheer suppression and humiliation of an entire nation. At this point in time, however, the efforts of the international community should be focused on securing an immediate end to the bloodshed and hostility. So can the Minister explain: where is the logjam and exactly how much aid have we managed to get through to the inhumanely blockaded Gaza?
The hon. Gentleman makes the important point that the priority at the moment is twofold: an immediate end to the conflict and the immediate access of humanitarian aid. The UK remains one of the most generous donors of humanitarian support to the Palestinian people and we are very proud of that fact. I am not able to give him an accurate assessment, as humanitarian access routes have been closed because of their targeting by Hamas, but we will continue to pursue the joint aims of bringing about a conclusion to this conflict and ensuring that humanitarian support reaches the people who need it.

I thank my hon. Friend for his point about the granting of diplomatic status. That sends a signal to Iran of how seriously we take the issue of our British dual nationals. This Government remain committed to doing everything we can to secure the full, permanent release of all dual nationals, including the return home of Nazanin Zaghari-Ratcliffe. We constantly review what further steps we might take—as I said, that is not something I am willing to speculate about at the Dispatch Box—to secure the release of all our British dual nationals and allow them to return home.
Like many other Brits abroad, Nazanin Zaghari-Ratcliffe has been completely let down by this Government through a litany of errors, including the Prime Minister’s gaffe. Nazanin and her family will doubtless be experiencing serious mental health pressures and anguish at this point in time. Indeed, her husband, Richard Ratcliffe, has previously stated that the Government’s inability to secure his wife’s return is a “failure of diplomacy”. Would not the Minister agree that this further sentence proves that he is right?
Sadly, what this sentence proves is that Iran is willing to do anything to attempt to apply diplomatic leverage, using British dual nationals as the tool. We will never accept that. We will continue to lobby for the release of all the British dual nationals. As I say, the fault sits wholly, squarely with Iran.

Commons ChamberI too would like to express my gratitude to the right hon. Member for East Ham (Stephen Timms) for securing this debate. I pay tribute to him for the work that he has done on advocating for pensioners as chair of the Work and Pensions Committee. I would also like to thank the other hon. Members who have raised individual cases from a number of parts of the country. My hon. Friend the Minister for Africa is frustrated that he is missing this debate, but he is currently travelling on ministerial duties. It is therefore my pleasure to respond on behalf of the Government. I will try to answer as many of the questions raised as possible, but there may well be details to which I am not able to respond in this debate; I hope that Members will forgive me if that is the case. I will try to provide more complete responses later if there are gaps.
The individual constituents referred to today were previously dedicated civil servants working for the Government of Kenya. They have not received their pension payments—in some instances, for over 18 months. Prior to that, as has been mentioned by a number of hon. and right hon. Members, they have not had a pensions uprating since 1992. There have been previous occasions where pensions payments have been withheld, but not for this duration. Of course, a prolonged period of withheld payments has real-world consequences for the day-to-day lives of the people involved, and there is a risk that this will push individuals into a position where they face the unacceptable choice about which basic essentials they should forgo. The people we are speaking about have worked often lengthy and distinguished careers in public service, with the promise that they would receive their pension benefits. I therefore join the House in voicing our frustration at the harsh and unfair reality with which many of these individuals have been forced to grapple.
In 1963, the Government of Kenya inherited both the assets and liabilities of the pre-independence era, including the payment and administration of public service employees’ pensions. In 1970, it became clear that it was becoming an increasing burden on Kenya, and—as an aid initiative and in recognition of our history with Kenya—Her Majesty’s Government announced that they would assume responsibility for the award, control, administration and payment of pension benefits of certain former public servants and their beneficiaries. As the right hon. Member for East Ham mentioned, these were people employed on expatriate terms—that is, those who had paid leave passage outside the country during their employment and who were not citizens of Kenya on 1 April 1971 or on their date of retirement, if that were later.
The pension of anyone who did not meet these criteria remained, and still remains, the responsibility of the Government of Kenya. It is this second group that we are discussing today. In response to the right hon. Member’s question, our estimate is that there are 229 retired civil servants who fall into this category. Some of these pensioners, whose payments are the sole responsibility of the Government of Kenya, now reside in the United Kingdom, and are our constituents and those of other right hon. and hon. Members.
The Government of Kenya appointed Crown Agents Bank as the global paying agent for their pensions liabilities, and it is Crown Agents Bank that is entrusted to make payments to those owed pensions by the Government of Kenya who are based overseas. However, in April 2019, the Government of Kenya ceased releasing funds to Crown Agents Bank, which was therefore unable to make the pension payments to the relevant former officers of the Kenyan civil service. We understand that there are a total of 286, with 229 residing in the United Kingdom.
The Government of Kenya have, as yet, not provided any explanation for the suspension of the payments. Her Majesty’s Government, specifically the former Minister for Africa, were first made aware of this suspension of payments at the end of May 2019 by the hon. Member for Washington and Sunderland West (Mrs Hodgson), who had received letters from affected constituents. From the speeches and interventions this evening, it is clear that other right hon. and hon. Members were approached by constituents in similar circumstances.
When it became clear that this was not an isolated incident, and indeed not a short-lived incident, a number of months later Her Majesty’s Government immediately got in contact with the Government of Kenya. We have regularly made both official and ministerial representations to the Government of Kenya, including on a number of occasions throughout 2019—I am making sure that I do not inadvertently pre-empt part of my own speech—and up to 3 December 2020, when the Minister for Africa raised this issue. The Foreign, Commonwealth and Development Office in London lobbied the Kenyan high commissioner and our high commission in Nairobi liaised with the pensions department of the Kenyan National Treasury, as well as raising the issue with the Ministry of Foreign Affairs. In all those exchanges, we asked for an explanation as to why payments were stopped, and called on the Government of Kenya to resume payments and backdate them as a matter of urgency.
I thank the Minister for allowing me to intervene. During all those exchanges with the Government of Kenya, and given that this is a moral and ethical issue, did our Government Ministers explain to the Kenyan Government that this will become a matter of great shame for them? Even given the small amounts and the small number of individuals involved, it will still be a historical blot of non-compliance and non-payment to hardworking individuals who have served Kenya so tirelessly throughout their lives.
I have not been privy to the details of the conversations, but I think it would be unimaginable for the Kenyan Government not to realise that when there is interest from Members of the UK Parliament, it will become a high-profile issue and it will have reputational implications for them.
The Government of Kenya, unfortunately, have never proactively raised this issue with us. Our high commissioner in Nairobi raised the issue with Principal Secretary Kamau from the Ministry of Foreign Affairs on 1 December, sharing with them the copies of the note verbale we had previously submitted on the subject. My colleague the Minister for Africa also raised it with Kenyan Cabinet Secretary for National Treasury and Planning Yatani on Thursday 3 December and pushed again for pension payments to be resumed and backdated.
We have been in regular contact with Crown Agents Bank and understand that in recent months it has made progress with the pensions department of the Kenyan National Treasury. Crown Agents Bank provided additional information at the request of Kenyan authorities but as yet the funds needed for payments to resume have still not been released.

Commons ChamberAs the Foreign Secretary made clear, the JCPOA is not perfect. However, while it continues to offer some benefits in constraining and verifying Iran’s nuclear programme, and in the absence of something better, we will continue to support it. It would be inappropriate for me to speculate on what future actions the Government might take in relation to Iran.
I commend my hon. Friend the Member for Hampstead and Kilburn (Tulip Siddiq). However, we need to note that a key reason why we are in such a mess with the Nazanin Zaghari-Ratcliffe case is that the former Foreign Secretary, who in spite of his incompetence was promoted by the Conservative party to the post of Prime Minister, was, as usual, not paying attention to detail. Instead, he decided to make a public statement that Nazanin was “simply teaching people journalism”. Similarly, the Scottish Sikh, Jagtar Singh Johal, has been imprisoned in India for the past three years. Despite his family’s lawyer alleging that he has faced torture and despite repeated requests, since taking office the Foreign Secretary has not even had the decency, has not bothered, to meet the despairing family. Instead of constantly delegating to others, such as the Minister here, when will the Foreign Secretary finally get a grip, do his job properly and help those Brits languishing abroad?
The actions of Iran this week show that the reason British dual nationals are being detained arbitrarily is that the Iranian regime choose to do so. To hand them opportunities to make excuses and to externalise their actions is deeply inappropriate. I urge the hon. Gentleman to reflect carefully. He is a deeply honourable person—I know him personally—but I think it is an error to hand them an opportunity to externalise the decisions that they have taken.
