The EU Commissioner for Security and the head of Europol have both made it clear in evidence to the Select Committee on Home Affairs how important it is to maintain our current policing and security co-operation with Europe. I know that my right hon. Friend is committed to continuing that co-operation. Are his counterparts in Europe as committed as he is?

After the issue of European migrants—European citizens—in the UK, that is the second issue that has come up among the Nordic and Baltic groups in particular, and with Germany and the eastern Europeans. It seems to me that we have a great deal to continue to offer the European Union, and we absolutely intend to do so, because we intend to meet our responsibilities as a global citizen and country.

I thought that I had explained that carefully, but I will say it again. Section 3(2) of the European Union (Amendment) Act 2008 makes it clear that any Act that refers to the European Union includes a reference to the European Atomic Agency Community. It is very clear that Euratom was included in the scope of the referendum. On the hon. Gentleman’s point about the transition, the Government will make it a priority, as I have just explained at some length, and I have absolute confidence that those on my Front Bench are apprised of the importance of the issue and will take it extremely seriously. We will continue as a member of the agency. In the highly unlikely situation that no deal were reached, I expect that we would continue to maintain nuclear safety under the auspices of the international agency.

Does my hon. Friend agree that Euratom, much like Europol, is one of those organisations from which the other EU member states would have absolutely no interest in excluding the UK and that, therefore, a quick agreement is likely?

That is an important point. About half of Business for Britain’s 1,000-page “Change, or go” report went through, section by section, all the areas on which we currently co-operate with other nation states through the European Union and its agencies. In each case, it explained that there were bases on which we could co-operate internationally. During the Prüm debate, I made a point particularly in relation to Europol: in a globalised world of cheap, fast air travel, and the internet making just about everywhere milliseconds away, we need global co-operation on police, judicial and security matters. We need to escape the mindset that the only way to do that is through the hierarchical arrangements of the European Union. I hope that my hon. Friend the Member for Kingston and Surbiton (James Berry) will not mind if I dilate slightly on his point.

I remember being told back in 2010 by Members across the House, particularly by the then leader of the Liberal Democrats, that politics was changing and that we were seeing a realignment of politics. I thought of Ronald Reagan’s words on choice:

“Up to the maximum of individual freedom consistent with law and order, or down to the ant heap of totalitarianism”.

That reorientation of politics is happening.

The availability of the internet and air travel means that the old hierarchical structures that were necessary for communication in the absence of the internet are no longer appropriate for the world in which we live. It is quite right that we should seek, as my hon. Friend the Member for Kingston and Surbiton suggests, to co-operate on a global basis on all these issues under new arrangements that allow us to act with far greater agility.

It is an honour to follow the hon. Member for Stone (Sir William Cash), who has fought his corner for 40-odd years. I intend to fight mine, but hopefully not for as long as that. I rise to speak to amendment 43, which is in my name and those of my right hon. and hon. Friends. It concerns the issue of democracy at the end of this process as well as at the beginning, and it would require the Prime Minister to look at the overwhelming case for a people’s vote on the final exit package that the Government negotiate with Brussels after triggering article 50.

On 23 June last year, a narrow majority voted to leave the European Union. I deeply regret that outcome, but I am a democrat and I accept it. However, voting for departure is not the same as voting for the destination. The Government should now give the British people a decision referendum, to be held when the EU negotiations are concluded. I admit that “mandate referendum” and “decision referendum” are not terms that I have used before in this context. They are not really my words; they are the words that were used by the Secretary of State for Exiting the European Union when he eloquently made the case in 2012 for holding a referendum on the deal at the end of the process, which is Liberal Democrat policy today.

When the hon. Gentleman said on 11 May last year that this was a “once-in-a-generation decision”, was he being straightforward with the voters?

As it stands, the Government intend it to be a once-in-a-generation opportunity. As the hon. Member for Stone has proved, however, we sometimes have to fight for two generations for the thing that we believe in. If we have the courage of our convictions, we keep going.

I want to quote the Brexit Secretary directly. I do not want to paraphrase him or risk misquoting him in any way. Describing the strategy of having two referendums—a mandate referendum and a decision referendum—he said:

“The aim of this strategy is to give the British people the final say, but it is also to massively reinforce the legitimacy and negotiating power of the British negotiating team.”

I shall not say this often during this process, but I completely and utterly agree with the Brexit Secretary on that. As we have learned, his words were endorsed the following day by the right hon. Member for Wokingham (John Redwood) on his blog, although we have now discovered that he did not really mean it; he was just saying that as a ruse.

It is a pleasure to follow the hon. Member for Arfon (Hywel Williams).

This House was right to decide in 2015, with just 53 votes to the contrary, that an in/out referendum should determine Britain’s continued membership of the EU. The referendum was the biggest exercise in democracy since the 1992 general election. The majority voted to leave and this House, this seat of democracy, would set a worrying precedent by frustrating that result tomorrow.

When I went into the polling station with my wife on 23 June, I did so knowing, as I had told many voters in the previous days and weeks, that our votes would count and that it was important to vote. It was important because there would be no going back and the result of the referendum would settle the question of whether or not we remained in the EU. Ironically, given the position of his party today, it was the leader of the Liberal Democrats who said:

“there is one thing on which I can agree with the Leave campaign: This is a once-in-a-generation decision.”

The very high turnout in the referendum suggests that that is what the majority of people understood.

For all the arguments advanced now about binding and advisory referendums, not one person told me that they voted on 23 June thinking that Parliament might override the result at some later stage. They were right to have that confidence, because that is what they were told by multiple sources: the Conservative manifesto; the Government’s official referendum leaflet; the leave campaign; the remain campaign; and leaders of political parties. In those circumstances, it would be unconscionable to block the result of the referendum. As the hon. Member for Ilford North (Wes Streeting) said in a powerful speech, that is simply not an option.

We are being urged to go back on those clear averments, by a minority of people—and I think by a minority of people who voted to remain—who want to find a way to block a result that they, like me, find disappointing. I want to explain why I disagree with the four main arguments they make.

Is it not ironic that the Liberal Democrats, whose second name is “Democrats”, want to block the democratic decision—much though I disagreed with it —taken last June?

That point is not lost on me or the House.

The first objection is that MPs in constituencies said to have voted remain are obliged to respect the result in their constituency and block article 50. We are told that we should act not as representatives in the sense that Burke instructed but as delegates. There are several problems with that argument. The first is that the referendum was a straightforward exercise in direct democracy applicable to the UK as a whole. The rules were not for a two-stage electoral college process including a vote in this House. If those had been the rules, the votes would have had to be counted on a constituency basis, which they certainly were not in England—it is likely that my constituency voted to remain, but we will never know. In practice, had those been the rules, it is estimated that the leave campaign would have won by a country mile—by more than 2:1. To get around this inconvenience, a second main argument is advanced: that all those MPs in seats that voted to remain should vote to block article 50 anyway in the national interest. To those arguments, I simply say: you cannot have your cake and eat it.

The third main argument, reflected in one of the amendments—one with which I respectfully disagree—is that the referendum gave no mandate to leave the single market. Whatever else can be said about the leave campaign —and I have a lot to say about the leave campaign—it was certainly clear about taking back control of immigration policy, laws and EU spending, none of which would be possible as a member of the single market. EU leaders said it at the time, leave campaigners said it, remain campaigners absolutely said it, and I know I said it, because staying in the single market was one of the main reasons I voted remain, knowing what a leave vote would entail.

The fourth main argument is that MPs who like me voted to remain have a duty to hold fast with that view and vote to block article 50: we were convinced that the best thing for the country was to remain in the EU last June, so what has changed? I say nothing has changed. I made a careful decision, having considered the arguments on both sides, and decided that it was in the best interests of my constituents, many of whom work in the City of London, and of the country to remain in the EU. I recognise, however, one straightforward fact: my side lost. We in the House are nothing else if not democrats. The democratic process of the referendum, set in train by a vote in this House, has run its course and delivered its result, and in this country, we respect the results of the democratic process.

A good number of my constituents who voted to remain have in the last few days and hours asked me to vote to block article 50. They will be disappointed by my vote on the Bill. I respect their views, I understand their desire to remain a member of the EU and I share their concerns about the uncertainty inherent in the article 50 process, but the consistently high turnouts in my constituency tell me that my constituents care about democracy. The majority of my constituents, and the majority of the people in the UK, would not expect their MP to try to obstruct the result of a democratic process just because that MP was on the side that lost.

I have come to the clear conclusion that the right thing to do—indeed, the only thing to do—as a democrat is to accept the result of the referendum, to avoid prolonging this damaging uncertainty and to focus on arguing for what I think is the best relationship with the EU once we have left, both for my country and my constituents. For me, that means the closest possible relationship with the EU consistent with the referendum result, and it means a liberal, tolerant, outward-looking, internationalist Britain that leads the world in free trade, the rule of law, the fight against terrorism, international development, research and innovation and environmental protection, all in close co-operation with our EU friends and allies. That was the positive vision set out by the Prime Minister in her Lancaster House speech, and she has my full support in seeking to deliver it, but she can do so only if we vote to trigger article 50 tomorrow—the inevitable and required result of the EU referendum.

Last week I updated the House on our progress towards leaving the EU. I have been clear that the Government’s overarching aims are bringing back control of our laws to Parliament, bringing back control of decisions over immigration to the UK, maintaining the strong security co-operation we have with the EU, and establishing the freest possible market in goods and services with the EU and the rest of the world.

The great repeal Bill will end the primacy of EU law. It will minimise uncertainty and return sovereignty to the institutions of the United Kingdom, because that is what the referendum was all about—taking control.

We will work to ensure the UK’s exit from the EU serves the interests of the whole country, from citizens to businesses. We will reap the opportunities exit provides all over the world and deliver an orderly and smooth transition, but I have been clear, as has the Prime Minister, that we will not be providing a running commentary on the negotiations; that would not be in our interests. Parliament will however be fully and properly engaged, as will the devolved Administrations.

We want to build a national consensus around our position and discuss our options with a range of stakeholders. Last week, I committed to a series of debates so that the House can air its views and we look forward to engaging with the new Select Committee. I congratulate again the right hon. Member for Leeds Central (Hilary Benn) on his election as Chair of that Committee.

From the Mill bakery next door to my constituency office to the wards of Kingston hospital, thousands of EU citizens work and live in Kingston, and they are very welcome. What process does my right hon. Friend have in mind for ensuring their rights are protected post-Brexit, as well as the rights of British ex-pats living in the EU, something that none of the 27 Heads of State is yet to guarantee?

As the Under-Secretary of State for Exiting the European Union, my hon. Friend the Member for Worcester (Mr Walker) has made clear already, we want to be able to guarantee the rights of all those European migrants in the UK. Many of them are already in the position of having indefinite leave to remain, or will have by the time we leave in two and a half years’ time or thereabouts, so we are talking about a small fraction of those people, but nevertheless we take this incredibly seriously and we will seek to get the agreement with the other European countries that we will uphold their rights and British citizens’ rights abroad as soon as possible.

I am not talking about a rerun of the referendum campaign we have just had. I am arguing specifically, as a Scottish MP, that Scotland voted to remain, so, before we go through the article 50 process, the Government in Westminster have the opportunity to reflect on recognising the sovereignty of the people of Scotland, and that to do so would help those who signed the petition we are debating.

This is the debate that we should have been having, rather than the one that we had. Rather than being seen as investing in our future, immigrants have become scapegoated and hate crime has been on the rise. Not only have immigrants been scapegoated, but EU citizens living in the UK are now fearful about whether they will have long-term rights to remain.

On the morning of 24 June, after a failure of leadership by the UK Government, the First Minister of Scotland spoke for many in a message that resonated not only in Scotland, but throughout the UK. Her message was clear: EU citizens living here are our friends, neighbours and colleagues, and they are welcome. Some 173,000 EU citizens are part of our communities in Scotland, and many are fearful about whether they can remain. Uncertainty still exists. The Prime Minister should do the right thing and state that all EU citizens who are here now are welcome to stay. It is about doing the right thing. Those who are here have been welcomed in; why would we not remove any uncertainty? We are talking about people who under no circumstances should be used as bargaining counters in any Brexit talks. Where is the humanity? The Prime Minister will be judged by her actions: show compassion and decency.

We should also have been discussing the very pillar of the argument about the benefits of European membership: peace in the continent, fostered by nations working together for the common good.

Does the hon. Gentleman agree that changing the rules of the game ex post facto if we do not like the result, which is precisely what the petition proposes, is not really the way that we do things in this whole United Kingdom? Even among people who voted to remain, myself included, a very large number would not accept a second referendum, despite being disappointed by the result.

There were flaws in the way that the referendum was conducted, but as a democrat and someone who argues very much for the sovereignty of people, I have some sympathy with the hon. Gentleman’s view. We must not override democracy by denying those in the UK who voted in the referendum their rights, but we must equally recognise the votes of the people in Scotland who voted to remain.

We must champion the benefits of the single market in trade, services and—yes—people. Much of that positive argument was lost in the deluge of fear and negativity. The costs of our membership were much discussed, but the benefits were not. When it comes to the costs, those who spoke about a bounty for the NHS should hang their heads in shame. Much of the Brexiteers’ argument has been shown to be false. The people who are responsible for this situation are those who engineered the referendum and our departed Prime Minister, who showed a complete lack of leadership in securing the UK’s continued membership of the EU. It is often claimed that all political careers end in failure. The Prime Minister fell on his sword after the referendum. His tenure will be reflected on as one during which he presided over the UK leaving the EU—something that he was personally against. I cannot think of a greater foreign policy disaster for any Conservative Prime Minister since Eden and the Suez crisis.

Not only did the Prime Minister announce that he was going, but one of the primary Vote Leave architects, the ex-Mayor of London, then proclaimed that the Government did not have a plan for Brexit.
