Commons ChamberWell, of course, tackling people smugglers at source is exactly what our country and Government are leading on right now. We are leading on that work with our intelligence and security partners, and through law enforcement co-operation. We are doing that through our EU near-neighbours such as France, Belgium and the Netherlands, but also countries further upstream, including Italy and Greece. It is right that we do that. This is difficult, difficult work and we are supporting them. My final comments very much come back to the hon. Lady’s question, but also to points made by others. Speeding up processes is exactly what the Nationality and Borders Bill is about: making sure we can speed up asylum claims and stop the merry-go-round of going to the courts and tribunal again and again and again, and ensuring we can bring efficacy to the asylum system.
I very much welcome measures that will offer a proper deterrent to those who are seeking to come to this country illegally. I also particularly welcome action to ensure that people are dispersed more fairly right across the country. Does my right hon. Friend agree that for far too long areas like Stoke-on-Trent have taken far more than their fair share and that it is about time other parts of the country did their part?
My hon. Friend is absolutely right. I pay tribute to Stoke Council and to all parliamentary colleagues from Stoke-on-Trent who have made representations over a long period of time many, many times with great strength and feeling. The dispersal policy is important. I have touched on it already. It is a complete and utter shame that the nationalists have been howling about this policy, while at the same time only one local authority has actually supported the dispersal policy. In the principle of fairness and a sense of fairness across the country, and to British taxpayers, we must make sure that every local authority participates in the scheme.

In the interests of time, I refer the hon. Lady to the new plan for immigration. On page 6, she will see that:
“The UK accepted more refugees through planned resettlement schemes than any other country in Europe in the period 2015-2019”.
That answers her question about the number of people who are coming here.
We have seen thousands of people coming into the country. Many areas, such as Stoke-on-Trent, which has already taken far more than its fair share, are continuing to see increased pressure. Will my right hon. Friend look at measures to reduce the numbers coming into the country and ensure that there is a much fairer share across the country?
I thank my hon. Friend and all hon. Members from Stoke-on-Trent in particular who have been very clear and engaged with me and the Department on the whole issue of asylum accommodation. They have demonstrated, with their local council leader, who has been outstanding, the principles of fairness and value in how we engage with local authorities.
My hon. Friend knows my message on this issue: we need other local authorities across the United Kingdom to step up, we really do. I restate that the long-term plan—it will not happen overnight—is to move people out of the current accommodation that they are in. They are in that accommodation for various reasons linked to the pandemic and Public Health England guidance. The Government, across Government and with military support, will be building reception centres.

Many of my constituents in Stoke-on-Trent South are shocked and angered by the illegal crossings of the English channel. The integrity of our borders is broken, and my constituents are fed up of seeing people continue to enter the UK illegally. We must act to put an end to the profiteering of criminal people traffickers, for whom illegal routes have become an industry, and we must deter those who seek to make these perilous journeys across the busiest shipping lane in the world in no more than a rubber dinghy.
Clearly, there must be safe routes for those in desperate need. The UK and Stoke-on-Trent have a proud record of helping those in the greatest need, but what my constituents cannot understand is why there should be any need to make illegal journeys to do so: European countries are safe, and those attempting to claim asylum should do so in those countries.
We have seen repeated attempts to game the system, using any legal loophole to do so. There were 16,000 illegal immigrants last year yet, because the system is overwhelmed and repeatedly abused, deportations are declining. The increased pressures we have seen on the entire immigration system put enormous weight on the few asylum dispersal areas. Stoke-on-Trent has seen one of the highest proportions of refugees in the entire country.
Does the hon. Member accept the criticism from his former colleague Anna Soubry, who said the Conservative party is now a “Trumpian”, far-right, “populist” party?
I do not agree with that. We have absolutely supported those in the most desperate need. It is about making sure we support the genuine ones in those countries and regions. We have supported around 25,000 over the past six years in this country, which is the most in the whole of Europe. We will not take any lectures from the SNP, which talks so much about support for immigrants but does not do a single thing. Glasgow is the only city in Scotland to be a dispersal area. The rest of Scotland does not lift a single finger to help asylum seekers.
I agree with my hon. Friend. Cities such as Stoke-on-Trent are actually putting in the effort.
The hon. Member’s statement that Glasgow is the only place in Scotland that accepts refugees is untrue. South Lanarkshire, my local authority, has accepted a number of refugees, particularly after 2014. [Hon. Members: “How many?”] I do not have the numbers, but the fact stated by the hon. Member is untrue.
Glasgow is the only official asylum dispersal area in Scotland. Other authorities have the opportunity to come forward as dispersal areas, but SNP-controlled authorities in Scotland have failed to do so. All the pressure has fallen on the minority of authorities that are dispersal areas, while numerous authorities have failed to resettle a single asylum seeker.
The west midlands is currently accommodating 12.26%, an increase on 2019, but all of this is falling on only half of the authorities in the region. In Stoke-on-Trent it is having a significant impact on our overstretched local services.
Perhaps the hon. Gentleman can join our delegation tomorrow, because what we seek and what the cross-party Home Affairs Committee has advised is that the Home Office properly fund the dispersal system. Every single local authority in Scotland got involved in the refugee resettlement scheme because it was properly funded. I am more than happy to join him in seeking more money for dispersal areas, and we will all then happily sign up to do the job properly.
What the hon. Gentleman is actually saying is, “We are happy for authorities like Stoke-on-Trent to continue to pull their weight, and we in Scotland will just sit here, not pull our weight and continue not to support asylum seekers in this country.”
The Scottish Government have published the “New Scots” plan to welcome asylum seekers and refugees across the entire country. If the UK Government do not want to give us the money, why do they not give us the power? Then we can have our own immigration system in Scotland.
I will make some progress, as I have very little time.
There are currently around 10,000 national foreign offenders in this country. Again, the Labour party will not do anything about it, and it tried to accept murderers and rapists into this country. We in Stoke-on-Trent will not allow that. As I said, the pressure faced by those few who have done the most is totally unsustainable. It saw all resettlement area authorities in the region withdraw from the scheme recently. Since then, we have continued to see attempts to place people, and the latest letter from the Minister—I do thank him for the support he has given—says that there will continue to be procurement in these areas, against our wishes. I totally recognise the urgent need for these areas to house people, but it cannot continue to fall on a few areas of the country. It is time that other areas of the country step up and do what they should in taking a fair share and contributing, as Stoke-on-Trent has and continues to do.

Before I come to the substantive points I wish to raise in relation to the Bill, it is worth reminding ourselves that what we are debating tonight touches on the experiences of some of the most vulnerable people in global society. Facing an ever-hardening legal system, asylum seekers find themselves in what can only be described as a paradox of precarity. The legal system offers asylum seekers little to no support, despite their already fragile and precarious position. That cannot be a satisfactory state of affairs.
I contend that this Bill only serves to entrench that paradox of precarity. While an account of the traumas faced by those who have fled their homeland for fear of persecution is best left to those who have first-hand experience, we cannot overstate the pain, suffering and disorientation faced by many of those who arrive on our shores. Let us reflect on the plight of the Uyghurs, the Rohingya and the Tigrayan people, for it is those groups the Bill will fall hardest on—those fleeing war and genocide.
For a nation whose proud reputation was part-founded on welcoming the persecuted over many centuries, this Government are doing much to trash that. Compare Germany, which accepted 1 million from Syria, Iraq and Afghanistan in 2015, with the UK promising to take just 20,000—a mere 2%. Our reputation is the reason why our legal system ought to be a bastion of firm, steady protection for those most in need, rather than—as will be the case in the event of the Bill’s passage—a contributory force in the erosion of the rights of asylum seekers. I am afraid that I want to let everyone speak this evening.
Let me give three clear examples of how the Bill will contribute to weakened protection for asylum seekers. First, clauses 16 to 20, requiring them to provide evidence supporting their claim by a specific date, appears to be almost entirely arbitrary. Indeed, the Immigration Law Practitioners Association has said that those clauses ignore the practical difficulties faced by many asylum seekers. Secondly, clause 24, which allows the Home Secretary to accelerate appeals when she thinks they would be disposed of expeditiously, grates against both article 34 of the UN refugee convention and the principles of natural justice—the very principles on which our legal system is founded, signed into force by the Attlee Government. It is more than regrettable that the convention appears now to be held in such little regard by this Government. Thirdly, not only will the Home Secretary have a much wider arsenal of powers at her disposal, but the Bill authorises decision makers to decide on the balance of probabilities, rather than on the basis of reasonable likelihood, whether a person claiming asylum has a well-founded fear of persecution.
Let us be clear: this amounts to an unnecessary raising of the legal bar for asylum seekers to succeed in cases. I struggle to see a valid policy reason for such a move, in the light of the Home Secretary’s commitment to upholding the apparently long, proud tradition of providing a home for people fleeing persecution and oppression. The answer lies not in raising the bar disproportionately high for asylum seekers to overcome, but in a more holistic approach to the support offered. It is not just our footballers who see this divisive Government for what it is; the public are more compassionate than the Government, and they seek a fair, compassionate system to provide for those in need.

Commons ChamberSince 2019, we have invested over £65 million to tackle county lines and drug supply, including £40 million committed this year. Through our county lines programme, we have become smarter in our activity against these ruthless gangs, resulting in more than 1,000 lines being closed, more than 5,800 arrests and more than 1,500 vulnerable adults and children safeguarded.
The hon. Lady rightly highlights one of the truly despicable aspects of county lines, which is the horrible exploitation and often victimisation of young people who are driven into the awful activity. She might be interested to know that we are very focused not necessarily on them but on those who control and victimise them. Much of the activity taking place in the three big forces we are funding—Liverpool, London and in the west midlands—is in targeting those line controllers who drive that exploitation. Interestingly, more and more of them are now not just being prosecuted for drugs importation or distribution, but for modern slavery or under child grooming legislation. That means that when they are convicted, they are put behind bars in the sex offenders wing, which is something not even they see as desirable. It is proving to be a very strong deterrent.
One of the key aspects of our work is gripping the transport network, in particular rail. We are finding that where we shut down their ability to use rail and they divert to roads, their likelihood of using young people, who cannot drive and are more likely to be arrested, is dropping. All our effort is being focused not just on restricting the supply of county lines across the country, but on rescuing and preventing young people from getting involved.
There have been a number of illegal cannabis farms busted recently by Staffordshire police. Many are in derelict and abandoned buildings, including the empty former Woolworths building in Longton, which was raided for the second time in under two years recently, finding 1,500 marijuana plants. Will my hon. Friend look at what more can be done to tackle the use of empty and derelict buildings by organised gangs to cultivate drugs?
My hon. Friend is known for his innovative approach to policy and he certainly raises something that merits further investigation. He is quite right that we have seen a growth in the number of cannabis farms across the country in all sorts of buildings. Notwithstanding the drugs they produce, there is very often disgusting oppression and victimisation taking place inside—people who are trafficked across the world to tend the plants—and we need to do something about that as well. He might be interested to know, however, that in their off-hours when police helicopters are not dealing with other crimes, one thing they do is circle around using thermal imaging cameras to find houses that are strangely heated to full blast in the middle of summer, indicating that there may be something afoot. That has been a very rewarding way of investigating those farms. I will look at his idea and pursue it further.

I am grateful to my hon. Friend the Member for Ruislip, Northwood and Pinner (David Simmonds) and the hon. Member for Bermondsey and Old Southwark (Neil Coyle) for calling this pertinent debate.
The issue is extremely current, given the situation we have seen in the English channel and the increasing pressures on dispersal areas. I am pleased that the Home Secretary and the Home Office are taking robust action to address those issues, with a new plan for immigration, which I entirely support, by taking action to remove those who have no right to be here and better deterring illegal migration, while supporting those who are in genuine need.
As a dispersal area, Stoke-on-Trent has contributed far more than most areas to the dispersal scheme since its inception, but we can take only so much. It is about fairness. It is now time for other towns and cities to learn from our example and do their bit. Far too frequently, hon. Members advocate doing more, but when it comes to taking action on places becoming dispersal areas, they do nothing. Numerous local authority areas have not resettled a single refugee. Sadly, because of the pressures on Stoke-on-Trent we have now reached the point where additional demands on already stretched local services, whether those are schools, health services or social services, are entirely unsustainable. We have resettled more than anywhere else in the west midlands and now, as part of Operation Oak, we are expected to take more.
I thank the Minister for hearing the concerns of Stoke-on-Trent MPs and the leader of the city council recently. Right now, on average, one person in every 250 in Stoke-on-Trent’s population is an asylum seeker. In one area of my constituency, the figure is closer to one in 80 and, in some parts of the city, it is as high as one in 30. In addition to those asylum seekers, there are thousands of confirmed refugees whom the city has embraced previously. Our city’s cluster limit ratio of 79% is greatly in excess of even Birmingham’s 29%, and our city council has recently had to challenge proposals repeatedly made over the course of the past year to increase numbers further. Sorry, but we can do no more.
Dispersal area local authorities of all complexions across the region have been united in their concerns about ever more pressure being placed on those few dispersal areas, when so many authorities have done nothing. There has been a tendency to place people in areas with lower value housing, just because it is cheaper. Yet the consequences of doing so and the impacts on local services are stark. The council has found itself challenging totally inappropriate accommodation, including unsustainable hotel accommodation. There are also much more serious concerns about radicalisation. Some accommodation is in extremely inappropriate locations, where vulnerable individuals may be targeted by extreme and criminal groups. I repeat that we are proud to have done much more than almost any other area to welcome refugees and asylum seekers, but it is time for other areas to stop grandstanding and actually do something.

Commons ChamberI pay tribute to Staffordshire police for their hard work and professionalism throughout covid. Local emergency services have given their all, often at high personal risk, particularly paramedics in responding to medical needs. I am truly grateful for their work, and their dedication brings us ever closer to a safe lifting of lockdown. Our policing is by consent, and I know that officers in Staffordshire hold this in great importance. In Stoke-on-Trent, officers have taken a measured approach based on the four Es—engage, explain, encourage and enforce. The comparatively low covid fines in Staffordshire demonstrate that enforcement is a last resort.
The images we saw over the weekend at Clapham common were disturbing for us all, and this should be thoroughly investigated, but I do not think it right to impede the progress of this important Bill. Our freedom-loving democratic values enshrine rights to peaceful protest, and this Bill does not curtail that. Many constituents have contacted me over the last year after seeing the wanton vandalism and obstruction of ambulances. This totally reckless behaviour of a minority demonstrates the need to update measures, such as putting static protests on the same footing as moving demonstrations. Emergency service workers frequently put themselves in harm’s way in protecting and saving lives of others, and we must give them the protections they need, such as doubling maximum sentences for assaults. How could anyone not support these measures, given that they frequently put themselves at great risk to keep us safe?
I fully support the new police covenant, which ensures that serving and retired officers and their families are properly supported. I know my constituents in Stoke-on-Trent are extremely concerned about more serious criminals. Although crime is generally down, it is worrying that crimes committed in Stoke-on-Trent are becoming more serious. Especially concerning are the repeat offenders, and I welcome serious violence reduction orders to target persistent offenders. The Government’s safer streets initiative in Fenton is particularly important locally, improving household security so that people feel safe in their own homes.
No one should ever feel unsafe, not least women and children. It is totally unacceptable that any woman should be too scared of going out at night or should expect to be regularly harassed. I very much welcome the Home Secretary reopening the survey on tackling violence against women and girls. It is most worrying that Opposition Members do not support measures targeting the most serious offenders, including those committing serious violence and sexual offences. This Bill ends automatic early releases, keeping dangerous criminals off our streets. It also encourages stricter conditions on bail in high-harm cases and extends protections against sexual conduct by those in positions of authority. Figures of authority must not abuse positions of trust through such despicable behaviour. A lack of trusted positive role models often drives young people into gangs, drugs and violence because they believe that they will be somehow more secure. That cycle must be broken down in Stoke-on-Trent and across the country.

Commons ChamberAs I have said several times already, all measures are under review. Colleagues across Government are working to implement the hotel quarantine policy and the logistics involved in that, but this is not just about hotels. This is absolutely about compliance and enforcement, and we have measures in place at our ports and airports to ensure that people are being checked and to ensure compliance.
My hon. Friend and I have spoken about this previously, and I very much recognise the pressures experienced in his constituency. Obviously we have had accommodation pressures throughout the pandemic, and we are implementing a recovery programme, with which he is familiar. Within that, we are looking to accelerate, where we can and in a covid-compliant way, working with Public Health England and all the relevant organisations that he is familiar with, the movement of people out of contingency accommodation and into much more dispersed accommodation across the UK.

The hon. Lady has made a very important point. The number of deaths from coronavirus has reached 100,000. Every death is an absolute tragedy. I think that puts this discussion today into some context—a great deal of context, in fact—regarding not only measures but the fact that we are working night and day to reduce the spread of coronavirus. I have highlighted the checks done by the isolation assurance service, but it is not just about that service. It may reassure the hon. Lady to hear that Border Force is now fulfilling 100% of compliance checks, working with airport staff on triaging to bring in those checks and with airports and ports on queues and managing the flows coming in. Those are important measures, but it does come back to the need for compliance, which is why, again, I urge everyone who should not be travelling to please stay at home.
Given the huge efforts that everyone has made, which have now got infection rates back under control, and given the rise of new covid strains in a number of countries around the world, does my right hon. Friend agree that we cannot risk importing further new strains of the virus into the UK, which would undermine all that work?
My hon. Friend is absolutely right. I have spoken already about our incredible vaccine—our world-leading vaccine—which we are proud of. Our work and focus since the development of the vaccine have been about protecting that vaccine from new strains, hence the measures that we brought in in December—the pre-travel tests and the carrier liability for pre-travel tests as well. Those are important measures, and they are clearly linked to the vaccine, but also to stopping the spread of coronavirus.

On the Select Committee Chair’s question about accommodation and support, I can confirm that it will be available, as I have said already, because not to provide it would breach article 3. That support will be available and people will not fall into destitution.
On the negotiations, back in May—I believe it was 19 May—we tabled an EU proposal on these matters, but if that is not agreed to in the course of the current discussions, we will seek bilateral agreements with various countries. As I said to the right hon. Lady’s Committee a week or two ago, individual member states have been asked by the Commission not to engage in such discussions while the European negotiations are ongoing, so we will commence those as soon as we are able to. Even in the absence of those discussions, it is possible to raise returns cases on a case-by-case basis with member states, which, of course, we can do from 1 January. Critically, the new provisions prepare the way—they lay the foundations—for agreements that we may reach in future, besides facilitating case-by-case action.
Finally, although currently in force, the Dublin regulations have not been terribly effective. The right hon. Lady will know that the numbers we successfully return under Dublin are really rather small, numbering in the low hundreds per year. I am confident that, through active negotiation, not only can we replace Dublin but we can improve on it.
I thank the Minister for everything he is doing to tackle illegal migration into this country. As he knows, in Stoke-on-Trent we have resettled the largest number of refugees in the region, which has put significant pressure on local services. Will my hon. Friend look at what more can be done to ensure that local services are not overwhelmed, and put more pressure on local authorities in other parts of the country that are not contributing fairly to the rehousing of refugees?
I thank my hon. Friend and Stoke-on-Trent for their work to welcome genuine refugees, including as part of the resettlement programme. He raises a good point, because some parts of the country decline to take unaccompanied asylum-seeking children as part of the national transfer scheme, thereby putting enormous pressure on gateway authorities such as Kent, Portsmouth, Croydon and Hillingdon; and many other authorities, despite proclaiming themselves to be cities or even nations of sanctuary, often do not give consent for dispersed accommodation for asylum seekers. I say to any of those local authorities and to the devolved Administrations in Scotland and Wales: please help us by accepting unaccompanied asylum-seeking children under the national transfer scheme, particularly from Kent, Portsmouth, Hillingdon and Croydon, and please give consent for dispersed accommodation, because it is essential that we have that available to accommodate people who are seeking asylum.

Commons ChamberMy hon. Friend is absolutely right to raise his concerns. He has raised the issue of crime and the implications of disorder for his local community, and he is right. I can confirm that his police force has recruited 72 additional police officers, and of course that number is going to go up and up in line with our commitment to recruit 20,000 more police officers.
My hon. Friend is absolutely right to point to and highlight the devastating impact of drugs such as Monkey Dust. I have visited his constituents in the past and we discussed these issues. The Government absolutely recognise the corrosive harm that these drugs do. Of course, there are penalties for supplying these drugs—penalties of up to 14 years in prison and unlimited fines. At this moment, we are keeping drug classification under review, and of course we do that taking into account all the harms and the impact of these drugs on individuals and our communities.
