As a former Home Office Minister, my hon. Friend has a great deal of experience in this area. The police are operationally independent, but we liaise closely with them and the National Police Chiefs’ Council. I have regular discussions with Gavin Stephens, who chairs the NPCC, and, in relation to this matter, with Chief Constable Rob Nixon, who is the criminal justice lead, and with Deputy Chief Constable Nev Kemp of Surrey, who is the lead for custody. I will take this opportunity to place on the record my thanks to police up and down the country for their careful management over the past seven days, which has ensured that our fellow citizens have been kept safe.
North Yorkshire and West Yorkshire police have just arrested 62 people in a county lines operation. They seized swords, a machete and a crossbow, and took 3 kg of cannabis, crack cocaine and heroin off the streets, alongside the misery and violence that characterises county lines gangs. I am so grateful to them for that work, but are the Government suggesting that they should have allowed it to continue until further notice under these contingency plans, all because the Government have so mismanaged the criminal justice system and the collapse in prison places?
First, prison places have not collapsed; I think there are more prison places now than in the recent past. I congratulate North Yorkshire and West Yorkshire police on that operation, which the hon. Lady said led to 62 arrests of dangerous criminals. As I have said, none of the contingencies referenced were activated, and there was never any question of dangerous criminals of that kind not being arrested. That is exactly the kind of operation we like to see. I am speaking from memory, but I think we have closed down something like 6,000 county lines in the past four years. I am delighted to see such operations successfully putting dangerous criminals where they belong: behind bars.

Commons ChamberTo be clear, there was a reduction in police officer numbers in the coalition years—the years immediately after 2010—owing to the appalling financial conditions that we inherited. However, those police officers have been more than replaced. The total number of officers in England and Wales last year was about 3,500 higher than it was in 2010. It is therefore true to say that many officers have joined relatively recently, which means that there is a training and supervision job to do—and police forces are doing it. Retention rates are quite high. The staff survey shows quite high satisfaction rates, so with each month that passes since the influx of the past three or four years, those officers become more experienced. That will benefit our constituents and make sure that the trend of falling crime continues.
We are taking action on drugs, having closed down more than 2,000 county lines since April 2022. We are also tackling knife crime, which we discussed extensively yesterday. We are removing more than 130,000 knives through stop and search, which is important. We need to use stop and search and surrender programmes with confidence. We are investing in violence reduction units, and today we renew our commitment to funding those units and doing prevention work. We renew our commitment to hotspot patrolling against serious violence, knife crime and antisocial behaviour.
This funding settlement includes £66 million of extra money that will go to every single police force in the country for hotspot patrolling in areas where antisocial behaviour and serious violence are a problem. Where we have trialled that—for example, we trialled antisocial behaviour hotspot patrolling in parts of Essex, and serious violence patrolling in places such as Brighton—we have seen a reduction of approximately 30% in antisocial behaviour and crimes such as robbery. We know that it works. From April this year, every single police force will get that funding. I urge Members from all parts of the House to talk to their local PCCs and make sure that those hotspot patrols take place in town centres, on high streets, or wherever else, so that the public can see that the issue is being dealt with.

During the years of austerity, which hit our police forces hard, we lost 21,000 police officers. He has talked about the uplift in numbers since then, but over the same period, police stations across the UK closed at the rate of one a week, which resulted in four in 10 police stations being closed during that period. What is his plan to reopen those police stations in the heart of our communities? That will be needed if communities are truly to take back some of the streets that have had massive problems with antisocial behaviour.

Commons ChamberI welcome my hon. Friend to his very well-deserved place. Of course, the Mayor of London, Sadiq Khan, had planned to close down Uxbridge police station, along with many others, until my hon. Friend forced him into a humiliating U-turn before he was even elected—that is more than most of us achieved prior to coming to Parliament. I join him in calling on the Mayor of London to keep Uxbridge police station open and to add that custody suite, but also to confirm the future of all those other police stations around London that he had threatened to close just a few years ago.
In my constituency, we have experienced a real escalation in antisocial behaviour and quite violent disorder in recent years, particularly around bonfire night. Last year, police had to deploy 100 officers to just one area of my constituency where local communities were being terrorised. What consideration has the Minister made of additional powers or resources for areas up and down the country that are anticipating further unacceptable disorder ahead of this year’s bonfire night?
The hon. Lady is quite right to raise this issue. Antisocial behaviour concerns everyone. There are a number of powers available to local police, such as community protection notices, and to local authorities—I am thinking in particular of public space protection orders—so I strongly urge her to work with her local authority and, if she is concerned about a particular area, to put in place a public space protection order ahead of bonfire night. Our antisocial behaviour plan envisages strengthening various antisocial behaviour powers. As of next April, we will also be funding every single police force in the country to have antisocial behaviour hotspot patrols. I am not sure whether her force is one of the 10 pilot areas, but every force will have that funding from next April, and the sort of situation that she describes sounds like the ideal use for those ASB hotspot patrols.

Commons ChamberThe chief constable of West Yorkshire police, John Robins QPM, recently told the BBC that his force does not have the resources that it needs to deliver the service that the public expect. Cutting through the spin, he said that the force was down 2,000 staff and £140 million since 2010. He said his force could deal with major incidents and crimes, but only at a cost to neighbourhood policing. This comes from a force that was rated outstanding in planning and the use of resources in its latest inspection by His Majesty’s inspectorate of constabulary and fire and rescue services. Which bit of policing does the Minister think should not be done because forces simply do not have the resources?
The shadow Minister will know that in the police funding settlement for this year, 2023-24, there is around about £500 million extra—in fact, it is slightly over £500 million—for police forces up and down the country. That has enabled us to deliver a record number of officers ever. There are 149,572 officers—about 3,500 more than there were under the last Labour Government. In West Yorkshire, which the shadow Minister asked about, neighbourhood crime is down by 30% since 2019 and overall crime—excluding fraud and computer misuse, which came into the figures only recently—is down by 52% since 2010. I am still waiting for the shadow Home Secretary to apologise for being a member of a Government who presided over crime levels that are double those we have today.

Here we are again, Mr Speaker, with an urgent question on Conservative party donations. As we have heard, the National Crime Agency has named Mr Marandi as a person of importance in its investigation into what has been described by the judge in the case as a “significant money-laundering scheme”. Mr Marandi has been on the Conservative advisory board of ultra-wealthy supporters, donating £756,300 to the Conservative party between 2014 and 2020. This is not the first time that we have to come to this Chamber to ask questions about the Conservatives’ lack of rigour when accepting donations. Just last month in the urgent question on alleged secret Chinese police stations, my right hon. Friend the shadow Home Secretary told the House that The Times had reported
“a Chinese businessman linked to an alleged Chinese secret police station in London, is linked to the united front work department, and has organised Tory party fundraising dinners and attended events with Conservative Prime Ministers”. —[Official Report, 19 April 2023; Vol. 731, c. 248.]
In April, the Good Law Project published damning revelations that, since the start of Russia’s invasion of Ukraine, the Conservatives had accepted at least £243,000 from Russian-associated donors, some of whom were linked to sanctioned businesses and organisations. I reminded the Security Minister of that when we recently debated Lord Carlile’s proposed amendment to the National Security Bill, which would ensure that political parties do their due diligence when checking where donations come from—an amendment which the Government whipped their MPs to vote against. I warned the Government just two weeks ago that, if they rejected proposals to clean up donations, the public would draw their own conclusions as to why, and here we are again.
Can the Minister confirm when the Government last accepted a donation from Mr Marandi and when he first knew that he was a person of importance in such a case? If he says that he was briefed only this morning, why has it taken until now to understand these revelations and the implications? Will the Government be giving back the donations that they have received in the light of these revelations? Can the Minister now confirm that the Government will back Lord Carlile’s amendment, or will they continue to suggest that there is nothing to see here?
The London laundromat must be shut down. The Government’s donations must be cleaned up.
I welcome the fact that the National Crime Agency is investigating the apparent wrongdoing that has been going on and taking legal action as well. I am sure that all Members of the House will welcome that.
The National Security Bill is still being considered in the House of Lords, and we may see it down here in the course of ping-pong, so there will be plenty of further opportunities to discuss that. I would add that people are entitled to be considered innocent until proven guilty. That is quite a long-standing principle of law in this country, but all political parties, on both sides, need to be vigilant about donations. [Interruption.] Well, there have been donations received by a Labour Member of Parliament, and connections of a Labour Member of Parliament to someone who was later declared a foreign agent of China by MI5, so to suggest that this is polarised on party political lines is a misrepresentation. All political parties need to be very careful, thoughtful and discerning about where donations come from, regardless of what the law may say, and that is a lesson which political parties need to reflect on very carefully and learn from.

Public Bill CommitteesIt is a pleasure to serve under your chairmanship, Mr Bone, for the second time in two days. I will keep this brief, but I join others in congratulating the hon. Member for Buckingham on securing so much cross-party support for his private Member’s Bill and on getting it to Committee. We very much hope that the Bill will successfully play a part in clamping down on ATV and quad bike theft.
As other Members have outlined, this issue has long been prevalent in rural communities, afflicting those involved in agricultural work in particular, but as we have heard, the impact is felt in all our constituencies across the country in different ways. According to NFU Mutual, around 900 to 1,200 quad bikes are stolen every year. NFU Mutual’s most recent crime report, published in August 2022, found that rural theft had risen by 40% from the previous year, with the overall cost to the UK economy estimated at £40.5 million.
Quad bikes are predominantly manufactured by just two companies, with little technological development to the same basic key system they have had for over 35 years. I am reliably informed that it is possible to start up one of the most common makes and models of quad bike with just a screwdriver, and a quick Google search provides detailed instructions as to how to start these quad bikes without a key.
The theft of ATVs has a significant financial impact on both customers and insurers. As well as the financial impact, quad bike theft perpetuates further and wider criminal activity. On Second Reading, I spoke of a recent spate of quad bike theft-related crimes in my own constituency of Halifax. That includes their use in antisocial behaviour and vandalism. A number of hon. Members from all parties have made the point about vehicles, after their theft, being used in a variety of types of vandalism and antisocial behaviour afflicting communities, whether they are rural or urban.
As outlined, the Bill seeks to mandate the fitting of an immobiliser and forensic markings on all quad bikes and all-terrain vehicles sold in the UK. The Bill is relatively tight in scope, which is often the winning formula for a successful private Member’s Bill. However, it will also allow for the enactment of secondary legislation that could expand the Bill’s remit to cover other agricultural and construction equipment. Again, on Second Reading I spoke of the problem of theft from commercial vans—a point made by the right hon. Member for Chelmsford and others. According to research carried out by Volkswagen Commercial Vehicles in 2021, 27% of van drivers had fallen victim to tool theft in the previous 12 months. The total cost of all lost tools and equipment is estimated to be about £15 million a year. Volkswagen estimates that the associated downtime for drivers who must replace those tools costs £550 a day per van.
In conclusion, we very much welcome the opportunity to support the Bill through its passage on to the statute book. We hope that it makes the difference that we would all like to see, and we very much hope that there is a further opportunity to consider and evaluate its impact with regard to what other types of kit it might be appropriate to extend these protections to.
It is a pleasure once again to serve under your chairmanship, Mr Bone. Let me start by expressing my very warm congratulations to my hon. Friend the Member for Buckingham on the work that he has done in developing and bringing forward this Bill with a great deal of conscientiousness, perseverance and, most important of all, charm. That is a quality not universally present, I have to say—[Hon. Members: “Oh!”] But it is certainly well represented by my hon. Friend the Member for Buckingham. He has done a very good job of talking the Committee through the operative provisions of the Bill, so I do not propose to repeat what he has already said so eloquently, other than to make it clear that the Government very strongly support these measures, for the reasons that hon. Members on both sides of the Committee have eloquently and powerfully set out. Clearly, agricultural communities the length and breadth of the United Kingdom are affected by ATV theft, and the provisions in the Bill will help us to combat that.
As my hon. Friend the Member for Buckingham said, the operative provisions of the Bill will be enacted via secondary legislation, so the principal thing that I would like to say is that work on preparing those regulations is happening at the moment. It is happening in parallel with the preparation of the Bill, so, as quickly as possible after commencement of the Bill, we will be able to bring forward the relevant statutory instruments to enact the provisions that we have been debating. That work is happening.
What I would mostly like to say, however, is that I have certainly heard the powerful opinions expressed on Second Reading, and again this morning in Committee, about a strong desire on both sides of the House to consider expanding the scope of the statutory instruments beyond just all-terrain vehicles to look at other agricultural equipment and also tradespeople’s tools. We have all had reports of often quite valuable tools being stolen from tradespeople’s vans. As hon. Members have said, that is not just a financial loss; it prevents tradespeople from working, sometimes for a number of days, which disrupts building projects and causes loss of earnings at a time when people obviously are struggling to make ends meet, so I am very powerfully seized of the need to look at that. I have asked Home Office officials to work on developing the statutory instruments to address it as well as doing the work on ATVs. That work is ongoing; they are doing the technical work to look at it at the moment, so I cannot make an absolute commitment that it will be done at the same time, but my starting position is that if we are going to bring forward statutory instruments under the Bill to deal with ATVs, why not do the other tools at the same time?
There may be some technical reason that I am not aware of why that is very difficult, but my starting position is that we should do both of them, or all of them, at the same time, later on this calendar year, so I will do whatever I can, as Minister, to try to make sure we do all of that. As I said, I am due to get some further advice on it, so there may be some technical elements that I am not aware of or some other arguments that get brought forward, but that is my intention, and it sounds like it has support on both sides of the House.

Commons ChamberIt is a genuine pleasure to follow the hon. Member for Milton Keynes North (Ben Everitt), who has shared some of his insight and expertise, having clearly spent a great deal of time working on a farm in a previous life—I am curious about the notion of Fabergé egg farms and the potential for expansion there. In all sincerity, I congratulate the hon. Member for Buckingham (Greg Smith) on bringing forward this private Member’s Bill and on comprehensively and convincingly setting out the case for it today.
Having considered the hon. Gentleman’s Bill and having listened carefully to his arguments, the Opposition are inclined to agree that his proposals would have a strong impact on mitigating against quad bike and all-terrain vehicle theft. That form of criminality has blighted rural and more urban communities for too long, either because of the initial theft or the illicit and antisocial use of such vehicles thereafter in constituencies across the UK.
As outlined, the Bill seeks to mandate the fitting of forensic markings and an immobiliser on all quad bikes and all-terrain vehicles sold in the UK, which would solve a specific problem. If enacted, the Bill provides the scope for those measures to be expanded further. It would be a welcome tool to support the police in deterring such thefts, finding stolen goods and supporting agricultural and land workers who need that kit to do their jobs and undertake the incredibly valued work that has been discussed.
Rural crime has been a priority. My hon. Friend the Member for Croydon Central (Sarah Jones), who is a fellow shadow Home Affairs Minister with responsibility for policing, has visited a number of rural crime initiatives, such as Operation Hawkeye in Northumberland, where efforts to disrupt poaching recovered £850,000-worth of property and arrested 65 people. From my experience of my Halifax constituency, which takes in urban and rural areas, quad bike and all-terrain vehicle theft and subsequent misuse is a massive and sustained challenge.
Last month, I was frustrated to hear that Todmorden junior football club, just down the Calder valley, was subject to a serious act of vandalism. One of its pitches was left badly scarred and unplayable by someone repeatedly driving a quad bike over it. Louise Leeming, the club’s welfare officer, said:
“They’ve completely trashed it, you can’t play on it. The council spent an absolute fortune repairing it and they”—
the vandals—
have just destroyed it.”
At a time when council funding is, frankly, being decimated, it is reprehensible that an individual would flagrantly seek to damage a much-needed facility for local children.
That is just the tip of the iceberg, however. Locally, in October, as part of Operation Heelfield, officers executed a section 26 warrant to arrest a Halifax man on suspicion of burglary after a recently stolen Yamaha Kodiak quad bike was found in his garage. In March, two quad bikes were seized by police after two males, who had been involved in using them antisocially, had abandoned them. That formed part of Operation Hedgeson, which was carried out by the Halifax neighbourhood policing team to pursue, catch and convict those responsible for causing a nuisance in our communities through their antisocial and dangerous behaviour on and off the roads with such quad bikes and ATVs.
Unfortunately, such stories are not surprising and occur far too often. According to statistics released by NFU Mutual, in 2021, West Yorkshire had the third-largest number of quad bike thefts in the country. As the hon. Gentleman said, estimates suggest that nationwide, between 900 and 1,200 quad bikes are stolen every year, and many end up circulating back on to the market in some way. An NFU Mutual crime report estimated that in 2021, rural theft cost the UK £40.5 million.
I am sure that hon. Members will join me in paying tribute to our local policing teams, who work incredibly hard to try to get ahead of the criminals in getting a grip on and tackling this problem, but they simply do not have the requisite resources or toolkit to completely clamp down on such crime. The Bill, if introduced, would be a formidable starting point, but there are no two ways about it: the underfunding and under-resourcing of our police forces have undermined their capabilities for more than a decade. Analysis carried out by the Labour party, which studied the budgets of all 43 police forces in England and Wales, found that, in 2021, police budgets were £1.6 billion down in real terms on when the Conservatives came to power in 2010. In August this year, the National Police Chiefs’ Council said in a statement that crime detection and charge rates had dropped following austerity measures and a fall in police numbers since 2010. Its spokesperson said:
“Detection and charge rates for a range of crimes have fallen over the past five years.”
The shadow Minister is talking about policing figures and theft. Would she like to join me in welcoming the fact that, since March 2010—when Labour left office—theft figures have fallen by 46%, according to the crime survey for England and Wales, from 4.99 million theft offences to 2.69 million?
I would be really interested to see the details of those figures. I am sorry to say that detection rates, charge rates and prosecution rates are all going in the wrong direction under this Government. I gave a quote from the National Police Chiefs’ Council. If the Minister wants to take that up with the council, he can certainly do that. Its spokesperson said:
“Detection and charge rates for a range of crimes have fallen over the past five years…This has been impacted by austerity and the loss of thousands of police officers and staff, increasing complexity of policing and crime, growing demand related to mental ill health and impact of backlogs in the court system.”
I am grateful to the shadow Minister for giving way again. I suppose she will not get many interventions from her own side, looking at the empty Opposition Benches, so I am happy to fill the gap. She mentioned police officer numbers. Would she like to join me in welcoming the fact that, come March next year—just four months’ time—when the police uplift programme is completed and 20,000 extra officers have been recruited, we will have about 149,000 police officers, which is more than at any time in the country’s history?

It depends on market prices, as I say. Lacking any clairvoyance about where prices may move in the future, it is not possible to make an assessment not knowing where prices will be in a fast-moving market. I repeat that the volume of gilt purchases by the Bank of England have so far been a great deal below the ceiling that was set out.
The Resolution Foundation’s chief exec, Torsten Bell, told the Treasury Committee this morning, “This is what happens when you are not paying attention.” He said that the Government’s proposals would not have been a good idea at any time but, “You definitely shouldn’t be doing it in the current climate.” Our constituents need the Government to pay attention. Where is the plan to stabilise the economy now and stem the ongoing damage the mini-Budget continues to cause?
The growth plan protected the hon. Lady’s constituents and mine from what could have been £6,000 or £7,000 energy bills this winter. Frankly, I think they will welcome that. The growth plan will lay the foundations to continue the G7-leading growth we experienced last year and this.

Commons ChamberThe closure of the barracks would be made a lot easier if more councils in Scotland—other than only Glasgow—would accept dispersed accommodation. That is the sort of thing that puts pressure on our accommodation estate. Thanks to the generosity of our approach, the number of people we are accommodating has gone up from 48,000 to 61,000 during the pandemic, because we have taken a thoughtful and protective approach. That is the right thing to do and we stand by it.
On Napier barracks, the equality impact assessment makes it clear that the use of disused barracks as asylum accommodation is absolutely a political choice. The Government have consistently refused to confirm the numbers of those who contracted the coronavirus while staying at Napier barracks, but I understand that, out of around 400 people, 105 who did not have the virus were moved out, leaving us to draw our own conclusions about just how massive an outbreak took place there. Does the Minister not agree with me and others that the use of barracks as asylum accommodation has been both a moral and public health disaster and that people must be moved into dispersed accommodation as a matter of urgency?

On the first question, about the asylum track, after somebody arrives—having come, we believe, from a safe country where they could have claimed asylum—and if they are declared inadmissible, we will seek for a short period to get the agreement of that other country to return them there, where their asylum claim can be substantively and properly considered. If that is not possible, the asylum claim will of course be substantively and properly considered in this country.
My right hon. Friend asked some questions about our asylum system more generally—I think she was in some way seeking to insinuate that it was not reasonable or fair. The accommodation that we provide is reasonable and good, and there are 60,000 people currently being accommodated.
In terms of our system more widely, last year we made 20,000 grants of asylum or other forms of protection—that is a very high number. We welcomed and received more unaccompanied asylum-seeking children last year than any other European country, including Greece. Over the last five years, our resettlement schemes have seen 25,000 people taken directly from conflict zones and resettled in the United Kingdom—more than any other European country. After the 232 remaining people have come over, we will continue with resettlement, as far as we are able to, given the context of coronavirus and everything else. I therefore think we have a proud record of helping people who are genuinely in need.
My right hon. Friend asked about safe and legal routes. In addition to what I have described, last year over 6,000 people came into the UK under the refugee family reunion routes, which of course continue to exist.
The purpose of these changes is to prepare us for life after Dublin, and it is quite right that we make preparations, but at the heart of this is a desire to dissuade people—indeed, prevent people—from making unnecessary and dangerous journeys, particularly across the English channel, endangering their own lives and feeding ruthless criminal people smugglers, and all for no purpose, because France is a safe country where asylum can easily be claimed, as are the other European countries these migrants have travelled through.
My right hon. Friend asked about future agreements. She referenced France, and we are of course in close dialogue with France—we have a very close and friendly relationship. We will also be entering into discussions with other countries, including some of the ones she mentioned, as soon as the current European-level negotiations are concluded. These rules lay the foundations for those future discussions and negotiations, but most of all they will deter dangerous and unnecessary journeys, and I hope the House will join me in supporting that objective.
I thank the right hon. Member for Romsey and Southampton North (Caroline Nokes) for securing this urgent question and for the incredibly important points she made, not least in relation to asylum accommodation.
As we have heard, these changes will allow a claim to be found inadmissible if someone has had the opportunity to claim asylum in another safe third country prior to claiming asylum in the UK. That is not dissimilar to the current arrangements under the Dublin III regulations that we have in place with our European neighbours, but which will cease at the end of this month. We are leaving the Dublin III regulations, so this change allows the Government to deem a claim inadmissible without any co-operation or agreement in place to facilitate returning the person concerned to a third country. This is an unworkable half-plan, being introduced by the back door as changes to the immigration rules, with no opportunity for proper parliamentary scrutiny.
On Monday, the Minister outlined that it is this Government’s intention to open discussions with those countries as soon as we are able to do so. Can he confirm that those talks are yet to start and that there will be no such arrangements in place by 1 January, when these changes come into effect? Will he clarify what a person’s rights will therefore be in the period between their claim being found inadmissible and a returns agreement being reached?
The changes also suggest that an asylum claim can be reinstated after a reasonable period of time, if another safe country is unable to admit that person. How long is “a reasonable period”? Further still, as the Minister has confirmed, these changes will allow someone to be removed to any safe third country, including countries that the person has never been to and has no connection with. How does he envisage that that could possibly work in practice?
The changes before us come into effect in less than a month’s time. The Minister must realise the widespread concern about leaving some incredibly vulnerable people in limbo, at risk of homelessness and destitution.
Let me reassure the shadow Minister on one or two points. She concluded her questions by asking about the risk of destitution. To be clear, if somebody who is in the inadmissible cohort is unable to make provision for their own accommodation or upkeep, they will be eligible for accommodation in the normal way, just as people currently in the Dublin third country cohort, awaiting return to a European country, are accommodated and supported. There will be no risk of destitution, which would of course infringe their article 3 rights were it ever to happen.
The hon. Lady asks about the status of people who may fall into that cohort. Clearly, the intention is that a period of time will pass when we seek the agreement of a third country to return them. That will happen within a reasonable time—we will set that out in guidance, but it will be a matter of a few months; it will not be a long time. If, after that reasonable time, no agreement is forthcoming, their asylum claim will be substantively considered here. There will not be any extended period of limbo, which I do not think would be in anybody’s interests.
The hon. Lady refers to the fact that these arrangements are in some regards similar in concept to Dublin. I hope the House will take from that that they are reasonable in spirit, because no one has objected to the principles that underpin the Dublin regulations—indeed, many people have pointed to them as exemplars.
Finally, the message all of us in this House should be sending out, the Opposition Front Bench included, is that if somebody is in continental Europe and they feel they have a protection claim that needs to be heard, they should not attempt a dangerous crossing of the English channel. They should not pay money to ruthless people smugglers. They should use the very well-functioning asylum systems in our very civilised European neighbours. Let that message go out from this House today; it will save life.

My hon. Friend, as always, puts it very well. Of course, when people come to this country as immigrants and make a contribution—to academia, to the work environment, and in myriad other ways—we welcome them with open arms. Our new points-based system, which will become active in just a few days’ time, does precisely that. However, as he says, if somebody comes to this country and enjoys our hospitality, but abuses that hospitality by committing a serious criminal offence, they can, should, and will be removed in the interests of public protection.
I first pay tribute to my hon. Friend the Member for Streatham (Bell Ribeiro-Addy) for having secured such an important and time-critical urgent question. I also pay tribute to my right hon. Friend the Member for Tottenham (Mr Lammy) for his previous work and advocacy in this important area.
The news of this flight comes just days after the Equality and Human Rights Commission found that the Government, as we have heard, acted unlawfully in their treatment of the Windrush generation through the hostile environment. As Caroline Waters, the chair of the EHRC, said,
“The treatment of the Windrush generation as a result of hostile environment policies was a shameful stain on British history.”
There is no clear timetable for implementing the recommendations of the Wendy Williams report, and with just 12% of applicants having received a payment and at least nine people having died waiting, the Windrush compensation scheme is failing badly. In his written response to me over the weekend, the Minister said that it is wrong and offensive to conflate this returns flight with the Windrush scandal, but I am afraid that given this Government’s track record, their failings on Windrush and the delays in the compensation scheme, we simply have no faith that this Government have done their due diligence in relation to those on this scheduled flight, and we would not be doing ours if we did not ask the questions.
Of course, we recognise that those who engage in violent and criminal acts must face justice. However, we also hear that at least one person on that flight has a Windrush generation grandfather; there is another whose great-aunt was on the HMT Windrush, and another whose grandfather fought in the second world war for Britain. It is clear that we have not yet established just how far the consequences of the Windrush injustice extend. With that in mind, what assessment has been made to ensure that none of those scheduled to be on the flight are eligible under the Windrush scheme, or have been affected by the wider immigration injustices that impacted the victims of the Windrush scandal? What assurances can the Minister provide the House that the mandatory duty to safeguard and promote the welfare of the children left behind, who are innocent in this, has been considered?
It has also been reported that the Home Office has reached an agreement with the Jamaican Government that people who left Jamaica as children will no longer be repatriated. Can the Minister confirm whether this is the case, and can he also confirm what age someone would need to be to have been determined to be a child?
The hon. Lady, the shadow Minister, asks about the Windrush scheme. As she will be aware, over 6,300 people have now been given citizenship, quite rightly, and 13,300 documents have been issued to those people who suffered terrible wrongs in the past. In terms of compensation, 226 people have now received claims totalling in excess of £2.1 million, with a great deal more to pay out. I can also confirm that all of these cases on the plane have been individually assessed, and none of them is eligible for the Windrush compensation scheme.
The hon. Lady spent a great deal of time talking about Windrush during her question, but I say again—as I said in my letter to her—that it is completely wrong to conflate the people who were the victims of terrible injustice in the Windrush cases with these cases, who are nothing to do with Windrush, have no Windrush entitlement at all, and have committed terrible criminal offences. She also asks about the age eligibility. The Government are fully committed to discharging their obligation under the 2007 Act, which is to seek to remove anyone of any age who has been sentenced to a custodial term of over 12 months. That has been, is, and will remain our policy.
I am not going to comment on the individual operational circumstances surrounding any particular flight, but we are fully committed to the 2007 Act’s provisions. In relation to children, there is a well defined test around family rights and how they interact with removal. It is possible for people to go to the courts if they want to test their family rights against the Government’s obligations to remove them. But we are clear that our priority is protecting British citizens from dangerous criminals, and that is what we are doing.

Commons ChamberI have been speaking very regularly to people working with asylum seekers in Glasgow. Just last week, I spoke to Aileen Campbell, the Communities Secretary, and I have spoken—I think twice now—in recent weeks to the leader of Glasgow City Council. We are doing a great deal of work with those providing services to asylum seekers in Glasgow. We have managed to reduce the number of people accommodated in hotels from over 400 to about 200. It is regrettable that Glasgow City Council still has 600 people in hotel accommodation.
I am eternally grateful to you for calling me, Mr Speaker. On 1 October, the shadow Health Minister and I wrote to our counterparts in Government asking why it was taking months to process the one-year visa extensions promised to healthcare workers, leaving them without their biometric residence permits, which is exposing this country’s heroes to the hostile environment. We have not had a response to that letter, so I will ask again: now that we are in a second national lockdown, why was the visa extension scheme closed at the start of October and why are the permits taking so long to process, only compounding the pressures on healthcare professionals rather than alleviating them?

I was about to come to that point. I heard the right hon. Gentleman make that point in his speech. He had seen evidence saying that the data was held, but it had not been provided. That is another action for me to take away from this afternoon’s proceedings. I will go and ask that question about the data relating to in-country visa applications. According to the letter that he referred to, the data is held, so I will endeavour to ferret it out. It might sit in the portfolio of the Under-Secretary of State for the Home Department, my hon. Friend the Member for Torbay (Kevin Foster), but I will certainly make inquiries in that part of the Home Office. If I am able to ferret out the information, I will certainly get back to the right hon. Gentleman. I will take that away as an action from this afternoon as well.
Finally, quite a few comments were made about coronavirus and our response to it. Clearly, everybody has access to the health service for coronavirus-related treatment. The shadow Minister asked whether the NRPF cohort are eligible for the payment if they have to self-isolate. I believe it is £500?
I do not know the answer to that question, but I will go away and find out because it is a very reasonable question to ask. More generally, people who are subject to NRPF are eligible for things such as the coronavirus job retention scheme, the self-employed income support scheme, and the support given to people on zero-hours contracts, based on their previous income. Those funds are not classed as public funds. Those are available to everybody, including the cohort mentioned today.
Local authority funding has been referred to a great deal. It has been denigrated as “cost shunting” and as being a small amount, but it is £4.3 billion, which, even by the standards of public spending, is a pretty significant amount of money. It covers more than just NRPF cases—I understand that—but it is none the less a very large amount of money, much of which has found its way to supporting NRPF cases. A case mentioned by one Opposition Member ended up being helped in that way. We can debate whether it is cost shunting or whether that is the best way of administering it, but local authorities often have the best knowledge about how to help people in their local areas. We might debate the nature of that safety net, but what cannot be gainsaid is that that safety net—that £4.3 billion to local authorities—does exist. It is there and it does help people. For those with children, which applies in all of the cases we have heard about this afternoon, there is a route to lifting—

Commons ChamberWe have fulfilled our Dubs obligation in full: 380 unaccompanied asylum-seeking children have been brought to the UK from European countries, in addition to 3,500 who came here last year. That is higher than any other country in Europe. In addition to that, we are honouring our Dublin obligations to Greece. It is not 16; well over 100 people have been taken from Greece directly back here. Where we have further obligations, we will do everything we can to make sure we meet them. In addition to that, as I said in response to an earlier question, the Foreign, Commonwealth and Development Office is looking at ways that we can help to provide the kind of shelter that the hon. Lady referred to. There is a lot that the Government have done and will continue to do. If she would like to meet me to discuss that, I would be delighted to do so.
I understand that on 15 September partner agencies were notified that the Home Office was lifting a ban on asylum evictions with immediate effect. I appreciate that the pause in the system cannot continue indefinitely. However, to evict people into destitution and homelessness as we enter a second wave of infections completely undermines public health efforts to keep everyone safe from the virus, especially in areas like mine that have local restrictions in place. Can the Minister share with us the plan to ensure that these risks do not become a reality?
As the shadow Minister says, on 27 March we paused cessations whereby people leave asylum accommodation when their decision is made positively or negatively. On 11 August, we resumed those for positive cases where they have been granted asylum, in a very phased, very careful, week-by-week, step-by-step way, moving them, where necessary, into local authority and other kinds of accommodation. We are now just beginning the process for the negative cases where asylum has not been granted, because clearly we cannot accommodate people at public expense indefinitely when their asylum claim has been rejected. We are doing this in a very careful, phased, week-by-week way to make sure that the sorts of risks that she describes do not come to pass. Where there are safe routes home to the country of origin for people whose claims have been rejected, we are working to make sure that those safe routes home are taken.

I thank my hon. Friend for his question, and he is right. Some asylum claims are meritorious—obviously, many are—and we should work quickly and humanely to grant those applications and offer help on integrating into UK society. But where there are meritless asylum claims, we need to make sure those are equally identified and rejected quickly, because it is unfair on the British public as a whole and on genuine asylum claimants if unmeritorious claims take up too much time in our system.
Let me start by thanking the hon. Member for Glasgow Central (Alison Thewliss) for securing this important urgent question and the Minister for his initial response. Once again, I wish to pay tribute to the extraordinary bravery and dedication of our emergency service workers. I know that the whole House is united in sending our gratitude to PC David Whyte and our best wishes for his recovery, just as we send our best wishes for the recovery of all those injured in this tragic attack. PC Whyte was part of a policing team who responded quickly and skilfully to keep people from danger, and he and his colleagues will have our heartfelt admiration and respect. Working alongside our magnificent NHS, they were able to save lives on Friday, but this worrying incident clearly poses a number of serious questions.
We are sympathetic to the speed with which additional accommodation has had to be sought for asylum seekers, at different stages of the asylum process, in the interests of public health going into lockdown. However, this tragic attack is an important reminder of why it is vital to deliver the correct, balanced approach to housing and related support services for asylum seekers, as well as supporting the wider community. As a result, there are a number of questions I would like to ask the Minister.
At the weekend, the Home Secretary suggested that this type of accommodation had been allocated because of the covid-19 crisis. However, we know that there is an ongoing problem, which predates the crisis, of people having been housed in what is deemed to be “initial accommodation” for prolonged periods before being moved into more appropriate dispersal accommodation. Can the Minister clarify how many asylum seekers are in initial accommodation compared with the number in dispersal accommodation across the country? Will he update the House about the duration of stays for asylum seekers at the Park Inn hotel in Glasgow? Will he share with the House what vulnerability and risk assessments the Home Office and service providers are currently conducting when placing people in asylum support accommodation, in order to ensure that people have the support they need, including access to mental health support? Finally, what work is being undertaken to identify the risk factors that could have been spotted in this attacker, and how will that change future practice?
I thank the shadow Minister for her question. I should take this opportunity to welcome her to her place, and I look forward to many exchanges across the Dispatch Box in the months and, perhaps if we are lucky, years ahead. She asked about the numbers of people being supported in asylum accommodation. We currently have 44,000 people being supported under section 95 of the Immigration and Asylum Act 1999 and some 4,000 people being supported under section 4; pre-coronavirus, we had about 48,000 people supported. The number has increased dramatically in the past four or five years—it has almost doubled in that period—so we are growing our asylum accommodation estate in order to cater for that growth. Of course, we are trying to get people into dispersed accommodation—the more stable accommodation—as much as we can. As my hon. Friend the Member for Newcastle-under-Lyme (Aaron Bell) alluded to in the previous question, the more we can make sure we can look after meritorious claims quickly but dismiss unmeritorious claims, the less pressure there will be on asylum accommodation in the first place.
Every asylum seeker is subjected to a risk assessment, on health and on other grounds, at the point of receipt into the system. I do not want to comment too much on this individual’s case, but when he first made one of his asylum claims—he made two—he flagged a health vulnerability, but it was a minor physical vulnerability, not anything that could have had anything to do with what happened on Friday. I assure the hon. Lady that those assessments do take place and there are round-the-clock facilities for asylum seekers to report any health or any issues that they may have.
