Commons ChamberIt is clearly a very serious matter when one of our number is found in contempt of the House, and no one can or should take any pleasure in the report that we are debating this evening. However, in light of what has just been argued by the hon. Member for Stone (Sir William Cash), it is important that we remember that the revelations about the parties at 10 Downing Street, and they were parties, caused many people a great deal of anger and distress. They saw what went on there and contrasted it with what they had done in faithfully upholding the rules and guidance as they understood them, at great personal cost—above all, when they were not able to be present as their loved ones breathed their last—and they have the right to be angry about what happened.
That is why we asked the Privileges Committee to look into what happened and what we had repeatedly, if I may use the word, been told by the Prime Minister. Having looked at the evidence, our colleagues—we are talking about our colleagues here, on both sides of the House—formed their judgment, and I think we have a duty to accept their report and what they have found. That point was made forcefully in a number of speeches, not least by my right hon. and learned Friend the Member for Camberwell and Peckham (Ms Harman) and the right hon. Member for Maidenhead (Mrs May).
Why should we do that? First, because we traditionally accept reports of the Privileges Committee, because it did give Mr Johnson every opportunity to explain what he said and why he said it, because it was a cross-party group of MPs, as the Privileges Committee always is, and because its conclusions were unanimous. That is why to suggest there was some sort of conspiracy—I am sorry that one or two Members have veered in that direction in this debate—by one party or certain people to do down the Prime Minister is frankly implausible and insulting to this House.
What is more, I agree with the Committee that Mr Johnson’s behaviour following the receipt of the draft report and since it was published, and the public attacks he has made on the integrity of the members of the Committee, their report and its findings, have been, to put it mildly, distasteful and certainly egregious. They have only compounded the contempt he has committed against this House.
To address the argument that has been put about whether people can criticise the report, it is one thing to argue one’s case, to be found against and then to disagree with the findings. Everyone is entitled to do that, and to cast their vote accordingly this evening. It is completely another to call the whole process and those involved in it into question, to accuse them and the report of being “nonsense”, “beneath contempt”, “rubbish” and “deranged”—those are the words that have been used—especially when it is a blatant attempt to undermine the very democratic system we are sent here to uphold. As has already been said, when the Committee is attacked for doing its job by a Member, now a former Member, it is us as MPs who are also being attacked.
The other thing that worries me about this situation, and I think it should worry all of us, is that the type of conduct we have seen from Mr Johnson is all too reminiscent of what is going on as we speak on the other side of the Atlantic ocean. People look at what he has said and done here and what Mr Trump is doing over there, and they see the similarities. Here are two people who are trying to trash our institutions and our democracy in the process. That is very different from expressing disagreement with the judgment of the Privileges Committee.
Why does this matter? The word has already been used many times in this debate, but it is about trust. I think the Committee summed it up perfectly when it said:
“The House proceeds on the basis that what it is told by Ministers is accurate and truthful…Our democracy depends on MPs’ being able to trust that what Ministers tell them in the House of Commons is the truth. If Ministers cannot be trusted to tell the truth, the House cannot do its job and the confidence of the public in our democracy is undermined.”
Let us be honest with ourselves: there is no doubt that the public’s confidence in our democracy, and in us as politicians, has been damaged by what has gone on. Therefore, this is our chance to show that we too think that telling the truth to the House of Commons matters and that we as a House are collectively determined to uphold that fundamental principle, however high and mighty a Member may have been. To agree this report today will not be proof of the shortcomings of the process or of our democracy or the way in which we work; on the contrary, it will be to uphold its integrity and its strength.

Commons ChamberI am sure the whole House will join me in expressing our deepest sympathies to Sara and David and our admiration to them for turning what must have been this most appalling tragedy into some positive action to benefit other families. The hon. Lady will know that across Government we are very focused on ensuring that people are able to cope not just with their own ill health or fluctuating conditions, but when they are caring for another or their child is ill. I shall certainly raise this matter with several Departments that will have an interest and ask that they make Ministers available to meet the family when they come to Westminster.
Further to the question asked by my hon. Friend the Member for Lewisham West and Penge (Ellie Reeves) a moment ago, the Leader of the House knows that there is an affordable housing crisis in this country, in significant measure because of the catastrophic decline in the number of council houses. Leeds has 26,000 people on the waiting list, more than 5,000 of whom have the very highest priority—they need to be urgently rehoused. Given the lack of support announced in the Budget yesterday, will the Leader of the House encourage the Levelling Up Secretary to come to the House to make a statement about what the Government are going to do to build more homes that our constituents can actually afford to rent?
The right hon. Gentleman touches on an issue that affects both social housing and affordable housing. He will know that more than 2.2 million additional homes have delivered since we came into power, including more than 632,000 affordable homes, and that the annual housing supply is up 10% on the figure for the previous year, with the third-highest yearly rate in the past 30 years. Blockages are occurring to developments that have been planned for and where sites have been identified. There are lots of reasons for that, but one is a lack of capacity in planning departments. I know that the chief planning officer at the Department for Levelling Up, Housing and Communities is very much looking at this issue to see what we can do to build capacity in local authorities, so that we can get on with these developments and give everyone a warm, safe, secure home.

Commons ChamberI thank my right hon. Friend for raising that point. I am sure that the Secretary of State will have heard it, and I will make sure that he is aware of the matter, which is an immediate issue for my right hon. Friend’s constituents. I understand that the results of the next round of funding will be announced shortly. I encourage him to look at central funding and to ensure that the organisation has registered with the particular tool that pulls together all possible other sources of funding, but I will write to the Department and make sure that it knows that this is a very pressing matter for his constituents.
Following this morning’s shocking report from Citizens Advice that more and more people are being disconnected from their gas and electricity because they have been moved on to prepayment meters, often without their knowledge, and cannot afford to top them up, when will we have a statement from the Government about their intention to ban this practice so that our constituents do not lose their right to light and warmth?
I thank the right hon. Gentleman for raising this important issue. It is one of a number of issues that have been identified both by the Government and by organisations such as the Centre for Social Justice in its work on what it calls the “poverty premium”—additional costs and obstacles that are causing people to be disproportionately impacted by the cost of living crisis. I shall certainly write to the relevant Department about the specific issue that he raises, and I think it would be a very well supported debate.

I agree, so will she explain why the Prime Minister is still in office when it is clear to almost everyone, including many of the colleagues of the Leader of the House behind her today, that she is no longer in power?

Commons ChamberMay we have a statement from the Health Secretary on when the go-ahead will be given for the construction of the new Leeds children’s hospital and adult hospital buildings? The Government have repeatedly expressed support for the project, the site will be cleared by the end of the month, and Leeds Teaching Hospitals NHS Trust is raring to go with a project that will bring not only world-class health facilities to my constituents, but wider economic benefits in the form of jobs for the city.
I celebrate the right hon. Gentleman’s enthusiasm for the Government’s investment in the health service. I am sure that the Health Secretary will be able to respond directly to his question about the timetable during Health questions next week, but the Government are committed to building 40 new hospitals, and I am sure that Leeds is a huge part of that investment programme.

Gentleman has expressed his views with great force, but I am sorry to say that he is in violation of the convention relating to the business statement in the way that the Leader of the House said was true of the right hon. Member for Leeds Central (Hilary Benn) the other day, as a consequence of which no response to the question is required.
Can the Leader of the House confirm that the withdrawal agreement Bill that is about to be published will disapply the requirement under the Constitutional Reform and Governance Act that any treaty must be laid before the House for 21 days before it can be ratified?
The right hon. Gentleman has done exactly the same, Mr Speaker.

Commons ChamberMy hon. Friend raises an important issue every week for the Government to consider. The Government’s careers strategy was published in December 2017. It contains a number of proposals to improve careers advice for pupils with special educational needs and disabilities, including funding for the Education and Training Foundation to provide professional development for practitioners working with these young people; funding for training and materials for post-16 providers to help them to design and tailor study programmes that offer a pathway to employment for these learners; and training for enterprise advisers so that they are confident in helping people with special educational needs and disabilities. I believe that what my hon. Friend asks for is being provided and will continue to be provided—and it is important that it is provided.
Can the Leader of the House confirm that the Government’s own economic assessment of a free trade agreement with the European Union shows that it would lead to the second-worst outcome for the economy after no deal and would, as Her Majesty’s Revenue and Customs reported recently, result in British businesses spending £15 billion a year on filling in forms that they do not have to fill in today? Since he has just extolled the virtues of allowing the Northern Ireland Assembly to decide whether it wants to change its mind about the deal that has been agreed, why is he so opposed to the British people deciding whether they want to change their mind on the deal whose virtues he has just extolled before the House? I have to say that this is not a culinary delight; it is really bad for the future of our country.
The right hon. Gentleman has not asked for a debate, an Adjournment debate or a statement. His question is therefore irrelevant.

Commons ChamberThe wisdom of a former Chief Whip is very considerable, and I shall ensure that that point is passed on to the Prime Minister’s adviser.
A moment ago, the right hon. Gentleman expressed confidence that the free trade agreement that is now the centrepiece of the political declaration could be negotiated between now and December 2020. Can he confirm to the House that if that proves not to be possible, it would be a no-deal Brexit—in effect, a hard Brexit—from 1 January 2021? We would be leaving the EU at that point on WTO terms, which the House has explicitly rejected in passing the European Union (Withdrawal) (No. 2) Act.
These are the matters that will be discussed if we pass the motion to sit on Saturday, so I think we are getting slightly ahead of ourselves in trying to go into the details of the debate. Much though I should like to be the one dealing with that debate, that will belong to higher authorities than me, who will I am sure welcome questions from the right hon. Gentleman.

The European Council is scheduled for Thursday and Friday, and the events to which he refers may come late on Friday evening. I have a very practical question: how does he propose to inform the House whether we are sitting at 9.30 the following morning?
If the right hon. Gentleman had not set a foolish date in his surrender Act, there would not be this problem.

Commons ChamberI will give way to the hon. Member for Bradford West (Naz Shah), but she is trumped, momentarily, by the Chair of the Brexit Committee.
I am extremely grateful to the Leader of the House for giving way. Now that Mr Speaker has made it clear that there is nothing at all irregular about his acceptance of this motion, and given that the Leader of the House accepts, as I presume he does, that the House is in charge of its own procedures, how can there be anything constitutionally irregular in the House choosing—if it passes the motion and then the Bill tomorrow—to instruct the Government that there is an outcome to the Brexit negotiations that it is not prepared to accept, which is leaving without a deal on 31 October?
The right hon. Gentleman conflates irregular and improper. The motion is unquestionably irregular, even though it is not improper—the two are different concepts, as I am sure he fully understands. It is of course for the House to regulate its own proceedings, but a fundamental principle of our constitution is that the Government command the confidence of the House. [Interruption.] Ah! From a sedentary position an hon. Gentleman says that the Government do not. Now, that is the lock that would undo this constitutional conundrum, because the House dare not say that it has no confidence in the Government—it is frightened of that—and therefore it tries to take away confidence on specifics while maintaining confidence in the generality. That is not a proper constitutional position to be in.
