That this House has considered the current situation in Yemen.
I am extremely grateful to Mr Speaker for granting this debate. There is rapidly rising concern in Britain about what is happening in Yemen and the part that Britain is playing in this crisis. There is deep concern that an almighty catastrophe of biblical proportions is unfolding in Yemen before our eyes, and a considerable fear that Britain is dangerously complicit in it.
I had the opportunity, thanks to Oxfam and the United Nations, to visit Yemen early this year, and I am most grateful to the Saudi Arabian authorities for facilitating that visit. I think I remain the only European politician to have visited Sana’a and the northern part of Yemen in the past three years. I want to pay tribute to the extraordinary work that the humanitarian agencies and the UN are carrying out, particularly the work that Jamie McGoldrick and his team at the UN are so brilliantly doing in almost impossible circumstances.
I returned from Yemen deeply concerned at what I had learned and seen, and I expressed my concern to both the Foreign Office and the British Government privately, and to the Saudi authorities, courtesy of His Excellency the Saudi Arabian ambassador. I regard myself as a friend of Saudi Arabia, albeit a candid one. Like many, I have great respect for the domestic reforms and modernisation currently in progress in the kingdom, which are being led by the Crown Prince, Mohammed bin Salman.
My visit to Yemen enabled me both to spend time with the humanitarian agencies and to meet the Houthi leadership, the former President of Yemen Ali Abdullah Saleh and those currently leading what is the largest political party in Yemeni politics, the General People’s Congress.
I congratulate the right hon. Gentleman on securing this debate, and I join him, as I am sure the whole House does, in offering our thanks to the humanitarian workers. Does he agree that although the roots of this terrible war are deep and complex, there is absolutely no justification whatsoever for repeated blockades of the ports and the airports? The blockades are denying the long-suffering people of Yemen the food and medicine that they require, and as a result they are suffering grievously. There is a threat of famine, and people are dying of diseases, including cholera.
The right hon. Gentleman is right in every syllable of every word that he has just said. I hope to set out both the extent of the problems that he has identified and what I think the British Government can do to assist in their resolution.
I was talking about those I met when I was in Yemen and about the Houthis. There is an idea that persists that Yemen has been captured by a few thousand terrorists of Houthi origin who have stolen the country. This analysis is not only wrong; it is an extremely dangerous fiction. The Houthis are in complete control of large parts of the country, and together with their allies, the GPC, have established a strong and orderly Government in the north, particularly throughout the capital city of Yemen, Sana’a. They will not be easily shifted. The Houthis commit grave violations against the civilian population too, including forced disappearances and siphoning vital resources from public services to fund violence. But for most people in Sana’a, the only violence and disorder that they experience is that which rains down on them from the skies night after night from Saudi aircraft.
If my right hon. Friend gives me such an undertaking, I am happy to withdraw that very specific point.
I have never called for an arms embargo on Saudi Arabia, because the kingdom is surrounded by enemies and is wealthy. Saudi Arabia is absolutely entitled to defend itself, and we as its friend and ally are entitled to sell it weapons as long as we do so in accordance with one of the strictest licensing regimes in the world. We may also have some influence that we could exercise to ensure that weapons are used in accordance with the rules of war. I cannot help observing, however, that British munitions are causing destruction and misery in Yemen that the other limb of the British Government, to which I referred earlier, is seeking to staunch through aid and assistance paid for by the British taxpayer.
I have no doubt that, during her current visit to the middle east, the Prime Minister will use every political, economic and security argument available to her to persuade the Saudis of the moral and strategic failure that they are pursuing in Yemen. I profoundly hope that the lifting of the blockade on Yemen will be the No. 1 priority on her visit. We must use every inch of our leverage—diplomatic, political and economic—to demonstrate to our allies that they have more to gain from peace than from a fruitless military strategy that is exacerbating the world’s largest humanitarian catastrophe and undermining the international rules-based order that keeps us all safe.
I thank the right hon. Gentleman for giving way to me again, On the question of arms sales, given that the final report of the United Nations panel of experts on Yemen found that the coalition had conducted airstrikes in violation of international humanitarian law, and given the consolidated criteria—the rules governing arms sales from the United Kingdom—is there not a bit of a problem if the UK Government do not pause their sales, which is what I called for, along with the Leader of the Opposition, when I was shadow Foreign Secretary, since we have an obligation to see those claims investigated? Otherwise, is there not a risk that the sales will be in breach of our own law?
I agree that it is important for these incidents to be investigated, and investigated impartially, because otherwise the investigation will carry no credence.
I have completed the speech that I intended to make, but I think it worth adding that I have steered away from a debate on an arms embargo, because I think it would have taken our eye off the critical ball. We must see an end to this blockade, for humanitarian reasons and for reasons of international humanitarian law.
The answer to the last part of the right hon. Lady’s question comes from the investigations into incidents where there is legitimate concern that there may have been civilian casualties. That process was started by the coalition; it was not in place at the beginning. We have provided advice not only so that information can be given to us, but to assist in the process of ensuring that the coalition targets legitimate military targets. I understand that thousands of places have been deemed not to be targets. As in any conflict—this is one of the reasons why my right hon. Friend the Member for Sutton Coldfield was safe—there are indications of where attacks should not happen, and I believe that we have been part of the process of ensuring that the coalition understands the international rules of engagement.
I cannot directly answer the question about BAE Systems personnel being elsewhere as I just do not know the answer, but I have noted what the right hon. Member for Islington South and Finsbury said, and I will come back to that.
I want to move on to discuss the humanitarian situation, but I am of course happy to give way to right hon. Gentleman.
I am grateful to the Minister. Since the House understands the Government’s position to be that they do not feel there have been breaches of international humanitarian law, because they would otherwise have had to invoke the arms control criteria, and given that the UN panel of experts that I quoted earlier was of the view that breaches of international humanitarian law had taken place, will the Minister tell the House what other sources of information the Government have drawn upon in reaching their conclusion? Do they include the views of the military officers who are offering the advice that he has just described to the House?

Commons ChamberI am grateful to my hon. Friend for giving me the opportunity to congratulate RAF Brize Norton on its anniversary and all its achievements in tackling the consequences of the hurricane. Along with colleagues on the Government Benches, I used RAF services during trips to the region, and the station will continue to be absolutely vital to getting those areas back on their feet.
In view of the Foreign Secretary’s self-declared “ruthless consistency”, will he tell the House why he now thinks that we should accept the judgments of the European Court of Justice during the transitional period that the Prime Minister has announced the UK will now seek?
As the right hon. Gentleman knows very well, the implementation period that we have suggested is still under negotiation, so we will have to see the result of that negotiation. We do not know as yet whether our friends and partners will accept the suggestion of an implementation period. What we do know is that we have made a fair—we think reasonable—suggestion on money, citizenship, the Northern Ireland question, rights and privileges, and so on. It is now up to our friends and partners to decide how they will respond. If we are going to get on to that kind of question, now is the time for them to do so.

At the recent United Nations General Assembly, the High Representative of the European Union called a meeting of all the signatories who were available. As I said a moment ago, I represented the Foreign Secretary, who was attending a Cabinet meeting in the UK. There was a discussion about our respective positions. This was a known meeting, not a private meeting, so I can disclose the situation. It was an opportunity for all the parties—knowing that the United States was considering its position very carefully—to say what they thought about the deal, and all of them except the United States professed that they believed it was working and that they intended to continue it.
This was the first meeting between Secretary of State Tillerson and Foreign Minister Zarif, and it gave the two of them an opportunity to have an exchange about their respective positions. I have to say that it was one of the most enlightening conversations that I listened to. I thought that both of them were perfectly honest in relation to their concerns about their positions. The Secretary of State explained, as did the President in his statement, some of the background to the United States’ concerns, which Foreign Minister Zarif met.
The conclusion is that this was an agreement based not on trust but on distrust. That is why it was so painstaking, that is why it is so important, and that is why it needs to be adhered to. Making an agreement in these circumstances means that we must be very sure about commitments for the future, or about pulling away from them, if we are to build on that with the rest of the mistrust in the region.
As the right hon. Gentleman can already tell, the Government’s strong support for the deal is widely shared on both sides of the House. Does he agree, however, that among the consequences of President Trump’s announcement are, first, that it will undermine confidence in international agreements of this sort—and, as we have already heard, this agreement was painfully and painstakingly negotiated by many people including Baroness Ashton—and, secondly, that it will enable the less than moderate forces in Iran to say to the more moderate forces, “We told you that you could not trust the United States of America”, which is not in anyone’s interests?
The right hon. Gentleman speaks with great experience. Of course there is a risk that an agreement signed by one Administration and not followed through by another in its full terms will lead to exactly the consequences that he has described. In defence of its position, the United States has made it clear that the President was elected having said what he had said about the agreement, which had not been ratified by Congress, and he stands by that.
I think that we should focus less on what was said last week by one party to the agreement than on what is being said by all the other parties to it: that is, we recognise its importance, and we recognise the need to adhere to an agreement if it is working and is certified on all sides. It is the United Kingdom’s view, and that of all the other signatories bar the United States, that the International Atomic Energy Agency has certified that Iran is living up to its obligations under the deal, and that that is the basis on which we should work. Certainly, if we want to encourage others to sign deals that may not benefit all elements of a regime, adhering to a deal is extremely important.
The right hon. Gentleman is right to recognise that there are different voices to be listened to and different voices that speak in Tehran, and it is essential for us to be cognisant of that before we take any particular action.

In March, the Foreign Secretary said that leaving the EU with no deal would be perfectly okay. Last month, however, the Chancellor of the Exchequer said that that would be a very, very bad outcome for Britain. Given that the two positions are clearly completely contradictory, who should the British public believe?
I think that what the British public can take from both the Chancellor and myself—and, indeed, from the vast majority of Labour Members, as I understand their position—is that we all want to get on and do the deal, to do the best deal possible, and to leave the EU.

Commons ChamberMy hon. Friend is absolutely correct. I mentioned that earlier. Peace is very much the desire of the peoples in the areas concerned, but the awkwardness is how to get there. I have said before from the Dispatch Box that there are always 100 reasons to say no, but we have to find the reasons why people should say yes.
I can think of no one better to do so than the right hon. Member for Leeds Central (Hilary Benn).
I am grateful to the Minister for giving way; like everyone else, I am pleased to see him back in his rightful place. We have just been debating Northern Ireland, the history of which has taught us that courageous political leadership and a willingness to compromise are absolutely essential to progress. Does he share my view that the absence of such courageous political leadership on all sides in the current Israel-Palestine conflict is the biggest obstacle to bringing about the peace that we all wish to see?
I think that the right hon. Gentleman suggests that there is a gap into which courageous leadership should come. It is certainly true that for every courageous step taken, there are issues that pull people back, which may demonstrate that a courageous position might not be well enough rewarded. Leaving Gaza, for example, has not brought the swap of land for peace that the Israeli Government intended when they left. Courageous acts sometimes do not occur because they may make the situation worse. The outside world needs to assist in the building of trust, so that those courageous acts can be taken. There are examples from both sides of where leaders have been prepared to take courageous acts, and that is what the situation calls for.

Commons ChamberI entirely agree with my hon. Friend that we should be clear that our quarrel is not only with Bashar al-Assad, but with others in his regime. It will be possible to sketch out a route map to show how we can keep the institutions of Syrian government and yet get rid of the most murderous elements of the regime. We need to be getting that idea across clearly in the next weeks and months.
On North Korea, I am sure that my hon. Friend’s words on the need to avoid ratcheting up the rhetoric are wise—he speaks from experience—but I believe that the key lies mainly with China in this arena. It is very much in the interests of the Chinese and the Russians, who share a border with North Korea, to rein in Kim Jong-un and persuade him to abandon what I think is a path of self-destruction.
In the light of the American Vice-President’s current visit to the region to consult, one hopes, South Korea and Japan, among others, on the most effective way of containing North Korea’s nuclear ambitions, and reflecting on the Foreign Secretary’s own experience at the recent G7 summit, does he think that there is the potential for further economic sanctions directed at Pyongyang? Does he think that China would fully support such a step?
The crucial thing is for the Chinese and others to implement the current sanctions and to allow them to have a full economic impact. As the right hon. Gentleman may know, there has been some doubt in recent months about the full application of those sanctions. The people of North Korea are living in absolute misery, penury and servitude. The trouble is that they can probably continue to live in that state for a long time to come, unless their Government see sense. We must work with the Chinese to persuade them.

Friend the Member for Doncaster North (Edward Miliband) on securing this debate and on putting the case so eloquently, and I join others in congratulating the hon. Member for Stratford-on-Avon (Nadhim Zahawi) on bringing home so movingly the pain that this has caused to so many people.
My mother was a proud American from Ohio. Her forebears made the journey across the ocean to seek a better life, and they found safety and opportunity in equal measure. Perhaps that explains why those of us who have a family connection with the United States of America felt, I must confess, a sense of shame and rising anger as events unfolded this weekend. We have seen that passion expressed in this debate, which tells us something about the nature of the decision that we are objecting to. It is precisely because we have such respect for the United States of America that we yearn for something better—much, much better—than this, and why we have a responsibility as friends to speak out.
Has the right hon. Gentleman noted that Donald Trump’s mother was a migrant? She was not just from Scotland but from my constituency. Donald Trump’s first cousin’s wife was my English high school teacher, but we can leave that to one side.
The right hon. Gentleman mentioned shame. As a Hebridean, I feel utter shame at how Donald Trump, the son of Hebridean woman, is behaving on the world stage. It is absolutely disgraceful and shameful. I hope he rescinds and changes the measure—not recasts, but rescinds it.
I agree with the hon. Gentleman. We hope he rescinds the measure.
I want to make three very quick points, the first of which is that however much the Foreign Secretary may seek to argue that this is not a ban on Muslims, our fellow Muslim citizens and our constituents, and my hon. Friend the Member for Bradford West (Naz Shah) and I, know that it is. Why do we know that it is? We know because Donald Trump said during the course of his election campaign that that is what he wanted to do. The fact is that people listen to that. They see the order. They know he is talking about them. Imagine the conversations in families when children say to their parents: “What is it about us that means that country doesn’t want us?” What message does that send to the next generation? Frankly, the message it sends is offensive, divisive and misguided.
Secondly, I agree absolutely with the point made by the hon. Member for Reigate (Crispin Blunt) that the order will not help us or anyone else in the fight against the brutal ideology of Daesh. Instead, it will act as a recruiting sergeant for Daesh. I simply observe that our security is too important to be damaged in that way when populism triumphs over reason, as has happened in this case. Our best defence against the lethal obscurantism of Daesh is to cleave ever more strongly to the values that make us proud to be British.
My final point is about the international rules-based system. Why did we create these institutions after the end of the second world war, including the United Nations? We knew that out of the ashes of that terrible conflict, we needed to work together to observe and uphold certain principles to enable humanity to thrive in the world we were seeking to create. Article 3 of the refugee convention states:
“The Contracting States shall apply the provisions of this Convention to refugees without discrimination as to race, religion or country of origin”,
and the truth is that the order offends against article 3 of that convention. We have other worries—the Paris climate agreement and the Iran deal—but they are all expressions of the international rules-based system that we have fought so hard to create and sustain.
I conclude by saying this: if we are going to deal with the challenges we face as a world as this century unfolds, we must seek and strive to bring people together and not to drive them apart. That, after all, is the very principle on which the United States of America, which we respect so much, was founded.

Friend’s words will be heard in Washington, but all I can say is that we will continue to engage with the Administration to make our points about the interests of UK nationals and, of course, to convey our feelings about the global consternation that this measure has caused.
Will the Foreign Secretary clarify what the position would be for an Iraqi national resident in the United Kingdom whose child was a dual British and Iraqi citizen working in the United States, in the event that that child died? Would her mother be able to travel from London to the United States to bury her daughter, under the current US arrangements? If not, would he agree that that would be quite simply inhuman and outrageous?
Of course, it is possible to create all sorts of hypothetical situations that are yet more outrageous. As far as I understand the matter—the right hon. Gentleman will appreciate that it is for the US to explain that aspect of its policy—the answer is that such a case would be treated very expeditiously and particular arrangements would be put in place to ensure that that person was able to travel to the US.

Commons ChamberLet me repeat my point: John Kerry was completely right to draw attention to the illegal settlements and to the substance of resolution 2334. I remind the House that the UK was closely involved in its drafting, although of course it was an Egyptian-generated resolution. We supported it only because it contained new language pointing out the infamy of terrorism that Israel suffers every day, not least on Sunday, when there was an attack in Jerusalem. I was glad that the resolution identified that aspect of the crisis in the middle east, and John Kerry was absolutely right to point out the rounded nature of the resolution. May I pay tribute to John Kerry, who is shortly to step down as Secretary of State, for his tireless work for peace not just in Israel-Palestine, but across the wider middle east?
I welcome the Government’s vote in favour of UN Security Council resolution 2334, not least because it stated that
“the cessation of all Israeli settlement activities is essential for salvaging the two-State solution”.
Following the Foreign Secretary’s discussions in the past couple of days with members of the incoming Administration in the United States, does he think that that view is shared by President-elect Trump?
I think it is a widespread view in Washington, and across the UN Security Council, that settlements are illegal, which was why the resolution went through as it did, without any opposition. To answer the right hon. Gentleman’s question directly, I think it is too early to say exactly what the Administration will decide on this matter, but he can rest assured that the British Government will continue to make the points that we have, not because we are hostile to Israel—on the contrary—but because we wish to support the state of Israel.

My hon. Friend, with the experience that he brings to the House, articulates the challenges that we face. We must work with the United Nations, and receive its advice on how best to get the aid in. I do not rule out the use of airdrops, but it must be a last resort when we are unable to get the trucks in by gaining permissions on the ground.
I think that, in truth, all of us in the House, and in the world, feel ashamed by the fact that we are unable to bring food and medical supplies to the 250,000 people who are trapped in eastern Aleppo, including, as we have heard, 100,000 children. They are in harm’s way today. I understand—we all understand—the difficulties involved in airdrops, such as the one raised by the hon. Member for Beckenham (Bob Stewart), but back in the summer—as we heard from my hon. Friend the Member for Islington South and Finsbury (Emily Thornberry)—the then Foreign Secretary told the House that agreement had been reached for airdrops to be used if necessary. I simply say to the Minister that if this is not the last resort, given what is being reported every day, what on earth is?
I pay tribute to the right hon. Gentleman and the work that he has done in this regard, and I have listened carefully to what he has said. I spent some time discussing what we could do with Matthew Rycroft, head of the United Kingdom Mission to the United Nations in New York. Unless we have permission for aircraft to enter that space—not necessarily British aircraft; any aircraft—the dangers that those aircraft are likely to face will be considerable. We need to weigh up the options to ensure that we are content for those risks to be taken.
