I know the hon. Gentleman looks at these issues in detail and very seriously and I very much respect that. I have looked at the report to which he refers and the work of my right hon. Friend the Member for Harlow (Robert Halfon) on this, but the reality is that there is an inherent contradiction in respecting the referendum result and suggesting that we can cherry pick from the four freedoms that the EU has always been clear cannot be divided. The reality is that the Norway option does not give us what is needed. There is Norway or Norway plus, but the reality is that Norway has a population of 5 million and much of what is done in terms of rule taking for Norway is not suitable for the UK in areas including financial services. There is also an inherent contradiction in what was committed to in the manifestos of the hon. Gentleman’s party and my own, and delivering on the referendum result.

Mr Speaker, may I wish you and the House a constructive new year?

Given that neither the EU nor the UK wish to be in the backstop for any length of time, can my right hon. Friend explain to the House why it is so difficult to agree with our 27 EU partners a short protocol to the withdrawal agreement that would allow the UK to have a unilateral right to withdraw from the backstop in a relatively short period of time?

As my hon. Friend knows, there has been some progress in this area, in terms of the commitments around best endeavours and the backstop being temporary. Indeed, article 50 requires that the backstop would be temporary. These issues have been raised across the House. The Prime Minister is discussing them with EU leaders and we will have more to say on this in the forthcoming days.

We work very closely with our colleagues in the Treasury and, of course, we make sure that information is shared between us. Our negotiating position is informed, as we have repeatedly said, by a very wide range of analysis, much of which is in the form of advice to Ministers.

Paolo Gentiloni, the Italian Prime Minister, called on the EU this week to give the UK a “tailor-made” trade deal. Is it not precisely that sort of sentiment that would help all sectors if we concluded a trade deal that suited them?

My hon. Friend raises an interesting point. We need to reflect on the fact that the UK is uniquely aligned among the countries that will be outside the EU; it is a huge market for the EU. There is a real opportunity for the EU to do a trade deal with what will be its biggest export market.

The Government have made it clear from the beginning that they value the 3.2 million EU citizens who are here, and the Prime Minister has written to them all, or at least to the ones for whom we have records. It is our clear intention, and it will be legally binding in the withdrawal Bill, that they will have the rights that we have laid out in very short order.

Does my right hon. Friend agree that our leaving the European Union does not mean to say that we cannot co-operate with it at the very closest level on the environment, to lead the rest of the world?

My hon. Friend is absolutely right—we are leaving the European Union; we are not leaving Europe. The Prime Minister has been very clear that we will want to work together on shared challenges such as global warming and the environment.

The official advice is that the Home Office is clearly working on a process to ensure that settled status can be achieved as straightforwardly as possible. There is no need for anyone to apply for that status as yet, because it is very clear that EU nationals living in the UK have the right to be here under EU freedom of movement rules. What we are talking about is putting in place a process for when the legal order changes. As the Prime Minister says, we want them to stay, and we want to make that process as straightforward as possible.

Does my hon. Friend agree that not only do EU citizens in this country need rapid reassurance of their status, but the very large number of British citizens living in a host of EU countries need the same reassurance? When does he expect to conclude this agreement?

My hon. Friend is absolutely right. That is why it is very important that we work through the detail of this agreement to show how it works on both sides, and that it can deliver both for EU citizens living in the UK and UK citizens living in the EU. As I have said, the talks have been constructive and we believe that we are within touching distance of reaching a full agreement.

I welcome the hon. Lady’s question and her focus on financial stability, because, as I said in my answer to my hon. Friend the Member for Wimbledon (Stephen Hammond), we absolutely recognise the importance of financial stability for the whole of Europe, including the UK, and of reaching a deal with our European counterparts. When I met the financial services industry in Scotland to talk about these matters, it was clear on the importance of financial stability, and it was very clear on the vast importance of the United Kingdom market for Scottish financial services.

What assessment has my hon. Friend made of the French Government’s warnings that the City should continue to be overseen by EU regulators?

We recognise the importance of regulatory oversight and mutual regulatory understanding as we move towards a comprehensive trade agreement with the European Union. One thing I have learned while doing this job is the huge respect in which UK regulators are held around the whole of Europe. I think we have some of the best financial regulators in the world.

I am not familiar with that commentary, but I welcome the hon. Gentleman’s view about the chapter on the relationship with Ireland. One of the most important parts of the last seven month’s preparation has been striking a relationship with Ireland that ensures that we underpin the peace process, maintain the stability of Northern Ireland, keep an open border, and so on. It is incumbent on the British Government to be as helpful as we can to the Irish Government because they are in the most difficult position, so that is what we are doing.

Paragraph 8.43 of the White Paper makes it clear that we want to leave the customs union so that we can negotiate free trade agreements “around the world.” If we leave the customs union, we will be bound by an external tariff unless we negotiate otherwise. Is that the correct position?

Generally speaking, a most favoured nation arrangement applies under WTO rules, but countries are generally allowed to make free trade agreements at whatever level they seek. We want to ensure that as many of the existing EU free trade agreements carry straight over, which will also be lower than MFN rates.

This is an historic debate. I was in the Chamber during the Maastricht debates 25 years ago: it has been a long time. The British people voted by a margin of 1.35 million to leave the European Union, and two thirds of the constituencies in the country voted to leave. I respect all my constituents who voted to remain—and The Cotswolds voted very narrowly to remain: it was 51% to 49%—and I totally reject the Liberal Democrats’ assertion that I cannot represent those constituents.

The British people, through this referendum, have regained the sovereignty of this Parliament. We will no longer be subject to the directives and regulations laid down by Brussels. We will regain control of our borders, and, above all, we will be able to reassure the Europeans who are living in this country that they are welcome here, provided that our European partners give reciprocal rights to us. Shorn of the EU competence for trade, we will be able to regain our old entrepreneurial spirit and go round the world, trading openly with all its nations. Some people assert that the peace in Europe has been maintained by the European Union. I say that the peace in Europe has been maintained by NATO—and it is absolutely right for our Prime Minister to ensure that all NATO members abide by their obligation to spend 2% of their GDP on defence.

As many speakers have said during this debate, we shall not be leaving Europe. We shall be leaving the European Union, but the Europeans will still be neighbours and friends. I think that, pragmatically, we will do a deal for this country that will be in the interests of all its people. It is a byzantinely complex negotiation on which our colleagues on the Front Bench are about to embark. I say to them that we have an absolute duty to get the best deal that we possibly can for this country. However, I am confident that when our partners look at what we have to offer them and what they have to offer us, it will, pragmatically, be in their interests to make sure we do a deal that suits both of us.

We will reset our relationship with Europe: it will be an easier relationship; it will be a relationship that all parts of this kingdom can relate to—whether that is England, Scotland, Wales or Northern Ireland. I simply say to our Scottish nationalist friends, echoing the soothsayer in Shakespeare’s “Julius Caesar”: beware of referendums—you cannot be certain what the result will be.

I agree with my hon. Friend. That is why we are here tonight, and it is what the vote will be about tomorrow. We are all going to vote to trigger article 50. We will then have at least two years of negotiations to find out exactly where we are going to be. Who knows, that might take even longer, but I have every confidence in our Government and in our Prime Minister, who could not have been clearer about the direction in which this country is going. She has said that no deal is better than a bad deal, and I entirely endorse that view. If we have to fall back on WTO rules, so be it, but I am convinced that common sense and pragmatism will ensure, over the next two years, that that will not happen.

My hon. Friend talks about pragmatism. Given our huge imbalance of trade with the European Union, does he agree that it would be hugely in the EU’s interests to strike a better deal with us rather than reverting to WTO rules?
