Commons ChamberI well remember when the SNP advocated the “arc of prosperity” for Ireland, Scotland and Iceland. I very much doubt that the people of Scotland would want to endure the pain that the people of both Iceland and Ireland have endured to ensure that their economies are back on a stable footing.
Perhaps all of us on this side of the House can agree that Scotland’s greatest contribution has been to show that there is actually an alternative to the destructive policies of this UK Tory Government. It is worth remembering that in Scotland we have free prescriptions, free eye tests, free childcare and free university tuition. We have scrapped bridge tolls, reopened railways and invested in infrastructure, and we are building more council houses than any UK nation. That is what the SNP has delivered in government in Scotland. Does the Secretary of State not agree that that stands in marked contrast to the Tories’ mismanagement and destruction of public services south of the border?
What I see in my constituency is falling educational standards, with Scotland’s once-proud education system having the lowest international ratings ever. What I see is my constituents experiencing increasing waiting times for the health service and having to deal with inadequate infrastructure. I do not believe that the SNP Government in Scotland are focusing on the day job. They are focusing on their obsession—independence.
Quotes about doing the day job when the Government are calling an early general election are a bit cynical. Let us rest on a neutral observer, not a Tory party research officer. What about the director of the Institute of Health and Society, who said:
“Scotland is in a much stronger position than England with respect to both health and social care”?
He went on to say:
“The problem is at the moment that the English government is not committed to a national health service”.
Is not that another example of the fact that the real alternative to the Tory UK Government is the progressive policies of the SNP?
Absolutely not, and I look forward to debating these subjects over the next six weeks. The right hon. Gentleman was very careful not to mention education standards in Scotland, which the latest international figures demonstrate are the lowest ever on record. That is not a proud record of the Scottish Government. I look forward to holding them to account over the next six weeks.

Commons ChamberMy hon. Friend is absolutely right to highlight food and drink as Scotland’s top manufacturing export, accounting for £8.9 billion in 2015. Leaving the EU offers us the opportunity to negotiate new trade deals across the globe and create even more opportunities for Scotland’s world-renowned food and drink.
Agriculture and fisheries are key parts of the Scottish economy and Scotland’s export sector. Powers for both are devolved to the Scottish Government. Under the Secretary of State’s Government’s plans, will all decisions on agriculture and fisheries be taken by the Scottish Parliament and the Scottish Government after Brexit?
As the right hon. Gentleman knows, the Government have confirmed in the White Paper that all the powers that the Scottish Parliament currently exercises in relation to agriculture, fisheries and all other issues will continue. We wish to have a dialogue with the Scottish Government, the other devolved Administrations and stakeholders about what happens to powers that are currently held in Brussels and where they will rightly rest after the United Kingdom leaves the EU.
Anybody watching this will realise that the Secretary of State did not answer the question. During the Brexit referendum campaign, people were told that decisions currently taken in Brussels on agriculture and fisheries would revert to the Scottish Parliament. The Secretary of State has not given a clear answer to the question, which really matters to our rural industries, our rural economy and Scotland as a trading nation. Let me try the same question again, and I would be grateful if the Secretary of State answered it. Under his Government’s plans, will all decisions on agriculture and fisheries be taken by the Scottish Parliament and the Scottish Government after Brexit—yes or no?
This Government’s plan is to engage with the Scottish Government and with the other devolved Administrations to discuss those serious issues. It is not to go out and tell the people of Scotland that the devolved settlement is being undermined by Brexit, which will lead to the Scottish Parliament exercising more powers. I can give the right hon. Gentleman an absolute guarantee that, after the United Kingdom leaves the EU, the Scottish Parliament and Scottish Ministers will have more powers than they have today.

Commons ChamberMy hon. Friend makes a very relevant point. The hon. Member for Blaydon (Mr Anderson) referred to personal independence payments, to which, I know, the Scottish Government are opposed, but I have no idea what they intend to replace them with, or on what timetable.
May I begin by joining colleagues in paying tribute to Canon Kenyon Wright? He not only played a significant role in helping to deliver devolution to Scotland but, of course, in 2014 supported a yes vote for Scottish independence.
The UK Government are planning to close half the jobcentres in Glasgow without even knowing the number of people who will be affected by such a radical change. Was the Secretary of State consulted in advance of the closures, and when did he show enough interest to find out which specific locations would face closure?
I have taken a very close interest in this issue and worked closely on it with my colleagues in the Department for Work and Pensions and the Scottish Government. The Government and I have never suggested that the procedures followed during the process have been perfect, but we have put forward a public consultation for people who are affected and will have to travel more than 3 miles or for more than 20 minutes. I encourage everyone involved to take part in the consultation.
The devolution of powers hangs very much together with the hard Brexit plans of the current Government. The Secretary of State has said that his role is
“to ensure Scotland gets the best possible deal and that deal involves clearly being part of the single market.”
Does he still believe that, or has he changed his mind after being told what he should say by his Tory bosses in London?
I do not recognise the Prime Minister’s speech yesterday as a hard Brexit plan. I do not think that the 500,000 Scottish National party voters who voted for Brexit will take kindly to being referred to as right-wing Tory Brexiteers. They were independently minded people in Scotland who voted for what they thought was the right thing for Scotland. It is absolutely clear, as the Prime Minister said yesterday, that we want to have access to the single market, and that is what the quote from me that the right hon. Gentleman just read out made clear. On the other hand, membership of the single market is a quite different thing, as Mike Russell and, privately, the Scottish Government accept.

Commons ChamberI can update my hon. Friend. The Scottish Government have now brought forward one piece of legislation since the Scottish parliamentary elections in May. He may be interested to know that this Government currently have 19 pieces of proposed legislation before this Parliament. Of course I agree with him, and I think the majority of people in Scotland want the First Minister and the Scottish Government to get on with their day job of running Scotland and seeing to the devolved responsibilities, rather than constantly talking about independence.
The Scottish Government have announced that the new powers over benefits will be used to end the misery being meted out to disabled Scots by the UK Government. First Minister Nicola Sturgeon has pledged to reduce the need for assessments for personal independence payments and disability living allowance, in particular for those with long-term illness. Will the Secretary of State take the opportunity to welcome that and urge his UK Cabinet colleagues to follow suit?
What I will welcome when I see it is some detail behind those fine words. We have heard lots and lots of fine words on welfare, but to date we have absolutely no detail as to what the Scottish Government plan to do.
I suppose we should view it as progress that the Secretary of State believes they are fine words, and perhaps he will follow the Scottish Government’s initiative, but it is fair to say that the majority of welfare and economic powers are not being devolved to the Scottish Parliament. Will the Secretary of State confirm that he has no plans to devolve powers to deal with Scottish legal partnerships, and the risks they pose in the fight against global money-laundering and organised crime? I have raised this matter with the Prime Minister and spoken to the right hon. Gentleman. Will he now tell the House what he and the UK Government will actually do about it?
As the right hon. Gentleman knows, the settlement in the Scotland Act 2016 was the outcome of the Smith Commission. The Scottish legal partnerships issue was not a part of that arrangement and will not be devolved, but I take it extremely seriously. I commend him for the way in which he has highlighted it in this House and elsewhere, and I commend The Herald for the way in which it has highlighted the issue. Colleagues in the UK Government are looking at how we can best take the situation forward to end the abuses, which are evident.

Commons ChamberI agree that we need to see Brexit as an opportunity, and I was very interested to see yesterday that the leader of Glasgow City Council also took the view that Brexit offered an opportunity for Glasgow to continue to flourish. Rather than doom-mongering, which is the constant refrain of the SNP, let us take a positive approach and seize the opportunities that are out there for Scotland.
May I remind the Secretary of State for Scotland that he was elected on a manifesto commitment to
“safeguard British interests in the Single Market”,
so will he and his Government work with the Scottish Government, respect the 62% of Scottish voters who voted to remain within the European Union and protect our place in Europe?
Of course I will do that, but I will also respect the half of voters in the right hon. Gentleman’s constituency who voted to leave the EU. He does not make much of it, but a higher percentage of people in his constituency voted to leave the EU than voted for him, so let us respect everybody in this debate. I am committed to working with the Scottish Government. I have met Michael Russell on a number of occasions. The First Minister and the Prime Minister will meet on 24 October, and their engagement will be essential to achieving what we want: the best possible deal for Scotland.
Yesterday, we learned from statistics emanating from the right hon. Gentleman’s Government that Brexit will cost £66 billion a year. If these statistics are being prepared for the Cabinet Office, surely they are also being prepared for the Scotland Office, so will the Secretary of State for Scotland be candid with the House and with the people of Scotland and tell us how much Brexit will cost Scotland?
We are not even at the stage of beginning the negotiations. What we are going to see—[Interruption.] The Prime Minister has set out the process for taking those negotiations forward. It is inevitable that, over the next few weeks, months and years, we will see press reports and speculation, leaks and all sorts of other supposition. I want to ensure that we go into those negotiations in conjunction with the Scottish Government to get the best possible deal, and that is my commitment.

Commons ChamberObviously when I met Scottish businesses I wanted them to address the opportunities for business. I have just referred to a leading Scottish company with significant interests outwith the EU, but businesses in Scotland are naturally concerned to understand the arrangements that will be put in place for our future relationship with the EU.
In Scotland more than 62% of voters voted to remain in the European Union. Since then the Scottish Parliament has voted overwhelmingly to support First Minister Nicola Sturgeon in her efforts to protect Scotland’s place in Europe. That was voted for by the Scottish National party, the Labour party, the Liberal Democrats and the Scottish Green party. The Tories abstained. Will the Secretary of State finally join the cross-party consensus to protect our economy and our place in Europe, or will he abstain like his colleagues?
The right hon. Gentleman omits one fact. My colleagues were unable to support his party’s motion because the SNP would not take the toxic and divisive issue of a second independence referendum off the table. Anyone who wants to unify opinion in Scotland does not start talking about a second Scottish independence referendum. I hope the First Minister was listening yesterday to Scottish businesses when they said decisively in relation to discussions about the EU that they did not want to hear about Scottish independence.
Tens of thousands of European Union citizens play a massive role in our economy and society in Scotland. The Scottish National party wants to do more than just pay tribute to them; we want them to have guarantees that they can stay in Scotland. Will the Secretary of State act in the Scottish and European interest, and guarantee the rights of fellow EU citizens to remain in Scotland, and end the intolerable worry and concern with which they are being confronted?
I share the right hon. Gentleman’s view of the important role that EU citizens play in Scotland, and we want them to stay in Scotland and have their position guaranteed. We also want British citizens in the rest of Europe to have their right to stay there guaranteed, and I hope that it will be possible to issue both guarantees.

Commons ChamberThat is another positive campaigning point from the SNP. It is not for me to give advice to the SNP, but if my vote had fallen by 500,000 between the general election and the election for the Scottish regional list I would be focusing on getting my supporters out to vote on 23 June to ensure that Scotland votes to remain.
In the run-up to the European Union referendum, we are delighted on these Benches that the Scottish electorate has returned a pro-European SNP Government with the highest vote of any current party in any national election anywhere in western Europe. Most people in Scotland are pleased that, when given the opportunity, the Scottish electorate did not return a single MSP from the Europhobic UK irrelevance party and that there is a majority in the Scottish Parliament for Scottish independence as a member of the European Union. On the powerful case for remaining in the EU, will the UK Government please concentrate on making a positive, inspiring case to stay, rather than on rewarming endless scare stories?
I have made it clear to the right hon. Gentleman that that is my exact intention. Perhaps he could undertake today to stop obsessing about process and a second Scottish independence referendum and to concentrate entirely on the positive reasons for Scotland to remain in the EU.
Scotch whisky is the largest net goods exporter to the European Union, both from Scotland and from the United Kingdom as a whole. Does the Secretary of State agree that the European single market is profoundly important and positive for that £1 billion trade, meaning that there is no need for customs forms, duplication of labelling, and safety requirements? Will he stress the positive advantages to the whisky industry, and all exporters from Scotland, to jobs and to profitability of remaining within the European single market and the European Union?
I am absolutely clear that what the right hon. Gentleman states is the case, and I am sure he will have welcomed the visit to Scotland made yesterday by my right hon. Friend the Secretary of State for Environment, Food and Rural Affairs to stress the importance to the whisky industry of remaining in the single market. The particular points he makes about duplication in relation to labelling, certification and licensing are ones the Scotch Whisky Association has made, and I am sure the public will take them into account when they vote in the referendum.

Commons ChamberI am delighted to follow the hon. Member for Edinburgh South (Ian Murray). It is a calumny that he has been described as negative. He spent much of his time at the Dispatch Box trying to be positive about the Scotland Bill. Parts of his speech were positive and we welcome that, and we also welcome the Secretary of State’s positive comments.
The Scotland Bill is an important step in extending the responsibilities of the Scottish Parliament and in Scotland’s journey towards greater self-government. That journey has quickened in pace since the Scottish National party was first returned to power in 2007. The Bill follows progress including the Scotland Act 2012, the independence referendum and the Smith commission itself. As Deputy First Minister John Swinney has said, the Bill delivers additional powers that can benefit the people of Scotland, including extended powers over tax, new powers over welfare, and responsibilities for the Crown Estate, tribunals and the licensing of onshore oil and gas activity.
The agreement on a fiscal framework published on 25 February increases the Scottish Parliament’s financial responsibility, is consistent with the Smith principles of no detriment, and is fair to the people of Scotland. As the Bill, including the amendments under discussion, provides useful powers and has moved towards delivering more of the recommendations made by the Smith commission reports, and as the agreement on the fiscal framework would be a fair basis for future funding consistent with the principles agreed by the Smith commission, the Scottish Government recommended that the Scottish Parliament should consent to the Bill. On 11 March 2016, the Devolution (Further Powers) Committee published its report on the Scotland Bill and the fiscal framework. Although it makes recommendations on specific policy areas, its overall conclusion is that the Scottish Parliament should consent to the Bill. That is what is before us. On 16 March, the Scottish Parliament consented to the legislative consent motion for the Bill.
The SNP has, of course, governed in Scotland for nine years, and every indication is that the people of Scotland have been delighted with the governance of Scotland under the SNP. I join the Labour party spokesman in paying tribute, as I did earlier today, to every outgoing Member of the Scottish Parliament—not least my right hon. Friend the Member for Gordon (Alex Salmond)—of all political parties, who have worked hard to achieve the best governance that decision-making closer to home can bring.
The outgoing Scottish Government have already acted with pace and creativity, in consultation with others, to be ready to use the limited powers—there are, of course, limits on the powers that are being devolved. That includes introducing a social security Bill within the first year of the new Scottish Parliament, to support the transfer and administration of Scotland’s new, devolved social security benefits. It also includes enhancing opportunities for employment and inclusive economic growth by improving support for people to move into employment through reform of the Work programme and linking employment programmes with training and education.
The outgoing Scottish Government have also committed to abolishing fees for employment tribunals, to reduce the burden of air passenger duty by 50%, and to promote equalities by taking early action on gender balance on public boards. They have also set out longer-term intentions for further income powers, are committed to a progressive taxation policy and have applied that to the decision on existing tax powers. Commencement of most of the new powers will take place in 2016, but new arrangements for the use of major new powers on matters including tax and welfare will not be in place before April 2017 following scrutiny of the proposals by the Scottish Parliament.
On 11 March 2016, the Scottish Parliament’s Devolution (Further Powers) Committee published its final report and gave its unanimous recommendation that legislative consent be given to the Scotland Bill. That was described as
“a significant milestone in a remarkable political process”
by Committee convener Bruce Crawford MSP. I pay tribute to him and his colleagues on the Committee, as I do to my hon. Friend the Member for Perth and North Perthshire (Pete Wishart), the Chair of the Scottish Affairs Committee, for their work. Although the Scotland Bill and the Smith commission could have delivered more effective and coherent powers to the Scottish Parliament, the Bill provides useful additional powers in important areas such as taxation and social security.
The UK Government amended the Bill to reflect some of the comments of the Scottish Government, the Scottish Parliament and its Committees. With an agreed fiscal framework that increases the Scottish Parliament’s responsibility and protects the Barnett formula, the Scottish Government recommended that the Scottish Parliament consent to the Scotland Bill. The final report of the Devolution (Further Powers) Committee also had some important things to say:
“There are still some areas where we feel that the Scotland Bill continues to fall short of the spirit and substance of Smith…Nevertheless, the Bill has been improved during its passage through our detailed scrutiny and we welcome the fact that the Secretary of State for Scotland has been prepared to listen to the evidence we have presented and improve the Bill in other areas…in our view, on the basis of the information provided to date by both governments, we are prepared to endorse the fiscal framework underpinning the powers to be devolved to Scotland as part of this Bill. Therefore, on balance, we recommend that the Scottish Parliament gives its legislative consent to the Scotland Bill.”
UK Government amendments that implement more of the Smith report, including the permanence of the Scottish Parliament, are welcome. However, it needs to be said that the Scotland Bill continues to fall short of the spirit and the substance of Smith in some areas, including the devolution of employment programmes and the future operation of the legislative consent provision. It is important to understand that the UK Government can still effectively veto the exercise of devolved powers over universal credit by inserting their own date for the changes to commence. The social security provisions on discretionary payments and assistance are still subject to restrictions, notably for those who are under sanctions. The Smith report was clear that the Scottish Parliament should have complete autonomy over devolved benefits. The Scotland Bill is many things, but it is not federalism or near-federalism. Anybody who understands the powers of the German or Austrian Länder knows that to be true. It is an improvement, and it is progress.
We in the SNP thank all in the Scottish Government who have been involved, especially John Swinney. We also thank those on the UK Government side, even though—this is an important rider—I see that there is a Minister from the Treasury on the Treasury Bench, and we all know that the Treasury wanted a fiscal framework that would have made Scotland worse off by £7 billion. Thank goodness for the efforts of John Swinney and colleagues in the Scottish Government. I would like to take the opportunity to thank my SNP MP colleagues, who have worked so hard on the Bill throughout the parliamentary process. In fairness, it is also right to place on record the fact that Members in the other place spent a lot of time on the Bill.
Most importantly, I thank all those in Scotland who have believed in more powers. They did not draw lines in the sand or say, “This far, and no further”, as others have done, even in the recent past. Thanks to all those yes voters and all those SNP voters, Westminster has had to take note. This is just the latest stage on Scotland’s journey, and there will be many more. We agree with the amendments, and we wish the Bill to proceed. That is exactly what will happen today.
I will not detain the House for long, but I want to respond briefly to some of the points that have been made.
I add my best wishes to all Members of the Scottish Parliament who are leaving at this election, particularly my colleagues and others who were elected to the Scottish Parliament alongside me back in 1999. A number of people who have served in Parliament throughout that period are leaving, and others who are standing in the election will be leaving, although not necessarily of their own accord. We should wish them well.

Commons ChamberMr Speaker, you will be pleased to hear that the First Minister and I met and shared a platform in St Andrews, which is of course the world home of golf. On sport, as on any matter, Scotland of course does best when Scotland’s two Governments work together.
This is the first opportunity in Parliament to put on the record our total revulsion at and condemnation of the terrorist atrocities in Brussels, as well as our solidarity with everybody affected. We join the Secretary of State for Scotland in that.
The promotion of the Ryder cup in Scotland was a huge achievement for the Scottish Government and the then First Minister, my right hon. Friend the Member for Gordon (Alex Salmond). Today is the last sitting day of the Scottish Parliament. Given that he is standing down from Holyrood, may I pay tribute to my right hon. Friend for his remarkable tenure as an MSP and as First Minister, and pay tribute to all other MSPs from all parties who are retiring? Does the Secretary of State agree that there is much that can be built on following the success of the Ryder cup? How does he plan to contribute to that?
I am sure that that was a courteous tribute, but I hope the right hon. Gentleman will not object if I say that the first part of his question was way off the fairway.
Securing the Ryder cup to be held in Scotland was a significant event. I agree that the former First Minister of Scotland has made a remarkable contribution to Scottish politics, although the right hon. Member for Moray (Angus Robertson) and I will probably differ on the detail of that. What the former First Minister and many MSPs who are standing down—I also pay tribute to them—have done, and what we all need to do, is promote Scotland together, because that is when we get the best results for Scotland.
I will try to remain on the fairway, Mr Speaker.
Tourism is one of Scotland’s most important industries, and golf and whisky are key drivers for people visiting the country. Does the Secretary of State welcome local initiatives better to promote iconic Scottish regions and locations, such as Speyside? What encouragement would he give to public and private sector partners in making the most of Scotland’s world-class potential as a tourism draw?
I am aware of the initiatives to promote Speyside, having recently visited the right hon. Gentleman’s picturesque constituency, and I wish them well. Such opportunities reach their full potential only with significant public and private sector partners playing a full part, and I look forward to hearing about progress from Speyside and other regions of Scotland that are making the most of that potential.

Commons ChamberI am very happy to give my right hon. and learned Friend the assurance he seeks. The Scottish fiscal framework will be consistent with the UK fiscal framework.
May I begin by thanking the Secretary of State for advance sight of his statement and indeed for the conversations he had yesterday, given the constraints of parliamentary time and being able to make a statement only today? We appreciate his having done so.
I speak on behalf of all Scottish National party Members in welcoming the agreement on the fiscal framework, and we all look forward to the draft heads of agreement being published for parliamentary scrutiny in this place and in the Scottish Parliament later this week. My SNP colleagues in the Scottish Government were clear throughout these protracted negotiations that they would not sign a deal that included a threat to the Scottish budget. Members on the SNP Benches here, too, pursued the UK Government’s commitment to the principle of “no detriment”, a promise made during the Smith commission negotiations and a promise that the SNP has ensured has been delivered.
When negotiations began, Scotland’s budget faced a threat from the Treasury of a cut of £7 billion. This week, it was £3 billion, and yesterday morning it was £2.5 billion, but last night my colleagues in the Scottish Government secured a deal that will ensure that Scotland will not be a pound or even a penny worse off, and that the new powers that were promised will be delivered. I pay tribute to the First Minister, Nicola Sturgeon, and the Deputy First Minister, John Swinney, for their efforts to stand up for Scotland and for being stronger for Scotland.
I welcome the fact that the UK Government will guarantee that the outcome of the Scottish Government’s preferred funding model—the per capita indexed deduction—is delivered in each of the next six years. I understand that a transitional funding arrangement will be reviewed following the UK and Scottish parliamentary elections in 2020 and 2021 respectively. The review will be informed by an independent report, with recommendations presented to both Governments by the end of 2021. In that context, let me say this: the Smith report was crystal clear that the fiscal framework had to be agreed by both the UK and Scottish Governments. The Treasury tried to engineer an agreement that would have allowed it to impose a model of indexation in five years’ time—those are the facts of the matter. That would have seen billions cut from Scotland’s budget. Let me therefore ask the Secretary of State the following questions: will he confirm that the Treasury no longer has the power to impose a method of indexation? Will he confirm that the review will go ahead without prejudice to the outcome? And will he confirm that there is no default indexation option and that the Scottish Government’s agreement is required before any new indexation model can be adopted?
I thank the right hon. Gentleman for welcoming the parts of the agreement that he did. This has been a negotiation, and this is the point arrived at in the agreement; it is not possible for the Treasury or the UK Government to have engineered an agreement, as what was needed was the agreement of the Scottish Government, and that is what has been achieved. The two parties have been able to reach an agreement on a fiscal framework that is both fair to Scotland and fair to the people of Scotland.
I can reassure the right hon. Gentleman that the review will go ahead on an independent basis, without prejudice or a predetermined outcome, and it will be concluded by the end of 2021. There will be no imposition of any formula at the end of that period, and what happens will be by way of agreement. As I said in my previous comments, when I quoted what Lord Smith said, I believe that this process, through some of the most difficult types of negotiation, gives us confidence that in a maturing relationship the UK Government and the Scottish Government will be able to reach such an agreement.

Commons ChamberIn a reformed EU, we could have the best of both worlds—access to the single market while not being a member of the euro or Schengen. I believe that would be good for Scotland and good for the rest of the United Kingdom.
The single European market and the ability to affect the legislation that governs it is hugely important to the Scottish economy, especially the exporting sectors such as whisky. Will the Secretary of State confirm that, regardless of the ongoing negotiations, he will personally campaign for Scotland and the UK to remain within the European Union?
The right hon. Gentleman will know and will, I am sure, be pleased to have heard that the leader of the Scottish Conservative and Unionist party, Ruth Davidson, has expressed exactly that position.
The good news is that I get a second bite of the cherry, so perhaps at the end of this question the Secretary of State will answer my question about whether he will support Scotland and the UK remaining within the European Union. Making a positive case for remaining in the EU will be crucial in the weeks and months ahead, so will the Secretary of State give a commitment not to repeat the grinding negativity of project fear and condemn ridiculous scare stories such as those from the Prime Minister on immigration and the refugee camp in Calais?
I will make my position known when the negotiations have been concluded, but I make this offer to the right hon. Gentleman: if the reform package goes ahead and if I am campaigning to keep Scotland in the United Kingdom I would be delighted to join him, the right hon. Member for Gordon (Alex Salmond) and the First Minister on a platform to make that case.

Commons ChamberSince the hon. Gentleman has put that on the record so many times, I want to point out that the Conservative party polled more votes in the 2015 general election than in 2010 election. He has sought to distort those figures. Perhaps he would like to join me in congratulating the new Conservative councillor in Aberdeenshire, who topped the poll in the very constituency of the right hon. Member for Gordon (Alex Salmond).
Oh dear, oh dear! The right hon. Gentleman had the opportunity to name a single country in the industrialised democratic world where a centre-right party does worse than the Scottish Conservative party, but he could not think of one because there are none. The Scottish Tories polled 14.9%, down two points on the previous general election. To be proud of that—
For the Secretary of State for Scotland to deny the facts just goes to show how far the Conservative party, the Labour party and—[Interruption.] I was going to add the Liberal Democrats—there is not a single one in the Chamber—because they lost 10 out of 11 seats in Scotland.
The point of saying all this is to understand where the democratic mandate lies. We went to the country saying that Smith should be delivered in full and that further powers should be delivered, and the Scottish National party won an overwhelming mandate to come to this place and make our case.

Commons ChamberI do not recognise my hon. Friend’s description of the Barnett formula, which of course will remain in place. The Scottish Parliament will now have significant powers over tax and welfare, and it is about time the SNP told us what it will do with them.
It is interesting that the Secretary of State did not take the opportunity to condemn the views of his Conservative colleagues who believe that Scotland is subsidised.
Only 9% of people in Scotland believe that the vow has been delivered, so unsurprisingly the Government are belatedly having to accept amendments. The financial framework underpinning the Bill is crucial. The Secretary of State could only give a one-word answer to my hon. Friend the Member for Lanark and Hamilton East (Angela Crawley), so will he elaborate and tell us exactly when the UK Government will update this Parliament on the progress made on the fiscal framework?
I am sorry that the right hon. Gentleman did not read my written statement on Monday, which updated the House on the progress of the fiscal framework. What I recognise in the right hon. Gentleman’s comments are these words from the editorial of the Daily Record:
“Moan, moan…whinge, whinge. Their response has been as negative as it was predictable. A cynic might argue that the SNP don’t actually want those new powers because it makes them…accountable to the people of Scotland.”
The Secretary of State has now had a second opportunity to condemn the views of his Back Benchers that Scotland is subsidised. I challenge him to come to the Dispatch Box and disassociate himself from the views of his colleagues. His Government are bringing in detrimental measures that will impact on families and individuals—not just in Scotland, but across the length and breadth of the UK. Will he give us some detail on what is going on between the Treasury and the Scottish Government, and give an assurance that there will be no detrimental implications for people in Scotland as part of the fiscal framework?
Not only does the right hon. Gentleman not read written statements; he did not even listen to my answer to my hon. Friend the Member for Harrow East (Bob Blackman)—perhaps he will read Hansard. The reality is that the powers being delivered to the Scottish Parliament will make it the most powerful devolved Parliament in the world. Rather than SNP Members telling us what they will do with those powers, it is grievance and grudge. The Scottish Parliament acknowledges that tax credits can be topped up, so will the SNP top them up—yes or no?

Commons ChamberIt is a pleasure to serve under your chairmanship, Mr Hoyle. I welcome you back to your role. I wish to speak in support of amendment 58, which stands in my name and in the names of my hon. Friends.
The Scottish National party has submitted a series of amendments to the Scotland Bill based on the three-pronged commitment outlined in our manifesto for the UK general election: first, delivering on the Smith agreement in full; secondly, devolving additional powers in priority areas such as job creation and welfare protection; and, thirdly, enabling the Scottish Parliament to move to a position of full fiscal autonomy. This approach was backed in record numbers by voters in Scotland in May, giving the SNP a clear mandate for change, which the UK Government must recognise and must act upon.
The UK Government must live up to the words of the Prime Minister on 10 September 2014, when he said:
“If Scotland says it does want to stay inside the United Kingdom then all the options of devolution are there and are possible”.
If all options are possible, it is the duty of the UK Government to respond to the clearly expressed desire of the Scottish people for more powers in the Scotland Bill. The SNP amendments include effectively entrenching the Scottish Parliament—that is what we are discussing now—placing the Sewel convention on a meaningful statutory basis and giving the Scottish Parliament the legislative competence to remove the reservation on taxation, borrowing and public expenditure, enabling the Scottish Parliament to legislate to deliver full fiscal autonomy. The SNP also proposes amendments for further priority powers at later stages in the Bill, including powers over tax, setting the minimum wage and taking responsibility for welfare decisions. In this first group of amendments, I will speak on issues relating to the permanence of the Scottish Parliament, and my hon. Friend the Member for Dundee East (Stewart Hosie) will speak shortly on full fiscal autonomy.
Amendment 58 relates to the permanency of the Scottish Parliament and Government. Paragraph 21 of the Smith commission report stated:
“UK legislation will state that the Scottish Parliament and Scottish Government are permanent institutions.”
However, in its analysis of the draft clauses published by the UK Government, the Scottish Parliament’s Devolution (Further Powers) Committee raised two main issues. As I stressed in the previous stage, that was an all-party Committee, involving members from the Scottish National party, the Scottish Labour party, the Scottish Conservative party, the Scottish Liberal Democrats and the Scottish Green party.
It is important to get it on the record that Alex Johnstone MSP has made it perfectly clear that his participation on the Committee is not to be conflated with the SNP press release issued at the time of the Committee’s report. He clearly supports the Committee’s report, but not the SNP’s attempt to distort that report.
It will no doubt be a relief to you, Mr Hoyle, that I will confine myself to the words agreed by all Committee members, including Mr Johnstone, when he signed up to the report.
That cross-party Committee found that the form of words on permanency proposed in the Scotland Bill was a weaker formulation than stating simply that the Scottish Parliament and the Scottish Government were permanent. We agree with the view of the Committee—and of Mr Johnstone—in paragraph 47:
“The Committee is of the view that the inclusion of the words ‘is recognised’ in draft clause 1 has the potential to weaken the effect of this clause, which would be unfortunate given the all-party agreement to this recommendation as part of the Smith Commission, and the views expressed to us by the former Secretary of State for Scotland that he perceives that the permanence of the Scottish Parliament and Scottish Government is guaranteed.”
The Committee was also told by the former Secretary of State that he was open to reconsidering the wording of draft clause 1, but changes were not made in the published Bill. This suggests that the Government might be open to the amendment.
Paragraph 49 of the report agreed by Mr Johnstone and all other Committee members states:
“In evidence to the Committee, the former Secretary of State for Scotland commented that he was ‘open to thinking about different ways in which…permanence could be achieved’. The Committee welcomes the openminded approach of the former Secretary of State with regard to this issue. The Committee therefore considers that there is scope to further strengthen the permanency provisions.”
The Committee’s analysis of the published Bill, however, confirmed that there was no change between the draft and the final clause.
The Committee called for additional protection in paragraph 50 of its report, supported by Mr Johnstone and all other members:
“The Committee considers that the effect of the clause on permanency, as currently drafted, is primarily declaratory and political rather than legal in effect. The UK doctrine of Parliamentary sovereignty makes achieving permanence problematic. The Committee recommends that the Scottish electorate should be asked to vote in a referendum if the issue of permanency was in question, with majorities also being required in the Scottish Parliament and the UK Parliament.”
That is the purpose of the SNP amendments, which we will be moving.

Commons ChamberI have said in the House that I fully support that campaign, and I know that it also has the support of my colleague John Lamont, the local Member of the Scottish Parliament on the Scottish side of the border.
I associate my right hon. and hon. Friends with the comments of the Secretary of State in respect of Charles Kennedy, and I welcome the right hon. Gentleman back to his place in his role as Secretary of State for Scotland.
The next UK Budget is going to continue the austerity course of the Tory Government, and it will hit the poorest in society. Will the Secretary of State be up front and explain whom it will hit when £12 billion of cuts hit families and communities across Scotland?
When it comes to being up front, it is the Scottish National party that needs to be up front about its proposals for taxation and spending. It used to tell us it wanted full fiscal autonomy, but now it does not seem to want that. It is for the SNP to answer the question of where the additional spending in Scotland would come from.
The last time I looked, this was Scottish questions, where it is the Government who have to answer the questions on the powers for which they are responsible. They are about to bring in £12 billion of cuts and the Secretary of State for Scotland has not been up front about where they will hit. On a related topic, the living wage can make a huge difference to those on low incomes, and I am very proud that the SNP Scottish Government are the first Government in the UK to become an accredited living wage employer. When will his Department and his Government follow the SNP lead on the living wage?
I am very proud of the proposals that my colleague Ruth Davidson has taken forward in the Scottish Parliament to incentivise small businesses to pay the living wage. One would have thought, when one hears SNP rhetoric, that it supported such proposals, but it does not.
