Commons ChamberAs the hon. Gentleman knows, this country was one of the first to ground the 737 Max aircraft, which was absolutely the right thing to do. There are clearly some alarming circumstances surrounding the two accidents that have taken place. It is something that Boeing clearly has to deal with. Unless and until the problem is solved, I cannot see countries such as ours allowing those planes to fly again.
Regardless of when we leave the European Union, we must continue to apply the highest environmental standards around our airports. What will the Secretary of State do to continue to reduce the noise footprint around airports, particularly those in very built-up areas, such as London City airport?
We have now appointed the head of the new aircraft noise body, which will monitor noise levels at airports and inform the Civil Aviation Authority when it needs to step in and use its enforcement powers. Of course, with the transition to a new generation of lower noise, lower emission and lower fuel consuming jets, the noise footprint around our airports is now considerably lower than it was a few years ago.

Commons ChamberI was very pleased to learn this week that the electric trains have now started running between Blackpool and Manchester through my hon. Friend’s constituency. Of course, it is worth remembering that that single electrification project represents a level of electrification many times greater than the Labour party managed across the entire country in its years in office— 13 years: 10 miles, which is fewer, by far, than that single electrification project alone.
If I understand this right, the Secretary of State is claiming a triumph for having signed a contract with a company that had no ferries to provide no ferries and, because it cost the taxpayer no money whatsoever, that is okay. Is that where the Secretary of State is? We are still facing the south-east of England being turned into a huge car park if we were to leave with no deal, and what has he done about it? Absolutely nothing.
As I set out, we have substantial contracts with two major operators to provide additional capacity, and we have put in place contingency measures in Kent, in case they are needed because of delays caused not in this country but on the French side. When I see what is happening in Calais and the preparations being made, I am increasingly confident that the flow of traffic through the channel ports will continue pretty normally. It is in everybody’s interest on both sides of the channel for that to happen, and it will certainly happen if we leave the European Union with a deal. It is disappointing, however, that the Labour party seems to want to stymie us leaving the EU with a deal.

Commons ChamberI am happy to meet my hon. Friend to discuss this. I do not expect any of the contingencies that we have in place for a no-deal Brexit to be needed, because I am confident that we will reach a sensible agreement, but I would be happy to discuss this with him.
Peak-time trains were cancelled yesterday and today, and there are regular delays at peak time. Is the railways Minister satisfied with the performance of the network and of the Southeastern train operator?

Commons ChamberWhat I have done is take decisive action to deal with a problem that needs to be addressed to make sure that we protect passengers. That is what everybody would expect.
The Secretary of State is the one who wrote the letter saying that he would not hand over suburban services to a Labour Mayor of London, but in today’s statement he has had to eat his words about the overground services in north-east London. In south-east London, my constituents face a worse service, with less choice of destinations as a result of the new franchise, so will he reconsider the position with regard to the Southeastern franchise and allow the Mayor of London to take it over and give a better service to my constituents?
The issue remains twofold. The Mayor of London’s business plan for the Southeastern franchise provided virtually no new investment at all. There was a handful of extra services on the Nunhead line, and the rest of it was on a wing and a prayer. I think that the new franchise document specifying improvements for passengers will deliver, not just in London but across the whole of the Kent and south-eastern area, because this is not a London franchise.

Commons ChamberAll franchise operators are required to obtain a pre-qualification passport. The Department may suspend or withdraw a passport in the event that the passport holder triggers certain requirements within the passport application. This would place restrictions on or remove the passport holder from bidding for franchise competitions.
I take it from that answer that it is possible for the Secretary of State to deny an existing franchise holder the right to rebid in a new tendering process. Govia, which has had the south eastern franchise for a long time, has consistently been a poor performer, so can he remove Govia from the service? If it were to get the franchise, what guarantees can he give to my constituents that they will get the improved service that they deserve?
In the case of the south eastern franchise, we will accept the bid that is going to deliver the best possible outcome for the hon. Gentleman’s constituents, with longer trains and better services. This is a competitive process. I will not hesitate to remove a passport from a firm when that is required. I also have to operate within European procurement law—something that the Labour party is still very keen on—and that requires me to take a proportionate approach. I will always seek to do that and I will always seek to operate within the law.

Commons ChamberTfL has clearly demonstrated its ability to run efficient services and improve them in London, so will the Secretary of State enter into negotiations with the Mayor of London about south eastern suburban services before my constituents are forced to endure yet another bungled privatisation?
The first thing to remind the hon. Gentleman of is that London Overground is also a franchise—Labour always conveniently forgets that. It is run by Arriva. The other thing to say is that the document we published yesterday on the new south eastern franchise involves far greater additional benefits for passengers than was ever the case in the Mayor’s business plan for that franchise. The last point to make is that I have extended to TfL and the Mayor the same offer that I made and is now in force in the north for a partnership in operating, designing and managing the franchise, but that offer is yet to be accepted.

Commons ChamberMy constituents are used to travelling on trains where there is a link between those who run the track and those who run the rolling stock, but that body is the publicly run Transport for London, and the Secretary of State refuses to allow it to have anything to do with the south-eastern franchise based on the fact that we have a Labour Mayor. My constituents deserve better than his petty political grievances. Will he allow TfL to demonstrate that it is capable of running the franchise more efficiently than the private sector has done hitherto?
I would make two points. First, Transport for London does not run the track and the trains. The trains are run as part of a franchise by Arriva. Secondly, I can assure the hon. Gentleman that what we have outlined today—more services and longer trains on the south-eastern line—is a lot better than what TfL offered in its business plan. My concern is to deliver a better service for his constituents rather than unnecessary political shuffling.

Commons ChamberI do not normally like to differ with my right hon. Friend, but I am very clear on this: CH2M has done the right thing in taking a step back, having identified a problem that would have called into question whether it could and should operate the contract. It was not some massive misdemeanour, but an error in process that has caused CH2M to take a step back. It is now for the board of HS2 Ltd and its independent directors to make sure that they do the right thing in taking the contract forward. From the country’s point of view, it is important that we get on with the job. We will have all the necessary governance in place as we go through the process of replacing CH2M, but we do need to get on with the job.
My constituents have endured all the disruption and chaos while the Thameslink work is going on at London Bridge, and they did so in the expectation that they were going to get an improved service. They are now incandescent with rage, because the new franchise proposes cutting services to Charing Cross and Victoria and reducing off-peak services. This is unacceptable. Will the Secretary of State agree to meet me to discuss the matter?
The whole point is that it is a consultation. We have not taken any decisions, and we do not even have an intent. It is about asking people, “There are ways of running this railway that could potentially make it more reliable. What do you think?” If the answer is, “We don’t want you to do that,” we will listen. My focus for the hon. Gentleman’s local passengers and for those local railways is to deliver more capacity, the best possible reliability and, in particular, longer trains. All those things are firmly on our agenda.

Commons ChamberFranchising has been instrumental in improving the railways for passengers and as part of the enormous growth in rail usage since privatisation 20 years ago. Our approach to rail reform is about delivering an improved service for passengers through better teamwork between Network Rail and passenger rail franchises, and making Network Rail more customer focused by giving more power to its local route managers.
We now know that the Secretary of State is putting politics before the interests of passengers, and he is taking a dogmatic approach by ignoring what could improve our railway system. He has refused to allow the Mayor of London to take over suburban services, in spite of the fact that his predecessor thought that that was a good idea. The public are in favour of public ownership: 58% of people polled by Transport for London are in favour of the Mayor having greater control over suburban services and only 14% support his position. Is it not time that public ownership of our railways was considered by the Government, and are not the public in favour of it?
It is hardly a surprise that Conservative Members for constituencies outside London have doubts about a Labour Mayor inside London running local services, particularly when the Mayor delivered a business plan that did not offer improved capacity and was founded on a lot of uncosted promises. So far from this Mayor, we have seen a fare freeze that was not a fare freeze and a London of no rail strikes with a rail strike last Monday. I do not take the Mayor’s promises at face value, I am afraid. We have taken a partnership approach that also listens to the people of Kent, who are equally important in this franchise and said they should be equal partners with the people of London in designing it.

Commons ChamberI think the message that Britain is open for business is one of the most important messages that we can send to the world. When are we ever going to create this gateway to the future if not now, at a time when we are changing our role in the world? I think we all regret the fact that, notwithstanding our ambitions, it still takes time to do, but we really must get on with it now.
The Department’s answers to questions that I tabled asking what protections there were from noise pollution at City airport for constituents such as mine were woefully inadequate. It is clear that once expansion has taken place there will be scant regard for protections for the public, whether from industry or the Government. It is hardly surprising that people roll their eyes when the Secretary of State comes here and tells us that there will be all these environmental protections. In order to convince people that he is in earnest, would he be prepared to make those requirements legally binding, with penalties in place, before any permission is granted for this expansion, so that people can be confident that there will indeed be environmental protections?
My view is straightforward. The commitments that are made in relation to compensation for the public and amelioration must form a binding part of the eventual agreements.

As far as I am aware, Mr Speaker, we are having a debate where everybody’s views are being put forward, on both sides of the argument, and that is going to carry on for another three months.
I am racking my brain trying to think of a previous occasion when the Leader of the House has agreed so readily with the right hon. Member for Sheffield, Hallam (Mr Clegg). Surely the Leader of the House must accept that the Justice Secretary’s failure unequivocally to state that he had nothing to do with this is the reason he is answering this urgent question now. Should the Justice Secretary not either make such a statement or resign?
So the hon. Gentleman is asking the Justice Secretary to say that something that did not happen did not happen—that just does not make any sense.

Commons ChamberMy hon. Friend makes an important point. There is a curious irony, given who controls her borough council. The Liberal Democrats argue for openness, but do not necessarily deliver it when in power. I am sure that if the decisions they take are as opaque as she is suggesting, they will not be holding that power for very much longer. It is of course important that local government is transparent, explains the decisions it takes and sets out why, when it has had to take difficult decisions, it has chosen that route rather than any other.
Yesterday in Westminster Hall we had a debate about the chaos on Southeastern trains. The Minister gave us some reassurances that things were improving, but last night I got a phone call from a concerned constituent who was on a train. He was told by the driver that the signallers had mistakenly put the train on the wrong line, so it would not be visiting any of the stations the passengers on the train intended to go to. My constituent said to me, “We are used to the chaos, but this is downright dangerous.” May we have a statement from the Secretary of State for Transport about safety on our railways and, in particular, Southeastern? This is going too far.
Obviously a situation like that is unacceptable. Every service is occasionally subject to human error, but nobody would seek to defend a situation of that kind. The Secretary of State for Transport is here on Thursday and will be able to take questions on the challenges in relation to Southeastern trains. They are, to a significant degree, being generated by the huge investment we are putting into London Bridge. That means some disruption in the meantime, but it will mean a better service for passengers in the future.

Commons ChamberRaising an issue in business questions can be effective and I hope that my hon. Friend will take comfort from the fact that his raising this issue last week has led to the changes he suggested. The Chief Whip and I have been talking about how to address what are issues for many hon. Members. We will, of course, revert to them shortly and I thank my hon. Friend for the work he has done in raising this and other issues.
My constituents have been suffering all week from cancelled trains because of a landslide on our local rail line. Can we have a statement from the Transport Secretary, because the knock-on effect is complete chaos on all lines? People have received no information from Southeastern about when the service is likely to be reinstated and they are suffering trying to get to and from work. Businesses are also suffering, so we really need someone to get a grip of the situation.
I absolutely understand the problems that such events cause the hon. Gentleman’s constituents and, indeed, others. Other parts of the network have also suffered in recent weeks because of extreme weather. I will make sure that his concerns are drawn to the attention of the Transport Secretary this morning. The Transport Secretary will be here in 10 days’ time, but the issue is clearly urgent so I will make sure that the hon. Gentleman’s concerns are passed on immediately.

Commons ChamberI note what my hon. Friend and others have said today. That is something the Government will have to take into account as they consider how best to respond to the report, so I thank him for his contribution.
Thank you, Madam Deputy Speaker, and merry Christmas to you and to everyone in the House. The power under discussion is one that the Lords seldom use. The fact that it has been used so rarely in its history probably proves why it should be there for a House that is required to make the Government think again. The Lords knew that what the Government had claimed at the Budget was wrong, and they discovered with the benefit of hindsight that the claims of the Chancellor that people would not be worse off were incorrect, and that working families with children would have been thousands of pounds a year worse off. It was not just the Opposition who were pointing that out to the Government. A significant number of Government Back Benchers were doing so as well. The Lords listened to that and used the power that they rarely use to make the Government think again. The Chancellor came back to the House and wanted to be cheered for saying that he would never do it again. The Lords were proven to be correct, so the power was proven to be useful. This is just a spat and a tantrum from the Government because the Lords had the temerity to make the Government think again.
I remind the hon. Gentleman that the changes that he is referring to were voted on and passed five times by this elected House. There comes a point where the elected House needs to be able to assert its will. Lord Strathclyde has recommended a number of options that enable it to do that.

Commons ChamberFor any organisation to link the swastika to Prime Minister Modi in a demonstration in this country is unreservedly unacceptable. We have close relations with India and I would condemn any such action. I am also aware of the incident to which my hon. Friend refers. It is not yet clear that that was an actual incident as opposed to a creative use of computer technology to create the sense that it took place. If he has information that suggests that it did, I think that you, Mr Speaker, and I would be very glad to see it.
May we have a debate on cuts to the police? The Metropolitan police is making clerical staff redundant and filling those posts with warranted officers. That flies in the face of the Government’s policy of making police more visible to the public; I assume that the Met will adopt a policy of moving desks closer to windows to fulfil that requirement. May we have a debate on that, as it is seriously depleting the number of officers available in our communities?
I think the hon. Gentleman is a couple of weeks late. If he listened to the autumn statement, he will have heard that we are not cutting police budgets. It is a matter for the Mayor and the Metropolitan Police Commissioner to decide how to spend their budgets most effectively in the interests of the citizens of London and I will not seek to tell them how to do so. We have not cut their budgets; we have actually protected them.

Commons ChamberI am shocked that we have not yet heard that the Health Secretary will make a statement to the House. The Leader of the House indicated that he would, but it would not be good enough for him to do that tomorrow, hiding it away on a Friday, when many Members will be back in their constituencies. A statement would give him an opportunity to correct his assertion from the Dispatch Box that patients have to wait more than 14 hours to see a consultant at weekends. That has been disproved. The only people who now believe it are the Government. When are we getting this statement?
With respect, the result of the ballot was announced only a few minutes before the sitting. I have secured a commitment from the Department of Health that a Minister will make a statement shortly, and no doubt that will give the hon. Gentleman an opportunity to ask his questions.

Commons ChamberBecause I value the strength that this Chamber brings. To take away its remit over English matters would be to devalue it. We need to ensure that there is fairness in this Parliament; we do not need to dismantle our constitution to the point where we have an English Parliament as well.
I will give way one more time and then I will conclude so that other people may speak.
In 1997, the incoming Labour Government had devolution in their manifesto, which is similar to the position of the current Government, but there was extensive consultation before they created a Parliament and two Assemblies. What we have here is a shabby little alteration to Standing Orders. How is that suitable for the people of England, even for those who agree with what the right hon. Gentleman has to say?
The hon. Gentleman clearly did not read our manifesto and clearly did not pay attention to what took place before the election, because these proposals were published months ago and have been discussed extensively. They were also set out in fine detail in our manifesto. He is claiming that we should not be implementing our manifesto commitment. There may be other parties in this House that do not believe in fulfilling their manifesto commitments, but we do.

May we have a debate on the role of the National Crime Agency in preventing harm to children? I have been raising my concerns about a substance called Miracle Mineral Solution, which is being promoted particularly to parents of children with autism as a cure for that condition. I have been asking the National Crime Agency why this is not considered a direct threat to children. It is being promoted as something that can be given orally in a baby’s bottle or even as an enema. May we have a debate to ensure that the National Crime Agency is on top of issues like this?

Commons ChamberLet me start by paying tribute to my hon. Friend for his work in establishing a national network of work clubs. Several hundred are now up and running around the country, some with a degree of help from Jobcentre Plus and others with none at all. I hope that this strong network of organisations will make a real difference to people looking for jobs, and that their number will continue to grow.
I opposed changes to Remploy made by my own party in government which resulted in the closure of my local factory in Woolwich. Before the Government implement any further changes under the Sayce report that may result in more closures of Remploy factories, will the Secretary of State contact the former employees of that Woolwich factory, and write to me telling me how many found jobs and are currently employed?

Before I conclude, let me briefly touch on a couple of points raised by hon. Members. The Chair of the Work and Pensions Committee, the hon. Member for Aberdeen South (Dame Anne Begg), raised the issue of contributory ESA. I want to make two points to her. The first is that all those who move off incapacity benefit who fit into the contributory bracket will be given access to the Work programme regardless of their status. That is important in ensuring that they receive back-to-work support. However, I would also remind her that the changes to ESA simply bring it into line with JSA. It is a simple principle that, if someone has financial means in their household, the state will not support them. The state will be there to provide a safety net for those who do not have the means to support themselves. That is a sensible principle. We have extended the period beyond six months, so that we can deliver support to people with health problems, but it is sensible to have an aligned system. I will be happy to talk further with the hon. Lady in Committee or in the Select Committee.

Commons ChamberWill the Secretary of State give a guarantee that every job that is found through any Government-backed scheme to move someone from benefits into work will be paid at or above the national minimum wage?
Self-evidently, if the providers who work for us under the Work programme are successful in getting someone into work, we will reward them on the basis that they provide post-employment mentoring and stay with the person to ensure that they stay in work—
Of course, by law, they will have to pay the national minimum wage. That is the requirement for any employer in this country; it is not going to change.
