Commons ChamberI met the First Minister and the Deputy First Minister last week. We had a constructive discussion about the Executive’s priorities.
The public’s relief at the restoration of the Assembly has given way to frustration at the lack of pace of delivery by the Executive. After a two-year void, they are saying they do not want to be hurried to deliver for the people of Northern Ireland. Pressed healthcare staff, people waiting for special educational needs services, and those watching Lough Neagh face another summer of algal blooms are very much in a hurry for action. Northern Ireland urgently needs a delivery plan, a programme for Government and a budget. Yes, resources are a part of that, so will the Minister update us on any negotiations on the fiscal framework? Will he impress on the Executive the need for urgent action, not just warm words?
One thing that I picked up from the First Minister and the Deputy First Minister last week is that they too want to act in all the ways the hon. Lady said. Their priorities include developing a programme for government that will enable them to take forward the vital work of public service transformation. They are only 12 weeks in, and I look forward to good results in the short, medium and long term.

Commons ChamberI thank my hon. Friend for his question, and I absolutely, 100% agree with his sentiment. It is a real pleasure to see the devolved institutions at Stormont up and running. You, Mr Speaker, have a new colleague there: the former Speaker was desperate to retire for two years—tributes were paid to Speaker Maskey at the time—but Speaker Poots is now in place. It has been wonderful, too, to see the new First Minister and Deputy First Minister working together to achieve good solutions, on public services and a whole host of other things, for the people of Northern Ireland. The Union is best served by devolved institutions working. I very much welcome everyone’s commitment to that cause.
This morning’s High Court ruling confirms what every fair observer knows: that the Government’s legacy legislation is not compatible with human rights. It puts the needs of perpetrators ahead of the needs of victims, and it is not supported by any party in Northern Ireland or across the island of Ireland. The Secretary of State cannot truly believe that it serves the rule of law or our shared future in any constitutional arrangement. When will the Government repeal that completely unacceptable legislation?
I thank the hon. Lady for her question, but I am afraid that she will have to refer to the answer I gave earlier. The Court judgment was handed down only earlier this morning; it is a complex case and we have more than 200 pages of judgment to consider. I do not even believe that the Government KC has gone through the ruling yet in any great detail. We were not given any notice beforehand of what might be in it, but obviously I pledge that we will consider Mr Justice Colton’s findings carefully. As I will continue to say, we remain committed to implementing the Northern Ireland Troubles (Legacy and Reconciliation) Act 2023, including delivery of the ICRIR.

Commons ChamberVery few have shown support for this legislation, but I have met many, as has my Lords Minister, Lord Caine. In fact, part of the process of changing the Bill has come from those conversations. I understand that lots of families do not want this Bill, but the question then is: if not this Bill, then what? [Interruption.] The hon. Member for Foyle (Colum Eastwood) says “Stormont House”, but he knows that Stormont House did not have cross-party agreement at the time and that the Ulster Unionist party did not agree to it—
Would the Minister acknowledge that it did have cross-party support—the Ulster Unionists deferred on one small matter—and that it was recommitted to by his Government and the Irish Government as recently as January 2020?
And it did not move forward because of the different political issues that came about.
I understand that point and, again, that is the purpose of all the amendments we have made. The hon. Gentleman will know that I was not comfortable with the Bill that I inherited because, as there would be a gap in investigations, I did not believe it could be article 2 compliant. Amendments have been introduced that completely change that and I believe that the Bill is now compliant, but that will undoubtedly be tested. Only when it is tested and the results come forward can anybody actually say that the Bill is article 2 compliant, as Government lawyers truly believe it is.
The Secretary of State was unhappy with the Bill he inherited, which is the context of the amendments and changes that have been made to this Bill. Has he consulted with the chief commissioner-designate on the Lords amendments he is rejecting today? If the chief commissioner-designate was consulted, did he agree to reject the amendments?

I thank the right hon. Gentleman for his question. I hope he will forgive me for pushing back slightly, but I think I have been particularly clear on this, and all of this could be solved much more easily if there were an Executive in place. I very much hope that that happens.
The last few weeks have been hugely damaging to hard-won progress in our still fragile society. Ordinary officers are feeling vulnerable and demoralised, and we are thinking of them and also of the families of the victims of the Sean Graham murders, who have been thrust into a political row that they did not seek due to a heavy-handed response. In the interests of officer morale and impartial policing, it is important that we know, following that Ormeau Road incident, who in the Northern Ireland Office spoke to the Chief Constable and, when the issue came up of Sinn Féin withdrawing from the Policing Board, what the NIO said to the Chief Constable.
If the hon. Lady would kindly nod to indicate whether she means in the last couple of weeks—[Interruption.] I am afraid I will have to come back to her with that answer, if I may, because I do not have those details.

Commons ChamberToday is a day of reflection in Northern Ireland. It marks an opportunity for people to think about the tragic and needless loss experienced by so many families during the troubles. It also allows us all as a society to reflect on how far Northern Ireland has come from the most difficult days of the troubles, and the further work required to ensure that we never again return to violence and that Northern Ireland is a truly peaceful, prosperous and reconciled society, which is something this Government are determined to deliver.
If I may, Mr Speaker, I would like to note that my permanent secretary since January 2020, Madeleine Alessandri, is leaving the Department next week for another role within Government. I would like to place on record my thanks to her for all the help and guidance she has given me and everyone else over the last 10 months.
In answer to the question, in his spring Budget the Chancellor stated that Northern Ireland would receive Barnett consequentials for 2023-24 and 2024-25 as a result of increased UK Government spending on childcare policy reform in England.
The Secretary of State may be aware that there is no childcare strategy in Northern Ireland and very little support, which is placing many families under extreme financial pressure because of growing costs, exacerbating inequality among children and forcing many, particularly women, to abandon their career for years. Research by the advocacy group Melted Parents demonstrates that families in Northern Ireland have been consistently failed on this issue. Does the Secretary of State agree that childcare must be recognised as a core part of the economic and societal fabric, as well as a tool to give kids a great start in life? Will he support the Department of Education and others to ensure that families in Northern Ireland can finally access the benefits promised in the Budget, promised in New Decade, New Approach and promised before that as well?

Commons ChamberIt is kind of the hon. Gentleman to admonish my Department. I think he will find—this is a problem that politicians have—that I did stand outside the Northern Ireland Department and knock back joint authority within a few hours of it being mooted, but I had also said a couple of other things that seemed to catch the public’s eye rather than that. Our focus is on ensuring that the institutions in Northern Ireland are able to deliver on the priorities of its people, which means that our first priority must be restoring the Executive. The people of Northern Ireland deserve a stable and accountable devolved Government and we will continue to work tirelessly to secure that objective. I hear what he says about other commentators. He will understand that there is a massive international focus on what is going on in Northern Ireland. I, like him, intend to ensure that all strands of the Belfast/Good Friday agreement continue to be agreed to.
We believe strongly and hope that a fair deal is available between the EU and the UK that will satisfy all people of all identities and all economic sectors, if parties will just lead and compromise, and not spend their time on misinformation and disinformation. I believe that that is what the people of Northern Ireland want. For many years, people of my background faced the jibe that we did not want to make Northern Ireland work. We desperately do, but, unfortunately, the party in front of me, the Democratic Unionist party, will not allow that at the moment. Let us consider the following:
“it is wrong…in a democracy, that one party, representing…25% of the people, is able to veto the establishment of a Government. That is not democracy”.
Those are not my words but the words of the right hon. Member for Lagan Valley (Sir Jeffrey M. Donaldson), whose party represents 21.3% of the voters. Will the Minister confirm that he will allow the exploration by all parties, in a transparent and inclusive way, of reforms of the Assembly, if necessary, to incentivise compromise and allow those of us who want to serve the people to do so together?
I am new to my glasses and when I looked up as the hon. Lady was talking about the people in front of her, I saw the Lib Dem Member here, the right hon. Member for Orkney and Shetland (Mr Carmichael), and I thought, “I am so sorry that you have been holding up so much progress in Northern Ireland for some time.” He is a great man so he will understand the point. I hear what the hon. Lady says. I will not be stopping any debate on anything. The one thing I have learnt quickly in Northern Ireland is that it is impossible to stop any sort of conversation or debate, so I will not even be trying.

Commons ChamberThe Executive do need to reform. That is very, very important. Whatever issues there are with the protocol, there are very important functions and services that the people of Northern Ireland need to work, so the Northern Ireland parties need to form an Executive as soon as possible. The protocol has put up barriers to trade and other things. We can fix them through negotiation, but if we cannot, we will fix them through legislation.
I welcome the Minister to his new role. We are concerned about his politics, but the SDLP will work constructively with anybody to get solutions. He will be aware of the absence of a fuel poverty strategy and that UK-wide solutions do not account for the fact that 68% of Irish homes run on oil. They are proof that Stormont caretaker Ministers either cannot or will not see Northern Ireland through the cost of living crisis. We are concerned that the only trick up the Government’s sleeve appears to be one that will alienate a majority of Northern Ireland voters and parties, but we ask the Minister to commit to working constructively with all parties, with all identities, to get us through this impasse and see the people of Northern Ireland through the winter.
I thank the hon. Lady for her question. She had some experience of working with me when I had my Foreign Office role at the beginning of this year. I would like to think that we did work constructively together. I demonstrated that I will happily work with all parties and all communities in Northern Ireland and I intend to continue in that frame as I move forward.
