I take it from the ruling you have just made, Madam Deputy Speaker, that, unfortunately, there was no application for an urgent question on the matter that my right hon. Friend raises. If there had been such an application, in the circumstances it is likely to have been granted. Perhaps the Government, when thinking about whether they will make a statement, should take into account that so far they have been very lucky that there was not an application for an urgent question in the required timescale. They were probably prepared for such an eventuality, so it would be reasonable for the Government to come along and volunteer a statement, as my right hon. Friend has requested.

You are quite right, Madam Deputy Speaker, to emphasise the importance of the Bill we are discussing. This is not the only occasion when, compared with what is happening in the rest of the world, the legislation we are discussing seems to many people to be relatively unimportant, but pet abduction is a very important subject for those who are directly affected by it.

Before the point of order, I was seeking to make the point that people should not be charged or arrested for dog abduction if it is clear at the time of the initial investigation that, at the time of the taking or detention of the dog, the person who took or detained the dog, the person from whom lawful control was taken and the dog all lived together in the same household. Why should a household in that situation be faced with having to defend themselves against arrest and prosecution by using this defence? Surely it would be better and fairer to require that someone only commits an offence if they abduct a dog without lawful authority or a reasonable excuse. That is the background to my putting forward new clause 1. We increasingly put the cart before the horse in accusing people of crimes and then forcing them to defend themselves against the allegations, instead of requiring the prosecuting authorities to look into possible defences or excuses before making an arrest or instituting a prosecution.

Amendment 2 is designed to test out whether an offence is committed if a dog is not permanently removed from someone’s lawful control. I look forward to hearing the Minister’s comments in response to that.

Amendment 3 is designed to ensure that an offence is committed only where a dog is removed from the lawful control of its registered keeper, rather than where it is taken from any other person. I know it will be said that if someone is a dog walker or running some kennels and is not the registered keeper, the offence of pet abduction should equally apply, but in those circumstances the more serious offence of theft should be applied under the Theft Act 1968. Again, that would emphasise the distinction between somebody who is a registered keeper and whose details are set out on the microchip database, and another person to whom the dog has been given for safe keeping, for whatever reason.

Amendment 4 would test out the distinction between the requirement of permanence where someone is depriving an owner of their dog, which in essence comes under the Theft Act 1968, and the less stringent requirements under this Bill. Amendment 5 is a similar amendment to ensure that only where a dog is detained so as to keep it from its registered owner would there be an offence. Amendment 6 is consequential on amendment 1, and amendment 7 is consequential on amendment 6.

I suspect that the incidence of theft of tortoises is much higher, if we look at the percentage of thefts in the relative populations. My hon. Friend says there were only 379 cases of cat theft, and my understanding is that there are 10.5 million cats, so if we work out the percentage of cat owners who find that they have been deprived of their cat, I suspect that it is much lower than the percentage of tortoise owners who find that their tortoise has been abducted.

However, I think what my hon. Friend’s point shows is that, in the context of 10.5 million cats, 379 thefts is hardly a really serious issue. He is a cat owner; I am not—my family are dog lovers, but the two are not necessarily incompatible. I recognise the importance of microchipping cats. Obviously, this legislation will not get on to the statute book until after the microchipping of cats has become mandatory, and until there are criminal penalties if that is not complied with.

I am proud to have visited the premises of the Cats Protection League in my constituency, in Ferndown, which is a very important centre for the rehoming of cats, and that is one of the great tasks that that important charity undertakes. I am not against cats, but I tabled this amendment to test the Government’s thinking. The original taskforce set up to look into these issues reached the conclusion that dogs should take precedence, but the Government subsequently gave way because of behind-the-scenes lobbying by interest groups—not as a result of public consultation—and supported the extension of the legislation to cats.

The taskforce’s advice was to start off with dogs and then extend the measures to cats. All I am doing is, in a sense, repeating what the taskforce said. The essence of my amendments 10, 11 and so on is that they would enable cats to be included at a later stage under the provisions of clause 3, thereby bringing the Bill into conformity with the recommendations of the pet abduction taskforce. If the Government do not want to do that—I understand why they may not—then so be it, but I still think that is worth exploring in debate. That is why I tabled the amendments, including amendment 13, which is consequential on the removal of clause 2, as are amendments 14 and 15.

The next amendment on the amendment paper is amendment 19, in the name of my hon. Friend the Member for Southend West, who promotes the Bill. She says:

“This is a technical amendment to ensure that it is clear how the commencement of clauses 1 and 2 operates in so far as those clauses extend to England and Wales (rather than just in relation to England).”

Who could possibly object to that? However, when Back Benchers bring forward legislation and do not get it drafted by Government lawyers, there is always something faulty with it, and Ministers delight in saying at the Dispatch Box, “We agree with the intent, but the wording is inadequate.” The question I throw out for debate and discussion is this: why did the Government lawyers who drafted the Bill for my hon. Friend not get it right in the first place? Why did they leave it until so late in the day before insisting that this amendment, and Amendment 20, be included in the Bill? When she addresses her amendments, I hope that she can explain the background to that situation. It shows that instead of being all-knowing and beyond criticism, Government drafters have some of the same frailties as Members of the House when trying to draft legislation, even with all the expertise that the Public Bill Office is able to bring to bear when assisting us in that task.

Amendment 21 links back to my new clause 1, which would make the commencement of the legislation contingent on the necessary guidance having been issued. From discussions I had with the ministerial team, it seems that is the intent, but the amendment would put that in the Bill. Amendment 16 is consequential, and I have already referred to amendment 20, in the name of my hon. Friend the Member for Southend West.

That is a quick run-through of the amendments. I hope it will generate a proper debate and discussion, and enable people who take an interest in the matter to become more familiar with the issues around microchipping, including the importance of ensuring that cats and dogs are microchipped, the burden on the enforcement authorities, and the deterrence that microchipping provides against those who are minded to engage in the theft of pets. I hope those issues can be shared more widely across the country. There is a lot more detail behind the Bill, but there is no need for me to go into any more of that at the moment. If the Government cannot accept new clause 1, I hope they will be able to provide undertakings that its measures will be implemented voluntarily.

Thank you, Madam Deputy Speaker. That is very wise advice.

I take the hon. Lady’s point, but the Government were reluctant to concede, at the beginning, that there might be risks associated with all this. Now, we have seen that some people have been adversely affected and, in certain circumstances, have even lost loved ones. We would expect the Government to look after people who have been adversely affected, which was the whole ethos of the vaccine damage payment scheme when it was set up. The Government are falling down on their responsibilities on that and, as a result, that is adding to vaccine hesitancy. The proportion of people who are accepting invitations from the health service to have yet another booster is plummeting, because increasingly people realise that in their particular circumstances the risks may outweigh any possible benefit.

I thank the hon. Gentleman for giving way. The Chamber asks for a link. We know that the excess deaths are predominantly in cardiac arrests, heart problems and strokes. We know that the vaccine works supposedly by inducing human cells to produce spike protein, to be attacked by our own immune system and create the immune response. We know that the vaccine does not stay in the arm. It travels all over the body through the blood supply. Blood vessels are lined by endothelial cells. The mRNA goes into them and makes them creates a spike. They are attacked by the immune system. That explodes into the blood supply and that is a blood clot. If it goes to the heart, you have a heart attack; if it goes to the brain or the lungs, you have a stroke or a pulmonary embolism. That is the link. [Interruption.]

The hon. Gentleman has put on record what he wanted to say in that intervention. All I am saying is that, as the chairman of the all-party parliamentary group on covid-19 vaccine damage, I receive a large number of letters, not just from my constituents but from across the country, from people who have been adversely affected. I do not think anybody is challenging the authenticity of their circumstances or the complaints they make.

I am going to close—I know a lot of other people want to participate in the debate—with one such letter that came not from one of my constituents, but somebody else. She gives her name, but I will not repeat it. She says:

“After receiving my covid-19 vaccination, I experienced severe adverse reactions that resulted in hospitalisation. These reactions encompassed stroke-like symptoms, including seizures, tremors, inability to work or talk, irregular heart palpitations, low oxygen levels, vertigo, brain fog, memory loss, balance issues, tingling, high blood pressure and more. Despite undergoing extensive examinations, a recent diagnosis of Functional Neurological Disorder has highlighted my ongoing struggles with headaches, declining eyesight, and daily seizures.

Before vaccination, I was a healthy 34-year-old; however, now I am severely disabled, unable to work, and filled with uncertainty about my future, especially with the imminent arrival of my baby. Unfortunately my situation is not unique; thousands of individuals are suffering similar consequences. Despite assurances of safety, many have been left with life-altering disabilities or worse. I am writing to urgently request an investigation into cases like mine to address the impact of vaccine-related injuries.”

She goes on to give the batch number, and to quote the rather lame response from the MHRA.

Hunting Trophies (Import Prohibition) Bill

That is what unites us. The disagreements across the House are on the means to the end. Everybody wants to have better conservation of endangered species and wildlife in Africa. Like the hon. Member for Eltham, I have had the privilege of going on safari in Africa—indeed, in South Africa—on two separate occasions. One was in about 1984, when it was pretty hard to find the wild animals we were looking for in the game reserves. When I went again, about 18 months ago, there was an abundance of rhinos, giraffes, elephants, lions, leopards and so on. We had the most amazing experience. People used their cameras, and they relied on the protection provided by the excellent team that looks after and conserves that safari park or game reserve.

We could see with our own eyes that people were trying to poach the animals that were being looked after, and the cost of anti-poaching measures is incredibly high. How will that cost be funded unless it is paid for by the people who are engaged in the conservation? One small means by which they raise funds is by allowing the collection of trophies, and almost all the trophies that are not kept in Africa are imported into the United States, Spain or Germany. Very few are brought into this country.

Whatever happens to this Bill, trophy hunting will continue—but it may not include the import of a small number of trophies into this country under a licensing and regulatory regime that has stood the test of time. Instead of regulation, we will have an outright ban. Why are we doing that? The 2021 impact assessment in respect of an earlier Bill said:

“Why is government intervention necessary? Government intervention will address public concerns about imports of hunting trophies from endangered animals.”

Essentially, the Government’s impact assessment admits that this is about presentation, virtue signalling and pandering to public opinion, whether or not that public opinion is sound.

Let us take ourselves back to when the Government and Parliament took the view that we should abolish capital punishment. At that time, a vast majority of the population took the view that we should keep capital punishment. If we had applied the principle that is being applied to this Bill, we would still have capital punishment because it would “address public concerns” about people being murdered. We, in this House, need to rely on science and fact, rather than allowing prejudice and ignorance to prevail, which is one of the reasons why I hope the Bill will be improved, if it receives Second Reading today.

Section 4 of the impact assessment, from paragraph 98 onwards, refers to the costs of this proposed legislation, which is the point that my hon. Friend the Member for North Herefordshire and I are seeking to get across to the Government.

The impact assessment says:

“A 2019 letter from 130 researchers described how in African countries that practice trophy hunting, more land has been conserved under trophy hunting than under National Parks, with hunting areas contributing to landscape connectivity. Some argue that restricting the import/export of trophies from hunting risks land conversion and biodiversity loss, and other alternative area management strategies must be in place to promote conservation, protect endangered species, and support livelihoods. Furthermore, many questions remain on whether alternatives such as wildlife tourism can effectively replace trophy hunting, especially in areas with poor political and economic stability, and areas with less aesthetic appeal.”

That is not what I am saying; it is what the Government said about the costs of this legislation when they did their impact assessment, which goes on to say:

“Wildlife conflict with local people can impose serious costs including causing physical harm and death, damaging crops, predating livestock and competing with livestock for food. Where wildlife provides few benefits to local people and/or imposes substantial costs, animals are often killed for food, trade, or to remove problem animals.”

That is a welcome recognition by the Government of some of the realities surrounding this subject, rather than the prejudices of people who have been ill informed by certain organisations.

In paragraph 100 of the impact assessment, the Government also concede that:

“Evidence suggests that trophy hunting can provide a value for animals which incentivises their protection for the purposes of hunting rather than indiscriminate removal, e.g. land use change to agriculture. Without trophy hunting, an income stream linked to positive conservation outcomes could be lost and other options need to be in place to address this conflict.”

That is what the Government said in their impact assessment, so I hope we are going to hear from the Minister how they will address the concerns that they recognised, if indeed they are still hell-bent on pushing this legislation through to try to get it on to the statute book.

The Government also conceded in their impact assessment—perhaps this is a point that my hon. Friend the Minister could refer to—that:

“A ban in the legal movement of animal trophies could have the unintended consequences, including increasing the illegal trade in wildlife parts which is unregulated. It could also reduce the amount of protein available to local communities as meat is often a by-product of trophy hunts. After a hunting ban in 2014 in Botswana one village lost the provision of 154 tonnes of meat, so less protein was available to the community. This resulted in an increase in illegal poaching and documented declines in wildlife.”

Those are facts. What is the Government’s response to the facts to which they referred in their own impact assessment in 2021?

The issue of costs is discussed in paragraph 102:

“One of the major arguments for hunting for trophies is that it provides financial benefits to local communities, and without trophy hunting these benefits could be lost. However, the extent to which local communities truly benefit is widely debated.”

Of course, that is the debate we are having today. Let us not take a view that all the people who support this Bill are lovers of animals and all the people who are against it despise animals. Nobody could be a stronger supporter of animals than I am. Indeed, my wife and I are proud that we have produced a daughter who is now a veterinary surgeon. Can one adduce any more evidence of the importance of inculcating into one’s children a love of animals that their parents share? Let us have none of this nonsense suggesting that this is not a vile activity and that those who are against this Bill should be subject to some sort of vilification. That is completely ridiculous.

Let me also refer to the letter to which my hon. Friend the Member for North Herefordshire referred from the Namibian Association of Community Based Natural Resource Management Support Organisations. The letter was sent to all British MPs, and I am disappointed that more of my parliamentary colleagues who will have seen that letter are not present. One asks rhetorically, what have they done as a result of the points made in it? Mr Louis says:

“Please do not regard Africans as being incapable of deciding our domestic policies. The reason we have legal hunting is that it pays for protected land for our big animals. As our human population grows, it is crucial for our lions and elephants to have such space.

Our rhinos also require armed guards to safeguard them from ruthless poaching gangs financed by Chinese criminals. When there are no guards, massive numbers of the animals get killed by these brutal gangs. Legal hunting pays for the guards and kills far fewer.”

When we as a family were in South Africa, we saw the consequences of what happens with rhinos. To try to disincentivise the illegal poaching of rhinos, the rhinos are de-horned, but such is the value of rhino horn now, even from dead animals, because of ill-conceived bans on its use, rhinos are now being poached just for that part of the horn that is no longer visible, which is part of an extension of the head. That is a consequence—an unintended consequence, obviously—of the restrictions on countries exporting the rhino horn from dead animals. That is why this is a very nuanced debate, and I am not sure we are getting as close to that today as their lordships were when they were debating the legislation on Report in their House.

This very important letter from Maxi Louis goes on to say:

“The evidence for this is in the peer-reviewed science which shows how successful Africa’s system is at defending our precious animals. People who have read this science—and back legal hunting—include the EU Commission”—

I am not sure that is his strongest argument—

“and George Monbiot”,

which is a stronger argument. He continues:

“So does the global regulator, the International Union for Conservation of Nature. We use legal hunting to manage our big animals because they are a mortal risk to us and our children. African lives are at stake.

You do not have any dangerous wild animals. Britain got rid of its last brown bears 1,000 years ago and its last wolves 264 years ago.”

In his conclusion, he says that

“wildlife in Africa is flourishing. Because of our management. We ask for no more virtue signalling. It is arrogant, ignorant and racist.”

I could not have put it better myself. That is why I am disappointed that the Government continue to pander to those who would fit into the description given by Maxi Louis.

I turn now to the amendment that was made to the Bill introduced in the last Session by my hon. Friend the Member for Crawley. In introducing this Bill today, the right hon. Member for Warley (John Spellar) did not refer to that, except to say that that amendment was in the proposed legislation, and that it showed how we had passed a Bill to the other place as a result of a consensus. That is one interpretation of what happened on that Friday when we were debating amendments on Report. Essentially what happened, as you may recall, Madam Deputy Speaker, was that there were a large number of amendments, and a deal was done whereby two of those amendments were accepted, and all the others were rejected. One new clause about setting up an advisory board on hunting trophies is now in the Bill, and I wish to speak briefly about the importance of that and the background to it.

Who will decide on issues relating to hunting trophies? I think we should have expertise, rather than people who are prejudiced. Clause 4 states:

“(1) The Secretary of State must appoint an Advisory Board on Hunting Trophies

(“the Advisory Board”).

(2) The Advisory Board appointed under subsection (1) may have up to three

members.

(3) The role of the Advisory Board is to advise the Secretary of State—

(a) on any question relating to this Act which the Secretary of State may

refer to the Committee;

(b) on any matter relating to the import to Great Britain of hunting trophies derived from species of animal which appear to the Secretary of State to be, or to be likely to become, endangered.”

That is an improvement on the original Bill, because it would require the Secretary of State to take advice, instead of just listening to the mob, so to speak, and I am pleased that that measure is in the Bill. Clause 4(4) states:

“In appointing members of the Advisory Board, the Secretary of State must have regard to their expertise in matters relating to the import of hunting trophies.”

One thing we discussed previously, which I do not think we have discussed today, is the extent of the Bill. The Bill extends to England, Wales, Scotland and Northern Ireland, but the prohibition on imports applies only to imports into Great Britain. Why is that, and why does the right hon. Gentleman, in limiting the Bill to imports into Great Britain, think that that will help meet his objective? Does it not show that we are no longer one nation of the United Kingdom, but that there will be a different regime in Northern Ireland, compared with the one that prevails in the rest of our country? I hope the Minister will be able to explain why, if the Government are in favour of the Bill, and if they purport to be a Government for the whole United Kingdom, rather than just Great Britain, they are proposing to restrict the import of hunting trophies into Great Britain and not into Northern Ireland. Perhaps it has something to do with the fact that there is an open border between Northern Ireland and Ireland, and that Ireland is in the European Union, which has a much more benevolent approach to the import of hunting trophies than this Government seem to have. That important issue needs to be addressed in the Bill, and I hope that if it goes into Committee, we can ensure that its provisions apply equally to all parts of the United Kingdom.

There is no need to speak at great length on something like this when the arguments against the Bill are so strong, but we should not vilify those people who engage in conservation measures in the way that some have been seeking to do. The proof of the pudding is in the eating. If we compare Kenya with other countries in southern Africa, we see that Kenya’s well-intended ban has been totally counterproductive, whereas in southern Africa there has been tremendous progress on the conservation of endangered species.

On a lateral point, is the collection of rare and endangered butterfly species illegal in this country? No, with very few exceptions. If we are free to pin butterflies to the wall or put them in display cabinets, does it suit us to preach to people in Africa about their conservation measures? I think not. We talk about the importance of culling, which is essential to control the numbers of a species in the restricted area of a wildlife park. We cull in this country, particularly deer. That culling can include the use of rifles to shoot the deer that people think have the finest antlers. Those antlers are kept as trophies. That is not my line of business at all, but I respect that other people might like to do that. It is all part of culling to ensure that we do not have too many deer to manage.

This complex Bill is worthy of further detailed consideration, but I am worried that the Government may have a secret agenda: they may try to use the Parliament Acts on this legislation. I would be grateful if my hon. Friend the Minister could assure me that under no circumstances will the Government seek to override the Parliament of this United Kingdom by seeking to use the Parliament Acts on a Bill that was rejected in the other House—not because it was voted down, but because not enough time was given for it. I am not sure that there is any precedent for the Parliament Acts being used when debate in the other place has been curtailed through lack of time, the Bill has been brought back in the next Session, and the Government’s failure to provide time is used as a justification for using the Parliament Acts. I would be grateful if the Minister could respond to that point when she winds up the debate.

Finally, let me put on record that I am against this Bill having a Second Reading in its present form. Hopefully, I will have the opportunity to vote that way later.

Pedicabs (London) Bill [Lords]

I am grateful to my hon. Friend, because in that case I am sure she will support an amendment, or perhaps draft it herself, to place on the face of the Bill exactly what she has said. At the moment, the discretion as to who should be consulted rests solely with TfL, which I think is ridiculous.

Let me expand a little on the point I was making about clause 5 and the need for clarification of what is meant by “a power-assisted pedicab”. Cycling UK believes that the potential pitfalls could be avoided through reference to the Electrically Assisted Pedal Cycles Regulations 1983 to define the vehicles that will be exempt from the legislative requirements for private hire vehicles. I hope that the Minister will take that point on board.

Cycling UK has made a number of other suggestions. It asks, for instance, what will happen about pedicab stands:

“Subclause 2(7) of the Bill currently provides for TfL to make regulations to limit the places, times and/or circumstances in which pedicabs may ply for hire or operate”—

Madam Deputy Speaker, I take your point completely, but this is not a situation where the Bill will go into Committee upstairs, the Committee will start with a couple of evidence sessions with people who are interested in the Bill, and members of the Committee will look at it. This is a situation where the Government have on the Order Paper a motion that all the remaining stages should be dealt with in three hours. There is no indication as to how much time there will be between now and the time that those stages are timetabled for this House. Therefore, I thought it would be helpful if I flagged up in advance some of my concerns about this Bill, to which I am referring in this Second Reading speech. As you know, Madam Deputy Speaker, a Second Reading speech can extend to things that are not included in the Bill, which is why I am referring to things that could be included in the Bill but which are not currently included—that is my intent.

That is extremely helpful. The hon. Gentleman is very experienced and is on the Panel of Chairs, and he understands a lot about procedure. Although he is flagging up issues, too much detail about the clauses would be inappropriate, but I am sure he is coming back to his main points. I just remind him that I have two other speakers to get in.

Fortunately, because there has not been much Government business today, we have a reasonable period of time for discussing the Bill.

To summarise the point I was seeking to make, Cycling UK says that the Bill grants powers for TfL to make regulations to limit this, that and the other, but there is no power to require TfL to provide places where pedicabs can have stands. Again, that seems to be rather asymmetrical or illiberal.

My final point is about the concern that Cycling UK expresses about the need for consistency between civil offences relating to the use of pedicabs and motor vehicles. Cycling UK refers specifically to clause 3(5)(a). I will not refer to that in detail, taking your advice, Madam Deputy Speaker, but I think there is sufficient meat in this Bill for us to have a very lively discussion in Committee and on Report. However, I hope that in advance of that, we will get a clearer view from the Government, and particularly from the Minister, about whether it is essentially their intent to stand by idly while giving powers to Transport for London, which does not exactly have a good record on all this, to exercise what the Government hope will be its good intent to facilitate a high-quality pedicab regime in London. We know jolly well that quite a lot of the people who are concerned about pedicabs in the city stop short of actually banning them altogether or introducing regulation that would have exactly the same effect.

It is, Madam Deputy Speaker. In answering my question about early-day motion 114, the Leader of the House said that she would write to the DEFRA Minister about it. However, when the subject was debated on 27 November in Westminster Hall, I asked the DEFRA Minister whether he would facilitate a debate on the statutory instrument, saying that it is

“obviously of great concern to many Members of Parliament and even more so to our constituents, before it comes into force on 31 December”.

The Minister for Food, Farming and Fisheries, my right hon. Friend the Member for Sherwood (Mark Spencer), responded:

“I thank my hon. Friend for that intervention. Of course he will be fully aware that it is for parliamentary business managers to arrange such debates, but I will certainly have a conversation with those business managers following this debate.”—[Official Report, 27 November 2023; Vol. 741, c. 223-24WH.]

I wonder whether that discussion ever took place. We are now in a situation where the Leader of the House says she relies on DEFRA to organise a debate, and a DEFRA Minister says it is for parliamentary business managers to organise. Who is in charge, Madam Deputy Speaker?

On a point of order, Madam Deputy Speaker. The hon. Member for Rhondda (Sir Chris Bryant) refers to the guide to the rules on all-party parliamentary groups. I went out to try to get a copy of this document from the Vote Office and was able to get one copy, but there were no other copies available. The Vote Office is currently trying to print more copies. Considering how few Members there are in the Chamber, it seems most unsatisfactory that we have such a small number of copies of the guide to the rules, which extends to a very large number of pages. Why can we not all see this before we reach a conclusion?

I have received no other complaints from hon. and right hon. Members that they do not have a copy. As the hon. Gentleman says, he has not been here for the whole debate, so he has not heard a lot of the other arguments. It is a bit discourteous to keep disrupting the debate in this way. We should allow the Chair of the Standards Committee to finish his speech without interruption through points of order, which is a poor approach when we are having a debate. The hon. Member for Christchurch (Sir Christopher Chope) is on the Panel of Chairs, so I hope he would understand.

Another unintended consequence is that, if a group is allowed only four officers, and one of those officers is appointed to the Government, or falls under a bus, the group will be unable to operate until it has had a formal meeting to elect a replacement. Does my hon. Friend agree that that is so rigid as to be unworkable?

I am indicating that I am referring to him in the debate, because he indeed gave me the Liaison Committee terms of reference and the press release, including the quote from himself. Since he is the Chair of the Liaison Committee, I am rather surprised that he has not made himself available to participate in this debate, particularly given that it is all about a much more important role for that Committee, which he has the privilege of chairing. I had not realised, Madam Deputy Speaker, when I rose to my feet at the beginning of this debate, that my hon. Friend was not actually in his place. I now see that he is not in his place but at the Bar of the House. But because of what you said—the debate perhaps started earlier than he expected —he will not now be able to participate in it and will have to rely on the Leader of the House to put the case, which he would otherwise be able to put himself, as to why this proposal does not amount to an expensive and unnecessary mission creep on the part of the Liaison Committee.

It is, in my view, probably unique to this Parliament that we have a Chair of the Liaison Committee who is not already the Chair of another Committee. I wonder how the members of the Liaison Committee, all of whom are Chairs of other Committees, will physically be able to get to grips with the enormous subject of the quality of strategic thinking across the world, because that is what we are talking about.

Will my right hon. Friend apologise for the delay in producing this impact assessment? Will he also explain to the House why the four countries of Scandinavia have been able to reduce the number of asylum applications from 239,000 in 2015 to 28,000 last year? Why have they been able to do that when we cannot? Why is our asylum process still taking longer than it ought to? The rate at which asylum applications are being dealt with is currently at its slowest ever.

On a point of order, Madam Deputy Speaker. May I seek your help? What can be done to force Ministers to honour commitments made to this House at the Dispatch Box?

On 24 March, during my Adjournment debate about covid-19 vaccine victims, the vaccines Minister—the Under-Secretary of State for Health and Social Care, my hon. Friend the Member for Lewes (Maria Caulfield), to whom I have given notice of this point of order—promised to come to an early meeting of the all-party parliamentary group on covid-19 vaccine damage. Despite exhaustive efforts, it has proved impossible to obtain any date from the Minister. We have offered any time, any place, but we cannot get any offer back from her or her Department.

Today I attended the inquest for one vaccine victim, Dr Stephen Wright, whose widow and mother heard the coroner confirm that Stephen’s death at the age of 32 was caused by the AstraZeneca vaccine. We heard earlier from the Paymaster General that the Government are very keen to hear the voices of victims. As it has now been more than six months since I have been trying to get Health Ministers to meet vaccine victims, the Paymaster General’s words do not ring very true.

This is just not good enough. We owe victims such as Dr Stephen Wright and his widow and children something more than the Government are currently giving. The Government owe them respect, which they are not currently receiving.

I thank the hon. Gentleman for his point of order. As he will know, it is not a matter for the Chair, but Mr Speaker does expect Ministers to keep commitments made in the Chamber. I know that the Ministers present—and the health Whip, who is also present—will take back the hon. Gentleman’s point, and I hope that that will lead to some progress for him.

I have tried to avoid—and have done so up to now—getting into the debate about the difference between sex and gender. I will not rise to my hon. Friend’s bait to try to develop arguments around that. The Bill, commendably, is specific to sex, and it leaves out gender. I will leave it at that if that is all right with my hon. Friend.

This brings me to the conclusion of my remarks. I will not say what my intentions are in relation to these amendments until I have heard from the Minister, which I hope, Madam Deputy Speaker, you will think is a reasonable approach to take.

I thank the hon. Lady for her point of order and for notice of it. As the House has agreed a Humble Address—an effective motion—that should be complied with. In other words, the Government should provide the documents that were demanded. Resolutions of this House have equal force whichever Member moves the original motion. If the only effective motions were ones moved by members of Her Majesty’s Government, Parliament would simply be, in effect, a rubber-stamping exercise and we might as well all go home. I reiterate that such motions should be complied with. I would not want to speculate at this point about whether or not the Government intend to comply—that would be hypothetical—but I am sure that those on the Treasury Bench will have heard what has been said.

On a point of order, Madam Deputy Speaker. Can you help us? What is the purpose of having named day questions if one Department—the Department of Health and Social Care—consistently does not comply with the requirement to reply to those questions in a timely fashion, to which the Leader of the House referred earlier? The most recent records show that only one third of the named day questions to that Department are answered on time. I have 12 outstanding named day questions to that Department that have not yet been answered, some of which date back more than five weeks, and we are now on the last day before the recess. What can be done to enforce the rules, particularly against the Department of Health and Social Care? Many of the questions are highly pertinent to people who want information about whether or not it is safe to take the covid-19 vaccine.

I thank the hon. Gentleman for that point of order. He raises an important issue that the Procedure Committee has looked at, and he might like to draw it to that Committee’s attention. He is quite right to say that the Leader of the House has indicated that Departments should answer questions in a timely fashion. We have just had business questions; it may be that the hon. Gentleman would like to raise the issue at a future session of business questions when the Leader of the House is present.

Further to that point of order, Madam Deputy Speaker. We have raised the issue before—in fact, Mr Speaker granted an urgent question on it and the Minister for Health had to come and answer it—but despite all the pleas from you, Madam Deputy Speaker, and Mr Speaker in the Chair, the Department does not seem to be responding. I am a member of the Procedure Committee and the statistics to which I referred are the latest statistics reported to that Committee. The question I ask is: what can be done to enforce the rules?

All I can say is that we have to persist, which the hon. Gentleman is clearly doing. He is not alone in his concern about this matter, as he has rightly said. On a point of order, Madam Deputy Speaker. I know that there was reference to current events in the last debate, which was moved by my hon. Friend the Member for Wellingborough (Mr Bone), and I wonder whether you and Mr Speaker have been able to express your views about the issues currently confronting the Government that relate directly to the separation of powers. I thought that it was this House that held the Government to account for their policies, not the Metropolitan Police.

As I made clear earlier, there is no reason for the Metropolitan Police to require Sue Gray not to issue her report in an unamended way for the benefit of the Prime Minister, who ordered that report, and of this House, which is eager to see it. It seems that the Metropolitan Police is usurping its position by seeking to interfere in the affairs of state without there being any criminals offences or grounds to carry out such interference.

With this it will be convenient to discuss the following:

New clause 2—Members of local authorities: disqualification relating to controlled

drugs offences (England)

“In the Local Government Act 1972, after section 81 insert—

81A Disqualification relating to controlled drugs offences etc (England)

(1) A person is disqualified for being elected or being a member of a local authority in England if the person is subject to a conviction relating to controlled drugs contrary to the Misuse of Drugs Act 1971.

(2) For the purposes of subsection (1) a person shall not be regarded as having a conviction until—

(a) the expiry of the ordinary period allowed for making an appeal against the conviction, or

(b) if such an appeal is made, the date on which it is finally disposed of or abandoned or fails because it is not prosecuted.””

New clause 3—Members of local authorities: disqualification relating to anti-social behaviour sanctions issued by the Court (England)

“In the Local Government Act 1972, after section 81 insert—

81A Disqualification relating to anti-social behaviour sanctions

(1) A person is disqualified for being elected or being a member of a local authority in England if the person is subject to a civil injunction made under section 1 of the Anti-social Behaviour, Crime and Policing Act 2014.

(2) For the purposes of subsection (1) a person shall not be regarded as being disqualified until—

(a) the expiry of the ordinary period allowed for making an appeal against the civil injunction, or

(b) if such an appeal is made the date on which it is finally disposed of or abandoned or fails because it is not prosecuted.””

This new clause would disqualify persons subject to an anti-social behaviour injunction from serving in local government in England, as consulted on by the Government in 2017.

Amendment 1, in clause 1, page 1, line 6, after “authority” insert “(except a parish council)”.

This amendment excludes parish councils from the provisions of Clause 1.

Amendment 2, page 2, leave out line 2.

This amendment (and Amendment 3) remove being subject to a sexual risk order from the list of reasons for disqualification from serving in local government in England, as consulted on by the Government in 2017.

Amendment 3, page 2, leave out lines 7 and 8.

This is an important Bill, and I think everyone supports it in principle, because it is designed to ensure that those in local government who fall short of the behaviour expected of them in a civilised society are disqualified from being able to participate in local government. My problem with the Bill at the moment is that it is very selective. It deals only with sexual offences, and does not extend to other offences which I think are equally important, particularly in the context of local councillors who have responsibility for road safety, for example, and also for social services and dealing with the scourge of illegal drug taking.

New clause 1 contains the first such addition that I want to make. It accords very much with the strategy of the Bill, which was set out by the current Chancellor of the Exchequer when he was the Minister for local government. In his ministerial foreword to the response to the consultation on updating the disqualification criteria for councillors and mayors, published in October 2018, he wrote:

“The Government considers there should be consequences where councillors, mayors and London Assembly members fall short of the behaviour expected in an inclusive and tolerant society… Elected members play a crucial role in town halls across the country, and are the foundations of local democracy. They are community champions, and have a leading role to play in building a better society for everyone.”

My view, reflected in new clause 1, is that councillors who fall below the standards expected in relation to drink and drug driving offences should be included in the category of those who are disqualified from being able to serve as councillors and mayors. I think that they fall four-square within the Government’s definition of having been convicted of behaviour which everyone in a right-minded society would say was intolerable. Why should people who are in that position be allowed to continue as councillors while other councillors who have been convicted of a different set of antisocial offences are excluded? That is the essence of new clause 1. If someone is convicted of driving or being in charge of a motor vehicle with excess alcohol or a controlled drug, they should not be able to hold office as an elected councillor in this country.

I thank the hon. Member for that point of order. First, I can confirm that if a motion is tabled for tomorrow night at five o’clock and if the hon. Member were to table an amendment and the Speaker were to accept it, the same process would be followed as has taken place tonight. I am sure that those on the Treasury Bench will have heard the comments of the hon. Member and will feed that back to the Leader of the House. Of course, it is business questions tomorrow, where this may be something that gets raised again.

It is a pleasure to follow the hon. Member for Liverpool, Wavertree (Paula Barker), although I do not agree with her obsession with trying to restrict free speech and information for the general public. Surely it should be for the general public to discuss and determine these things themselves.

The Minister referred to evidence, data and scientific advice as being the watchwords of the Government. Those words ring rather hollow with my constituents, because they regard that as spin rather than substance. Earlier today, I suggested to the Prime Minister at Prime Minister’s questions that the million-plus people who had tested positive for covid-19 and had recovered should be exempt from the regulations because their T cells would give them immunity for at least six months. That is the evidence provided by and published in The BMJ, and yet the Prime Minister seemed to cast doubt on it, despite the fact that that evidence was produced in collaboration with Public Health England and has won plaudits from the Medical Research Council.

One of the advantages of providing such an exemption is that it would deal with the people who are suffering from long covid, to whom the Minister also referred. In Sweden, they apply such an exemption. I know that any references to Sweden are anathema to the Government. Last time I mentioned Sweden, the Minister tried to pour cold water on my statistics. She was wrong, and I questioned her and have not had an answer. Again, I make no apology for referring to the comparable statistics.

In the past week, ending 17 November, there have been 85 deaths from covid-19 in Sweden. In the similar period in the United Kingdom, there have been 2,975 deaths. Taking into account the population difference, there are six times as many deaths per capita in this country as in Sweden, and that takes no account of all the collateral damage that we are causing to our people who cannot get access to healthcare, including 5,000 excess deaths from heart disease alone.

The Minister was saying that we talk about evidence. In answer to parliamentary question 111413, asking about the public health justification for refusing to allow the giving and receiving of the sacrament in places of worship, this is the answer I received:

“Public Health England had not been requested to research and publish detailed specific data on the numbers of COVID-19 cases related to place of worship and allied settings on outbreak investigation. This is now being performed.”

That answer came in 10 days after it should have done, but why was that work not done before? Why are we refusing to allow people to receive the sacrament in places of worship without any evidence in justification? Similarly, I asked about the difference between two people playing golf on a public golf course and two people walking a dog on a public footpath. There was no satisfactory response from the Government.

On another issue, while the Government say that people are at great risk if they go to play golf together, the greatest risk, it seems, is to have the misfortune to go to hospital and then contract covid-19. In answer to a question yesterday, I have been told by the Minister that in October alone there were 3,934 cases of people who went to hospital without covid but got covid while they were there, as a result of hospital transmission of infection. In October, in Poole hospital, which serves many of my constituents, 120 people were in hospital, and some 73 of them contracted covid as a result of infection within the hospital.

The question I ask of the Minister, therefore, is: when we get the vaccination, will someone getting a vaccination automatically be exempt from the lockdown rules? If not, why not? Also, when we get into discussing criteria for moving out of the lockdown, what will we do about false positive tests? If there are 500,000 tests a day and 5% are false positives, we will have 25,000 false positives. That is number enough to justify a continuation of lockdown—based on false tests. Surely that cannot be sensible policy for the Government.
