I thank Mr Speaker for granting this debate, which is the first such debate on the Vaccine Damage Payments Act 1979 since 24 March 2015.

Vaccines have been our major public health defence against covid-19. This debate is not about all those millions who have benefited from vaccination; it is about the tens of thousands who did the right thing, were vaccinated but then, as a result, suffered death, serious injury or other life-changing adverse consequences. The vaccine damage payment scheme was extended to cover covid-19 vaccinations in recognition of the potential importance of this issue.

I am delighted that the Prime Minister also clearly believes that this is an important issue. On 11 August last year, he wrote to Kate Scott, whose husband Jamie, a fit 44-year-old software engineer, spent 124 days in hospital following severe brain injury caused by the vaccine. The Prime Minister said, referring to Kate’s husband Jamie and his family from Warwickshire,

“you’re not a statistic and must not be ignored”.

The Prime Minister went on to thank Kate Scott for her suggested changes to the vaccine damage payment scheme and promised that the Government would consider the case for reform.

Why, then, is there no tangible evidence of the Government having done anything in the six months since the Prime Minister said those words? The Government have repeatedly blocked my Covid-19 Vaccine Damage Bill, which was briefly debated in this House on 10 September. Why have they not even uprated the £120,000 payment under the scheme to take account of inflation since 2007, when it was last reviewed? On this basis, the maximum should now be over £177,000. Why have no payments yet been made under the scheme, even where a full inquest has established that the vaccine was the cause of death?

That, sadly, is the situation of Lisa Shaw’s family. The 44-year-old BBC Radio Newcastle presenter died from a brain haemorrhage confirmed by a coroner in August as having been caused by the AstraZeneca vaccine, as reported in The Sunday Telegraph on 5 December 2021. Another case about which somebody has written to me arose from a decision by the Westminster coroner who recorded the AstraZeneca vaccine as the cause of death on her mother’s death certificate. Neither of those families is yet to receive any acknowledgement that they qualify under the VDPS, let alone that they will be compensated. Are the Government disputing these coroners’ verdicts? I sincerely hope not, and perhaps the Minister can confirm that in her response.

The Sunday Times reported on 27 February this year that 920 coronavirus vaccination injury claims had been registered, but none has been accepted or been the subject of any payment. That article referred to Zion Spit, described as “a ridiculously healthy” 48-year-old antique dealer from Cumbria, whose death was confirmed as having been caused by the vaccine. His partner of 21 years and fiancée, Vikki Spit, has been in touch with me to express her solidarity with my efforts to obtain redress from the Government and her frustration at the Government’s refusal to engage with victims and their families.

Will the Minister please tell us now when the first payments will be made under the VDPS, and why, despite having told me that 26 staff are now processing claims—11 more than in December—no payments have yet been made? Will she also say how many medical assessors are currently reviewing outstanding cases, and when the backlog will be cleared?

First, I congratulate the hon. Gentleman on bringing forward this debate. He has been a doughty campaigner on this issue, and we all recognise that and wish him well. Does he not agree that while it is right and proper that we have confidence in the vaccine—including those of us who have taken the vaccine; the two doses and then the extra one—there are undoubtedly occasions where things go wrong, as he has outlined, and on those occasions there should be appropriate compensation? The Government and the Minister have a duty of care, and indeed a moral obligation to stand up for those people, and when it comes to being appropriately compensated, that must move in line with the times and reflect not just the loss alone, but dealing with the consequences.

I agree absolutely with the hon. Gentleman. I describe him as a veteran of this issue, because he was one of the Members who participated in the 2015 debate to which I referred.

Many of those who have written to me have indicated that even a payment of £177,000 would be totally inadequate for the injuries and financial losses that they have suffered, including loss of earnings and the cost of care. The range of adverse conditions caused by the vaccines is extensive. By way of example, Mr Julian Gooddy of Henley has given me permission to disclose his circumstances because of his frustration at the lack of understanding by the Government.

Two weeks after his vaccine, Mr Gooddy experienced acute pain throughout his body. He developed Bell’s palsy, required treatment for his left eye, which would not close, and suffered bowel incontinence and severe fatigue. Peripheral numbness and pain in his upper legs, feet, neck and hands then developed. He was in and out of the accident and emergency department at the John Radcliffe Hospital for two weeks, being prescribed steroids, pain killers and undertaking multiple MRI and CT scans, electromyographs and nerve conduction studies. He then collapsed at home in pain and was admitted as an in-patient for five days of intravenous immunoglobulin in an effort to halt the continuing nerve damage caused by the autoimmune response to the vaccine. He was then diagnosed with Guillain-Barré syndrome, which is an autoimmune disease in which the body attacks its own myelin sheath.

Does my hon. Friend the Minister, having listened to the circumstances of Mr Gooddy, believe that his case meets the 60% disablement threshold? I have received so many other reports of complicated symptoms, which have been a real nightmare for our hard-working NHS to address and for which there are, in many cases, no cure.

I thank the hon. Lady for her intervention. Again, they are very wise words and I wholeheartedly agree with what she has said. We are impressed by what the Government have done so far. We are highlighting some of the issues across the world where there are anomalies and where we need to focus. That is what we wish to do. We in the western world have a responsibility to reach out for those who have no one to speak for them. We will probably never meet some of the people the hon. Member for Beaconsfield has referred to, and of whom I shall speak today, in this world, but perhaps we will speak to them in the next.

Finally, I also want to use this opportunity to congratulate the Foreign, Commonwealth and Development Office. I also want to put on record all its work in implementing the recommendations made by the Bishop of Truro’s report in the independent review of the FCO’s work to support persecuted Christians. I have been greatly heartened by that. I have also been greatly heartened by the hon. Member for Congleton, who has been made the special envoy for freedom of religion or belief. We had a chance just a few weeks ago to hear her speak at the annual general meeting of the all-party parliamentary group for international freedom of religion or belief, and it was not just her smiling face but her words that encouraged us all. The hon. Lady is a good person with a passionate belief and interest in the issue. I do not believe there is anyone better to champion it at that level.

As we approach the deadline for an independent review of how the 22 recommendations have been carried out, I ask the Minister, what plans have been put in place for the review to be conducted? Would he consider asking the Foreign Affairs Committee to conduct that review? This time next year or thereabouts, there will be an international conference that coincides with that. I know that some of those recommendations have already been secured, and some have yet to be secured. This time next year, we will have the chance to review all of them. Perhaps at that stage we will be able to look honestly and truthfully at what we have achieved and what we need to achieve in the next period.

I have said quite a lot, because I need to have it on the record for all those who have contacted us. As I said earlier, as chair of the APPG for international freedom of religious belief, I speak up for those with Christian faith, those with other faiths and those with no faith. Today has been an opportunity to speak for those of all faiths and no faith, and those with Christian belief as well, which is very close to my heart. I have put the case for them across the world, so that our Government can focus their attention on helping those people where we can. Covid-19 has been horrific for the whole world. It has been horrific for those who are probably well off and have a good standard of living, but for those with Christian belief who are ethnic minorities across the world, the effect has been disastrous. Today we highlight that for those people across the world. I look forward to other contributions, and to the Minister’s response in particular, as I always do.

It is pleasure to speak in this debate. First, I congratulate the hon. Member for Devizes (Danny Kruger) on putting forward the case very well and with a certain amount of humour, and I thank him for that. It is also nice to see the Minister in her place. She and I were born in the same town—in Omagh, in County Tyrone—so it is pleasing to see her elevated to that position. I will never reach the heights of Minister, of course, but she has, and well done to her. I thank the Backbench Business Committee for selecting this debate and colleagues for raising the issue in the first place.

Covid-19 has been incredibly difficult for so many people and so many families. I am feeling the effect of it myself this week, as I lost my mother-in-law to it. The effect on children, grandchildren and great-grandchildren is very real. Our children are aware of things that we would want to hide from them for their safety, and I know there is concern that this age group should be carefree. Hon. Ladies and hon. Gentlemen have referred to that, and I thank them for it. It saddens this grandfather to see so many children so uncertain and unable to do things that their normal lives saw them doing. Swimming lessons have been cancelled again. They can have no meals out with granny and granddad. There are no play dates with cousins. Little lives are disrupted, and that will have implications for their mental health.

I want to speak specifically on mental health, and others will probably do that as well. For some families who have already had their struggles, this isolation and removal from support can see irretrievable breakdowns. We need dedicated and focused support for children and families on this issue from the Government. I am proud that Northern Ireland pioneered the introduction of a nationally funded school-based counselling service over 10 years ago to support our vulnerable children and young people, and such a service has been adopted by the Scottish and Welsh Governments. It is important now that there is UK-wide provision of this critical early intervention.

Now more than ever, when we are isolating people in their individual circumstances, we need the support of well-funded initiatives to ensure that those individual circumstances are manageable. Some of the teachers I have spoken to in the last months have expressed fears that their children, to whom they give that little bit of extra support emotionally, as well as academically, are removed from them. That happens when schools do not operate as they should, and teachers are concerned that the gap is not being filled.

In Northern Ireland—I suspect it is the same on the mainland—we have rising numbers of those of school age with mental health issues. I welcome the NHS long-term plan commitment that, by 2023-4, at least an additional 345,000 children and young people aged up to 25 will be able to access support via the NHS. That is good, and I am convinced that it will serve a fifth to a quarter of schools and colleges in England by 2023. That is the start that must be made, and we welcome it as a good step forward.

However, we also need to consider the pandemic’s impact on the mental health of children and young people. We need to see more ambition; investing in school-based counselling services would help to serve the missing middle in terms of the support provided between child and adolescent mental health services and meeting the needs of the 75% to 80% of schools not supported under the new model. Mental health in the UK has worsened substantially as a result of the covid-19 pandemic—by 8.1% percent on average, and by much more for young adults and women, and those groups already had poor levels of mental health before covid-19.

A further survey—it is important to record this in Hansard—by Young Minds found that 80% of respondents agreed that the pandemic had made their mental health worse. Of those, 41% said that it had made their mental health much worse, up from 32% in the previous survey, in March. There are increased feelings of anxiety and isolation and a loss of coping mechanisms or motivation. Of 1,000 respondents who were accessing mental health support in the three months leading up to the crisis—including from the NHS and from school and university counsellors, private providers, charities and helplines—31% said they were no longer able to access the support they still needed.

I want to speak up for the people who need that support. Of those who have not been accessing support immediately because of the crisis, 40% said they had not looked for support but they were struggling with their mental health. That is the issue for children. Urgent steps must be taken to provide help to our families and to keep family units intact and—more importantly—happy, and support is needed for that to happen.

I shall start with some quotes from my constituents about the Government:

“The most inept and incompetent administration in my lifetime.”

“Incoherent and indecisive.” “Authoritarian and arrogant.” “Inconsistent and incomprehensible.” “Socialist in all but name.” As these criticisms become increasingly difficult to rebut, it is indeed essential that the Prime Minister gets a grip. The constructive purpose of this debate is to remind the Government that one key tool to enable them to get a grip is to use regulatory impact assessments as part of the policy-making process.

A regulatory impact assessment is a well-established, internationally acclaimed toolkit for good policy making. It facilitates transparency and public accountability, promotes democratic discussion by enabling potential possible policy options to be evaluated and compared. It prevents the inconsistency that arises from knee-jerk reactions and policies being developed on the hoof.

It helps to ensure that sudden changes are the exception and are made in response to changes in hard evidence rather than in response to the chorus of a single-issue pressure group—and I think it is probably fair to say that the covid alarmists are the most successful pressure group in British history. If, for the past six months, the Government had been using this toolkit, it would not have been possible for commentators to observe, as one did on Sunday:

“Britain has become a paradise for those who like to answer questions with ‘rules is rules’; even when they’re clearly made up on the spot or nonsensical.”

Allowing beard and eyebrow trimming for men but not eyebrow treatments for women was but one ridiculous example.

Most fair-minded observers supported the Government’s initial response to the covid-19 pandemic. The Government had no option but to make their priority ensuring that our hospitals were able to treat all those seriously ill as a result of covid-19. Our NHS was not as well-prepared as it would have been if the recommendations of Exercise Cygnus had been implemented. Cygnus was a brilliant initiative to war-game a serious epidemic of respiratory illness in order to identify where investment was needed to fill the gaps and thereby ensure an effective response. Tragically, Public Health England did not learn the lessons identified and failed to put the recommended preparatory work in place. We, the public, have been denied access to the full results. It remains a mystery to me as to why the Government are so defensive about the whole matter—and have indeed been dodging parliamentary questions that I have put down on the subject.

The hon. Gentleman often brings things to the House that are very important, and this is certainly one of them. Does he agree that impact assessments, if produced reliably, can form a critical element of the better regulation agenda? Regulatory impact assessments need to be the right foundation and the right basis to ensure that legislative scrutiny is not just a checklist but is instead an effective mechanism. I think that that is what he was referring to.

The hon. Gentleman has given a brilliant summary of my Adjournment thesis. He is saying that this should not be a tick-box exercise but that clear evidence should be presented that can then lead to proper debate and facilitate scrutiny, and that is what this is all about. I hope the Government are still wedded to that, because their better regulation unit has had consultations and is, I think, still taking the line that we need to have proper regulatory impact assessments. The purpose of this debate is to try to get some more assurance from the Government that they are going to apply these principles not just to covid-19 but to other regulatory measures that are, at the moment, being brought in with far too insufficient scrutiny.

Tomorrow it will be six months since the Department of Health and Social Care policy paper on coronavirus was published. This action plan, as it became, on which the Coronavirus Act 2020 was based, envisaged four phases: contain, delay, research and mitigate. The delay phase was to

“slow the spread in this country, if it does take hold, lowering the peak impact and pushing it away from the winter season”.

Because of the emergency timetable, the legislation had the sketchiest of regulatory impact assessments, without any cost-benefit analysis. But who would have thought that none of the regulations being made under that primary legislation would be properly evaluated before implementation? I certainly hoped that that would happen, but it has not.

The basic steps in the RIA process should involve consultation and an assessment of the nature and extent of the problems to be addressed. There should be a clear statement of the policy objectives and goals of the regulatory proposal, which should include the enforcement regime and strategy for ensuring compliance. Alternative courses of action should be identified, including any non-regulatory approaches considered as potential solutions to the identified problem. There should also be a clear outline of the benefits and costs expected from the proposal and identified alternatives. The conclusion should not only identify the preferred solution but explain how it is superior to the other alternatives considered. Finally, there should be a monitoring and evaluation framework set out describing how performance will be measured.

Although the processes I have set out could not be embarked on in the immediate emergency of introducing lockdown, they should surely form an inherent part of the process of easing lockdown, and ensuring consistent and timely relaxations of the regulations. It is the failure to do this that has resulted in sudden and contradictory changes to the regulations.

This has also led to unacceptable mission creep, which increasingly embodies a gradual shift in objectives. Hon. and right hon. Members will remember that the original objective was to enable the NHS to provide the best care to all the victims of covid-19 who needed it. That clear mission has now widened into a mission to suppress the spread of covid-19 as an end in itself, regardless of the cost. The irony is that, in allowing the original objective to be blurred, the important subsidiary objective of preventing the virus peaking again in the winter is being put in jeopardy.

The easing of lockdown has, sadly, become a veritable shambles. While the number of deaths from covid-19 has mercifully plummeted from its April peak, there has not been a corresponding relaxation of the emergency regulations. I shall refer later to the OECD principles of best practice for regulatory policy, but one of the key principles is:

“Proposed solutions should be appropriate to the risk posed, and costs identified and minimised.”

In the statement he made yesterday to the House, the Secretary of State for Health said that there are now

“60 patients in mechanical ventilator beds with coronavirus”.—[Official Report, 1 September 2020; Vol. 679, c. 23.]

This compares with 3,300 at the peak of the epidemic, and he then said that the latest quoted number for reported deaths is two in one day. Today, The Sun newspaper has calculated from these figures that the odds of catching covid-19 in England are about 44 in 1 million per day. Economist Tim Harford, who presents what I think is one, if not the only, good programme on the BBC—the statistics programme, “More or Less”—has said:

“Covid-19 currently presents a background risk of a one in a million chance of death or lasting harm, every day.”

While age, gender, geography, behaviour and other aspects affect the risk, it is now far lower than the risk of death or serious injury in a motor accident. On average, five people continue to be killed each day on our roads, yet I have not yet heard from the Government any proposals to ban people from driving because of the risks associated with so doing.

One sure way of ensuring consistency would be to impose the discipline of a regulatory impact assessment on each and every continuing restriction, so that the justification for loss of personal liberty could be evaluated against the alleged benefits. It is not too late for this to start, and I hope that the Minister, in responding to this debate, will provide an assurance that the forthcoming six-month review of the legislation will include a full regulatory impact assessment and an evaluation of the performance of the emergency regulations introduced.

The public would then be able to see the evidence about whether the decisions taken were correct. For example, was closing schools and setting back the education of the covid regeneration a proportionate and necessary measure? Was the postponement of 107,000 weddings across the United Kingdom justified? Could any of the 4,452 weddings which should have taken place last Saturday have been permitted? Why can people sit safely side by side with strangers on an aircraft, but not at a wedding breakfast or in a church, a theatre or a concert hall—or even in this Chamber?

Why was the World Health Organisation advice, which was originally that there should be 1 metre social distancing, not applied from the outset? We introduced a 2-metre or 6-foot rule, but that has now been modified with the 1 metre-plus rule, but at the same time the additional safeguards required for the 1 metre-plus situation are being applied to the 2-metre situation, which is creating all sorts of problems, conflicts and uncertainties for our constituents.

Is it protecting the NHS to create a situation where, as was revealed in The Times on 27 August, 15.3 million people are now on the hidden waiting list for treatment? Is it reasonable that we should try to prevent two deaths a day and keep 15.3 million people on waiting lists for treatment, with all the dire consequences that flow from that? Madam Deputy Speaker, I do not know whether you were listening to the Secretary of State for Health when he made his statement yesterday, but in my view his responses on the issue of NHS waiting lists were the weakest and least convincing parts of what he had to say.

Is the continuing economic cost of lockdown now disproportionate to the benefits? Well, let us have an exercise and see. Let us see the data presented, so that we can have a proper debate about it. I raised the importance of regulatory impact assessments in public policy making with the Leader of the House at business questions on 2 July. It was his response on that occasion which caused me to apply for this Adjournment debate, which I am delighted that we are having this evening. I said that we would be able to achieve much more consistency in Government advice with regulatory impact assessments. The Leader of the House, however, argued that

“if we spend too long doing all this, by the time we have done it we have moved on to the next stage of the lockdown.”

He accused me of “calling for bureaucratic folderol”, which would inhibit moving

“at a pace to ensure that things happen in a timely manner”.—[Official Report, 2 July 2020; Vol. 678, c. 534.]

Would that they were. But I must correct the Leader of the House, because, far from being the worthless trifles described in the expression “folderol”, regulatory impact assessments are fundamental to ensuring that we make the right decisions as legislators.

It is incredible that, instead of lockdown continuing to be relaxed, new restrictions on freedom, such as mandatory face coverings, have been introduced. The consequence is that I detect a growing atmosphere of gloom and foreboding as we see winter approaching: no vaccine availability for many months; the economy in a worse state than most of our competitors; and the prospect of the resurgence of the pandemic coinciding with the flu season. I do not like the expression “waves” because it makes it seem as though we are talking about something equivalent to the Atlantic rollers so much enjoyed by our former Prime Minister and colleague, David Cameron. We are not talking about waves. We are talking about the potential resurgence of the pandemic—not everywhere, but in particular hotspots.

This scenario demands a rational evaluation of conflicting risks to the economy and public health, together with a cost-benefit analysis, and now is the time for the Government to reinstate the intellectual rigour of the regulatory impact assessment process. Sooner or later, the incredible economic cost of the Government’s failure to remove lockdown restrictions in a timely and effective manner will become apparent. If that coincides with the Government asking their natural supporters to pay the price for their failure through higher taxes, the political consequences will indeed be dire. It is for that reason that I commend to the Government what the OECD says about regulatory impact analysis. It describes it as an

“important element of an evidence-based approach to policy-making…that…can underpin the capacity of governments to ensure that regulations are efficient and effective in a changing and complex world.”

I will not read from the whole OECD regulatory impact assessment report on best practice principles for regulatory policy, but it extends to about 40 or 50 pages and is extremely well researched and documented. As I understand it—the Minister will correct me if I am wrong—these principles are supported by the Government; the trouble is that they do not seem to be being implemented by the Government and by Government Departments. I hope that in his response the Minister will tell us what he is doing to try and put that right.

The Government should revert to following their own “better regulation framework” established under the Small Business, Enterprise and Employment Act 2015, which requires that

“A RIA should be prepared for all significant regulatory provisions as a standard of good policy making and where an appropriate RIA is expected by parliament and other stakeholders.”

The interim guidance issued in March this year sets out a general threshold for independent scrutiny of regulatory impact assessments and post-implementation reviews, where the annual net direct cost to business is greater than £5 million. It calls on Government Departments to undertake proportionate cost-benefit analysis to inform decision making.

The trouble is that this is not being done, and I will give just one topical example, to which I referred in my brief comments in the previous debate. Under the Coronavirus Act 2020, there was specific primary legislation saying that residential tenancies should be protected from eviction until 20 September this year. On Friday last week—27 August—regulations were made extending that period from 20 September for another six months. The regulations came into force on 28 August, which was last Saturday, the very same day that they were laid before Parliament. Regulation 1(2) says:

“These Regulations come into force on the day after the day on which they are laid”.

Those regulations have caused a storm of protest from residential landlords in my constituency; they are apoplectic about the fact that they are not going to be able to recover possession of their premises. Notwithstanding the contractual agreements they have entered into with their tenants, they are not going to be able to recover their premises until 31 March 2021.

It says in the explanatory notes to the regulations that they amend schedule 29 of the 2020 Act. This is primary legislation being amended by subordinate legislation subject only to the negative resolution procedure, and so one might have expected that there would be a regulatory impact assessment or something which would indicate to us, on behalf of our constituents, that the Government have thought this whole process through, but that is not there, and instead there is a little note which says:

“A full impact assessment has not been produced for this instrument due to the temporary nature of the provision.”

This is a very emotional subject, and we ignore that at our peril.

The Bill and the lack of response by the Government to the criticisms that were made on Second Reading lead me to believe that the Government do not really accept the important role that family life has to play in maintaining social cohesion in this country, with the institution of marriage at its heart. The Government almost seem to be venturing down the same route as those who support cultural Marxism. Are the Government inadvertently collaborators with cultural Marxism in seeking to undermine nuclear families?

In the opening speech on Second Reading, the Lord Chancellor said that

“it is often too late to save a marriage, once the legal process of divorce has started.”—[Official Report, 8 June 2020; Vol. 677, c. 95.]

but he sought to avoid the concerns of the Member for Strangford (Jim Shannon) about access to free counselling for those with marriage difficulties, and he cited the Department for Work and Pensions programme of £39 million on reducing parental conflict as the solution.

The hon. Gentleman mentions my comments to the Secretary of State last week. I do feel that the opportunity for Relate and marriage guidance should be available, as the hon. Member for Congleton (Fiona Bruce) said, before the marriage starts but also as the process comes to its end. It should not just be available in the early stages—I understood from what the Secretary of State said that it would only be available early. Is it not important that at all stages the chance to reconcile and save a marriage should be paramount and should be tried in every case?

I agree with the hon. Gentleman. My regret is that the Marriage Guidance Council ever changed its name to Relate because I do not think that as many people understand what Relate is actually about. Of course, after the hon. Gentleman put that point to the Lord Chancellor, there was a non-response—I think that is the generous way of putting it. Then my hon. Friend the Member for South West Bedfordshire intervened and asked about guarantees that the DWP programme would continue, because at the moment it is only funded for the next nine months. Again, there was no willingness to give any assurance from the Front Bench that that programme would be renewed or even that the Lord Chancellor would support such a renewal. That is why I am sceptical about all this.

The Lord Chancellor said that the aim of the Bill is to “reduce conflict”. He described it as being about the “legal process”, not about stopping the decline in the institution of marriage or, as he put it, “committed relationships”. He also conceded that this Bill is not going to make divorce less attractive, and he did not think it was intended for that end. However, surely this is a golden opportunity to expand marriage guidance services and to make them more easily accessible. It is an opportunity that has been missed, and that is why I shall be supporting new clause 1 if it is put to the vote.

Marriage is something that people have to work at, and I think most marriages will have had their ups and downs. The temptation now is that a party to a marriage going through a bad spell can suddenly, arbitrarily, unilaterally and without consulting their spouse terminate the marriage, and then within six months have a divorce, and I think that is highly unsatisfactory.

The Lord Chancellor seems to believe that nobody embarks on divorce other than in circumstances where the marriage has ended. May I draw his attention to the fact that one of the side-effects of this will be to facilitate the development of more sham marriages? A sham marriage can then result in a sham divorce, and sham divorces will be able to follow on much more quickly than they have been able to do hitherto. Ironically, I think this is going to promote sham marriage and all the abuse of our immigration law and other laws that that leads to.

This Bill is essentially introducing what I would call marriage shorthold, a legal agreement that can be terminated unilaterally after six months, without any evidence of fault. Is it not ironic that, while the Government are introducing marriage shorthold, they are seeking to abolish tenancy shorthold? Section 21 of the Housing Act 1988 allows a six-month housing tenancy to be terminated unilaterally after six months, without evidence of fault. What is the justification that the Government are putting forward for ending tenancy shortholds? It is because tenancy shortholds undermine security. What does this lead us to conclude? It leads me to conclude that the Government value housing security above marriage security, and I think that is a really perverse order of priorities.

I suppose, as a supply side supporter, I could be arguing that, in the same way that the supply side reforms in the 1988 Act—I was privileged to be a Minister in the Department of the Environment when we bought it in—had the consequence of increasing the number of tenancies and the availability of rental options, perhaps the supply side changes to our divorce law will have the consequence that people will feel they can enter into marriage more easily because they are going to be able to end it after six months if it does not work out. That is not a justification so far put forward by the Government, but I would be interested to hear from the Minister how he finds consistency in the approaches to shorthold tenancies and to shorthold marriage.

I think this Bill lacks ambition, and that is another reason why I am not going to be able to support it. I think it should be used as an opportunity to help address conflicts in marriage and between married partners, but it should not be designed, as I think it is, to undermine the institution of marriage in itself.



In conclusion, let me just say this. My right hon. and learned Friend the Lord Chancellor has repeatedly described himself as a doughty champion of family values, but I think it is significant that throughout the debates we have had on this Bill, he has been remarkably diffident about promoting the positive benefits of marriage, as many of my right hon. and hon. Friends have done during the course of this debate. Unless the Government accept the amendments before the House today—particularly, in my view, new clause 1—there will be no evidence to back up the Lord Chancellor’s assertion of being a champion of family values. Indeed, like a party to a divorce under this Bill, he will have absolved himself of any requirement to establish the facts. What a sad state of affairs that is.

I think I would say two things. A lot of what I am going to say about the East Anglian fishing industry does relate to the south-west fishing industry, but I would also make the point that we need localised management going forward to address the specific issues of local fisheries. That was one of the problems with the common fisheries policy. We want to develop our own East Anglian policy. In the same way, my hon. Friend should develop a policy for his industry in the south-west, and likewise in Northern Ireland—[Interruption.] I see that the hon. Member for Strangford (Jim Shannon) wants to intervene.

The hon. Gentleman is right to refer to local community involvement. We need to have that across all the fishing communities, wherever they may be in the United Kingdom. In my constituency of Strangford, the fishing industry is also very important. The Irish Republic has introduced a six-mile limit, which is totally out of order—

If we want to have influence, we should bear in mind that tomorrow is the eighth anniversary of the imprisonment of seven Bahá'i leaders in Iran. They are prisoners of conscience, and were imprisoned as a result of their religious belief. That is an unquestionable violation of their human rights.

Outside Europe, the United Kingdom’s membership of the European convention on human rights sends a strong signal of our continued commitment to upholding and advancing human rights globally. Is there not a good reason for our being a member of the convention when we can do something for those Bahá'i leaders in Iran who have been violated and persecuted because of their beliefs? That is one example.

The hon. Gentleman has made his point very well. However, I am concentrating on what the Home Secretary said. She seemed to be announcing a Government policy that the United Kingdom should leave the convention but stay in the EU. Her speech led to an urgent question, which was granted by Mr Speaker, and I—and other people who were present on that occasion—could not understand how we were going to be able to deliver the Home Secretary’s agenda on human rights if we remained in the European Union and subject to the EU charter of fundamental rights.

Questions were raised by Members during those exchanges, and it became clear that the Home Secretary—and, indeed, the Government—were indeed rather muddled about this. One of the questions that was asked was whether membership of the European Union required us to be a party to the European convention on human rights. The Home Secretary was not answering the urgent question. The Attorney General answered, as a Law Officer. He said:

“It is not…in any way clear that membership of the European Union requires membership of the European convention on human rights…there are considerable legal complexities”.—[Official Report, 26 April 2016; Vol. 608, c. 1291.]

My hon. Friend the Member for North East Somerset (Mr Rees-Mogg) then cited article 6.3 of the treaty on European Union, which states:

“Fundamental rights, as guaranteed by the European Convention…shall constitute general principles of the Union’s law.”

He went on to refer to the fact that the Commission had said that any member country of the European Union that sought to disengage from the European convention on human rights might have its voting rights suspended.

Then, as so often happens in this House, my hon. Friend the Member for Wellingborough (Mr Bone) asked a really pertinent question. He said:

“Can a country remain in the European Union and still come out of the convention? What is his legal opinion on that?”

The Attorney General replied:

“As I have suggested, the legal position is not clear.”

He went on to say that he did not

“have the time to go into all the ins and outs of that particular question now, but I suggest it would also be wrong to say that it is clear in the opposite direction.”—[Official Report, 26 April 2016; Vol. 608, c. 1301.]

So that was what the Government were saying about this particular matter.

This morning, I heard the Prime Minister chiding Brexiteers for having no clear comprehensive plan for life outside the EU, but that was a classic case of the pot calling the kettle black. As I have just said, the Prime Minister and the Government have no clear plan for life inside the European Union if there is a remain vote on 23 June. They do not know what will happen to their human rights agenda. There are many other examples beyond that.

It is a failure by the Government not to address this issue up front, and to leave it hanging in the air pending the referendum. We have had some quite clear advice from lawyers of great distinction. For example, Lord Woolf said:

“You can legally reconcile the doctrine of the sovereignty of Parliament with the European Convention on Human Rights. You cannot do that with regard to the European Charter, because the position there is that you can trump a statute.”

Lord Woolf was being quoted there in the House of Lords paper 139, which was published today. We now have a situation in which the Home Secretary seems to be arguing that we would be more secure if we left the convention on human rights but retained European law relating to fundamental rights.

I should like to give the House some examples of how EU law is undermining our security. In The Sunday Telegraph yesterday, it was reported that six Algerian terror suspects with links to Osama bin Laden and al-Qaeda were to be allowed to stay here after a 10-year battle in the courts. I think that the Under-Secretary of State for Justice, my hon. Friend the Member for Esher and Walton (Mr Raab) has made the point that the number of people fraudulently trying to gain entry into the United Kingdom has almost doubled in a year. That is because those people realise that we do not have the power to turn them away at our borders if they are waving a European Union identity document.

I was speaking at a conference on European freight security last week, at which it became apparent that we are not allowed to X-ray lorries in Calais to see whether they contain illegal migrants because it might be damaging to the human rights and health of those illegal migrants. That is another example of how human rights laws undermine our ability to keep our borders secure. Another example is that we are not allowed to take DNA samples from migrants who refuse to give their fingerprints when they enter the European Union, which is expressly prohibited by the Eurodac regulations.

Then we have the example, which came out a couple of months ago, of Abu Hamza’s daughter-in-law. We found out that she was his daughter-in-law only through a freedom of information request. An advocate-general in the European Court of Justice said that it was in principle contrary to European Union treaties to remove the lady from the United Kingdom, notwithstanding the fact that she had been convicted and sentenced to a year’s imprisonment. It was subsequently revealed that she had been convicted of attempting to smuggle a Sim card to Abu Hamza while he was in a high-security prison, but even that grave crime was insufficient to allow the courts to remove her from the United Kingdom because of the intervention of the European Court of Justice, which exercised its powers under the EU’s fundamental rights laws.

I cannot understand how the Home Secretary can consistently argue that we should stay in the European Union when the logic of everything she said in her speech was that we should be leaving the EU. It is potentially misleading for members of the public to think that they can have their cake and eat it by leaving the European convention on human rights while still remaining subject to the European Court of Justice.

You have inspired me to speak longer, Mr Chope, but I will not; I will divide the time clearly between us. I thank the hon. Member for Wrexham (Ian C. Lucas) for bringing this debate to Westminster Hall. It is a really good subject matter and one on which we are all keen to participate. In my short speech, I will mention some good things that we do in Northern Ireland—I know this is a devolved matter, but it is good to exchange ideas about what we do in Northern Ireland and what is done here in the mainland.

Despite the great services that exist and the Access to Work scheme, the proportion of people with a learning disability in paid employment has remained stubbornly low—we cannot ignore that fact—and according to Mencap UK, which represents people with learning difficulties, that proportion appears immune to economic factors. There are clearly issues to be dealt with. I know the Minister is totally committed to that and that he has done great things. We respect him greatly, but I think we need to look at what we can do better.

The proportion of learning-disabled people known to social services in paid employment fell from 7% in 2012-13 to 6.8% in 2013-14. Some hon. Members have spoken about the good things that have happened in their areas, and when that is the case, that is good—let us recognise those. We need to exchange such ideas and make others aware of them. However, that fall in numbers happened despite the fact that the majority of people with a learning disability can and want to work. There is an eagerness and a keenness to work, and we should encourage it. The figures are stark if we compare them with a national employment rate of 76% and an overall disability employment rate of just below 50%. As hon. Members have said, the Government pledged to halve the disability employment gap. Indeed, that pledge was in Conservative party’s manifesto, and we recognise and welcome it. It is good to see a commitment to it—well done.

Although welcome moves have been made to realise that commitment, the facts show that we need to do a bit more. I know the Minister will respond in a positive fashion, and I look forward to his comments. The Government need to monitor the disability employment gap, identify the factors that are still preventing it from closing and preventing disabled people from having access to work, and take action on those factors. There are things that the Government can do.

Department for Work and Pensions data show—I say this respectfully—that between 2011 and 2015, the number of jobcentres employing a full-time adviser to help disabled people fell by more than 60%, from 226 to 90, with reductions in every recorded year. We cannot ignore that issue. We all know that the Minister is a very pleasant person who is approachable and who does his job well, but that fact needs addressing. Perhaps he can tell us what steps the Government have taken to address the fall in the number of jobcentre advisers, and how we can best help people who are disabled when they come looking for assistance and help. That reduction surely contradicts the Government’s commitment to reduce the disability employment gap, and the effects of that cut in services need to be closely monitored to ensure that it is not having an adverse effect on the efforts to reduce disability unemployment.

I will give an example from Northern Ireland, because it is always good to put in the mix what we have done back home. We have an additional scheme to help reduce the disability employment gap. As well as the Access to Work scheme, there is Workable (NI), which is delivered by a range of providers contracted by the Department for Employment and Learning. Those organisations have extensive experience of meeting the vocational needs of people with disabilities, and using them is a great way of advancing social enterprise and supporting that sector.

Workable (NI) is a two-year programme that helps people out of economic gloom, gives them support and hope and prepares them for employment. It tailors support to individuals to meet their specific needs. The provision can include support such as a job coach to assist the disabled worker and their colleagues adapt to the needs of a particular job, developmental costs for the employer, and extra training, including disability awareness training. Those are all vital factors for any and all disabled people who want to work.

As I said, I am a great believer that this great country of the United Kingdom of Great Britain and Northern Ireland is better together. We know that, and many of us would subscribe to it. Let us exchange the good points and good practice that we have in every region of the United Kingdom. Lessons can clearly be learned from the approach in Northern Ireland, and we can develop additional strategies here in the mainland to help make good the Government’s comment to halve the disability employment gap.

I congratulate the hon. Member for Gateshead (Ian Mearns) on bringing the matter to the House. I thank him, because it is one that is close to my heart, for two reasons. The first is personal, because my brother, Keith, had an accident in which he received serious brain injuries. He had many years of rehabilitation, and although it did not mean he could lead the independent life he once had, he can have some sort of independent life, because of his carers and my parents. My parents give as much help as they can, but my mother is 81 and my father is 83, so they will be able to give less and less help. There will be greater emphasis on the NHS and what it does through carers, but also on the DLA award that helps Keith to have carers in the house on a more permanent basis. He relies on the award to pay for the help he needs. If that were to change—I hope that the Minister is taking this on board—his quality of life would change dramatically. He would have to go to a health facility elsewhere.

Is my brother the only person in my constituency to whom that has happened? Of course not: there are hundreds—indeed, thousands—who fit into that category. All over the country people have made me aware of that. Some of the hon. Members present for the debate attended Baroness Tanni Grey-Thompson’s inquiry. In her report she has said that

“230,000 severely disabled people who do not have another adult to assist them could receive between £28 and £58 a week less”.

Also,

“100,000 disabled children stand to lose up to £28 a week”

and 116,000 disabled people who work risk losing up to £40 per week from payments towards additional costs of being disabled. Clearly, those figures cannot be ignored. Those are the facts of the case and that is how things will happen. A recent newspaper comment said:

“DLA helps disabled people to manage some of their own care needs; without this support, they could increasingly rely on family members.”

Yes, that is so if the family members are alive and accessible. If not, that cannot happen.

Other hon. Members have mentioned Carers UK and the Hardest Hit survey. Three in 10 disabled people stated that without DLA their care would not work. The figures are clear. Family carers provide an unmatched service in the United Kingdom, saving the Government millions upon millions of pounds each year. The Government must address care-in-the-home needs. There is only so much that families can do and while we are trying to save money care in the community cannot bear the brunt, but that is what is happening. Private care companies are under pressure and have less money available to them. That means that elderly people are living in unfit conditions, and much more is required of their carers.

Many young and single-parent families find it very difficult to cope. Young mothers try their best to do without the absent father, but they cannot juggle taking care of the home as well as looking after children with attention deficit hyperactivity disorder. There are many in that situation in my constituency, and that will be true of the constituencies of many other hon. Members. Those mothers have particular problems, trying to hold down a job of 16 to 20 hours a week to qualify for help, and they are under tremendous strain, which in turn leads to breakdowns in their health. Voluntary sector groups used to fill the gap, and sometimes they can, but mostly they cannot. Such a mother is under pressure, worried about DLA and the effect on her son, and about her increasing child care costs. Those problems multiply. I want to make a quick mention of Home-Start, a charity at home in my constituency and many others, which does marvellous work and can look after a child for a year for £422. Where else could anyone get that?

In conclusion, there is a degree of penny wise, pound foolish about what is happening—saving money in the short term, while in the long term there will be no saving. Worse, in the long term families will be pulled apart, disabled people will be isolated and the community will not function as it could, all because the big picture was not looked at. I urge the Minister to rethink the reform at this stage, consider its impact on individual lives, and put in place an efficiency package that saves money without doing it at the expense of decent quality of life.

To follow on from what the hon. Lady is saying, this scheme will benefit everyone in the United Kingdom of Great Britain and Northern Ireland. Does she envisage this high-speed rail having contact with Larne, Cairnryan and Stranraer, thereby ensuring that the people of Northern Ireland can also benefit from the high-speed rail link, which ultimately will take them to London? Based on a very significant business plan—
