My hon. Friend is right. Indeed, the commission did refer to those aspects and spoke about the damage done, saying in paragraph 109:

“The police force of the de facto authorities in Gaza bears responsibility for failing to take adequate measures to prevent incendiary kites and balloons from reaching Israel, spreading fear among civilians in Israel and inflicting damage on parks, fields and property. Similarly, the police force failed to prevent or take action against those demonstrators who injured Israeli soldiers.”

Some of that is touched on, but the underlying issue remains that Hamas has a credo of violence against the state of Israel, which is at the heart of its actions and sustains those involved in terror. That has to end, as part of the process that will see peace and security in the region.

Both the Minister and the shadow Foreign Secretary have said that it would have been better if the inquiry had also looked into Hamas’s involvement. I agree, but I do not believe that justifies or excuses our abstaining on the resolution. I, too, met Dr Tarek Loubani in London last week, as I know the Minister did. What message are we sending to the Palestinians if peaceful, diplomatic routes via the United Nations are being closed off to them, as we are doing now?

The hon. Gentleman understands the area extremely well. We are not sending a message that that is all closed off. We sent a clear message in relation to an inquiry that could do only one side of the job, but we have also made it clear that our opposition to item 7 being directed solely at Israel is mitigated if other items come into other parts of the agenda and that they will be considered by the United Kingdom on their merits, and we will continue to do that. There must be avenues— they will not all be closed down—but those that, from the outset, will not do the job are a false premise for seeking international observation. We must do all we can to prevent that and to ensure proper and proportional scrutiny if we are to get to the bottom of these issues and, above all, prevent them in future.

I am grateful for my right hon. Friend’s comments. It would be unlike him not to have slight concern about some of the things that the Foreign Office does. I appreciate the situation. First, let us be clear: there cannot be any definition of “winning” this conflict when something like half a million people have been killed—the vast majority at the hands of the regime, and a significant number at the hands of Daesh—and millions have been displaced. Should the regime and its backers claim to have won, I am sure this House would speak with one voice in its disgust at such a term.

Is it correct to say that the situation on the ground indicates that the regime is likely to stay in control of areas that it currently controls and regain control? Yes, that is likely to be the situation. The regime was rescued by Russia on one occasion and by Iran and Hezbollah on another. We do not need to rehearse the events of August 2013, but there are consequences of both intervention and non-intervention, as the House understands. The situation is plain, and my right hon. Friend is correct; the regime will count its survival as a success in the dreadful circumstances.

What happens next is really important. As I indicated earlier, if Syria’s regime and governance returns to where it was, Syria will never be at peace. First, people’s human rights will continue to be trampled on. That will provide the base of conflict for the future, and those who seek stability in Syria through the return of the regime will not get it. It is clear that there must be a response from the regime to provide for its people decently, as opposed to the conditions of war that it has waged upon its own people for the past few years. When that time comes, I will be able to answer my right hon. Friend’s question.

I welcome this statement. We can all be proud of the UK’s substantial contribution to humanitarian relief in Syria and neighbouring countries. I want to ask the Minister two questions. The first is about the area of Syria that has been liberated by Kurdish-led forces. He rightly referred to security issues in that part of the country. What are we doing to support humanitarian and development projects in that part of the country, working with its leadership?

Secondly, the Minister referred to there being 2 million children out of school. We know from Syria and other emergencies that more and more children are spending longer and longer periods of their childhood and adolescence in these protracted crises. Investing in their education and support is vital. Will some of this additional money, which is so welcome, be invested in education for children in Syria?

The International Development Committee and the hon. Gentleman, who chairs it, have kept a constant watch on this issue, which has really been appreciated by DFID and all our partners. We have recognised the support needed in areas that have been freed from Daesh. At the moment, DFID-funded partners are aiding the humanitarian effort by providing support to health facilities, child immunisation, de-mining activities—that remains so important—and child protection and education, as well as providing emergency supplies such as food and cash. Between January and June 2018, support to the Hasakah, Raqqa and Deir ez-Zor governorates provided 260,000 medical consultations, 23,000 food rations, 300,000 cash grants and more than 5,500 people with sexual and gender-based violence services. The humanitarian services are quite significant and complete.

However, in the camps, where the women and children of foreign fighters are concerned, there are no cash transfers.[Official Report, 25 March 2019, Vol. 657, c. 2MC.] The Secretary of State has taken the view that that would not be appropriate. Cash transfers are extremely valuable in many circumstances. They provide some flexibility for refugees and those who are dependent on them and help people to make easier choices. There is little evidence of any abuse, and it can be a most practical way of delivering aid. But in the particular circumstances of the women and children of foreign fighters, in order to ensure that there was no risk of divergence to terrorist sources, my right hon. Friend took the decision that cash transfers would not be used.

Finally, the hon. Gentleman asked about children. I am impressed with the number of international meetings I attend where support for children and their education and counselling has moved from a nice add-on to the protection provided by shelter and food and protection from harm to something that is absolutely fundamental. Like me, he will have seen UK aid workers and those we fund engage with children in camps. When the children arrive, their drawings are horrific and of deep violence, but after they have had some time with skilled and experienced counsellors, they can begin to exhibit signs of normal childhood, which they deserve. He and the Committee can be sure that we will continue to keep that as a serious priority.

The Stockholm agreement is indeed very welcome, but the Minister is right that it is also fragile. One of the features is the World Food Programme supplies, to which it is hard to get access. Will he update the House on the prospects of getting that access because the head of the Office for the Co-ordination of Humanitarian Affairs has said that there is a risk that the food will simply rot and therefore not be available for consumption?

The hon. Gentleman is right. I spoke to the World Food Programme director, David Beasley, last week. The situation is that it has been difficult to get to the Red sea mills because of mining. There is a concern that some food not only has rotted, but has been stolen by illicit elements, so we have to find out what is there. The continuing progress in relation to peace will make access to those mills more likely, and we will continue to press for that.

The full details of the impact of the US withdrawal have yet to be worked through. Our focus on humanitarian aid will not be changed, and we continue to monitor the situation closely as it develops. Our focus on providing humanitarian assistance to millions of people displaced both externally and internally will remain.

The possibility of a US withdrawal raises serious concerns about civilian protection. Will the Minister tell us what the Government are doing to work with agencies on the ground to ensure that, particularly in the Kurdish-controlled areas and in Idlib, as much as possible is done to protect civilians?

Yes indeed. To reassure the hon. Gentleman, who is the Chair of the Select Committee, we are very concerned about the potential implications, particularly on the Turkish-Syrian border. We are in constant contact with our partners in relation to this and with humanitarian agencies, which are fully abreast of the consequences of actions that have not yet happened. Everything is being done to try to encourage a peaceful resolution of the political conflicts there.

The £170 million that the United Kingdom is putting into Yemen in this financial year is currently feeding around 2.2 million people, including children. We continue to work on nutrition and sanitary issues, and on making sure that clean water is available. I repeat to the House that the most important thing is that the humanitarian support and efforts to gain access are only a sticking plaster for the wound; if the wound is to be fully closed, every effort must be made on the political track to end the conflict.

The UK can indeed be proud of our efforts on the humanitarian side, but I agree with the Minister that we need to do more on the political track. What are we actually doing now to sustain pressure on all parties to the conflict? In particular, what are we doing to build the coalition that we need in the Security Council to secure a new resolution that is relevant to the circumstances in Yemen today?

The consensus in the Security Council is that the best thing we can do is support the envoy, because a new resolution would either not get through or not be relevant. We do not want to waste any time on efforts away from the special envoy. While we were in New York, my right hon. Friend the Foreign Secretary had a meeting with the relevant parties, and separately I met those in the coalition, as well as people representing those who have influence with the Houthis, because this is not a one-sided issue.

As has been made clear during the debate, there is a war going on, in which the Government of Yemen have been usurped and those who are seeking to push back an insurgency are having to do it by military means because of the forces that they are facing.

Let me say a little more about the alleged breaches of international humanitarian law, because the issue is understandably vital to what the UK believes. We are, of course, aware of reports of alleged violation of that law, and we take them very seriously. It is important for all sides to conduct thorough and conclusive investigations of incidents in which it is alleged that international humanitarian law has been breached. As I have just indicated, we regularly raise the importance of compliance with the Saudi Arabia Government and other members of the military.

Saudi Arabia has publicly stated that it is investigating reports of alleged violations and that lessons will be acted upon. The key test for our continued arms exports in relation to international humanitarian law is whether there is a clear risk that those items subject to a licence might be used in serious violations of international humanitarian law. That situation is kept under careful and continued review. If the efforts of the coalition were not made, that would certainly be breached, but it is not, and that is why we believe as we do.

However, equally we are appalled by the many ballistic missile attacks the Houthis have launched in Saudi Arabia in recent months. There have been seven long-range ballistic missile attacks on Riyadh, indiscriminately, from March to August. The coalition claims that the Houthis have fired 190 ballistic missiles at the Kingdom of Saudi Arabia since the start of hostilities, and the Saudis have also recorded a number of smaller strikes on the KSA—mortars, artillery and so forth—with the total number currently standing at 67,000 strikes. That is not always given the prominence it needs to have.

The Minister rightly reminds us of alleged atrocities on both sides. Does that not reaffirm the importance of an independent investigation? In particular, will he address my question about the UN panel of experts and the stance the UK will take at the HRC in Geneva on that issue?

We are providing support in the crisis and to the region through the funding of key UN and humanitarian agencies, but, as my hon. Friend says, this is limited because of the Venezuelan Government’s refusal to admit the seriousness and reality of the situation. We are urging them to address the most urgent needs of their own population.

Very large numbers of people are fleeing the situation in Venezuela, particularly into neighbouring Colombia. Will the Minister tell us what the Government are doing to address that situation, and what opportunity the Government see for the proposed UN global compact for refugees to address crises such as this one?

The hon. Gentleman is right to highlight the regional crisis and the growing global problem of refugees in relation to the length of time they stay in host states and their prospects of returning. Venezuela is not the only affected area. We continue to support UN agencies in relation to this, and we are playing a leading part in creating the new compact for refugees.

It is difficult to say. A recent rocket attack killed three Saudi civilians, and there have been a number of different attacks. Attacks on the airport and the royal palace in Saudi have been prevented. Should one of these missiles land on such a target, the whole circumstance in the middle east would change radically.

The Minister is of course right to condemn the Houthis; I have never heard any Member of this House defend them. The reason for the focus on the Saudis and the Emiratis is that we are allied with them. Can I press him to answer the question from my right hon. Friend the Member for Leicester East (Keith Vaz) about clearly condemning this proposed attack, and will the Prime Minister speak to the leaders of Saudi Arabia and the United Arab Emirates as a matter of urgency?

Yes. One cannot take the situation in Gaza away from the administration of Hamas and their failure to resolve issues in relation to Israel and to meet the Quartet principles. The people of Gaza have suffered from a number of different things and we continue to believe that only an overall settlement will assist their needs. We will continue to work for that.

In 2016, the International Development Committee saw the brilliant work of UNRWA on education in Jordan. Will the Government work with other countries to make up the funding shortfall as a result of this outrageous cut by the Trump Administration?

We are working very keenly with other donors to get them to step up. I saw Commissioner-General Krähenbühl just last week in the UK and again at a recent conference. We know how much good work UNRWA does in the area. The education project the hon. Gentleman mentioned is particularly valuable. Other donors need to step up as well, and we will continue to be generous in our support for the needs of UNRWA.

I very much agree. [Interruption.] Welcome to the Chair, Madam Deputy Speaker. I raised this issue yesterday at Department for International Development questions, in the context of Yemen. The excellent organisation War Child has made the suggestion that at least 1% of all humanitarian aid should be spent on mental health and psychosocial support. For anyone who has been through this sort of conflict, and for children in particular, it is vital that they get that support.

I do not have a question, but following agreement with Mr Speaker a moment ago, I just want to say thank you to the Chair of the Select Committee for his work and to the members of the Committee and those who have spoken today. There will be a response from the Government in due course in the usual manner, but, of course, the matter will be a subject for discussion for some time to come.

The Committee has rightly put a spotlight on a situation that is unlikely to ease soon—a desperate situation. I want to assure the House that it is a matter of focus every single day for the Foreign and Commonwealth Office and DFID. That is true of not only the plight of the Rohingya at the moment—I was in Geneva last week to speak to international organisations about that—but the need for a solution for them, and that remains a priority for the Government. I thank the hon. Gentleman and colleagues again for the report.

UNICEF’s report this week highlights the appalling impact on children of the conflict in Yemen. Will the Minister examine the proposal from War Child that at least 1% of humanitarian funding should be devoted to mental health and psycho-social support?

I will be very happy to see that proposal; I have not seen it yet. Looking after psychological and mental health used to be seen as some kind of benevolent add-on in terms of aid and support. Bearing in mind the crisis and trauma that so many youngsters go through, it is very important that it is brought right up front and the UK is a firm advocate of that. I will certainly look at the report.

The initial responsibility to investigate any incidents lies with the state involved, and Saudi Arabia has been doing that with its investigations. I genuinely do not know the process of transferring that information to the UN should the UN request to see it, but I will have an answer for the right hon. Lady.

I know that there has been an instruction to be mindful of the time, Mr Deputy Speaker, so I will be as tight on time as I can, but I want to talk about both the blockade and the humanitarian response before moving on to the negotiations. As for the restrictions brought in after the missile attack of 4 November, I will deal first with where the missile came from. The right hon. Lady asked me whether we disagree with the UN’s assessment, and yes we do. That draft assessment was written some time ago, and there is the possibility that a different assessment by the UN has not been made public. The United Kingdom is quite confident that there is sufficient evidence to indicate that the missile came from an external source. If it did not, the right hon. Lady and others can answer the question of where such a missile came from in Yemen, but it is quite clear to us that it came from an external source. We therefore disagree with the UN’s initial draft report, and the evidence will come through in due course when a further report is published. That is all I can say.



The coalition’s response to a direct attack on Riyadh airport was sharp and severe. It wanted to be able to protect itself and, in doing so, placed restrictions on the ports in order to control what was coming in. Now, we do not disagree with what was said either by the right hon. Lady or my right hon. Friend the Member for Sutton Coldfield, and the UK’s clear position is that it is imperative that those restrictions are relieved. I am not going to dance on the head of a pin here; if Members want to call it a blockade, it is a blockade. There is no point in dancing around that. However, humanitarian and commercial supplies must be allowed in in order to feed the people.

As my right hon. Friend said, and as the House knows well, the vast bulk of food, water and fuel that comes into Yemen to keep the people alive is not humanitarian aid; it is ordinary commercial stuff. We have been clear right from the beginning of the restrictions that the UK’s view is that they should be lifted, and we have maintained that, so to be told that we have not done enough is just wrong. As evidence of some degree of success, there was some easing of the restrictions last week, but not enough. I have an update that I am happy to share with the House. It states:

“Humanitarian and commercial vessels are beginning to enter Hodeidah and Saleef ports. Since Sunday, three vessels have arrived and are being unloaded. This includes 2 commercial vessels into Hodeidah carrying respectively 5,500 metric tonnes and 29,520 metric tonnes of wheat flour. One humanitarian vessel has arrived into Saleef with supplies to support 1.8 million people for a month (and 25,000 metric tonnes of food). In addition, approximately 23 vessels have been cleared by UN Verification Inspection Mechanism (UNVIM) although not yet permitted to unload.”

It is essential that they are permitted to unload, and we are making representations to that effect. However, the fact that there has been some movement in response to representations made by, among others, the highest levels of the British Government indicates that the urgency of relieving the humanitarian situation is being heard. At the same time, we recognise the security needs of those who are threatened by missiles targeted at their commercial airports and civilian areas.

I welcome the fact that the Minister has described the situation as a blockade. If the blockade is not lifted completely, what is his estimate of how close Yemen is to famine—days or weeks?

Reports differ depending on the area. Five cities have already run out of fuel, meaning that power supplies, sanitation and other things cannot be maintained. On average, food supplies appear to be better and may be measured in months, but that will not apply to every individual area because some will be worse than others. A Minister will not stand here and say that because things can be measured by a few more days, the situation is less urgent; it is not. It is absolutely top of our priorities. In a variety of different ways, the UK has sought to make clear the importance of responding not only to the security needs of the coalition, but to the humanitarian situation.

I want to put the following on the record. On 5 November, there was a Foreign and Commonwealth Office statement condemning the attempted missile attack. On 13 November, my right hon. Friend the new Secretary of State for International Development spoke to Mark Lowcock of the UN about the humanitarian situation. On 15 November, an FCO statement stressed the need for immediate humanitarian and commercial access. On 16 November, I spoke to the UAE’s Minister of State. On 18 November, the Foreign Secretary made a call to the UN Secretary-General. On 20 November, I spoke to the House. On 21 November, I spoke to the Saudi Arabian Foreign Minister. On 23 November, the Foreign Secretary spoke to Saudi Arabian Crown Prince Mohammed bin Salman. On 29 November, as we speak, the Prime Minister is visiting Riyadh, where she said:

“I am also clear that the flow of commercial supplies, on which the country depends, must be resumed if we are to avoid a humanitarian catastrophe. During my discussions with Crown Prince Mohammed bin Salman in Riyadh last night, we agreed that steps needed to be taken as a matter of urgency to address this, and that we would take forward more detailed discussions on how this could be achieved.”

The Foreign Secretary hosted talks in London this week, after which we will intensify efforts with all parties to reach a settlement that will sustain security for Saudi Arabia, the coalition and Yemen.

For the House to feel in any way that there is not a serious response to the catastrophic situation that my right hon. Friend the Member for Sutton Coldfield set out with passion and determination is not correct. We are doing everything we can, at the highest level, to deal with the humanitarian crisis and the security situation.

My hon. Friend is right. A process is under way, led by the UN special representative, and we are supporting that. It requires both sides to recognise that there is no military answer to what is happening in Yemen. There has to be a political solution. We are working steadfastly through our ambassador in Yemen and through the UN to try to ensure that the parties get together to make sure that there is a political solution. We are doing everything we can because we recognise the urgency of the situation.

The scale of the humanitarian crisis is truly frightening and the Saudi blockade could result in thousands of further deaths. A political solution is vital. Will the Minister tell us whether the Prime Minister has spoken to the Crown Prince of Saudi Arabia? If she has not, can she do so as a matter of urgency to get the blockade lifted?

Ministers, including the Prime Minister, have spoken to the Crown Prince of Saudi Arabia. Repeated representations have been made by other Ministers since 4 November and continue to be made. We recognise the need for security for the coalition, but we also recognise the urgent need to lift the restrictions and make sure that humanitarian access is given.

Yemen is subject to restrictions brought in by the coalition parties following the attack by a Houthi missile on Riyadh, and because of the smuggling of arms and weapons that has threatened the coalition in the UAE and Saudi Arabia for some time. I am not sure that the nomenclature adds a great deal, but that is the reality of the situation.

I think it is pretty clear that this is a blockade, and the sheer scale of the humanitarian crisis must now require urgent action by this Government and our partners to press the Saudis to lift the blockade. The Minister said in his statement that our NGO partners in Yemen are already reporting that water in major cities has

“stopped operating because of a lack of fuel.”

Can he tell us how extensive the fuel supplies are? When will it no longer be possible to distribute food? The level of death will increase dramatically as a result.

We of course hope that we do not reach such a case. Mark Lowcock from OCHA has made it clear that both these issues will become critical within a number of days. On what we have done since the attack on 4 November and the response from the coalition, on 5 November, an FCO statement condemned the missile attack; on 13 November, the Secretary of State for International Development called Mark Lowcock to speak to him about the circumstances; on 15 November, we issued a further statement stressing the need for immediate humanitarian and commercial access; and on 18 November—just this weekend—the Foreign Secretary conferred with the Secretary-General. Conversations are taking place in Riyadh all the time to reassure the authorities there on the security they need to deal with weapons capable of launching an attack on their civilian areas. At the same time, however, humanitarian and commercial access is absolutely vital.

(Urgent Question): To ask the Secretary of State for International Development if she will make a statement on the impact of the escalation of Saudi Arabia’s blockade on the humanitarian situation in Yemen.

First, it has been made clear where the Secretary of State is, and we have apologised for her being on a visit to Africa. Let me answer the question.

Yemen is the world’s largest humanitarian crisis: 21 million people in Yemen are in need of humanitarian assistance, and nearly 10 million are in need of immediate help to support or sustain life. As the third-largest humanitarian donor to Yemen and the second-largest donor to the UN appeal, the UK is already leading the world’s response to the crisis in Yemen. Our funding of £155 million this year will provide enough food for 1.8 million people for at least a month, nutrition support for 1.7 million people and clean water and sanitation for an expected 1.2 million people. 

As penholder on Yemen at the United Nations Security Council, the UK was responsible for a presidential statement earlier this year that called on all parties to provide safe, rapid and unhindered access for humanitarian supplies and personnel to all affected governorates in Yemen. We continue to call on all parties to the conflict to respect the statement and take action accordingly.

As my right hon. Friend the Foreign Secretary set out in his statement on Sunday 5 November, the UK condemns the attempted missile strike on Riyadh this Saturday in the strongest terms. The ongoing ballistic missile attacks by Houthi-Saleh forces against Saudi Arabia threaten regional security and prolong the conflict. This latest attack deliberately targeted a civilian area. We therefore recognise the coalition’s concern about illicit flows of weapons to the Houthis, in direct contravention of UN Security Council resolution 2216. 

We also recognise that, following Saturday’s attack, Saudi Arabia needs to take urgent measures to stem the flow of weapons into Yemen. At the same time, it is vital that the country remains open to humanitarian and commercial access. The Saudi-led coalition has confirmed that it will take into account the provision of humanitarian supplies. We are encouraging it to ensure that humanitarian supplies and access can continue. Our ambassador is actively making this case directly to the Saudi authorities.

Finally, there remains a desperate need for a political solution to the Yemen conflict, to help to end the suffering of the Yemeni people, to counter destabilising interference and to end attacks on neighbouring countries. It is vital that this situation does not escalate further. The United Kingdom will continue to work towards a political settlement that supports regional stability, and calls on all countries in the region to support that goal. We will also continue to support our partners in the region in protecting themselves against security threats.

I join the Minister in condemning the missile strike on Riyadh by the Houthis, which has been described by Human Rights Watch as

“most likely a war crime”.

We have seen alleged violations of international humanitarian law on all sides of this conflict. Will the Minister update the House on progress towards the independent investigation that was agreed at the recent United Nations Human Rights Council? I welcome what he says about seeking to bring all parties back to the table in Geneva. Can he tell us what progress has been made towards securing a ceasefire, so that a political solution can be achieved?

The scale of the humanitarian crisis in Yemen is truly appalling. The cholera outbreak is considered the worst on record, and as the Minister said, the UN estimates that more than 20 million Yemenis are in need of humanitarian assistance, with 7 million on the brink of famine. The Saudi-led coalition has now intensified its blockade. With 90% of Yemen’s food imported, that risks making the dire humanitarian situation even worse. Does the Minister agree that that blockade could constitute unlawful collective punishment of the people of Yemen?

The Minister mentioned the representations that our ambassador was making. What representations has he and the Foreign Secretary made to Saudi Arabia to have the blockade lifted as soon as possible? I urge the Minister and the Government to do everything in their power to get that inhumane blockade lifted.

I am grateful to the hon. Gentleman, who is the Chair of the International Development Committee, for raising this issue. Let me try to take matters in order. On the reaction to the incident, we should in no way mistake the intent of the direction of that missile or where it came from. An Iranian-supplied missile to the Houthis was deliberately fired towards Riyadh airport, with all the implications that that involves. That the Saudis would take immediate steps to safeguard their country and ensure that the flow of missiles into Yemen was further checked is not unreasonable.

At the same time, as the hon. Gentleman makes clear, it is vital that humanitarian and commercial access should continue. We have consistently urged the coalition to take all reasonable steps to allow and facilitate rapid and safe access for humanitarian assistance and essential commercial imports of food and fuel. We are actively engaged with the coalition and those responsible for humanitarian support in Yemen to try to find a way that will enable the blockade not to affect the humanitarian access, while still safeguarding the important rights of those in Saudi Arabia who might be under attack. I spoke to the Saudi Minister on Saturday, shortly before the attack took place. I intend to speak to him again shortly, either today or tomorrow. Since Saturday night, the ambassador has been actively engaged in Riyadh in trying to deal with these issues.

In relation to cholera and malnutrition, we try to be at the forefront of international efforts on both those topics to provide support to UN agencies that are actively involved, and we will continue to do that.

Importantly, on the political negotiations, I am well aware of what is happening there. We had a meeting in New York recently, and there is likely to be another ministerial meeting shortly at which we will be trying to find a pathway through to the descaling of the conflict. This is not just about the coalition forces. It is about the Houthis and those who support them, and about whether they have any willingness to take regard of the appalling condition of the people of Yemen, which has been caused by their actions in starting the conflict and usurping a legitimate elected Government.

It is very easy for us on these comfortable Benches here in Westminster to talk about disproportionality in a conflict far away. My point is that the United Kingdom has focused on the activities of the Kingdom of Saudi Arabia without truly understanding why it is engaged, why the coalition is there and why the United Kingdom has an interest. I simply want to put that on the record. That is not, in any way, to minimise the reason and need for humanitarian law to be respected and for the activities of those who engage in warfare to conduct it according to the rules, but it does raise the rarely made argument about why on earth we are engaged in this and why the outcome matters to the United Kingdom.

I am grateful to the right hon. Gentleman for giving way. I have enormous respect for him and his experience, and I am listening carefully to what he has to say. For me, the crucial issue is respect for international humanitarian law. What is his answer to the point I raised: at what point would it be right to look at these matters independently, rather than leaving it to the Saudis to lead the investigation?

That point comes when the United Kingdom Government are not satisfied that the Kingdom of Saudi Arabia can fulfil its obligations, but I do not believe that position has been reached. I am sure the Minister will talk about the nature of our engagement with Saudi Arabia and how, as he says, it affects a group of states, through the Gulf Co-operation Council, that are engaged in a conflict in a manner they have not been before. There is an important point here: if we want and expect people in other parts of the world to be responsible for their own defence and security, they are going to have to get on with it and they are learning some of the processes. That is happening at the moment.

Secondly, on the nature of our engagement, I refer all colleagues to the very good report by the BBC’s Frank Gardner just before Christmas that is on the BBC website. Most of us recognise that Frank Gardner is a pretty independent voice, and he has looked at the nature of engagement. The openness of the Saudi authorities in dealing with him and explaining what they do, and the openness of the Saudi Foreign Minister in coming to this House, with any Member of this Chamber having access to talk about these issues and question in a manner not done before, is an important step forward. We know that everything is by no means perfect or clear, but the steps that have been taken by the British Government to encourage full disclosure have been important.

I must close on this next point, because Madam Deputy Speaker was very generous. We are beginning to learn that the importance of ending a conflict is paramount to the people who are affected by it, but there are good outcomes and less than good outcomes. Sometimes unless we are involved we can see outcomes to conflict that are not in our long-term interest and not in the interest of stability in the area. That is why we should continue to support our allies, who are working through the Gulf coalition. We should continue to be engaged fully with them, but recognise that our interests lie in a situation that does not create a terrorist cell in Sana’a and does not result in a Hezbollah-type operation active in Yemen. We must recognise that those states that oppose such situations are right to consider that their long-term stability and ours is best satisfied by a solution that ends the conflict, and puts in place a democratic Government supported by Yemenis and a Yemeni political process, not the outside interference of Iran.

If my right hon. and learned Friend would like to tell me the final terms of the resolution that will be presented to the UN, we might be in a position to answer the question. However, as I indicated, our position on recognition of Palestine as a state is assured as a result of the processes that have been gone through and the negotiations that are vital between both sides. As I mentioned in my statement, what happens next week is not an event, but part of that process. Palestinian statehood will not be secured by a resolution, whatever anyone thinks or whatever is passed at the UN. It will be secured by the mutual recognition of both sides, which comes through the negotiation process that both sides have been committed to. Our position remains that we are determined to ensure that whatever happens at the UN next week—and he genuinely should not prejudge anyone’s position in this on any side—it is good for the future and not damaging to the negotiation process.

I commend my right hon. Friend the Member for Manchester, Gorton (Sir Gerald Kaufman) for tabling an urgent question on this important issue. Surely it would have been better for the Government to have come to the House this week with an oral statement covering this issue and the developments elsewhere in the region, including Syria.

Labour has long supported the establishment of two states living side by side in peace and recognised by all their neighbours. There is widespread frustration and disappointment at the failure to make any progress in recent years. We seek an immediate return to meaningful negotiation between the parties, based on the 1967 borders with land swaps, resulting in a Palestinian state living in peace and security with Israel.

The Palestinians’ path to independent statehood will require recognition at the United Nations, and Labour supports that goal. We will judge any move made at the United Nations next week—such as the potential upgrading to observer status of the Palestinian delegation—on the basis of the contribution that it can make to securing meaningful negotiations between the Israelis and the Palestinians and achieving a comprehensive agreement. Contrary to what the Minister has said today, however, we believe that the options before the international community are now clear. This morning, President Abbas, who has seized the attention of the world on this issue, has said that the Palestinians will pursue statehood in the absence of genuine alternatives.

Will the Minister set out the Government’s position for the House today—the last opportunity before the House rises for the recess—and tell us how the United Kingdom will vote on the following three very real scenarios? First, how would we vote in the UN Security Council on full recognition? Secondly, what would be our position in a vote in the UN General Assembly advocating full recognition? Thirdly, how would we vote in the General Assembly on enhanced observer status for the Palestinians?

I thank the hon. Gentleman for what was, at the beginning of his remarks, a clear statement of a position that is virtually identical to that of the Government. That is to say, he and his party will make a judgment on any option that is put forward next week on the basis of the contribution that it can make to an ultimate settlement. We will do exactly the same. I am sure that he will respect my position when I tell him that I cannot answer his hypothetical questions, because every nuance in every comment adds to the general pot that is now being discussed. There are times when these issues have to be put privately, before a public position can be taken.

Over the past few weeks, we have heard many statements from representatives on all sides, indicating that a vote might be taken in the United Nations Security Council or that it might not, that it might be taken in the General Assembly or that it might not, or that this might depend on a Quartet statement. All those issues are still live and current, and although I quite understand the House’s desire to know the negotiating position, it would be genuinely unfair of hon. Members to press me on that at this stage. My answer would have to be the same. I understand entirely where the hon. Gentleman is coming from, and we take comfort from understanding, from his first remarks, that he and his party recognise the position that we are in. We want to ensure that nothing that is put forward and agreed next week will damage the prospect of peace between the parties, which we believe will come from a negotiated settlement and, we hope, as soon as possible.

We have no plans to change our position on Hamas. The Quartet principles that my hon. Friend sets out remain the benchmark towards which Hamas should move—that is, a rejection of violence, a recognition of the state of Israel and an acceptance of previous agreements.

There is real concern about the continuing lack of progress towards peace between the Palestinians and the Israelis. What is the Government’s assessment of the impact of last week’s reconciliation talks between Fatah and Hamas on the prospects of a peaceful transition to a two-state solution, and what role do they see for the European Union in this crucial period?

It is difficult to see the impact at this stage, because not all the details are available. It must always have been the case that at some stage there must be Palestinian unity, because there cannot be a sensible two-state solution unless all parts of what is deemed to be Palestine are involved. Therefore, the fact that Fatah and Hamas have come to some agreement is something that might provide a step forward. However, it is crucial that that should lead to progress and to both Palestinian wings continuing to reject violence, continuing with the peace process and recognising the state of Israel. As yet, Hamas has not made any move in that direction. We hope that the reconciliation will eventually lead to progress towards a democratic Palestinian state that will indeed reject violence and wish to live in peace and security with its neighbour, but we must judge it by its actions.

With your permission, Mr Speaker, I would like to make a statement on the situation in Egypt. First, may I apologise on behalf of the Secretary of State for his absence? The House may be aware that he is attending a Foreign Affairs Council today, where this issue is at the top of the agenda.

The calls for political reform in Egypt have been peaceful, but the general unrest has become increasingly dangerous, with elements of violence leading to lawlessness in some areas of major cities such as Cairo, Alexandria and Suez. Severe restrictions on freedom of expression, including the closure of internet access and mobile phone services, have only fuelled the anger of demonstrators. We have called on the Egyptian authorities to lift those restrictions urgently.

I am sure that the House will join me in expressing our deepest sympathies to all those affected by the unrest in Egypt, including the families and friends of those who have been killed and injured. Casualty figures remain unclear, but it is estimated that at least 100 people have died. On Saturday, the army took over responsibility for security in Cairo, and its role has so far been welcomed by protestors. Our aim throughout these events has been to ensure the safety of British nationals in Egypt and to support Egypt in making a stable transition to a more open, democratic society.

I turn first to consular issues. There are an estimated 20,000 British tourists in Egypt, the majority of whom are in the Red sea resort of Sharm el Sheikh, where, according to our latest information, the situation remains calm. We estimate that there are a further 10,000 British nationals in the rest of Egypt.

On Friday 28 January we changed our travel advice to advise against “all but essential travel” to the cities of Cairo, Alexandria, Suez and Luxor due to the severity of demonstrations there. On Saturday 29 January, we heightened our travel advice further to recommend that those without a pressing need to be in Cairo, Alexandria and Suez leave by commercial means where it was safe to do so. Those in Luxor are advised to stay indoors wherever possible. A daily curfew remains in place throughout Egypt from 3 pm to 8 am.

Cairo airport is open, but has been operating under considerable difficulties. The situation was particularly difficult yesterday, but our ambassador in Cairo reports that it has eased a little today. Flights are operating but are subject to delays or cancellation. The majority of British nationals have been able to leave Cairo airport today. We estimate that about 30 British nationals will remain at the airport overnight, to depart on scheduled flights tomorrow. The situation also appears to be improving in Alexandria, with road access to the airport now secure. We have staff at Cairo airport working around the clock to provide assistance to any British nationals who require it. We also have staff in Alexandria, Luxor and Sharm el Sheikh, who are providing regular updates about the situation on the ground in those parts of Egypt and staying in close touch with tour operators and British companies on the ground.

Additional staff reinforcements from London and the region have been sent to Egypt to help embassy staff maintain essential services in these difficult circumstances. A 24-hour hotline is available for British nationals to call if they need assistance or advice, and help is also available around the clock from the crisis resource centre at the Foreign and Commonwealth Office. I am sure the House will join me in recognising the hard work and dedication shown by all our staff, in both Egypt and London, in responding quickly and professionally to the unfolding events.

I turn to the political situation in Egypt. The UK has major strategic interests in Egypt, which has played an important role as a regional leader, including in the middle east peace process, and we are the largest single foreign investor. The scale of the protests is unprecedented in Egypt in the past 30 years. We have called on President Mubarak to avoid at all costs the use of violence against unarmed civilians, and on the demonstrators to exercise their rights peacefully.

In response to the growing protests, President Mubarak announced on 28 January that he had asked the Government to resign. On 29 January, he appointed the head of the Egyptian intelligence services, Omar Suleiman, as his vice-president and Ahmed Shafiq, most recently Minister for Civil Aviation, as Prime Minister. Further Cabinet appointments have been made today. However, demonstrations have continued and are now focused on a demand for President Mubarak to resign.

It is not for us to decide who governs Egypt. However, we believe that the pathway to stability in Egypt is through a process of political change that reflects the wishes of the Egyptian people. That should include an orderly transition to a more democratic system, including through the holding of free and fair elections and the introduction of measures to safeguard human rights. Such reform is essential to show people in Egypt that their concerns and aspirations are being listened to.

We continue to urge President Mubarak to appoint a broad-based Government who include opposition figures, and to embark on an urgent programme of peaceful political reform. We are also working with our international partners to ensure that those messages are given consistently and that technical and financial support for reform is available. The Prime Minister has spoken to President Mubarak and President Obama. The Foreign Secretary has spoken to Egyptian Foreign Minister Aboul Gheit, Secretary of State Hillary Clinton and EU High Representative Baroness Ashton over the weekend, and he will also be discussing the situation in Egypt with EU colleagues at the Foreign Affairs Council today.

The situation in Egypt is still very uncertain. The safety of our citizens is our top priority, and we are putting in place contingency plans to ensure that we are prepared for all eventualities. I commend this statement to the House.

First, I thank the Minister for his statement and for providing a copy in advance.

The House is united today in expressing our concern at the loss of life in Egypt since last Wednesday. As the Minister said, it has been reported that more than 100 lives have been lost, and I join him in expressing condolences to the families and friends of all those who have been killed or injured. Thousands of courageous Egyptian citizens have taken to the streets to demonstrate for the basic political freedoms that we in the United Kingdom can take for granted. We welcome what the Minister has said today in support of an orderly transition to a broad-based Government who will address the legitimate grievances of the Egyptian people.

Two weeks ago, we expressed concern about the speed at which the Government were offering support to British nationals who were stranded in Tunisia. We welcome the lessons that have clearly been learned since then, as this has ensured a swift response in getting the information and guidance that the Minister has described to British nationals in Egypt. As he said, the Foreign Office has issued travel advice urging British nationals not to travel to Cairo, Alexandria, Luxor or Suez, and to leave by commercial means when it is safe to do so. I thank the Minister for updating the House today on the assistance that is being given to those British nationals trying to leave Egypt, and I join him in commending the hard work and dedication of the FCO’s staff in Egypt and here in London. I also welcome his announcement of additional staff. Can he assure the House that the Government have contingency plans in place to cover every eventuality, and that they now have enough consular officials on the ground to provide the necessary advice and assistance to UK nationals in Egypt?

The European Union has an important role to play in promoting regional stability and security in the middle east and north Africa, and it is encouraging to hear that Egypt is at the top of the agenda for today’s European Foreign Affairs Council. Does the Minister agree that the European Union should place greater emphasis on supporting the development of democracy, pluralism and human rights throughout the middle east and north Africa?

Over the past 30 years, Egypt has played a crucial role in fostering steps towards the middle east peace process. There are legitimate concerns that a political vacuum in Cairo could undermine the already precarious prospects for peace. Can the Minister update the House on discussions with Egypt’s neighbours, including Israel and the Palestinian Authority, who have important concerns for the peace process and for the stability and security of the wider region? The Minister told us that the Prime Minister had spoken to President Obama about events in Egypt. Could the Minister update the House on the progress of those discussions with the US Administration?

A disturbing feature of the past week’s events has been the regime’s censorship of independent media. I join the Minister in calling for an urgent end to restrictions on internet access and television broadcasting across Egypt. As he said, it is not for the United Kingdom to decide Egypt’s future path; that is a matter for the people of Egypt. Does he agree, however, that the United Kingdom has a responsibility to those people to support their demands for freedom and to encourage an orderly transition to a more open, democratic and pluralist Egypt?

I thank the hon. Gentleman for the tone and content of his remarks, and particularly for his appreciation of the work of our consular staff in London and Egypt. I think that he and I see the political situation there in very similar terms.

In answer to the hon. Gentleman’s question on consular staff, we have 20 members of staff at Cairo airport. They are very visible, because they are wearing orange bibs so that people can see them. I understand that we are the only Government who have staff there. Indeed, a number of them slept there last night in order to be on hand constantly to deal with any issues and to show a degree of solidarity with the British citizens who were required to spend the night at the airport because of the curfew restrictions. We hope we have enough people in place to do the job of answering all the questions.

In terms of EU support over a period of time, Egypt has an association agreement with the EU, which is implemented through a jointly agreed action plan. Although Egypt has implemented some of its commitments on economic reform, progress has been more limited on political and social reform. Indeed, the engagement with the EU contains vital steps on political and social reform—those are pressed on all nations that wish for such relationships. It is only to be hoped that reform ideas will be further implemented as a result of the events that we have seen taking place.

The hon. Gentleman mentioned the middle east peace process. He is right that this situation has come at a very difficult point in that process. An awful lot of work is being done to try to get the parties closer together. Egypt has been an ally in terms of moderate Arab opinion, and of course made its own arrangements—a peace agreement—with Israel some time ago. Clearly, whatever Government emerge in Egypt, and whether the president continues or something else happens in due course, our strategic interests remain the same. We clearly hope for a Government in Egypt who see the middle east peace process as the absolute bulwark to the solutions that are needed in that whole region, and who see that it is crucial to proceed with the process. I know that those concerns are shared in Israel.

I welcome what the hon. Gentleman said about media restrictions, and we are pressing Egypt extremely hard on those matters. Egypt has international commitments to freedom of expression, which has been severely curtailed by restrictions on the internet and electronic media. Our sense is that that actually does no good at all, because of the way in which information spreads these days. Clamping down on one media simply squeezes the bubble and more information appears elsewhere. For all sorts of reasons, not least in respect of getting information to people when there are security difficulties, which we need to do, it would be best not to stop information spreading.

The Prime Minister has had conversations with US President Obama, as the Foreign Secretary has with Secretary of State, Hillary Clinton. Again, there is a common feeling that the demands of the people in Egypt for political reform have been long-standing, and that they are not going to go away, whether they are suppressed or repressed. The only way forward is to look for a proper political process that will give an orderly transition to a state of government of which political reform, free and fair elections, and an acknowledgment and acceptance of free expression, are key parts. On that, the US and UK are absolutely agreed.

Finally, the hon. Gentleman mentioned support for the people of Egypt. As I indicated earlier, it is not for this country to decide what Government there might be, but there are principles that underpin a stable society. Openness, transparency, accountability and a free political system are, in fact, not agents of dangerous change, but the foundations of political stability. The Government share that view with all in the House. We hope that there is an orderly and peaceful transition towards such a future for the people of Egypt.

The Government have already expressed concern about the build-up of arms in the area by Hezbollah and Hamas, none of which is conducive to what we all want: a negotiated peaceful settlement of the middle east process that is a secure and sovereign Israel side by side a viable Palestine.

When the Minister visits the middle east in the new year, will he press Israel further to reduce its restrictions on freedom of movement both for Palestinian people and for Palestinian goods? Free movement is crucial; so, too, is providing global opportunities for the Palestinians to trade with the rest of the world. In the Foreign Office business plan, UK Trade & Investment is developing its strategy; will the Minister ensure that UK trade with the west bank is absolutely part of that UKTI strategy?

Yes, indeed; I welcome the hon. Gentleman’s comments. There was a successful investment conference in the west bank just a few months ago, and it is in the interests of all that economic prosperity is encouraged on all sides. It is in the interests of Israel to make sure that there is as much access as possible—providing, of course, that its essential security interests are safeguarded. Wherever they have been threatened, as in Gaza, it remains necessary for the Israelis to control any materials that might detract from that. When it comes to economic development and movement, however, the hon. Gentleman is absolutely correct.

I welcome you to the Chair, Mr Gale, for the final two speeches of the debate. I congratulate my hon. Friend the Member for Ayr, Carrick and Cumnock (Sandra Osborne) on securing this debate, and I pay tribute to her long-standing and consistent advocacy of human rights in general, and the Palestinian cause in particular, during her time in the House. The same applies to my other hon. Friends who have contributed to the debate.

Over the past hour, we have heard powerful and often shocking testimonies that demonstrate the importance to the work of the House of delegations such as that sent by the Britain-Palestine all-party group to the west bank last week. It is welcome to have such an immediate and early opportunity to address the situation viewed by those who visited last week.

I see the Minister nodding—we have cross-party agreement on that.

This is my first opportunity to speak about the middle east since I joined the shadow Foreign Office team in October. My right hon. Friend the Member for Normanton, Pontefract and Castleford (Yvette Cooper), the shadow Foreign Secretary, visited Israel and the west bank last week, and met a range of Palestinian and Israeli leaders, including President Abbas and Prime Minister Fayyad. I would like to reaffirm the Labour party’s long-standing commitment to the middle east peace process and a solution based on the two states of Israel and Palestine living side by side in peace and security, with Jerusalem as a shared capital, and human rights at the heart of the process. Progress will require action by both sides, although in the context of this debate, particularly by Israel to end the expansion of settlements and the blockade of Gaza, as well as action by the Palestinians and other Arab states to fulfil their obligations under the principles of the Quartet.

I am pleased that my hon. Friend the Member for Ayr, Carrick and Cumnock focused on the plight of Palestinian children and, although I am a friend of Israel, I condemn everything that we have heard about today. That should not be difficult for a friend of Israel to do. If we are serious about the peace process, those of us who have long been friends of Israel must be clear that we are also friends of the Palestinians. I see my hon. Friend the Member for Birmingham, Northfield (Richard Burden) nodding; I know he believes that that can be achieved, provided that we stick with the absolute principles of human rights and democracy.

I deplore the methods that we have heard about in such detail today, primarily because they violate the universal principles of human rights, but also because they exacerbate tensions and undermine the prospects for peace. I pay tribute to the organisations mentioned during the debate and the brave NGOs that take up such causes. In particular, I mention Defence for Children International and the Israeli human rights organisation, B’Tselem, which does fantastic work in that field.

My hon. Friend the Member for Easington (Grahame M. Morris) mentioned night arrests, which are of particular concern especially if, as is alleged, they involve the use of physical violence. That cannot be right morally, but it must also worsen community tensions in what are already difficult and fragile circumstances. As a number of my hon. Friends have said, interrogation methods include the use of blindfolding and sleep deprivation to obtain confessions. Detainees are often presented with a confession written in Hebrew—a language that the vast majority of them do not understand. Several cases have been cited that suggest that people have signed confessions that they did not understand, which is not right or defensible. There is a lack of legal representation for detainees; many reports from international and Israeli human rights groups describe detainees not being permitted proper legal counsel throughout their interrogation. As we have heard, the majority of cases end in a confession.

Data from B’Tselem suggest that the number of detainees have been relatively constant over the recent period. At the end of October, just over a month ago, 251 minors were detained by Israeli security forces in the west bank, including east Jerusalem—my hon. Friend the Member for Ayr, Carrick and Cumnock also cited that figure. That is of great concern, but I am particularly worried about those 34 detainees who are aged between 12 and 15, and the two aged between 16 and 18 who are being held under administrative detention.

Earlier, there was an exchange with the hon. Member for Aberconwy (Guto Bebb), who is no longer in his seat, about the application of human rights conventions in the occupied territories, and the security situation. I have two observations about that. First, even if Israel argues that obligations on human rights do not apply in the case of an occupied territory, international humanitarian law is clear and should be respected. I would urge Israel to apply the conventions on human rights as well. Secondly, as has been mentioned previously, according to the convention on the rights of the child—to which Israel is a welcome signatory—a child is defined as

“every human being under the age of 18 years.”

Nevertheless, we still have the inconsistencies and discriminatory practices to which reference has been made.
