Commons ChamberWhat I am going to say will echo what has already been said this afternoon, but I want to add my voice to those of all Members, and particularly to those of my constituents, because Bath constituents have been affected, and I want to help them as much as I can.
The loan charge has destroyed lives. Of course businesses and individuals should pay their fair share in tax; however, much damage has been done to people who acted in good faith. They have been punished in an entirely inappropriate way, while those who were behind the schemes have got away scot-free. We must defend individual taxpayers, even if we think that they might have been ill advised in the first place. As we have heard, many were forced into the schemes and did not have a choice.
The Morse review concluded that the loan charge was not an appropriate or fair response to the use of payroll loan arrangements. It focuses on loans made many years ago. They were not taxable under the law as it was understood at the time, and HMRC did not act against them. As enacted, the loan charge means that income tax must be paid as if the outstanding amount were part of the income taxed in the current tax year. That does not account for changed financial circumstances, which is particularly relevant for freelancers. Those taxpayers pay much more than they would have if they had paid tax on the loan at the time.
The loan charge’s stated aim is to end tax avoidance schemes, which is understandable. We all want to ensure that people pay their share; however, the central injustice is that HMRC has pursued only the users of the schemes, who acted in good faith, instead of those who recommended, promoted and operated them. As a result, the loan charge is not even a deterrent. There has never been a conviction of those promoting loan schemes that are now subject to the charge. The people who were compliant and disclosed information on their tax returns have been hit the hardest. Nearly all respondents to a survey by the loan charge and taxpayer fairness APPG reported that the risks of payroll loan arrangements were not explained to them. Now some face tax bills as high as £400,000.
Families have broken down, and there have been suicides. People were made to feel like criminals, despite having entered into the arrangements following professional advice. Many have said that as contractors they had little or no choice but to enter the schemes. Many small and medium-sized company owners and directors were also impacted after following professional tax advice. Their staff now face redundancy. As well as the awful mental health impacts, which the hon. Member for Strangford (Jim Shannon) mentioned, tax bills of hundreds of thousands of pounds leave some with no option but to go bankrupt. In many cases, being declared bankrupt will prevent people from working again or paying tax.
None of that would have happened had HMRC identified the issue earlier, publicised the risks of payroll loan schemes and penalised those behind them. The nightmare now unfolding has echoes of the Post Office scandal, where individuals with no intent of wrongdoing were left with impossible choices. Livelihoods and lives are being destroyed while those running the schemes, who knew what they were up to, are getting away with it. In addition, Government bodies are magnifying the injustice, pursuing people with intimidation and making them fearful. We should put that right, rather than making this wrong even more wrong.
We urgently need a genuinely independent review of the whole loan charge, and a fair and final resolution for all. It is clear there is huge cross-party interest. It is in everyone’s interest to finally resolve this, not just for those facing overwhelming tax bills but for HMRC and the Government. The loan charge has not even achieved its intention. Instead, it represents a policy failure that has left thousands suffering. It is for all of us to act, and act quickly.

The best route to affordable energy security is renewables. Nuclear power is blighted by delays and rocketing costs, and the Government are never honest about its much higher costs compared with renewables. On the Government’s watch, renewables have faced long delays and the costs for offshore wind development have increased by 40%. Will a renewables road map soon follow the statement to address those challenges and ensure that the Government do not lose their competitive advantage in offshore wind development?

Order. I want to try to get everyone in but, as colleagues are aware, we have another statement and then further business, so I request that questions are short and to the point, which will enable the Minister to be short and to the point as well.
In the last year alone, Cressida Dick was forced to make two public apologies for corruption and cover-up, in the Daniel Morgan murder case and—although she never apologised—for the atrocious mishandling of the vigil for Sarah Everard. We have seen the Met accused of institutional corruption, misogyny, racism and, following the Stephen Port killings, homophobia, not to mention the handling of the partygate fiasco. Now we have this damning report on the Charing Cross police station by the Independent Office for Police Conduct. This lack of leadership and the culture of cover-up are letting down honourable rank-and-file police officers, so why did the Home Secretary think that it was remotely acceptable recently to extend Cressida Dick’s term, as opposed to demanding her resignation?

I take this opportunity to welcome my new colleague, my hon. Friend the Member for North Shropshire (Helen Morgan), to these Benches. I congratulate her on the excellent speech she made today.
I rise to speak to the Liberal Democrat amendments 1 to 5. The Government claim that the Bill will ensure that judicial review is available to protect the rights of individuals against an overbearing state, but it will have quite the opposite effect. As Amnesty International and others have pointed out, the Bill will tie the hands of the judiciary in respect of what remedies they can order when public authorities act unlawfully. It will weaken the courts’ ability to ensure that justice is done and that human rights violations are remedied.

Commons ChamberFewer than 1% of college students are on a course with coverage of climate change. Unless we embed climate change and the environment into our post-16 education, the Government’s plans to get to net zero will simply not be possible. Bath College is offering some of those courses and doing something about it. Will the Secretary of State commit the Government to putting its weight behind courses that embed climate change into the curriculum?
We must have very short interventions at this stage, because we have a lot of people who want to contribute to the debate.

Commons ChamberI wish to put on record my warmest thanks to all our doctors, nurses and care workers here in Bath, to the police and emergency services, key workers and council workers, and to everybody else who has helped us keep going during lockdown.
The covid pandemic has forced us all to change our lives in ways we would not have imagined only a few months ago. In all of the hardship and tragedy of this time, one of the brightest points has been the improvement in our air quality, because many fewer cars are on the road. As we have adjusted to lockdown, many people have commented that they have thought about the benefits of talking a walk or going for a bike ride, because it is much more relaxing and there is more time to reflect. Walking and cycling contribute greatly to our wellbeing. We have talked at length about social distancing measures and the space we need to give each other when we are socially distancing. In this country, safety has always been a barrier to cycling, but now, as our towns and cities are less congested, cycling has become a much safer option. Of course, we want to restart the economy as soon as it is safe to do so, but when we do we have a once-in-a-lifetime opportunity to look at our streets with fresh eyes. We need to think about what did and did not work before lockdown, and at what we want to achieve as we put in place the conditions for a new normal.
For decades we have been overdependent on cars, and that must change. I have also spoken before about the need to tackle emissions from surface transport. We have been having these discussions in my city of Bath, which has suffered from severe air pollution, for many months now. As we slowly emerge from lockdown, we need to look at ways to avoid a dramatic resurgence in car use, particularly as many people may be nervous about using public transport. Other countries are already looking at ways to rebalance the priority given to cars over cyclists and pedestrians in urban areas, through segregated cycle lanes, speed reduction zones or new and widened pavements. I welcome the Transport Secretary’s new guidance to local authorities. Early action will be crucial, in order to embed changes in behaviour This is a great moment for change, and we must ensure that our economic recovery is focused on the need to get to net zero.
