I guess it comes down to whether we believe that somebody should come to this country and make a contribution first. Our proposals exclude those who are refugees who are seeking refuge in this country, but they are set out in that way because, I think, people who come to this country should make a contribution before they can start taking money out of the state system for other means of support.

18. Does my right hon. Friend agree that, as well as targeting legal aid on those with a strong tie to the UK, we should not make it available to those fighting weak cases that they would not pursue if they were spending their own money but will pursue if they are spending taxpayers’ money?

That issue applies particularly to judicial review. The proposals set out in the Bill currently before the House would set an appropriately high bar that will do precisely what my hon. Friend says. There must be a bona fide strong case that goes forward to the courts before the taxpayer will pay the bill.

I have listened carefully to comments that my hon. Friend has made. With the detail of the contracting, we will have more contracting areas. However, the rules we have put in place will mean that local firms on the Isle of Wight will be able to continue to provide own-client work, so there is no reason why there should not still be a good service for people on the Isle of Wight who need it. Of course, through the contracting mechanism for duty slots, we will have guarantees that duty solicitors will be available in police stations on the Isle of Wight, regardless of other circumstances.

I congratulate my right hon. Friend, both on his statement and on the sensible and careful way in which he has approached this issue. The statement will deliver fair access to justice for my constituents, while also making the necessary savings. Will he confirm that the savings being made will not be taken from other areas within his Department, that they are an overall saving and that it is still the same as originally proposed?

That is a very important matter. As the House knows, I have to make some substantial cuts across the Department. I am trying to balance them sensibly and to deliver them through reforms. What this package does is enable me, in a different way, to get to the same point financially. I am grateful to those who have been involved in the negotiations for the constructive way in which they have approached this. I know it is difficult and that it will be very unwelcome to many people in the profession, but it is the best option we have available.

The precise point of the payment-by-results system and of bringing new people into the system will be to allow providers with specialist skills—for example, in dealing with women offenders—to bring those abilities, skills and experience to bear so that we have much more targeted and tailored rehabilitation than in the past. Specific groups, including obviously women offenders, will be rehabilitated more effectively in the future.

Seven out of 10 young people released from prison go on to reoffend within 12 months. Despite all the best efforts of those involved in the current system, it is obvious that it is failing. What does the Minister intend to do to improve the situation?

As my right hon. Friend the Secretary of State explained, we completely agree with my hon. Friend’s analysis that the current system is not good enough. Reoffending rates have been broadly flat for the last 10 years, despite an enormous increase in public spending in that area. We want to introduce payment by results, new ideas, new people and new providers not just so that more people are rehabilitated after they leave prison, but so that the rehabilitation system is better and more targeted.

Opposition Members must realise that they left behind not only the biggest deficit in our peacetime history, but also the most expensive legal aid system in the developed world. We must take tough decisions and have a system that is realistic, given our financial constraints. I believe we have achieved that with the reforms we have put forward. We will monitor the impact of those reforms and ensure that we adjust anything that needs to be adjusted. Opposition Members should not believe that there are alternatives to what we are doing.

Felmores approved premises in my constituency is located near a school, a nursery, a playground and a densely populated housing estate. Does my right hon. Friend agree that although the provision of such premises is essential, a location such as the one I have described is inappropriate? Will he encourage probation trusts to work with the local community to find alternative locations?

I have a lot of sympathy with my hon. Friend and I will ask the Minister responsible for prisons and probation whether he will work with him to look at the situation described. Clearly, it is not sensible to locate such facilities in highly sensitive locations, although my hon. Friend will agree that their provision in the community is vital.

Yes, I will certainly look at that. We are keen to see the expansion of exactly that kind of work, for the reasons the hon. Gentleman gives. It is good for prisoners because they learn the hard skills of a trade and the softer skills of going to work in the morning and working a proper day, and we all benefit if offenders have the skills they need to ensure that they do not reoffend on release. I will look at what he has described. If we can find a way of expanding it, we will.

Does my hon. Friend agree that it is entirely right to make prisoners work, and that the enforced idleness that there has been in prisons has to be reversed because that will lead to prisoners getting gainful employment on release?

I agree entirely with my hon. Friend. It is right, and it is what the public expect, that prisoners do something productive while they are in custody, rather than simply sitting around in their cells. That could involve a range of things such as work, education or drug treatment, but he is right that his constituents and mine would expect them to be doing something.

I am afraid that we inherited a criminal injuries compensation scheme that was £765 million in debt. That is why we have inadequate funds to pay compensation, and why the payment of compensation in many cases has, regrettably, been delayed. We are trying to repair a system that was bust when we inherited it.

Recently in my constituency, a convicted sex offender who was automatically released at the halfway point of his sentence reoffended in the most appalling way. Will my hon. Friend agree to meet me to discuss both automatic release for predatory child sex offenders, and whether it is appropriate to house such individuals close to young families, schools, a playground and a park?

I am very happy to meet my hon. Friend to discuss the individual circumstances of that case. On the face of it, that situation should not have been enabled to happen. There should have been a sensible degree of risk assessment and a proper placement of the individual concerned. I am therefore only too happy to meet my hon. Friend to discuss the details of that case.
