I thank the hon. Member for Carmarthen West and South Pembrokeshire (Simon Hart) for securing this debate, which is ultimately about the nature of our democracy. When disagreement is expressed in a hateful, vile manner that is intended to intimidate, it is a threat to the very foundations on which democracy is built. There can be no doubt that the poison, hatred and abuse faced by almost every serving elected representative in the House must give anyone who might be considering entering public life pause for thought. The sad fact is that I genuinely hesitated before participating in this debate, since there is a view out there—I do not suggest it is universal, but it does exist—that serving elected representatives should not be debating this issue. We should just suck it up, because that is politics.

For some, engaging in politics in an abusive and intimidatory way is the new normal, and if someone does not like it, they should go and do something else. Sadly, even the value of democracy has become open to question in some quarters. All hon. Members understand that the mere fact of participating in this debate may open us up to more abuse being heaped on us, and for that reason my colleague, my hon. and learned Friend the Member for Edinburgh South West (Joanna Cherry), withdrew her name from those due to speak in the debate. With the exception of Scotland’s First Minister, she is the most abused female politician—if not the most abused politician—in Scottish politics.

Much online abuse—perhaps not all—is facilitated by the mere fact of anonymity. Online someone can pour abuse and intimidation on to whoever they decide they do not like. They can send abusive Facebook messages and retain their anonymity, or they can hide their identity behind a Twitter handle. If someone’s identity is not revealed, the theory goes that they can say whatever they like. They can move on from disagreeing with the views of an elected representative in a vile and hateful manner, and slip easily into threats that are designed to intimidate. They can comment in any way they like—after all, elected representatives are fair game, are they not?

If we do not agree with a political party or politician, democracy demands that we take them on through argument in a constructive and respectful manner. I have absolutely no time for Nigel Farage, but like many others, I do not think for one second that what happened to him yesterday was acceptable. If we cannot challenge our opponents with arguments, respectfully, we have already lost. I am deeply concerned by the examples of abuse that we have heard about today. Sadly, however, for too many the poison, abuse, and attempts to intimidate are what pass for political discourse in some quarters.

Where does all this hatred and poisonous bile come from? It comes from a variety of sources—we could probably have an entire debate on that—but there is no doubt that, as I found out to my cost, it can be stirred up by some sections of the tabloid press. Recently, a freeze frame photo of me in the Chamber, which lasted about one second, was published in a way to suggest that I was asleep on the job. I am sure that when the journalist printed that story it seemed like a jolly good wheeze, but as a direct result of that story—it was categorically untrue, and if someone had watched the film for another 30 seconds they would have seen it was untrue—I encountered, entirely predictably, the most horrific abuse, which was designed to intimidate me for having seemed to do something I had not done. Given the toxic nature of our politics, that shamefully bad and dangerous piece of so-called journalism was not worthy of the name. Over time, however, such pieces diminish, denigrate and belittle all elected representatives, and corrode the basis of democracy itself.

No one should be abused and intimidated simply for doing their job, yet it is now unusual to come across an MP who has not received a death threat. Some of my colleagues have suffered the most appalling abuse, as have others across the House. We could say that that is because politics has become polarised, toxic and so on, but it is also because we who serve in public life have become fair game. Apparently, tolerating intimidation and abuse has become part of our job description.

It has been said that we in public life have a duty to uphold the standards that we wish to see, which is correct, and we must also be careful with our language. Disagreement—including robust disagreement—is absolutely fine and the lifeblood of political discourse, but when it turns into personal abuse or hate-filled rants, it has become something else entirely. Studies have been carried out into abuse in public life and much has been written about it. We know that the police take it seriously, but in reality it is not just respect for elected representatives that has declined; it is respect for the democratic process itself.

Somehow—I do not pretend to have the answers—we need to help the public rediscover and rebuild their respect for the political process and those who serve in public life. If we fail to do that—I appreciate that it is a huge task—I fear that more elected representatives will come to harm in the course of doing their job. Even more than that, I fear that the very essence and value of democracy will continue to decline in the long term. The press also has a part to play. Of course those serving in public life should be held accountable, but let us make that about the arguments, not about tittle-tattle and gossip.

My own fear—I hope I am wrong—is that the Rubicon has been crossed and there is now a subculture in which someone can say what they want, and threaten whoever they want if they are standing for public office. Someone does not even need to be elected—just putting oneself forward for election is enough, apparently, to merit the most intimidatory behaviour. A culture of abuse and intimidation of elected representatives has been carefully cultivated in some quarters. It has gone unchecked and continues to be so. We can pass as many laws as we like, but the culture has to change. Where we are today is the culmination of that cultivation, aided and assisted by the apparent courage that anonymous postings on social media create, and whipped up by some sections of the tabloid press. This issue is bigger than any one individual; it is about the survival of our democratic system.

The medieval guardianship system, whereby a woman is owned by her closest male relative, means women in Saudi Arabia cannot travel, play sports or do a whole range of things we take for granted without permission from their male “owners”. Given that women who seek any level of gender equality and human rights face unprecedented danger and abuse in Saudi Arabia, will the Secretary of State condemn Saudi Arabia for treating women as mere chattels?

It is absolutely right that we call out behaviour that does not support or empower women or enable them to make the choices they want to in their lives. I am proud of the work that not only my Department but other Departments have done on that, and we will continue it. I call on all nations to make sure that at every opportunity we ensure women’s rights are in summit communiqués and absolutely everything else, and are a core part of every activity we do.

The Prime Minister has repeatedly set her face against a second referendum, but she also said that compromise will be required, and that what she is willing to compromise on is subject to negotiations with the Labour party. If that is the case, how can she so categorically rule out a people’s vote, and why is she apparently removing that option from any future negotiations and compromise conversations?

People are very concerned and alarmed by this Brexit chaos, in North Ayrshire and Arran and the UK as a whole. This is a time of crisis, and people in Scotland and across the UK are represented in these Brexit talks by a Prime Minister and a Government whom EU leaders at the weekend described as “evasive” and “confused”, in the final days before Brexit. Does she think that that description by EU leaders inspires confidence in those across the UK who are worried about Brexit?

Perhaps I can remind the Chamber that my hon. Friend’s name is Brendan O’Hara. I totally agree with him and commend those who have assisted in exposing dark money to the light.

Why is all that relevant to a debate about unincorporated associations in the political process? Mr Cook is the poster boy for the way in which UAs have been used to funnel vast swathes of dark money into our political process. Even worse, the Electoral Commission allows fraudsters such as him effectively to mark their own homework. The Electoral Commission gave me a very informative briefing ahead of this debate, and I will use its definition of an unincorporated association:

“UAs are associations of two or more people, which do not fall into any of the other categories of permissible donors, are carrying on business or other activities wholly or mainly in the UK and have their main office here. They are permitted to donate money to political parties, non-party campaigners, individuals in elective office such as MPs, and referendum campaigners.”

The key phrase in that definition is,

“which do not fall into any of the other categories of permissible donors”.

That is what today’s debate is about. If the Minister answers only one question in this debate, I would like it to be this one: why, given all the ways in which individuals and organisations can donate money to political parties and groups in a transparent and straightforward manner, do we still allow this backdoor method, which seems to me to be easily exploited by those who would seek to obscure the provenance of funds?

My hon. Friend is giving an excellent speech. Is he surprised and disappointed, as I was, to learn that when SNP councillors lodged a motion asking Tory councils in North Ayrshire to make a statement on dark donations to local Tory branches, the Labour councillors abstained? Does he, like me, suspect that that is not unrelated to the much-denied informal confidence and supply arrangement that exists between Labour and Tory groups across Scotland?

It sounds like “Better Together”.

The case that proves my argument beyond doubt is the unincorporated association that Richard Cook leads: the Constitutional Research Council, or CRC. He describes the CRC as a group

“to start promoting the Union in all its…parts”,

and while it is based in Scotland, critically, it has managed to spread its tentacles across the rest of these islands. The CRC is most famous—or should I say infamous?—for the £435,000 donation it made to the Democratic Unionist party during the Brexit referendum.

I will set out the rules surrounding the involvement of unincorporated associations in election funding, which will be helpful in responding to the debate. These associations are included in the list of permissible donors set out in section 54 of the Political Parties, Elections and Referendums Act 2000. The additional Political Parties and Elections Act 2009 introduced reporting rules for UAs that supported political activities; those rules are in schedule 19A of the 2000 Act.

Unincorporated associations must notify the Electoral Commission if the political contributions that they make over a calendar year are more than £25,000, whether that is through a single contribution or several. An unincorporated association must also notify the Electoral Commission of the reportable gifts that it received in the calendar year before it made the contribution, the calendar year of the contribution, and the calendar year following the contribution. That information is published by the Electoral Commission in its register of unincorporated associations and its register of recordable gifts to unincorporated associations. In this way, there is transparency as to who is providing the funds that are paid out by the associations.

No, I will not, for entirely unsurprising reasons.

Reportable gifts include a single gift of more than £7,500, two or more gifts of over £500 given by the same person in the same calendar year that total more than £7,500, and any additional gifts of more than £1,500 given by a source from which the UA has already received a gift of more than £7,500 in the same calendar year. Electoral Commission guidance also states that any UA that intends to make contributions of more than £25,000 should keep records of all the gifts it receives that are worth more than £500.

There are various ways in which offences are deemed to have been committed. As hon. Members are aware, responsibility for regulating political finance sits with the independent Electoral Commission. It is right and proper that that should sit with an independent body. Any concerns about breaches of the law should be reported to the appropriate authority, and a record of the regulated groups who make and receive donations, including MPs, MSPs and other politically active people, is publicly available on the Electoral Commission’s website. That data is a treasure trove of information, because it reminds us that the Scottish National party and pro-independence campaigners have accepted political donations from unincorporated associations. Who would believe it?

My hon. Friend is absolutely right that we have done a lot in this country to change domestic legislation—for example, to put reporting requirements on parts of the NHS. One must pay tribute to the tireless campaigning by courageous activists, both here and overseas, in respect of changing the practice and changing communities on the ground.

Everyone would agree that we need to tackle female genital mutilation. The Minister will be aware that the private Member’s Bill on the issue was scuppered. In the light of that, does she understand that confidence in the Government’s willingness to deal with the issue has been shaken? It is important that they now move quickly to restore that confidence.

Many of my constituents who live with serious health conditions are very concerned about the disruption to the supply of medicines upon which they rely. Should doctors be writing prescriptions to permit patients to stockpile medical supplies, or can the Prime Minister guarantee today—a mere 45 days from Brexit—that there will be no disruption to medical supplies post Brexit?

We are working with suppliers that provide medicines to the UK to ensure that there will be a continuity of supply and that patients will continue to receive the medicines they need in all scenarios, including in the case of no deal, so that patients will not need to, and should not seek to, secure and store additional medicines at home. We have already agreed that medicines and medical products, including medicines that can be bought in shops, will be prioritised to ensure that the flow of all these products will continue unrestricted after 29 March 2019. My right hon. Friend the Health Secretary wrote to health and care providers in December about the preparations for no deal, and we have been discussing with the Scottish Government, the Welsh Government and the Northern Ireland civil service the arrangements that will pertain in those locations.

As I have said to Members when they have referred specifically to the last of those points, there is no unilateral withdrawal mechanism. The United Kingdom can make the choice, and we are clear that Northern Ireland—Stormont—should have a voice in that choice, as to whether to go into the backstop or the implementation period. The reason why a unilateral exit mechanism is not there is that the European Union has a concern that the United Kingdom—we are clear that we would not do this—might use such a mechanism to put Northern Ireland and Ireland in a situation where there was a hard border.

The Prime Minister clearly cannot get her deal through tomorrow night—the Foreign Secretary conceded as much last week—despite the false choice we are being offered. Meanwhile, the Leader of the Opposition wants to call an election in the hope, like Micawber, that something will turn up. It gives me no pleasure to say that I am beginning to think that, given how things are going, perhaps we all might as well wait to see whether a mermaid riding a unicorn will happen by and provide a solution. Does the Prime Minister not think that a sensible way forward would be, at long last and finally, to listen to the majority of the Scottish people, and reject Brexit and this entire shambles once and for all?

The hon. Gentleman’s question appears to based on the premise that we should be looking at staying inside the European Union. The people voted for us to leave the European Union. The economic analysis shows that the best option that meets that requirement and protects jobs is the deal.

Like the Leader of the Opposition, the Prime Minister has set herself firmly against putting this issue back to the people, clearly because they feel that the result this time would be different. Does she agree that both main parties in the House have come full circle, and that we have ended where we began: running scared of UKIP?

The hon. Lady suggests that I thought we should not have a second referendum because it might come out with a different result. Actually, no, I do not think it would come out with a different result. I just believe that when we said to people in 2016, “We give you the choice and we will abide by that choice,” we should stick by our word.

My hon. Friend is absolutely right. I recognise that there are concerns about the backstop but, for a number of reasons, it is indeed the case that it is not attractive for the European Union to have the United Kingdom in the backstop. First, in that backstop, we will be making no financial obligation to the European Union, we will not be accepting free movement and there will be very light touch level playing field requirements. These are matters that mean that the European Union does not see this as an attractive place for it to put the UK. The EU thinks that is an attractive place for the UK to be in and it will not want us to be in it for any longer than is necessary.

Q11. The European structural fund is worth billions to Scotland, and it funds initiatives in my constituency of North Ayrshire and Arran such as tackling poverty and promoting social inclusion. The fund is to be replaced by the UK shared prosperity fund. However, we have no real detail or clarity as to how this fund will be designed or when it will begin. Why not?

That will indeed be replaced by the shared prosperity fund, which will look at ensuring that we deal with the disparities that exist between communities and between nations. The Government will be consulting before the end of the year.
