Gentleman, contact the two Ministers to whom he has referred and get a consistent response, hopefully so that that good organisation can continue to provide advice to the citizens in his constituency. Will my right hon. Friend congratulate our right hon. Friend the Prime Minister on his efforts, including a change in the law, to clear the demonstrators out of Parliament square so that it is available for all the visitors during the Olympics? When does the Leader of the House expect the remaining demonstrators to leave?

My hon. Friend was a keen supporter of the Police Reform and Social Responsibility Act 2011, which prohibits the erection of tents on Parliament square. As he knows, many were removed relatively recently. Operational decisions on making further progress to clear the square are a matter for the Metropolitan police and I shall draw my hon. Friend’s remarks to the attention of the police to see whether any further action is needed.

I am grateful to the hon. Gentleman for raising a key issue. I think that the Backbench Business Committee held a debate in January on the subject of the future of the high street and the Mary Portas inquiry. The Government have said that they will respond to that inquiry in the spring. I hope that it might be possible, perhaps with the assistance of the Backbench Business Committee, then to revisit this issue to see whether we can get the balance right between the supermarkets and the imperative to have a flourishing high street full of smaller shops.

Will my right hon. Friend tell the House when he expects the remaining demonstrators to leave Parliament square and when he expects the road works outside Derby Gate to be completed, as apparently it has taken three months for two valves to be put on to a defective water main there?

I will make inquiries about the last matter. I commend my hon. Friend’s work over many years in campaigning for Parliament square to be restored to its traditional glory. He will know that all but one of the encampments have been removed. I believe that the last remaining encampment is subject to an injunction that is to be heard quite soon. On the works on Parliament street, he will know that that is a matter for Westminster council, and I will raise it with the council. I am grateful to him for his initiative in ensuring that the road surface opposite the House of Lords is now much flatter, which is of great assistance to those of us who go on two wheels.

The hon. Lady is right that the Government made funds available. There was one source of funds, through the police authorities under the Riot (Damages) Act 1886, and there was another source of funds, I think through the Department for Communities and Local Government. I will pursue the issue that she raises and unblock any hindrance in funds flowing to her constituents, perhaps retailers, who have been adversely affected, and see whether we can make fast progress. It is our view that they are entitled to compensation; we want them to get it.

Mr Speaker, may I also wish you a happy birthday? It is an easy date for me to remember because it is also my birthday.

Does my right hon. Friend the Leader of the House recall me raising, in October 2010, the situation in Parliament square, when I described it as

“a no-go area surrounded by a campsite”.—[Official Report, 24 November 2010; Vol. 519, c. 256.]?

Will he update the House on progress in clearing Parliament square?

I commend my hon. Friend for the initiative he has taken over many years to ensure that Parliament square is restored to its dignity. Following the passage of the Police Reform and Social Responsibility Act 2011, powers were available to the Metropolitan police to clear the encampment, and the House may have noticed that, earlier this week, the majority of the tents were removed using the provisions in that Act. One encampment remains, which is subject to a High Court injunction, which I think will be addressed in a few weeks’ time.

I very much hope that before too long we can restore Parliament square to its former glory. It is at the centre of the finest capital city in the world, with Westminster abbey, the Houses of Parliament and Whitehall, and I very much hope that we can make the space available to people who have been denied that space by the activity over recent years. Finally, I would say that we have also restored the historic right to protest, as long as those protesting go home at the end of the day.

With the greatest respect to the hon. Gentleman, I wonder if I could put the same question to him. Can he use his good offices to persuade the relevant unions to call off the action? It is unnecessary, it would damage economic growth and recovery, and many of us consider it to be wholly premature.

Will my right hon. Friend ensure that the House can vote before Christmas on our sitting hours? The Procedure Committee is considering both sitting hours and the calendar of the House, but would it not be best for us to have a report on sitting hours? I think that there is a strong wish to return to the earlier start on Tuesdays that operated between 2003 and 2005.

My hon. Friend will know that the Select Committee on Procedure is conducting an inquiry into the parliamentary calendar, and I understand that some eight hon. Members gave evidence to it yesterday. I am not sure that the Committee is planning to report within the time scale that my hon. Friend has suggested, but certainly any change in the sitting hours will be subject to a vote in the House, which I suspect will take place some time next year.

May I say by way of preface that I commend the action that the hon. Lady is taking, in conjunction with others, to tackle excessive interest rate charges on credit cards and other means of credit? She asked for a debate, but answered her own question by saying that there would indeed be a debate next Monday. I shall draw her remarks to the attention of my colleague at the Treasury who will be replying to that debate. I am sure that nothing underhand has taken place at all.

May I draw the House’s attention to the real concerns, particularly in Norman Shaw, about the proposal to transfer the postal delivery from the Attendants to the postmen? That is causing great concern among the Attendants, many of whom have worked for the House for 20 or up to 36 years. Are they going to be made redundant? What is going to happen to them if that change is made?

I understand my hon. Friend’s concern, and I share his appreciation of the work that the Attendants have done. As he will know, this is a matter for the House of Commons Commission rather than the Government. You, Mr Speaker, as Chairman of the Commission, will have heard the comments, and I will ensure that the Commission addresses the issue at its next meeting.

The hon. Gentleman may have an opportunity on the first day back, when I have announced a debate on the Second Reading of a terrorism Bill, to raise his concerns, or he may be able to raise them in a debate on Monday dealing with police and crime. May I congratulate my right hon. Friend on his efforts to clear Parliament square? Is he aware that the lawn there is now completely clear of demonstrators for the first time in 10 years, so when does he expect the square to be open to the general public and what is happening about the pavement?

I applaud my hon. Friend’s continuing concern about Parliament square. He will know that the Greater London authority was successful in clearing the green, which is now being restored, and that Westminster council is now taking action to remove the encampment along the pavement, which I hope produces some results. The real answer, however, is the Police Reform and Social Responsibility Bill, which is now in another place and provides for the necessary powers to achieve a better balance between freedom of expression on the one hand and the right to protect Parliament square on the other. I very much regret that it is becoming increasingly like a shanty town, and I hope it will not be too long before we can restore its iconic value.

I thank the right hon. Gentleman for his kind words about my hon. Friend the Member for South East Cornwall (Sheryll Murray) which were appreciated by Members from all parts of the House. It was a tragedy that took place after she had taken part in a debate on coastguards and marine safety. On recall, as I have said previously, we will keep the position under active consideration. The right hon. Gentleman will know that at the request of a Minister, Mr Speaker can recall Parliament. We will do so if circumstances require it.

On the defection of the Libyan Foreign Minister, there will be an opportunity on Tuesday morning in the debate on humanitarian aid and Libya to update the House. We want to encourage those around Gaddafi to abandon him, and we welcome the further defection, which we hope will allow political transition and real reform to take place. Moussa Koussa is one of the most senior members of the Gaddafi regime, and the Foreign Secretary has regularly been in touch with him, most recently last Friday.

On policing, we welcome the fact that there is a debate on that subject next Monday in Opposition time. It remains our view that the police can make the necessary savings while protecting front-line services and prioritising the visibility and availability of policing. On health, the one change that the Government will not make is the change advocated by the right hon. Gentleman’s party to reduce resources for the NHS—cuts that would plunge the NHS into crisis, put at risk cancer drug funds, thousands more health visitors and better support for carers, to which we are all committed.

The right hon. Gentleman took a sideswipe at the two previous Prime Ministers. I am surprised that he wanted to refresh our memory of the Gillian Duffy incident, and the embarrassment of the previous Prime Minister. He then took a side swipe at Tony Blair and his cashpoint policy. The distancing of the Labour party from its history is well under way.

I am happy to say that the Deputy Prime Minister will answer questions at the Dispatch Box on Tuesday. We have extended the length of time for questions to the Deputy Prime Minister to 40 minutes, which will give him ample time to sweep away the somewhat frivolous suggestions that we have just heard from the right hon. Gentleman. Finally, may I reassure the right hon. Gentleman that we will block the Bill to which he referred? We will all miss during the month of April the refreshing contributions that he makes every Thursday morning.

I welcome my hon. Friend’s interest. There may be an opportunity later today in the remaining stages of the Police Reform and Social Responsibility Bill to raise the issue. As he knows, we are changing the law so that in future police will have powers to remove those encampments. In the meantime, we welcome what the Greater London authority has done to remove the encampments on the green. We welcome the enforcement action taken by Westminster city council to deal with the encampments on the pavement, and further discussions are under way between the police and the relevant authorities to make sure that Parliament square is in a fit and proper condition for the royal wedding.

Will my right hon. Friend update the House on the situation in Parliament square? Does he expect the measures taken by the Government to be sufficient to make the square a clear, free space for all people by the middle of April?

I understand my hon. Friend’s concern. He may have seen that a case ended, I think, on Monday, and the judge has reserved judgment on action being taken by Westminster city council. I welcome what the council is doing to remove individuals on obstruction grounds. On his specific question, we are talking to the police, the council and the Greater London authority to ensure that the square is in a fit and proper state for the royal wedding.

I understand that a programme has been introduced by Remploy. It is now in the third year of a five-year modernisation plan agreed with the last Government, which involved the merging or closing of 29 factories and the setting of challenging targets for a huge increase in the number of disabled people helped into work. We are totally committed to supporting disabled people in employment. We confirmed as part of the spending review that the five-year £555 million operational budget and status of Remploy would remain unchanged—and we did that at a time of financial constraint.

Can my right hon. Friend tell the House why the windows of some Government buildings in Parliament square are still boarded up following the students’ demonstration? The Ministry of Justice managed to fix the windows of the Supreme Court next day, but it seems that the Treasury cannot do the same for Her Majesty’s Revenue and Customs.

I am sure that funds are available for that purpose somewhere in the Treasury.

The 41 damaged window panels were removed from the site on 22 January. Replacement work will begin on 12 February and will be completed by the end of the month. Orders were placed by the contractor following clarification and agreement on costs with the loss adjuster.

I understand the hon. Gentleman’s deep concern. There will be Defence questions on Monday, at which he might have an opportunity to raise the matter. As he knows, we have concluded that RAF Kinloss and two other bases are not required by the RAF. The review to which he refers is now under way and will assess the overall needs of our armed forces, the long-term future that the bases may have and what alternative military requirements they could meet. I understand the urgency of an early decision, and I will pass that on to my right hon. Friend the Secretary of State for Defence.

The mess in Parliament square is now the subject of part 3 of the Police Reform and Social Responsibility Bill, but as that Bill cannot possibly become law before Easter, will my right hon. Friend consider asking for it to be split? Having taken advice from the Clerks, I understand that it is in order to split the Bill in Committee, so that part 3 could make its own way through both Chambers in that time.

I will put that proposition to my right hon. Friend the Home Secretary, whose Bill it is. My hon. Friend will know that Westminster city council is taking action, which I am sure he welcomes, to remove the tents that are out there. I understand that notices have been served, and I hope that follow-up action will be taken by the courts, and if necessary by the police.

I am grateful for the hon. Gentleman’s welcome for the written ministerial statement. Any Government have to strike a balance between written ministerial statements and oral statements, given the impact that a number of oral statements can have on the business of the House. He makes a strong case for that matter being debated, however. The alternative to Yarl’s Wood, whose closure I am sure he will welcome, has been piloted, and he might have heard Martin Narey of Barnado’s on the “Today” programme welcoming this initiative while recognising that there needs to be some secure accommodation available in the days before deportation. Also, the hon. Member for North East Derbyshire (Natascha Engel), the Chair of the Backbench Business Committee, might have heard his bid for a debate on the policy.

Can my right hon. Friend tell me whether he had any say, as Leader of the House and on behalf of the House, on the routing of the recent demonstrations outside the House? Given that it is possible that Parliament square will be restored under the provisions of the Police Reform and Social Responsibility Bill, does he agree that it would be unwise to put large numbers of demonstrators into the restored square?

Does my right hon. Friend recall that, in the 2001 Parliament, the House voted to rise at 7 o’clock on Wednesdays, yet last night we rose at 11 minutes past midnight after debating a motion that was proposed at very short notice and at great inconvenience to many Members? Does he think that that is a satisfactory situation, particularly when the shadow Leader of the House spoke for more than two hours in what was apparently a filibuster?

To one extent, we were better off having that debate yesterday; otherwise, we would have had it on Tuesday at 10.30 pm, and it would have gone on until even later. We do not plan to have debates after the moment of interruption on a regular basis but, from time to time, it is necessary to ensure that the business of the House is properly discharged.

The Government will introduce in due course a health reform Bill, which will be an opportunity for the hon. Gentleman to develop his case and for the Secretary of State for Health to explain why our proposals for the NHS will deliver a higher quality of service than we are getting at the moment.

Further to questions about the situation in Parliament square, is my right hon. Friend aware that there are now tents on the pavement outside at least one Government Department? Does he not think that that reflects very badly on the Government, the Greater London authority and the Metropolitan police? Why is this part of Westminster the only area in the whole United Kingdom where people can pitch a tent and not be moved on by the police immediately?

The short answer is that that is because of a somewhat surprising decision—which, of course, one cannot criticise—made by a magistrate, who decided that that pavement was not a pavement because very few people used it. The good news for my hon. Friend is that we have now published the Police Reform and Social Responsibility Bill, which deals specifically with encampments on Parliament square. The measures include a power to allow local authorities to attach a power of seizure to byelaws, to allow them to deal promptly and effectively with the nuisances to which my hon. Friend has just referred.

I agree with the right hon. Gentleman. It is important that we do not succumb to pressure from the Chinese and that this country—and, indeed, NATO countries and all countries—should send strong representations to the ceremony so that the Chinese understand that on this issue they are alone.

Does the Leader of the House agree that it would be better if large and volatile demonstrations were routed away from Parliament to end in a rally in a park, where just grievances and speeches could be heard? Does he agree that the Police Act 2005 has to be amended so that the commissioner can refuse a particular route?

I am grateful to my hon. Friend. My understanding is that section 12 of the Public Order Act 1986 allows the police to place conditions on a march, where they consider that without such conditions the march would result in serious public disorder. These conditions would include the duration, the location and the size of the march. I therefore think that the police may well already have the powers that my hon. Friend wants them to have.

Neither myself nor my hon. Friend the Deputy Leader of the House has had an opportunity to taste the products of the Government’s wine cellar. I have to say that the hon. Gentleman and his hon. Friends are probably better placed than we are to know exactly how much was invested in wine, what the vintages were—and, indeed, how much wine was consumed.

Further to his answer to me on 14 October, will the Leader of the House update the House on his discussions with the Home Secretary about sorting out the problem in Parliament square? Will specific provision be made in the forthcoming Home Office Bill to ban tents there?

I admire my hon. Friend for his persistence. He may know that there was an exchange in the House of Lords earlier this week when this very issue was touched on. The Government’s view is clear: it is not acceptable for people permanently to take over a site of national interest. We support the action taken by the Mayor to evict the democracy village from the Parliament square garden. We are working closely with Westminster city council, the Greater London authority and the police to ensure that the law supports the right to peaceful protest, but we also support the rights of others to enjoy our public spaces. As my hon. Friend said, we are considering introducing legislation to address this issue; if we do not get it spot-on first time, I am sure that we will be interested to consider any amendments that he might table.

When the House introduced experimental sitting hours in 2003-05, whereby we sat from 11.30 am to 7 pm on a Wednesday—as we do now—and also on a Tuesday, it was never intended that the House should sit in the morning and then through the evening until 10 o’clock, as we did yesterday. Will the Leader of the House consider reintroducing Tuesday morning sittings? Is he aware that we have sat later hours in this Parliament than we did on any night in the 2005 Parliament?

I am grateful to my hon. Friend, who raises the broad issue of the parliamentary calendar and whether we should change Tuesday hours back to ending at 7 o’clock instead of 10 o’clock. The Procedure Committee will examine the sitting hours and the whole parliamentary calendar, and following its inquiry I understand that it will put a range of options before the House. I agree that it is right that the House revisit the issue, because there has been a substantial change in membership since we last visited it. There will be an opportunity to look more radically at how we operate.

On my hon. Friend’s specific question, as I said in response to the hon. Member for Slough (Fiona Mactaggart), the last two weeks have been unusual, partly because this Government want to allow adequate time to scrutinise Bills, particularly important constitutional measures. However, we do not envisage the regime that we have had for the past two weeks being the normal pattern.

When does my right hon. Friend expect Parliament square to be cleared of demonstrators? Is he aware that the situation is worse than it was in the summer, with 20 illegally placed tents on the pavement meaning that nobody can use the square at all? When is he going to deal with this situation?

I am grateful to my hon. Friend for once again raising this issue. I support the action that the Mayor of London took a few months ago to clear the green in the middle of the square, and I hope that that area will be restored to the condition in which it used to be. In the meantime, the camps have simply moved to the pavement. That is wholly unacceptable, and it is not what one should see in the centre of an historic capital city. We are going to consider legislation in the forthcoming Home Office Bill to put the situation right.

As a former Housing Minister, I am of course concerned about what the hon. Gentleman says. The fact is that in 2004-05, expenditure on housing benefit was £10 billion. If no action were taken, that would go up to £20 billion within 10 years. That is simply unsustainable, as is the fact that people can claim and are claiming £100,000 a year in housing benefit. At the moment, working families, through their taxes, pay the housing benefit of families who live in better-quality accommodation. That is also unsustainable, which is why we are introducing proposals to restrain the increase in housing benefit, but there will be discretionary payments and transitional arrangements. There will be an opportunity to debate the matter at greater length when legislation is before the House.

Will my right hon. Friend update the House on the situation in Parliament square? Apart from the protester on the pavement, when will the rest of the square be cleared of demonstrators and when will it be open to the public?

I agree with my hon. Friend that the current position is unsatisfactory. Although the protesters have been moved from the square, they are now encamped on the pavement, which is unacceptable and unsustainable. I accept the right to protest, but we cannot have permanent encampments on the pavement. Legislation will be introduced following discussions with Westminster city council and the Metropolitan police in order to put that right. I hope that the legislation introduced by this Government succeeds where that introduced by the previous Government manifestly failed.

I am sorry that the hon. Gentleman has not been successful in getting an Adjournment debate on that subject. I can only suggest that, if he continues to apply, his number may come up one week. I am afraid that I cannot find time between now and the summer recess, but if Tuesday 27 July follows the usual pattern, and there is an Adjournment debate during which various subjects are raised, he may find it possible to share his concern then and press Ministers for the information that he wants.

Has the Leader of the House considered the possibility of legislation if the appeal about Parliament square fails? What will he do about the lone protester? Would not it be better if Parliament had authority over Parliament square?

I think that somebody made the same suggestion 10 years ago, and we legislated but it did not work. That is why we are where we are. It makes sense to await the Court of Appeal decision before considering fresh legislation. In the meantime, Mr Haw is allowed to continue to protest, so long as—speaking from memory—he remains on the pavement. Whether it would be appropriate to legislate just to deal with Mr Haw is something on which the House would like to reflect.

I am grateful to the hon. Gentleman, and I congratulate him on his election to the chairmanship of the Select Committee on Political and Constitutional Reform.

The debate on Tuesday is House business, and it will be for the House to decide whether it wants to proceed with the motions I have tabled or agree to amendments. Amendments to some of the motions have already been tabled. I should be more than happy to see the hon. Gentleman after business questions if he is available, to explain why we have constructed the motions as we have, why this is not the last word on implementing Wright, and why I believe that on Tuesday we should take an important step forward and build on it.

Last week, the Leader of the House told us that the Mayor of London had applied to the High Court for an injunction in respect of the demonstration in Parliament square. Will my right hon. Friend update the House on the situation?

The Mayor did indeed apply for an injunction. The case has been adjourned. My understanding is that more people appeared wishing to make their case than was originally anticipated, so it is taking longer for the High Court to hear many of the people now on Parliament square before it reaches a decision, but I shall try to keep the House informed.

Will my right hon. Friend make further representations about the demonstration in Parliament square? The current demonstration is completely different from the one in the last Parliament. That focused on one individual, but this morning there were 20 tents in Parliament square. Does he think that this is a satisfactory situation?

First, does the Leader of the House accept that the larger demonstration in Parliament square represents a real security risk? At the start of this new Parliament, he must show the dynamism to do something about it. Secondly, when will the Embankment entrance between the Norman Shaw buildings open? It is inconvenient to Members that it is closed.

On the second point, I will raise the matter with the appropriate officials in the House and ensure that my hon. Friend gets a reply. On the first, I would be reluctant to comment on issues relating to security.
