Lords ChamberI can take that point back. I may be completely wrong here but I thought the EU insisted on six months. I am glad someone is nodding, so I am not going mad: the EU insists on six months. There might be a pragmatic solution. We are probably undergoing a hump in the process and things will smooth out, particularly by engaging more staff.
My Lords, my noble friend mentioned that the performance of the contractor answering the telephone lines was unacceptable. Does the contract with Teleperformance have any penalties, so that there is a financial consequence to the company if standards are not maintained?
As always, my noble friend asks a very good question. I do not know the answer to it. I know that we have been engaging with the contractor and outlining that what is happening at the moment is utterly unacceptable, and I know that steps are being taken to rectify that.

My Lords, the ONS has recently published data that shows, after adjusting for age, that men and women of black ethnicity are four times as likely to die from Covid as people of white ethnicity. What steps are the Government taking to identify and then eliminate the causes of this very worrying disparity?
My Lords, my noble friend asks a pertinent question—that there is a disparity is not disputed. I know that the Ethnicity Subgroup of SAGE has done some work on this, both the year before last and last year. Factors include people’s jobs, and therefore their exposure to risk; household circumstances, such as more people in the house interacting; and financial difficulty in isolating. Vaccine hesitancy is an undoubted factor. The Government are giving financial help with things such as Covid support payments, but I think there is more to be gleaned. On people’s responses to Covid, maybe there is something in the physiology or make-up of different types of people—such as the cytokine storms that we talk about and inflammatory responses—that make them susceptible to more serious illness. I think some of that is yet to be uncovered.

Lords ChamberMy Lords, the cross-government effort to ensure that people were brought from Afghanistan to the UK as quickly as possible meant that it was not always possible to arrange local authority support in advance of arrival. In those cases, we have put in place hotel bridging accommodation. There are approximately 12,000 Afghan people living in 80 bridging hotels. That figure changes regularly as people move in and out of hotels.
My Lords, following the withdrawal of US troops from Afghanistan, the Government deserve praise for evacuating some 15,000 people to safety in the UK and for then launching what they described as
“one of the most generous schemes in our country’s history”
to resettle Afghan citizens. While many are indeed rebuilding their lives, too many, as we have just heard, are still stuck in hotels, with their children unable to access schools, with difficulty getting GP services and being unable to work because of problems with visas. Can my noble friend give a target date for moving into permanent accommodation the judges, doctors, members of parliament and other brave men and women who worked alongside us in Afghanistan?
My Lords, I am afraid I cannot announce a target date as it is subject to the number of housing pledges, the “jobs first” approach and other options. However, we continue to work with local authorities to source appropriate accommodation as soon as possible for families who were evacuated to the UK, and we are most grateful to the 323 local authorities that have pledged support.

Lords ChamberWas the former Secretary of State, Robert Jenrick, speaking on behalf of the Government when he said that the Vagrancy Act should be repealed?
When I voiced my support for something needing to be done about the Vagrancy Act, there was a general acknowledgement that something needs to be done about it. I extend the invitation to the noble Lord, Lord Best—and, indeed, to my noble friend as well if he so wishes—because it would be an important discussion ahead of the next stage. What I was trying to say in my rather long-winded explanation is that there are some complex things in the Vagrancy Act that need to be unpicked and understood, with consideration of the legislation on the back of that.

My Lords, I am grateful to all those who have taken part in this debate, beginning with my co-pilot, the noble Baroness, Lady Blake, who made the point that this is all about prevention and early intervention, and housing is absolutely crucial if we are to achieve that. She mentioned the broad support for this group of amendments from organisations such as Shelter and Crisis and made the point that this is simply building on existing provisions and extending what is already the case for domestic violence to gang-related violence—I will come back to that point in a moment. The thrust of the amendment to which she spoke was to embed best practice in statutory guidance; she mentioned the tragic case of the child Chris.
I am grateful to the noble Lord, Lord Carlile, who referred to the work of Mr Houlder on knife crime—the scourge of many housing estates—and also referred to the Edlington case, which he mentioned in an earlier debate. That underlined the point that there can sometimes be fatal consequences if there is inadequate consultation between the housing authorities and police authorities—a point that was underlined later in the debate by the noble Lord, Lord Bach. I am grateful to the noble Baroness, Lady Bakewell, for her support; she made the point that there is a potential resource implication behind these amendments if they are to be fully effective. Again, the experience of the noble Lord, Lord Bach, as a police and crime commissioner was of real value to the debate; he emphasised the importance of strengthening the link between housing and the police.
I am grateful to the noble Lord, Lord Paddick, who expressed concern that the Bill was too focused on a police-led initiative. The impact of these amendments will be to broaden the base by including housing; other amendments later on will also help broaden the base. He was anxious that this should not be entirely police-led.
I am grateful to the Minister for a thoughtful, sympathetic and comprehensive response to the debate, informed by her experience as a council leader in the north-west but also by her time as a Minister in what was then the Ministry of Housing, Communities and Local Government, now the Department for Levelling Up, Housing and Communities—he said with some hesitation. She made the point that she expected housing authorities to participate—they were well placed to do so—and referred on many occasions to statutory guidance. The concern that I have, and some other noble Lords may have, is that there is a gap between statutory guidance and what actually happens on the ground; hence the case for legislation to make it clear that this is not just guidance, there is an obligation so to do.
I recall listening to exactly the same arguments we have heard this evening in resisting what became the Domestic Abuse Act, which gave a statutory right to be rehoused to those suffering from domestic violence. Previously, the argument was, “There are adequate powers for local authorities to do this under the housing legislation.” However, we have now taken the step forward and put it in the Domestic Abuse Act, and this will build on that precedent and extend it to gang violence. I am concerned by the gap between theory and practice, and this would embed best practice in legislation.
Having said that, as I said, my noble friend gave a thorough response which I want to reflect on, together with the contributions of other noble Lords who have taken part in this debate, and in the meantime, I beg leave to withdraw the amendment.

Lords ChamberClearly, this Bill does not extend to the jurisdiction in Scotland, but I absolutely understand the point that the noble Lord is making. I will write to him with any updates on that because, of course, a woman should not be prohibited or stopped from receiving support just because she has crossed a border. I will write to him further on that and I thank him for raising the issue.
My Lords, I am grateful to all of those who took part in this debate and particularly to the Minister for her reply, which I will come to in a moment. The initial speech was made by my noble friend Lord Randall, who made a forceful speech about the importance of flexibility on local connection. He referred to the postcode lottery due to the different local authorities interpreting the guidance in different ways. In a sense, his plea was the same as mine, namely that it is not enough to leave this to guidance; one wants a legal assurance on the face of the Bill. My noble friend, and others who supported Amendment 147, will want to reflect on the Minister’s reply to that section of the debate.
The noble Baroness, Lady Finlay, reminded us that in Wales the amendment is, in effect, already in place, and that there has been no abuse of it. The noble Baroness, Lady Hamwee, put our debate in a slightly broader context, and reminded us of the need for move-on accommodation in order to free up capacity in the refuges, and she is absolutely right. I was grateful to the noble Lord, Lord Kennedy, for Front-Bench support for the amendments and I am sorry that he was not quick enough off the mark to add his name to my amendment. I was grateful to the noble Baroness, Lady Bull, who rightly pointed out that the application for housing, if it is known to come from the survivor, can be a trigger point in a relationship and provoke a violent reaction. This is why it is important that somebody, who she referred to as an ally, should be able to make the application on behalf of the victim to avoid exactly that risk. My noble friend Lord Cormack said that, unlike the previous amendment that was a probing amendment, these amendments meant business. The noble Baroness, Lady Armstrong, was too modest to say that she spoke with the authority of a former Housing Minister, which of course adds weight to the representations that she has made. I am grateful to the noble Baroness, Lady Burt, for Front-Bench support from the Liberal Democrats. She used the opportunity to trail an important amendment later on, which puts the emphasis on the perpetrator moving out of the building rather than the victim.
The Minister, my noble friend Lady Williams, is of course a former Minister at the Department for Communities and Local Government as it then was, and so she will have a first-hand knowledge of the issues that we discuss. I am sure that she remembers the passage of the Housing and Planning Act 2016, if not always with happy memories.
I was grateful to my noble friend for saying she entirely shared the objectives of those behind the amendments. She made two points in rebuttal. She referred to the Housing Act 1996, requiring that the accommodation should be suitable for the whole household; however, the whole household may not want to move—it may just be the victim. She did not quite address the point that in Wales and Scotland they have already resolved the issues she described and enabled an application to be made, as I understand it, on behalf of the primary victim.
I very much hope there can be a way through. My noble friend said the guidance says that the initial approach can already be made with consent by a third party. If the initial approach can be made with the consent of the victim, it is not absolutely clear why the substantive approach could not also be made. While I am happy to withdraw the amendment, I very much hope we can have some discussions to see whether we can give the assurance that I think the whole House wants and avoid the issues my noble friend raised in her response. In the mean time, I repeat my thanks to those who have contributed and beg leave to withdraw my amendment.

Lords ChamberI think that the noble Lord knows me by now. If Amendment 24 is carried, I will of course continue to work with him. The same is true for any other amendment that is successful on Report. I think that most noble Lords come from the same standpoint: they want to protect children but recognise that, sometimes, children may have to be involved in criminal activity. I know that my noble friend Lord Young does not take that view, but I think that most noble Lords recognise it. I will continue to work with the noble Lord, Lord Kennedy, Stella Creasy and others, whatever the outcome of today’s votes.
The noble Lord, Lord Russell, asked what happens if a person retires. That lifetime duty of care would probably necessitate certain people retiring and others taking over, but that does not mean that the duty of care does not extend over the young person’s whole life. On the formal reporting mechanism, we have IPCO and I am sure that there are other such mechanisms through the person tasked with that duty of care to the CHIS. If there are any other formal reporting mechanisms, I will notify the House of them.
My Lords, this Bill has generated a series of debates about the role of the state in protecting society, including where the boundaries lie and the extent to which they impinge on civil liberties. This debate has been no exception, as the noble and learned Lord, Lord Hope, said. I am grateful to all those who have spoken; I will come to some of their comments in a moment.
The argument in favour of the use of underage CHIS has basically been that, in exceptional circumstances, the end justifies the means. Permitting a child to commit a crime and take risks is justified by the prospect of catching criminals. The contrary argument is that the end does not always justify the means, as the noble Lord, Lord Paddick, said; if it did, we would allow the waterboarding of suspected criminals and terrorists to save lives—but we do not. The debate has really been over where the risk/reward ratio, if I can call it that, falls in this case.
I am grateful to all those who have spoken. The noble Baroness, Lady Massey, referred to the UN convention and the inevitability of an element of risk if we go down this road. She also offered some additional safeguards of her own—namely, prior judicial approval.
The noble Baroness, Lady Kidron, along with others, paid tribute to the work of Stella Creasy. I do so as well. She has been heroic in liaising with your Lordships in taking this agenda forward. As the noble Baroness said, the Bill formalises the ability of the state to harm a child. She made the very valid point that a guardian is required if someone underage is charged with shoplifting but that there is no such protection if they become a CHIS. She also analysed the difference between Amendment 24 and government Amendment 26.
My noble friend Lord Cormack came up with a different limit—namely, under 16—but said that he would be tolerably satisfied with Amendment 24, which may indeed be where we end up.
The noble Baroness, Lady Hamwee, again made the important point about how you distinguish between grooming on one hand, which we do not approve of, and using a child as a CHIS, which we, on occasion, do. I think she said that her party’s preference was for Amendment 24 rather than Amendment 12.
I am grateful to the noble Baroness, Lady Chakrabarti, for her kind words. She pointed out that having exceptional circumstances always allows a degree of flexibility and subjectivity which one cannot get away from. She pointed out that, even if the amendment was carried, we still cannot ban the use of underage CHIS. Again, she made the useful point, which I think picks up on a point the Minister made, that many people look younger than they are—they are over 18 but look younger. Could not more use be made of them to avoid the dilemma that some of us find ourselves in?
The right reverend Prelate the Bishop of Durham emphasised the moral imperative of safeguarding a child. I think he said that, while his first choice would be Amendment 12 and then Amendment 14, Amendment 24 ended up as his third choice.
The noble Baroness, Lady Jones, rightly pointed out that people are unaware at the moment of what is going on. She referred to them as “child spies”. Again, if push came to shove, the noble Baroness would support Amendment 24. She seemed amazed that an aristocrat—if I can call myself one of those—should bring forward social reform, but if she looks at the whole history of the 19th century, she will find that a lot of social reform was indeed pioneered by aristocrats.
The noble Lord, Lord Dubs, was the swing voter in the last debate. He remains pro-Amendment 12, and I am grateful for that. Amendment 24 was his third preference. He referred to the long-lasting impact on the mental health of a child and cast doubt on whether they could give informed consent.
My noble friend Lady McIntosh also referred to UNCRC and came down, on balance, in favour of allowing CHIS in the most exceptional circumstances. But she needed convincing that Amendment 26, the government amendment, was better than Amendment 24.
The noble Lord, Lord Kennedy, was in favour of Amendment 24 and felt that Amendment 26 did not go far enough. He was in favour of using CHIS in exceptional circumstances and made it clear that he cannot support Amendment 12. I am disappointed by that, and I will come back to that in a moment.
The noble Lord, Lord Judd, spoke in favour of Amendments 25 and 19, and was against the use of CHIS.
The noble and learned Lord, Lord Hope, favoured the more nuanced approach of Amendment 24, rather than the absolute approach of Amendments 12 and 14.
My noble friend Lord Naseby agreed with the arguments that the vulnerable should be exempted, but he had some doubts about modern slavery.
The noble Baroness, Lady Bull, remains pro-Amendments 12 and 13, and I am grateful for that and for her support. She has not been persuaded by the argument. She made the point that parents who did what the Bill allows the police to do would find that their child would be taken into care. She also made the point that teenagers quite often act on emotion rather than reason.
I blushed when my noble friend Lord Holmes said his kind words about me. The high esteem in which he currently holds me may be lowered by what I have to say in a few moments.
The noble Lord, Lord Russell, has played a key role behind the scenes in trying to find a way through, and I pay tribute to that. He also mentioned James Brokenshire, somebody with whom I served in government for many years; I join those who wish him well and a speedy recovery. The noble Lord made four suggestions as to how we could build on what the Government have proposed, with a view to finding a solution.
The noble Lord, Lord Paddick, was unimpressed by the government amendments and ended up pro-Amendment 24.
I have had a bit of time to read the Minister’s letter. In her wind-up speech, she made the point that Amendment 24 would be unworkable because of the difficulty of finding appropriate adults. But appropriate adults are already there; they have to be there for under-16s and for those who are vulnerable between the ages of 16 and 18. One could draw on the same cohort to meet the requirements of having an appropriate adult for others. I listened to her example, but in it the child is extricated only after the information has been procured. The argument many of us have put forward is that the child should be extricated at the earliest possible opportunity, rather than after they have done their bidding.
In a former life, I was a Chief Whip, and one of the qualities needed in a Whip is the ability to count. I have looked at the fate of amendments to this Bill where the Opposition has withheld support, and they have gone down by three-figure majorities. I also note the reservation of several on the Cross Benches whose views I respect, such as the noble and learned Lord, Lord Hope. I do not believe that dividing the House is a useful use of its time, particularly given the position of the Opposition. Against that background, I will not test the opinion of the House, but I hope that all those who spoke in favour of Amendment 12 will back Amendment 24. I beg leave to withdraw my amendment.
My Lords, can my noble friend tell the House what percentage of planning applications are dealt with within the statutory period by local authorities?
My noble friend sends a question to try me. I will have to write to him on that.
The noble Baroness raises a very pertinent point—a point which the noble Baroness, Lady Grender, has spoken about previously. This Government have committed to put in place £1 billion per year to help alleviate mental health problems. One of the worrying features that we have seen over the last few years is the rise in cases of young people in mental health programmes. The £40 million Homelessness Change and Platform for Life programmes help to deliver new low-cost housing for young people at the risk of homelessness, and it supports their transition into adulthood.
My Lords, has my noble friend seen the recent dialogue between the Association of Residential Letting Agents and the homeless charity Crisis, aimed at encouraging more private landlords to give support and homes to those who are homeless? Has she been able to give any support to that initiative?
I thank my noble friend for raising that question, because I certainly have. Crisis has been absolutely invaluable in providing, for example, underwritten tenancy deposits for homeless people. The programme has seemed to be very successful, with 90% of those people adhering to the tenancy and making it work.
To ask Her Majesty’s Government what has been the rate of new house building starts in the past 12 months.
My Lords, housing starts in England in the 12 months to the end of September 2015 totalled 137,490, with completions increasing by 17% over the same period. Under this Government, housing starts and new housing construction output are at their highest annual levels since 2007.
I am grateful to my noble friend for that reply. Has she seen the latest review by the National House Building Council, which shows a welcome increase of some 75% in new homes registered over the past six years, but says that there is a very substantial gap between supply and demand? Can she give any assurances that, as the industry recovers and responds to the many initiatives taken by the Government to increase supply, progress will not be impeded, as it has been in the past, by shortages of skilled labour or building materials?
My noble friend raises the important issue for the housing industry of both brickies and bricks. The Government have been very mindful of that: the DCLG and BIS are working with the Construction Leadership Council to review what skills the industry needs. The research that my noble friend mentions shows that more than 100,000 new jobs were created in England in the past year. We want to go further than that and encourage people who want to go into the industry to be able to do so, in line with our other ambition of creating 3 million apprentices by 2020.
