My Lords, does the Minister agree with the noble Lord, Lord Lilley, that we on this side are the establishment while the anti-establishment are the poor people who are stuck in government with only the Daily Mail, the Telegraph, GB News and a few others to help them, battling against a profoundly demoralising liberal consensus that somehow they do not seem able to break?
I rather agree with Michel Barnier, with whom I imagine the noble Lord sympathises quite a lot, who said:
“You can find nothing in the French constitution about migration, and there is almost nothing in the European treaties. For 30 or 40 years, there’s a kind of interpretation that is always in favour of the migrants … We have to rewrite something in the … treaties or in”
the European Convention on Human Rights. Is he wrong?

Lords ChamberThere is no workforce plan in process. As I say, the communication between the Home Office and the Department of Health and Social Care and other relevant government departments is a close one. The function that the Home Office can perform is to set the minimum floor for the sum that these workers must be paid, which, as I said earlier, is £20,960, reflecting an hourly salary of more than the living wage. That is an important mechanism to achieve the objective that the noble Lord outlined.
My Lords, I read in the financial pages of the profits that chains of privately owned care homes are making. I also note that some of them have their headquarters outside the United Kingdom for tax and other purposes. Is it a failure of regulation that these companies are extremely profitable with a substantial chunk of those profits coming from subsidies from the state or local government? Do the Government think they should tighten regulations to make sure that conditions for such workers are adequate?
It is not for the Home Office to regulate the profits made by private companies, and the noble Lord would not expect me to comment on that. I reassure him that the Department of Health and Social Care is sighted on what the appropriate standards should be for those working in the sector, and it works with the Home Office on the grant of sponsor licences for those coming to work in the sector.

Lords ChamberMy Lords, we are told that two of those arrested in Paris for painting anti-Semitic slogans on French synagogues have said to the police that they were acting under orders from Russian sources. Are the Government looking to see whether there is any element of foreign interference in some of these protests? It is in the Russian interest to stir up disorder in this country, and this is a very easy way to do it.

Lords ChamberMy Lords, I will talk a little about the role of the House as a revising Chamber and the legislative process. I am not an expert on the legalities of combating fraud, although I am well aware of the international dimensions of economic crime as someone who worked in the international sphere.
We have had a thorough committee process which was largely non-partisan; indeed, the way this House has treated the Bill has been almost entirely so. I have learned a great deal from a number of former Conservative Ministers and Cross-Benchers on the Bill, and I am interested to hear that two other former Conservative Ministers in the House of Commons supported the approach of these two Motions.
We are a revising Chamber, and the parliamentary process should be one in which reasoned amendments are taken into account by the Government and, where the Government are not entirely sure of their ground, compromises are made. The role of a Lords Minister is partly to act as a mediator between the reasoned arguments in this Chamber and the insistence of Cabinet Ministers that whatever they had thought of in the first place should absolutely go through unchanged. I have a strong memory of talking to Cabinet Ministers when I was a Lords Minister about why perhaps they might not wish to insist on their full original, because the reasoned arguments made in the Lords were sufficiently persuasive. That is the process that should be taken on. This is not an attempt to delay the Bill further: we are all committed to it going through. We are also committed to future-proofing it, so that it does not have to be amended, and to producing a Bill that commands as wide a consensus of support as possible.
I remind the Minister that we have not followed that for some Bills we have seen in recent Sessions. I am sure that he is well aware of the issue of party finance, which came up in the Elections Act and the National Security Act. He was sufficiently firm in resisting some of our arguments as to accuse me at one point of spreading rumours about a non-problem. I have now learned that the Leader of the Commons, Penny Mordaunt, has just written to the Security Minister to ask for the assistance of the intelligence agencies in investigating the origins of donations to political parties from foreign sources, so clearly there is now recognition within government that there is a real problem. There are other aspects of that Elections Act, particularly the insistence on a strategy statement from the Secretary of State, which the Government also appear to have had second thoughts on. Sadly, whoever become the next Government will have to introduce another elections Bill to put right some of the things that this House wished to amend but that the Government resisted.
Here we are with a Bill that has been improved and carefully scrutinised, and on which I, certainly, am persuaded by having listened at length and in succession to the arguments made by former Conservative Ministers wanting simply to improve the Bill to improve the fight against international fraud and economic crime.
Having been persuaded by that, I and the team on these Benches will recommend that Members of the Liberal Democrat group in the House support both the noble and learned Lord and the noble Lord in pressing their amendments, if they wish to do so, because we believe in a legislative process in which this House has a role to play, in carefully scrutinising and improving Bills, and making sure that when a Bill becomes an Act, it lasts for some time, because it commands a widespread consensus.
My Lords, I listened carefully to the case that the Minister advanced against these amendments. The core of that case seemed to be that the cost of a company actually responding to this legislation would make the company less efficient, and that it should be concentrating, as he said, on increasing its production and activities, and not be bothered with issues such as fraud, perhaps. What was peculiar about the Minister’s argument was that it was an argument which could be placed against any regulation whatever. It could be placed against the need, as has been commented already, to have seatbelts in cars. That increased the costs of production of the vehicle and, indeed, the cost of the vehicle. It could be argued that most financial regulation, which seeks to increase the stability and respectability of the financial system in this country, increases costs. Yes, it does, but the benefit far exceeds the cost.
If the Minister feels that the amendment of the noble and learned Lord, Lord Garnier, increases costs and damages production, why is he accepting it at all, even for larger companies? It seems to me that this is an empty argument. The Minister has not produced any data or argument for the cost-benefit trade-off on which he has rested his entire case. In fact, I think he has no case at all.

Lords ChamberMy Lords, I want to focus on a particular aspect of family migration: the recruitment of researchers and technicians from overseas, under the global talent and skilled worker visa programmes. I emphasise “recruitment”. Unlike the determination to block immigrants as such, at least part of our current Government positively want to attract large numbers of such talented scientists, technicians and engineers.
The noble Viscount, Lord Camrose, told the House last week, in reiterating the Government’s optimistic claim that they will make the UK a science superpower by 2030—that is to say, in seven years’ time—that
“bringing in overseas talent via the visa system”
is vital to that aim. He added that the number of researchers in key science subjects
“will have to increase by around 380,000, and overseas talent will be a very big piece of that”.—[Official Report, 13/9/23; col. 1008.]
That is what DSIT thinks, as perhaps do the Department for Business and Trade and DfE. The Home Office is pushing hard in the opposite direction.
The visa system is designed to keep families out. It will discourage any applicant with a family from coming. Visa charges have been raised several times in the past 10 years. In addition, an immigration health surcharge was introduced in 2015, initially at a modest £200 a year. This autumn, the health charge will rise from £634 to £1,065 a year, with a discounted rate for children of £776 a year. That is an increase of roughly 400% since 2015. It is payable for an incoming scientist’s partner and children and payable up front, on arrival. Alongside this, the visa charge will be raised by a further 20%, also payable up front on arrival on behalf of the researcher and all their dependants. Someone who has been offered a post at a salary quite likely to be under £50,000 a year will be charged up to £25,000 a year at the point of entry.
The Government have abandoned all pretence that these payments are assessed on the basis of regaining direct costs. The rise in visa charges has been justified by the Home Office as helping to pay for the cost of police forces and border services. The increase in the health charge has been hailed in official government statements as contributing to the cost of offering doctors an increase in pay. These charges are far higher than those imposed by comparable countries with which we are competing for this sort of talent.
We are already in a situation in which graduate students who come to study in this country are pressed to leave their family behind: acceptable perhaps for a nine-month course but agonising for people with partners and children staying much longer. For post-doctoral researchers—precisely the people we want to attract—we are expecting some of the world’s most talented scientists to leave their families behind when they come here to support the UK’s scientific ambitions, or to mortgage their first year’s salary to pay these upfront costs.
Some in government have suggested that universities should pay these extra charges themselves if they really want to attract such talented people, or that grants for research should have to include funds to defray these additional costs—taxing universities and grant-giving foundations to avoid having to pay for public goods out of our own taxes. These people will be paying UK taxes from when they start to work here. In effect, they will be paying twice for health services and, if they want to renew their visa after five years, they will have again to pay a similar amount up front.
This represents a total contradiction in government policy: the Home Office doing all it can to keep talented people out while universities and research centres, with the Government’s active encouragement, are trying to bring them in. I first came across this mess when my son returned from 10 years working in the United States with an American wife. Some of his friends from Cambridge, working in some of the best American universities, decided to stay in the USA because of the way they thought the British Government would treat their American wives and children if they accepted posts back here.
I understand that the Home Office does not always pay much attention to other aspects of government policy. I know that there are many on the right of the Conservative Party who are hostile to universities as hotbeds of leftie intellectuals. They are happy to undermine their finances and unconcerned about universities’ scientific ambitions. But sensible Ministers, such as the noble Lord, Lord Murray, will want their Government to rediscover strategic planning and coherent policy. So I ask the Minister to take this back and tell his colleagues that these increased charges discourage British researchers from returning from abroad and foreign researchers from coming to work here. It is bad enough being nasty to the families of refugees; it is counterproductive to make talented people we want to attract to the country pay through the nose for the privilege of a family life while working here.

Lords ChamberI beg to disagree and am happy to offer humility. I note that recently the Labour Party returned a donation from a Mr Ian Rosenblatt which it decided was inappropriate. All credit to it. It happens regularly. This is not a political issue; this a cross-political matter. As I say, every donation is listed, so there is 100% transparency. I welcome my noble friend the Minister’s proposals, which I think are extremely sensible and helpful to this argument.
We on these Benches very much welcome the concessions that the Government have made. I disagree with the rather overoptimistic interpretation of where we are from the noble Lord, Lord Leigh. In the last exchanges, the Minister said that the National Security Bill was about national security and not about donations to political parties, but donations to political parties from foreign powers are a matter of national security.
Indeed, in the last Commons debate on this, a number of rather distinguished Conservatives intervened to say how strongly they supported the amendment as put forward by the noble Lord, Lord Carlile, on the last occasion. I recall Sir Jeremy Wright saying that he found it “very difficult to disagree” with anything in the amendment. He is currently on the ISC and was previously a member of the Committee on Standards in Public Life when it was writing its report on public finance.
I have just read a paper on political finance that the Institute for Government has just published. That stresses how rapidly the context is moving and how the law needs to adjust to cope with that. It particularly stresses the extension of overseas voting rights to British citizens who have been resident abroad for a very long time, many of them dual nationals. Checking on where the ultimate source is for those things is going to be extremely difficult and probably impossible, but political parties should be on their guard against undue influence and the suggestions the Government are now making perhaps will help political parties to take further moves in that direction
I was also struck by the speech that David Davis made in the Commons last week about a donor to the Conservative Party who had given £750,000—not a modest donor, even by the terms of the noble Lord, Lord Leigh—who had spoken openly about buying influence and “access capitalism” as part of what he expected. This was a dual national whose fortune appears to have come largely from contracts within a number of post-Soviet states.
There is a problem there, and it requires investigation, and I welcome the Government’s acceptance that there is a problem and that it needs further investigation, and we look forward to reading the text of the amendment that the Government will move in the Commons and to the further work that they will do then—we hope in co-operation with other parties—to last beyond the next election. This is an area where we need to have electoral rules that are agreed by all the participants.

Lords ChamberMy Lords, I support Motion A1 from the noble Lord, Lord Carlile, and Motion C2. On Motion A1, I spoke in favour of the previous version of this amendment on Report on behalf of the Intelligence and Security Committee. Our position in the committee remains very much the same: we firmly support the introduction of this clause. Indeed, I cannot really understand why the Government continue to oppose the amendment. It is eminently sensible and the previous version received widespread support across this House. Indeed, as the noble Lord, Lord Carlile, said, it was notable that, apart from the Government Front Bench, not a single Peer across the House spoke against it.
The ISC’s Russia report in 2020 recognised that the UK, including political parties, had welcomed money from Russian elites, and the Government acknowledged that. They have, for example, as part of the Bill increased the sentences for electoral offences involving foreign powers. There is no doubt that protecting our democratic institutions should be the very top priority for the Government and parliamentarians, but the Government have adopted a rather dismissive and worryingly complacent approach to this risk. They claim that they oppose this amendment on the basis that the existing protections within electoral law are sufficient, that the amendment would not work in practice and that it would place an undue burden on grass-roots political organisations. These claims are patently not true.
Current protections within the electoral financing law are demonstrably inadequate. As the noble Lord, Lord Evans, the chairman of the Committee for Standards in Public Life, who is in his place, noted on Report, his committee undertook a major report into the regulation of electoral finance in 2021 and provided a series of recommendations to close several loopholes in this space, all of which were rejected by the Government. The report stated that
“we consider the current rules are insufficient to guard against foreign interference in UK elections”.
One of the many problems the committee identified was the ability of a foreign corporation to create a UK subsidiary with the sole function of receiving and channelling money to a UK political party. Further, as extraordinary as it may seem, unlike charities or companies, political parties do not have to examine the source of funds they receive. This means that it is perfectly possible for companies to make significant donations to political parties despite clearly not making operating profits and therefore with limited explanations of how they can afford such donations and where the money comes from. These factors clearly increase the threat of political parties being unduly influenced by a foreign power.
The report also noted that, since 2018, the Electoral Commission has supported the introduction to electoral finance of risk management principles that are used in anti-money laundering checks conducted by companies. As the noble Baroness, Lady Hayter, suggested on Report, this amendment would introduce such principles and ensure that political parties identify foreign money and potential proceeds of crime, establishing a culture of “know your donor” within parties similar to the “know your customer” approach in the financial sector.
Contrary to the Government’s suggestion, this amendment would not place a significant administrative burden on smaller political organisations, and nor would it be too difficult for political parties to implement in practice. As the shadow Security Minister noted in the other place, the Electoral Commission has stated:
“These requirements could be introduced in a way that recognises the need for proportionality … with different requirements depending on the size of a regulated entity’s financial infrastructure, or the size of a donation”.—[Official Report, Commons, 3/5/23; col. 129.]
Guidance would prevent this amendment, which increases transparency and accountability, becoming a disproportionate burden. The fact that due diligence measures are used in the charity sector and not just by commercial enterprises demonstrates that it would be entirely possible for similar measures to be adopted by political parties.
I find it extraordinary that the political parties currently do not have to check the source of their funding in the same way as charities and businesses—it is extraordinary—and it is inexplicable that our Government or any political party could consider it appropriate to oppose such a sensible and proportionate amendment. It is entirely necessary and it would go a long way to strengthening our democratic institutions, providing greater protection from foreign influence. I am sure that the Government agree that we must protect our democratic institutions from harmful interference and I am sure that, having heard all these arguments, they will change their view—or I hope they will
Moving on to Motion C1, on behalf of the Intelligence and Security Committee—I have been given its approval to speak on this—I am grateful to my noble friend Lord Coaker for introducing this amendment and we fully support it. It is interesting to note that, when a similar amendment was debated in the House, many Peers spoke in favour but only one, on the Government Front Bench, spoke in opposition. It seems to be a trend with these various amendments. Strangely, the same was true in the other place, where many MPs spoke in support and only the Minister opposed the amendment. The Security Minister himself acknowledged the need for the amendment when he stated that an update to the ISC’s memorandum of understanding needed to be made.
Parliament is united in its support for independent oversight of the intelligence agencies; it is only the Government who are seeking to undermine the ability for oversight, for purposes unknown. National security is too important to play party politics with. Members from across both Houses have repeatedly explained the need for this amendment throughout the passage of the Bill, but to no avail.
I intend to do so again to demonstrate the absurdity of the Government’s opposition to it. The ISC’s memorandum of understanding, which sits underneath the Justice and Security Act 2013, outlines its remit and the organisations that it oversees. Its remit encompasses the expenditure, administration, policy and operation of the agencies and four other organisations that form part of the UK intelligence community. As the ISC has made very clear in its most recent annual reports, intelligence and security activities are increasingly undertaken by a wider assortment of policy departments, as the noble Lord, Lord Coaker, mentioned, including those that generally do not carry out national security-related activity, such as BEIS—now the Department for Business and Trade—DCMS and the Department for Transport.
Those teams are not currently listed in the ISC’s MoU. This is solely because, when the MoU was drafted in 2013, they were not responsible for intelligence and security matters. Had they been, Parliament would have included them in the ISC’s remit. Parliament was clear on the remit it wished the ISC to have and the work it wished it to do on its behalf and that of the British public.
Effective oversight of intelligence and security matters can be undertaken only by the ISC. Only it has the security infrastructure to scrutinise effectively those aspects where classified material, such as intelligence, underpins decisions on national security. This is not rocket science—perhaps sometimes it is, but that is a different issue. Intelligence and security matters deal primarily with highly classified information. Parliament established the ISC, supported by security infrastructure such as the appropriate computer systems, storage facilities and vetted staff, to provide independent oversight of classified matters precisely because Select Committees cannot effectively undertake that role. They definitely cannot do it and it is wrong for the Government to pretend that they can.
The sole purpose of the ISC, and the reason Parliament set it up, is for it to hold the Executive to account on behalf of Parliament and the public. Independent oversight in this space is particularly important given the gravity of national security decisions and the significant intrusive powers that the agencies have at the Government’s disposal. The inability for Select Committees to provide effective oversight of intelligence and security matters has already been acknowledged by the Minister on Report.
The ISC’s MoU, which sets out which government bodies it can oversee, is woefully out of date. There is now intelligence and security activity undertaken by government that is outside the ISC’s independent oversight, which means that it is outside Parliament’s democratic oversight. I am sure noble Lords agree that that is unacceptable. In effect, it means that secret activity is being carried out in our name that no one is scrutinising. The ISC’s MoU needs to be updated so that Parliament can ensure that the Government are acting appropriately in the intelligence and security space at all times.
I find it appalling that the Government continue to oppose this amendment. It is hardly controversial. There is no reason to oppose it unless one wants there to be less independent oversight, less transparency and less accountability in relation to classified intelligence and security. Is that really what the Government want? Would they rather keep any problems behind closed doors? If so, we should be very afraid. This is a matter of grave concern. I therefore support this amendment.
My Lords, the Commons reason given for disagreeing to Lords Amendment 22 is:
“Because the law already makes sufficient provision in relation to donations to political parties”.
Yet we have heard that the Committee on Standards in Public Life and the Electoral Commission have made it quite clear that they do not believe the current law makes sufficient provision for that. I remind the noble Lord that the Committee on Standards in Public Life and the Electoral Commission, like the Intelligence and Security Committee, are part of the structure of constitutional safeguards in our politics. They are there to remind the Government how the rules need to be kept. A wise Government should accept that advice. When they do not accept it, Parliament should insist that they do.

Lords ChamberI thank the noble Lord for that question. The numbers are these. In March 2023, 477,931 sponsored study visas were granted to main applicants, which was 22% more than in March 2022. In the year ending March 2023, almost one-quarter, 24%, of all sponsored study-related visas granted were to dependants of students—149,400—compared with 15% in the year ending March 2022. Our indication is that 88% of those dependant visas were to those undertaking taught postgraduate courses, so the rule changes will have the effect of greatly reducing the availability of the dependency visas to those who might otherwise have used them, and therefore reduce the net intake.
My Lords, I declare an interest as someone who used to run the research side of the international relations department at the LSE. We had well over 50 research students while I was there. To my knowledge, all but one returned to their country of origin, or went elsewhere, after completion of their studies, and the one who remained, an Indian, is now teaching in a senior position in a British university. Is this a real problem, or is it part of the muddle of our migration statistics? Should we not be separating students who come here for either one or three years as temporary migrants and distinguish them from permanent migrants? The problem of our current migration statistics is that they lump everyone together, which as a result makes the whole problem look worse than it is.
I am afraid that I must disagree with the noble Lord: it is a real problem, for the reasons I have just read out to the Chamber, with the statistics demonstrating the increase in dependants attending, in particular those from two countries. The numbers are startling and required action to change the rules, and I am very grateful for the support from the Official Opposition in doing that.

Lords ChamberClearly, the increase in net migration has been the result of global events, such as the world recovery from the Covid-19 pandemic, and international events, as I outlined in the Statement, including the policy changes introduced as part of the new immigration system at the end of EU freedom of movement. All have had an impact on migration. The Migration Advisory Committee agrees that the discount available to employers employing foreign workers under the skilled worker route is a sensible solution for occupations where there are shortages, at least in the short term. However, no occupation should be on the shortage occupation list for ever. Sectors must therefore present a realistic strategy for ending their reliance on migration before such jobs can be added to the shortage occupation list, and present compelling evidence that they should remain.
My Lords, there is not time now, but perhaps the Government could initiate an informed cross-party debate on the long-term issues involved in migration. The pull factors in migration are that we have not been investing enough in education and training, and that companies have found it easier to recruit staff from abroad than to spend money training their own in too many instances. Also, in public health we need to reduce the number of people who are long-term unwell. There are also the push factors—climate change, conflict in other countries and, potentially, expulsion. The Turkish Government are talking about expelling several million refugees. The UK Government might wish to emphasise that we cannot manage migration without active international co-operation with our neighbours and others, which is almost entirely outside the current debate. Can the Government not attempt a constructive effort, to which I am sure other parties would respond?
I am not quite sure what the noble Lord suggests would result from such a negotiation. Of course it is right that the Government discuss international migration issues on a regular basis. We saw that at the recent meeting of the Council of Europe. We recognise that no single measure will control immigration. As the impacts of temporary pressures become clearer, we will keep matters under review. The Government will continue to strike the balance between reducing overall net migration and ensuring that businesses have the skills that they need. We continue to support economic growth.

Lords ChamberYes; I absolutely accept my noble friend’s point. Certainly, in relation to the question that has been asked, it is incumbent on all parties to be vigilant about all donations at all times.
My Lords, I am sure that the Minister shares the general concern about maintaining public confidence in the integrity of our electoral process, including political finance. He must be aware that there have been persistent rumours, with a good deal of circumstantial evidence, that there have been flows of money indirectly from the Russian state into Conservative Party funds. So long as that suspicion is maintained and we do not have transparency about what really happened, there will be questions about the integrity of our political process. Should the Government not ensure that there is full transparency about these various reports and publish some of the redacted parts of the ISC’s Russia report?
My Lords, we have gone back and forth on this issue on a number of occasions. The noble Lord refers to rumours, but he is prone to starting some. I remind the noble Lord that, as my right honourable friend the Policing Minister pointed out in the other place, an MP from the noble Lord’s party in the other place accepted sizeable donations from somebody who was later identified by MI5 as a foreign agent.
