My Lords, I will speak briefly, largely in relation to Labour’s amendment. As the noble Baroness may recall, some of us spoke about the provision of early years facilities in Committee. I want to return to that issue briefly to see whether we can tie up one or two loose ends.

I am most grateful to the noble Baronesses, Lady Scott and Lady Barran, for the correspondence and meetings that we have had between Committee and Report. The meeting with the noble Baroness, Lady Barran, had the largest number of advisers in the smallest room that I have ever been in; that would not have been possible under Covid. The new DfE advice to local authorities, Securing Developer Contributions for Education, is a great improvement on its predecessor. It is much clearer and on several occasions makes clear and specific mention of early years provision.

However, the response from the department of the noble Baroness, Lady Scott, was slightly less clear. Given her background as an effective head of a local authority, I think she assumes that all local authorities are run as well and professionally as her one was. All I say is that the evidence from a range of local authorities is that their ability to provide early years facilities is not good.

An article last week indicated that local authorities are sitting on a grand total of £3 billion of unused Section 106 money, £420 million of which is for education. It is somewhat disappointing that the LGA spokesman’s response to that said just that doing this is “a complex process” that takes a lot of time. I thought that was local government’s job.

I have four specific questions for the Minister, of which I have given her advance warning. The first is: what we are going to do to monitor whether these funds are being used to expand childcare provision, because there is no central collection of data at the moment. Please can we do something about that?

Secondly, there is an expectation, which is clear in the advice, that existing or new spare primary school capacity will be repurposed for early years services. How will guidance be flexible to ensure that, if there are changes in the birth rate, we do not end up with nurseries closing and have the same problem?

Thirdly, how can we make sure that we are also looking at early years settings that are convenient for people’s work? It is one thing to have early years provision near where you live but, for many working women, it is far more useful and a more efficient use of their time to have early years provision near their place of work. Could the Government say whether they are aware of this potential issue and, if so, what they are doing to try to mitigate it?

Lastly, how will the Government make sure that all local authorities can use this funding on new stand-alone provision if they deem it appropriate, without being reliant on private providers, which may or may not want to operate in the area? This applies to the new infrastructure levy but also to existing sources of funding. I look forward to the Minister’s reply.

My Lords, in following the noble Lord, Lord Russell, I should declare my position as a vice-president of the Local Government Association and of the NALC. With the greatest respect to the noble Lord, I point out that the impact of austerity and the slashing of central government funding to local government left departments utterly eviscerated and a lack of resources to take actions that may be desperate.

I have two reasons for rising. One is to express the strongest possible Green support for the amendment in the names of the noble Baronesses, Lady Hayman of Ullock and Lady Twycross, to allow local authorities to provide their own childcare services. These are public services in the community; having them under democratic control is surely an extremely good way to proceed.

In noting that, I have a question to put to the Minister, which arises from issues that I have raised with her previously, on the involvement of private equity and the financial sector in childcare provision. It has been described as becoming a “playground for private equity”. In the last four years, investment funds have more than doubled their stake in Ofsted-registered nurseries. Now more than 1,000 are fully or partially owned by investment funds, which is 7.5% of all places—up from 4% in 2018. Those 81,500 places are being run for profit. We know from their involvement in the social care sector that those companies will have stripped out huge sums and introduced massive instability. We think of what happened with the collapse of Southern Cross and Four Seasons Health Care. Financial engineering is so often behind that.

With that in mind, regarding government Amendment 259 on services in wholly non-domestic premises, the Minister talked about local community centres and village halls. Picking up the points made by the noble Baroness, Lady Pinnock, provided that they have the right facilities, I do not believe that anyone would have any objection to those kinds of premises. However, following the remarks of the noble Lord, Lord Russell, about places near where people work, I think it is possible to imagine that we might see private equity invest in building or repurposing a facility, so that it is designed for a lot of small groups of childminders to come together, with private equity and the financial sector sucking huge amounts of money out of that. Could the Minister, either now or perhaps in writing later, tell me what the provisions for non-domestic premises actually mean? If someone set up a for-profit setting, what kind of controls will there be to make that that is not exploitative of the childminders or the children and their parents?

My Lords, I was happy to add my name to this amendment to give it a bit of cross-House balance. Like the noble Baroness, Lady Brinton, I am an officer of the all-party parliamentary group on coronavirus. In the last two years, we have had a bellyful of coronavirus; we have heard ad nauseum about the problems and the tragedies that it has created and encompassed, and that is partly what leads to this amendment.

It is self-evident that the United Kingdom, and most of the rest of the world, was unprepared. Countries that had experienced SARS, particularly in south-east Asia, had a better idea of what they were getting into. Frankly, however, for most of us in the West, it was the blind leading the blind. Looking in the mirror today—and accepting our failings, and the unease that we in the developed world should surely feel for largely having prioritised looking after our own—is for me, certainly, distinctly uncomfortable.

The aim of Amendment 174 is very simple: equitable access to affordable health technologies for all. One of the biggest challenges is how to deal with the exclusive intellectual property rights that exist in the healthcare sector. Only 7% of people in low-income countries have been double vaccinated. Only an additional 14% have had one dose.

Noble Lords should remember where the variants have come from. The exception, of course, is alpha, for which global Britain is responsible, so that is something that we can be proud of. Beta came from South Africa, gamma from Brazil, delta from India, and omicron is truly global because it started in about 10 countries simultaneously. The two countries that went it alone, rather proudly, in developing their own vaccines—China and Russia—have produced manifestly inferior vaccines, which have not been subject to proper, clinical peer scrutiny.

I give two examples of the problem we face. First, Pfizer’s new antiviral treatment excludes most Latin American countries, and generic versions—unless Pfizer does something about relaxing its intellectual property—may not be available in those countries until after 2041. Secondly, Tocilizumab, an antiviral manufactured by Roche, which is based on UK government-funded research, is unable to be manufactured in countries with established production capacity because Roche is enforcing its patents in these countries. There is a global shortage of this particular treatment.

Tackling the complex world of healthcare intellectual property is not easy. In my past career as a headhunter, I worked with clients that were large, complex, well-funded, international pharmaceutical companies, so I know full well the level of intellect and resource that they put into their intellectual property defences. We must apply ourselves in a disciplined and determined way at an international level; this is a chance for Great Britain to prove that it is indeed global. As an aside, during Oral Questions this morning, some of us on the Cross Benches were playing a game where, every time somebody from the Government Front Bench mentioned global Britain, another notional £10 clinked into the pockets of the Cross-Bench Christmas drinks fund; this afternoon, we had a particularly fruitful Oral Questions. As a mantra, it is meaningless unless it has real content behind it.

We need to develop a rapid response plan for the next pandemic. We will demonstrate that we have intellectual and moral myopia if we fail to do it. In a nod to Amendment 170, which we debated earlier, we should not show that we are content to let the less-developed world suffer from what I would describe as unassisted dying. That is unacceptable.

My Lords, I rise briefly to offer Green support for this amendment, which I would have signed had there been space.

The noble Baroness, Lady Chakrabarti, referred to today’s report that a watered-down version of the India-South Africa proposal for a TRIPS waiver looks likely to go through the WTO. I quote Max Lawson, co-chair of the People’s Vaccine Alliance:

“After almost 18 months of stalling and millions of deaths, the EU has climbed down and finally admitted that intellectual property rules and pharmaceutical monopolies are a barrier to vaccinating the world.”


Bouncing off the comments of the noble Lord, Lord Russell, I think that the Cross Benches might find an even larger drinks fund if they go for “world-leading” as the key phrase to identify. The comment from Mr Lawson shows that, collectively, the world has done very badly throughout the Covid pandemic and done very poorly by the global south. If the Government want to be world-leading, they could leap in right now and accept the noble Baroness’s amendment.

My Lords, it is a great pleasure to follow the noble Lord, Lord Davies of Brixton, and to join many others in thanking the noble Earl, Lord Kinnoull, for securing this debate and his introduction to it. I think he referred to creaks and groans in the union, but I would probably say that they are rather gaping cracks and heaving frustrations, as a reflection of the mood. The timing of this debate and its length perhaps reflect the way the peoples of Scotland, Wales and Northern Ireland very often feel their importance is regarded in your Lordships’ House and by the Government.

I rise as possibly the only person in this debate who is a Green. The Scottish Green Party is campaigning very hard for independence, and the Wales Green Party has said that, if there is an independence referendum, it will campaign for independence. I offer one very important thought in the context of this debate: I believe that the Government and your Lordships’ House need to think constructively and deeply about what might happen if the union ends—what it would look like, and how it could be done in the best possible way. If we look back to 2016, we can see that that was not done with Brexit, and we are still dealing with all the fallout. That is a very important message.

I have one other brief message. I agree with the noble Lord, Lord McConnell, that we need something much more radical, although I would not particularly fault anything in this report. But I agree with the noble Lord, Lord Kerr of Kinlochard, that a parity of esteem has to be at the foundation of this—and not just esteem but money and resources. Green political philosophy says that power and resources should rest locally and be referred upwards only when absolutely necessary. Far too much power is concentrated here in Westminster, which is the foundation of the gaping holes to which I referred.

My Lords, I thank the noble Lord the Deputy Leader for his full response in our previous discussion, but there was one figure that he raised in that response that I wanted to ask him about the source of and justification for. That was the claim that the financial sector contributed £76 billion in tax receipts. I am basing this question on work done by a fellow Member of your Lordships’ House, the noble Lord, Lord Sikka, who may not be joining us until later—so I wanted to raise this point now. I understand from his work that this figure comes from a report prepared by PricewaterhouseCoopers and includes £42 billion borne by customers in the form of VAT and paid by employees in the form of income tax and national insurance contributions. The remaining £33 billion is an estimate, and the report says that PwC

“has not verified, validated or audited the data and cannot therefore give any undertaking as to the accuracy”.

Could the Minister tell us what further justification the Government have for that figure?

Apologies, my Lords, but I have sorted the problem out now. I speak briefly in support of Amendments 5, 73 and 95, in the names of the noble Baronesses, Lady Bowles, Lady Altmann and Lady Kramer. Although not a generalisation that is 100% true, the gender division of the people on various sides speaking on the Bill is interesting. It made me reflect back to the financial crash of 2007-08 and the role that the extreme gender imbalance in the financial sector was seen to have played within it.

When I thought to look at these issues about exploitation, unconscionable conduct, and legal protection against mis-selling, I went to the website moneysavingexpert.com. In a previous contribution, I referred to the role of such commentators who, using the power of public opinion, often seem to be a stronger check on the behaviour of the financial sector than the Government. But, of course, they are able to work only after the fact. Just looking down the list, we are talking about payment protection insurance, mis-sold ID fraud insurance, the mis-selling of package bank accounts and excessive charges on bank accounts—and that is just talking about individual consumers. A similar list would come up for small business. It is a long tale of woe that has caused a great deal of suffering and harm to individuals and small businesses, the operators of which have often put their whole heart and soul into the business.

What we seem to have now is a strategy of shutting the stable door sometime after the horse has bolted, and after a long delay for debate and inquiry. All three of these amendments are a very strong bolt that we should be sliding home now to protect consumers and small businesses from the overweening, immense power of the financial sector.

My Lords, I declare my membership of the Roma, Gypsy and Traveller APPG which, as the noble Baroness, Lady Whitaker, said, represents some of the children who may be particularly affected by our current discriminatory system, which is effectively impossible to navigate. The noble Baroness, Lady Lister, made a hugely powerful introduction, so I will be brief in offering the Green group’s support for this amendment. I add my hope to that of many noble Lords that the Government will the see the sense of it and agree to adopt it. We are talking about rights that people are entitled to. We cannot allow people to be excluded from them by lack of knowledge, lack of funds to access them or lack of access to the systems needed to exercise them. Keeping that exclusion would be a profound injustice.



I think I have to declare a personal stake in this issue. I chose to become British, as I chose, before that, to live as an immigrant in Thailand for a number of years. But I was able to make both moves very easily, reflecting my relatively privileged background. In Thailand, the Australian state, through Australian volunteers abroad, sorted out my paperwork, then my employer did. It was then through grandparent rights that I was able to come to Britain. The family story is that my grandmother came back to the UK to have a baby. Then, after a period of residence, I was easily able to secure citizenship, back when the price of a British passport was close to the actual cost of administering it, in the early 1990s, which was not really that long ago.

It was only recently, when I read the excellent book, Bordering Britain: Law, Race and Empire, by Nadine El-Enany, that I was educated about the racism behind that arrangement, the grandparent right. There is much that should be tackled in our law to clear the taint of racism, colonialism and expropriation that remains central. But after Windrush, surely we can do something to clean up the structure of our systems—modest changes, as noble Lord after noble Lord, including from the Minister’s side of the House, has said before me—particularly systems that deny children and young people their right to security and a stable place in the world. Equality before the law is a foundational principle, but the letter of the law is not enough, as Windrush has demonstrated. The practice of government has to be fair and non-discriminatory.

I declare my interest as a governor of the children’s charity, Coram. I rise to speak strongly in support of this amendment.

In Committee, the noble Baroness, Lady Lister, and her supporters were praised for their “terrier-like” characteristics. My initial research into terriers slightly alarmed me, because the original animal, which, in 1815, inspired the creation of the canine family of terriers, was called, believe it or not, Trump. You heard it here. I became less alarmed when I read Johannes Caius’s 1576 description of dogs with similar characteristics, which he praised for their

“insane dedication to chasing creatures bigger and stronger than themselves.”

The Minister knows what she is up against. 

The Minister may recall that at Second Reading I spoke about the paramount importance of accurate, reliable and timely data in making any key policy and process decisions. I think she agrees with this. 

I am supporting this amendment because I am persuaded by several key pieces of evidence. As a terrier, I doggedly follow the scent—or, in this case, the evidence. The first piece of evidence comes from the PRCBC, of which the noble Baroness is a patron, and which repeatedly encounters children who fall into two particular categories. The first category is that of those born in the UK, but not born British citizens because their parent, also born in the UK, had been unaware of, or was unable to exercise, their own right to register as a British citizen. The second category is that of children who are British citizens by birth, who were taken into care or adopted, for whom nobody has acted to confirm their right to citizenship, leaving them unable to establish that they are already legally entitled to British citizenship. These two categories of children are being treated as though they are not British but mere guests in this country, as a result of which they run the risk of effective loss of their citizenship rights. This is both morally and legally wrong and is certainly not what Parliament intended, as several noble Lords have said.
