Lords ChamberOf course, I do not have the answer to those questions because the Government are not intending to issue defence bonds. However, the noble Baroness mentioned one of the rationales for issuing green gilts—ensuring that the City of London is a global financial centre—and she is absolutely right. Indeed, we are the No. 1 financial centre for green finance.
Is my noble friend aware that investment in good defence companies is entirely compatible with ESG? Will she ensure that our fund managers in the City take a copy of what she has stated today?
I am very happy to reiterate what I said about the Government’s commitment to the defence industry, ensuring that it receives the amount of private sector investment it needs. My noble friend may have seen that, to that end, there was a joint government/ Investment Association statement to fund managers that gave exactly the clarity he seeks.

Lords ChamberThe Government absolutely recognise their crucial role in stemming corruption; we work very closely with the overseas territories on all sorts of issues when it comes to illicit finance. I refer the noble Baroness to the Written Ministerial Statement from my honourable friend in the other place, the Minister for the Americas, Caribbean and the Overseas Territories; in that is a helpful summary that sets out where each of the overseas territories is in relation to introducing a public, accessible register of beneficial ownership.
My Lords, I declare an interest as I have family living in the Cayman Islands. Is that particular territory not a good example that others should follow? It has a well-regulated jurisdiction with a tax-neutral framework, which supports taxes being paid where the profits are made. It has signed up to and is approved by FATF, on anti-money laundering, and also has a positive rating on the OECD Global Forum. Against that sort of background, does it not demonstrate that territories such as Cayman that are close to us have got their house in order? And, yes, against that background one would hope that any that have not would follow suit.
I am grateful for my noble friend’s support for the Cayman Islands, but it is just one of the many different overseas territories. Not wishing to detract at all from his words, I would say that the Cayman Islands is doing well, but I think it can do better. For example, the beneficial ownership register that the Cayman Islands is planning to put in place will still have a legitimate interest access filter. We believe that that is an interim step, and we would like to see fully open registers of beneficial ownership as soon as that can be implemented.

Lords ChamberFirst, let me clarify that I am not defending Fujitsu or any other software— I am not sure where the noble Lord got that from. It is the case that more people will be filling in self-assessment tax returns, but it is also the case that, given the current figures, it seems that people are perfectly capable of doing so. By 1 January, 6.49 million people had completed their self-assessment tax return; that is 200,000 more people than last year and well over half of those whom we would expect by this stage, so at this current time we are not seeing a significant drop-off of people being unable to fill in a tax return.
My Lords, is my noble friend aware that, having seen the Question on the Order Paper, I contacted a number of professional accountancy firms to ask them whether the returns from HMRC are comparable to last year or not? The consensus appears to be that HMRC is running at least four to six weeks behind last year. Is there a particular reason for this?
No, and I would be very happy to look at any evidence that my noble friend has. My understanding is that, for more complex tax matters which require the intervention of an HMRC adviser, those tax returns are dealt with within about three months.

Lords ChamberTo ask His Majesty’s Government what plans they have to introduce a graduated driving licence or other restrictions on newly qualified drivers.
My Lords, every death or serious injury on our roads is a tragedy, and we continue to work tirelessly to improve road safety for all users. Our broad approach to improving safety for new and novice drivers includes new technology and improving education while reinforcing vital road safety messages through our THINK! campaign. There are not any current plans to introduce driving licence restrictions on newly qualified drivers.
My Lords, I am greatly relieved to hear that Answer from my noble friend, because there are numerous rumours going round. I am sure young people will be greatly reassured. Nevertheless, is she aware of the other real problem that young people face today: that it is very difficult to get a test date when you are ready to take it? Is she aware that there are sellers out there using bots to hoover up at least a quarter of all the exam slots and reselling them to learners desperate to take their test? Furthermore, there appear to be dozens of websites offering to find learners earlier booking slots for a fee as high as £300. Can my noble friend look closely at this abuse of the situation and take the appropriate action?
I thank my noble friend for raising that. When I was Roads Minister until fairly recently, I worked very closely with DVSA to ensure that those bots cannot get access to the booking system. I will take his comments back and ensure that DVSA is doing all it can to make sure that those slots are not being used by other people. At the moment, there are about half a million people already booked into slots, and there are about 44,000 slots available in the next 24 weeks. The key to all this—it loops back into the road safety element of this Question—is that we must ensure that drivers are ready to take their tests. At the moment, fewer than 50% pass, so the number one message for learner drivers must be: be ready and then you will be able to pass your test and drive with confidence.

Lords ChamberThe Government are investing £8 billion over the next two years in all types of road enhancements and improvements, including £200 million for maintenance and potholes.
Is my noble friend the Minister comfortable that London is now rated the most congested city in the world? Is she equally comfortable that our major retailers in the West End are suffering in relation to trade from people coming into our country? Finally, even the City of London, the centre of finance, is itself complaining that this is affecting the City badly.
I think there is a slight question of clarification here. The data that my noble friend cites actually misses out several cities in the world. Lagos’s traffic is 10 times worse than London’s, and in Seoul it is twice as bad—so London is not the worst. However, what we have to understand, and what the Government understand, is that one needs a mixed economy for transport. Of course, car usage is important, but particularly in London, where excellent public transport is available, we need to make sure that we use that more. I note that traffic is back to 100% of pre-pandemic levels, but the Tube remains persistently below them. I think that the Mayor of London should be doing more to get people back on the Tube.

Lords ChamberIt is really important that we understand what happens to batteries throughout their lives. It is the case though that there are 20 million EVs on the world’s roads already and there is no evidence to suggest that their lifespans are any different from those of a petrol or a diesel vehicle. We expect that many EV batteries will have a guarantee of about eight years, or 100,000 miles. As for the end of their lifespan, it is very important that we focus on recycling. Of course, the Government are focused on that, and I will write to the noble Baroness with more information.
Is now not a good time for His Majesty’s Government to have a whole look? We have the strategy of 2030 ahead of us, when petrol cars are supposed to disappear, but at this point in time we have a situation where electric cars are hugely expensive; they are not available at a competitive price for ordinary families. Ordinary families living in tower blocks in my former constituency cannot recharge those cars, so is it not time that we had a look at the whole strategy openly and took a little time about it to ensure that we have a policy that is workable in the future, taking into consideration the point added by my noble friend on the Bench below?
The price of electric vehicles has fallen dramatically over recent years, and that was helped by the Government providing quite significant grants in the early years to ensure that the prices were lower. There are now 24 models that cost less than £32,000 new—

Lords ChamberI am grateful to the noble Lord for highlighting some of the tremendous things that we can achieve to celebrate this 200-year anniversary. I am also aware that Sir Peter Hendy is out there with his begging bowl and working his magic. I am sure he is doing exactly what we want him to do, which is bringing together all the interested parties to work with government. This is a huge opportunity to not only celebrate the heritage of our railway network but promote the wider, modern system across the country.
My Lords, if we are to celebrate the 200th anniversary properly, do we not need ticket offices up and down the country? Although only 12% of tickets may be sold there at the moment, nevertheless, is my noble friend not aware that a ticket office does far more than sell tickets? They give advice, not least to parents who are going on holiday or with children, and are of course very important to the tourism industry.

Lords ChamberMy Lords, Brexit is not the basis of this. At the current time, Germany has a 45,000 to 60,000 HGV driver shortage, France 43,000, Spain 15,000, Italy 15,000, and Poland 124,000. This is a problem that is impacting developed countries all across the EU and in the US, which has a 61,000 shortage right at this moment in time.
The noble Baroness refers to cowboys. I do not know who the cowboys are that she is referring to; I hope it is not the haulage sector, which I know is doing everything it can to make all the interventions we are putting in place work. For example, as the noble Baroness well knows, hauliers have to notify the department that they are going to use the extension of the hours and we obviously monitor the safety that comes out of that.
The noble Baroness seems to think that somehow the HGV test is getting easier. I am sorry to disabuse her: it is not. There will be no change to the standard of driving required for HGVs. The simple fact is that a certain element of the test will be delegated to trainers, who already train the HGV drivers in things such as manoeuvres. I would go on on the safety issue, but it is clear that we have some of the safest roads in the world and we want to keep it that way.
My Lords, is it not clear that, with just about 100 days till Christmas, there is an urgent short-term problem? Against that, why cannot Her Majesty’s Government produce a six-month visa for former HGV drivers who are somewhere else in Europe and recognise that they need be for only six months? I have had a six-month visa in my life as a commercial man and everybody obeys the six months. That surely will help in the short term.
In the longer term, it costs a young person of a non-academic interest over £7,000 to train. Why can we not have the equivalent of the student loans scheme for young people who want to learn to be HGV drivers, which could be repaid in the same way, so that when they have a job they can pay the loan back to Her Majesty’s Government?
I recognise that my noble friend wants to open the floodgates to EU drivers, but I sense that he may be waiting quite a while for the flood to arrive, because as I have outlined there is a shortage of drivers across the EU. What we must do is focus very hard on recruiting and training domestic drivers, and getting some of them to return. That is where the heart of this lies.
I note what my noble friend says on training. I do not know where the £7,000 figure comes from, because I actually phoned up an HGV trainer the other day—not for myself, of course—to ask and they said that it was around £3,000. By removing the staging requirement to get a C licence and a C+E, we will have combined the two training elements together. We would also expect training to reduce to get a C+E articulated licence. As my noble friend may know, there are private sector loans available and many of the training schools will make those available to the trainees, but of course it would be better if industry paid for the training in the first place.

Lords ChamberMy Lords, the quarantine requirements apply to all individuals who are arriving in the UK, irrespective of the time that they have spent outside the UK. They are all required to self-isolate, except for a very small number of exemptions. This applies to all individuals, however they choose to leave the UK, whether that be on a charter aircraft or indeed using another form of travel—for example, a ferry or the Eurostar.
How will it help British industry to get going again if our borders are now to be closed for marginal health gains at the cost of putting at risk our huge key aviation industry, which employs thousands and, even more importantly, is vital for our exports? Now we read in the papers that Her Majesty’s Government are contemplating interfering in landing rights at Heathrow. Will my noble friend reflect on the seriousness of the situation and give some positive help to this industry? Let us see some positive action to help aviation, to the benefit of all our economy.
The noble Lord is quite right that we need some positive support for the aviation sector. That is why we have the aviation restart and recovery expert group, which includes representatives from airlines, airports, unions and industry bodies. It is putting together the best minds to work out how we can make sure that our aviation sector comes out of this as well as it possibly can. For example, it is setting up common health standards to be applied to an air passenger’s journey, from home all the way through to the other side. That is the sort of system that will help the sector to get back on its feet.

Lords ChamberThe noble Baroness, Lady Randerson, is absolutely right that many of the cruise companies are indeed foreign owned. Provided that a cruise has been sold, or indeed offered for sale, in the UK, it will be covered by the package travel regulations. Therefore, the consumer will be entitled to a refund within 14 days. If a cruise holiday has been sold outside the UK or the EU, different terms and conditions may well apply. I will take back to the department her suggestion that other EU countries have changed their regulations. We will look into it.
On hotel and travel cancellations, what action can a consumer take where the provider’s insurance is claiming force majeure due to circumstances created by Her Majesty’s Government?
The issue around force majeure and contracts is complicated. I am sure my noble friend will appreciate that I cannot give firm advice, because in these cases, each contract is likely to be slightly different. In the case that this is happening to a consumer, I suggest that that consumer gets their own independent legal advice to fully understand the terms of the contract. It is also the case that some consumers who use a credit card will be able to make a claim with their provider. They might want to check with them as well.

Lords ChamberThe noble Baroness makes a very important point, which is that there is an opportunity to look in more detail at what changes might be needed. We will have to wait until the Williams Rail Review is published and the recommendations made, but one commitment that the Government have already made is to look at so-called Beeching closures. The Restoring Your Railway Fund has £500 million pledged to it. I reassure the noble Baroness that work on that fund continues and that bids put in for the March round of funding are being assessed. Details of a second round of funding for June were published on GOV.UK recently, so work is going on apace in that area.
My question is about Great Northern/Thameslink, which currently terminates at King’s Cross. The Minister will remember the chaos of the introduction of the new timetable, with a lack of drivers, et cetera. Can she ensure that drivers will be available for this really important link once it reopens all the way to Brighton, and that there will be no excuses about new drivers not knowing the route, about there being insufficient drivers because they are on furlough, or something else?
I reassure my noble friend that we are doing absolutely everything we can to put in place the plans we need to restart the railways. They are operating a significantly reduced service at the moment. The challenges are fairly significant, but we are working very hard to make sure that drivers are available on Thameslink, and indeed on all lines, to make sure that when we can restore services, they can be restored fully.

Lords ChamberI understand where my noble friend is coming from, but what she perhaps does not fully comprehend is that to those of us who have been involved in this industry for years, this is a highly dangerous area—far worse than motorbikes. The Government have the opportunity to lay down clearly that anybody who transgresses will be hit hard. This does not affect the genuine operators, who will take great care. However, quite frankly, listening to my noble friend, I can see this being abused. I see drones every weekend where I live. Half of them, perhaps, are being flown correctly, but a significant proportion are not, hence the two in my shed that crashed in the last six months.
My noble friend makes a very interesting statement. This Government recognise that in certain circumstances, when drones are not being flown correctly, it is literally a life and death situation. This is why the penalty for the most significant offences—recklessly or negligently acting in a manner likely to endanger an aircraft or any person in an aircraft—is an unlimited fine or up to five years in prison.
My noble friend suggested that only half of those drones are flying within the rules. That is why we have introduced the competency and registration system. People are taking the competency test. If the Bill is passed and the police have the powers, they will be able to stand in my noble friend’s garden, identify those who may not be operating within the law and do something about it. Without the Bill, they could not.
I am aware that my noble friend supports the Bill, and I appreciate his support. The Government are just saying “proportionality”. The Government’s role is not to come down hard across the entire sector, but to be proportionate. Those guilty of a minor contravention will get a fixed penalty notice; for something more serious, it is up to five years’ imprisonment and an unlimited fine.
Turning to a couple of points I have not covered, my noble friend Lord Glenarthur made an important point about electronic conspicuity, or remote ID. This is being introduced into drones. Although it is not ubiquitous at the moment, electronic conspicuity for all aircraft was consulted on in the Aviation 2050 consultation. We will be looking at how we take that forward but, as part of EU retained law, the EU-delegated Act is already within domestic law. It contains remote identification requirements. This delegated Act came into force on 1 July 2019. We are currently in a transition period; within three years, electronic conspicuity and remote ID will be a requirement for all drones.
My Lords, I thank all noble Lords who have contributed to what has been a very interesting debate. It has been more wide-ranging than I anticipated.
The Government are listening to everybody contributing to this debate—within this Chamber and beyond—about what they should be doing. Something needs to be done, but there is no silver bullet. Standing here now, I can absolutely say that there is no magic bullet, no single solution. We cannot legislate our way out of the issue facing us unless we completely ban drones. There was mention that perhaps we should have had a registration system at the outset, but we have had model aircraft for years. They have not had anything, and they too have been involved in incursions over airports. We cannot lull ourselves into a false sense of security. We cannot say that the Government are not doing enough, that something must be done and that this is all so terrible, because what in this Bill would have prevented Gatwick, for example?
Potentially, a transponder, but we knew where the drones were. We could see them flashing above the runway. What could we do about it? All the legislation in the world could not have done anything about that. It comes down to technology, and the work that we are doing with the CPNI to develop the counter-UAV technology. That is what we need to spend money on, and we intend to. The legislation before us is a series of things that have already been put in place under the air navigation order. The noble Baroness may criticise the approach as piecemeal, but essentially, it is keeping up with technology.
Perhaps I may be of help. It was pointed out to me that if I did not re-licence my shotgun within the statutory time limit I was given, the gun would be taken away from my premises. I do not know whether that would be for ever, but it would certainly be taken away for a long time.

Lords ChamberTo ask Her Majesty’s Government what assessment they have made of the impact of the use of electric scooters on public roads and pavements on (1) road users, and (2) pedestrian safety.
My Lords, to date, no assessment has been made of the impact of electric scooters on either road or pedestrian safety, as they are illegal to use on public roads, cycle lanes and pavements. However, the department is reviewing regulations that apply to electric scooters and similar vehicles as part of the Future of Mobility urban strategy. Safety considerations will be part of that review.
Is my noble friend aware that well over 1,000 incidents have been reported to the police—and not all police forces even record the figures involved? Can she assure the House that the department’s review will look at specifications of electric scooters to ensure that they have brakes, lights and stability? Will it consider imposing an age limit of 16 or above? Finally, will she ensure that the review is detailed and will not require further legislation over and beyond what arises from it, bearing in mind that when the issue of drones arose, we had to have about four bites at the cherry?
My noble friend raises a number of important issues. The strand of the regulatory review that will be looking at micromobility, which covers e-scooters, will look at vehicle requirements, user requirements—for example, age, helmets and insurance—whether they should be used on the roads or elsewhere, and the service provider requirements. On his second point about future legislation, we intend to build an agile legislation and regulatory system, because who knows where we will go beyond these scooters? It is important that legislation can keep up.
I pay tribute to the noble Lord for the work he has done on the late payment of commercial debt. As he will know, a year ago the Government set up the Small Business Commissioner. In the course of the year that Paul Uppal has been in place, he has managed to recoup £2.1 million in unpaid invoices for businesses, but there is so much more to be done. When I was the finance director of a medium-sized business, large businesses often used every trick in the book to avoid paying small businesses, which is unacceptable. We will work with the commissioner to find ways to develop systems to identify these large companies and make sure that they pay their bills on time.
Is my noble friend aware that there is concern among small businesses because their VAT and other returns have to be totally computerised by 4 April? Against that background, can she assure me and others who know these areas in some depth that there has been sufficient trialling of the software to ensure that it works, and that there is a back-up policy if it does not? The precedent of the rating appeals does not fill one with great confidence.
My noble friend refers to the Making Tax Digital initiative, which was announced in 2015, and he is right that it is due to become mandatory in April of this year. Ninety-eight per cent of businesses already file their VAT returns online; I certainly used to do so and it is by far the easiest way. We are working closely with software industry suppliers to develop sector-specific software to ensure that all businesses can comply. More than 100 products are now available, some of which are free, but I reassure noble Lords that nobody who is unable to go digital will be forced to do so.
