Lords ChamberMy Lords, I rise briefly to speak to Amendment 128. We are getting to the crux of what this regulator should be about: making sure that there are sensible financial decisions, and that risks are mitigated so that they do not jeopardise clubs’ futures.
Clubs in the EFL are expected to lose around £450 million this season and are reliant on owners to fund the shortfall. If this funding is not forthcoming, it can lead to financial trauma. Only 66 of the 92 clubs that filed accounts for the 2021-22 season included data on wages and cash reserves. Nottingham Forest spent £58,606,000 on wages but had just £25,000 in cash reserves—five hours’ worth of reserves. Surely that cannot be acceptable.
My Lords, I will speak to the amendments standing in my name in this group. I apologise to my noble friend Lord Maude if I address some of the plethora of regulations, conditions and verbiage concerned. I am proposing a number of amendments that I hope will facilitate and ease the position that the Government face in this context.
I turn to my Amendment 169A. It is unclear from my reading of the licensing section of the Bill whether the IFR is expected to produce a detailed and granular set of financial rules that would be applied in a blanket way to a large class of clubs or leagues; examples include the specific liquidity ratios, the debt-to-equity ratios, operating cash-flow metrics and size of financial buffers. Or will the IFR take an entirely bespoke approach, where every club will have DLCs—discretionary licence conditions—applied according to their own circumstances? That would drive a coach and horses through the competition organiser’s ability to provide a level playing field and maintain competitive balance. The third option is that the IFR could take an outcomes-based approach whereby it produces some high-level guidance with clear outcomes that clubs must achieve and league rules sitting underneath, giving effect to these principles and outcomes. For example, the IFR could have a series of outcomes relating to working capital, transitionally financed balance sheet health, resilience, protection of assets, et cetera. Leagues could colour in these outcomes into rules.
My own strong preference is for the third option. This amendment, which characterises the third option, is designed to create space for that conversation and, hopefully, allow the Minister to say that, where existing sustainability rules are in place and working, there will be an opportunity for that kind of league-led approach at all levels within an overall regulatory framework. Therefore, my recommendation is an outcome-focused, light-touch regulation, with step-in powers where issues are identified. That is why I have drafted Amendment 169A.
I turn to my Amendments 167A, 168A and 168B. The current test for attaching and varying a discretionary licence condition sets an extremely low bar for the IFR. For example, it seems to me that the test could be met in the case of a club that is already meeting the threshold requirement, on the basis that a discretionary licence condition somehow contributes to the club continuing to meet it.
The DLC test is even vaguer as regards the systemic financial resilience objective. The DLC needs only to advance that objective. While not necessarily the intention, this risks a very unpredictable, wide-ranging and open-ended power that could have a serious impact on club finances. It is also an issue that can be easily mitigated, while still allowing the IFR to meet its objectives. Again, I seek simplicity on behalf of the clubs. I am really concerned that here the detail is so great that it will swamp some clubs.
In the current drafting, potentially the only check on endless interventions, by way of DLCs relating to the systemic financial resilience objective, will be either the IFR’s discretion—in other words, the IFR deciding it has done enough for now—or the IFR being forced to have regard to avoiding adverse effects building up as a result of excessive intervention. Neither of those seems adequate to mitigate the significant risk to English football at all levels. I acknowledge that there is discretion for the IFR to not act in this way. However, I do not think there should be an option to do so, given the very significant risks to English football that would come with the powers being used in this way.

Lords ChamberMy Lords, Amendment 104 concerns the provision of defibrillators in schools and academies. My purpose in proposing this amendment requires me to declare my interest as chair of the board of governors of the Haberdashers’ Monmouth Schools, where we educate over 1,100 children, and place the highest priority on safeguarding their interests in every activity in which they participate. In this we are led by an outstanding governor, Jo Booth.
I am grateful to the noble Lord, Lord Aberdare, who cannot be with us this evening, sadly; to the noble Baroness, Lady Grey-Thomson, and the noble Lord, Lord Addington, for putting their names to this amendment, for offering my apologies in Committee when I was hosting a key meeting at the Monmouth Schools that Monday evening, and for their subsequent support; and to my noble friend the Minister, who has been active and diligent in listening to our case and, I hope, will respond positively this evening.
The Monmouth case was particularly important to me. The schools form a close-knit society, and from governor to ground staff there is pride in our schools and a strong sense of community. So it was that one of our popular and talented students joined his friends in the cricket nets at the idyllic sports grounds in the Wye Valley, shortly before last term’s half-term, for an evening’s practice session. There he was taken ill and, realising the seriousness of his condition, the master in charge gave him CPR twice. After the second time, he regained consciousness, and by the time the ambulance took him to hospital, his mum and dad were with him. I pay tribute to the staff who cared for him throughout. Had it not been for their professional care and devotion to the well-being of the students, it is more than likely that he would not have been with his parents at the end. Later that evening, he passed away, leaving family, teaching staff and all who knew him reflecting with a heavy heart on the tragedy, which continues to be felt by us all.
Sudden arrhythmic death syndrome kills 12 young people under 35 every week. Callum Stonier, a remarkable cricket coach and committed teacher on duty that evening, had decided that if our young, outstanding student had not come round from CPR, we would have used one of the five defibrillators in the school—the nearest, rightly, being close to the cricket nets in the pavilion. A defibrillator at the sports centre nearby had previously saved a life at one of our school sporting events.
Many noble Lords on all sides of this Chamber have made the case for ensuring that defibrillators are not a voluntary addition to a school’s first aid equipment and required just in new or refurbished schools, as is currently the policy, but a mandatory part of the first aid equipment in all our schools. In fact, if there is a strong enough argument that they should be a legal requirement for refurbished or new schools, there is an equally strong legal argument for the compulsory purchase of defibrillators in every school, as there should be. We should not and cannot differentiate between two groups of children; all their lives are equally important, and I am glad that the Government recognise that.
The announcement yesterday by the Government that they intend to do exactly what we have been campaigning for is exceptionally welcome. No doubt we will hear more detail in a moment. It is not just we in this House who have been campaigning. The Oliver King Foundation has for much longer been exceptionally active in this context. It has done outstanding and important work in lobbying to ensure that all schools have a defibrillator. It appears that the Government are now building on their current open-ended policy of engaging with civil society to ensure that there are defibrillators in all our 32,163 schools in the UK. A statutory duty will save lives, and the important relationships with civil society are the vehicle to ensure that this is done.
I hope my noble friend the Minister will confirm what we heard yesterday on the radio. I heard it at 6 am when I was driving to St Andrews for the final day of the golf, and I was absolutely delighted to hear the news that the Government intended to follow the spirit of the amendment before the House. No doubt it was because the Government were more than aware that there would be an overwhelming cross-party vote in favour of the legislation this evening, and I am delighted if that was the case. They acted first and deserve the credit for doing so, because their being in favour of the objectives behind such a long-running campaign is critical.
We owe my noble friend the Minister a great debt of gratitude and our warmest thanks for her personal commitment to this subject, without which I really do not believe this would have happened. Maybe I am being too optimistic; we will need to hear from other noble Lords this evening, and whether the announcement on the radio and from the Government yesterday is accurate, and potentially receive more details from my noble friend the Minister. If it was accurate, we should celebrate this evening. As far as I was concerned, it was great news from the Government and made an outstanding day’s golf all the more memorable, because it was even more important than the opportunity I had yesterday. It will allow us, particularly the noble Baroness, Lady Grey-Thompson, my noble friend in sport, the noble Lord, Lord Addington, and many others in this Chamber, to take this forward from schools and to really look at the importance of making sure that defibrillators are available in community sports fields and sports grounds and throughout the sporting world.
If this is true, I very much hope that it will be a first, important step in that direction. On that rather happier note than in many of the other debates in this House today, I beg to move.
My Lords, I declare an interest as the president of the Local Government Association, and I have a number of other interests in this area. I know that my noble friend Lord Aberdare is disappointed that he is not able to be in his place tonight; he is actively involved in the Procurement Bill. As I have previously talked about, 40% of sports facilities in England are behind school gates, so this is not only about protecting children, it is about all those people who use sports facilities.
I am disappointed that I was not going to St Andrews when I heard the news yesterday; I was merely out with a friend and we saw it on the television. I was absolutely delighted to read the social media post by the Department for Education, which said:
“We’re making sure every school in the country has a defibrillator. These life-saving devices increase the chance of survival from a cardiac arrest, and will help keep children, staff and local communities as safe as possible.”
I was even more delighted when I saw that it had been reposted by the Minister. I thank her for recognising the Oliver King Foundation, because its work in this space has been absolutely tireless.
The only question I have tonight is about the process and timescale for this announcement, because it is so incredibly important that we do this. I am sure that my noble friends will be coming back for more because, as the noble Lord, Lord Moynihan, said, we need to be looking at community centres and at widening this, but this is a really important step forward.

“The saddest thing about getting old is seeing my cricket bat in the corner and wondering if I will ever play again.”
I am sure that Amendment 297C in my name and those of some colleagues, who I will come to in a moment, would have been warmly welcomed by him, as I hope it is across the Committee. If accepted by the Government, it will ensure that many more cricket bats are rehabilitated with a wipe of linseed oil and put to good use again.
I did not want to interrupt the excellent debate, so I have waited until this point to come forward with my amendment, but I say to the noble Lord, Lord Stevens, that if there was ever an amendment in this group to tackle obesity, this is the one. I declare my interests as set out in the register.
Amendment 297C stands in my name and those of the noble Baroness, Lady Morris of Yardley, from the Labour Benches, the noble Lord, Lord Willis of Knaresborough, from the Liberal Democrat Benches—who admirably chaired the National Plan for Sport and Recreation Committee, which recently published a unanimous report that recommended a requirement for a national plan for sport, health and well-being to be placed in primary legislation—and the noble Baroness, Lady Grey-Thompson, who has been campaigning with me for this change in the law for well over 20 years.
Of course, the Select Committee of your Lordships’ House ceased to exist on the publication of its report. However, unusually, after hearing 76 witnesses in public evidence sessions and reviewing 163 pieces of written evidence, in addition to four round tables, we were unanimous in our hope that this Health and Care Bill could be amended, to reflect the views from all sides of the House, to include a statutory responsibility on the Secretary of State for Health to draft and publish a national plan for sport, health and well-being. The Minister for Sport would be moved from DCMS to the Department of Health to oversee the process of preparing the national plan, presenting it to Parliament and undertaking the additional functions that the Minister for Sport’s office currently undertakes with a very small staff of just 33, who work on sport and recreation, as set out in the Minister’s written reply to me on 29 July. Despite DCMS’s good work, participation rates in sport and recreation in this country are lamentably low and add to the problems of obesity.
Our rationale for encouraging the Prime Minister to make such a move was more than the obvious natural fit that sport and recreation sit more appropriately with health and well-being than with data protection, cybersecurity and the TV licence fee; more than the natural policy fit between sport and health; more than an attachment to a department on the fringes of government, established courtesy of David Mellor’s charm in persuading his good friend John Major to create the department in the first place; and more than a recognition that a Minister at the heart of government could position sport and recreation where it should be: an essential component of a fit and healthy nation, as part of preventive care, health and well-being.
The purpose of our amendment is to create a catalyst for change. The status quo simply does not work. We heard evidence from the Deputy Prime Minister of New Zealand, where the Minister of Finance is responsible for setting out a well-being budget that fully includes and embraces sport and recreation in that portfolio.
In the context of the UK, the three key elements of our amendment include focusing on outcomes that meet the needs of present generations, at the same time as thinking about the long-term impacts for future generations; taking a holistic—not the current siloed—approach to the subject; ensuring that society is fitter, healthier and happier; and increasing sports participation rates by at least 10% per annum, which happens on the continent, as opposed to the static levels of participation since 2005 in this country and the major lost opportunity to deliver a participatory sports legacy from London 2012. We face a crisis of obesity, as we have heard in this excellent debate. We have to take action now. We also face a crisis of inactivity, and we need a national plan.
Secondly, we need to break down departmental and agency silos and work across government to assess, develop and implement policies that improve sport, health and well-being. Efforts to increase levels of participation as a percentage of the population have simply failed, and that should be the most important outcome for the Minister for Sport at DCMS. In our view, it requires the major clout that comes with a central, large department of state to co-ordinate and deliver cross-departmental initiatives. There is hardly a department of state now that does not have to promote policies in sport and recreation—including, for example, the Department for Transport, which recently announced a £2 billion package to create a new era for cycling and walking, equal to the total amount of money spent by Sport England on all sport and recreational activities, outside Covid, over the last eight years.
Thirdly, we need to track progress with broader measures of success, including the health of people, communities, the environment and public finances. This is exactly what the Prime Minister said when launching the office for health promotion on 29 March last year. Our amendment backs the Government’s announcement of that day, which stated:
“New Office for Health Promotion will lead national efforts to improve and level up the public’s health … It will help ministers design and operationalise a step change in public health policy”.
Above all, it said that the
“New approach will see action across government to improve the nation’s health by tackling obesity, improving mental health and promoting physical activity”.
The Prime Minister had this to say:
“The new Office for Health Promotion will be crucial in tackling the causes, not just the symptoms, of poor health and improving prevention of illnesses and disease.”
Backing his words is all we are asking for. He went on:
“Covid-19 has demonstrated the importance of physical health in our ability to tackle such illnesses, and we must continue to help people to lead healthy lives so that we can all better prevent and fight illnesses.”
The then Health and Social Care Secretary, Matt Hancock, said:
“Good physical and mental health are central to our happiness and well-being. Yet so much of what keeps us healthy happens outside of hospital and the health service. By establishing the Office for Health Promotion we will bring health promotion into the heart of Government, working to the Chief Medical Office, so we can level up the health of our nation, working across national and local government.”
For reasons unknown, the cross-governmental approach to improving the nation’s health by tackling obesity and promoting physical activity was quietly dropped last summer. The office for health promotion was reorganised and rebranded as the Office for Health Improvement and Disparities, which retained all the objectives of the office for health promotion, save the essential component of promoting physical activity. Let us add that essential goal, so strongly backed by the Prime Minister and the Government at the time. This amendment would do that, and would add this core objective to the work of the OHID.
In the interests of time, I will not argue the case for all the issues that need to be covered by a national plan, some of which are set out in the amendment. I also will not go into detail, further than to say that my noble friends and colleagues who have worked on this, not least the noble Baroness who will follow me, will cover some of those issues in this debate in Committee. In conclusion, the case is admirably set out in detail by the noble Lord, Lord Willis, and his committee, in the excellent, unanimous Select Committee report. In that spirit, I commend the amendment standing in our names to the Committee.

Lords ChamberMy Lords, I will speak to Amendments 5, 19 and 20 in the first group. In so doing, I echo what the noble Lord, Lord Hunt, said: all of us are united in believing that the Games will be great. We already have an outstanding organising committee and there is both political and popular will to ensure that they will be memorable and enjoyable.
I thank the noble Lord, Lord Foster of Bath, for introducing my amendment so well. I need hardly say anything more, save to underline the fact that the original reporting provision required the first report to be submitted to the Secretary of State as soon as was reasonably practical after 31 March this year. Because of the delay in the legislation, that was put back a full year until after 31 March next year, which is very close to when the Games are going to be held the following year.
In the context of being transparent and accountable, not only to the people of Birmingham but to other taxpayers, it is important that there is a more regular reporting structure to and timetable for your Lordships’ House. That is why I have proposed the amendment that there should be a report, starting on 15 July 2020 and then every six months until the end of the year of the Games, 31 December 2022.
Transparency is critical. Transparency about any overruns on financing will carry the public with us. It will allow all of us to know the exact underwriting procedure, how it will be dealt with, the precise budget, the current expenditure on the Games at any given six months, and the provisions for drawing down on the contingency, which are unclear to me. I do not know if they are clear to the rest of the Committee. It would be helpful if the Minister could outline on what basis the contingency will be drawn down, particularly given that the Games are underwritten by the Government.
With those comments now on the record, clearly the amendment that I tabled about the budget and revenue sources for all Games events, including shooting and archery, has been overtaken by last night’s decision. However, I look forward to the debate that we will undoubtedly have on the second group, when we will look at some of the detail of what was announced yesterday and the consequences for the Games.
My Lords, like many others in your Lordships’ Chamber, I am very excited by the 2022 Commonwealth Games. I am excited for several reasons, not least because the Commonwealth Games book-ended my career, and my last Commonwealth Games signified that I should find something else to do with my life. Also, I lived in Ward End in Birmingham for four years, and I know that the opportunities to use the Games in an incredibly positive way for the city are boundless.
I agree with the noble Lord, Lord Foster, about the grouping of the amendments being quite sensible. The expectation that people have of the Commonwealth Games is different from the one they have of Olympic or Paralympic Games because they are different types of events. However, the challenge that this country has set itself is for the rest of the world to see how good we are at organising Games, so it is essential that we get the budget absolutely right—that we have enough money to spend, but spend it wisely. I also agree with the noble Lord, Lord Addington, about what happens in coming to this slightly late. As we get closer to the Games, things become more stressful. The amendments would ensure that all the different stakeholders worked together to do the reporting and make sure that the Games are carried on as well as possible.
The reporting of finances is important for a number of reasons—not just because of the Games in Birmingham. Looking to the future, we are much more likely to bid for another Commonwealth Games before we bid for another Olympic or Paralympic Games. I do not want the group of cities and countries that are able to host the Commonwealth Games to become smaller and smaller because of the cost and transparency involved in them; that is why I believe that the reporting is incredibly important.
I totally agree that there should be early and regular reporting. As we get closer to Games-time, those working on the Commonwealth Games organising committee will be looking for other opportunities. We know that there is a group of people who travel from organising committee to organising committee, and they will be looking to join the committee for the next Olympics or Paralympics. We cannot lose that corporate knowledge of reporting, and that is why it is essential that we have very regular reporting. It would also inform what we do in relation to future bids. Whether it is for the World Cup or any other Games, this information is incredibly important.
My Lords, I will be brief. The social value charter is now on the website. Details of the principles to be upheld are clear for all to read. They cover everything inserted in the new clause that the noble Lord, Lord Foster, and I have proposed to the Committee this evening. It is vital to protect and respect human rights. It is essential that the host country refrains from any act involving fraud or corruption, above all to prohibit any form of discrimination, and to carry out all activities in a manner that embraces sustainable development and contributes to the UN sustainable development goals.
Finally, the amendment looks to
“having regard to planning, construction, protection of the environment, health and safety, labour and working conditions, and cultural heritage”.
All these have been taken on board in the social value charter, and the work being undertaken by the organising committee is gathering pace. It has had conversations with accessible ticketing providers. We covered accessibility in some detail in the previous debate. It is important to recognise that Birmingham 2022 is not seen as an isolated event. These Games are the culmination of the Transformation 2022 agenda, which the Commonwealth Games Federation has been working on for several years.
I have recently returned from Qatar, where I was looking in detail at how many of the issues covered in this charter are being implemented, in a country which has faced many criticisms and challenges in the past. I was going to share some of those reflections with the Committee this evening but instead I might write to all Members, just to demonstrate how a country can use the greatest single sporting event—in Qatar’s case, the 2022 World Cup—to transform its political and social landscape. It has established is own charter and is committed to a much-needed process of implementing change.
There is a torchlight that is shone on countries over all aspects of the social value charter, which are summarised in the amendment; it is absolutely essential that the charter is taken seriously and implemented in full. Tomorrow I shall have the pleasure and privilege of meeting the president of the International Olympic Committee in Lausanne over lunch. I shall be discussing how this document can be turned into a live document. It is remarkable work; the organising committee should be congratulated on it. It can be a template for work that is undertaken in Paris for the forthcoming Olympic Games and for all future international sporting events. I very much hope that it will be seen as that. The Commonwealth Games Federation should be congratulated on the work it has done to date. It is far easier to write words than it is to implement them, as all those of us who are interested in the subject know—not least the noble Baroness, Lady Young of Hornsey, who spoke at earlier stages of the Bill and has done so much good work on this, and who continues to lead, as she does in the House, on the subject.
With that in mind, and with these brief comments, I simply ask the Minister to recognise that all this work is being done. Let us put it in the legislation and show the world that the Government are equally committed to ensuring that the social value charter is effectively implemented.
My Lords, I briefly thought about whether disability should be added to the list but, after the noble Lord, Lord Moynihan, presented Amendment 8 so eloquently, I am much happier with that.
The noble Lord’s amendment is really important. Given that homosexuality is illegal in 37 of the 53 Commonwealth countries, it is clear there is still a very long way to go in ensuring people’s human rights. This amendment brought to my attention the fact that a lot of disabled athletes who are part of the Commonwealth Games teams are treated far less favourably than their non-disabled counterparts. This goes down to the provision of kit. A number of Commonwealth countries do not provide their disabled athletes with appropriate competition kit or tracksuits. There is a charity called Kit Us Out, run by Alex Mitchell, which has provided several thousand pieces of sports equipment and kit to disabled athletes competing at both the Commonwealth Games and the Paralympic Games. At the previous Commonwealth Games, he also provided 12 wheelchairs for athletes who did not have them, making their lives significantly easier.
Due to the late hour, I shall write to all Members of the Committee and connect with the Minister’s department. This is something that is worth pursuing—making sure that we send out the right message to disabled athletes who will be competing in this country.
