My Lords, it is a delight to follow the noble Baroness, Lady Amos.

In a fully functioning democracy, we would have expected the Government to inform us about the constantly changing situation in Afghanistan; until today, it has not been possible. The Foreign Secretary has almost remained muted for a long time, and it is our high-calibre journalists and newspapers that have been at the forefront of updating us about what precisely is going on in a country where we have substantially invested in promoting democracy and democratic values and human rights.

In the past, I have avoided the temptation to contribute in debates with a large number of speakers. This time, I have a special reason to make my contribution: I was privileged as a delegate to visit Camp Bastion, the British base, in the company of a number of other parliamentarians. We were privileged to fly in an aircraft that was adapted to bring our wounded soldiers back to the UK.

We talk about over 450 British lives lost; we will have to add to this the large number of casualties we have now lost in civilian lives. What a heavy price we have paid. I was once told by a prominent Army general that you never get involved in a conflict unless you have a clear exit strategy. In Afghanistan, we seem to have lost this particular point.

However, let us thank our Armed Forces for the remarkable humanitarian work that they undertook. Despite fierce resistance from the Taliban, the British Army delivered a turbine for a large-scale power scheme at Kajaki dam, which generates enough power to feed 1.5 million people. Our medical and surgical facilities at Camp Bastion ensured that even enemies were not denied help.

I have also had the privilege to meet a number of Afghani delegates at inter-parliamentary conferences abroad. One point that they often raised was about Britain’s idea about promoting democracy in a predominantly tribal society. It is time that we think about how our work can be advanced and how democratic values should be promoted where religion and tribal rules and loyalty play an important part. After 20 years, we seem not to have much of an idea on this particular point.

There is no dispute that those who wish to leave Afghanistan should be assisted, but what lessons have we learned, given that, with a trained Afghani army of over 300,000, the Taliban was successful in taking over Kabul without any resistance? The present crisis points to failures at various levels. Did we ever work out the policy implication of the Taliban takeover? How effective was our intelligence service? The capacity-building work will now be negated. What is likely to replace this under the new regime? The allegations of corruption were rife against the previous Administration. The extent of opium production has remained high all these years. There is still no news about the involvement of al-Qaeda and ISIS in the present events.

My final point is about the Afghani people wishing to leave their homeland. I once had an interesting meeting with Lord Carr of Hadley, who dealt with this type of crisis as Home Secretary. He told me that it took less than five minutes for the Cabinet to take a decision that admitted 29,000 Ugandan Asians to this country. We should look at the initiative that the Government took at that time, which is today proved by the remarkable contribution of this community in Britain. The same can happen with refugees from Afghanistan.

I agree with all those today who feel sorry for the plight of the Afghan people, and for the service men and women who died or had their lives badly damaged by service in that country. The American decision to withdraw military support was a dreadful one and the resulting chaos should be of no surprise. But, rather than criticise American decisions or show anguish for Afghanistan’s future, I want to use my time to reflect on our own national outlook—our ambition in overseas military involvement, particularly in the context of the recent integrated review, which described an international security situation in which we were already engaged in a battle for ideas, truth and human values.

Some in this House will know enough of military theory to recall Clausewitz’s famous trinity: a trinity of society, government and the Armed Forces which, if any great national endeavour is to be successful, needs to be in harmony. A bond of mutual trust and support has to exist between the elements of the trinity, or the nation will lack the integrity and resolve to see an endeavour through. My own close involvement in the two most recent national campaigns, in Iraq and Afghanistan, has led me to believe that the United Kingdom never remotely enjoyed the beneficial advantage of a trinity in harmony.

Indeed, neither of the campaigns in Iraq and Afghanistan ever enjoyed the unreserved support of a British society that doubted their strategic wisdom. They quickly became unpopular wars, and society’s emotional relationship with its Armed Forces became one of sympathy rather than support. Secondly, once the British Government of the day had sensed society’s prevailing view, damage limitation rather than national resolve became the principal ingredient of strategy. Within Whitehall, troop reductions and military extraction became the true metrics of success. Thirdly, as I closely observed, there existed an unhealthy level of mutual suspicion between military advice, often in pursuit of greater resources, and political judgment demanding the exact opposite.

I fear that the Government’s recent integrated review gave little thought to the state of the Clausewitzian trinity in the UK. I therefore worry that, although we retain an aspiration to be a global Britain, we currently lack the national preconditions to support such an ambition. Our military budget remains primarily invested in the totemic platforms of a bygone age. We cannot afford the aid budget which underpinned much of our global moral standing; our diplomacy seems focused on losing friends, not making them; and our societal instincts are tending to the view that charity begins at home.

I say all this while continuing to believe that the United Kingdom is a wonderful country, a great place to live, a model of tolerance, the envy of many and with the latent qualities to achieve great things when the conditions are right. But the situation unfolding in Afghanistan should teach us the sobering lesson that only when we can combine national integrity, good friends, adequate resources and resolute intent will we be able to succeed in any endeavour that demands prolonged commitment and sacrifice. The one that now confronts us—a global struggle for ideas, values and human decency—must be seen in that light. If we do not, we really are in trouble.

My Lords, in three minutes I will give three reflections. First, on the lessons of history, the noble Lord, Lord King, reminded us of the unwinnable wars of the 1840s and 1880s in Afghanistan when, in spite of the pledges of safe conduct, our people were massacred in the Khyber Pass. This led to the saying, “You cannot buy an Afghan, only rent one”—which may also help to explain the rapid collapse of the ANA and the unheroic handing over of towns without a fight. But of course we also recall the Soviet intervention in the 1980s, which President Gorbachev called the “bleeding wound”.

What is the Government’s best analysis of the reasons for the rapid defeat? What are the geopolitical consequences of that defeat? President Biden, alas, will be diminished, certainly abroad. Do the Government see any danger of the US retreating into a new isolationism, abandoning the aspirations of nation building, spreading democracy and human rights, and a corresponding loss of trust in the US? Some will repeat the wisdom of the old saying “Do not enter the box unless your exit is clear”.

For the UK, one lesson in reality is in the limits of a post-Brexit independent foreign policy. In spite of our military expenditure and expertise, when the US leaves, we leave. Our adversaries will be emboldened; the jihadists worldwide will celebrate; and there is a loss of trust in our pledged word and our ability to stay the course. Other lessons include that if we allow the pendulum of intervention—after the high point of the Chicago speech and the duty to protect—to swing too far in the opposite direction, it will be to our disadvantage.

How do we respond to the reality of the Taliban? It depends, of course, ultimately on their conduct. Are they latter-day Bourbons or do we believe their PR people, which would be extremely naive? How united in fact are the Taliban and what is the best analysis we have of that? Yes, of course, bring out our citizens and those who depend on us—but we should be extremely generous, particularly in respect of women and girls. We have reduced our aid; who will lose out as a result of the doubling of that aid? Will our aid agencies, the NGOs, be allowed by the Taliban to operate freely?

We should build bridges where we can and where there is an overlap of interest, at least partially, with countries such as China and Russia. But we need to work particularly closely with Pakistan, which will assume a new importance in its regional role. In short, we should look long and learn the lessons of history, and we should remain very true to our own values.

My noble friend is entirely right: investing in nature-based solutions for adaptation will also help build resilience, support jobs, support livelihoods and help tackle biodiversity loss, but finance is lacking. Only 3% of global public climate finance flows was spent on nature. Noble Lords will recall that at the One Planet Summit in January 2021 the UK committed to spend at least £3 billion of our international climate finance on climate change solutions that protect and restore nature and biodiversity over the next five years.

Can I just check with the Lord Speaker: if people have already voted, is that taken as a vote? Is there a way of putting the extension on the screen, and extending it for more than three minutes, as a number of Members have left the Chamber thinking they were unable to vote? I am not convinced that an extra three minutes is long enough.

I agree with my noble friend’s last remark, but I can assure her that there is no inaction in this instance. I understand that a letter addressed jointly to the Speaker of the House of Commons and the Lord Speaker was received last month from the President of the European Parliament, David Maria Sassoli, confirming the recent decision of the Conference of Presidents to establish the standing inter-parliamentary delegation of the European Parliament, so the process is moving forwards at the European end as well.

It is my privilege to pay tribute to the noble Lord, Lord Fowler, from the Spiritual Benches. I start with a specific reflection from these Benches on our leading of Prayers at the start of each day. The noble Lord was consistently considerate and courteous, taking the time to personally thank the duty Bishop for their prayers on each occasion. It was a small, kind gesture that meant more than he may have realised.

We all know of the noble Lord’s long-term, ongoing dedication and perseverance in addressing HIV. His patient persistence is admirable and notable. As he continues with this commendable work, as a UN ambassador, we trust he will further help it move forward. As it happens, this morning, before we began business, I was on a call with Christian Aid, for Christian Aid Week, with people from Kenya who were reflecting not only on climate change but the ongoing impact of AIDS in their country. It is work that needs to continue.

I always valued the noble Lord’s faithful speaking up for the work of this House. He challenged us to fulfil our responsibilities well, he saw how we could perform more fruitfully as a smaller number, and he never held back from criticising those who held the power of appointment when they failed to help us reform ourselves. May we all learn from his example of speaking graciously and firmly, his dedication, perseverance and determination to seek justice and the well-being of all.

I take this opportunity also to warmly welcome the noble Lord, Lord McFall, to his role as Lord Speaker. We have enjoyed—I say “we”, meaning me personally and other Members who sit on the Front Bench—many quiet chats before proceedings as he sat with us, ready to present business as Senior Deputy Speaker. They may not take place now. I say to the Lord Speaker that he is assured of our support in his role and of our ongoing prayers.

In conclusion, I return to the noble Lord, Lord Fowler, and very simply say thank you for serving us all as Lord Speaker so extremely well.

My Lords, I would like to say a few words of my own to close the tributes to the noble Lord, Lord Fowler. What a joy it is to see him here today in his new place on the Cross Benches.

He and I began as Lord Speaker and Senior Deputy Speaker, respectively, in 2016; little did we know what was to come. The past five years have seen the House go through political turmoil, Supreme Court cases and, of course, the Covid-19 pandemic. The noble Lord, Lord Fowler, was present on the Woolsack for the first Saturday Sitting since the invasion of the Falkland Islands in 1982, and he recalled the House for the first Christmas Sitting since the civil war. Throughout it all, the noble Lord, Lord Fowler, steered the ship admirably. He and I worked well together—I know only too well that his job was not easy, but he bore the burdens, and sometimes frustrations, with patience, calmness and good grace. He was always courteous to me, and I speak personally when I say that the support and encouragement that he has given to me over the last five years have meant a great deal.

He has been a fierce champion of the House and of our Members. I have lost track of the number of letters and articles that he has penned and speeches that he has given in defence of our work and the valuable role that we play in shaping legislation, adding value and holding the Government to account.

Within four months of his Speakership, he established the Burns committee, and the efforts to reduce the size of the House ran like a golden thread through his time on the Woolsack. That the scheme commanded widespread support in the House and that No. 10 followed a policy of moderation in new appointments are both significant achievements. As the Burns committee report published last Sunday set out, we, the Members of the House, have delivered our side of the bargain; others have more to do. I know that the noble Lord, Lord Fowler, will continue to champion this cause from the Back Benches, where, ironically, he now has much more freedom to pursue it, with his characteristic resolve and determination.

His weekend emails over the last year came to punctuate the week and drew us together during a time when so many of us were apart. His lecture series showcased the best of the House and projected that to those beyond our walls. The lecture given by Sir David Attenborough in the Royal Gallery was a highlight, although he was not a Member of the House, and the spontaneous standing ovation showed the power and impact that his address had on those of us who were present.

The noble Lord, Lord Fowler, was not only a formidable champion for the House; he did a great deal to compound and grow the office of Lord Speaker. As noble Lords will know, the office is relatively new, and the noble Lord, Lord Fowler, was only the third incumbent. His willingness to grant PNQs from both the Front Benches and the Back Benches allowed more urgent business to be brought to the Floor of the House. The small but important changes that he secured, which mean that the Lord Speaker now announces business from the Woolsack, have allowed those outside the House, and some of those inside it, to better understand our proceedings.

There has been no formal review of the role of Lord Speaker since the Constitutional Reform Act 2005—yet, as noble Lords will know, the first three Speakerships have already seen significant evolution and growth. The noble Lord, Lord Fowler, and I spoke about this only last week, and we are united in the view that the office should continue to mature and that this will most definitely be of benefit to the House. I am grateful to him for the support that he has offered in this regard in these early days of my Speakership.

Two hallmarks of an effective politician and parliamentarian are, first, that they listen and, secondly, that they persevere. The noble Lord, Lord Fowler, possesses both qualities in abundance. As Secretary of State for Health and Social Security in the early days of the AIDS crisis, he listened to the advice that he was given and persevered in a course of action that he believed to be right. His resolve held firm—in the face of considerable opposition at the highest levels, I think it is fair to say. His resilience over the decades that have followed has strengthened rather than diminished; in my view, this speaks volumes.

Finally, I congratulate him on being appointed as an ambassador for UNAIDS; this is a cause that he cares deeply about and has championed for decades. UNAIDS is fortunate to have him as such an effective and determined advocate, and I know that all noble Lords will join me in wishing him every success for the future and thanking him most sincerely for his loyal and selfless service to this House.

My Lords, given that one of these Motions relates to the new Convenor of the Cross Benches, I wanted to say a few words about the outgoing Convenor, the noble and learned Lord, Lord Hope of Craighead.

All noble Lords will know that the noble and learned Lord had a long and distinguished career as a lawyer, playing an instrumental role in the transfer of judicial authority from this House to the newly created Supreme Court. Over his four years as Convenor, the whole House has benefited from the measured and constructive way in which he has stood up for the interests of the Cross Benches and approached the work we have done together, not least via the work of our domestic committees. He has been a committed and constructive part of the usual channels, and I thank him sincerely for that. I know that these thanks are echoed by my noble friend the Chief Whip and his predecessor, my noble friend Lord Taylor of Holbeach.

Noble Lords may not be aware that the noble and learned Lord is a keen diarist, and I am sure we will all look forward to the volume on his years as Convenor. I particularly thank him for his involvement in the cross-House, cross-party working group which helped develop the new independent complaints and grievance scheme. His counsel and advice were certainly invaluable to us all.

On behalf of the whole House, I would like to wish the noble and learned Lord well and hope that he will be able to spend more time enjoying his hobby of bird-watching, without having to be in the range of a computer or hunting for what I understand is an elusive phone signal in the local Tesco in Craighead.

Finally, I look forward to working with his successor, the noble and learned Lord, Lord Judge. I am sure we will have an equally constructive and positive relationship.

My Lords, may I say something which is not about me? Apart from the things that noble Lords have said about me—and thank you all for being so kind—I agree with everything that has been said about my noble and learned friend Lord Hope. The custom is, certainly in my experience, that where you agree with everything that has been said, you say so and sit down. I am not going to. I will hold you up a little longer, because I enthusiastically support what each of you has had to say in the very generous tributes to the Convenor who—it is lovely to see so many Cross-Benchers here—has led us. Sorry, I have made a mistake; Convenors do not lead. He has guided us—I am not sure my colleagues would even agree with that. At any rate, to be neutral, he has been there: he has been ever available, ever helpful and, a lovely characteristic, self-effacing as Convenor of the Cross Benches. He is having a few days away. If he had been here today, he would have been profoundly embarrassed at what you have all had to say about him, so it is wonderful that he is not here. But he will be here next week and thereafter, and I for one will be rushing away from the very important corridor which you all inhabit, and I do now, to find him in his room to seek his advice and guidance in order that I can do a better job as the Convenor.

I would like to add my personal thanks to the noble and learned Lord, Lord Hope, with whom I have worked very closely since I have taken up this job. I hugely welcome the profound, ready and wise advice he has given to me—all pro bono—and which I am sure the noble and learned Lord, Lord Judge, will continue in the same fashion.

My Lords, Lord Lester resigned as a Member of the House on Wednesday last week, a few hours before this report was published. As a result, Lord Lester is no longer a Member of the House and the recommendation for his suspension is unnecessary. Nevertheless, the report before us today is an important part of the process. It sets out several key points of principle which the House is invited to endorse. I urge the House to agree the report, both to deliver justice to the complainant, Jasvinder Sanghera, and to give confidence to other possible complainants and respondents that we have a robust but fair process in place for investigating allegations. That point is key. Since the debate on 15 November, there have been comments in the media, and by members of the public, suggesting a loss of confidence in our ability to hold our Members to account. We must work to regain that confidence today.

On 15 November, the House debated the committee’s original report on the conduct of Lord Lester. During that debate, a number of criticisms were made of the House’s procedure, and of the commissioner’s investigation. These criticisms relate to the need to ensure that investigation is fair and provides natural justice for both the complainant and the Member; whether such investigations should involve cross-examination; the need for the evidence to be robustly tested; the standard of proof required for the commissioner to reach her finding; and the question of legal representation. At the end of that debate, the House voted to remit the original report to the Privileges and Conduct Committee on the grounds that the commissioner had,

“failed to comply with paragraph 21 of the Code of Conduct which required her to act in accordance with the principles of natural justice and fairness”.—[Official Report, 15/11/18; col. 1995.]

The House asked us to think again, and we have taken great care to reflect on the arguments made in the debate. In doing so, we have drawn on not only the considerable legal and investigatory experience of individual committee members but expert input from Dr Helen Mott, a specialist in understanding the psychology of the perpetration and experience of sexual harassment, research from the Library of the House, and the policies and practices of other parliaments and professional organisations in dealing with such cases. We have also considered further submissions from both Lord Lester and the complainant, Jasvinder Sanghera, which are published with our latest report.

Our report before the House today robustly and fully addresses each of the criticisms made in the previous debate. It reaffirms the recommendations in our original report that Lord Lester,

“breached paragraph 8(b) of the Code of Conduct by failing to act on his personal honour—and specifically, that in the course of his Parliamentary duties, he had sexually harassed a member of the public and offered her corrupt inducements to sleep with him”.

It restates our unanimous support for the commissioner, who conducted her investigation,

“to the highest standards of fairness and rigour”.

She did so in accordance with a process set out in the Code of Conduct, which each of us signs at the start of each Parliament. That afforded Lord Lester every chance to put his case across and question the evidence against him.

I do not intend to set out those parts of the report which deal with factual questions about the detail of the investigation. They speak for themselves, and I believe the House has already gone further than it should in reopening the commissioner’s inquiry. However, I wish to summarise our response to the points made in the debate about the fairness of the processes. The report shows clearly that it is best practice in complaints of this nature to follow an inquisitorial process, with no cross-examination. We are not just heeding the advice of experts, such as Dr Helen Mott; we are also absolutely in line with the practice of the bodies which regulate the conduct of Ministers, judges, and parliamentarians in similar legislatures around the United Kingdom and beyond.

Our system works because the commissioner interrogates the evidence, particularly that of the complainant and the respondent, and gives all parties the right to challenge the evidence at each stage. This is an internal disciplinary process, not a judicial one. We simply do not accept that cross-examination, whether conducted by a QC advising the commissioner or anybody else, would be appropriate. Indeed, it would put us out of line with most comparable organisations and the advice received.

Finally, this has caused enormous concern and distress to the staff of your Lordships’ House and to others across the House who rely on us to uphold this as a safe and respectful workplace. The debate last month did nothing to enhance that reputation. It is a very sad state of affairs when we must have a debate such as this on a report. I should hope there would be some trust in the commissioner, who undertook her responsibilities diligently and carefully with respect for all involved; in the sub-committee and its members, who said that it should be investigated; and in the committee as a whole and the noble Lord, Lord McFall. However, the greatest respect we should show should be for the complainant who has had to sit through these debates.

My Lords, it falls to me to respond briefly to the debate. At the outset, I acknowledge how difficult this topic is for all of us. It is not a subject that any of us would wish to be debating today or any day. I shall pick up a number of points. Perhaps it was translated into an email as well, but I read it. In fact, I read it again in the Times of 13 December and I read the reply of the noble Baroness, Lady Jay, of 15 December. Then, this morning at 5.30 am, I read the reply of the noble Lord, Lord Thomas of Gresford. What does that indicate? It indicates that there is a lively debate. The point that the noble and learned Baroness is making, on procedure, is for the future, and she can be assured that it will be taken on board.

The noble Baroness, Lady Jones, asked about access rights for Lord Lester. That is a matter not for the Privileges and Conduct Committee but for the House of Lords Commission, which will meet on Wednesday.

The noble Lord, Lord Butler, asked about procedures. The role of the House is to satisfy itself that its own procedures are set down in the code and the guidance to be followed. Those procedures were established in 2009 in the Leader’s Group by the noble and right reverend Lord, Lord Eames. Since then, I believe that there have been seven revisions and, as has been mentioned, when there is a general election we have to sign up to that code. So since 2009 there have been 10 opportunities for people to comment on the procedures. Given the highlighting of the debate here, I urge Members to put their comments in, because the Privileges and Conduct Committee will be looking at the independent complaints and grievance procedure recommendations in the new year.

I have no knowledge of any complaints against other Peers in this House. I make that clear.

I mentioned the noble and right reverend Lord, Lord Eames, who established a concept of personal honour. That concept is central to this debate. In elaborating on that, he mentioned words such as selflessness, accountability, integrity, openness, objectivity and honesty.

To conclude, we are dealing with two individuals who are both eminent and respected in their fields, as I said previously. As the noble and learned Lord, Lord Mackay, said on 15 November,

“the most severe burden that anyone has to carry is adjudicating upon the conduct of our fellow citizens”.—[Official Report, 15/11/18; col. 2017.]

I know from Members’ comments to me that they have found this painful and distressing on occasion. The Independent Commissioner for Standards, the sub- committee and the Committee for Privileges and Conduct carried out their difficult task dutifully. The commissioner, an experienced lawyer and investigator, as well as a mental health tribunal judge, carried out her task precisely as laid down by the code and the guide that the House designed and agreed to. Each Member signs up to the code and the guide at the start of each Parliament. We must remember that, unlike the House, the commissioner had the unique advantage of seeing, interviewing and assessing the complainant and Lord Lester.

This is the redacted material, which every Member was invited to read before the first meeting. No one took up that invitation. We reiterated the invitation and two individuals have taken it up. I know that one Member has contacted the office to say that they would like to take it up on Wednesday. I invite all other Members to come along after this if they wish to see this material, because it is detailed, comprehensive and fair to both parties. That invitation is open.

I was one of the two Members who asked to see the material. The point that has not been made today is that the material contains the contemporaneous witness accounts of what happened in Lord Lester’s house. I found that evidence absolutely overwhelming and persuasive. I join the noble Lord in inviting other Members to read it as well.

The noble Lord said that there were six contemporaneous witnesses. We invite Members to read their accounts.

In her own words,

“on the basis of the strong and cogent evidence of the complainant and her witnesses”,

the commissioner found that Jasvinder Sanghera was a victim of sexual harassment and that Lord Lester was guilty of a grave abuse of power. The Committee for Privileges and Conduct reviewed and endorsed this view. We ask the House to do the same. I hope the House will now agree to this report.

My Lords, we have not ignored diversity. We are committed to increasing competition in banking to improve outcomes for consumers. The Government have an ambitious programme of reforms to increase competition in banking. This includes, for example, divesting both Williams & Glyn and TSB from RBS and Lloyds, creating a seven-day current account switch service, and delivering more data to enable customers to compare which bank is best for them—I could go on.

My Lords, the Chancellor of the Exchequer at the time of the bailout promised that all the money expended by the taxpayer would be recovered in full and that there would be a reformed Royal Bank of Scotland. Neither of those promises has been realised. The Royal Bank of Scotland has still to escape the shadows of seven years ago. Why is the Chancellor breaking his promise?

I do not agree that he is. The Chancellor said two years ago that he would return RBS to private hands. He is doing that. He is increasing competition. RBS has been reformed. The independent advice is that this is the best time to go forward. We have reformed the banking sector completely. I cannot agree with the noble Lord.
