My Lords, I declare my interest as president of the Independent Schools Association. What progress has been made by the excellent schemes to provide places in both state and independent boarding schools for children in care who would be suited to them and benefit from them—which not all children in care would? Should not local authorities consider this option for their children in care with a completely open mind? How does the average annual cost of a place in a children’s home compare with that in a boarding school?

My Lords, the noble Lord is correct. Through the Royal National Children’s SpringBoard Foundation charity, the Government are currently running regional pilots in the south-west, the north-east and London, to try to ensure that, where it is in the best interests of the child and the most appropriate placement is in one of those boarding schools, that is the placement. That is being done with a view to, after looking at the regional pilots, making it national.

My Lords, all I can say to the noble Baroness is that, unfortunately, we have had to make some difficult decisions in relation to current priorities. An arts premium will be considered in the spending review but, as I have outlined, about £84 million this year has gone into the music hub and various programmes to ensure that provision. I wish we had the ideal world that the noble Baroness outlines.

My Lords, I declare my interest as president of the Independent Schools Association, which is made up of over 550 smaller independent schools serving their local communities up and down the country. Following on from my noble friend Lord Lingfield’s question, have the Government noted that, before the pandemic, state and independent schools were working together in over 1,200 partnership schemes involving either music or drama? With so many pupils having missed out over the last year, is this not the moment for the Government to encourage more state schools to work with their local independent colleagues so that the education system as a whole achieves the maximum benefit of collaboration between the two sectors?

My Lords, my noble friend is correct: there are many successful partnerships and I have the pleasure of regularly meeting the Independent Schools Council and other sector bodies, as he outlines. In the next couple of weeks I am holding a round table for precisely that purpose: to see how the existing partnerships could be strengthened and whether we could see an expansion of that activity.

My Lords, obviously many of the mitigations that certain children with special educational needs need in terms of extension of time in exams are not obviously going to be relevant under this system. There is a short list at the moment of assessment materials that teachers can take into account; it is not just “sit an essay”. There is are a range of materials and we would and do expect and hope that teachers will know, in circumstances such as the noble Lord outlines, which materials to set for children with those particular needs. I will write to him about whether there is any specific aspect of the training that exam boards will give in regard to special educational needs students and the outperformance in exams that he outlines.

My Lords, I declare my interests as a former general secretary of the Independent Schools Council and the current president of the Independent Schools Association. Do the Government recognise that independent schools want to work as closely as possible with their colleagues in the maintained sector, strengthening the well-developed partnership between them still further, in order to play a full part in the recovery of the entire national education system? Will there be opportunities for independent schools to contribute to the recovery schemes that the Government are now designing?

I thank the noble Lord for his persistence in raising this issue. I have the great privilege of meeting at least every fortnight with the Boarding Schools’ Association and the Independent Schools Council. We have certain partnerships with them, particularly in relation to vulnerable children in boarding schools, but I do want to say, in relation to catch-up being for the lifetime of the Parliament, that now is the moment for us as the department and that sector to really try to square this circle and find a larger-scale way in which the good will of the sector and the needs of our children can be aligned so that we can deliver something more substantive.

My Lords, the JCVI has asked government to look at occupational roles in the next phase of the rollout. We are working across government to make the case for the teaching and education workforce generally; advice will be produced and then it will be for Ministers to decide on the next phase of vaccination.

My Lords, the Government have now delivered 875,000 laptops of a £1.3 million order. We are one of the world’s largest purchasers of laptops, in a competitive market—obviously, many Governments are trying to purchase them. Secondary schools did a great job over the Christmas holidays of standing up mass testing, and we intend to extend that to primary schools and early years settings as and when we can.

Would it be unrealistic for schools to start planning for inspections before September?

My Lords, there are currently no grade inspections either by ISI, of the independent sector, or Ofsted. However, monitoring inspections are happening, particularly of our “requiring improvement” and “inadequate” state-funded schools. Both those inspectorates, particularly Ofsted, retain the power to go into a school if there are safeguarding concerns.

I declare my interest as a former general secretary of the Independent Schools Council and the current president of the Independent Schools Association. Is it not essential that the Government give the highest priority to the vaccination of all those who work with such dedication in our country’s schools? Will they consult closely with the Independent Schools Council in settling the detailed arrangements for this summer’s exams and assessments, recognising the close partnership that the council has with maintained sector colleagues?

I am grateful to the noble Lord for mentioning vaccination, because I forgot to outline the position. We are following independent experts from the JCVI in distributing the vaccine first to those who are most clinically at risk of hospitalisation and death. The single biggest factor, as I am sure noble Lords are aware, is age. I understand that the Prime Minister might be talking about the progress of the vaccination at this very moment. In relation to reopening schools, the testing being rolled out and consideration of the vaccine are very much on the department’s mind. I am due to meet the Independent Schools Council later this month. From previous discussions, I know that it is closely linked to Ofqual and I am sure it will be involved in responding to the consultation on exams. We recognise the concerns and views being expressed by Members on the priority that should be given to vaccinating school staff.

My Lords, the Government’s position is that the protections afforded by the UN convention are already present in domestic law. Specifically on the Online Harms White Paper, there will be a response later this year, and we plan to legislate to introduce a new duty of care on companies which will be overseen by an independent regulator. Protecting children is at the heart of what we are seeking to do in that regard.

My Lords, as I have outlined, as there is no legislative change, there is not a case for renewing wholesale the guidance. The Statement makes clear the law around single-sex spaces, and I believe that most people who responded to the consultation felt that there will be no change to the use of those spaces in that regard. However, we keep the guidance under review.

My Lords, I join the noble Lord, Lord Watson, in thanking young people for their resilience during a crisis this summer that no-one intended them to have to go through. I repeat to your Lordships’ House the apology made by the Secretary of State and in my letter to noble Lords. I thank the noble Lord for his wish to work constructively on these matters.

On schools reopening, the main guidance to put in place the hierarchy of controls, on the need for bubbles or for year groups to be kept separate in secondary schools was issued on 2 July—well in advance of the end of summer term—and enabled schools to prepare. However, for the thankfully very small number of situations where there are additional restrictions, the guidance was issued only recently.

On the noble Lord’s questions about exams, it is important to remember the principle that Ofqual was a body created by Parliament. It was created by statute and is answerable to Parliament. There are good reasons in principle why the regulation of public examinations in this country is not subject to direct government interference. It was Ofqual’s responsibility to have the data to develop the algorithm and then send that algorithm to the various examination boards. There was a reaction at the stages at which the department was made aware of additional concerns and Ofqual met regularly with the department even from before the announcement was made for exams to be cancelled. The department reacted, but Ofqual is the independent regulator.

On sharing data, in the week running up to the A-level results the system was as per any normal year. On the Monday or Tuesday some headline data is given to the department. On the Wednesday that data is shared with schools and is then published on Thursday. To respect the normal division of responsibilities between the department and Ofqual, that long-standing practice was abided by and Ministers did not see the detail of results for individual students or the schools that would have been affected.

Only a tiny fraction of BTEC examination results remains to be communicated to students. That is where further information is needed. Each year there are normally, unfortunately, a small number of results outstanding. Pearson has assured us that it is working to issue these remaining results as soon as possible.

It is envisaged that the first services from the national tutoring programme, which is being delivered by the EEF and Teach First, will be delivered in the second half of the autumn term.

On the specific questions on early years catch-up, of the £350 million tutoring programme, £8 million has been awarded to Nuffield for early language development and there was an announcement that there will be small-group tuition for disadvantaged 16 to 19 year-olds. They are now included in the catch-up.

On the issue around special educational needs students, as noble Lords will be aware, the Oak Academy’s provision of online lessons has of course included some for those with special educational needs. The guidance and the links to the various resources on the Department for Education’s website include links to these. We have been working closely with the sector. Over the next year an additional £730 million will go into the high-needs budget, meaning that it will have grown by £1.5 billion, or 24%, in just two years. We are responding on special educational needs. The £650 million of main catch-up funding going out to schools has been weighted per pupil for specialist schools, because we recognise the higher per pupil costs in those settings.

There will be a contingency plan for examinations next year. There has already been guidance on the curriculum so that schools knew what they were doing from the moment they came back. For instance, in English literature they know that pupils will potentially be examined on only three of the four set texts and there have been changes to field work in geography, et cetera. The question of whether there will be a delay was part of Ofqual’s consultation on the 2021 series, and that will be confirmed as soon as possible.

There is now a higher education task force, chaired by Michelle Donelan, the Minister for Universities, which meets regularly with Universities UK and other stakeholders to work with the sector on the implications of the change in the awarding of grades for A-levels.

Turning to the questions raised by the noble Lord, Lord Storey, I specifically checked and, while it is my personal preference to read the Statement, I was told that in this hybrid situation I do not repeat it. However, I put my view that I want to read it to noble Lords because it helps.

A lot of specific guidance has had to be set out for the sector. Officials and the sector have worked very closely to try to get the right boundary in not being able to be prescriptive, because we have over 20,000 schools in about 70,000 buildings. There must be the framework and the principles for head teachers and other school leaders to make their risk assessments and the changes to their buildings.

Masks are recommended only where we have something such as a tier 2, where there is a local lockdown, but schools can advise their students on that. I hope that the guidance is not contradictory on that matter.

Disadvantaged pupils are of course a concern for noble Lords and for the department. That is why there is the £1 billion catch-up fund. On excluded pupils, many of whom will have been in alternative provision, all schools reopening includes AP schools. At the end of the summer term we announced additional funds for those leaving AP to make sure that they had additional support and did not end up not in education, employment or training. We are working to ensure that they do not fall within the gaps.

On home education specifically, yes, we are particularly concerned. Going back to the cancellation of exams and the work the exam centres did, obviously some home-educated students then register at a school and sit their examinations in that school. As far as possible, we asked those schools to evaluate the performance of that student if they had any data on which to do so, but of course there were situations in which it just was not possible. That is also about the integrity of head teachers and teachers who did not feel they could give a grade. That is why the autumn series of resits in all subjects will be so important, particularly for home-educated students.

There was a recent consultation from the department on whether to have a register with local authorities and whether to pay exam fees for home-educated students, because we are concerned about the rise in the number of home-educated students. The reasons are not, as perhaps they were 10 or 20 years ago, well-meaning parents. Some who are in home education are potentially not getting the education they deserve, but we do not have the data. I will update the House as soon as I can on what is happening with that consultation.

My Lords, is it not incumbent on us all, whatever our political party, to do all we can to encourage and support our country’s teachers and those working responsibly in the teaching unions? Has my noble friend noted the ways in which the recovery of our education system is being assisted by independent schools sharing their online programmes with state-sector colleagues, asking them to join summer courses, and strengthening the flourishing partnership work that benefits both sectors so much?

My Lords, it has been a pleasure during my tenure as Minister to speak regularly to the Boarding Schools’ Association and the Independent Schools Council. One of the things we have seen during the pandemic is a sharing of educational expertise, not only from the independent sector to the state sector but within the state sector, whether that is sharing online classes, as with the Oak National Academy, or teachers sharing lesson plans. I hope that will be one of the positive legacies of this crisis—that we will continue to share the best of our educational practice so that all pupils can benefit from it.

My Lords, would it not be appropriate to extend to the secondary sector the flexibility that primary schools have been given to allow more children back when they can do so safely? Can my noble friend confirm that independent schools, which are actively engaged in the national effort to bring pupils back into school, as she has mentioned, can bring children on to the school site as long as the correct protocols are observed?

My Lords, the flexibility is to respect the professionals on the ground. Unfortunately, because of the specific risks that secondary pupils travel greater distances to school, often use public transport and usually have a wider range of social contacts, we have not been able to have the numbers back in a secondary setting. We are grateful to the independent sector. The guidance is that boarding schools should not expect year 10 and year 12 back; if they can have that face-to-face contact on a day basis, that is permissible. I am grateful that, as they have atypical transition years, they have heeded the Government’s guidance to bring back reception, year 1, year 6, year 10 and year 12, as I have outlined.

Is my noble friend aware that the 1,300 independent schools belonging to the Independent Schools Council want to do all they can to assist their local communities? I declare my interest as a former general secretary of the council. Has my noble friend noted in particular that they are anxious to help with childcare? To that end, they are getting in touch with their local authorities to concert practical plans. Finally, I ask the Government to bear carefully in mind the grave difficulties that independent schools will suffer if they are unable to secure help from insurance companies for business interruption.

I am grateful to my noble friend for that question. Yesterday afternoon, I had the pleasure of speaking to the heads of both the ISC and the Boarding Schools’ Association. They passed on that message, particularly in relation to looked-after children who are in their care and will remain in their care for the moment. We are grateful for their offer of support, which I have passed on to the Secretary of State. When we talk about collaboration locally, that means all schools and colleges, including the independent sector.

I am grateful to the noble Lord. Obviously, within priorities at the moment the most vulnerable group at risk has been that of older people; but, as of last night’s guidance, there was reference to those young people with specific medical conditions, such as severe asthma or cystic fibrosis. They will be contacted directly by the NHS. But we are acutely aware that there are groups of young people, particularly within the SEND population—for instance, those in special residential schools—where there are implications in having any kind of household-type isolation. There are also profound implications for the families; those children are in residential special provision for very good reasons. As we completely realise, it is not as simple as saying “You now need to go home”, so that guidance is being worked on as well.

My Lords, I think my noble friend is referring to the tribunal process. Since 2014, the percentage of decisions being taken to the tribunal as a proportion of the overall number of plans is the same. Numerically, it is going up because the number of plans is going up. There are actually now five different decisions, or combinations of decisions, that parents can appeal. But my noble friend is right, too: we have given £365 million of capital so that local authorities can build more spaces because—he might not be happy to hear this—it is actually cheaper for local authorities to provide the spaces themselves, rather than use private or independent providers.
