Lords ChamberTo ask His Majesty’s Government what is their assessment of the destruction of the Nova Kakhovka dam and the international response.
My Lords, at least 80 communities and 40,000 people are affected by flood water. Damage to homes, infra- structure and agriculture will affect thousands more. Our partners are working hand in hand with the emergency services to evacuate people and provide vital relief. We have also provided an additional £16 million to the United Nations and the Red Cross to help civilians, including those affected by flooding and others elsewhere in Ukraine in humanitarian need. To bolster efforts, we are also sending boats, water filters, pumps and waders to Ukraine.
I thank the Minister for his reply; it is particularly good to hear of the support the British Government are giving to those affected by the floods. My Question concerns a different aspect of the matter: adherence to the Geneva conventions. Article 56 of the 1977 Protocol 1, additional to the 1949 Geneva conventions, says that dams and nuclear sites must not be the object of attack if civilians are going to suffer. Over 170 nations have signed up to this, including Ukraine; Russia originally signed up and then withdrew ratification. Will His Majesty’s Government reaffirm the importance of adhering to that in a world where there are now so many dams and nuclear power stations?
My Lords, I agree with the noble and right reverend Lord. The essence of all the Geneva conventions was to ensure that these important elements are protected during conflicts, so I very much support his sentiments. However, I remind the House that, as my right honourable friend the Prime Minister has said, our intelligence communities are still looking at the incident, and it remains too soon to make a definitive judgment as to the cause.

Lords ChamberTo ask His Majesty’s Government what progress has been made in obtaining access to West Papua for the United Nations’ High Commissioner for Human Rights.
My Lords, the United Kingdom welcomes recent engagement between Indonesia and the UN, as part of Indonesia’s universal periodic review in November 2022. We continue to support a visit by the United Nations High Commissioner for Human Rights to the region of Papua. We recognise that a significant amount of time has passed since the visit was first proposed, but we hope that both parties can come together to agree dates very soon.
I thank the Minister for his Answer. He mentioned the universal periodic review of Indonesia. He will know that, at that review, a number of major countries, including the United States, Australia and Canada, called for an intervention from the UN in Indonesia and an immediate visit by the UN High Commissioner for Human Rights. It is not at all clear that the United Kingdom was among those supporting that call. Perhaps the Minister will be able to enlighten us.
I hope the Answer I have given in the House today reassures the noble and right reverend Lord that we support an early visit. I am cognisant that this visit was first proposed under High Commissioner Zeid, who has since been succeeded by High Commissioner Bachelet and subsequently by High Commissioner Türk. The visit has been pending for a long time, and it is important that it takes place at the earliest opportunity.

Lords ChamberTo ask His Majesty’s Government what steps they have taken to work with the governments of Islamic countries to persuade the Taliban to allow women in Afghanistan to work with non-governmental organisations.
My Lords, the ban on Afghan women working for NGOs is totally unacceptable. I have spoken to my counterparts from across the Islamic world to agree that we must convince the Taliban that these edicts are un-Islamic and contravene all global norms and values. I am encouraged that the Organisation of Islamic Cooperation is considering initiatives to address this very problem. I shall of course continue to seek practical solutions and work with Muslim-country partners to ensure that Afghan women can continue to work and, importantly, benefit from lifesaving aid.
I thank the Minister for that Answer. When this issue was raised last week by the noble Lord, Lord Singh, the Minister suggested that there might be a way of bending the present rules to allow this to happen. Does he agree that it is essential that some long-term solution for this is found? Could he indicate what work is going on in relation to Pakistan, Saudi Arabia and Qatar—all countries that have, in the past, had good relationships with the Taliban? Would he use all his much-respected powers of persuasion in relation to these countries to get a long-term solution to this?
My Lords, the noble and right reverend Lord is right to raise this issue. As I alluded to, I find it unimaginable—I put it that way—that the Taliban, with their rigidity and coercion, will back-track on the edicts that they have issued. However, as reported by the Deputy Secretary-General to the UN, we have seen workarounds on ensuring that support on key issues such as health and education is being provided. The noble and right reverend Lord is correct that we are working on that. I assure him of my good offices and those of others. We are working closely with the Islamic countries. I was in Pakistan in October 2022 and I raised this issue directly when I met the Foreign Minister of Pakistan, in December. My colleague and right honourable friend Andrew Mitchell met the Pakistani Prime Minister recently at a conference in Geneva. I have recently engaged with Oman, Qatar, Algeria, Tunisia, Morocco, Egypt, Indonesia and Pakistan.

Lords ChamberTo ask His Majesty’s Government what assessment they have made of the influence of Russia in Georgia.
My Lords, we fully support Georgia’s sovereignty and territorial integrity, and we work closely with the Government of Georgia to strengthen their resilience with regard to malign Russian influence through our bilateral defence and security co-operation. The NATO leaders’ summit in June agreed a tailored support package for Georgia that builds on the extensive support provided to Georgia over recent years. We expect the UK to play a leading role in the framework of this additional package, supporting strategic communications and cyberdefence.
I thank the Minister very much for his Answer, but I am not sure that it fully reflects the seriousness of the current situation in Georgia. Political and economic life in Georgia, including the media, is controlled by Bidzina Ivanishvili, the multi-billionaire businessman who made his money in Russia. It is clearly documented that he still has huge assets there in the names of his relatives and business associates. This is worrying enough, but more recently there have been in the public realm 100 files of leading politicians, churchmen and diplomats, with the details of who their contacts are, who they support and any material that might be used for blackmail against them. That shows clear signs of collusion between Russian secret police and the Georgian police, the old KGB. This is a worrying situation; will the Minister ensure that the relevant bodies in the European Union are fully aware of this?
My Lords, first, I recognise the noble and right reverend Lord’s important work in support of Georgia over a number of years, not least since 2008. He raises some important issues of concern, and I will of course take them away. He spoke about sharing them with the important authorities on the ground; we do work very closely with others, including the EU. If there is more detail I can share with him, I will certainly do so.

Yesterday the Government made the very welcome announcement that they are opening out this humanitarian sponsorship scheme, but they did not say anything about how all these people who want to offer their homes can link with those who want to come here. Are the Government yet able to reveal how this contact is to be made?
I know that my noble friend Lady Williams and my colleagues in the Home Office are working on the very points that the noble and right reverend Lord raises about the detail of the scheme. I am sure that she will update the House on progress very shortly.

Lords ChamberTo ask Her Majesty’s Government what representations they are making to the government of Georgia about the continued imprisonment of Mikheil Saakashvili, the former president of that country.
My Lords, we are closely following events connected to the detention of former President Saakashvili. The former Minister for Europe, Wendy Morton, raised Mr Saakashvili’s detention with the Georgian Ambassador on 15 December, highlighting concerns about his health and treatment. Our ambassador and other officials have raised Mr Saakashvili’s case at senior levels in Tbilisi, including with the Deputy Foreign Minister and the Speaker of Georgia’s parliament. We will continue to monitor developments regarding this case.
I thank the Minister for his reply. Under Mr Saakashvili’s presidency, Georgia flourished economically. He took significant steps to eliminate corruption and when he lost power in 2013, he transferred power peacefully, the first ever peaceful transition of power in Georgia. Since then he has been stripped of his citizenship and put in prison on trumped-up charges in what Amnesty International describes as apparent political revenge. I pass all this on to the Minister, but my question focuses simply on his imprisonment. Yesterday I received a letter from him, smuggled out of prison, in which he talks about being denied private communication with his lawyers and being repeatedly assaulted by prison officials. Will Her Majesty’s Government protest most strongly to the Georgian Government about this and ask that our own ambassador might visit him in prison?
My Lords, I thank the noble and right reverend Lord for providing that additional information. I will of course take that forward and pass it to both our team here in London and our ambassador on the ground in Tbilisi. On the issue of Mr Saakashvili’s continued detention, we are urging the Georgian Government to ensure the fair treatment of the former president. We welcome recent steps to facilitate medical care for Mr Saakashvili and to accord him the right to due process in legal proceedings. I share the noble and right reverend Lord’s view of Mr Saakashvili’s tenure. Of course, when he returned in October he did so willingly and was at that time taken into custody. I will certainly take forward, as the noble and right reverend Lord suggests, any further action on the additional information that he provides.

Lords ChamberTo ask Her Majesty’s Government what representations they have made to the government of India about the blocking of overseas funds for the Missionaries of Charity and other non-governmental organisations.
My Lords, we are aware of some non-governmental organisations that face difficulties in India due to the use of the Foreign Contribution Regulation Act by the Indian Government, and that some have recently had applications to renew their foreign funding licences rejected. We support a wide range of local NGO partners in India, including through programmes directly. A vibrant civil society is central to any democracy. Officials have discussed issues facing NGOs with the Indian Government, and the British high commission in New Delhi will continue to monitor developments in this respect.
I thank the Minister for his reply. The work of Mother Theresa and the charity she founded, the Missionaries of Charity, is renowned throughout the world. It works among some of the poorest and most destitute people on earth. What possible reason could the Indian Government have for wanting to hinder and block its work? The rumour, I am afraid, is that it is continuing pressure from Hindu nationalism, because people might come into contact with Christianity and eventually convert to it. We need to know from the Indian Government precisely, in writing, what their reasons are so that we can examine the validity of their reasoning.
My Lords, first, I share the noble and right reverend Lord’s view on the important work the Missionaries of Charity has done among particularly vulnerable populations within India. On the issue of the licence in India, I have looked into this specifically, and we do not know why its applications were rejected. I have asked and pressed to see the kinds of numbers that currently exist. Among the 12,580 organisations whose licences have ceased to exist, some ceased to exist because they did not submit their applications in time, and others were rejected for other reasons. There are Christian NGOs, but there are also 250 Hindu NGOs and more than 250 Muslim NGOs, so whether this is specifically against Christian organisations is not shown by the data, but I am requesting further information in this respect.

Lords ChamberTo ask Her Majesty’s Government what progress they have made towards their commitments to providing (1) health services, (2) water and sanitation, and (3) access to justice, for marginalised communities in Nepal, including Dalits and Adivasis.
My Lords, the UK targets our development support at the most marginalised communities in Nepal, including Dalits, Adivasis, Janajatis and people with disabilities. The United Kingdom provides significant support to the Ministry of Health to strengthen systems and ensure universal health coverage, particularly for the most vulnerable. We provide £45.5 million in targeted security and justice assistance, and in 2021 we also repurposed our support to ensure that water, sanitation and health facilities reached 400,000 people, prioritising the most vulnerable in light of Covid.
I thank the Minister for his reply. The Dalits and Adivasis comprise about 14% of the population of Nepal, and they suffer the same kind of extensive humiliations as they do anywhere. In theory, the constitution acknowledges the rights of Dalits, but nobody has yet been appointed to the National Dalit Commission that was set up, and although a National Human Rights Commission has been set up, there are no representatives from the Dalit communities. Will he please press the Government on these issues?
My Lords, I pay tribute to the noble and right reverend Lord’s work in his role as chair of the APPG for Dalits. I think there are some encouraging signs from Nepal. He will be aware that in 2017, when local elections took place, about 22% of those elected to official local government positions were from the Dalit communities, so there is some progress. But he makes a very valid point and of course we will continue to lobby on strengthening human rights, not just for the Dalit communities but for all vulnerable communities in Nepal.

Lords ChamberWhat the report confirms is utterly shocking in its scale and the systematic nature of the abuses perpetuated. Of course, the question is: what can we do about it and what are the Government doing about it? Will they at least contemplate economic sanctions against mid-ranking officials, such as the governors of the areas in which the internment camps are situated?
My Lords, on sanctions specifically, we keep the whole situation under review. As the noble and right reverend Lord and your Lordships’ House will be aware, on 22 March, under the global human rights sanctions regime, we introduced asset freezes and travel bans on four senior Chinese government officials, as well as an asset freeze against the public security bureau in Xinjiang. We will continue to see the impact of these sanctions and will review future sanctions as the need arises.

Lords ChamberMy Lords, I note what my noble friend has said, and my colleague Minister Morton has been working on this agenda. However, very much the first priority is to ensure that the Minsk process, which has been agreed by both sides, is strengthened further. We are certainly lending support to ensure that all aspects of this conflict can be resolved through that mechanism.
As the Minister knows, allegations of war crimes have been made by both main parties to the dispute. What steps have Her Majesty’s Government taken to ensure that those are subject to proper international—not just local—examination, and, if proven, to prosecution?
My Lords, again, the noble and right reverend Lord raises an important point. Certainly, exactly those points have been pushed through the various engagements we have had with both sides, and indeed by those working on the peace deal more specifically, including our colleagues in Russia, the United States and France. The issue of holding to account those responsible for such actions is a key priority and both sides should seek to co-operate fully.

Lords ChamberOn the specific definition of genocide, my response and those of other Ministers are well documented. But I recognise the description that the noble Lord gave us all of the situation in Xinjiang, and I stand by the fact that the human rights abuses that we have seen, and which he described, are why we are acting with partners today.
I welcome the strong Statement and the actions that are to follow from it, but will the Government act with consistency and similar firmness in relation to other countries where human rights are grossly violated? I could mention a number, but I shall mention one that gets almost no publicity: the continuing atrocities and ethnic cleansing in West Papua. For example, the retired General Hendropriyono, the former head of Indonesian intelligence—the BIN—has called for 2 million West Papuans to be forcibly removed from their homes and relocated elsewhere in Indonesia. I know that the Government repeatedly condemn such actions, but will they go further, be consistent and impose sanctions on him and others involved in what is, in effect, an attempt to destroy a whole people and its culture?
Again, as the noble and right reverend Lord acknowledged, the Government have rightly consistently called out human rights abuses, not just in the situation he described but elsewhere in the world. On sanctions specifically, as I have indicated, a process is followed to ensure that the sanctions we impose are evidence-based and robust. We will continue to act. We do not shy away. Many rightly challenged us for a number of months that we were not acting on sanctioning figures from China. We have done so, and China is a major world power. We have not shied away from our moral responsibility in this respect. The fact that we have acted with 30 other countries demonstrates the will of the international community.

Lords ChamberMy noble friend raises an important point about transparency in development spending. That is why the new structure at the FCDO will pursue that very point, ensuring that development support is intended for those who are suffering, and gets directly to them.
In answer to the question asked by the noble Baroness, Lady Northover, the Minister said that the Government were in touch with France and Germany. Are the Government in touch with any power in the region itself that might be an influence for good, and what response have they had from the African Union about the role that it might play?
Let me assure the noble and right reverend Lord that yes, we are in touch with some of the countries I have already listed, such as Kenya, Uganda, Somalia and South Africa. We are dealing with those countries in the region at the most senior levels of government.

Lords ChamberOne of the great and obvious advantages of our parliamentary system is the scrutiny that the noble Lord alludes to, and I am sure that that will continue through Statements, Questions, Urgent Questions and so on. However, I assure him that, not just through the creation of the new department but through the integrated review, our international capabilities will be very much aligned through the FCDO and the Ministry of Defence.
On 16 June, the Prime Minister said that the guiding principle of the new department would be promoting the UK’s national interest overseas. Does the Minister agree that, at least in theory, there could be the possibility of a clash between promoting that national interest—for example, by supporting a prestigious project which has been much wanted by the beneficiary Government—and supporting the most vulnerable communities in that country? If there is the possibility of this clash, what monitoring process will be in place to really ensure that those most vulnerable communities are not pushed aside?
My Lords, the noble and right reverend Lord has talked to two sides of the same coin. I think that our national interest reflects the importance of investing in the interests of the most vulnerable communities, of looking at responding to humanitarian challenges as we see them, and of alleviating poverty and famine. Those will very much remain priorities for this new department.

Lords ChamberTo ask Her Majesty’s Government how the merger of the Foreign and Commonwealth Office and the Department for International Development will enhance the United Kingdom’s ability to help (1) the poorest, and (2) the most vulnerable, communities abroad.
My Lords, the new FCDO will be a force for good in the world. Building shared global prosperity, eradicating poverty, tackling climate change, strengthening the international rule of law and global security and promoting free, open societies are all in our national interest. Development will remain central to the new department’s mission. Our commitment to spending 0.7% of our national income on aid is enshrined in law.
I thank the Minister for his Answer. Given that the Prime Minister has said promoting the UK’s national interest is at the heart of the new department, does the Minister agree that there is a possibility of real clashes between projects that directly support the nation’s interests and those that might do so in a rather more indirect way? For example, there might be a choice between a big, grandiose project supported by the recipient Government on the one hand and supporting poorer and more vulnerable communities, which supports the UK’s national interests only in a rather indirect way. What mechanism will there be in the new department to ensure that the voices of the poorest and most vulnerable communities are heard when these kinds of clashes arise?
My Lords, my right honourable friend the Prime Minister has made absolutely clear that alleviating poverty and responding to humanitarian crises remains a priority programme in the new FCDO.

Lords ChamberTo ask Her Majesty’s Government what plans they have to report annually to Parliament on the operation of the Global Human Rights Sanctions Regime, including the details of those subject to that Regime.
My Lords, as required by Sections 30 and 32 of the sanctions Act, we will report annually to Parliament on all sanctions regulations. This year’s Section 32 report, which focuses on sanctions for human rights purposes, will be laid shortly. We will also publish a list of names of those subject to UK-autonomous sanctions. This has been updated with the names of those designated on 6 July under the global human rights sanctions regime.
I thank the Minister for his Answer and, like other noble Lords yesterday, I warmly congratulate the Government on this hugely significant step, which is a flare of light in the continuing darkness of human rights abuses. It was good to hear that the Government are to report annually to Parliament. Given the Minister’s well-known and serious commitment to this area, and the fact that in the House of Lords, in particular, there is widespread concern about this issue, can he give any kind of indication as to when the earliest opportunity might present itself for us to engage with him on this issue?
My Lords, within the sanctions Act there are provisions stating that after the laying of these final designations, which was on 6 July, there is a period of 28 sitting days during which the debate would take place in Parliament. I think that we will seek, through the usual channels, to have an early debate when we return in September.

Lords ChamberMy Lords, let me assure my noble friend that we take our role as part of the UN Command very seriously. Most recently on the specific issue of deployment and support, the Royal Navy deployed ships to the north-east Asia region in 2018, through HMS “Sutherland” and “Albion”, and in 2019, as my noble friend may be aware, through HMS “Enterprise”.
The APPG on North Korea would particularly like to ask the Minister about two issues. First, what assessment has been made by our ambassador in Pyongyang of the widespread reports of food insecurity, even famine? Secondly, is anything known about the size of any listening audience to the BBC World Service’s Korean service and whether it is in fact helping to break the information block?
My Lords, I will write to the noble and right reverend Lord on his second question. On his earlier question, we retain a mission, of course, but as he may be aware, we drew that down due to concerns around the Covid pandemic; we are working to restore the ambassador to North Korea at the earliest opportunity. As I said in response to an earlier question, the situation on the humanitarian front remains very dire within North Korea.

Lords ChamberTo ask Her Majesty’s Government what steps they are taking in response to Open Doors’ 2019 World Watch List of the 50 countries where Christians face the greatest persecution.
My Lords, the Government are deeply concerned about the severity of violations of the freedom of religion or belief in many parts of the world. We regularly raise our concerns at ministerial and senior levels. To ensure that the United Kingdom is supporting Christians in the best possible way, my right honourable friend the Foreign Secretary has commissioned an independent global review into additional practical steps the Government can take to support persecuted Christians. The aim is for this review to make an initial report by Easter.
I thank the Minister for his reply and I very much welcome what the Government are doing, particularly through the Foreign Secretary. The right of people to freedom of religion or belief is absolutely fundamental, whether they are Muslim, Hindu or atheist, but does the Minister not agree that there is a particular crisis affecting Christians at the moment, with the number of countries in which Christians are suffering persecution at a very high level, having doubled in the past year? Does he not agree that it is particularly dismaying that India should now appear at number 10 on this list, just below Iran and above Syria? India has a very good constitution and sound laws, but because of the rise of nationalism, these laws are simply not being enforced. Will he convey to the Indian Government our deep dismay that India should appear on this list at all, let alone at number 10?
My Lords, I agree with the noble and right reverend Lord on the issue of persecuted Christians. Around the world today 245 million Christians in 50 countries have been identified as suffering persecution of varying levels. As the noble and right reverend Lord said, that has doubled over the last four or five years. Clearly, action is needed. This does not preclude the fact that we will continue our efforts, and it is right that we stand up for all persecuted communities around the world, including those of no faith. He mentioned India specifically. India is the largest democracy and has an inherent, vibrant and strong rule of law. I assure noble Lords that we will continue to make representations to all countries, including India, to ensure that equality and justice for all citizens in India are upheld according to its own constitution.
