Lords ChamberMy Lords, I too add my thanks to the noble Lord, Lord Alton, for bringing this debate and for his speech. I am not going to explore the legal implications, but want to make a few theological points, if I may. I want to comment on the origins of the spring from which these ideas first came, how it developed into a stream and then a river, and how still today our understanding of rights and responsibilities is developing.
The noble Lord, Lord Lilley, is right. It goes back to those early chapters of Genesis. In fact, you could go back to the Code of Hammurabi, 1,700 years before Christ, but let us go back to the Ten Commandments, where we find the creation narratives where humankind is created in God’s image. It is about the inherent dignity that belongs to each and every person, not dependent on sex, wealth, education or any other differentiation. This is implied in the Ten Commandments and is developed further in passages such as Deuteronomy 10, where God defends the cause of the fatherless and the widow and loves the stranger in the land. It is why the prophet Isaiah urges the people of God to seek justice, correct oppression, defend the fatherless and plead for the widow.
However, as Jonathan Sacks, a former Member of your Lordships’ House, was keen to point out, rights are things we claim and duties are things we perform. In other words, duties, he said, are rights translated from the passive to the active mode. The biblical teaching in the New Testament reaches its fullest expression in this reciprocity in human relating, expressed by Jesus in this way: love the lord your God with all your heart, soul and mind, and love your neighbour as yourself.
Nowhere in the scriptures do we find the phrase human rights—and certainly no reference to the ECHR. Indeed, some theologians, such as the eminent Alasdair MacIntyre, have argued that human rights are actually a fiction; he simply did not agree with them as a concept. Others, including a former Member of this House, Lord Williams of Oystermouth, disagreed, saying that the fundamental theological point
“is not so much that every person has a specific set of positive claims to be enforced, but that persons and minority groups of persons need to be recognized as belonging to the same moral and civic world as the majority, whatever differences or disagreements there may be”.
He went on to argue that
“a proper consideration of human rights has a better chance of sustaining its case if it begins from the recognition of a common dignity or worthiness of respect among members of a community than if it assumes some comprehensive catalogue of claims that might be enforceable”.
All laws and all conventions are ultimately human constructs. There are some who dislike the ECHR and have problems with the wider issue of human rights. There are people who are not happy with the way that the court has interpreted the underlying legal principles which are enshrined in the convention. But the huge benefits that it has brought to so many people, particularly people who have traditionally been marginalised and not given the ability to participate and to engage, surely outweighs the frustrations that people sometimes feel. I, for one, am thankful that we have the ECHR.

Lords ChamberThat is not a decision that this Government made. Looking back, it was a mistake to put that burden entirely on the licence fee payer. We are looking at long-term solutions and we are open-minded about what they might be, but I repeat: the important thing is that we preserve all that is good that the World Service does for us around the world, but it needs to be on a much more secure footing so that we do not have the annual discussions we have had to have. It needs to plan, and it needs security to enable it to continue to do the amazing work it does.
My Lords, there is a tension here between having an independent BBC, which we are all grateful for—indeed, that is part of its integrity—and it being part of our strategic soft power. Could the noble Baroness tell us a little bit more about the strategic approach His Majesty’s Government are taking to thinking about the key places we need to engage with, not least in countering the deliberate disinformation coming from China and Russia, which is fundamental to the future of our democracies?
It is vital that we maintain the independent position the BBC has, so that it makes its own decisions. However, this Government want to refresh the approach to soft power. We are establishing a soft power council, in which I hope the World Service will take part. From my point of view, it is absolutely legitimate for the Government to say that we are worried about these circumstances in these places and to share our understanding of situations around the world, and it is for the BBC to tell us to back off and to make its own decisions. My aim is to have a collaborative, respectful relationship with the BBC, preserving at all times its independence and ability to make its own choices.

Lords ChamberTo ask His Majesty’s Government (1) what representations they are making to the Government of Israel in light of a potential new offensive by Israeli forces, and (2) what humanitarian aid and support of essential services they plan to provide to the region.
My Lords, we want an end to the fighting as soon as possible. Well over six months since Hamas’s terror attack against Israel, it is appalling that hostages are still being held. Too many civilians are also dying in Gaza, and this weekend Hamas rockets killed four IDF soldiers and injured others. As we have said, the fastest way to end the conflict is to secure a deal which gets the hostages out and allows for a pause in the fighting in Gaza. It is then that we must turn that pause into a sustainable, permanent ceasefire.
Regarding the situation in Rafah, our position has been consistent. We are deeply concerned about the prospect of a military incursion, given the number of civilians sheltering there and its importance for delivering aid. It and other crossing points, including Kerem Shalom, must be reopened quickly to allow essential aid in. Israel must facilitate immediate, uninterrupted humanitarian access in the south, including for the entry of fuel, and ensure the protection of civilians and safe passage for those who wish to leave Rafah. As yet, we have not seen a credible plan to protect civilians.
We are following closely the latest developments around hostage talks and, at this stage, while events are still shifting quickly, we will not provide a detailed running commentary. As the Foreign Secretary has said, we want a deal agreed that will ensure the release of hostages and a pause in fighting. A generous offer was on the table last week, proposed by Egypt and accepted by Israel. We need now to see Hamas also accept the viable deal so that we can start building the momentum towards a permanent, sustained ceasefire. In parallel, we will continue to push as hard as we can to get much-needed aid into Gaza via vital land routes alongside sea and air to alleviate the suffering. Israel has now committed to significant steps to increase the amount of aid getting into Gaza. We now need to see this turned into action to ensure that aid actually gets over the border and is safely and properly distributed. I—
I thank the Minister for his reply. My concern is with the immediate humanitarian crisis facing civilians in the Gaza Strip, with Israeli forces now in control of the southern border crossing. What representations have His Majesty’s Government made about getting more fuel, food supplies and medicines in? Are there any other avenues by which we can get aid into the country to alleviate the immediate suffering?
My Lords, I seek the House’s indulgence. The reason my Answer was slightly more lengthy is that it has been a very long working weekend on this and I wanted to give details. In answer directly to the right reverend Prelate, I say that we are imploring Israel to ensure that the crossings that were shut are opened immediately, including in Rafah. Noble Lords will know that the southern border on the Palestinian side is currently controlled by the IDF. My noble friend Lord Cameron had a conversation with the President of Israel this morning, and just a little while ago I also had a conversation with the chief negotiator of Qatar.

Lords ChamberMy Lords, I reiterate that I believe it is a vital service. When we use the term soft power, we are talking about different services that the United Kingdom offers to the world and the tools that are available. Of those, the BBC World Service provides exceptional news information. I know that in the case of the Hindi language, the World Service is one of the most effective and listened to channels in India. The noble Lord is right that the Government provided exceptional funding of £4.1 million, and my noble friend alluded earlier to the additional support we have provided to Ukraine in its fight against the illegal war Russia has waged on it. We will continue to see what tools are available to us, and we will work to ensure that the BBC World Service, along with a range of other soft power tools, is utilised effectively. I agree with the noble Lord that it is particularly effective in conflict situations.
My Lords, I notice that the funding agreement with the FCDO runs only until April 2025, which is not very far ahead. Can the Minister tell us whether the Government are considering, at the very least, taking back full funding of the World Service in the longer term rather than leaving it to the licence fee?
My Lords, I hear clearly the proposal from the right reverend Prelate, which has also been suggested by the director-general. I accept the premise of his question; that model existed until 2014. It is important that we make full leverage of funding. It is a challenging fiscal environment, but the Government have demonstrably shown that when we need to provide additional funding to the BBC World Service, we do so. The funding review being undertaken by the DCMS provides an opportunity to look specifically at the funding of the World Service.

Lords ChamberTo ask the Secretary of State for Foreign, Commonwealth and Development Affairs what steps he is taking to address the Rohingya Refugee crisis.
My Lords, since 2017, we have provided more than £373 million in funding for Rohingya refugees in Bangladesh and more than £30 million for Rohingya and other Muslim minorities in Myanmar. In December, at the Global Refugee Forum, we announced an additional £7 million for Rohingya refugees in Bangladesh and for the Myanmar humanitarian crisis. We also reiterated our commitment to finding a long-term solution to the crisis, including the safe, voluntary and dignified return of the Rohingya to Myanmar when conditions there allow.
My Lords, I am grateful for all that His Majesty’s Government have been doing to support the victims of this terrible humanitarian crisis. However, UK aid to the Rohingya refugees in Bangladesh has actually declined by about 82% since 2019-20. In the past year, Rohingya refugees in Bangladesh have suffered flooding, cyclones and fires, and cuts in food rations, simply because of reductions in aid. Just two weeks ago, 800 dwellings in Cox’s Bazar were destroyed by a fire. In the light of this terrible humanitarian crisis that we are observing, what other resources can His Majesty’s Government offer to try to address this dreadful problem?
The right reverend Prelate is entirely right about the scale of this crisis. There are 1 million Rohingya refugees in Bangladesh—think of the scale of that—with people often living in IDP camps and other temporary accommodation. I do not deny for a moment that the scale of funding has gone down. That is the same with many aid programmes, because of the move from 0.7% to 0.5%. Crucially, it is due also to the diversion of a lot of aid money to support refugees from Ukraine and Afghanistan, which I think was entirely the right thing to do. We will be spending another £20 million next year. To put it in context, Britain’s contribution has been almost twice as much as the EU’s over the past seven years. We are playing our role to make sure that this is not the forgotten crisis.

Lords ChamberI pay enormous tribute to the noble Baroness for her work. The answer to her latter question is that we have consular staff attending the court daily and they are reporting back on the proceedings. She is right that it is a sham trial and that we need to make sure that we are raising this issue on every occasion possible. We are working with teams of expert lawyers, both nationally and internationally, and we are supporting Jimmy Lai in any way we can. The Foreign Secretary’s response was very robust and clear. This will continue to be raised at the highest level, as it has been recently, in bilateral meetings with the Chinese Government.
My Lords, I too congratulate the Foreign Secretary on a much more robust approach. This is not happening only in Hong Kong; it is part of a much wider movement right across China, where not only human rights but religious rights are being denied. Churches are being knocked down, pastors are being arrested and, most notoriously of all, there is, many people would argue, a genocide of the Uighur people. What are we doing with our colleagues internationally to press China on these rights in a consistent, long-term way that is backed up by sanctions?
I thank the right reverend Prelate. The Sino-British joint declaration is an internationally registered, legally binding treaty between the UK and China, under which China committed to uphold Hong Kong’s high degree of autonomy and to protect the rights and freedoms of its people. This explicitly includes freedom of expression and freedom of religion or belief; that is why we need to make sure that this declaration is upheld.

Lords ChamberOn the noble Lord’s last question, I think I have answered that. Of course, I will not speculate on what actions we may or may not take but my noble friend the Foreign Secretary’s statements on the issue of accountability have been very clear. On humanitarian support, the noble Lord will also recognise that we have increased our support, particularly through UNRWA, and we are working directly with those on the ground, including international agencies. Our current support is now up to £60 million, and we will continue to review what further support is needed. We are working directly not just with other UN agencies but with those on the ground, including key partners such as Egypt—Qatar also has an active operation—to ensure that we get the right support through to the right people.
On the issue of people within Gaza being displaced, I of course note what the noble Lord said. I agree with him, and that is why we have made it very clear that safe zones and protected areas is a key question for Israel to answer. We have seen in history that safe zones are not something that the UK has supported, nor continues to. We need a sustainable sense of these hostilities coming to an end—the creation of those conditions —and we are working to that end.
My Lords, the Office of the Prosecutor of the ICC has called for the collection of evidence where there are alleged violations of international law. What are His Majesty’s Government doing to help with the collection of any such evidence?
My Lords, I am aware of the prosecutor’s visit to both Ramallah and Israel. We are strong supporters of the International Criminal Court. He will make his appropriate determinations, and it is important we allow him the space and opportunity to do his job effectively.

Lords ChamberI thank the noble Lord for his question. It is an extremely important point, and it is one of the things that I have looked at since taking office. I am going to Washington this week and will be discussing that specific point with my counterparts in the United States. To me, it is clear that this is confiscated money; it should be taken away from the Russians who possess it and should be used as a downpayment now—instead, as it were, of reparations coming later. Of course, there are all sorts of legal concerns and all sorts of concerns about precedent and chilling effects on investment and the rest of it. But I am with the noble Lord on the moral and emotional stance—that this is the right thing to do. Let us see if we can get it done.
My Lords, could the Minister comment on his department’s assessment of reports that not only has Turkey vastly increased its trade with Russia but that Turkish ports are being used for arms smuggling and, in some cases, exporting dual-purpose goods into Russia, thereby helping Russia? I wonder what the assessment is, and what we might be able to do about that.
I thank the right reverend Prelate for his question. He is absolutely right: one thing that we have to do is to look right across the world at where there is potential for countries exporting dual-use goods and other goods of concern to Russia so they can build more weapons and drones and all the rest of it. He is absolutely right that there are concerns about Turkey, and I raised those specifically with the Turkish Foreign Minister when I met him recently at the NATO conference. There are also concerns about other countries, and I can tell him and all noble Lords that we are going though it country by country and concern by concern, trying to track down where those dual-use goods are coming from and trying to take the appropriate measures, including sanctions, when necessary.

Lords ChamberWe constantly look over the horizon to make sure that we factor in important phenomena such as climate change and the extreme weather events we are seeing. The National Audit Office has reduced that figure principally because of the inflationary effect on the cost of building concrete and steel defences. Of course, that is only part of it; nature-based solutions are now becoming a key part of our defences. I really question the Unearthed data. The Environment Agency puts all defences in a category from 1 to 5. If it is a category 4, meaning that it is not where you want it to be, it still functions in the main. When we know that a flood is coming, a minor change can be made. That was an unfair description by Unearthed; the figure of 94% to 95% of our assets being in good condition is worthy of comment.
My Lords, more than half of Britain’s best farmland is on flood plains. Farmers are providing a public service by protecting towns and cities from flooding, but this means that they incur costs. What are His Majesty’s Government doing to ensure that farmers are adequately recompensed for this public service that they provide for our nation?
The right reverend Prelate is correct. Farmers can enter into some agri-environment schemes, which, as we know, are now targeted on public goods. One of those is protecting the public from flooding so, if farmers are holding flood-water on their land, they should be rewarded for it. They can also access the farming recovery fund, which provides assistance to farmers whose agricultural land has been damaged by flooding and declared a natural disaster by the Government. We provide financial assistance up to 100%, with a minimum grant level of £500 and a maximum of £25,000; that has been accessed in some extreme flooding conditions.

Lords ChamberTo ask His Majesty’s Government (1) what assessment they have made of recent developments at the Zaporizhzhia Nuclear Power Plant and (2) what contingency plans are being made in the event of the power plant being damaged.
My Lords, we remain gravely concerned about the implications of Russia’s illegal invasion of Ukraine for nuclear safety, security and safeguards. We take President Zelensky’s concern about possible Russian threats to the Zaporizhzhia nuclear plant, which is currently under illegal Russian control, extremely seriously. We are in regular contact with Director-General Grossi of the International Atomic Energy Agency and with the highest levels of the Government of Ukraine regarding the situation at the nuclear power plant. Working with our international partners, we continue to call for Russia to grant the IAEA full access to the nuclear plant, as called for by Director-General Grossi on 5 July. It is vital that IAEA staff have full access to the nuclear plant in order to monitor the safety and security of the site. Let me assure the right reverend Prelate that the Government also have well-developed and tested contingency plans to cover a range of eventualities.
I thank the Minister for his reply. Obviously, anything we can do to work with our international partners to put pressure on Russia to allow the IAEA access to the site, as it has requested, is now of utmost importance. I hope that the Minister will do all he can in talks with our international partners to put that pressure on Russia. Can he give any more information about our own domestic contingency plans, in the event of a nuclear disaster of some sort taking place on the site?
My Lords, first, as the right reverend Prelate may be aware, much of the site has been scaled down, in terms of its direct energy provision. There is currently only one operating generator on the site, and even that has been scaled down sufficiently and specifically for this purpose. Of course, the risk remains very high, but we have been assured by the IAEA that there is no immediate threat. I caveat that by saying that Director-General Grossi’s requirements and requests for full access to the site are important, and we are working through those with international partners, including countries with key influence over Russia, because that is vital in order to reassure people not only in Ukraine, but across the wider area and region.
