My Lords, last week in the other place the Department for Transport said that the contract tenders for refurbishing existing trains would be brought forward very soon. Time is short for Alstom, the only end-to-end manufacturing facility in the UK. Can the Minister give any assurances about how soon these contracts will be brought forward, because the days are now being counted down?

My Lords, I pray for the indulgence of the House to speak very briefly in the gap. I apologise that I just missed the deadline to get my name down. Speaking so late, I find that many of the points have been made very eloquently so I have been putting lines through various paragraphs. I will be very succinct. I need to declare my interests because I want to refer to some of the Church Commissioners’ properties in London and the reports that have come from tenants and also to my role as a vice-president of the LGA.

We welcome this Bill. We think it needs a fair bit of work, and there are a number of issues that need to be resolved. I agree that for many people pedicabs are a cause for fun, not least for tourists, but the Church Commissioners, being one of the local landlords in London, have received many complaints from local people affected by unregulated pedicabs. We have listed some of them: playing loud music at night; causing local traffic congestion; charging extortionate prices; blocking pavements; sometimes blocking cycle lanes, which is a real problem and causes real danger to cyclists who are going to and from work; and, not least, their lack of insurance, so many passengers and other users are left without protection.

The Church Commissioners’ Hyde Park Estate stretches from Oxford Street to Paddington so, as a local landowner, we have an interest in ensuring that central London remains a welcome and safe area. It is therefore very encouraging to see the powers that the Bill would provide by enabling Transport for London to regulate pedicabs, ensuring they are properly licensed and that there are enforceable standards which operators, drivers and vehicles must adhere to.

In passing, I have to say that I was fascinated by the spirited speech of the noble Lord, Lord Blencathra, and look forward to the amendments for e-scooters and e-bikes that we will be debating in Committee and later on. Meanwhile, we would want to support the Bill in its passage through your Lordships’ House.

My Lords, I thank the noble Lord, Lord Berkeley, for securing this debate. It is a vital area for us. Those of us who live in the south-east of England are aware of the huge strains that are being put on ordinary people’s lives day by day, and on our businesses, through the problems with our transport system, not least with public transport.

I am also aware that this matter touches so many other areas of concern at the moment, such as our desire to work for a net-zero carbon future and the question of how we can get people off the roads as much as possible and on to good, fast, efficient public transport. I am aware that this means having a long-term policy on active transport; we need to work out how to get a sea change in what we expect and what we can offer. I was therefore pleased to hear the announcement by His Majesty’s Government of the provision of additional funding for transport in the recently published Statement. However, as has already been pointed out, it raises an awful lot of questions, not just about what was in it but what was not in it.

I declare my interest as president of the Rural Coalition. I want to focus my comments mainly on the rural dimension of public transport policy. Nearly 10 million of this country’s 67 million people live in rural areas—one in six of us. Sadly, there was little in the Government’s announcement to bring cheer to rural inhabitants. I and others who care about rurality and the long-term sustainability of the countryside entirely accept that we cannot expect anything like the levels of public transport and roads that our urban colleagues take for granted.

However, it is deeply disappointing that the recent Statement made no specific mention of buses and bus routes, as the noble Lord, Lord Berkeley, pointed out. In my diocese of St Albans—which is, compared with many shire counties, not that rural; by and large, we have large villages and are pretty much a commuter county—buses provide a vital lifeline to rural communities, especially for those on low incomes, pensioners and those with disabilities who cannot drive themselves or afford disabled-friendly vehicles. Therefore, such people are almost entirely reliant on rural bus routes to carry out their daily activities. According to Age UK, one in three older households in rural areas have no access to a vehicle, leaving them entirely reliant on bus routes or expensive taxis—if they can get a taxi. We moan in our urban areas that it is sometimes difficult to get a taxi; it is much worse in rural areas where, sometimes, there simply is no taxi available.

These bus routes continue to be relied on by our rural communities, with statistics showing that over a quarter of bus passenger journeys in England outside London are made in rural areas. It is therefore very concerning to see the steady reduction in rural bus services. Since 2017, there has been a 56.5% reduction in bus mileage in Hertfordshire, and many of our “lifeline” routes such as the 84 service between Potters Bar and New Barnet have been phased out and only partially replaced.

Funding for rural transport has long been an issue. Most rural bus routes are not commercially viable if it is simply left to the market. They tend to be used by fewer people and to involve much longer journeys. They are not sustainable without local government support. Further, as noted by the Government’s Statement, the pandemic has, certainly in the short and medium term, reduced the number of passengers hugely. The problem with cutting bus services is that the chance of rebuilding them as we try to emerge into whatever new society we are to have will be difficult; it is more or less being forced on people.

I am grateful that His Majesty’s Government have been funding the £2 cap on bus fares in England; I note that this was extended for a further three months recently, and for that we are grateful. However, as transport economists have been quick to point out, if and when the subsidies come to an end or are removed, it is likely that hundreds of rural bus services will be cut.

One of the major concerns for rural areas is the Government’s Bus Back Better strategy, which requires that local authorities develop a local bus service improvement plan and apply for funding. Of the 79 local authorities that submitted those improvement plans in 2021-22, only 31 are set to receive central government funding to deliver their plans. The Campaign for Better Transport has highlighted that this strategy leaves out rural authorities, which have often much smaller transport teams and advisers and simply lack the resources and expertise to successfully apply for and win government funding. That is an extraordinary irony, whereby the communities most in need of government support do not have the capacity or the skills to apply for it, with some notable exceptions.

Good public transport networks are vital to all communities. As we are trying to work out a long-term strategy for sustainable rural communities, we need those networks to allow people to connect to their workplaces, families, local shops, doctors’ surgeries and so on. A report by KPMG estimated that for every £1 invested into local communities for bus networks, you could expect to see an economic return of £4.48. Therefore, I conclude by asking the Minister: what steps will His Majesty’s Government take to ensure that rural authorities are not left out of the local bus improvement plan funding in future?

My Lords, I declare my interests as president of the Rural Coalition and a vice-president of the Local Government Association. I, too, welcome Her Majesty’s Speech and the Government’s commitment to implementing the levelling- up agenda; although, as other noble Lords have, I note the Secretary of State’s comments about the difficulties of levelling up in a period of high inflation.

The scope of the Government’s 12 levelling-up missions is ambitious, but they now need to be accompanied by a determination to deliver them, which will be costly. Cautious as the Government may be about fulfilling these mission statements, expectations are high among those in left-behind communities, even if, to date, some of the most deprived areas are still not receiving the funding that they had hoped for and expected. The BBC programme has been referenced by others; it was telling when we looked at how the money has so far been allocated.

To strike a more positive note, the initial content that we know will feature in the Levelling-up and Regeneration Bill with respect to local high streets and empty retail units is welcome. However, notably absent from the White Paper was any mention of delivering prosperity or growth to rural communities, which is what I want to concentrate on for the rest of my speech.

The shared prosperity fund certainly has great potential to help to level up rural Britain by investing in local communities. However, money alone will not close the 18% productivity gap that currently exists between urban and rural locations or achieve the mission statements of the levelling-up agenda. I am thinking particularly of mission 1, to close the productivity gap; mission 2, to increase research and development; and mission 5. There is also a lack of any talk about buses, which are absolutely fundamental in rural areas—anyone working in a rural area knows that they are vital. A comprehensive rural strategy is absolutely essential.

I was pleased by the announcement that legislation will be brought forward to encourage the domestic agricultural and scientific innovation required to unlock the future of sustainable and efficient farming. In my opinion, this has the real potential to revitalise the rural economy and promote our rural localities as scientific hubs at the cutting edge of agricultural experimentation. We have so much to be proud of in this country. We are right at the forefront of some of the most exciting agricultural initiatives, and we do not do enough to showcase these around the world.

However, to turn this ambition into reality, alongside the wider mission statements of the levelling-up programme the Government will have to reverse the brain drain affecting rural areas. If rural localities are to attract the talent required to close the productivity gap and turn themselves into scientific hubs, questions of affordability and connectivity will have to be tackled. Despite rural wages lagging behind their urban counter- parts, England is the only OECD country where it is more expensive to live in a rural area.

Poor digital connectivity is an important factor in deciding where people locate and a major impediment to businesses and individuals thriving in our 21st-century rural economy. The fact that the gigabit digital rollout will cover only 85% of the country by 2025 could be a stumbling block to closing that £43 billion productivity gap. Hopefully, the desire on the Government’s part to meet their own levelling-up missions will spur them on to expedite the rollout for the remaining 15% by 2030 at a minimum, but hopefully long before.

Rural communities need tailored policies to build more affordable houses that chime with their needs, values and design, along with the creation of well-linked business hubs. I commend to your Lordships’ House the recent report by the APPG for Rural Business and the Rural Powerhouse on levelling up the rural economy in achieving the twin pillars of connectivity and affordability needed to facilitate a thriving business and innovation environment.

The Government’s priorities to strengthen the economy and ease the cost of living for families are the right ones at the right time, but we need them to be bedded into the rural as well as the urban.

The Government obviously looked at their own advice and that from the Joint Biosecurity Centre, but it is the case that Norway has pretty much the same requirements as the UK. Belgium, France and, I understand, Germany have also put in place some restrictions on all or parts of Spain.

My Lords, it is not only holidaymakers and travel firms that are suffering. Luton Borough Council, in my diocese, owns Luton Airport. As a result of the lockdown, it has a significant hole in its finances, affecting every person living in the borough. It is surely in the interest of every country to find a better way to provide travel corridors based on regions rather than simply designating entire countries. What consideration are Her Majesty’s Government giving to the idea of having regional travel corridors?

The right reverend Prelate raises a very important point. For the time being, we are taking the approach by country for border measures, but we could put them in place for regions in the future. We are not there yet, but we are certainly looking at it, because it is an appropriate consideration.

I thank the noble Baroness for raising this really important issue. In the operator guidance, there are clear points for those with protected characteristics, be they disabled, elderly or pregnant. We have been very clear with the transport operators that there must be no dialling back on the ability for all passengers to get a safe and reliable service. Travel may be slightly problematic for everybody, and therefore people are advised to plan their journey ahead where they can, to buy their tickets in advance and, most of all, to be patient. I reassure the noble Baroness that services for disabled people will continue as they did previously.

My Lords, as well as issues of safety when using public transport, many people in rural areas are worried that the already infrequent services in the countryside are now at further risk. What are Her Majesty’s Government doing to ensure that public transport will be maintained to support communities and the economy in rural areas?

Rural transport is absolutely key to being able to provide for more vulnerable groups who have no alternative but to use public transport so that they are able to access the services they need. The Government have already provided funding to support the services during the lockdown, and we are in discussions with the Treasury regarding supporting more services as they ramp up. As I am sure the right reverend Prelate will understand, those services will be suffering from a revenue loss, which the Government will seek to make good to ensure that rural services can be restored to what they were before.

It is also important to make sure that we make the most of the data that local operators have about their buses and collate it in one place, so that people can see information about where their bus is, and how much it will cost them, when they get on it.

My Lords, in welcoming the strategy, I am aware that we have seen numerous stories this week about levels of pollution, particularly along school runs, so we should do everything we can to get children on to buses where appropriate. However, many buses are still very poor in terms of the pollution they create, which might take some years to go through. Is there any way in which the Government can help bus companies move more rapidly to zero emissions?

The right reverend Prelate is right, and pollution is a key element that we are taking forward in our strategy. To date, the Government have provided £240 million, which went towards 7,000 cleaner and better buses, but we must do more. In the new bus package that was announced recently, one provision was £50 million for the first all-electric bus town or city.

I, too, thank the noble Lord, Lord Bradshaw, for bringing this important question before us today. The topic is close to my heart: I have spent much of my life and ministry working in rural areas. I declare an interest as a vice-president of the Local Government Association. Given that I, too, am going to talk about particular challenges to do with rural bus services, which the noble Earl, Lord Arran, and the noble Baroness, Lady Scott of Needham Market, have spoken about, I also declare my interest as president of the Rural Coalition.

As a former Bishop of Shrewsbury and the current Bishop of St Albans, when I was looking at the statistics I was deeply alarmed to discover that Bedfordshire, in my diocese, and Shropshire, in my previous patch, have seen the second and third-greatest reductions in bus services in terms of miles lost in the country in the past four years, beaten only by Bracknell Forest. Even worse is the decrease in the quantity of subsidised bus miles in those two areas, which has decreased by 77% and 81% respectively. This has a huge impact on a whole variety of groups, particularly vulnerable people in our rural areas. I hope that Her Majesty’s Government will not ignore it. Indeed, as we are wanting, longing, hoping and working for a flourishing, thriving rural community and countryside, this is a really vital aspect.

Age UK’s 2010 Loneliness and Isolation Evidence Review found strong evidence that physical isolation is still the single factor most closely associated with feelings of loneliness. Lack of a good rural bus service has an impact on a large number of groups: those who are too elderly or too young to drive, who cannot drive due to a disability or who simply cannot afford to drive at all. In those cases rural transport, particularly buses, is a vital lifeline, as well as providing important social interaction. A lack of transport is a barrier to community and to flourishing in the countryside.

As more and more services become available online and local services close or amalgamate, those without good internet connectivity or digital skills must travel even further to get the help they need. That is one of the reasons why I have been particularly passionate in talking and working with the whole issue of rural connectivity: it is fundamental if we are going to see our rural areas continue to thrive. Not everyone can use online banking. A trip to the hospital for a regular appointment can be a huge endeavour if you live in a rural area—less than one-fifth of those in rural areas have access to a hospital within a reasonable time by public transport or walking. That is not to mention the problems people can have enrolling for universal credit when they do not have a computer at home and the nearest job centre is miles away, as we have already heard, or the challenge of looking for work when people cannot drive to interviews or have young children at home to look after.

I am sure it will not surprise noble Lords that surveys show that people in rural areas express significant levels of dissatisfaction when it comes to issues of public transport. According to an analysis produced by the Department for Transport this year, more than 70% of people living in London are satisfied with their bus service compared to only 24% of those in the most rural areas.

The 2012 decision to cut the bus service operators grant, which central government gives to local authorities to subsidise socially necessary bus services, continues to bite, and has bitten especially hard in more rural parts of my diocese. Community groups, charities and church groups do extraordinary work to serve their communities by providing transport. Last week I was visiting a parish where all sorts of people use cars and minibuses to collect a whole lot of young people together for a youth group. A few weeks ago I was at a church where people were describing their weekly lunch for the elderly; they manage to ensure that everybody gets their lift in. This is, of course, informal and voluntary; it is not the same as a consistent bus service so people are able to get to places when they need to. In 2014, the Transport Select Committee of the other place concluded that:

“Central Government and local authorities are being unrealistic if they expect voluntary community transport projects to compensate for decreased bus services. Although community transport has an important role to play, in practice it does not serve all sections of the community and therefore cannot substitute for bus services”.


Young people in rural areas in particular suffer when they do not have access to consistent, timely, affordable bus services. I would therefore like to know from the Minister what Her Majesty’s Government are doing to make rural bus services a priority. What assessment have they made of the appropriateness of current access to services, and what analysis has been made of the impact of cuts, both centrally and to local government funding, on service provision? What are the Government doing to ensure that the worst off, particularly the young, have reasonable access to bus services? Will the cross-governmental strategy on loneliness be doing any work on rural transport?

As I travel around, I hear this issue raised time and again and I cannot overstate its importance. Bus services are a lifeline for rural communities and are becoming increasingly important in a digital age. I hope that today’s debate will spur Her Majesty’s Government, and indeed all of us, on in this important area.

That is why it is my very firm view and the view of thousands of our citizens that the Government need to accept this amendment. These people were devastated by the Public Bodies Bill; they were delighted by the establishment and report of the independent panel; they were heartened by the Government’s response. Now, they feel totally let down by lack of action and are deeply concerned once more about the future of the Public Forest Estate. A few words in the Bill would alleviate those concerns. I beg to move.

My Lords, I am glad to speak in support of this amendment proposed by the noble Baroness, Lady Royall. I am also glad to pay tribute to her persistence on this matter which I, too, believe is crucial. When the discussions about the future of the forestry estate have come before the public they have made their views absolutely clear that trees, woods and forests are a vital part of the make-up of the English countryside. Although they now cover only 9% of the land area of England, trees have an iconic place in our relationship with the landscape. Whether living in towns, cities, villages or hamlets, many people express affection and deep regard for the well-being of trees in the locality. Protecting the Public Forest Estate will bring many benefits to the public and the environment. I will mention three of them briefly.

First, exempting the Public Forest Estate from development and making that clear in the Bill will help secure some of the timber needs of the UK. We need our woods. They are practical things. Secondly, it would help to ensure continual public access and amenity uses. Forests and woodlands are not just places of access and recreation to be consumed but are places of relaxation and renewal, offering an opportunity to reconnect to the natural world in all its diversity. For Christians, this is part of God’s gracious provision for the well-being of humans and wildlife and should be respected as such. For many individuals, whether Christians or not, trees, woodlands and forests play a deep part in their spirituality, offering a sense of peace or well-being. They form a background to the tapestry of everyday life, from creating meeting points or landmarks for navigation to providing shade and improving the view. Whether in a cityscape or landscape, they contribute significantly to the improvement of life. Thirdly, this protection would also contribute to climate change. Trees are vital for the future of the planet in carbon sequestration—one of the things we are going to come to in Amendment 108.

I believe this is not just a peripheral thing. It is fundamental to the thriving of our communities and the environment in which we live. I shall press the Minister further to honour the commitment made following the report from the Independent Panel on Forestry. Will the Minister agree to consult with interested parties prior to Third Reading and consider including an amendment to bring forward legislation to establish that new public body to hold the Public Forest Estate to account?

My Lords, I apologise to the House that I have not participated in the debate on this Bill so far but I have been indisposed. I am now back healthy and prepared to enter the fray once again. I support this amendment from the noble Baroness and the right reverend Prelate because I think it is critical. It also brings back memories. Although I understand that the Minister is very committed to this Bill and to forestry, the coalition does not have the best of records in this respect. I remember this issue being debated during the Public Bodies Bill and the concern that was expressed. I remember the campaigns when thousands of people expressed their views. I do not know what has happened to the signatures that 38 Degrees collected. There is deep concern about forests for the very correct reasons the right reverend Prelate mentioned. I want to pay tribute—like virtually everyone in the House—to James, the former Bishop of Liverpool. He did a tremendous job of re-engaging politicians with the people out there and their love of forests.

I understand that there is a need for the transfer of land, especially for big infrastructure and housing. It would be foolish to deny that. I support this amendment because having read the Bill I am convinced of the intention of the Ministers and have no doubt about their sincerity, but I am not convinced completely that this Bill backs up their intentions. They may not be prepared to transfer land from the Forestry Commission to the HCA, but the Bill, I believe, gives other Ministers, future Ministers and future Governments the powers so to do. It may be a point of dispute or of interpretation. If it is, the amendment from my noble friend Lady Royall makes that quite clear.

As I understand it, one of the assurances that Ministers are giving us is that the forest land is not surplus land, but there is some difficulty with the issue of surplus. When I was chair of the Forestry Commission, I sold quite an amount of forest land, but I did so because I was reshaping the forest estate. In my mind, some of the forest in deep rural areas could be disposed of quite happily to the private sector, which would manage it just as well. On the other hand, we could use the money received to create new forests near the centre of population for reasons such as health, recreation and conservation, as well as for timber. I was very proud that in the time I was there we planted more than 1 million trees in Wigan, more than 1 million trees in St Helens and more than 2 million tress in Warrington because we were reshaping the estate. The argument about surplus is very difficult to define. If we rely on that to safeguard our forests, we could run into difficulties. For that reason, I am very keen to support the amendment proposed by my noble friend this evening.

The right reverend Prelate’s approach would help get us back on track to what appeared to be the starting consensus. A requirement that the compliance standards be met on-site before off-site allowable solutions are deployed is something that we support but we oppose, as our Amendment 101A makes clear, any ongoing exemption for small sites. Making real progress on zero-carbon homes is vital if we are to meet our commitment to tackling climate change and our emissions targets. We support a higher standard for homes than that set out by the coalition—the one recommended by the Zero Carbon Hub. We would structure allowable solutions in such a way that developers are incentivised to prioritise on-site measures over external offsets. If we have any reservations they are about whether, given a chance to govern in 2015, these matters can quickly be put back on to the original 2016 trajectory. My Lords, in speaking to Amendment 108A, I should like to thank the noble Lord, Lord Berkeley, for co-sponsoring it. I bring forward this amendment out of concern that the standard proposed in the Bill is significantly lower than that already agreed through cross-industry consensus. I fear that an excessive focus on off-site carbon savings will undermine the effectiveness of the proposals and that an exemption for small sites will create confusion by causing the emergence of a two-tiered regulatory system. It is essential that housebuilders meets the carbon compliance standards that have already been agreed through cross-industry consensus. This was endorsed by the Government back in 2011 and strongly supported by around 70% of those responding to their consultation. I am therefore troubled by the proposal of a new on-site energy performance standard for zero-carbon homes that is lower than the one already agreed. It is not clear why this reduction is necessary. The proposed exemptions from the standard for homes built on small sites and for starter homes would also serve to undermine the main purpose behind the zero-carbon standard: namely, that of prioritising carbon reduction. It is to address the lack of measures necessary to realise the Government’s stated commitment to carbon neutrality that I have tabled this amendment which requires the previously agreed carbon compliance standard to be met on-site before allowable solutions can be undertaken. It also requires all homes to meet that standard, ensuring that no exemptions are allowed.

First, I will address zero-carbon standards. Your Lordships’ House will be aware that the zero-carbon homes standard was originally created by the Zero Carbon Hub set up by the previous Government. This involved the green technology industry, developers and the Government. Together the decision was taken to set the standard based on what was technologically available back in 2010-11. As this Bill is addressing homes that will be built after 2016, what is technologically achievable will be far greater than the minimum standard set out back in 2011. The cost and viability of these technologies will have improved along with their accessibility and reliability. It is therefore difficult to see on what basis the Government have drawn their conclusion that the previously agreed standards are now unworkable. Surely standards must be set at the optimal point, which has been previously agreed through intense cross-sector scrutiny, and must be consistent across the board. There should be a common standard regardless of the size of the development.

It is essential that these agreed standards apply to all homes, especially starter homes where tight budgets are more likely to squeeze out energy-saving measures. The proposed exemptions for small sites are problematic as such sites are much more likely to be in rural areas that are off the gas grid and therefore expensive to heat. We must not allow this Bill to be a means of compounding the desperate situation of those households already struggling with fuel poverty. As we have already heard, there is currently a lack of clarity over what comprises a small site. A consultation on small sites was promised before the summer but has yet to take place. It would be very helpful if, in his summing up, the Minister could tell the House when the consultation can be expected. As many as 12.5% of homes a year could come under the small sites exemption if these sites are classified as 10 units or fewer.

It is also as yet unclear which parts of the zero-carbon policy the exemption refers to. Does it refer only to the allowable solutions flexibility mechanism, which can be used to top up the carbon savings from code level 4 to level 5, or will developers of small sites be exempted even from the code level 4 on-site standard? The proposed reduction to code level 4 is in itself damaging and unnecessary. Three of the country’s largest housebuilders have recently shown that code level 4 compliance can be achieved primarily through improved efficiency of the building fabric, in the form of insulation and glazing, and not requiring any expensive renewable energy technologies. Furthermore, these developers have stated that they expect to be able to build these code level 4 homes, when delivering at scale, to the same price as it currently costs to build to the 2010 code level 3 building regulations.

In the immediacy of economic pressures, we must not lose sight of the overriding purpose for which the zero-carbon standard was designed. The recently published IPCC report reiterated the very real dangers of anthropogenic global warming and the concurrent impact on humanity across the world. Carbon reduction is essential to climate change adaptation and mitigation.

Briefly, and in passing, I am also glad to say that my own church, the Church of England, is playing its part. Vicarages and other properties are now normally being built to the highest green standards and more than 400 of our church buildings, many of them medieval, now have some form of renewable energy.

In conclusion, the Bill would lead to confusion in the supply chains and among house buyers, a two-tier regulatory environment and greater fuel poverty. Moreover, the large-scale exemptions signal a retreat from a full-blooded commitment to reducing carbon emissions, the goal on which the future flourishing of our country as part of the global community depends.

My Lords, I have a great deal of sympathy with the comments of the right reverend Prelate the Bishop of St Albans. I spoke on these issues in Committee. As has been said by both previous speakers, we managed to get such agreement across the building sector and all the organisations that care about these issues as to what the standard would be. When we came in as a coalition Government, we stuck to that. For some reason, we changed our minds. I would really like the Minister to explain what made us question the agreements we had and the standards we had wanted.

I know that two of my honourable friends who have been Liberal Democrat Ministers in the department have pushed to row back from where we were going, and we have now gone forwards again. However, we have not managed to get any farther. We are owned an explanation from the Minister tonight of why we have ended up in this position when we had such a good agreement back in 2010.
