Without hesitation, I reassure my noble friend that such is the case; the continuous at-sea deterrent is just that. It has been doing that important job without interruption. I am aware of his concern about industrial action and understand that it is under control and will not obstruct the operation of our CASD.

My Lords, there is much to be welcomed in the defence Command Paper and the integrated review. As the Bishop of Portsmouth, I particularly welcome the ambitious signals to British shipbuilding for the Navy. However, I worry that, noting the tilt to the Indo-Pacific and expansion of Britain’s geographical scope into Africa, the integrated review does not suggest reducing the UK Government’s commitments anywhere, yet the proposed cuts to the Armed Forces mean the smallest full-time Army for centuries. Size is not everything, but are we asking too much of the Armed Forces? Do we risk overstretch? We seem to be gaining commitments, while failing to resource the resolution of existing challenges. Can the Minister indicate how the Government intend to flesh out their order of priorities?

I reassure the right reverend Prelate that, as he is aware, we currently engage in activity in Africa, partly with the United Nations and partly with other allies. That is where we help in trying to defeat terrorism and assist with capacity building. We are satisfied that the plans we have laid out are not just capable of discharging our existing obligations but, because of the focus that we have on a reconfigured and different kind of military force, make us better placed to deal with some of the challenges that we are facing. The right reverend Prelate is aware of the exciting vision for the Army, which involves a number of changes, not least brigades with specific functions and the creation of the Ranger regiment. It is marginally smaller, because the change is not hugely significant, but this regiment is going to be fleet of foot, highly trained, with a professional focus, and the right equipment and technology, so that we can have it where we need it quickly, doing the job that it is required to do.

My Lords, if the Armed Forces are to continue to promote global Britain, we must look after them and fulfil our obligations under the Armed Forces covenant. Research by the Royal British Legion and Poppyscotland points to the difficulties that veterans are encountering in getting benefits assessors to understand post-traumatic stress disorder when scoring health assessments for disability benefits. One stated that:

“I supplied a consultant psychiatrist’s letter stating all my mental health conditions. I scored zero. This is laughable”.


I agree. A government spokesman has said that the report would be given careful consideration, but consideration must be given both carefully and urgently if we are to continue to promote global Britain.

My Lords, reflecting on the Bill, its intentions and likely legal effect reminded me of something I learned during my time as chaplain of Wadham College, Oxford, during the febrile days of the 1980s. Wadham was then, as now, a crucible of intellectual innovation, not least in literary studies. Its senior English fellow then was Terry Eagleton, who interested himself in a method of criticism known as deconstruction. This meant, I think, that the story we thought we were reading or being told was undermined by another narrative hidden within the text, so what we might have thought meant one thing often meant something entirely different.

The Bill before the House represents a model of deconstruction. The Government’s stated intention is, as we heard in the gracious Speech,

“to tackle vexatious claims that undermine our Armed Forces”.

I regret to say that I cannot see how the Bill, as drafted, fulfils that intention. The Government may then deserve two cheers for acting when other Governments have not, but action is not the same as outcome. The good intentions of Ministers and their statements in Parliament and the media do not match what the Bill will do. The Bill would do what the Bill states, not what the Government would like it to do, or what an MoD press release announces as its objectives. I leave it to other noble Lords far better qualified than I to reflect on the very troubling risk that the Bill might lead to crimes of torture going unpunished as well as providing an attractive precedent for those countries that have historically accepted lower standards than our own.

But I would like to comment on one aspect of the Bill. I applaud the Government’s stated intention to protect service personnel from being hung out to dry under the risk of investigations over many years, but I wonder whether, as a matter of law, this Bill provides the protection that the Government seek. I doubt it does. Indeed, I worry that we risk offering false comfort to the men and women of our Armed Forces, who deserve our support.

Moreover, I am troubled that the effect of the Bill would be to reduce, indeed take away, the legal rights of our service personnel. That concern is shared, as we know, by the Royal British Legion. I say this because the Bill introduces a six-year time limit for bringing personal injury and human rights cases against the Government. Such an absolute prohibition does not apply to civilians, because the courts can use their discretion to extend the time limits available. This Bill, as it stands, would therefore mean that service personnel have fewer legal rights than civilians, while the Government are provided with an additional protection against what might be entirely deserving late claims.

Protecting the Ministry of Defence from legitimate claims might not be the Government’s intention, but it would be the effect of this Bill. That is a poor position for the Government to get into, and, to put it as gently as I can, it is difficult to see how it accords with the commitments the Government and we have made under the military covenant. Good intentions are one thing; bad law is another. This Bill, I say with deep regret —and understatement—is disappointing, and it would represent disappointingly poor law.

My Lords, one of the most significant threats to our security would be if our Armed Forces were unable to guarantee that security and to play their part in NATO. With the recent positive tests for Covid among some of the crew on HMS “Queen Elizabeth”, is the Minister confident that any member of the Armed Forces who needs a test has ready access to one? How many have been tested, and how many of those tests have been positive?

My Lords, the noble Lord, Lord Dannatt, has just reminded us that none of us participating in this debate can forget that we will shortly mark the 75th anniversary of what must surely be the most defining day in Europe in living memory: D-day. That has special significance for the city of Portsmouth, and indeed the whole diocese I serve. As a result, we will have the pleasure—I think—of welcoming the President of the United States into our midst as part of the commemorations.

Memories of D-day are long in Portsmouth, and these are memories of which we can all be justly proud. Perhaps the most powerful memory is of those young men who crossed the channel in a storm to face another storm. It was a mighty army; a staggering 156,000 men were landed on D-day itself. That represents a force just under double the size of the British Army today. It is instructive to dig into that number, because the army that crossed the channel to France consisted of men from no fewer than 12 nations. The logistics of such an endeavour rather boggle the mind, but those people made it work. It is a powerful reminder of what can be done when, despite difference, we work in concert with partners and allies for the common good—the good not just of the United Kingdom but for a more united world. More than that, it reminds us of a moment when Britain incontrovertibly acted as a force for good and accumulated colossal moral authority for decades thereafter. With considerable regret I worry that we risk squandering such moral authority as we currently enjoy.

I turn to the CSDP and the committee’s excellent report. Of course, it does not consider interventions on the scale of the Normandy landings, but it shows the good that can be achieved by deploying British expertise and know-how in, as paragraph 90 says,

“lower-intensity crisis management, such as capacity building, reform and training”.

The committee rightly draws attention, as others have, to the important success of Operation Atalanta, a signal success in suppressing piracy using Type 23 frigates well known to Portsmouth. This has seen a reduction in reported pirate attacks from 176 in 2011 to just nine in the past three years, according to the Government’s response to the committee.

The tragedy—and it is a tragedy—is that we might be willing and able to participate in future operations, but our leverage in planning them will be more limited. We risk looking from the outside in. That is something on which the committee rightly focused, not least in noting that the Government’s aspirations for their co-operation with the EU on the CSDP is some distance beyond the current third-country model. The Government’s response acknowledged that the model allows operational but not strategic involvement, and goes on to note that the overall initiative to strengthen strategic partnerships with third countries is “ongoing”. I would be interested to hear the noble Earl’s analysis of how it has gone on and how such aspirations will become reality.

That we even have to ask such questions is a source of sadness. It would be a tragedy for the influence we have to be lost. We have perhaps punched above our weight; we now risk punching below it. Our soft power risks being that much softer. But “soft power” is perhaps a misnomer. The CSDP is not about projecting power: it is about doing good and doing the right thing. Limiting our capacity—indeed self-limiting it—above all risks those whom we seek to serve: those at risk from instability, those subject to violence or those who live in fear of violence. It risks ordinary people who just want to get on with their lives.

Recently, someone told me that they were “Brexited out”. It is a new verb, in increasingly common usage, and I am wholly in sympathy with those who suffer from the debilitating effects of the syndrome. But Brexit, or being “Brexited out”, does not provide a reason to turn away. We must engage and serve the wider world. We must not let Brexit dilute our moral purpose.

Lest we forget, our moral purpose is lived out in the nitty-gritty of how we participate in endeavours such as the CSDP. Lest we forget, deploying British expertise and know-how within a multinational enterprise can be a tremendous force for good. Lest we forget, we have a duty as a developed, affluent nation to be a force for good.

My Lords, it is as ever a pleasure to speak in your Lordships’ House, but today perhaps I feel the privilege especially. I cannot report that, 70 years ago, a Bishop contributed to this House’s debate on the founding of NATO. Without the personal, military, diplomatic or political experience to which the Minister alluded, I am grateful for the forbearance of your Lordships in listening to my contribution today.

I am sometimes all too aware that bishops—and indeed many members of the clergy—like to hold that their pronouncements are of a prophetic character. At its best, that means telling hard truths to those in power. The importance of holding to account, and of setting out the likely consequences of a course of action, will be familiar to all who value the work of this place. However, I admit that this also means that the voice crying in the wilderness can sound like the voice of one who neither knows nor appreciates the challenges and hard choices that power presents.

It is a particular pleasure, therefore, to congratulate the noble Earl on bringing this Motion before the House. This truly is an anniversary to celebrate. It is an occasion to honour all our NATO partners—from the dozen of 70 years’ standing, to Montenegro, the most recent addition—and to honour our own nation’s significant, indeed defining, contribution in establishing the alliance, and our continuing commitment to it.

The diocese I serve has its own particular close connection to the Armed Forces, and through them to the alliance itself. Less than a fortnight ago, we saw one example of that commitment as we said a temporary goodbye to one of our own: HMS “Westminster”, one of the Type 23 frigates based in Portsmouth, departed for NATO duties in the Baltic. It was a reminder of our commitment, in the form of people and often very expensive kit; a gigantic aircraft carrier conducting asymmetric warfare, or the ability to combat ever more insidious, subtle and damaging cyberattacks. We can be proud that our commitment is translated into cash and that we can count ourselves one of the NATO members to contribute the requisite proportion of our GDP to defence.

Equally, however, I am seized of the importance of that contribution manifesting itself in the capability required to face down, deter and tackle any potential adversary or threat. I confess that, though I accept that the letter of our expenditure commitment is honoured, I remain to be wholly convinced that we obey the spirit quite so properly.

We must not forget that NATO is not just a defensive military enterprise: it is nothing less than a community of values. That was a point made abundantly clear when the treaty was signed in 1949, not least by Dean Acheson, the American Secretary of State. He said that yes, the alliance was to deter bullies—those who used, as he put it, “power to dominate others”—but in it also lay,

“the affirmation of moral and spiritual values which govern the kind of life they propose to lead”.

It was and is democracy’s shield and guarantor.

I am of course not blind to the nature of organisations. NATO’s foundations will have been the fruit of all kinds of motives: often complex, sometimes contradictory, and even ignoble. None the less, those do not detract from its purpose. Moral and spiritual values were at the heart of NATO’s foundation; they must also be at its heart now. But perhaps those values represent something more. Perhaps they represent our recognition that we are best served when we act closely in concert with our friends—with those who share our values. Such multilateralism has enormous merits, although, goodness knows, it presents challenges; people and nations bring conflicting motives and aspirations to the table. However, we do the most good, and serve our own interests best, when we act in communion. Even when we disagree, it is always better to continue to jaw-jaw and to differ well. That is nothing more than good, sound, practical politics—and, I might add, sound theology too. It was also the ambition of our forebears in Parliament. Standing alongside Dean Acheson in 1949 was our own Foreign Secretary, Ernest Bevin. He said that,

“democracy is no longer a series of isolated units. It has become a cohesive organism, determined to fulfil its great purpose”.

That purpose would best be achieved through multilateralism.

I need hardly tell this House that we live in interesting times. That is true of the debates, divisions and dissensions in the other place—and sometimes here. It is also true of the interesting environment into which the fine young men and women on board HMS “Westminster” are sailing. It is tempting to imagine these times solely in geopolitical terms: as a broad historical sweep of a big political canvas. I submit that we should—indeed must—think of them another way. I hope the House will forgive me for praying in aid Mr Bevin once again. In 1949, as the great men of affairs signed the treaty, he reminded them of the motive and force behind it:

“The common people (who only want to live in peace) have been unable to follow their peaceful pursuits or to sleep safely in their beds”.


Its work meant, and means, that ordinary people are able to follow their peaceful pursuits and sleep safely in their beds. I find it hard to imagine a better ambition for any public institution. These are words that might be engraved on all our hearts, especially at the present time.

My Lords, the Type 26 is a high-end specification, anti-submarine warfare frigate; not unnaturally, that specification makes it expensive. The Type 31e is an adaptable, general purpose frigate, subject to completely different procurement processes. However, it should not be inferred from that comparison that the Type 31e will be in any sense a low-grade warship. Of its kind, we intend it to be a world-beater, which other Governments will wish to buy.

My Lords, will the Minister confirm that these frigates will be based in Portsmouth, and when a decision will be announced to this House? As the home of the Royal Navy, Portsmouth is the obvious home for these frigates, not least because the general purpose Type 23 frigates are currently based there. This decision would bring much support and give reassurance to the city, community and the diocese I serve.

My Lords, I confide in you. Priests—even bishops, perhaps particularly so—are inclined to repeat themselves. I imagine noble Lords might have noticed. I have heard it said that we have only one sermon in us and just dress the message up differently each Sunday. I will be repeating my message today, and I am grateful to the noble Lord, Lord Sterling, for the opportunity to do so. I am just as grateful to the noble Earl, Lord Howe, for listening to my repetition with the grace, care and attention that we all appreciate.

My message is that I applaud the Government’s ambition for defence, which is about British power for good in the world—but as things stand, I doubt that we have the capability, or the defence budget to deliver the capability, to meet that ambition. Things could be about to get worse, judging by what we read in the media. So, if we are to meet the Government’s ambition, we must also review our ability to do so.

My second point is that the present state of uncertainty is not helpful, and that is an understatement. The media is not the forum in which to conduct discussions on defence expenditure. We should have discussions in private, followed speedily by clarity in public. That would be fair to those who are affected, so they know where they stand. The current lack of clarity creates uncertainty, particularly among the servicemen and women we value so much.

My final point is also on morale. The noble Earl may have an inkling of the direction in which I am heading. I hope that he will be able to respond to my question on whether he can commit to a debate on the Floor of the House on the Armed Forces covenant—an opportunity to pat the Government on the back for all that has been done and to look forward to all that might be done. When it comes to defence, our greatest riches are the commitment, sacrifice and professionalism of our Armed Forces. We need to provide them with resources and end this ghastly uncertainty.

I am grateful to the noble and gallant Lord for that clarification. However, I would still suggest to the Committee that substituting the principle of a right for that of a working relationship in any context in which it occurs in these new elements of the Bill would not be helpful at all. As I have said, it would fudge the issue. I urge the Minister to reject the amendment.

My Lords, I humbly confess—your Lordships may think that seemly for a priest—that despite the weighty contributions of noble and noble and gallant Lords, I am confused about the problem apparently being raised by describing those who serve in the Armed Forces as part-time.

Of course, part-time is a slippery term that seems to relate to the actual hours of delivery so that even those of us who claim to work full-time certainly do not. Working occupies only part of our day, whether we are in the Armed Forces or we are politicians, doctors, priests or whatever. So soldiers, sailors and air force personnel have a whole-time, sometimes decades-long commitment to the security of our nation regardless of the number of hours they are working and on duty in any week or month. In the same way, my local GP practice has more doctors who work part-time than full-time, but that is no measure of their skill and competence. Surely we are long past the point when part-time might suggest second rate. My surgery offers a whole-time service and capability through a blending of people working different patterns and hours.

My own clergy have a whole-life vocation. They may be called upon at any time but they minister in a variety of flexible patterns, including part-time. Part-time is well understood to be an accepted and honourable working pattern, including among those whose service and work is a vocation.

My Lords, we are in Committee. It is always tempting to make a Second Reading speech but I will resist that. However, before I make some brief remarks about the amendment, if the Committee will indulge me, I would like to thank the Minister and his officials for their engagement so far.

At the end of Second Reading, the Minister and I were far apart on agreeing the merits and demerits of this piece of legislation. Indeed, he said that my remarks were,

“sceptical bordering on the cynical”.—[Official Report, 11/7/17; col. 1205.]

But, as always with this Minister, he has sought to assuage my concerns and those of other noble Lords, and while I still have some reservations and share some of the concerns expressed today, especially by those with first-hand experience of command at a very high level in our Armed Forces, I am more positive about the measure now than I was at Second Reading. We have received some very useful briefings and the Minister has sought and welcomed comments, criticism and discussion. I am encouraged that he is prepared to take these issues seriously and I look forward to his response.

I am sympathetic to the amendments tabled by the noble and gallant Lord, Lord Craig of Radley. Terminology is all-important in matters of this sort and the Minister did indicate, I believe, that we would be given more details on the current options for flexible working. The Minister has gone some way towards responding to that with the helpful papers that have been produced in the past week or so, but there is a powerful argument for putting something concrete in primary legislation, even if it is not strictly necessary because such definitions may already be covered by the Queen’s Regulations. The amendments tabled by the noble and gallant Lord are important because we need to understand the proper definitions of what we are talking about. I hope that the Government will give them the fullest consideration and, if they are not able to respond positively today, to do so on Report.

My Lords, it is both a privilege and a responsibility to ask this Question and open this debate on the impact of the Armed Forces covenant. It is a privilege because, despite my day job, opportunities to talk about good news do not occur as often as you might think, and a responsibility because it is clear that there is work to be done as service personnel and their families still suffer disadvantage and do not always receive the consideration that they need. I am delighted by the range of expertise and interest of those who will be contributing this evening, albeit very briefly given the substantial and encouraging interest in the debate, and by the Minister for the personal commitment he has shown to the covenant. I await the debate and his response with eagerness.

First, the good news: those on lowest incomes in the forces have seen their wages increase despite the public sector pay freeze. Many have benefited from changes in mortgage agreements and mobile phone and broadband contracts which no longer penalise them during deployments. The advances made in healthcare at Camp Bastion are now mirrored by specialist centres, particularly in Birmingham. Also, partly as a result of the excellent e-Learning for Healthcare module, there is increasing awareness in general practice of both the needs of service personnel and the special access to healthcare available to them.

Service pupil premium payments have enabled schools to fund projects which support the children of forces families. A superb example of this can be found a short distance from my own home in the diocese I serve. The Crofton Cabin was built with a £20,000 grant. It provides a space for children to Skype parents while they are overseas and specialist counselling to help with the stress of deployments. Home life has been improved for many through the £68 million spent on improving and upgrading accommodation, and 9,000 families have bought their own homes through the Help to Buy scheme. The covenant has helped to raise awareness in the business sector of the needs and opportunities presented by service personnel both as customers and as future employees.

The ripple effect of the covenant should not be underestimated. Only last month the Karimia mosque in Nottingham signed up and ushered in a wave of Muslim-owned businesses that are now contributing to supporting members of the military. By signing, that mosque is encouraging this young community to play its role in defending its country, and making clear how much it values those who serve. This appreciation is vital and much deserved, not just for work done overseas but for the invaluable assistance provided by service personnel during emergencies here—for instance, following the floods.

Where is change still needed and where should we look for further improvement? There have been undoubted improvements in surgical care and rehabilitation for physical injuries, but mental health care provision lags behind. It depends on a health service which has been underfunded in this area. Despite the Prime Minister’s welcome announcement today, mental health provision is strained at best and provision for military personnel is often less than adequate. Can the Minister give us reassurance on the way this essential provision can be better delivered? This applies with as much or greater force to reservists, who are increasingly important to the Armed Forces yet are scattered and less visible. Can the Minister reassure the House on the awareness of the Government as regards the special challenges of this remarkable group?

Mental health problems are known to put a strain on relationships, and it sadly remains the case that the divorce rate among military families is double that of the civilian world. However, it is likely that mental health is not the only reason for that, when the main reason cited by those leaving the forces is the impact of their job on family life. A crucial part of that is where you live. Jesus said:

“Foxes have holes, and birds have nests, but the Son of Man has nowhere to lay his head”.

He is therefore not my primary source of advice for what makes for good housing but, like the Armed Forces, the Church has a great deal of experience with housing its people and is aware of the impact of poor housing on morale. The Public Accounts Committee in the other place concluded that families have been let down by the inadequate performance of CarillonAmey. Accommodation remains by far the number one issue reported to the families federations, and service personnel will welcome reassurance from the Minister, if he is able to help today, about the Government’s appreciation of the concern about this and how it will be addressed.

Service personnel can also be disadvantaged when they leave. The variable interpretation of the Armed Forces community covenant scheme by local government means that ex-service personnel and their families are still sometimes faced with the hurdle of “local connection” to overcome before they are housed. There are examples of good practice but at best the situation is patchy. What encouragement can the Government and indeed the rest of us give to raise the level of local government understanding and action?

Family life is of course wider than the house you live in, and it is unfair that those seeking to adopt children, and those seeking to get their children into new schools, still face huge hurdles because of the special circumstances of service life. I hope the schools admission problem might be adequately addressed by the Children of Armed Services (Schools Admission) Bill, which is to be debated for the second time later this month in the House of Commons. Perhaps the Minister could indicate if the Government have sympathy and if they perhaps plan to reduce and remove these problems.

The principle of the covenant is that those who serve in the Armed Forces and their families should face no disadvantage compared to other citizens in the provision of public and commercial services. For that to be the case, there has to be a clear understanding of what is fair and achievable. Communication of these aims has been helped by an improved website, covenant champions and access to the gateway, but this is an ongoing task, not a once-only one. Both local government and business need to train new members of staff as well as reminding their existing staff about the key features of the covenant and its implications. We are talking here about a culture not of entitlement or advantage but of fairness and equity.

As I resume my place—within time—and await your Lordships’ speeches with anticipation, I remind the House that the covenant has admirably begun to redress injustice, unfairness and disadvantage. We all need to ensure that none of us fails to pay due respect to the men and women, with their families, who are prepared to lay down their lives in our protection.
