Lords ChamberMy Lords, I echo the excellent opening speech by the noble Baroness, Lady Berridge, by saying that I view anti-Semitism as perhaps the greatest tragedy and disgrace in the history of the Christian Church.
Christian complicity arose after the break between the Church and the Synagogue in the late first century of our era, and with the emergence of the view that the Christian Church had replaced the Jews as God’s chosen people. The properly New Testament view that Christians had been graciously grafted into Israel to share its promises and inheritance reasserted itself only in the 20th century, after nearly two millennia. This was partly the result of renewed biblical scholarship and partly due to the efforts of a small but distinguished group of continental Christian theologians led by Dietrich Bonhoeffer and Karl Barth, who saw the evil of Nazism.
The Bonhoeffer-Barth view, with its rejection of the previously well-nigh universal belief that the Christian Church had replaced the Jews was expressed in its own terms by the Second Vatican Council, and is now widely accepted across all the Churches. I had hoped—naively, no doubt—that these changes would come to exert a downward pressure on anti-Semitism. I have been shocked and deeply disappointed by the contemporary re-emergence of anti-Semitism. What are the underlying causes? Further research into this question is still needed, but clearly today there is a connection with opposition to the current policies of the State of Israel—which so easily becomes falsely associated with the belief that Israel itself has no right to exist. This seems to be the crux of the problems that have beset the Labour leadership in recent times.
I have taken a keen interest in these issues, and have visited Israel seven times in my time as a bishop, taking around 500 people from my diocese there over the years. One cannot but be deeply impressed by modern Israel in many ways—its economy, its cultural life, its protection of ancient archaeology and its commitment to democracy and the rule of law. Anyone who thinks that the modern State of Israel should somehow disappear is tilting at the moon from every possible angle. Quite beyond the facts on the ground, including the military facts, there is another reason why the State of Israel is here to stay. Studies of Jewish life on the continent before World War II have demonstrated that, paradoxically, Zionists who wanted a new Jewish state in Palestine shared this hope with many anti-Semites, who wanted large numbers of Jews to leave Europe. Continental anti-Semitism wanted Jews expelled or destroyed, and their influence curtailed. Zionists could in this sense agree that Jews, like everyone else, must have a national home which would be open to all Jews, as is still the case today. It is largely forgotten that in the late 1930s, Nazis could assist Zionists to organise the departure of Jews to Palestine, before the dark reality of the Holocaust took over.
There is a sense in which the appalling and tragic anti-Semitism of the Holocaust itself helped to achieve the Zionist hope. In the great sweep of history—and, I would add, from my perspective, the providence of God—it is hardly an accident that the modern State of Israel was founded just after the most systematic attempt in history to erase Jewish people from the earth. The challenge for us today is to do our best, in every way we can, to erase anti-Semitism from future history.

Lords ChamberMy Lords, in this immensely complex situation, I want to comment on three historic issues which affect contemporary circumstances. The first was what I will call a reaction of the indigenous Palestinian people 70 years ago not to accept the decision of the United Nations to support the establishment of a mainly Jewish state and a separate Palestinian state—we must remember that that was part of the 1947 resolution. It may be that it will not work, as the noble Lord, Lord Hain, said; it may not have been endorsed later, as the noble Lord, Lord Hylton, said, but that was the original plan, and not a later plan, to sort things out. Whether we look back 3,000 years to biblical times, 100 years to the growing Jewish resettlement of Palestine or to the Holocaust, there was, I believe, an inevitability and rightness about the emergence of the modern state of Israel. This clearly required, and still requires, a parallel Palestinian state.
I have visited Israel and the Palestinian territories seven times since I became a bishop. Perhaps the most obvious fact on the ground is Israel itself: an extraordinarily prosperous, modern state whose emergence in just a few decades has almost been a modern wonder of the world for those who see it and a great credit to the Israeli people. It is a tragedy that the indigenous Arab, mainly Muslim, people of Palestine, admittedly with the support of surrounding nations, thought that they could stop the establishment of the modern state of Israel or subsequently destroy it in the disastrous wars of 1967 and 1974. It is a tragedy that a two-state solution was more possible 70 years ago than it is today.
The second mistake was the failure of the United Nations in 1948 properly to manage the emergence of the two new states, as envisaged in the resolution adopted in November 1947. It needed money and a peacekeeping force, and neither was provided. The withdrawal of the British mandate simply left a vacuum, which is not a good story about the responsible action of the United Nations at the time. One result was the refugee camps, with all the problems that have arisen from them to this day. I believe that the international community bears a greater responsibility for today’s problems than we often recognise, although I am not sure whether the Palestinian Arab community could have been helped and persuaded to the two-state solution 70 years ago.
The third major error of judgment, to which reference has already been made, was the Israeli decision to create Jewish settlements in the Palestinian territories. We have to make some distinctions. The Gaza settlements were handed back to the Palestinian Authority in 2005, with 8,500 settlers removed, some very publicly and forcibly. I went and looked into those settlements at the top of the Gaza Strip a couple of years ago. It seems that nothing has happened on them. I would be interested to know why the Gaza people do not occupy the land that was then released.
Jerusalem is a special and unique case. I do not think that we could simply go back to the pre-1967 lines. However, on the West Bank, I regard the settlement policy as a major political blunder—in political terms, it is equivalent to apartheid; it is a similar type of political error of historic proportions. I cannot see peace without its reversal. Although the Gaza situation is currently in the headlines, the demise of Hamas and the reassertion of a co-ordinated Government of the overall Palestinian areas should focus attention back on the most fundamental obstacle to the two-state solution, the West Bank settlements. Those settlements undermine the moral authority of Israel to promote a lasting solution. Sadly, I have come to think that Israel cannot see a solution, and it is left to the rather brutal management of affairs, as we have so sadly witnessed.

Lords ChamberAgain, my noble friend raises an important and pertinent point. As I have already alluded to, our immediate advice to UK companies impacted as such has been to take specific legal advice on their individual cases. The full implications of how these sanctions will translate is still being evaluated. Once more detail is available we will share that with the companies, as appropriate; but I cannot stress enough that any company in the United Kingdom that feels or believes it is impacted should take legal advice now.
My Lords, I wonder whether the greatest danger here is that the approach of President Trump is completely counterproductive, in precisely encouraging the more hard-line and reactionary elements in Iran. Given that there has in fact been some good movement in the past year, with President Rouhani being re-elected against the more hard-line candidate and some changes on the legal front in the last six months, the danger is that this is going to provoke a deep anti-American, anti-western reaction that is precisely contrary to our fundamental thrust, which should be to promote the moderate elements in Iran. If so, what can we do—quite apart from the issue around the treaty—to promote the more moderate elements in Iran, which have a real traction when it comes to elections?
The right reverend Prelate raises an important element within the context of how the American withdrawal from the deal will be perceived in Iran. We have taken a very progressive, constructive and vital step forward, through the showing of strength of E3 unity. The President of France and the Chancellor of Germany, together with our Prime Minister, have issued a joint statement in that regard. As I said earlier, that translates the fact that not all the West shares the opinion of the United States in pulling away from the deal. It is important to communicate that effectively, as my right honourable friend the Foreign Secretary did today to Foreign Minister Zarif, and we continue to make that point consistently in all our dealings with Iran. On there being different voices within Iran, we saw President Rouhani step forward and give his commitment. We will continue to support all efforts to keep Iran within the deal and all international efforts to ensure that the deal itself remains alive.

Lords ChamberMy Lords, Amendment 62 is partly in the name of my noble friend Lord McNally. I knew he would not be able to be here, and he sends his apologies for that. I have to say that I read the amendment and the clause a number of times and it seemed to me that the amendment tightened and clarified the clause. What I failed to spot, as a non-lawyer, was what lay underneath it. I am extremely glad that the issue I raised earlier has been so effectively explained by the noble Lord, Lord Pannick. I again express support from these Benches for what he has said.
My Lords, if I heard the Minister correctly, he compared the noble Lord, Lord Pannick, to Oliver Twist asking for more. I wonder, having heard the noble Lord, whether the Minister would agree that Oliver Twist had right and justice on his side.
My Lords, I support the amendment. I recognise that it is not an entirely simple point; it is not perhaps as straightforward as some of the amendments with which we dealt earlier. I see the force of the Government’s argument that the UK has no alternative under international law but to give effect to our obligations under the UN charter; indeed, Article 103 of the charter expressly dictates that these obligations prevail over any conflicting international law obligations. In the 2010 Supreme Court case of Ahmed, I ended my dissenting judgment with the hope that the majority view would not be thought to indicate any weakening of our commitments under the charter. In Ahmed, however, I also stressed the draconian nature of these orders. I said:
“The draconian nature of the regime imposed under these asset-freezing Orders can hardly be overstated … they are scarcely less restrictive of the day-to-day life of those designated (and in some cases their families) than are control orders. In certain respects, indeed, they could be thought to be even more paralysing”.
It strikes me as highly relevant to the amendment that in the case of Ahmed the Court of Appeal had held—and before the Supreme Court Treasury counsel for the Government argued this in terms—that orders implementing a UN resolution are reviewable, and that on such a review the court can grant relief directed against any UK public authority, not against the United Nations. That, essentially, is what the amendment seeks to achieve, or at least to clarify.
I note not least that one of the team of counsel instructed for the Government in the Ahmed case was Sir Michael Wood, who had been the senior legal adviser to the FCO. Clearly he had seen no insuperable obstacle to the court having this judicial review jurisdiction—the very thing that the amendment seeks to put beyond doubt that the court has. On balance, therefore, my concluded view is that we can and should make plain that the court will have this jurisdiction.

Lords ChamberMy Lords, in my contribution to our debate on these complex matters, I will comment on two areas. I do so with great appreciation for the report, so comprehensively introduced by the noble Lord, Lord Howell. It is full of excellent, empirical detail. We ought also to pay attention to certain overarching factors or narratives.
For my first point, I go back 30 years to the excellent BBC series presented by the historian John Roberts, “The Triumph of the West”. A book of that title was published to accompany the series. I reread it recently and thought how perceptive and prescient it was. Perhaps politically correct censors would not allow the title these days, but John Roberts’ compelling thesis was that the essential message of contemporary history was the dominance and penetration of western civilisation, driven on by the power unleashed by modern science. The term “globalisation” had yet to be coined, but in part of course it names the phenomenon. Modern science derives from western European civilisation from the 16th century onwards and carries many of the implicit assumptions of our culture. John Roberts’ name is not as well known these days as it should be. I knew him a little because he was a history don and later warden of my old college, Merton, although in those days I was an unreconstructed and perhaps even reprobate chemist. Sadly, he died prematurely but his works are still worth reading again, as I say.
Modern rejection of western civilisation, often presented in what I agree is a false Islamic guise, can probably best be seen as a kick-back against the very triumph and hegemony of that which it protests against. Of course, ironies abound, as when the report says that the IS/Daesh conquest of Mosul in 2014 was enabled in part by 40,000 tweets on Twitter in one day by the conquering forces. They use the products of western civilisation in their very protest against it. Unless we understand better the underlying dynamics of what is driving events, our political responses are likely to be either ineffective or even counterproductive. Although the term “culture wars” can be overplayed, there is a significant element of truth in that description of what is going on today, focused in a particular way in the Middle East.
Secondly, and following on from this, we need to recognise, as the report does, that our reaction to the various events we call the Arab spring was far too naive, simplistic and, indeed, optimistic. The report calls our reaction “muddled”. We were too optimistic that the Iraq war would usher in modern, western standards of democracy and human rights. We were much too optimistic in our backing of the original protest and rebel groups in Syria, as we are gradually coming to realise. In saying this, I recognise the monstrous character of the behaviour of Saddam Hussein and of President Assad—certainly of the forces under his control. But despite the appalling dimensions to their character and behaviour, we also need to acknowledge the downside of the chaos in Iraq since the end of the war and in Syria since the uprising began there. In Iraq, for example, it is estimated that more than three-quarters of the Christian population has either fled abroad or been killed.
Warnings went unheeded. I used to be a member of the Central Committee of the World Council of Churches, which comprises about 150 representatives from around the global Church. I recall six or seven years ago the anguish of two Syrian Christian leaders at the support of western Governments for the anti-Assad forces. Despite his other failings, Assad had protected the minority communities in Syria, and they feared that this protection would disappear, which is exactly what has happened. The experience of the substantial Christian communities in Syria has been a sad and sorry tale of displacement and persecution. The report touches on these matters, but I think it could more honestly and fully acknowledge the—entirely well-motivated—failures of western policy in Syria, not least in relation to other religious minorities.
I have said nothing about the Israeli dimension to the situation, although Israel is the country in the area that I know best. I have visited it half a dozen or more times while I have been a Bishop and I have taken more than 500 people from my diocese on pilgrimage visits there, including more than 100 just a few weeks ago. We will be debating Israel tomorrow in relation to the Balfour Declaration, but let me tie it in in this way: Israel represents—or presents itself as—a highly economically successful, militarily sophisticated and powerful western state. That is how it actually impacts when one goes there. In its own way, it testifies to the triumph of the West in the midst of Arab and Muslim cultures that can find this very difficult to accept and accommodate. Our policies in the Middle East need to take a careful and sophisticated account of these underlying cultural and, yes, religious issues. The religious side could be overplayed, but I think the report tends to underplay it.
My conclusion, which the report echoes here and there, is that our future influence in the region will rely much more on soft power than coercive or military approaches, with education and aid to the fore. Indeed, quite a lot of our foreign aid already goes to the region, but education has been underplayed in what the report calls a “transactional” emphasis in our relationships with the countries of the region, as the noble Baroness, Lady Coussins, has just so clearly explained. Somehow we and other western countries need to appear less “in the face”—if I may put it that way—of the countries of the Middle East, seeking less cultural dominance, as it is perceived by them, and a greater spirit of collaboration as the countries of the area evolve in our irreversibly global world.

Lords ChamberMy Lords, the Motion before us is not limited to economic issues, although the debate so far has understandably concentrated on them. I would like to take a slightly broader look at our future relationship with the EU. Of course, the social and economic issues associated with the four freedoms will inevitably take centre stage over the next few years, and it will be an anxious time for many. I hope it will also be a time of opportunity for at least some, perhaps many; we will see. The as-ever excellent Library Note for this debate usefully sets out the options as they might be understood on the economic front. Inasmuch as I have any confidence as to what will emerge after the present cat-and-mouse phase unfolds, I suspect it will be nearer to the Singapore, Turkey or Canada end of the spectrum, as opposed to what is hoped for—perfectly properly and rightly—by the noble Lord, Lord Liddle. We do not know; I claim no divine insight into this. But amid the uncertain labyrinth of discussions and negotiations that will have to take place, I hope that our sights can be raised above the purely economic horizon.
The original concept of “Europe” was never primarily economic or, for that matter, geographical. Geographically, there is not really a continent of Europe; it is simply a peninsula at one end of the great Asian landmass. We speak of Europe because a great civilisation developed there, shaped by Christianity and other forces ancient and modern—a civilisation that gave birth to modern science, in any serious sense of that word. While the original founders of the EU in the immediate post-war years had a certain economic view, they were also concerned to lay down foundations to avoid future conflict and were influenced by Catholic social teaching at the time. More recently, a more secular spirit has been to the fore that has left Europe rather ill equipped to deal with the new religious presence in its midst, and the growing presence of Islam in particular.
My plea is simply that, alongside the inevitable concentration on what promises to be a difficult economic negotiation and transition, we should especially promote the continuation and deepening of the educational, artistic, scientific and—yes—religious ties that over the decades and centuries have made European civilisation what it is today. Whatever we mean by “soft Brexit”, that would precisely promote a soft Brexit beyond the mere economic understanding of the term. The riches of our cultural destiny will continue to be European, whatever our precise future economic relationship with the EU proves to be.

Lords ChamberMy Lords, I have visited the Holy Land of Israel and Palestine five times since 2000 and I have commitments to lead study tours or pilgrimages next year and the year after. I have yet to go to Gaza but I hope to go to the border next January. What strikes the modern traveller most is the sheer contrast between Israel and the Palestinian areas. To pass from one to the other is like passing from a really up-to-date and modern first-world state to a third-world state, living cheek by jowl with it. In economic and other terms, modern Israel has of course been an extraordinary success in a brief period of just 65 years or so. Although recent economic growth in the West Bank areas has been encouraging in patches, in Gaza the World Bank estimates the per capita income to be 30% lower today than 20 years ago. The contrast just gets greater over time, which sets up a huge instability. I understand all the arguments for a two-state solution—I think I believe in that myself—but will two states so closely linked geographically and yet on such divergent paths easily exist side by side? I always return to that question when I have been to the area.
There is so much about modern Israel that I admire and respect. Given that it has had to fight for its life three times in its brief history, I can understand the toughness that is often manifested in the modern Israeli psyche. I so well remember sitting down with a senior member of the Government there, soon after the wall was built. He turned to me and said, “I don’t like the wall but I have five daughters. At least they’re not going to get blown up on the school bus”. We have to respect aspects of that element in modern Israel.
I do not at all defend all the Israeli tactics in the recent conflict in Gaza—how could one?—but in a funny way I sort of understand them. I greatly regret what happened but what is one to do when thousands of rockets are fired at one’s civilian population from an area controlled by political forces that are dedicated in some degree to the destruction of the country? So there is much that I can understand about modern Israeli attitudes, even if I do not always like or approve of them. What I cannot understand from the Israeli perspective is the settlement programme. It is acknowledged on practically all sides outside Israel that it is both illegal and ill judged. In a certain way it is a parallel to the political mistakes in South Africa, where the South Africans simply dug themselves in and could not see the misjudgment. It took a very long time for them to come to terms with it and, for all the differences between those situations, I often see a certain parallel.
How are we to go forward? We have to work with Hamas. I agree with the noble Baroness, Lady Tonge, that working with it must be the future, difficult though that may be. We also need to recognise the danger of the more militant strands of Islam. As soon as the Syrian conflict quietens down, as we all hope it will, the real danger is exporting it to the northern border with Lebanon or into Palestine. However, on the economic issues, unless something can be done to address the disparity between modern Israel and the Palestinian areas, one way or another history is destined, sadly, to repeat itself.

Lords ChamberThat certainly appears to be the case and, of course, if the noble Lord’s reading and recollection is of that being the case, certainly I would take his word on that.
My Lords, the noble Lord, Lord Desai, made the point that using force to resolve a situation is nearly always counterproductive and has results that you do not anticipate. Are there two additional lessons from this? First, the speed with which this report has been produced is commendable. I think of the Chilcot inquiry that we are still waiting for. This has been done in a few weeks and it seems to me to be a lesson for other situations in which a bit more speed can help the reconciliation process. Secondly, is one of the lessons that understanding religious sensitivities is something the modern world can find hard to do? One thinks of Ariel Sharon going to the Temple Mount and starting the second intifada, with all the consequences that have flowed from that. Is that a lesson that we should draw from these events?

Lords ChamberI repeat that the best way forward is for Turkey and Armenia, which have initialled detailed protocols, to work to sort this out. I believe that Turkey, which is a very dynamic and an increasingly key country in both the Middle East and in European affairs, is fully aware of this and is determined to push forward with an understanding. There are many people on the Armenian side who, while fully recognising the horrors to which my noble friend has referred, also believe that this is the right way forward.
My Lords, given that, as the Minister said, there is no doubt that genocide took place and that those who were killed should not be forgotten, can he say what is the official guidance on representation at the Armenian Genocide Memorial Day? I understand that there has been some reluctance of Ministers and others to attend the commemoration.
I will write to the right reverend Prelate on the precise wording of guidance on that. Behind it, there is always the concern that it is a matter to be settled between Turkey and Armenia. They are trying their best to do so and we must be very responsible and careful about any moves or acts of recognition or acceptance that would upset a delicate but very important process. I know that it is a natural impulse to feel, as the noble Baroness, Lady Flather, indicated, that we want to express our outrage at what occurred, but the best way forward is between these two countries.

Lords ChamberWe are urging our allies and friends, including the United States, at all times. However, perhaps the noble Lord will recognise that a clear development in the region is the increasing determination of the surrounding Arab states to play for once a more forward part in these developments. Obviously we are deeply concerned by the events at the weekend, but if one can stand back from such horrors for a moment, it seems that they reinforce the urgent need for the Israeli Government and authorities to begin to move in a positive direction in a very fluid overall situation in the Middle East.
My Lords, does the Minister agree that a premature declaration of a Palestinian state might destabilise the region rather than contribute to the emergence of a stable two-state solution?
The right reverend Prelate is right; it might do so. Of course one understands why there is a desire to move forward in this direction, but our position is that statehood must be built through the pattern of a negotiation that must be resumed, and that pressure should be put on both the Israeli side and on a peace-aiming, violence-rejecting Palestinian Government to move forward on that basis.
