Lords ChamberMy Lords, since Brock became active, five road traffic collisions have been reported to Highways England, although that is yet to be validated as an official statistic. It is not dissimilar to other contraflows; there have been five incidents in the same period within the adjacent M20 smart motorways roadwork. However, I reassure noble Lords that Highways England will closely monitor the performance of the contraflow and ensure that the M20 continues to operate safely. The point of Operation Brock is to ensure that the M20 does not close down, which would obviously have a terrible effect on local roads. Both Highways England and Kent Police will continually monitor the situation.
My Lords, is not the answer to contraflows to set appropriate speed limits and then enforce them? I have seen many people caught speeding in contraflows. If speed limits are properly enforced, surely that will reduce accidents.
The noble Lord is right to point out the benefits of having speed limits within contraflows. For safety reasons, there has been a speed reduction in the area while the contingency is in place: for the freight side the limit has been reduced to 30 miles per hour, and for the non-freight traffic travelling in the contraflow it is now 50 miles per hour. Highways England has redeployed 80 traffic officers to support Operation Brock, which will ensure that there are 30 on duty at any time. That action will ensure proper enforcement measures. We are also considering activating speed cameras and further signage.

Lords ChamberMy Lords, the regulations that we are considering will be made under powers in the European Union (Withdrawal) Act 2018 and will be needed in the event of no deal. This instrument amends the retained EU legislation governing access to the international passenger transport market and associated domestic implementing legislation to deal with deficiencies that would otherwise exist when the UK leaves the EU.
EU regulation 1073/2009 establishes the conditions for the international carriage of passengers by coach and bus within the EU and cabotage within member states by non-resident EU operators. It covers regular timetabled services and occasional services such as holidays and tours. It establishes for this purpose a system of Community licences, which act as the international bus and coach licences used within the EU, and enables these licences to be issued by the competent authorities of member states.
Section 3 of the withdrawal Act will preserve EU regulation 1073/2009 in domestic law, and Section 2 will preserve implementing domestic legislation, including the Public Passenger Vehicles Act 1981 and the Road Transport (International Passenger Services) Regulations 2018. This SI adjusts the language and references in those pieces of retained legislation, and five other pieces of legislation, to recognise that the UK is no longer a member state.
The SI also amends the retained UK version of regulation 1073/2009 to allow EU-based operators to continue to access the UK market in a no-deal scenario on a unilateral basis by means of the recognition of Community licences and control documents—other than new authorisations for regular services—issued by EU authorities under EU legislation. Existing authorisations for international regular services into the UK will continue to be recognised to avoid any additional administrative burden for operators.
This SI also covers Northern Ireland in its territorial extent. The devolved Administration have to make some consequential changes to their devolved legislation, and that is subject to a separate instrument.
The retained regulation 1073/2011 will apply only to EU-based operators. In the event of no deal, UK operators will be able to continue to access the EU market through accession to the Interbus agreement. This is an EU multilateral agreement that allows bus and coach operators to carry out occasional services between the participating countries—currently, the EU and seven other contracting parties in eastern Europe. At present, the UK is party to the agreement through its EU membership. Although the agreement currently covers only occasional services it is being extended to cover regular services, but this process has not yet concluded.
As part of contingency planning for no deal, the Government have deposited their instrument of accession to the Interbus agreement. This means that the UK will become a contracting party to the agreement in its own right. Due to the way the rules of the Interbus agreement apply, this will happen on 1 April. The Government are currently working closely with the European Commission to agree a way to close the two-day gap if we leave without a deal on 29 March.
In acknowledgment of the fact that the extension of the Interbus agreement to regular services will not be in place by exit day, the European Commission has extended the scope of its measure for an EU regulation on common rules ensuring basic road freight connectivity to include regular passenger services. This regulation was formally adopted by EU Ministers on Tuesday and will apply to UK passenger transport operators running regular services to and from the EU for the first nine months after exit, if we should leave without a deal. The Commission’s proposal is based on the UK reciprocating, and the draft regulations that we are considering today will reciprocate those conditions for EU operators in the UK.
Coach travel provides a low-cost, safe and environmentally friendly way to travel. Coaches from continental Europe bring in some 1.6 million visitors each year, and in Northern Ireland travel across the border is a commonplace daily activity, with 900,000 journeys per annum. These regulations allow for the continuation of EU bus and coach services in the UK and reciprocate the EU regulation so that UK regular services can continue to operate to and from the EU.
These regulations are essential to support our tourism industry and to ensure that international services can continue to run. I beg to move.
My Lords, I am grateful to the Minister for bringing this SI and for her introduction. She has probably answered my question, but from reading paragraph 7.3 of the Explanatory Memorandum it looked as if UK operators would not be able to operate on the continent from 30 March. I think she has confirmed that that is no longer the case because of these more recent agreements. I hope we will be able to see a continuation of this important traffic without any interruption. What the French customs and immigration people do is of course a different matter, but let us hope that at least the services can run. I hope this will continue and that therefore the services that go to many member states across Europe can continue without getting bogged down in too much bureaucracy. As the Minister has said, it is a very important market.
On 1 January 2020, assuming that we have all the signatories that we need and the Interbus agreement is in place, the main issue will be cabotage, as the Interbus agreement does not cover cabotage. UK operators will not be able to provide cabotage in the EU. There would be a separate arrangement for that for Ireland, but UK operators will not be able to do it. There is very limited UK-operator cabotage in the EU; as I said, most journeys go out and come back. However, that is the main implication and the main difference.
Following up on that, I would have thought cabotage was pretty important for coach operators. Does this restriction apply in the other direction for continental operators coming here?
This SI allows EU operators to continue cabotage operations. We do not have figures on how much cabotage takes place. The new EU unilateral regulations allow cabotage for regular and special regular services in the Irish border regions until 30 September 2019, when we will have something else in place. However, other cabotage is not permitted and, as I said, the Interbus agreement does not allow cabotage.
There is little exercise of cabotage from UK operators, because services are usually hired for a group of passengers who return to the UK, such as for a school trip or tour. Regular services allow cabotage as part of an international journey, but all current UK-to-mainland-Europe timetabled services, such as Eurolines, are operated by non-UK companies, so they will not be affected by Brexit.
As we have said, cabotage forms an integral part of cross-border bus journeys on the island of Ireland. Such services are incredibly important for remote communities. We recognise that the provision within the legislation proposed by the EU offers a solution, but that solution is based on reciprocity, which is what we are doing through these SIs.
I suppose that one could say that this is an asymmetric agreement at the moment. We are allowing cabotage within the UK, but these things are of a temporary nature. When we join the Interbus agreement and have future discussions with the EU on our relationship—

Lords ChamberWill the Minister say something about what would happen in the event of the Prime Minister’s deal—in other words, not the cliff edge—and whether this SI would no longer apply? Would the Government bring back a similar SI or would they carry on as we are at the moment? What options are open?
If the exit day is changed as agreed, the exit day in this SI would change as agreed. I do not want to predict what is going to happen over the next couple of days or the length of an extension, if there is one. Our position is still that we do not want to seek membership of the European Union Agency for Railways.
I understand noble Lords’ concerns in this area. I will take them back to the department and inform the Secretary of State of the strength of feeling on this. I hope I have provided reassurances on the consultation, the impact assessment and parliamentary scrutiny of any future divergence, which is the main and understandable concern of industry, whether manufacturers, importers, exporters or whatever.
The noble Lord, Lord Tunnicliffe, made a key point about volume. This is not an attempt to diverge from standards; it is simply that if we are no longer a member state, we will not have a vote in the European Union Agency for Railways, so these regulations remove the obligation to take its rules. If we decide to diverge, we will have full consultation and a full impact assessment and we will ensure that we inform Parliament. While this is a no-deal exit SI, the future relationship is always subject to conversation with the Commission and member states, should we get to an implementation period. We will have close conversations with them on this agency and other European agencies in the future partnership agreement.
I am not able to go any further on our future position with the European Union Agency for Railways at this stage, but the noble Lord’s position on it is clear and I will ensure I take it back and discuss it with the department. Given the assurances that there are no set plans to diverge, that we will consult, publish an impact assessment and inform Parliament, I hope that the noble Lord feels able to withdraw his Motion.
I am grateful to the Minister. She has tried very hard to justify something which is probably impossible to justify. She talked about divergence, as did many noble Lords. Unfortunately, when people say there is going to be no divergence, it happens for political reasons. That is not just under this Government; it has been around since time immemorial. It helps to have an agency which is completely separate from the political process. As the noble Baroness, Lady Randerson, said, if it can work for air and sea, why can it not work for rail?
It may not matter, but I can see cost, bureaucracy and a loss of business coming from this SI. I very much hope that we do not leave the European Union in the manner that requires this SI to be implemented, but I have not heard what would happen in the event of our agreeing with the European Union another way out or even staying in—that is a different matter because we would stay in the ERA. I also have not heard a good argument for us not staying with the European Union Agency for Railways under associate membership. If Switzerland can do so, why not us? Switzerland has very good railways. We all have a process for derogations. We have been having derogations from the ERA for a long time. I am told that it has stopped giving us derogations, probably because it is so fed up with us at the moment, but that will not go on for ever.
I thank all noble Lords who have spoken in this debate. There seems to be solid support for stating in the European Union Agency for Railways, with the exception of the Minister and my noble friend on the Front Bench—he and I do not always agree on everything, and that is fine. I wish to test the opinion of the House.

Lords ChamberMy Lords, in moving the regulations I will also speak to the Train Driving Licences and Certificates (Amendment) (EU Exit) Regulations 2019. These regulations are being made under the powers conferred by the European Union (Withdrawal) Act 2018 and will be needed in the event that the UK leaves the EU without a deal. The regulations fix deficiencies in two sets of domestic railway regulations and EU implementing legislation: the Train Driving Licences and Certificates Regulations 2010, the TDL regulations; and the Railway (Licensing of Railway Undertakings) Regulations 2005, the operator regulations.
As part of the measures aimed at liberalising rail markets, the EU introduced standard documentation for train driving licences and rail operator licences. These documents are valid across the European Economic Area. The Office of Rail and Road—the ORR—is responsible for issuing train driving and operator licences in the UK. Subject to meeting certain criteria, such as medical and competence requirements, the ORR will issue a train driving licence valid for up to 10 years. Train drivers also need a certificate, issued by the operator, confirming that the driver is competent to drive a certain type of train on the infrastructure. Operator licences are issued subject to the operator meeting certain conditions, including financial fitness and having necessary insurance cover. In Northern Ireland the Department for Infrastructure is the licensing authority.
The Train Driving Licences and Certificates (Amendment) (EU Exit) Regulations amend the TDL regulations and three pieces of EU implementing legislation. The regulations will ensure that the train driving legislation will continue to function after exit day by making a number of technical changes. They remove reporting requirements to the Commission, references to member states and functions reserved for the EU Commission and the European Union Agency for Railways. The regulations also amend the definition of a “train driving licence” so it refers only to ORR-issued train driving licences. In addition, changes are needed to ensure that licences issued in Northern Ireland are valid for use in Great Britain and to make corrections to the EU implementing legislation that applies to both GB and NI.
The Railway (Licensing of Railway Undertakings) (Amendment etc.) (EU Exit) Regulations make similar technical corrections, removing references to member states and replacing references to EU legislation with references to domestic legislation. The most significant amendment is to rename the “European licence” as a “railway undertaking licence”, though the cost, criteria and processes for obtaining a licence will not change. The draft regulations also revoke implementing regulation 2015/171. This EU regulation sets out a standard template for the form of an operator licence and details on the procedure of applying for a licence. These will not be required post exit as this detail is already incorporated into the ORR’s procedures, which are published on its website in accordance with the operator regulations.
Both sets of regulations also make transitional provisions that recognise existing European documentation, issued in EEA states, for a maximum of two years after exit day or until it expires, whichever is the sooner. In short, existing train drivers and operators providing services in Great Britain will not have to take any immediate action if the UK leaves the EU without a deal, regardless of where their documents were issued. There are a small number of drivers in the EU using ORR-issued licences, which will not be automatically recognised in a no-deal scenario. Departmental officials have worked with the regulator and operators to ensure that these drivers are aware of the need to obtain an EU licence. There are also UK operators providing services in the EU. All these operators already have licences issued in the country they are providing services in, so will be unaffected.
These draft regulations support the smooth continuation of cross-border services, such as Eurostar, by ensuring that EU-licensed train drivers engaged in cross-border services will continue to be able to operate in the UK. The Government are actively engaging with a range of European counterparts, including relevant member states, to secure bilateral agreements for cross-border rail services. These discussions include arrangements for longer-term recognition of train driver licences and operator licences. Bilateral discussions are progressing well, and we are confident of having measures in place in time for exit day.
By removing certain administrative requirements, the draft operator regulations technically widen the scope of who can be charged an application fee by the ORR for an operator licence and of who could be captured by the existing criminal offence of driving or operating on the railway without an appropriate licence. Consequently, these draft regulations are subject to the affirmative procedure. In Northern Ireland, the role of issuing these licences falls to the Department for Infrastructure and a separate instrument is being taken forward on behalf of Northern Ireland.
We have worked closely with the ORR and have engaged with industry to provide as much certainty as possible. The regulations are an important part of our no deal preparations, providing clarity for business and certainty for drivers. I beg to move.
My Lords, I am grateful to the Minister for bringing these regulations to the attention of the House. We have only got a week to go, and if we do not pass them today there may not be any trains running after 29 March—so well done the Department for Transport for leaving it to the last minute.
I have a couple of questions on both SIs. On the licensing of railway undertakings regulations—this is not clear to me and maybe this is not part of these regulations—I was talking to a train operator, from a UK company which has a licence in this country and also operates railway services in other member states, who explained that the company was having trouble in finding out whether its UK licence, in other words its licence to operate in the UK, would be valid in other member states after Brexit. Such companies try hard, often in competition with other incumbents, and it is a strain on their business and management set-ups if they still do not know whether they will be able to operate, either under a new franchise or in continuation of an existing one, after next week. I note that in paragraph 7.3 of the Explanatory Memorandum, as the Minister said in her introduction, there is a two-year window for these licences to continue. However, I am not sure whether that occurs in the other direction, and I would be grateful if she could respond to that.
I have two issues on the train driving licences and certificates regulations. Will UK drivers operating in France, the Channel Tunnel or other member states need to take driving tests in France and, if so, when? Is there a two-year window or when will it happen? This concerns not only Eurostar because in the future there might be other companies operating services through the tunnel, as well as rail freight. I declare an interest as having been chairman of the Rail Freight Group. These regulations add a great deal of bureaucracy, and I would be glad to hear what arrangements will be required for drivers with licences from other member states to come here. Is there a two-year window there?
My second comment relates to paragraph 7.8 of the Explanatory Memorandum. This SI removes the duty to inform the Commission on licences and safety matters and, presumably, vice versa. The statement that we do not need to tell the Commission anymore and it does not need to tell us is putting our head in the sand about anything to do with railway safety. Railways are rule-based operations and the more common rules we have the easier it goes. The transfer of information on safety, accidents, driver qualifications and so on, in the widest possible sense, is surely good for the safe operation of our railways. The text of paragraph 7.8 and elsewhere is drafted in a very negative way. Even if there is not a requirement—I think there should be—to exchange data, I hope the Minister will say that the ORR and the European Railway Agency should be encouraged to exchange data and participate in putting it together in common, European co-ordinated, long-term information about the safety performance of railways over the years. I look forward to the Minister’s response.
I thank noble Lords for their consideration of these draft regulations. I agree with all noble Lords that sharing information is very important, not least because of safety. There will still be a power, rather than a duty, to share information on train driving licences with other member states. That will enable mutual sharing arrangements to be put in place. It is our long-term aspiration to continue to share that information.
On numbers of driving licences, the vast majority of people driving trains in the UK have an ORR-issued licence. There are around 250 drivers in the UK who have licences issued under the EEA. Those licences will be recognised for up to two years. In answer to the point from the noble Baroness, Lady Randerson, it is up to two years because they may expire before then. If they do, they will need to be replaced. That two years is from exit day, which is currently defined as 29 March, but if that definition changes, it will be two years on from that.
Going back to the Minister’s last comment about sharing information, paragraph 7.8 of the Explanatory Memorandum on train driving licences says:
“The duty to inform EEA safety authorities will be replaced by a discretionary power to provide such information for the two-year period during which European licences continue to be recognised, and then will cease altogether”.
That is not quite the same. I understand what she says about wanting to continue to share information, but that does not appear to be the intent of this document.
I presume that that is the case because we have the two-year implementation period and our future relationship will be subject to negotiations. As I said, our long-term aspiration is to share that information. We think a legal duty is inappropriate, because another authority might refuse to receive information or co-operate, so we would not be able to fulfil that duty.

Lords ChamberMy Lords, I welcome this report but does the Minister understand the importance of shipbuilding? The report states that the Government will,
“further develop the UK shipbuilding and maritime engineering industry, building on our global reputation for design, innovation and quality”.
All that applies to Appledore, which is due to close this Friday. What are the Government doing to make sure that they get more orders and find an operator for it?
My Lords, we published the National Shipbuilding Strategy in 2017, which will help transform naval and commercial shipbuilding. In relation to Appledore, the Government have worked hard with Babcock to identify defence opportunities that could protect the yard. However, regrettably, we were unable to identify any potential solutions. The South West Business Council has created a task force to help to ensure a future for the Appledore yard and negotiations with potential proprietors are ongoing. I know that the noble Lord has made representations on this matter to the Maritime Minister, who has responded and is working closely with local stakeholders.

Grand CommitteeMy Lords, these draft regulations will be made under the powers conferred by the European Union (Withdrawal) Act 2018 and the European Communities Act 1972. Unlike our two previous SIs, some provisions in this instrument will be needed if we leave without a deal, but specific provisions relating to an enforcement power are needed regardless of the outcome of EU exit negotiations.
The regulations amend EU Regulations 437/2003 and 1358/2003 and seek to maintain the status quo with regard to the provision of data by operators of airports served by commercial flights. This is achieved by making technical changes to ensure that retained legislation continues to function, including amending redundant references to the UK being a member state. A further part of this instrument, made under the European Communities Act 1972, also creates a mechanism to enforce the obligation on airports to provide data, because there is currently no penalty if an airport does not comply.
This SI was proposed as a negative instrument, but we have accepted the Secondary Legislation Scrutiny Committee’s recommendations to re-lay it using the affirmative procedure, acknowledging its concerns around the potential impact of these changes on commercial airport operators. I thank that committee for its consideration of this SI.
This draft instrument amends two pieces of EU legislation. The first of those is EU Regulation 437/2003, referred to as the statistical returns regulation, which requires operators of airports served by commercial flights to provide their member state with specified statistical data. In its existing form, the regulation specifies information that must be compiled by the member state—a function completed by the Civil Aviation Authority. It also requires that the same information must be provided to the European Commission’s statistical office, Eurostat. It further sets in place standards that must be met during the compilation and submission process. Secondly, it amends EU Regulation 1358/2003, referred to as the implementing regulation, which requires that the process set out in the statistical returns regulation is applied to a set list of airports and updates the list of statistical information that said airports must supply. The list of airports is effectively comprised of all airports that see commercial air traffic. This list included 46 airports across the UK at the point of its last update by the EU.
The withdrawal Act will retain both these regulations in their entirety. The draft instrument we are considering makes the changes necessary so that they continue to function correctly. That is essential to ensure that the regulatory regime in place continues to allow statistics on the total volumes of passengers and freight using UK airports to be compiled. The gathering of such data and the publication of derived figures are activities that are important for the Government, the public and the sector itself to be able to monitor performance.
This draft instrument amends the statistical returns regulation to remove the duty on the UK to continue to transmit this data to Eurostat. The power to collect statistical data and the obligation on respondents to provide that data are to be retained, with responsibilities for these functions given to the CAA.
This instrument amends the implementing regulation to remove the specific list of airports covered. This list is in fact superfluous, as the existing implementing regulation also contains a mechanism that sets the burden of data collection at different levels dependent on the volume of traffic seen by an individual airport. The mechanism will remain in the retained EU regulations, so that what is expected of airports will stay the same as it is now. The data collection power provided is an important tool for accessing data due to the competitive and commercially sensitive nature of the sector. As such, it is important that this legislation continues to operate after the UK has left the EU.
During the preparation of this instrument, a review of the statistical returns regulation highlighted the requirement for an enforcement mechanism in this instrument to meet the UK’s responsibility as a member state. This is why the SLSC recommended this instrument be upgraded. This instrument therefore provides a mechanism whereby the CAA can enforce the obligation on airports to provide the data specified. In determining the penalty, enforcement mechanisms in similar pieces of legislation were considered so as to not go beyond prior precedent. Consequently, the department decided to match the enforcement powers that exist within the Airport Charges Regulations 2011, with a civil penalty of up to £5,000. This part of these regulations is required regardless of final decisions on the UK’s future relationship with the EU. As I say, it is there to meet our responsibility as a member state.
The best outcome for the UK is to leave the EU with a negotiated agreement, but this instrument ensures that, in the event of a no-deal exit from the EU, statistics on the total volumes of passengers and freight using UK airports can continue to be compiled and published. I beg to move.
My Lords, I shall be quick. I note that in paragraph 7.2 of the Explanatory Memorandum, the Government think that,
“The gathering of such data … of derived figures are activities that are crucial for Government, the public and the sector itself to be able to monitor performance”.
However, paragraph 7.7 suggests it is no longer appropriate for any of these statistics to be given—they can be given to the Secretary of State, if he so directs—to anybody else in Europe. Why is that? Would we not want data from there? Would it not be helpful for our ongoing air services between the whole of the European Union and the UK if we exchanged this statistical data? Or will we put a ring around ourselves and pretend that Europe does not exist? Surely it would be useful—and the Government say it is useful. Why is no mention made of the CAA being able to share this information with the relevant European body?

Grand CommitteeI thank noble Lords for their consideration of this statutory instrument. The regulations do not set noise policy; noise standards for aircraft are set by ICAO and we will continue to follow them.
On the point about the competent authority, last year we laid regulations that appointed competent authorities in England and Wales. The implementation provides for the local planning authority to be the competent authority when an application for any change is brought under the Town and Country Planning Act, but it also allows the Secretary of State for English airports or Welsh Ministers for Welsh airports to be the competent authority for called-in applications. Therefore, that matter is slightly separate from this SI.
The noble Baroness mentioned the balanced approach. Regulation 598 requires the competent authorities to take account of the balanced approach, and that requirement is kept by this SI. It will ensure that the balanced approach consists of identifying noise problems at specific airports and giving consideration to various measures that might be available to reduce noise. That is being carried over in its entirety.
Expansion at Heathrow is conditional on a package of mitigations. The NPS makes clear that noise mitigation measures should be put in place to ensure that the impact is limited. Again, that is going through the planning process following the judicial review process. We of course recognise that aviation noise is a key concern for communities living near airports. I regularly meet community groups and MPs to discuss this. We have played a leading role at an international level in relation to noise standards, and we will continue to promote further improvements in this area.
This SI does not change noise policy; it is concerned only with corrections as a result of EU exit. It does not impose restrictions; it is just a framework. We are consulting more widely on our noise policy, which we set at a national level through the aviation Green Paper consultation which we published in December. In that, we set out a number of policies designed to reduce noise and its impact, and that is how we will set our noise policy in future.
On consultation, in 2017 we consulted on proposals for appointing competent authorities, and the Scottish Government conducted a consultation on their proposals earlier this year. However, we have not consulted communities on this. The changes in Regulation 598 will not have a direct impact on overflown communities. They will ensure that the correct procedure is followed when operating restrictions are considered or it is proposed that they be imposed, but they will not change things for communities per se. As I said, that is being dealt with through the aviation strategy consultation.
There is a delegated power which provides for the Secretary of State to make secondary legislation under the negative procedure. It is about providing technical updates to the regulations, but again that power is limited to such updates to the noise certification standards and methodology indicators relating to the assessment of noise impact at an airport. Again, those updates are limited within the regulations to account for changes to relevant international rules.
As with the previous SI that we discussed, we will continue to follow the international rules. We have been leading the way with our noise policy and are suggesting further measures to improve it through the consultation. We will publish our final aviation strategy later this year, which we hope will address the understandable concerns of communities around the airport. However, that noise policy is not directly relevant to the SI we are discussing, which simply ensures that in the event of a no-deal exit from the EU there will be continuity of aircraft noise standards and certification and of the process when operating restrictions are considered at airports.
Perhaps I may press the Minister a little further on the competent authority. I think she said that the competent authority for Heathrow would be the Secretary of State, but I recall that over the past 30, 40 or 50 years, Ministers of different persuasions have had a major influence on what happens at Heathrow. It does not matter which party has been in power; a Minister either likes it or does not like it. There is a perception that these Ministers have encouraged studies, shall we say, or other independent work to support their particular opinion. I suppose that is part of the political process for Heathrow, but nobody will have any confidence if a Secretary of State is promoting very hard an expansion of Heathrow while being the competent authority in deciding whether the noise is too great or too little, or whatever. I appreciate that this SI—
I was just concluding. I wanted to note that, as we all know, this SI will come into force only if there is a hard Brexit. However, it would be good to have the Minister’s assurance that, depending on the type of Brexit we have—if there is no Brexit, it will not matter, but it will matter if there is some type of Brexit—if and when she brings these regulations back again she will take into account the question raised by several noble Lords about the competent authority and independence when it comes to Heathrow and perhaps other airports as well.
I understand the noble Lord’s point, but competent authorities will not be appointed by this SI. That was done last year following extensive consultation. As I said, that role was to follow the balanced approach of ICAO. Article 3 of Regulation 598/2014 requires competent authorities to be independent.
Of course, the Government and the Secretary of State are allowed a position on airport expansion. They are very clear on the benefits that expansion at Heathrow will bring. That will have an impact, which is why we set out lots of requirements in the national policy statement. The Secretary of State is not deciding on the planning process; that is being done through the independent planning process, as is right.
Under Regulation 598, the appeal route is broadly aligned with the planning process, so there may be scope to challenge any local planning authority’s decision related to operating restrictions. That is the appeal process under the Town and Country Planning Act 1990. For all other cases, including where the Secretary of State was the decision-maker, judicial review would be the appropriate route for challenging that decision. There is independence there on the granting of planning permission and the appeal route.
As I said, I very much understand the impact aviation noise can have on communities. As Aviation Minister, I am alive to it, which is why we suggested many new noise policies in our consultation on the aviation strategy. This SI is purely about the regulatory framework and will ensure the continuity of aircraft noise standards and certification and the process for considering operating restrictions at airports in the event of no deal. Noise policy is covered extensively elsewhere.
For this SI, they did not because the communities are not going to be affected by it. We consulted when we were appointing competent authorities because that will affect them. That was properly consulted on in 2017 ahead of those regulations coming into force. We did not consult on this SI because we do not believe that it is going to affect communities. It is purely about transferring the regulatory framework and not about the noise or competent authority policies. We are having a full consultation now on our aviation strategy after setting out some policy positions. We will certainly meet community groups; we are meeting community groups and will continue to meet them as the consultation evolves and the strategy develops.
My Lords, the Minister is right that there is no change in policy but, as I understand it, there is a change of the organisation or person who is the competent authority. It is now the Secretary of State and before it was somebody from one of the European organisations. There is a change and that introduces a conflict of interest.
There is a change, but to the relevant authority not the competent authority. The competent authority is staying the same. Competent authorities were consulted on and set in the previous regulations. Under current EU law, they have an obligation to report operating restrictions to the Commission. Instead, under this SI they will have an obligation to report operating restrictions to the relevant authority. In some cases, that will be the Secretary of State, in others, it will be the Scottish Government. I do not believe there is a conflict of interests because the competent authority remains the same; it is purely who it reports to that will change. There are the same reporting obligations but just to a different person.

Grand CommitteeMy Lords, this draft instrument will be made using powers in the European Union (Withdrawal) Act 2018 and will be needed if the UK leaves the European Union in March without a deal.
The draft instrument corrects five principal EU regulations related to aviation safety, together with a number of Commission implementing regulations made under them. The draft instrument also makes some corrections to domestic legislation which establishes offences and penalties relating to the EU legislation. The most important of these is EU Regulation 2018/1139 —more commonly known as the EASA basic regulation —which establishes a comprehensive regulatory framework for aviation safety in the EU. In particular, it provides for the continued establishment of the European Aviation Safety Agency and the adoption by the European Commission of implementing regulations on aviation safety. These implementing regulations also ensure the EU member states can meet their obligations under the Convention on International Civil Aviation—the Chicago convention.
The implementing regulations each deal with a specific aspect of aviation safety regulation, including: the design, construction, maintenance and operation of aircraft; the licensing of flight crew, maintenance engineers and air traffic controllers; the provision of air traffic management and air navigation services; the design and operation of aerodromes. The other principal regulations are: Regulation 3922/91, on technical harmonisation, which has largely been replaced by the EASA basic regulation—but provisions on flight and duty time limitations still apply to the crews of aeroplanes undertaking air taxi, emergency medical service and single pilot commercial air transport operations; Regulation 2111/2005, which establishes the list of air operators banned from operating to the EU on safety grounds; Regulation 996/2010, which sets requirements for the investigation of air accidents and incidents; and, finally, Regulation 376/2014, which establishes requirements for civil aviation occurrence reporting.
Many of the corrections we are considering today are to clarify that the retained legislation only applies to the UK. For example, references to “the territory to which the treaties apply” are replaced with “the UK”, and references to “the competent authority” are replaced with references to “the CAA”. Other amendments relate to the relationship between member states. For example, requirements on the mutual recognition of licences are deleted, as are requirements on co-operation and the sharing of information.
The draft instrument also reassigns functions that currently fall to EU bodies. The majority of regulatory functions required under the EU regulations are currently undertaken by the competent authorities of member states. These include: licensing pilots, air traffic controllers and maintenance engineers; and certifying the airworthiness of individual aircraft. However, EASA is responsible for a number of functions, including: preparing proposals for new technical requirements and for amendments to existing technical requirements; approving organisations that design aircraft and aircraft engines as well as certifying the design of aircraft and engines types. The CAA will take on these functions, with the exception of those related to management of the EU safety regulatory system, which will be corrected so as to no longer apply. While design certification has formally sat with EASA since 2008, it is not a capability that the CAA has totally relinquished, and we are confident that the CAA will be able both to meet the needs of industry and to fulfil the UK’s international obligation as the “state of design”. The CAA is implementing contingency plans to ensure that it will be able to undertake the new functions effectively from exit day in the event of no deal.
The European Commission also has a number of functions under the EU regulations. Most notably, it has the power to adopt regulations, to adopt or amend technical requirements, to impose operating bans on airlines which do not meet international safety standards and make limited specified amendments to the principal EU regulations. All of these legislative functions will be assigned to the Secretary of State.
The powers to amend the retained principal EU regulations are very limited and are designed to ensure that the regulatory system can adapt to technical developments and changes to the international standards adopted by the International Civil Aviation Organisation—ICAO. Most notably, the Secretary of State may amend the annexes to the retained principal EU regulations, particularly the ones to the EASA basic regulation. The annexes contain the high-level safety objectives which are implemented through the technical requirements. This power is exercised through regulations subject to the negative resolution procedure.
In addition, the draft instrument also revokes four implementing regulations that set out internal procedures for EASA and which will become redundant after exit day. None of the amendments in this instrument changes any of the technical requirements established by the retained EU regulations. All valid certificates, licences and approvals issued by EASA or by EU/EEA states prior to exit day will remain valid in the UK by virtue of the withdrawal Act. The draft instrument provides that such certificates shall be treated as if they were issued by the CAA. The instrument limits the validity of most such certificates to two years after exit day, after which time CAA-issued certificates will be required. However, certificates related to aircraft design will remain valid indefinitely. The CAA needs to issue the safety certificates to have full oversight of aviation safety in the UK in accordance with the UK’s obligations under the Chicago convention.
The best outcome is for the UK to leave the EU with a deal, and delivering a deal negotiated with the EU remains the Government’s top priority. However, we must make all reasonable plans to prepare for a no-deal scenario. This draft instrument ensures that, in the event of a no-deal exit, legislation on aviation safety continues to work effectively and that the aviation industry has clarity about the regulatory framework in which it would operate in a no-deal scenario. My Lords, I am grateful to the noble Baroness for introducing these regulations. It would be good if she could say something further as a result of the Boeing accident a couple of days ago, which brings aviation safety into focus.
I have a couple of questions, and I will use the Explanatory Memorandum as a reference because it is easier. My first question is on paragraph 7.2, “Corrections to domestic subordinate legislation”. She said that most aircraft types are subject to EU technical requirements and that will be changed from “EASA aircraft” and “non-EASA” aircraft to “Part-21” and “non-Part-21”. What is the point of this, and has anybody seriously tried to get associate membership of EASA? I know “European” is in the name, which probably means that it is anathema to some members of the Government, but it would be a lot easier. I will probably bring this up when we debate railways as well. EU technical requirements are well known and well respected. We will have CAA technical requirements if this SI goes through. What happens when they diverge? Is there any mechanism for our side to talk to the European side? It is pretty stupid to have technical requirements for aircraft in this country that will be different—even to a small degree—from those in the European Union. Of course, the same applies vice versa. We tend to think only about the problems in this country, but for our planes to be able to fly on the continent, presumably somebody has to confirm with EASA or the Commission that the technical requirements of our planes fit in with their specifications.
My second question relates to paragraph 7.5 of the Explanatory Memorandum concerning banned operators. Quite a few rather unpleasant cases over the years come to mind. The paragraph refers to the,
“list of aircraft subject to an operating ban in the Community”.
That means that there is a list, which is great, but what process will there be for the UK and the European Union to share that list? It would be pretty stupid to have two lists, and I hope that the Minister can give us some comfort that there will be a mechanism for sharing, as this is a very important issue.
My last question relates to paragraph 7.8, which refers to,
“powers provided for in Single European Sky”.
That is an ambition that has not quite been achieved, although it is some of the way there. Do I understand that it will now be dumped, that there will be a single European sky that does not include the UK and that we will have our own little sky? I look forward to the Minister’s responses.
On consultation, can the Minister assure me that there will no more use of non-disclosure agreements for this ongoing consultation? That is happening at the moment for whatever reason, but it does not need to be a precedent that carries on after Brexit.
I agree with the noble Lord. We have used NDAs when commercial issues are at hand, for example on our US agreement. The aviation industry is not silent about Brexit. It has been very clear about its position. It is supportive of this draft instrument, but it is not supportive of no deal or leaving EASA; it is making that very clear and has done for quite some time. I genuinely do not feel that the industry has in any way been restricted by talking about its views on Brexit; it has been very vociferous on that point, and we are very aware of its views, which have influenced our position on EASA membership.
The noble Lord, Lord Tunnicliffe, asked about the removal of provisions dealing with the relationship with and co-operation between member states. As I said previously, our future relationship with EASA is going to be a matter for negotiation. We have been clear on our position. We very much hope that the EU will welcome that. It has been quite frustrating because the CAA has not yet been able to have conversations with EASA because of the position we are in with the negotiations. We stand ready, but we have not been able to do that because a deal has not yet been agreed. We will continue to participate in ECAC and ICAO, as participation in both organisations does not depend on being an EU state. Even in a no-deal scenario, we recognise the importance of co-operation and collaboration with our European and international partners and will continue to do that.

Lords ChamberFollowing the Lion Air crash, Boeing, the manufacturer, issued an emergency safety bulletin and the FAA and EASA issued an emergency airworthiness directive. That mandated that 737 MAX 8 operators revise the flight manual and training procedures to prepare pilots to deal with the same incident that the Lion Air pilot appeared to experience. Of course, before the aircraft entered into service, the CAA conducted a safety assessment that took into account the preliminary findings from the Lion Air accident and the EASA airworthiness directive. As I said, this accident happened yesterday and we are keeping in close contact with those investigating it.
My Lords, most people would believe that if Boeing issued new instructions and safety rules after the Lion Air accident four months ago, they were probably defective as another accident has happened. Will we have to wait another four months before any action is taken? That seems a risky policy.
The accident happened yesterday and obviously, we are looking carefully into what caused it. As I said, an airworthiness directive was issued and acted on. We are working closely with EASA and the FAA on any further steps we should take.

Lords ChamberThe noble Baroness is right to point out the importance of East Midlands Airport for our freight capacity. In the event of no deal, the Government are designing customs arrangements in a way that ensures that goods can continue to flow. As we have made clear, we will not compromise security on the border, but keeping goods flowing is of vital importance. We are working very closely with East Midlands Airport to minimise disruption.
My Lords, last night in the Statement on Eurotunnel, the noble Earl, Lord Courtown, who is in his place, said that the agreement to pay Eurotunnel £33 million,
“will help to deliver an unhindered supply of vital medicines and medical devices under any Brexit scenario”.—[Official Report, 4/3/19; col. 503.]
Would it not have been better value for money to send this medicine by air freight, rather than paying Eurotunnel £33 million for nothing?
I was wondering how that would come back to air freight. The noble Lord is right that we are considering air freight as part of our plans to ensure that we have vital medicines. Some medicines with very short half-lives will need to be carried by air freight and the Department of Health is working to ensure that that happens. The decision on the £33 million was made to guarantee that we will be able to carry essential medicines in the event of no deal.

Lords ChamberI thank noble Lords for their consideration of these draft regulations. I agree that this is an important SI, dealing with vital security at our airports and in our skies.
The noble Baroness, Lady Randerson, and the noble Lord, Lord Rosser, asked about future regulation-making powers, and I apologise that these were not specified in the EM. Currently, three legal processes are used for agreeing amendments to EU aviation security, and that depends on the level of the regulation. Essentially, we are following what has been done under the previous regulation.
In order to maintain equivalence between existing EU procedure and the proposed UK procedure for making future amendments, the statutory instrument provides the Secretary of State with powers to make amending regulations by affirmative resolution for amendments to provisions currently covered by Regulation 300/2008 and the overarching Regulations 272/2009 and 1254/2009, and by negative resolution for amendments to provisions currently covered by Regulation 2015/1998 and the amendments to that.
Does that mean that the Secretary of State intends, through the amendments the noble Baroness has mentioned, that the regulations will stay in line with the European ones as they develop?
I am not able to give the noble Lord that reassurance as we are not sure how EU regulations will develop. However, we are of course committed to maintaining our high security record. As has been mentioned, we already have more stringent measures and that will continue.
On the more stringent measures and the Commission decision, the Aviation Security Act gives the Secretary of State powers to give directions to or serve notices on specified parties—for example, directly to air carriers or airports—for the purpose of discharging his aviation security responsibilities. The single consolidated direction is a compilation of the various directions and, after the UK exits from the EU, the single consolidated direction will continue to refer to the retained EU legislation, supplemented already, as I have said, by the more stringent measures. This is essential to maintaining our existing aviation standards, which will be continually assessed and modified, where necessary, to reflect the current threat picture.
The single consolidated direction will also be used to set out the content of the Commission decision, and the content decision will continue not to be published. The information was not published before and will not be published in the future. I understand the noble Lord’s concerns about that but, obviously, if more details were out there on the specifics of what was needed for aviation security that would put us at risk—for example, the specifications of screening equipment, the volume of detection, the criteria for the random testing of airport supplies, details of the exact screening requirements such as what percentage of passengers are checked, and the green list for aviation security. There is no change in this.

Lords ChamberI should first point out that these regulations apply to everyone who travels on a plane regardless of nationality, so actually the nationality is not important. The important part is the carrier that operates the flight. In that example, as I said, the flight leaving the UK would be covered by the CAA and the flight leaving Amsterdam, regardless of the nationality of the passenger, would be covered by the existing EU regulations, so that would not change.
Will the Minister explain what would happen in the reverse direction? Say you are flying Nigerian Airways from Lagos to Amsterdam with a through ticket to London with another carrier. What is the enforcement on the compensation rules there?
They will remain the same. The flight operating into the UK from a third country will be enforced by the CAA, and a flight operating into the EU would be covered by that EU member state. I understand that this is a little complex, so I will list exactly what will be covered.
But before doing that, on code sharing, asked by my noble friend Lady Altmann, the carrier operating the flight will be liable under the regulation, irrespective of who sold the ticket.
I will attempt to be a little clearer than I was in my opening speech. This regulation will apply to: all flights departing a UK airport; flights to the UK from a country other than the UK if on a UK air carrier; flights to EU airports from a country other than the UK if on a UK air carrier; and flights to UK airports from a country other than the UK if on an EU air carrier. That applies to passengers of any nationality.
So in answer to the question asked by the noble Lord, Lord Tunnicliffe, about who will be disadvantaged by this, in short no one will be adversely affected. The aim of this SI is absolutely to maintain continuity after exit day. In the event of no deal, passengers will retain the same rights as they have today. In the event of a deal, which will obviously get us to an implementation period, this SI along with many others will be amended or revoked.
I take the point made by my noble friend Lord Deben that all things aviation will not stay the same in the event of no deal. That is why we are trying to avoid that. But in the case of this SI, the rights will stay the same—

Lords ChamberThe Minister seeks to blame Arklow for this withdrawal, but the Irish Times says something rather different. It states that Arklow was never “a backer”, did not have “any formal agreement” with Seaborne and was not “a contract partner”. Who is telling the truth?
My Lords, the contract was with Seaborne Freight. I have read out extensively the reassurances provided by Arklow, which are set out in the letter published on GOV.UK. The contract, however, was with Seaborne and we entered into that given the reassurances that we had.

Lords ChamberMy Lords, since the Traffic Management Act 2004 came into force, more than 93% of local authorities in England have taken up the powers. On the specific point about enforcement, I will have to follow it up with the department and write to the noble Lord.
My Lords, I am sure that the Minister will be aware that her colleague Jo Johnson wrote a circular letter in the autumn to local authorities, praying in aid—about penalties for persons committing nuisances while riding on footpaths—that people shall not,
“tether any horse, ass, mule, swine, or cattle, on any highway, so as to suffer or permit the tethered animal to be thereon”.
This came from the Highway Act 1835. Is it not about time this legislation was updated?
My Lords, I was interested to find that cycling on a footway is also an offence under Section 72 of the Highway Act 1835. Obviously, it has been updated with various pieces of secondary legislation. As I say, we are looking carefully at the issues around vehicles on pavements and will respond in due course.

Lords ChamberTo ask Her Majesty’s Government what progress has been made in improving the resilience of the railway line at Dawlish towards south Devon and Cornwall since the two-month disruption beginning on 5 February 2014.
My Lords, Network Rail has worked to develop long-term solutions to make the railway at Dawlish and Teignmouth more resilient to extreme weather, engaging an expert team of tunnel, cliff and railway engineers. This is part of a £15 million investment provided by the Government. The first phase of work to protect the sea wall began in November, with essential repairs now completed to four breakwaters. Following engagement with local stakeholders in autumn last year, Network Rail has now submitted plans for a new, stronger sea wall at Dawlish.
I am grateful to the Minister for that reply, and am sure the House will wish to congratulate Network Rail on the way it recovered from that terrible accident five years ago where the track was waving in the air with nothing underneath it. However, is the Minister aware that already this winter services have been disrupted on 10 occasions—sometimes because the tide is just over the tracks and the tracks are buried? One solution might be for the Secretary of State to play King Canute, but I am sure he would not want to do that. The alternative is to encourage Network Rail with some funding to go ahead with the issues that the Minister mentioned. Also, will she start looking at the process of reopening the Okehampton-Tavistock line, to provide a better service to Plymouth and Cornwall for when the line by the sea is disrupted?
I join the noble Lord in congratulating Network Rail and the orange army who did such a great job of recovery after the storms more than five years ago. We have been clear that ongoing investment in the south-west transport infrastructure is a key priority, and we remain determined to find a permanent solution for Dawlish. As I said, £15 million of funding has been made available, and world-leading engineers have been carrying out detailed assessments. Network Rail is making good progress on its plans, and we are considering them carefully.
On the noble Lord’s point about the regular Okehampton service, we are working closely with the local councils on that. We responded to the future of the Great Western franchise consultation last August, and are looking into what scope of work will be needed to reinstate regular services on that route.

Lords ChamberMy Lords, I am pleased that the noble Lord feels a lot better for having got that out of his system. I absolutely agree with him about the excellence of the civil servants in my department—and across Whitehall—who are working incredibly hard to ensure that these statutory instruments are correct and that they are in place so that we have a functioning statute book in the event of no deal. I share the noble Lord’s desire to reach agreement on the withdrawal arrangements. I am sure that we will be watching the other place with close interest today and on Valentine’s Day. I should probably leave it there.
This SI will ensure that the legal framework for ship recycling remains legally operable when the UK leaves the EU. It will make amendments to the EU ship recycling regulation and three Commission implementing decisions. I hope that I will be able to provide the noble Baroness and the noble Lord with assurance on our standards. All UK ship-recycling facilities with a valid permit are eligible to be included in a new UK list. That list will also include all the non-UK ship-recycling facilities on the European list when we exit the EU. We expect those two lists to remain closely aligned with each other. In effect, any changes to the European list after we leave the EU will almost certainly be mirrored on the UK list. As a consequence—
Does the list include places such as Bangladesh, India and other places outside the EU or the UK? They are major centres for ship recycling and I am sure that many noble Lords will have seen the revolting conditions that people have to work in to cut up old ships on the beaches.
It does include some non-EU countries. I am afraid I cannot find the list in my files, but I will write to the noble Lord to confirm which countries are on it. The EU has very high standards of recycling and we will continue to match them after we leave.
The Secretary of State reserves the right to change the list. The power to add new facilities to it is included so that it does not become static. If we did not include this power, it would not be possible without primary legislation to add ship-recycling facilities to the UK list and to mirror what the EU does on its list. Over time, that could reduce the choices that UK ships have, compared with their EU counterparts. Because we will be retaining the standards and criteria for approving ship-recycling facilities used under the current EU regulation, the UK and EU lists will continue to be compiled to the same high standards. The powers in this instrument cannot be used to lower the standards of ship recycling.
If the EU changes its criteria, we will of course consider revising ours along similar lines. We do not think that this will happen for a few years, until the ship recycling regulation—which is fairly new—beds down. The Commission is committed to reviewing the EU regulation 18 months before the Hong Kong convention comes into force. That could lead to amendments to the criteria for ship-recycling facilities on the European list to align it more closely with that convention. If this happens, we will liaise closely with the EU, as our two regimes are virtually identical. Again, any change to those criteria would need to be done through regulation.
The EU regime is one of the strictest in the world. We are committed to maintaining those high standards, regardless of our membership of the European Union. I am happy to confirm that there are no—

My Lords, I have a very quick question on this one, to do with air pollution and the Merchant Shipping (Prevention of Air Pollution from Ships) Regulations 2008. This basically moves the responsibility for ensuring minimum air pollution from ships from the European Economic Area to the United Kingdom. I do not want to go into any detail at all, except to say that I hope the Minister can confirm the statement that has been made many times before by Ministers in this House—that when we leave there will be no reduction in environmental standards. I am particularly interested in:
“In Schedule 2 (engines excluded from regulation 21) … before ‘the European Economic Area’ insert ‘the United Kingdom or’”.
I hope the Minister can confirm that there will be no reduction in environmental standards from this change.

My Lords, I will not delay the House for long but I have to question the point of this SI. It seems to try to ensure that we have the same safety regulations for passenger ships and many other things as we had before Brexit, this being a post-Brexit SI. But I do not think that we have the same regulations at the moment, because I happened to go on a passenger ship in Brittany last summer which looked exactly like what I thought would be a nice idea for a ship to go to the Isles of Scilly. I had a long chat with the skipper and got hold of all his certificates and the regulations on the board. I asked him, “Can you operate across the English Channel and to Scilly, in all weathers and at all times of day?” He said, “Yes—when do you want me to start?”
I thought this idea would be interesting, so I sent that information to the Maritime and Coastguard Agency but the answer that I got back said, “We do not recognise French legislation”. I thought that there was one common European system for ferries which could go across the English Channel, or anywhere else, to help interoperability so I was a bit distressed that this did not happen. Maybe the Minister will not be able to answer my point but I would be glad to have some response from her, perhaps in writing.

My Lords, I will briefly ask the noble Baroness a couple of questions on this Motion. It is good to have it before the House—it shows progress with HS2—but I am wondering why today. It is probably because we do not have much else to do in your Lordships’ House. Could she give us any idea as to when the Bill will complete its passage through the House of Commons and when we might see it?
Before the Bill comes to your Lordships’ House, will the Government publish a new business case and cost estimate for phase 2a—the subject of the Bill—taking into account the latest information about land purchase and design development? I am already hearing stories about quite difficult ground conditions on the route, including salt mines. There are lots of salt mines in Cheshire. Let us hope that the costs estimate does not go shooting up. I ask this because on HS2 phase 1 we are still working on the 2013 business case, which is six years old—six years of the Infrastructure and Projects Authority’s amber/red designation, which I think is a record.
This was raised in the House of Lords Economic Affairs Committee hearing last week, when Nusrat Ghani, the Minister, and officials gave evidence. When the committe quoted higher costs to the Minister—I think she had probably gone to vote by then—the officials said, “We don’t recognise these figures”. When the committee went back to them and said, “If you don’t recognise the figures we’re quoting, what figures do you recognise?” The answer was, basically, “None”. I do not know whether this is the first of many Treasury blank cheques, or whether in fact the Minister will confirm, as she did in a Written Answer to me about six months ago, that before permanent work starts on phase 1, the Government will come up with a new cost estimate and a new business case.

Lords ChamberMy Lords, of course it is very important that we take the needs of general aviation users into consideration, as well as drone flyers. As my noble friend points out, the vast majority of drone users behave safely and responsibly. We will continue to work with them as airspace modernisation and drones develop.
My Lords, the Minister used the word “proportionality” today, and in a previous answer. Could she explain the principle of proportionality between a drone closing Gatwick for two days and people being allowed to do what they like with them elsewhere? It is a bit of a challenge, is it not?
The noble Lord is quite right; it is a challenge. We have brought in laws governing the use of drones within airport exclusion zones and across the country. It is against the law to fly your drone above 400 feet, but the noble Lord is right to point out that this is a complex issue.

Lords ChamberMy Lords, the tabletop exercise has already taken place; it took place on 10 January and had 180 local attendees, so I am not sure how large the table was. The important thing is that we are ensuring that we work with all stakeholders who will be affected by this. We have been clear that in the event of no deal there will be some disruption and that is why we are working closely with all stakeholders and, indeed, France to ensure that we minimise that disruption.
My Lords, has the Minister consulted the port of Ostend over this new ferry-less service from Ramsgate? Is she aware that the mayor of Ostend said last week that he would not accept a ferry under any circumstances due to the cost of security?
My Lords, the port of Ostend is an operational ro-ro port, but nevertheless improvements are naturally required in order to bring all the necessary facilities up to date for the reinstatement of the Ramsgate route. The Government have no plans to provide any funding to the port of Ostend: that is a commercial matter for the port and for Seaborne.

Lords ChamberAs I said, the current work at Ramsgate will certainly benefit that area. With this procurement, the Government set the criteria of the additional freight capacity, within which the port of Harwich would have been in scope, but we did not specify the origin or destination ports. We left that up to the commercial operators. We regularly engage with a wide range of ports across the country, including Harwich, and we will continue to discuss how the Government can support them in the development of the maritime industry.
My Lords, could the Minister explain her comment that no money would be paid to this company until the service is started? It actually started dredging at the weekend. Who is paying the probable millions that will be spent on dredging? Are the Government or someone else paying? Secondly, who will guarantee the traffic on this ferry service, if it ever starts? Who will set the prices? As my noble friend Lord Campbell-Savours said, it is an open competition now between these ferries. Will the Government direct trucks where to go?
My Lords, the dredging of Ramsgate, which the noble Lord said is already happening, is separate from this contract. We have a prioritisation process in place to ensure we can facilitate trade in the goods that we need to. That is an ongoing process that will continue up until we reach a deal with the European Union.

Lords ChamberTo ask Her Majesty’s Government whether they will consider proposals by Transport for the North to include capacity and capability for freight services within their plans to electrify and upgrade the Manchester to Leeds route; if not, why not; and what alternative proposals they will make for freight services.
My Lords, we are planning to invest £2.9 billion in the first phase of the trans-Pennine route upgrade over the next five years, with an immediate focus on improving journeys for passengers. We have taken Transport for the North’s advice into account as we develop this first phase and are taking forward many of TfN’s recommendations. We will continue to work with Network Rail and Transport for the North to develop future phases of the upgrade and on how best to realise potential future benefits for cross-Pennine freight flows on this line and other routes.
My Lords, I am grateful to the Minister for that Answer, but she has not answered the second part of my Question, about alternative proposals if the Government are not going to do this. Is the Minister aware of the enormous pressure from ports and customers in the north for rail freight to go across the Pennines? PD Ports, which runs Teesport, says that this failure to allow for freight,
“could seriously damage the economic aims of the Northern Powerhouse and would leave an overreliance on the heavily congested M62”.
Perhaps the Minister is going to widen the M62 instead, which would have enormous environmental benefits. Will she give a categorical assurance that this freight upgrade will happen and that freight can start running now, even without the necessary gauge clearance?
My Lords, there is some freight on the route already, and that will continue. I absolutely agree that rail freight plays a vital role in transporting our goods around the country and in cutting congestion on our roads. Sadly, however, taken together, all the proposals for freight and passengers exceed the amount of work we are able to do over the next five years and, indeed, the £2.9 billion we have allocated. Where we are doing electrification work, we will also ensure that it is future-proofed for freight in the future and we have enhancement works east of Huddersfield, which can provide more capacity for freight movements that use the main trans-Pennine route.

Lords ChamberMy Lords, we want to improve accessibility, not only at airports but in aircraft and we are working closely with industry to deliver changes in aircraft design. That will be for the slightly longer term. A number of issues are stopping people from travelling in their own chairs on planes—from ensuring that chairs can be tethered safely and safety issues around batteries to investigating flexibility in cabin seating to make it commercially viable for airlines. But I know that in order for some passengers to fly they of course need their own wheelchairs. I recently chaired a round table on that specific issue. We are working closely with the aviation industry, the CAA, wheelchair manufacturers and disability organisations to achieve the long-term goal of enabling wheelchair users to travel with their own airworthy wheelchair on a plane.
Is it not about time that the security rules were proportionate to the services? My stepson lost a leg some time ago and was forced to take off his prosthetic leg in Newquay airport in front of a lot of passengers and his family when he was flying on an international service to the Isles of Scilly. For goodness’ sake, surely there should be a rule to apply a little more common sense to such searches.
My Lords, as well as setting the right standards for service, we need to ensure that all staff are properly trained to address these issues. We are including a proposed measure for training programmes to improve disability awareness for all customer-facing staff, be that at the border or for ground handlers, but including security staff as well.

Lords ChamberMy Lords, I thank noble Lords for their consideration of these draft regulations. Throughout the passage of the Haulage Permits and Trailer Registration Act there was valuable debate, which allowed us to refine and improve the Act and ensure that it laid out the necessary framework. I am grateful once again for the opportunity to consider the detail of this legislation. I shall attempt to answer all the questions, although I am not sure I will be able to in the time allowed. If there are questions I do not get to, I will follow up in writing.
On the requests for current haulage industry figures: there are 8,400 standard international licences currently in use and 32,000 Community licences. Our figures show that if hauliers were to make one trip per week on each permit, around 20% of current activity by UK HGVs could be facilitated on ECMT permits alone. However, 20% is not enough and we do not expect to rely solely on ECMT permits. These regulations and the published guidance refer only to ECMT permit applications. We do not yet know the outcome of negotiations, so we are not able to provide further information to hauliers on that. Whether with the EU or with member states, it could be that no permits are required at all. In that case, obviously these regulations will not come into force.
I will say a little more on the permit application process—
I am grateful to the Minister for giving way. She is outlining what she probably thinks is the best case. If we get the worst case—no deal—there may be no trucks going across the Channel apart from the small number with the permits that she has just outlined. Will we be allowing Bulgarians—or Romanians, or anyone else—to come in and drive trucks, or will we just be cut off?
My Lords, we will certainly not be cut off. The case I outlined—20%—is the worst-case scenario for UK hauliers under the ECMT permits. What happens with EU hauliers coming in—80% are non-UK hauliers—would depend on the negotiations. We have not yet made an agreement with the EU or member states but, of course, traffic goes the other way too.
On the permit application process, we have been working closely with the DVSA to build on existing IT systems for the online permit application system. As I have said, that is currently for ECMT but may be for other bilateral permits if we agree a permit scheme bilaterally. To apply for the permit, hauliers have to be registered on the vehicle operator licensing scheme—some 87% are already registered. The permit application scheme has been tested extensively with hauliers, who found it straightforward to use. I have seen the system myself and can attest to its user-friendly manner. Therefore, we are well prepared for that. As I said, the guidance that we have provided has given advance notice of the information that is needed, and we have tried to keep that information very simple to help the application process.
The noble Lord, Lord Berkeley, asked about the timing. Permits will be allocated and notifications will be made in good time to ensure that permits are with the successful applicants by January 2019. They will receive an email notification as soon as the permits are allocated and the system will allow applications to be considered promptly. However, as I said, this is for ECMT permits, and until we know where we are with the wider negotiations or bilateral agreements, that is the only information we are able to give.
The noble Lord, Lord Rosser, asked about monthly permits. We will have around 2,800 monthly permits, which will be available for mostly Euro 6, as opposed to Euro 5, vehicles. The noble Baroness, Lady Randerson, asked about the emissions criteria. It is purely a case of whether a vehicle is categorised as Euro 5 or Euro 6. We have chosen to take out the maximum number of monthly permits, as we think that that will give us the maximum possible flexibility. Exactly how these permits will be used will depend on the outcome of negotiations with the EU or with member states. As yet, we have not reached a firm decision on how they will be allocated. The guidance published yesterday related to annual permits. We will begin to take applications for annual permits later this month and will offer monthly permits closer to exit day.
The noble Lord, Lord Berkeley, asked about international journeys. Hauliers who plan to travel to the EU will need a valid permit to make an international journey, and they should not start that journey if they do not have the appropriate documents. They will be subject to the usual checks, although we would not specifically check for an international permit because they are not needed domestically. As I said previously, 80% of haulage is undertaken by international hauliers, and these regulations refer only to UK hauliers. Subsequent decisions about EU hauliers will be published at a later date when we see the outcome of the deal.
The noble Lord, Lord Bradshaw, was quite right to point out that we rely on foreign drivers. We have already said that we will recognise EU-issued driver qualifications, such as the CPC, so that foreign drivers can continue to work for UK hauliers. That was set out in our technical notices.
Specifically on the bilateral agreements, as I said, we remain confident of getting a good multilateral deal with the EU. There is obviously a clear mutual interest in reaching a good agreement that benefits both our haulage industries, but we are preparing for other outcomes. With regard to the number of bilateral deals, in the past we have concluded 26 such agreements with EU member states. Of those, the Government consider the agreements with 20 EU countries to be extant, with the other six having been terminated.
Some of those bilateral agreements will require permits, although a number are liberalised. We are expecting to have to update them and are preparing for that. In practice, we need to work with the member states on the agreements, so at this stage I am not able to give detailed information about them. However, should we get to the point where we go down that route, we will of course share that information. Any future agreement will be brought into force under the permits SI through the negative procedure simply by adding a member state—if permits with it are required—to the list under Regulation 1. However, obviously any bilateral agreement will be properly scrutinised and brought before Parliament.
We will be using the criteria that we have decided on to deliver the principles of obtaining the greatest economic benefits from the permits, protecting the interests of UK hauliers, and applying a fair and consistent process. To achieve that, we will consider the exhaust emissions, the goods that will be carried, how frequently the permit will be used and what proportion of the applicant’s haulage is international. Again, all that is set out in the guidance, which has now been published. It shows the exact questions that we will be asking and the specific measurable data that hauliers will need to provide. As I said, we have designed the guidance alongside research with hauliers so that it is clear for them and so that the system is straightforward.
Assessment of the criteria will be based on the numerical data that hauliers provide, and the IT system will automatically assess the applications. The criteria are included in broad terms, as we think that these are the key considerations for the permits to be allocated effectively. The regulations will ensure that the Secretary of State continues to consider the relevant guidance, and he must also provide guidance on how they will be applied.
Random selection was brought up by many noble Lords and we discussed it at length during the passage of the HPTR Bill. There are many objectives of the allocation criteria. Scoring purely on other criteria without that random element could mean that only a few hauliers got all the permits they applied for and others got none at all. Not only would that be that uncompetitive; it would also mean that smaller international hauliers who still use these permits intensively would get none, which we think is unfair. It is important to have as large a number of UK hauliers as possible to be able to continue to haul goods internationally in the unlikely case that we have to rely on the ECMT.
The random element acts to distinguish between very similar applications while preserving the basic principle that the most intense users of permits, and the hauliers most reliant on international work, have a greater chance of being allocated permits. To be clear, this does not mean that permits will be allocated by chance and without considering those criteria. It is not a lottery. Applicants who use permits more intensely and who perform a greater proportion of international haulage will always be more likely to get permits. We will look at the proportion of goods currently carried internationally when allocating them. Modelling that the department has done suggests that at least four times as many different hauliers will be awarded permits under this system than would be without the use of random allocation.
May I ask a question supplementary to that? If the criterion is going to be the greatest economic benefit, how can the Government identify something vital for a small business, as the noble Baroness suggested—25 tonnes of oranges, or the parts for a major car manufacturer who says, “If I do not get the parts today, I am going to close the whole thing down”—when we are only going to get a quarter or so of the permits we need at the moment? It seems there is going to be chaos either way. Does the Minister have a solution?
My Lords, it is of course incredibly important that we protect the interests of small businesses. The impact of the legislation on small businesses has been carefully considered. We are very aware of the tight operating margins the sector faces. As we said in the impact assessment, a large majority of the sector is made up of small and medium-sized businesses. In the case of the permits regime, we are looking at the proportion of business that is international. The criteria have been designed not to disadvantage smaller operators. For example, the number of international journeys made by a haulier is measured per permit rather than by the actual number of journeys. The inclusion of an element of random selection also ensures that small businesses are not disadvantaged.
On the point made by the noble Lord, Lord Berkeley, we are aiming to replicate the current mix of goods carried by hauliers, and we will do that as we issue the permit allocations. We have worked carefully with the haulage industry on that throughout the passage of the Act and in the run-up to the publication of the guidance and the legislation. We will continue to work closely with the trade associations—the Freight Transport Association and the Road Haulage Association—as well as lots of industry associations and small business. Industry supports our negotiation objective to maintain and develop the existing access for commercial haulage. I will read the evidence mentioned by the noble Baroness, Lady Randerson, but I am very clear where industry is. It is very keen to continue with the open access we have now, and that is our negotiating position. It also welcomes that the Government are working to ensure we have the right system in place and are able to allocate the ECMT permits, should we need to rely on them.
The noble Baroness, Lady Randerson, also briefly mentioned caravans. This does not replace the NCC scheme. We are working very closely with it on the CRiS scheme, and with it and caravan council members to make sure they understand how this will affect them. We also have a communications campaign aimed at both hauliers and those with trailers to ensure that they are aware of this.
The noble Baroness also mentioned Wales. I looked into this thinking that it might come up again, and it is a standardised text, as England and Wales are a single legal jurisdiction. It is therefore not referred to separately. The standardised language is to show that EVEL does not apply. However, I will go back and reiterate her point that that could cause confusion.
These instruments represent an important stage as the Government progress with plans for leaving the European Union. We all agree that we do not want to rely on ECMT permits, and that is not the Government’s position. Haulage is of course a key industry and integral to the success of our wider economy. It is this that led to our focus earlier this year on bringing forward the primary legislation underpinning these regulations and the technical systems for implementation. If we do end up with just the ECMT, we will be ready, but, as I said, that is not where we want to end up. Whether it be through an agreement with the EU, which we are optimistic for, or through updated or new bilateral agreements with other member states, it is clear that that is in our mutual interest. We are keen to get that in place as early as possible to provide certainty for all the haulage companies that contribute so much to our economy. As I said, our negotiating position with the EU is clear as we look to achieve a deal with reciprocal arrangements that work for the industry. However, we are putting in place solid preparations for a range of outcomes, including the unlikely event of no deal.

Again, I will endeavour to answer as many questions as I can; those that I cannot, I will follow up in detail in writing. Shipping, like other modes of transport, has a responsibility to control emissions. That is what we are doing with this SI, which replicates the current EU regulations.
My noble friend Lady McIntosh and the noble Lord, Lord Berkeley, asked about monitoring and enforcement. I will go through the main requirements of the current regime. By August 2017 ship owners had to send the monitoring plan for their vessels to an approved verifier. That plan includes information such as the fuel consumption of the ship and how it will be monitored. It will be done in many different ways. The noble Lord described an interesting way of monitoring, which I had not come across. It will be up to the owners of vessels to explain how they are doing the monitoring and to get that approved. From January this year, ships have had to collect CO2 data on their voyages for the calendar year. That data is collected and recorded separately for each voyage. By 30 April 2019 ship owners must submit their accumulated yearly data to the verifier. By 30 June each year after the reporting period, the document of compliance for the ship will be issued by the verifier and will be valid for 18 months from the reporting period.
I am grateful to the Minister for her explanation. Can she explain who they submit these documents to?
Yes, absolutely. They are issued by the independent verifiers and then checked by the MCA. On compliance and enforcement, the existing regulations bring in fines if people fail to comply. That also allows for the detention of non-compliant ships that come into UK ports. Inspectors from the Maritime and Coastguard Agency will ensure that ships have the correct documentation and will do the enforcement on UK-flagged ships. Other ships using UK ports will also be liable for inspection as part of the port state control regime. Non-compliant ships can be detained and their owners prosecuted via the courts and fined. The enforcement will stay the same, it will just be done under the UK regulation rather than the EU regulation.
I hope I have answered the point made by the noble Lord, Lord Teverson. Rather than it being about greenhouse gas emissions or carbon, it is about the fuel consumption and reducing that over time.

Grand CommitteeMy Lords, I thank noble Lords for considering the draft regulations. Many questions have been asked and I will do my best to get through all of them, but if I do not I will follow them up in writing. As I have said, the regulations just make the changes necessary to ensure that the retained EU legislation setting out the insurance requirements continues to function properly. They do not change that legislation.
My noble friend Lady McIntosh asked about the level of insurance. The regulations do not change the prescribed level of insurance in any way. I agree with my noble friend that drones are a real threat and that is why we are taking action. We have brought in height restrictions and flight restrictions close to airports, but there is more to do on that. We will bring forward a draft Bill which will look at police powers, among other things.
Reciprocal cover on insurance is required under international treaties. That will continue to be the case. Our continued membership of EASA is a matter for negotiations, but we have made our position clear that it is in everyone’s interest that the UK should remain part of EASA. We have played a leading role in it and will want to continue to do so.
The noble Lord, Lord Berkeley, asked whom this insurance will cover. It will apply to all aircraft flying into the UK, including EU carriers, third-country carriers and UK carriers. Everyone who flies into the UK will be required to hold this insurance as a condition for their permit to operate in the UK. The noble Lord is right to point out the number of pieces of secondary legislation coming our way. There will be around 14 aviation SIs to get through.
The noble Baroness mentioned international treaties. Will those need to be redone because we are leaving the EU or are they ones to which the whole world is signed up and so there will be no change? In other words, did we sign up to them or did we sign up to them through the EU?
We signed up to the international treaties as a member state—as the UK—so we will not need to rejoin them. Obviously, EASA is a separate group of which we are a member as part of our membership of the EU, but we have signed up to the Montreal convention, for example.
Regarding the member states negotiations mentioned by noble Lords, sadly I have not been on a Europe-wide trip negotiating bilaterally with member states. We are working closely with the Commission on agreeing a liberal deal, and that kind of multilateral level agreement is our primary objective. We want to be as ready as we can be for when we leave the European Union, and so the noble Lord was quite right to point out that we have approached member states, but our preference would definately be a multilateral deal on that.
Turning to the questions from the noble Baroness, Lady Randerson, regarding the minimum level required and how low we could go. Just to be clear, it is not about reducing cover in any way. Article 7 sets out the minimum insurance for special drawing rights and that is carried across, so we will still have that same minimum level. I can assure all noble Lords that the amendments to regulations will be made only in response to an international treaty change.

Grand CommitteeMy Lords, these draft regulations would be made under the powers conferred by the European Union (Withdrawal) Act. They form part of the work being done to adjust our existing legislative framework in readiness for our leaving the European Union. The draft regulations, if approved, will make amendments to three Department for Transport fees orders to correct deficiencies in the orders arising from the withdrawal of the United Kingdom from the EU. This will be done by removing references to the Secretary of State carrying out functions to comply with EU law. Those functions will continue but under domestic law rather than EU law.
The fees orders themselves do not set fees, nor do they amend, raise or lower fees. They set out in secondary legislation the matters that can be taken into account when setting fees for delivery of the functions specified in the orders. For example, for any of the functions prescribed in the orders, account can be take of the proportion of the cost in providing staff, premises, equipment and facilities that are attributable to the carrying out of the relevant function. The actual fees for the functions listed in the orders, such as for driving licences, are contained in other secondary legislation. Generally, before any change can be made to the fee level in that other legislation, the Minister must first have the agreement of the Treasury, then conduct a consultation with representative organisations of those affected and consider the impact on stakeholders. The Minister must take account of that impact in deciding whether to proceed. Only after this process has been followed can the SI to change the fee be laid before Parliament.
The functions contained in the fees orders are all in the areas of road vehicles and drivers. They are carried out by three of the Department for Transport’s executive agencies: the Driver & Vehicle Standards Agency, the Driver & Vehicle Licensing Agency and the Vehicle Certification Agency. The functions that are relevant to the draft regulations are: driver licensing, vehicle registration, international road haulage permitting, vehicle type approval certification, the approval of tachograph calibration centres, international road passenger transport authorisation, licensing to operate public service vehicles, licensing to operate goods vehicles and, lastly, enforcement against UK and non-UK drivers and vehicles that break the law on these matters. The fees orders relate to both EU and domestic law, and the regulations before the Committee are concerned only with amending the EU-related aspects of the orders.
In conclusion, the amendments contained in this instrument are to ensure that the fees orders recognise EU exit but otherwise maintain the status quo. I commend the regulations to the Committee.
My Lords, I am grateful to the noble Baroness for outlining these regulations with such brevity and clarity. I have a couple of questions, though. As she said, they cover international agreements, driving licences, vehicle registration, public service vehicle operation and licences to operate goods vehicles. I believe we have added licences for trailer operation, or something, which we discussed in some legislation—I cannot remember its name now—a few months ago.
The Minister mentioned non-UK drivers. Does this change mean that the charges are going to go up? Did the European Union previously have any control or oversight or a role in setting these charges? It is always very easy to say that the costs of doing it are going up. There may have been some control or advice from Brussels as to how these things should be assessed and charged.
Lastly, the noble Baroness mentioned that there might be some changes to the licences of non-UK drivers. The impression I get is that licences from other member states will no longer be valid in this country. How do drivers get new licences and are they going to be charged a rate seen by most people to be reasonable—or is it going to be one of these Home Office ones that make you pay £500 to try to dissuade you from coming? I hope it is the former and not the latter. I look forward to the Minister’s comments.
My Lords, I thank noble Lords for their consideration of these draft regulations. As the noble Baroness said, I am afraid they are the first of many EU exit transport regulations. The purpose of these regulations is indeed to make minor and technical amendments to the three pieces of legislation that we are discussing, by amending the language used to take account of EU exit, but otherwise to maintain the status quo.
As I said in my opening remarks, the regulations themselves do not set, raise or lower fees. The fees orders are supplementary to existing powers that the Secretary of State has in other legislation, and that other legislation sets the fees. The regulations do not in any way extend the powers of the Secretary of State or relate to a change in the fees.
I turn to the questions that were asked. The noble Lord, Lord Berkeley, mentioned the Haulage Permits and Trailer Registration Act, as did the noble Lord, Lord Rosser. We have consulted extensively with the industry on that and we will be discussing the regulations under that Act soon. There is a government response to the consultation, which I will forward to the noble Lord, explaining where we are on fees. We will be discussing that soon.
As I said, the regulations do not set or change the fees themselves but merely set out what can be taken into account, so charges absolutely will not go up. There has been a role for the EU Commission in setting the charges in the past but there will not be after exit.
For the non-UK driver—an issue raised by the noble Lord, Lord Berkeley—EU driving licences will continue to be recognised in the UK post Brexit, as set out in some of our recent technical notices, so the charges for getting a GB driving licence will not change.
On the question of devolved Administrations, which the noble Baroness, Lady Randerson, mentioned, we are working closely with them throughout our entire SI programme—obviously more so on some which are directly relevant than on others, but on every one we are working closely with them. Some of the fees orders’ functions are GB-wide—for example, driving licences, as Northern Ireland has its own regime and its own legislation to set its own fees—while others relate to the whole of the UK.
The Minister mentioned that driving licences from EU member states will still be valid. That was in the technical note and I should have mentioned it; I am sorry. What about licences for vehicles? Are we involved in quotas and the like? If so, how would that work? Will a Bulgarian vehicle need a licence to operate in the UK?

My Lords, HS2 cost estimates and business cases are periodically updated as the scheme design is progressed to ensure that the scheme remains affordable and viable. HS2 Ltd is currently developing an updated phase 1 cost estimate, to be finalised prior to the completion of the phase 1 full business case accompanying the authorisation of notice to proceed in June 2019. The Government remain confident that the phase 1 cost estimate will remain within the SR15 funding envelope of £27.18 billion.
My Lords, I am grateful to the noble Baroness for that Answer. It is good that HS2 is regularly updating its budget, but it is a pity that no one knows about it. The last public budget given was in 2013, which is five years ago. Since then, we have had reports of the land purchase costs going £2 billion over budget and well behind, while a report in the Sunday Times last weekend by the consultant to the Infrastructure and Projects Authority using Treasury figures said that the project is up to 60% over budget and was in a “precarious” and “fundamentally flawed” position. Many other reports have also cited increased costs and delays. How can Ministers go on saying that they do not recognise the figures that are coming from all these different sources? Indeed, the Minister has almost repeated that today. Is it not time that we had a review of this project in costs and programme terms, because spending £100 billion with no budget for five years is surely not a good use of public money?
My Lords, I thank the noble Lord for his question, and I greatly respect his lifetime of experience in the rail industry. I am also grateful for the noble Lord’s continuing scrutiny of HS2. As I have said, we continually update the cost estimates, but we do not share the details of those estimates as they are commercially sensitive. However, the headline figures will inform the business case as published in 2019. I understand that the article in the Sunday Times was based on an end-of-role report from a few years ago, and of course we do not comment on leaked documents. HS2 does not recognise or agree with either the analysis or the figure it contains, while the Infrastructure and Projects Authority recently described the HS2 programme as on target to be completed on time and on budget.

Lords ChamberMy Lords, the scheme is part of a long-term strategy to better link the M3 and the south-east to the M5 and the south-west. Upgrading to a continuous dual carriageway standard will transform it into a high-quality route. Of course, the local residents will benefit from that. I am afraid I do not have specific information for the noble Baroness on compensation, but I will write to her. But, as I say, there will be benefits, both from the improved connectivity and the removal of rat-running through villages.
My Lords, can the Minister explain how long the tunnel underneath Stonehenge is? This issue has been around for 20 or 30 years and the tunnel gets longer and longer because the archaeologists keep digging up further remains at each end of it. Is this the end of the tunnelling, or are they going to find more remains to make it even longer?
My Lords, as the noble Lord points out, this is a key heritage site and we are being very careful when making our plans for this. The heritage site suffers significant congestion because the single carriageway carries significantly more traffic than it was designed for, and that is why the tunnel is important. The proposed scheme includes a free-flowing dual carriageway and a tunnel of at least 1.8 miles in length.

Lords ChamberMy Lords, we are committed to electrification where it delivers passenger benefits, but we must also ensure that it is good value for money. Where possible, we will also take advantage of new technologies to improve journeys without carrying out disruptive electrification works. I have not seen the details of the system mentioned by the noble Lord but we continually assess the investment decisions in our programme of railway upgrades to deliver passenger benefits in the best way possible so as to give passengers and taxpayers maximum value for money.
My Lords, while accepting that the Government have made progress in the devolution of railway issues, is it not time for much greater devolution of the infrastructure and train operation to the Welsh Government? The noble Baroness has talked about bimodal trains. The only reason we have those trains is that Network Rail has failed to electrify the track. Bimodal trains are slower, more expensive and more polluting. Surely the answer is to give the Welsh Government total control without the micromanagement that seems to come from her department.
My Lords, the Government made a commitment to devolve powers for the Wales and Borders franchise following recommendations from the Commission on Devolution in Wales, which I am very pleased that we have delivered. It is a good example of effective co-operation between the Welsh Government and the UK Government. On the devolution of infrastructure funding, we do not believe that it is desirable generally to reopen discussion on the Silk recommendations, around which there was no consensus. We do not intend therefore to revisit the question of devolving Network Rail funding, given the discussions on the issue during the St David’s Day process. Of course, we continue to work closely with the Welsh Government on the specification and funding of Network Rail’s operations.

Lords ChamberTo ask Her Majesty’s Government what assessment they have made of the funding they provide to Highways England and local authorities to ensure that roads are maintained in a safe condition.
My Lords, over £12 billion has been provided to Highways England and local authorities to maintain and renew the road network in England outside London in the six years up to 2020-21. This is a significant increase on previous years. It is of course for each authority to assess which of its roads need repair, based on local knowledge and circumstances, but the Government believe that the sums allocated are ensuring that roads are maintained safely.
I am grateful to the Minister for that reply, but many organisations will think that even that increase is nothing like enough. The RAC reckons that potholes cost drivers £100 million a year in damage to their cars. Cycling UK notes that in 2016, 64 cyclists were killed or seriously injured because of potholes. I nearly joined that rank when I fell into a pothole, which was under water, outside your Lordships’ House. The repair consisted of a white line painted round the pothole—and it is still there, three months later. On 13 June the Government issued a British road safety statement, which included measures to improve the safety and reduce the deaths of vulnerable road users such as cyclists, pedestrians and motorcyclists. Will the Government put that into practice, with more commitment? One idea would be to put an extra 3p per litre on the price of petrol, ring-fenced for potholes on local roads.
My Lords, we must certainly do all we can to reduce deaths and injuries on our roads. According to Cycling UK, over half of people say that they would cycle more if they were not so worried about the state of our roads. Potholes and poorly maintained roads are a menace for all road users—including noble Lords—which is why we are taking action to improve the condition of the local road network. In particular, the Department for Transport has allocated £296 million to the Pothole Action Fund, on top of existing funding. Noble Lords will know that fuel duty is most definitely a matter for the Chancellor, but I will certainly pass on the noble Lord’s suggestion.

Lords ChamberI am afraid that yet again I will have to disagree with my noble friend on HS2. Our railways are at capacity; we have seen the doubling of passenger numbers since privatisation, and HS2 is much needed to relieve that capacity and provide a better service for people across the country.
My Lords, will the Minister confirm that the trains which she pleasingly told the noble Lord, Lord Cormack, would be going to Lincoln will have enough seats for everybody in this House, and that they are not just two-car trains? More seriously, can she confirm that there is enough capacity on the branch line, and on the main line provided by Network Rail, so that these trains can be operated without any disadvantage to other services?
My Lords, I am afraid that I do not know the exact size of the trains on the new local railway. On capacity, moving towards the east coast partnership, as we are planning to do in 2020, will enable both Network Rail and the train operator to work closely together to ensure that we have enough capacity on all lines.

Lords ChamberI am grateful for the noble Lord’s explanation. It depends on whether the road is as defined in Clause 1(1)(a),
“roads or in other public places”,
on whether or not it will be a railway.
I want to point out that autonomous railways are happening at the moment. The centre section of the Thameslink railway is effectively driverless. It does not go very far—from Kings Cross St Pancras to Blackfriars—but it does not need a driver. Of course, a driver is there, but that is the state of technology on the mainline railways, and the underground railways and metros have done it for a long time. Whether the same number of passengers could be taken by these autonomous pods up a railway, road or whatever, compared with a 12-car train every two minutes with people standing is a debate we can have. But I am not sure that I would support widening this Bill to get that far.
I have also been studying a few issues related to the content of the Bill, and recently met the author Christian Wolmar who has written a book, Driverless Cars: On A Road To Nowhere. I recommend that the Minister and other speakers to read it; I am not going to give it away today. Without necessarily supporting what he says, there are issues relating to the human reaction to automation that are quite useful to study, including how close a vehicle can get to the one in front, and all the things we spoke about on Second Reading, which I shall not repeat today. It may take rather longer than some noble Lords think for all this to come about. We are certainly right to debate it now and to concentrate on common standards.
I certainly support my noble friend Lord Tunnicliffe. I think he was speaking to Amendment 8, which I did not know was in this group, but he made a good speech and I certainly support it.
My Lords, at the outset of this debate today on automated vehicles, I think it is helpful to set out what this Bill is trying to achieve. The provisions within the automated part of the Automated and Electric Vehicles Bill extend compulsory motor vehicle insurance to cover the use of automated vehicles when operating in automated mode, so that victims of an accident caused by an automated vehicle while driving itself will be covered by the compulsory insurance in place on the vehicle. The insurer would be initially liable to pay compensation to any victim, including to the driver who had legitimately handed control to the vehicle. The insurer then would have the right to recover costs from any liable parties under existing UK common law and product liability law.
The Bill therefore requires the Secretary of State to publish a list of automated vehicles which are,
“designed or adapted to be capable, in at least some circumstances or situations, of safely driving themselves”.
The purpose of this power is to allow manufacturers, owners of vehicles and insurers to know if the extension to compulsory motor insurance in this legislation applies to their vehicle. This will provide certainty to the automotive and insurance industries, as well as clarity to the public. The scope of the Bill applies to highly and fully automated vehicles only—that is, vehicles for which, when driving themselves, there is no monitoring or controlling role required of the driver.
This is broadly equivalent, as the noble Baroness, Lady Randerson, said, to levels 4 and 5, as defined by the Society of Automotive Engineers—the SAE—and does not apply to vehicles with lower levels of automated technology or utilising advanced driver assistance systems, no matter how sophisticated. It does not apply to level 3 vehicles, and the Tesla vehicle the noble Baroness mentioned would not be covered. We will come to this point later, but level 3 cars still require monitoring by a driver, so they are not fully automatic and are not covered by the Bill. It also only applies to automated vehicles that are or might lawfully be used on roads or in other public places in Great Britain.
I acknowledge the point made by many noble Lords on the narrow scope of this Bill. It was designed with a specific purpose in mind, and I look forward to hearing the views of noble Lords from across the House on the amendment from my noble friend Lord Borwick introducing more powers for the Government.
Regarding the first amendment of the noble Baroness, Lady Randerson, on the inclusion of vehicles manufactured and purchased outside Great Britain, there is already a long-established process, along with guidance on the GOV.UK website, which covers the permanent use of foreign-registered vehicles in the UK. As part of this process, any vehicle which drives on UK roads must already be type-approved. For temporary use of vehicles on our roads, through the Motor Insurers’ Bureau we operate a Green Card scheme—an international certificate of insurance to make sure that victims of accidents involving foreign-registered vehicles are covered. We think this process would be the same for automated vehicles and, therefore, do not think the amendment is necessary at this stage because all vehicles manufactured and/or purchased outside Great Britain will be covered by the existing text.
The Bill does not define automated vehicles by SAE levels, as proposed by the noble Baroness, Lady Randerson, in Amendment 2. This is because the SAE levels are generalised industry categories describing a broad capability, which could change over time. The type approval of an automated vehicle, the criteria of which have not yet been agreed, will not be carried out according to SAE levels of automation. Noble Lords may find it helpful to note that the UNECE working parties that set the international standards by which vehicles will be type-approved and used have rejected the SAE definitions because they do not meet the level of precision needed for regulation. Instead, they simply set out broad definitions.
The categories set out by the SAE are under continual revision. A direct link to the levels creates problems if the definitions move away from what is needed for the proper functioning of the Bill. I want to be clear: we are not rejecting the SAE levels. They are helpful, but they do not—the UNECE agrees with us here—meet the level of precision needed for type approval and regulation.
Could the noble Baroness explain what she means by “manufactured in Great Britain”? She is aware of all the Brexit debates about certificates of origin, and that bits and pieces and components go right across the world and back again. What exactly do we mean by “manufactured in Great Britain”? Is it just the name on the front?
Happily, the Bill covers vehicles manufactured in Great Britain and abroad: it covers any vehicle. I am afraid I do not have an exact definition, but I imagine that it is when the majority is manufactured in the UK. As I say, the Bill will cover all vehicles, wherever they are manufactured.
On Amendment 33, I am in complete agreement with the noble Lord, Lord Tunnicliffe, that we must ensure that all new automated vehicles are safe and secure for use in Great Britain. We have many amendments to come on that. We are working at the United Nations level to develop international requirements for vehicle manufacturers on both vehicle safety and cybersecurity. These standards, which are still being developed, will then form the basis of the type approval process which automated vehicles, like conventional vehicles today, must pass before they can be sold for safe use on British roads or in other public places, or get on to the Secretary of State’s list for insurance.
Based on the international UNECE standards, which the UK is actively contributing to, and our evolving domestic regulatory programme, we expect it to be very clear which vehicles, including their software, can safely operate in automated mode. We do not think it appropriate at this early stage to set too precise criteria.
My Lords, I entirely agree with the noble Lord, Lord Borwick, about “must” and “may”. It is interesting that the Government like to put “must” on its own. I am sure the Minister will have a view on that.
I have a short comment on Amendment 12, which is in this group. I support it. The Minister may say it is too early but, if you are going to have a written notice under proposed new subsection (2), surely the documentation, certificates or anything relating to not only the vehicle but the software, control system and everything else should be included.
My Lords, I am sorry to disappoint my noble friend on further regulatory powers in the Bill. As I said, I would be interested to hear views from noble Lords from across the House on further regulatory powers later but, at this stage, we are just not ready to make further regulation. That is why we have not asked for the powers.
The purpose of the list in Clause 1 is to allow manufacturers, owners of vehicles and insurers to know if the extension of the compulsory motor insurance in this legislation applies to their vehicle. The aim is to provide certainty to the automotive and insurance industries, as well as clarity to the public. As I have said, the list itself is not a mechanism to approve which vehicles are safe to use. This will be determined by future regulation, most likely based on international standards. The list in Clause 1 is simply to inform the insurance industry which vehicles require automated vehicle insurance.
My noble friend Lord Borwick’s Amendment 9, which replaces “must” with “may”, would imply that preparing, updating or publishing this list might be at the Secretary of State’s discretion. We believe it is right that the Bill imposes a duty on the Secretary of State, who “must” ensure that the list, comprising any vehicle that may lawfully be used when driving itself on roads or other public places in Great Britain, is published and kept up to date. If the list is not updated, people may obtain the wrong type of insurance, leading to difficulties for victims in securing compensation quickly and easily. As I said, this aims to provide certainty.
In order for the Bill to deliver the insurance framework that it is intended to—this is after consultation with the insurance industry—it is important to maintain the list as a duty on the Secretary of State. Perhaps this is something we can discuss further before Report.
Amendment 12 concerns the duty of a manufacturer to notify the Secretary of State. I understand my noble friend’s intention but, at this stage, it is not appropriate to legislate in this regard. There are already existing processes in place when registering a vehicle or notifying changes regarding a status of the vehicle, and we are working with the DVLA on how to replicate these processes for automated vehicles. We have yet to complete that work, so we do not feel it is the right time to legislate in this regard. I hope that, given this explanation, my noble friend is able to withdraw his amendment.

Lords ChamberCan the Minister confirm whether the cost of the permits that she mentioned will include just the operation of the system or will there be a requirement for hauliers to fund the setting up of some IT system that might, or might not, last several years or go wrong or anything else? I hope her answer will be that it is just the operation.
The noble Lord has read my mind. I was about to come to the fact that I can confirm today that these fees will cover only the day-to-day running costs. The Government will cover the set-up costs of the scheme, which is being funded by part of the £75.8 million we have received from the Treasury as part of our planning for exiting the EU. I hope noble Lords and the haulage industry are reassured by that. I fully agree with noble Lords that we want the greatest possible access for road hauliers, coupled with the lowest possible costs to hauliers, but we do not believe that we should be asking the taxpayer to pay indefinitely for permits.
Before I turn to the specific amendments, it may be helpful to set out some detail on current fees. Fees are already charged in relation to some of our permit agreements with non-EU countries. They are reasonably consistent. For example, there is an £8 fee for a single-journey permit to any country with which we have a permit agreement, such as Ukraine. In our agreement with Morocco, we charge £50 for a 15-trip permit. The ECMT permit—referred to in the regulations as an ECMT licence—which allows unlimited journeys for a year, costs £133. All those fees have been set on a cost-recovery basis and give a good indication.
The noble Lord, Lord Berkeley, raised reciprocity. First, on the number of permits, many international agreements, such as our agreements with Ukraine and Belarus, are permit-based and agreed under the principles of reciprocity. In circumstances where the agreed number of permits is used up, additional permits can be provided. We do that on a reciprocal basis because no country wants to limit the amount of haulage carried out. Under a future permits scheme, we would absolutely seek reciprocity in the number of permits so that neither side is limited and we are confident that that can be achieved. In the first group, we discussed amendments relating to negotiation objectives being in the Bill, and the Government remain of the view that they should not be included in the Bill.
Secondly, on fees, the arrangements for issuing and charging for permits are handled at a national level and the UK has no agreements with other countries that address the cost of their permits. We are not aware of any international road haulage as said, but? arrangements that has such an agreement. We set our own fees for UK hauliers and other countries set their own fees, including for permits for travel to the UK. To give some examples, in Ireland there is a separate fee for Community licences that we do not have. The Netherlands charges fees for both applying for and issuing ECMT permits, whereas we currently charge only for the issue of a licence. Other countries’ fees can be higher or lower than the fees charged in the UK, depending what the fees choose to cover.
Looking at equivalent charges in other countries, I mentioned the single-journey permit. The equivalent permit in the Netherlands costs around £4, slightly less than in the UK, but in Finland it costs £35, which is more than in the UK. In Norway there is no charge for permits, but it charges around £98 to issue a Community licence. While we charge £133 for an annual ECMT permit, it costs around £219 in Serbia, and in the Netherlands there is a fee of around £302 for applying and a further fee of around £121 for issuing the permit. I am afraid I have no details of some of the new EU members which the noble Lord mentioned. It is proving quite difficult to get hold of the details, but we will get them and consider them when setting fees.
If we have permits and seek an agreement on fees, other countries may wish to charge more. I think the examples I have given show that there is quite a lot of disparity between the charges. We do not want to seek reciprocity on fees because it could be unnecessarily complicated and it has never been done before, which may delay our reaching an agreement. As noble Lords are aware, we are keen to get an agreement in place as quickly as possible.
If we end up with a permit scheme, we may have to introduce fees, and we expect that other countries would do the same. They could be higher or lower than the fee charged in the UK depending on what the fees cover. While we will look at the international comparisons, the best we can do is to make sure the costs are as low as possible for hauliers.
As to exactly what the fees will amount to, I regret that I am not able to provide exact figures because that will depend on the negotiations and the cost of administering any permit scheme as required. However, I repeat my assurances that if permits are needed, we want to keep the fees as low as possible—in the region of the existing permit fees that I have referred to.
Noble Lords are right to highlight the impact of these fees on the haulage industry. We intend to have one set of regulations and permits that will include fees, and I am pleased that the later government amendment on affirmative regulations means that noble Lords will have the opportunity to discuss those fees. Prior to the fee being set, we will of course consult fully with industry, including small and medium-sized businesses. I absolutely acknowledge the noble Baroness’s point that it has more effect on them than it does on the bigger hauliers. That is something that we will consider. The government amendment on consultation that we will come to later will make that consultation a statutory requirement.
I sympathise with the aims of the amendments but I hope noble Lords will agree that the costs are best met by charging fees for permits on a cost-recovery basis. If the permits are needed, the Government are committed to covering the set-up costs of the scheme and will do all we can to keep those day-to-day running costs as low as possible. The fees, if needed, will be discussed carefully in the consultation and will be subject to further scrutiny from noble Lords should our later amendment on the affirmative resolution be accepted. However, I confirm that we aim to keep the costs as low as possible. With that, I ask the noble Lord to withdraw his amendment.
I am grateful to the Minister for that detailed reply. I had understood from our debates in Committee that there might have been one opportunity for us to negotiate the amount of charges with the EU as a whole. That is clearly not the case and the examples that she has given indicate that my amendment is not a good idea at all, which I now accept. All I can say before withdrawing it is that her department will have to negotiate with not just 26 member states but quite a few other countries around the outside. I hope she has enough staff with the right expertise to do that so that we do not have the cliff edge we were talking about earlier. However, I am very grateful for the information that she has given us, and beg leave to withdraw the amendment.
My Lords, in Committee, a number of noble Lords brought forward amendments to require the Government to analyse and report on the impacts on the efficiency of the UK haulage industry of any permit scheme that might be introduced, and to report on the Government’s intentions, expectations and achievements with regard to future arrangements with the EU. While we have been clear that we are seeking continued liberalised access to the EU, I recognise the concern about any impact of a limited scheme on the haulage industry. I gave an undertaking to the Committee that we would publish details of any permit scheme as soon as they were available. I also undertook to consider how best to review the impacts of any permit scheme, should one be required.
The new clause proposed by the Government requires the Secretary of State to lay an annual report assessing the effects of any restrictions on the haulage industry. We already issue permits to UK hauliers to travel to some non-EU countries where we have agreements that require permits. This amendment would be triggered only where the UK has struck an agreement with at least one country that is a member of the EU that requires a permit scheme, and where there is a limit on the number of permits available for hauliers travelling to EU member states.
The amendment also sets out the length of the reporting interval. If an assessment of the effect of a permit scheme is to be of value to Parliament and to the industry, sufficient time must pass to enable the effect to be assessed and evidence to be gathered to inform that assessment. Setting the timing of the obligation to report for the first time as one year on from any regulations coming into force will ensure that the actual effect of the regulations is properly assessed. The Government believe that the amendment they have laid imposes a proportionate obligation to assess and report, while addressing the concerns that were raised in Committee. I beg to move.
My Lords, I welcome this amendment, as far as it goes. Again, we debated this in Committee. The noble Baroness has tabled the amendment after Clause 8 and explained very clearly its purpose. However, when I read it, I said to myself, “What are ‘relevant restrictions’?” It is not included in the definitions and, although she has explained it, in the cool light of day when the Bill becomes an Act, I would read it and say, “Whatever is that?” Could she look again at that and either clarify it or come back with a definition at some stage?

Grand CommitteeI understand the noble Lord’s point. Sadly, I cannot speak for what will happen in the EU until we have concluded the negotiations. Within the UK, that is absolutely the idea: there would be a system to check on these permits. The noble Lord makes a very good point: we will seek to minimise corruption in future, but that will be subject to negotiations.
On the issue of fraud, I have come across people involved in the delivery of trucks. There appears to be a way you can avoid being limited in your hours by the tachograph because it does not stay with the person, it stays with the truck. That has probably been the case for 20 or 30 years. What have we learned from that and how will we prevent the same thing happening in future with these licences that my noble friend has spoken about?
Absolutely. I agree with the noble Lord that that has happened in the past. We are working with the DVSA on how to better enforce compliance, on both this and future licensing systems, and we will continue to do so.
My noble friend Lord Moynihan mentioned the tripartite agreement between the UK, France and Ireland. We have been looking at how best to ensure that the racing industry is not affected by this Bill and is protected. However, I will take away what he said and will look at it.
The clause as drafted ensures that there has to be a direct agreement between the UK Government and the Government of Ireland before any such scheme is introduced. It aims to avoid exactly that.
Does not the question of requiring the Government of Ireland to consent to the use of permits apply to the whole European Union? In other words, are we allowed to use these permits unless the EU accepts them as a valid document? Does that not apply equally to the rest of the EU, not just Ireland?
The permits would need to be recognised by the EU to be used. As I said, this is an extra clause to ensure that we can also have a separate agreement between the Government of Ireland and the Government of the United Kingdom before anything is put in place.
Before the Minister responds, I will widen the question a little. My noble friend mentioned the example of a lorry starting in Dublin and going through the UK to the continent, and asked whether it needs a permit. That is why I tabled Amendment 14B, which we shall come on to in due course, to ask whether foreign trucks need a permit to enter the UK. Surely it does not make any difference whether it is delivering from Dublin to the UK or going through the UK to deliver to Paris, as it still needs the same licence. Is my assumption correct?
The noble Lord is correct. We will move on to discuss cabotage, which is an incredibly important issue, whether it be for Republic of Ireland hauliers or UK hauliers. We continue to work with industry to understand its needs. We have spoken to those within the island of Ireland and to a certain extent those in the EU about the Bill. As I said, the exact arrangement on cabotage will be subject to negotiation, so I cannot provide a precise answer at this stage on exactly what that truck from the Republic of Ireland travelling to the UK and on to France will need, because it will depend on the outcome of the negotiations.
As I said, the clause is an attempt to provide clarity on the issue around the island of Ireland. I will take away noble Lords’ comments, consider them carefully and look again at the wording. The reason for this provision is to single out a potential issue and provide reassurance that there will be no hard border in Northern Ireland. Noble Lords may not agree that it does that, so I will take it away and look at it in detail. But for now, I ask the noble Lord to withdraw his amendment.
I am grateful to the Minister for some pretty long and detailed explanations. I can see the political need for something like this. On the other hand, when one sees what has been going on in the last six months, where the Irish Government have clearly allowed the European Commission—probably quite rightly—to do all their negotiations for it as just another member state, that gives cause for reflection. I shall reflect with colleagues and, in the meantime, I beg leave to withdraw the amendment.
The reason we put these two methods in the Bill and left other criteria and approaches for the regulations is based on legal advice. Perhaps the Committee would allow me to set it out.
Although there is no specific reference to the exercise of discretion in the Bill, all regulation-making powers and the regulations state that the Secretary of State “may make provision”, which obviously involves the exercise of discretion. Decisions on the allocation of permits will involve an element of discretion in both setting the criteria and applying them to determine which operator gets a permit. Discretion in the Secretary of State’s decision must be in accordance with public law principles, so it must be lawful, rational and procedurally fair, and decisions may be challenged by way of judicial review where they do not comply with those principles.
To be clear that the Secretary of State is able in certain circumstances to allow the use of first come, first served or random allocation, they have been included in the Bill. Where the criteria set out in regulations and guidance are not sufficient to allocate all the permits, the Secretary of State is able to use that discretion to allocate permits on a first come, first served basis. It is best included in the Bill in accordance with public law principles.
I understand the noble Lord’s point. We have had extensive discussion on this. It is based on very clear legal advice that if we were not to include it, we could not use it at any point. Although we do not want to use it for the allocation of permits, because I entirely agree that that would not be fair, I will take it back and discuss it further with the legal team to clarify. I understand why it standing alone in the Bill causes concern.
I am grateful to the Minister. While she is doing that, could she come up with some precedents where the first come, first served principle has been used and, if it is buying tickets for sporting events, or whatever, whether it is appropriate for this?
I certainly will. As I said, we currently use it in certain non-EU agreements, but this is obviously the first time we will be partially using it in an EU-UK agreement. Let us not forget that we are all hopeful that we will not need to include it, but if we do, it is incredibly important that we get it right in order that it is fair. I will take it away, discuss it further and see whether we can get across the same principle and ensure that we are not subject to legal challenge in a way that is more acceptable to noble Lords.
When my noble friend takes it away, can she also have a look at why we do not simply auction the permits? We auction all sorts of things: oil exploration rights, for instance. They are very valuable and they are auctioned. That seems a much more sensible way to allocate a scarce resource rather than first come, first served, which seems to have all sorts of difficulties alluded to by the noble Lord, Lord Campbell-Savours, although he shakes his head vigorously.
My Lords, these amendments set out requirements to report on a range of matters related to road haulage, from the allocation of permits to forecasting how a permits regime will affect the efficiency of road haulage, what our future arrangements will be for transporting goods, the cost to the road haulage industry and the permit arrangements for foreign hauliers. As noble Lords have made clear, road haulage is essential to our economy. It is an indispensable enabler of much of the wider economy, too. I appreciate that the Committee’s concerns here are how the permits system may affect the movement of haulage between the United Kingdom and the EU, and any impacts on UK hauliers and the wider economy—the direct financial impacts to industry and the wider economic effect.
The key impact for hauliers alongside the use of permits, as highlighted by many noble Lords, will be any restriction of trade and the possible friction at borders, which is why we are obviously doing what we can to reduce that. I am afraid I cannot give any further information on the wider negotiations currently taking place, and can only repeat that a future partnership is in the interests of both sides.
In implementing this legislation, we will bring forward a straightforward system that minimises any additional burdens or costs for business arising from the scheme. I previously set out that there will be no new transport checks required at borders. The noble Lord, Lord Berkeley, proposes that we produce a report outlining the content of any agreement on the allocation of permits, if they are required. When our agreement with the EU is settled, we will of course ensure that the haulage industry is properly informed and educated. As he predicted, I can say that we will publish the details of that scheme as soon as it becomes available. I am not convinced of the need to enshrine in the Bill the requirement to lay such reports before Parliament, as the information will be in the public domain.
Within the other amendments, Amendment 12 proposes that one month after the Bill comes into effect, and thereafter on an annual basis,
“the Secretary of State must lay a report before both Houses of Parliament containing a forecast of how the permits regime will affect the efficiency of haulage”,
while the noble Lord, Lord Berkeley, has tabled an amendment about reporting within three months of the Bill coming into effect on the arrangement of the allocation of permits. I will address those together.
Although I cannot provide detailed forecasts of the impacts on the haulage industry while we are in negotiations as we do not know the final deal, as I have said, we are aiming to continue the existing liberalised access we have today. Again as predicted, this time by the noble Lord, Lord Bassam, I do not believe that a requirement in legislation to produce a report containing analysis of how the permits scheme has impacted haulage is appropriate, or indeed even possible, one month or three months after the Act is passed as suggested, as negotiations may still be concluding.
However, I absolutely agree that it is incredibly important that the impact of any EU permit scheme—if that is required, and we are obviously all keen that it will not be—is assessed at an appropriate stage to take into account the application of the agreement itself, the administration of the scheme and the effect it will have on industry. If we need any new permit scheme, it is unlikely to have gone live within the timescales suggested, and we would not be in a position to provide any evaluation of its impacts. As I have said, we will publish details of the scheme as soon as they are available, but I absolutely recognise that there is a need to review the impacts. I will consider how best to do this ahead of Report and come back to noble Lords on that.
The noble Lord, Lord Campbell-Savours, made a point about information. Where possible, we aim to use existing information provided as part of the operator’s licence, and of course we will consult on all additional information needed and will aim to minimise that. He helpfully highlighted previous requirements, which certainly seem excessive to me. If we can use the negotiations to simplify the information needed on permits, we should certainly do that. As the noble Baroness, Lady Randerson, said, this should be as simple and straightforward as possible.
I turn to the amendments on foreign hauliers. The Bill is not directly concerned with the operation of foreign hauliers in this country, except to the extent that Clauses 10 and 11 allow for derogations from a permitting scheme in emergencies. With the exception of Clauses 10 and 11, the Bill is solely concerned with requirements on UK hauliers operating internationally and provides powers only for the UK Government to issue permits to UK hauliers. But in light of the amendments, and because how EU hauliers are treated in the UK is incredibly important, it is probably helpful to outline the Government’s current thinking on international hauliers operating in the UK.
As noble Lords have pointed out, foreign hauliers play an essential part in freight movements between the UK and the EU. Foreign-registered HGVs carry more than five times as much freight as UK-registered HGVs, hauling 40 million tonnes between Great Britain and the other 27 EU member states. While the UK remains an EU member state, we participate in the Community licence scheme, an EU-wide scheme that permits a haulier licensed in one member state to operate across the Union, including some cross-border and within-border trade in other member states. The arrangements we make with the EU should, of course, be reciprocal. Whether we will require a permit scheme for foreign hauliers, and how it will work, will be subject to negotiations with the EU in the same way as whether UK hauliers will require a permit in the EU.
If future arrangements require permits for UK vehicles to travel to the EU, it follows that EU vehicles would require permits to travel to the UK. If we did require a permit scheme it would be for other member states, rather than the UK, to organise the issuing of their own permits. That would not be something the UK Government did. How they allocate these will be up to them, but we will discuss this with them in detail. I would be interested to hear their thoughts on first come first served and random allocation. That is why the Bill does not address this.
I thank the Minister for her explanation. To be clear, if each member state is to be allocating permits, what about the quantity for each state? Will there be more permits in total than we want and will we be able to limit them? How is it going to work? Will the European Commission do it? I think that would be a pretty good disaster, but it is for it to decide.
The noble Lord is quite right. We think it is best to negotiate this as an EU-wide agreement. Bilateral agreements remain an option should we need them, but we very much hope that we do not.
Is there a precedent in the negotiations with Ukraine, or another country outside the EU? Does Ukraine negotiate bilaterally with every other member state or with the EU, and are the lorries allowed to roam freely within the EU once they have got in?
Our current agreement with Ukraine is negotiated through the EU. I believe that Ukraine has an unlimited number of permits. I will go back and look at specific examples. Most of these negotiations are done with the EU as a bloc, as I say, not bilaterally.
This came up at Second Reading, and we have consulted extensively with the horseracing industry to ensure that it does not affect it. Our understanding is that all-in-one horseboxes—as I will call them again—are used rather than trailers, so they would not be affected by this legislation, but we are working with the industry to ensure that this will not affect it.
The reason why I set out how we deal with this in legislation is to make the point that there is a system there for us to do it through the withdrawal Bill and the Goods Vehicles (Licensing of Operators) Act, which is why we have not addressed it in the Bill, which relates solely to UK hauliers. However, as I say, we are hopeful that we will not need to use it.
Before we leave that, I think the Minister is arguing—obviously, I will have to read the record afterwards—that we do not need these amendments because it is already covered by existing legislation. However, I would be interested to know two things. My noble friend Lord Campbell-Savours talked about the difference between owned goods in a lorry and third-party ones. Is that condition still there, and do we have to take it into account? After the noble Baroness’s intervention earlier, would it be possible to have a total list of all the different permissions that are needed to carry goods out of and into the country? I could put it down as a Written Question, but it is easier to ask it now. It would be quite interesting to have such a list of what permissions one needs. I do not suggest that the Minister answers this now.
The noble Lord makes a valid point. I will have to go back and look at that in detail and come back to the Committee in writing.
As was covered earlier when we were discussing the reporting requirements, I agree that we must consider the impacts of leaving the EU on the haulage sector. That should cover both UK and foreign hauliers. We need to come up with a form of reporting on this; I do not believe it needs to be in the Bill, but I will consider that and come back with a proposal ahead of Report. Once again, I welcome the discussion that this amendment has enabled, and I ask the noble Lord to withdraw his amendment at this stage.
I am grateful to the Minister. She has been very patient with the questions from me and other noble Lords. Obviously I shall reflect on what has been said. In the meantime, I beg leave to withdraw the amendment.
My Lords, the idea is that a lot of foreign trucks are going to be inspected. It does not happen at the moment very much, and if it is going to happen in future, there will have to be a very large increase in the number of inspectors and locations for inspection. The profit margin of most of these operators is very low, so the cost of a permit, which, as the noble Baroness said, may be only £50 to £85, may be quite a lot to some people. I am more concerned that it appears that EU lorries coming into our country will not have to pay anything because they already have a permit from their own country. Are we giving them an £85 advantage just to come here? I assumed that we would be able to charge them to give them a permit, but, as the noble Baroness said earlier, they already have a permit. There is something out of balance here. I do not know what the solution is, but I hope that the Minister can look at this. Perhaps we should have our own permit scheme, or else it should be free for everybody. It does not seem fair at the moment.
My Lords, this clause creates fee-charging powers for administering a permit scheme, which, understandably, is a key concern for the UK haulage industry. I am grateful to the noble Baroness, Lady Randerson, for giving us the opportunity to discuss the issue in detail.
The regulations under this Bill will apply to all the permit schemes that the UK has. Once we have introduced a robust legal framework for permit schemes it would be both necessary and sensible for the regulations to cover all schemes. They would therefore apply to potential permit arrangements for EU member states, existing and future permit arrangements with non-EU countries, and ECMT permits. This means that fees for permits for different countries can be consistent and consolidated in a single set of regulations.
What about the HGV levy system and the technology behind it? It uses ANPR to enforce it, so I should have thought that it would work automatically.
The noble Lord and my noble friend make important points. Of course, we want to use IT systems whenever we can both to minimise the burden for hauliers and for Government to check on these things. The permit system may not be allocated to a specific truck; it could be allocated to a haulage company. That may be difficult, but we are exploring it. The current system is that the DVSA outside the port will pull over a truck and check it on the side of the road. That is one of the options that we are exploring. If there is a way to do it that is less expensive and more efficient, we will certainly do that.
That is very interesting. I thought the permit would be allocated to a truck. If it is not, there seems to be more potential for fraud—by photocopying, for a start.
The reason we do not think the permit will be allocated to a specific truck is to allow for flexibility, should there be a limit on the number of permits. It will enable hauliers to move them between trucks, so they are not restricted to only one truck going back and forth to Europe. On fraud, we are designing a system to try to ensure that it will be allocated to a specific company. It may give us the number of trucks that could use the permit. We could check the licence plates and other things. We are working through the issues on that. I hope that that explanation will satisfy the noble Baroness.

Lords ChamberWe are working with the existing IT system at DVSA, so there would be no additional contract. I can certainly provide the noble Lord with further details on that.
The noble Lord, Lord Teverson, asked about the implementation period. Obviously, this is being discussed. The Government have been clear that the implementation period will be based on existing rules and regulations. I hope that we will reach agreement on that soon, which should provide some reassurance to industry.
The noble Lord, Lord Bassam, asked about the recognition of driver qualifications. The treatment of drivers’ certificate of professional competence will—again—depend on the outcome of negotiations with the EU, but our objective is absolutely to ensure that following our exit from the EU, CPCs will continue to be recognised.
The noble Lords, Lord Teverson and Lord Berkeley, asked about access for foreign hauliers, including cabotage. These, again, are important issues for negotiations that we are considering carefully for any future arrangement. In any scenario, there is existing domestic legislation to provide appropriate access for foreign hauliers coming to the UK, so the Bill does not address that specifically. However, as the noble Lord, Lord Berkeley, pointed out, it is an important part of the negotiations, and it will obviously be part of the discussions.
The noble Lord, Lord Tunnicliffe, and others mentioned ECMT permits. The permitting system operated by the European Conference of Ministers of Transport is an international agreement entirely separate from the EU and will not be part of our negotiations. The ECMT permits currently allocated to the UK are little used and we have absolutely no intention of allowing them after we leave the EU.
As much as I would love to give the noble Lord, Lord Bassam, a timeline for our transport negotiations, I am unable to do so. We are working closely with industry to understand its requirements and priorities, and have been doing so since the result of the referendum. We represent those views to the Department for Exiting the European Union. That department and the Department for Transport stand ready to move forward with the transport negotiations as soon as they begin.
The noble Lord, Lord Snape, spoke about optimism. I agree with him that we do not want to return to rationing. We are optimistic in these negotiations and am pleased that at least my noble friend Lord Attlee shares that optimism. It is absolutely to the mutual benefit of us and the European Union that we maintain liberal access; 84% of the freight transported between the UK and continental Europe is operated by EU hauliers, and it is in both our interests that we have a successful outcome.
If this goes ahead and we have licences here for drivers and trucks to operate on the continent, we will presumably need some approval process. Perhaps it would not be a taxing system but it could work alongside the customs declaration for all the 80% of foreign trucks coming into the UK—either into Northern Ireland from the Republic or from the continent. Has that been taken into consideration?
Certainly not in the context of the Bill. I apologise for going back to this, but exactly what that will look like is a matter for the discussions with the European Union as part of the negotiations.
The noble Lord, Lord Snape, asked about the reservations to the Vienna Convention on Road Transport. We will be making reservations in respect of six sections of the convention, relating to jaywalking, parking direction and so on. They apply only domestically and will not affect the other countries. It is usual practice for countries, on ratifying the convention, to put forward such reservations. We do not expect there to be any issue on that.

Lords ChamberMy Lords, I rise to move Amendment 1 and speak to Amendment 3, which is grouped with it. Amendment 1 would replace “on a journey” with “moving or ready to move”. At Second Reading and in Committee, the definition of “on a journey” was the topic of extensive discussion and I am grateful to the noble and gallant Lord, Lord Craig, and the noble Lords, Lord Trefgarne, Lord Balfe and Lord Rosser, who contributed to those discussions and made such helpful suggestions.
Our intention in the Bill has always been to capture when a vehicle is in motion and also when it is stationary but about to travel, as there is still a safety risk if the person in control were to be dazzled or distracted at this stage. This includes journeys of any length and journeys that begin and end in the same place, such as training flights. It also includes taxiing in the case of aircraft, as well as temporary stops, such as at a train stations, bus stops, traffic lights or when waiting to take off. To clarify this, the Government have laid the amendment to remove the references to “journey” and refer instead to when a vehicle is “moving or ready to move”. This wording is wider than “journey” and removes the ambiguity of what actually constitutes a “journey”.
To strengthen this further we have, in Amendment 3, defined that when a mechanically propelled vehicle’s engine or motor is running, it should be treated as being ready to move. It is important that we include all safety-critical points, for example when an aircraft is at a stand, as this could have safety implications for persons on the ground in the immediate vicinity. The amendment does not change the policy intention of the Bill but does provide greater clarity, which I hope noble Lords will welcome. I beg to move.
My Lords, the noble Baroness and the Government have made some good changes to the Bill, but I have one or two questions, which I am sure she will be able to answer. They relate to the definition of a “vehicle”. The word “vehicle” appears in Clause 1(1)(a)—“on a journey”, as the noble Baroness said—and subsection (2). She is then introducing—on page 2, line 9, through Amendment 3—“a mechanically propelled vehicle”, which seems to substitute the wording of subsection (6), which includes an,
“aircraft, motor vehicle, pedal cycle, train, vessel, hovercraft or submarine”.
I am glad she has got rid of some of those because that could be quite difficult.
However, she goes on to say in the interpretation—I know it is not in this group but I might as well mention it now—that Clause 7 defines an aircraft, but a “vehicle” also includes an aircraft. Presumably you can get done both ways, in either Clause 1 or Clause 2 or something. Perhaps she could explain whether these definitions include trains or bicycles, I just wonder whether a little bit of tidying up might be a good idea before the Bill reaches the statute book.

Lords ChamberMy Lords, I detect a certain amount of ducking and diving in this very long Statement. I congratulate the Minister on keeping a straight face on some of it. However, the role of Network Rail is not mentioned at all. My understanding from several sources is that Stagecoach’s contract was based on Network Rail undertaking a large number of enhancements on the east coast main line so that Stagecoach could run more trains, and, presumably, get more revenue. This has not happened because, apparently, Network Rail has run out of money. Surely the answer is to give Network Rail the money to do that and not blame Stagecoach for everything that has gone wrong, as I think that most of the blame lies within the department and its own infrastructure manager, Network Rail. Perhaps the Minister would like to comment.
My Lords, I agree that there is no simple reason why the franchise has failed; there are a number of reasons. The east coast has not performed as expected. It can be attributed to external factors which were not predicted. For example, the decrease in petrol prices resulted in increased competition. On the enhancements, from the start of this franchise to date all the infrastructure upgrades planned for the east coast have been delivered. Further upgrades for the route are planned but were not due to be completed by this stage. It is clear that Network Rail’s overall performance has not been satisfactory in recent years and we need a change within the business to deliver a more customer-focused policy. Network Rail has committed to transformation and an efficiency programme of change. That will see it judged on the performance it delivers for passengers in partnership with train operators. We continue to push Network Rail to devolve to ensure that there is one route managing director directly accountable to passengers.

Lords ChamberMy Lords, we broadly accept the recommendations of the NAO report. We accept we have made mistakes and are learning lessons. I assure the noble Baroness that we will put passengers at the forefront in our future franchising decisions. We are listening to passengers and acting on what they tell us. We are opening public consultations as part of the franchising process and will use the responses to inform our decisions.
My Lords, could the Minister explain one thing in the National Audit Office report? It said that the timetable that the Department for Transport agreed could not, according to Network Rail, be operated and that it was trying to put too many trains on the line. I understand there is the same problem on the east coast main line, which is why things have gone wrong there. When will the Government look at the timetables, with Network Rail, before they let franchises?
My Lords, the department did take National Rail’s views on feasibility into account. As part of the evaluation of the bids for this franchise, and indeed all franchises, we look at National Rail’s concerns. It had concerns about all of the bidders’ timetables propositions in this instance, although Govia’s proposition had a lower risk rating than other bidders. Network Rail said that the proposed timetable needed more development at the beginning of the franchise, and we agreed with that. The Thameslink timetable was some years off, and the project, as the noble Lord knows, was a complex one. We always accepted that more work would need to be done, and we have been working with Network Rail to finalise the timetable. I agree with the noble Lord that we need to work more closely with Network Rail to make sure that the timetables can be delivered in the future.

Lords ChamberI thank the Minister for repeating the Statement, and congratulate her on some of the things in it. Now is the time to see what can be and will be delivered. It sets out in a very positive way the contestability of some of Network Rail’s costs and how other contractors can do enhancements. I like the list of new openings and enhancements, some of which I have been involved in. I notice that something dear to my heart and that of my noble friend the Chief Whip is missing from the list—the reopening of the Lewes to Uckfield line. Perhaps the Minister can say why it is not included.
My biggest concern is the structural issue of the east coast main line, which is mentioned a lot in the report. It is easy to say that having the passenger and the Network Rail operators work together is a good thing, but there are open access operators and freight. I declare an interest as chairman of the Rail Freight Group on that line. The passenger figures for the open access operators on the east coast main line are very positive, so competition has brought benefits, not just to the traffic on the main line but to some of the other places served. Can the Minister explain how what the Government are trying to create as a big monopoly is going to protect the interests of the other open access operators and freight on a vital artery?
As for the specific line the noble Lord referred to, the ones used in the strategy were just examples of lines that could be reopened; of course there are many others across the country. As I said, we will look into the economic case for all of them. On the east coast partnership, I acknowledge that the increased competition has led to increased numbers, but we believe that that suggested partnership between private and public ownership will be the best solution for the passengers. On freight, we think that joining up the track and train will benefit freight as well. We will ensure that those interests can contribute to the decision-making process on the franchising, and on the use of the rail lines.

Lords ChamberTo ask Her Majesty’s Government what detailed information they have provided to (1) HMRC, and (2) the transport and related industries, to enable planning and procurement for delay-free border crossings between the United Kingdom and European Union member states immediately following the United Kingdom’s withdrawal from the European Union.
My Lords, a number of government departments, including HMRC, are working together to ensure a co-ordinated approach to our exit preparations for the border. The Department for Exiting the European Union has established clear governance arrangements to scrutinise and assure policy development on exit across Whitehall. The Government continue to engage with a wide range of businesses on exit readiness and are developing border plans through discussion with industry bodies, including ports and airports.
I am grateful to the Minister for that Answer, which I might refer to as motherhood and apple pie—it is a nice piece of pie, though—but I wanted some detail. Perhaps I can offer her some detail; I have just received it from MDS Transmodal, which compiles statistics across the channel. Apparently, in 2014, just-in-time deliveries—the ones that could be held up most by customs—were valued at £282 billion. That includes £30 billion of fruit and veg and temperature-controlled goods, but also parts for aircraft, cars and other manufacture. If those do not operate, where will the businesses—Toyota, et cetera—go? Will the Minister congratulate the only person who has put his head above the parapet, someone called Jon Thompson, who runs HMRC? He was reported in the Sun on 30 October as saying that it might take five years to set up a post-Brexit customs system that worked. What are the Government going to do in the meantime?

Lords ChamberMy Lords, shining a laser at pilots or drivers is of course incredibly dangerous, and we are looking at how to address that. The legislation I am discussing today refers solely to drones and not to lasers.
My Lords, can the Minister explain to the House who is going to catch the perpetrators who fly drones illegally? What are the Government going to do about it, and what kind of penalties could there be? There are so many flying around today—who is going to identify and catch them?
My Lords, as I mentioned, we will extend police powers in the legislation. I am sure your Lordships understand that it is sometimes a challenge to link an operator to a drone. We are trying to help address that by introducing a registration system, and we are investigating electronic identification. We are looking at putting powers in the legislation for the police to require drone users to produce registration ID and documents and to land their drones, and to search for and seize a drone when there is reasonable belief that a crime has taken place. We very much hope that that will enable police to capture people who are misusing drones.
