As was the case during the passage of the Bill, there is a great deal of unanimity. Can the noble Baroness send a message back to her department that whatever the outcome of the next general election and whoever is sitting in the place she now occupies, this is a matter which, while there are one or two doubts, enjoys broad agreement that there should be equality and that the legislation in this form should be implemented at the earliest opportunity?

My Lords, it is important and indeed incumbent on those of us who are in heterosexual marriages to express our support for the sentiments uttered by the noble Lords, Lord Collins and Lord Cashman, and the noble Baroness, Lady Barker. That is because it is easy for these issues to appear as though they are being pushed by just one section of society. Therefore, I want to say how strongly I would like to see the elements which still need to be resolved here being addressed in the future. I have a feeling that the Minister feels similarly. In art as in social policy, a leap of a mile is often required to gain an inch. In this instance, the Government have gone a long way further than an inch, but I take this opportunity to encourage them to aim for the mile in the near future.

I will add just a note on the words of the noble Lord, Lord Lexden. I have enormous sympathy for his point about siblings, but there is a certain sense of Groundhog Day here because I can remember the same noble Lords talking about this. I cannot help feeling that this is a slightly different issue, although that does not mean that it is not one which the Government should tackle in due course.

My Lords, I am all in favour of civil partnerships for heterosexuals and of them being converted into marriage. However, I am a bit puzzled, because the argument for civil partnerships for heterosexuals is that they want to avoid the patriarchal nature of marriage—but, of course if you enter into a civil partnership, and good luck to you, you will take upon yourself all the financial and other burdens and unfairnesses that come about in marriage if you split your civil partnership; it will be just the same. Still, people should have the choice.

I want to say, in support of the noble Lord, Lord Lexden, that over the years I too have argued for protection for two people who live together, whether they are sisters, strangers or people in a legal partnership whose financial and social position depends so much on the way the state treats them, through tax law and, especially, inheritance law. I do not accept the argument that to give support to, say, siblings or a father and daughter would in any way undermine the respect due to civil partnerships and marriage.

So I hope that this goes through and that civil partners will be allowed to convert if they want to. I also feel that heterosexual civil partnerships will mean that there will not be any more call for extending the oppressive and unfair law we have at the moment regarding financial provision on split to cohabiting couples. If they choose to cohabit and do not want civil partnerships, which are readily open, good luck to them; they ought to be free of the law.

My Lords, in terms of taking the rap, the Henriques report makes it clear where accountability or failings have lain. It is a matter for the Metropolitan Police to hold the commissioner to account.

My Lords, is it not the case that this sorry story might never have unfolded if anonymity remained for victims until the police are ready to charge?

Of course, the presumption is anonymity before charge, but there will be circumstances where the police will feel it necessary to release names—although that is not in most cases; quite honestly, in a lot or most of the cases recently, it was through the media actually releasing names. It is against the law, I think, and anonymity before charge is an important standard to uphold, but of course we can all think of people who, had anonymity not been there, may never have come to justice.

I will make some progress, but I will come back to that point—when inspiration arrives.

No UK Government, regardless of their political leanings, could ever accept such a carving up of the United Kingdom—I am referring here of course to the division between Northern Ireland and the Republic of Ireland. Indeed, on 15 October, in another place, the Prime Minister said:

“We have been clear that we cannot agree to anything that threatens the integrity of our United Kingdom, and I am sure that the whole House shares the Government’s view on this. Indeed, the House of Commons set out its view when agreeing unanimously to section 55 in … the Taxation (Cross-border Trade) Act 2018 on a single United Kingdom customs territory, which states: ‘It shall be unlawful for Her Majesty’s Government to enter into arrangements under which Northern Ireland forms part of a separate customs territory to Great Britain.’ So the message is clear not just from this Government but from the whole House”.—[Official Report, Commons, 15/10/18; col. 410.]


Turning to Amendment 80—before I come to some of the points raised during the debate—the Government’s position is that they will not seek to be in a customs union with the EU. We have debated this issue in this House and in the other place throughout the passage of this Bill—leaving aside the very clear response that is on its way to the noble Lord; he should be prepared for that. As has already been highlighted to the House, at Report stage in the Commons, MPs rejected an amendment seeking to keep the UK in a customs union with the EU.

On the specific points relating to import VAT, it is clear that the Government are highly cognisant of the concerns raised. I will deal with that point now because the noble Lord asked some very good questions on VAT treatment, and it is good to have an opportunity to put the position on the record. Goods from third countries are treated as imports, with VAT due accounted for on import or by the 15th of the following month as duty of customs. This means that, unlike acquisitions, there is a cash-flow impact because traders have to pay the import VAT and potentially recover it later when they submit their VAT returns. It also means that there needs to be an option to pay import VAT on the border, as not all businesses have the necessary guarantee to defer payment until the following month. Generally, import VAT is paid sooner on goods from non-EU countries than on goods from EU countries. This provides a cash-flow benefit to companies importing goods from the EU compared to businesses that import from non-EU countries. Without an UK-EU agreement to retain this treatment, goods entering the UK from the EU would be treated as imports and would be subject to the same rules as businesses moving goods from non-EU countries. This would mean businesses paying VAT on imports from the EU sooner, affecting their cash flow. The Government published a series of technical notices in August 2018 to help businesses prepare for the unlikely event of a no-deal scenario. The VAT technical notice, “VAT for businesses if there’s no Brexit deal”, announced that the Government will introduce postponed accounting for import VAT on goods brought into the UK.

The noble Lord, Lord Stevenson, asked why we accepted Section 54—originally New Clause 36—of the Taxation (Cross-border Trade) Act 2018. The Government did so because it was consistent with our position. It requires the Government to negotiate a reciprocal arrangement for the collection and remittance of VAT, customs and excise duties. The Government have been clear that both the UK and EU should agree a mechanism for the remittance of relevant revenue. The Government set out in their July White Paper that they propose a revenue formula that takes into account goods destined for the UK entering via the EU and goods destined for the EU entering via the UK.

The noble Lord, Lord Purvis, asked whether the customs territory is a customs union under GATT, and he deserves a full answer to his detailed question, so I commit to writing to him. That should be very clear to the noble Lord and all Members of the House—well worth waiting for.

I ask this question as someone who is not a politician and who therefore sometimes gets quite confused about the repetition of entrenched views, which have led us to the undoubted stalemate that we are in. This really concerns the point made by the noble Lord, Lord Lansley. I heard the Minister’s response, but it seems to me that everything I hear about Brexit suggests that the Northern Ireland backstop is a real sticking point. Is it not conceivable that, to get around that problem, the Government might have to consider some form of customs union?

I thank the noble and learned Lord for that explanation, which gives me a bit of reassurance. I hope that the Minister will do the same. The fact is that two committee reports have raised serious concerns about the powers that are being extended or given in the Bill. I make it clear from the outset that we support the passing of the Bill and its objectives. We would not want to do anything to hinder it but, on the other hand, we want the Minister to be clear about the precise nature of these powers—about how they will be used and their scope.

The noble and learned Lord has been clear about proposed new subsection (3). I hope that the Minister and the noble Baroness, Lady Hodgson, will be able to respond clearly in relation to my noble friend’s question about proposed new subsection (7). Precisely what is its purpose? I suppose the right reverend Prelate alluded to this, in that he referred to the implications for couples who have been married in church. I suppose that is what he is concerned about. There are obviously many people who have married in church and later divorced, then married again—maybe not in a church, but that has extended even to members of the Royal Family and, potentially, a future head of the Church of England. That is not for me to query. However, this really is important because, in scrutinising legislation, we have to be clear about the sort of precedent we are setting.

My own view, expressed partly by the Delegated Powers Committee, is that when the Supreme Court decision was made the Government should have come in with a Bill themselves. Why are we not conducting primary legislation properly and scrutinising it properly? We have here an omnibus Bill to which, as I say, I do not object; we certainly want to see it passed, without delay. People who want civil partnerships should be able to have them as soon as practicable and we will support that. However, it is incumbent on the Minister to answer these very important questions about scope.

The noble Baroness, Lady Hodgson, referred to the conversion period. I have experienced that myself, not least because I converted my civil partnership into a marriage and I wanted clear assurances about the timeframe for that when the 2013 Bill was going through. I got assurances but it still took a bit longer than I thought it would, so I hope the Minister will tell us precisely what the window of opportunity that has been alluded to is. What is the Government’s view about this period in which people may be able to convert their marriages into civil partnerships? What timeframe are we looking at and how will people know about this? If there is a window of opportunity that will close, it is really important that the Government communicate that effectively. I hope the Minister and the noble Baroness, Lady Hodgson, will be able to respond to those points.

My Lords, I am grateful to my noble and learned friend Lord Brown for his reassurance on the point that was raised. The reason I am grateful is that when I attended and listened to the debate in which the noble Lord, Lord Lexden, made a very moving speech—I would love to see some form of protection for siblings of the kind that he mentioned—I felt that the noble Baroness, Lady Barker, won the day with her comments and reservations. It is reassuring to have this advice from the noble and learned Lord.

My Lords, in responding, perhaps the Minister might refer to the Delegated Powers and Regulatory Reform Committee’s report, not least, if she has it in front of her, paragraph 27. It deals with the committee having stated that it was,

“puzzled that the Memorandum fails to mention that Ministers already have power to remedy by secondary legislation the ECHR-incompatible provisions in the 2004 Act”.

The Minister might want to refer to that and, equally, to paragraph 31, regarding the concerns raised by that committee and its recommendations.

We work closely with my noble friend at the Department of Health and Social Care on the specifics of vaccines. DfID has funded some candidates for potential vaccines in the past. It is a very long-term project. There is such demand for scarce resources that we have to allocate them correctly, but if there are promising candidates for a vaccine we would very much want to look at the possibility of funding them.

My Lords, I was rescued from the clutches of this disease by wonderful NHS treatment. Does the Minister agree that TB can remain dormant in the human body until a time of great stress or malnutrition? Therefore, it is the combination of drug efficacy and, I am afraid, poverty that can exacerbate this problem.

That is very true, and that is why the vast majority of cases of TB around the world—an estimated 10 million new cases in just the past year, leading to the potential deaths of 1.6 million people—are predominantly in low-income countries, which is also where the UK aid budget is focused most.

I cannot tell the noble Lord the terms of reference or who will be on the review at this time. The Home Secretary will outline that in due course. My right honourable friend the Home Secretary wants Wendy Williams, who is dealing with the Windrush review, to be part of the wider exercise of this review. In view of some of the lessons that we have learned and the ways in which she operates, she will be very helpful in the review. However, I cannot give the noble Lord the detail on the review today.

My Lords, I, too, welcome the tone of this Statement. There has been much mention of culture. That is correct, but in my experience culture begins to slip when people are pushed beyond their limits in terms of work. My question to the Minister is very simple. Will the Government bite the bullet and fund more staff for this important area? With Brexit—I am thinking in terms of visas for artists—the workload will increase by a staggering amount.

There is no doubt about it. If noble Lords were in their place for the Question earlier, they will have heard that the number of people crossing the border has increased quite substantially in the past few months. Beyond Brexit, we are expecting pressure on the system, as the noble Lord, Lord Wallace of Saltaire, pointed out. The sort of thing that has to be considered is whether we have the capacity to deal with issues such as this. Noble Lords are right to talk about the culture of the Home Office. The Home Secretary has made a firm pronouncement that it has to change.

I thank the noble Lord for his questions. He asked why there is a two-year extension, especially when G4S was the subject of the “Panorama” programme. I hope I have outlined to the noble Lord, through my answer to the noble Lord, Lord Kennedy, what the Government’s expectations of G4S will be in this period—and the full reprocurement will provide a solid basis for further progress on all the issues I have outlined. We will continue to monitor the progress and the performance carefully. The conclusions, in due course, of Kate Lampard’s review and Stephen Shaw’s wider follow-up review will provide further opportunities to learn the lessons and embed good practice, both at Gatwick and across immigration detention more widely.

The noble Lord made the point about the hostile environment, and I have said several times since the new Home Secretary has been in post that that is not a term he wants to see, because of the connotations. He is more interested in a compliant environment, with people complying with immigration rules. As for people not knowing how long they will be detained, we are clear that people are detained for as short a time as possible. It must be noted that 92% of people in detention are not there for more than four months. Indefinite detention is against the law: it is not something that we do. Therefore, people are in detention for as short a period as possible.

My Lords, does the Minister accept that at the root of this problem is, possibly, not having a rigorous enough selection process for staff? The make-up of staff—for example, their attitude to immigration—is vital. I know that it is difficult to find the right staff, but it is absolutely essential if we are to change the culture of how we look at people in detention.

I totally agree with the noble Lord about the rigorous selection of staff. He will have heard me saying that nine staff have been dismissed in the light of the programme. However, going forward, it is not so much about those nine staff having been dismissed as about the staff who will be employed. My right honourable friend the Home Secretary has also talked about a humane environment. Humanity is at the heart of this: these are people, and they must be treated properly and humanely. I also talked about the whistleblowing procedures and the internal whistleblowing policy, which have been refreshed and reinforced. The engagement between case workers and detainees is a very important relationship that must be treated sensitively. The new arrangements will also strengthen our capacity to oversee the contract effectively. I totally agree with the noble Lord’s point.

My Lords, I want to contribute briefly this evening because I was very moved by what my noble friend Lord Cormack said earlier. I should say, by way of background, that I come from a long line of Anglican priests. Indeed, I am the black sheep of the family, having fallen into politics, which is regarded by the rest of the family as being disastrous in that respect. My grandfather, a Cornish parson, was so horrified by the way in which Parliament treated the 1928 prayer book that he became convinced it was necessary to disestablish the Church of England. I follow in that respect, too.

I want to express my appreciation of what my noble friend Lord Cormack said earlier because his generosity should, I hope, be shared by others who may be disappointed, or even dismayed, by the way in which this Measure has come forward. I rejoice in the way it has come forward. I recollect very well a service in Truro Cathedral, on a bright, beautiful Cornish day nearly 20 years ago, when the then bishop, who had voted in the Synod against the Measure for the ordination of women, preached eloquently to us, expressing the most moving reason for changing his mind. He recollected that in the New Testament, in the Acts of the Apostles, the Almighty had given guidance to those who were voting on a decision to replace one of the apostles. He said, “What is good enough for the Apostles is good enough for me”. As part of that very moving ceremony, when he presented the seven candidates with a bible, he also presented them with a bunch of sweet peas, which he had picked from his garden that morning. It was a very moving moment when he, who had been relatively opposed to the ordination of women, said that he accepted the outcome of that vote. I hope that those who may now be concerned, apprehensive, worried or even dismayed will not only listen to my noble friend in the way in which he has accepted the outcome of this process but may also remember the words of that very distinguished Bishop of Truro.

My Lords, perhaps I may add a word from someone who was brought up in the Catholic Church and to whom, therefore, the ordination of women was very foreign. However, one word sums up much of what I have heard, particularly from the noble Lords, Lord Cormack and Lord Tyler, and that word is love. Recently, my wife was buried by a lady vicar, who also christened our grandchild. In the course of that, I came to realise that the semantics are not important; what is important is the degree of love. This lady bestowed a quite extraordinary gift on me, and I feel that we have come to a stage in our history where this is not only acceptable and desirable but extremely important. I have seen myself do a complete volte-face over the last decade, to a point where I enormously welcome women bishops, and I know that people such as the noble Lords, Lord Cormack and Lord Tyler, will do so as well. It is correct that we should also show great love to those who find this difficult. Having seen both perspectives, I can see that “love” may sound corny but it is in fact the answer.

My Lords, I thank the most reverend Primate for his introduction to this Measure and all noble Lords who have contributed to this historic and extraordinary debate. I, too, thank the noble Lord, Lord Cormack, for the graciousness of being willing to stand up and explicitly commend this Measure to the House, given the pain that it clearly has caused him. I also thank the noble and learned Lord, Lord Lloyd of Berwick, for having shared with us the context and the excellent report from the committee under his chairmanship. I thank all committee members who contributed.

I probably should declare an interest, in that I, too, am an active member of the Church of England. The nearest that I have come to high office is that I was briefly the secretary of my PCC. The downside of being brought into your Lordships’ House was that, tragically, I was unable to be present in Durham on the evening that the PCC met and was forced to relinquish that role—I can tell noble Lords now that they will never get me back to do it again. None the less, because of that, it is an enormous privilege for me to be even a small part of this debate. I am so pleased to be able to do it.

Of course it was so different in November 2012, when the last attempt to resolve this issue was rejected by Synod. I was among those who were dismayed by the result as well as slightly baffled. As the most reverend Primate pointed out, for any Chief Whip in this House a 64% majority would be a result, and we did not think that he could have done much better. At a meeting with a bunch of parliamentarians from both Houses attended by the most reverend Primate the Archbishop, people were concerned. He explained that he would address the matter with urgency. People were very impressed—as were, I am sure, other noble Lords who were there—but a Member of another place said, “That is all very well, but the same people will be in Synod until the next election, so how can anything possibly change?”. I shall paraphrase what the most reverend Primate said, but he said, “I do not know, but I have worked in situations where very unlikely people have been reconciled and I believe in a God who is capable of doing miracles”. He may have had a point.

I pay tribute to the most reverend Primate for the commitment that he has brought to this process, the urgency that he has taken and the care and love that he has lavished on it. Working with the right reverend Prelate the Bishop of Rochester and all members of the steering group of the General Synod from a range of persuasions has enabled him to help Synod come to the place where it felt able to support the Measure before us today.

My Lords, I thank and congratulate my noble friend Lady Cox on again airing this important subject. It is outrageous that such a practice should be happening in what we like to think of as a civilised society. Having said that, I do not doubt for one minute that the Government and the various departments involved find this as shocking as the rest of us. However, it is not resulting in prosecutions, so I shall look at why that might be.

When the noble Baroness, Lady Manzoor, asked a Question about this a few weeks ago, the Minister, the noble Earl, Lord Howe, replied very sensitively about why France has had some success. He said that there is compulsory examination. I took his point that that would not necessarily go down very well in this country. Looking at children’s private parts is a very tricky subject, but in France, they expect people who come there to behave like the French. The noble Lord, Lord McConnell, made a very good point that even if we do not go as far as examination—and I agree with the noble Earl, Lord Howe, about that—there might be some aspects of French law that we should take and make it clear that anybody committing this act is committing a crime.

We cannot overstate that there are no medical reasons for FGM. There are no religious reasons in the Bible, the Koran or any holy scripture that justify it. It is about cultural tradition. I completely accept the Government’s point that this is a very tricky area to deal with. However, we have to deal with it. There have to be prosecutions. Reading all the papers that have been assembled, mainly by government agencies, I am struck by the fact that they feel there is a lack of leadership and joined-up thinking. For example, even those cases that come to the attention of the professionals are not being reported as well as they might be. There are initiatives that, with the greatest respect, the Government could take to improve this situation. Let us not wait another 10 years for a prosecution. Let us not wait another five years. Let us not wait another year. We need to see some effective action.

My final point is that I agree with the noble Baroness, Lady Barker, about the success of Orchid. It is an example we should look at because it has had real success in various African—mainly sub-Saharan—countries in persuading people that this practice should change.

My Lords, it has been extremely pleasant to hear such endorsements of the profession of which I am delighted to be a member. I started off with a score in mind, but this concert, so ably conducted by the noble Lord, Lord Storey, has been through virtually all the possible movements. I am reminded that music is essentially a form of variation; everything is a variation of what has gone before. So I have torn up my score and I will, like all good jazz players, improvise on the themes that I have heard.

The noble Lord, Lord Storey, mentioned the Proms, which are about to begin, so for my first variation I would like to talk about the BBC, which I broadcast for and on which I have had my music played. I would like to compliment Roger Wright and his predecessor Nicholas Kenyon not only on building incredibly successful seasons, but on taking music into different spheres, whether they be film music, jazz, popular music or the musical. It is important that we are an all-embracing family.

The BBC does extraordinary work across various networks. However, I have always felt that praise is more credible if it is balanced by criticism. On this particular day, and on behalf of so many people who work for the BBC on the shop floor, I must say how outraged I am to read that, when those of us who work there are being cut back on the programme-making side, absolutely staggering sums have been given as golden handshakes. It is essential that the public have confidence in the BBC. They must know that when people get it wrong, whether in the Civil Service, the Government or the BBC, they are not simply moved sideways, but pay the price that most people have to if they make a huge mistake. Margaret Hodge has done a very fine job in focusing on this particular subject and holding people to account. My noble friend Lord Hall, with whom I worked very closely at the Royal Opera House, is now the Director-General. If anyone can turn that around, he will. The BBC is worth saving because it is a marvellous ship. The world—I say the world, not just this country—would be a poorer place without what the BBC achieves.

I shall move on to a couple of specifics. I would like to look at some of the ways in which music is allied to other arts, an example of which would be dancing. I was very much involved with the Royal Ballet and in fact I still am. One of the great problems we had at the Royal Ballet School was to do with visas. It was so difficult to allow young students to dance on the main stage. It is absolutely crazy that young people who are really gifted come into your school, but you are prevented from letting them get the experience they need on the main stage, either at the Royal Opera House or the Royal Ballet, because of what are essentially visa restrictions. I would ask the Minister to look at that. I know that some progress has been made, so I feel that there is a conversation carrying on.

While I am on this particular tack of asking the Minister to follow up on a couple of things, I will also mention the British Academy of Songwriters, Composers and Authors, which represents everyone from Paul McCartney to Harrison Birtwistle. When somebody wants to commission a composer—I had a conversation about this with one of your Lordships recently—they say, “I have no idea what it costs to commission a piece of music”. The BBC is wonderful at this, but we need to disseminate music—to Buxton, to small groups, to churches and cathedrals, so that the new music being created will be the music of tomorrow. When someone goes to the academy, which is our representative, and asks, “Can you give us some idea of how much money is involved?”, it has to answer, “We’re not allowed to tell you”. That is because the Office of Fair Trading has said, “Because you are not a union, you cannot give guidelines”—and they are only guidelines. I cannot believe that a Conservative Government feel that this is right. However, because our representatives are not a union, they are not allowed to give guidelines for fees. If that could be looked at, a great problem could be solved for us all.

We talked earlier about the regions. It is very easy to talk about the Proms and the Royal Opera House, so it was lovely to hear comments from all over the country—from Scotland, for example—about how important music is. We heard about Plato, and of course there is Socrates, who towards the end of his life intimated that rather than be a philosopher, perhaps he really should have been a composer. Music, in its abstraction, can do something that takes us further inside ourselves and allows us to see society in a wider and much more generous context.

The British Council has been mentioned. The work that is done overseas is terribly important. I am sorry to reference this to myself, but it is difficult not to. I was in Rome because the British Council had helped to put on a performance of an opera I had done with Ian McEwan; the British ambassador was incredibly helpful. That would not have happened without these people holding hands. I loved something that happened to Ian McEwan and me—of course, he is a far more famous person. We were walking through the streets of Rome and got lost while looking for a restaurant. Here is an example of British success. A Vespa screamed to a halt. “Ian McEwan!” said the driver. Ian was very taken aback. “I love your books”, the man said. “Is there is anything I can do for you?” “Yes”, Ian said. “You can tell us how to get to a particular restaurant that we’ve been looking for for three hours”. The fact that the arts are recognised abroad is terribly important. However, a recent UK survey shows that of London households, 36% had been to an orchestral concert more than once, although that is over a period of six years, it has to be said. I find that fantastic. The equivalent figure for other ticketed arts events is 21%. That is an amazing achievement which speaks volumes about what I feel that music can do.

I will finish by talking about sacred music. I completely agree with the right reverend Prelate the Bishop of Derby that this is an area that has to be protected, but it is an area where we speak to a huge audience. I think of people like John Taverner or Arvo Pärt whose music can hold people; it is a way of connecting to something higher. You do not need to believe in God to feel that you are experiencing something that transcends everyday life. I have had some marvellous experiences in places like Durham and Ely, Westminster Cathedral, Westminster Abbey and St Paul’s, where great architecture and great music combine to lift the soul in a quite staggering way. This surely is part of what tourists also find marvellous about this country. Which other countries have quite the same cathedrals that we have in East Anglia, for example?

Recently, I was very privileged to be able to write a short anthem for the enthronement of the most reverend Primate the Archbishop of Canterbury. He chose words from the Rule of St Benedict. The opening line of the anthem is,

“Listen, listen, O my child”.

We have to provide all our children with things to listen to.
