Lords ChamberMy Lords, there was never any possibility of my becoming a member of the Court of Appeal, but had I been a member, the job I would most like to have had is that of the third member of the court who says, “I have read the judgment of my learned friend. I agree and I have nothing further to add.” I have heard what my friend the noble Lord, Lord Anderson, has said both at Second Reading and just now and I have nothing further to add save one point.
During the course of the Second Reading debate, instead of saying “two-thirds” I said “three-quarters”. I do not suppose that that made much difference to the way in which the House considered the matter, and the noble Lord, Lord Anderson, has made the points that need to be made. The one thing I have learned in politics is that it is possible to win the argument and to lose the vote, and it is possible to make winning arguments and sensibly to avoid a vote. For my part, I think that the noble Lord, Lord Anderson, has made and won the arguments, but whether he moves this issue to a vote is another matter. However, he has certainly won the moral victory.
My Lords, I do not dissent at all from that assessment that a moral victory has been won, but that is only the beginning of the story. I simply want to address the Government’s distinctly lacking arguments against the amendment as advanced so far in a context where there was such widespread agreement on the efficacy of bringing the Parole Board into all cases but no very clear defence by the Government as to why the two-thirds provision has to be imposed on those who would otherwise have been released without the Parole Board’s involvement half way through their sentence.
The arguments produced by the Government have been very strange. One was that it would create greater confusion. It is in the essence—in the nature—of this provision that there will be confusion, because nobody can know what assessment the Parole Board is going to make of their case. The avoidance of confusion is not a primary objective of this: quite the contrary, we invite the Parole Board to make a very serious consideration of each case and only to allow release at either the halfway or two-thirds point if it is satisfied that there is not a danger to the public from doing so. The confusion argument does not really make any sense at all.
Then there is the argument that this will increase public confidence. Of all the things that might increase public confidence, I cannot see someone rushing into the pub saying, “Have you heard? Do you know that some of these offenders might spend up to another year in jail, but then they will be released?” That is not what public confidence is built on, and it is the wrong argument to use for something that involves issues of liberty.
Then I want to challenge the argument about the further period of incapacitation, because terrorists in prison are not incapacitated. They engage in grooming and recruitment activities and, as I said in the Second Reading debate, in some cases might be able to achieve more by their work among other prisoners—including prisoners who are not there for terrorist offences—than they might be able to achieve on the outside. They might recruit a larger number of people, so I do not accept the incapacitation argument.
The only argument that would be persuasive would be that it was impossible, with this amendment as drafted, to avoid the situation in which the Parole Board could not cope in a reasonable period of time with the cases at the half-time stage, but that probably could be overcome by alternative drafting if the drafting presented tonight has that problem. That would be the only argument that would persuade me: that we were letting people out without the Parole Board assessment, when the whole purpose of this is to make sure that they have that assessment.
Therefore, unless the Government produce a better argument, I do not think that they have made the case.

Lords ChamberMy Lords, in agreeing with the noble and learned Lord, Lord Judge, given his anticipation of beneficial light emerging from the Front Bench, I caution him that, as so often happens in these matters—particularly when the Government are giving something away, such as consultation—the light at the end of the tunnel ends up being the light of the approaching train. I urge that we temper our enthusiasm for any blandishments from the Government—not that my noble and learned friend on the Front Bench would ever be guilty of offering anything as vulgar as a blandishment.
The noble and learned Lord, Lord Judge, has made all the points that need to be made and has made them better than I possibly could. However, if one strips away the words “the Lord Chancellor” and replaces them with the words “Secretary of State”—and Clause 6(2) condescends to do that, because clearly the Lord Chancellor cannot agree with himself and has to agree with his schizophrenic self, the Secretary of State—and if one strips away the ancient legal title and office of Lord Chancellor, one finds that one is in fact dealing with a political Minister in a spending department at the Ministry of Justice and that he or she will be placed under all the pressures of both self-interest and Cabinet responsibility that go with being in a spending department. If it is inconvenient for the Chancellor of the Exchequer to allow the Secretary of State to agree with the Lord Chief Justice, he will disagree with the Lord Chief Justice. We should not be under any misunderstanding about that.
In the what must now be 20 years since the removal of the office of Lord Chancellor as head of the judiciary—and I am standing behind one of the finest exemplars of that office—with that position having now gone to the Lord Chief Justice, the metaphorical gap and indeed the actual distance between the law and Parliament has grown immeasurably. The understanding between the law and those who administer it and politicians has grown immeasurably. One only has to look at the record of some Secretaries of State for Justice who have succeeded my noble and learned friend and who do not have that intimate knowledge of the administration of justice to understand the difficulties and dangers that the noble and learned Lord, Lord Judge, anticipates—and have happened already.
While I support the sensible policy behind the Bill, all kinds of little niggles pop up from time to time which will destroy its purpose. They will make it less beneficial for the public good than it would otherwise be, were the suggestions made in the previous debate by the noble Lord, Lord Marks, and in this current debate by the noble and learned Lord, Lord Judge, taken into account. As a supporter of the Bill and the Government, I urge them not to allow themselves to be swept down the river of consultation when the river of agreement is a much safer journey to take.
My Lords, the messages are getting more complicated and conflicting between approaching trains, rivers and nuclear options. Perhaps we should recognise that we are replaying debates in which some of us were involved when it was attempted to abolish the Lord Chancellor overnight and there emerged from that process the system we have now. It is very relevant to the noble Lord’s amendment and to the powerful points he has made in support of it. The change in the role of Lord Chancellor, quite correctly emphasised by the noble and learned Lord, Lord Garnier, as Secretary of State for the Government as well as Lord Chancellor, stretches forward to influence what we ought to be doing in this legislation.

Commons ChamberI am not going to answer that question, because it is not central to my point. When my hon. Friend and I meet elsewhere—perhaps in some shadow Attorney-Generals’ afterlife—we can have a long and fascinating conversation about the matter he has just raised, but if he does not mind, I want to make a few brief points.
Temporary is not two years; to my mind, it is something far shorter. I have no objection to the Home Secretary making a temporary exclusion order, but I prefer the expression used by my right hon. and learned Friend the Member for Beaconsfield (Mr Grieve) on Second Reading when he talked about “managed return”. That is a much more accurate description.
Would the hon. and learned Gentleman be happier, as I would be, if, by the time the Bill returned from the Lords, it was a Bill about managed return, not exclusion, and if exclusion were the back-up to enforcing managed return?

What discussions is the Solicitor-General having with his colleagues in the Ministry of Justice to ensure that the contract provisions are carefully examined and, if necessary, penalties are imposed if the service is not up to the standard required?
I am grateful to my right hon. Friend. I discussed that matter only this morning with colleagues in the Ministry of Justice and am assured by the Under-Secretary of State for Justice, my hon. Friend the Member for Reigate (Mr Blunt), that the contract with Applied Language Solutions is now running properly. The company has got a grip on it and we can expect nothing but progress from here on.

Commons ChamberWill the Attorney-General keep in mind the recommendation of the Justice Committee that the courts are quite capable of treating people with learning disabilities, and those with mental health problems, as credible witnesses? The Crown Prosecution Service should not be frightened to bring such witnesses before the courts.
I entirely agree with the right hon. Gentleman. As I hope I indicated in my first reply, the Crown Prosecution Service does its very best to ensure that all victims of rape are properly treated and that their evidence is put before the court so that the alleged defendants, or alleged criminals, can be brought to justice. I have absolutely no doubt that the CPS will do its very best. I should add that, having recently attended the Judicial Studies Board course on serious sex offences, I know that the judiciary are acutely aware of the need to deal with the sort of problems that the right hon. Gentleman mentioned.
