Lords ChamberMy Lords, how are we best to construe the fact that two Cabinet Ministers felt the need to write their joint letter to the Financial Times? That is probably unprecedented. Does it not mean that there is a certain concern among the more moderate members about the harsh line of the more extreme members? For example, regarding the licensing suggestion with the European pharmaceutical authorities, does it not mean that we have not given up altogether our hope that the European Medicines Agency will remain at Canary Wharf?
On removal, the European Commission has made it clear that it intends to move the two agencies. That is a decision for the EU to make. Regarding the letter written by my right honourable friends, who could not but welcome the fact that they refer to the importance of placing patient safety at the heart of regulation, providing certainty and long-term stability to the market and building on the UK’s legacy as a leader in medical innovation? There is entire Cabinet agreement on that.

Lords ChamberMy Lords, I cannot recall the exact date because, of course, I do not call in the Russian ambassador. But I can reassure my noble friend that I am aware that the Russian ambassador has been called in on at least one occasion last year with regard to Russia’s disregard for international norms. Whatever country uses international murder to dispose of people who are inconvenient to it is wrong and should face international opprobrium.
My Lords, China is the key player in relation to North Korea, and its action appears to complete the isolation of that country. How do the Government interpret its sanctions? Are they temporary, or can we expect a sea change in China’s policy?
The noble Lord is right to point to the fact that China has now made it clear that it is compliant with the UN Security Council resolution on sanctions on the coal trade between the DPRK and China. On 18 February this year, China declared that it would be fully compliant. It had actually been in breach in December, so it has made sure that throughout the whole of this year it will now be compliant. We welcome that public declaration and look forward to receiving further details about how it is observed. It was an important step forward.

Lords ChamberMy Lords, I shall not speculate on what might happen; I deal with what does happen. It is clear that in this case unacceptable activity was undertaken by one person who is no longer in this country, and appropriate action was taken by the Israeli embassy.
My Lords, a junior embassy official made a stupid remark at a gossipy lunch and was sacked, and our Government say that that is the end of the matter. Does the Minister share my puzzlement at any possible benefit that would result from raising the matter now? Is it seriously suggested, for example, that the Israeli embassy wants to bump off Sir Alan Duncan?

Lords ChamberMy Lords, apart from the vote to leave, how do we ascertain what the British people—or, at least, the 36% of the electorate who voted to leave—really want? We cannot negotiate with the people.
My Lords, in a democracy the people negotiate with government when they express their view at the ballot box, which they have done. It is then the duty of the Government to take into account the security and interests of the whole of the British people when putting together proposals for negotiation. I suspect that we will have an opportunity in this Chamber further to discuss these matters. It will of course be a matter for the usual channels to determine how that happens, both within the Chamber and outside it in a more informal way.

To ask Her Majesty’s Government what consultations they have held with the Overseas Territories and other Commonwealth countries over the United Kingdom’s future relations with the European Union.
My Lords, Ministers and officials meet regularly with the overseas territories and Commonwealth countries to discuss a wide range of issues, including issues raised by the UK’s renegotiation of its EU membership.
My Lords, the Falklands representative in the United Kingdom said that leaving the European Union would fuel Argentinian aggression towards us. The Chief Minister of Gibraltar has said that a vote to leave the EU would be a dire threat to Gibraltar. There are similar expressions of support for our membership from the Prime Ministers of Australia, Canada, India and New Zealand. Given this, why have the Government not trumpeted this clear and apparently unambiguous view by Commonwealth countries, but allowed Mr Farage, for example, to get away with claiming that he is a Commonwealth man?
My Lords, the Government have made it very clear that we value the announcements that have been made by the wide variety of representatives of Commonwealth Heads of Government and overseas territories to which the noble Lord has alluded. The Government have also noted that on each occasion when these people have put forward their views about how important it is for their countries that the UK remains within the EU, they have based their views on facts.

Lords ChamberMy Lords, as I outlined a moment ago, the decision-making process has to depend upon the discussions being carried on today, not just with the ISSG but with the UN. It is a matter of what is the safest and most effective way of delivering aid. However, the Assad regime should be under no illusions and neither should Russia. The allies who have united against Daesh are united against the attempt to subvert democracy in Syria as a whole. Therefore, it is important that Assad takes note of the determination of countries that are united in the ISSG, which includes the UK, to deliver humanitarian aid. I pay tribute to the organisations that stand ready to do that.
My Lords, is there any evidence that Russia will be co-operative in the United Nations Security Council and not block an initiative? Is there any evidence that Russia is acting positively in respect of pressure on the Assad regime?

Lords ChamberMy Lords, regarding use of the veto, the Prime Minister has made it absolutely clear that he would be prepared to block any future accession until reforms of transitional controls on freedom of movement have been achieved. The success of my right honourable friend the Prime Minister in his negotiation earlier this year means that our controls on free movement cannot be lifted until the economies of an accession country have converged much more closely with existing member states’. If we were to allow those controls to be lifted, we could seek to re-impose them if there were either a serious disturbance in our labour market, or adverse social or public policy impacts in the UK as a result of migration from this new member state. These are new powers that we did not have on the previous accession from the Balkans.
My Lords, will the Minister pass a copy of her reply to her hapless government colleague Ms Mordaunt? Does she recall that Chancellor Merkel used to talk of the proud nation of Turkey having a “privileged position” with the European Union? Is that now not a far more realistic position than continuing with the fiction that Turkey will one day be a member of the European Union, given, for example, that there is a need for referenda in Austria and France, and that there is no prospect, for as far ahead as we can plan, of Turkey having full membership?
My Lords, I happened to speak to my honourable friend Penny Mordaunt about an hour ago, and I reassured her of my admiration for her in all the work she does as Minister for the Armed Forces. Indeed, I am just about to issue a joint op-ed with her regarding the ceremony at the Cenotaph earlier today. I was disappointed that she was perhaps misinformed by one of the campaign groups about the powers of the United Kingdom. It is clear that, when Turkey is on the path to EU accession, it will face the fact that the UK, as all other member states, possesses a veto against its accession if it cannot achieve the standards needed to be a member of the EU.

Lords ChamberWill the Minister confirm that these distinguished Secretaries-General of NATO are joined in the roll call by virtually every international organisation that is relevant, and all of the international statesmen, including Commonwealth statesmen such as the Prime Minister of Australia? One would be hard-pressed indeed to find any international organisation or international leader, save perhaps for President Putin or Mr Trump, who would join the Brexiteers.

My Lords, is it an unspoken, unwritten part of the deal under discussion that we moderate our criticism of the authoritarian tendencies of the current Turkish Government?
No, my Lords. Human rights underpin all the work of the Foreign and Commonwealth Office, as I made clear when I appeared before the Foreign Affairs Committee of another place recently. We will never hold back from speaking out or from holding people to account on the important issues of the Copenhagen agreement, whereby democracy and the rule of law underpin everything.

Lords ChamberMy Lords, the noble Lord is right to point clearly to the value of all our ambassadors and those who work with them around the world. At this point, it is important that we see Assad’s regime take seriously the peace negotiations that are just within grasp. If we are able to see that he comes constructively to those negotiations to achieve the transition, I feel that we would look very positively at how we might engage further. We need to see how Assad reacts to the peace process first.
My Lords, the noble Lord is right to point to the appalling position for those who find themselves being starved out by Assad. Of course, some areas are under siege by Daesh and some by opposition groups, but mostly by Assad and Daesh. For the RAF to operate in the area of Madaya would have caused great—perhaps I may say—peril, in security terms. The right way to go forward is for Assad to grant the applications by the UN to have safe progress through. He has agreed so far only to 10% of those requests.
My Lords, the Government’s initiative on convening and hosting the pledging conference is most welcome but first there has to be a settlement. Reverting to the Question posed by my noble friend Lord Soley, does the Minister agree that the Russian intervention has bolstered the position and strength of President Assad and can only complicate the search for a settlement? Does Russia recognise the effect of its intervention?
The danger is that Russia’s action may well have strengthened Assad’s hand and makes it more difficult, perhaps, for Assad to see the benefit of a peace process. That is why I call on Russia to use its levers of influence with Assad to make sure that he takes the transition process seriously and comes to the table on the peace negotiations. I believe that the Syria crisis conference can go ahead even before that peace has been achieved. It can show the way that we can achieve stabilisation in Syria in the future.

Lords ChamberMy Lords, I have not heard the witness of that victim. I clearly sympathise with her experience. I have had the opportunity to hear witness from others about the appalling violence they suffered and witnessed. We regularly raise with the Nigerian authorities rescuing people being held by Boko Haram. We also work to support women and girls in northern Nigeria as part of our general humanitarian response. That includes helping the safe school initiative in north-eastern Nigeria. As part of our work on the prevention of sexual violence in conflict, we help to fund a UNICEF programme which supports the reintegration of victims of conflict-related sexual violence.
My Lords, what is DfID doing specifically to help those internally displaced persons who simply cannot return home and are forced to languish in deplorable conditions in camps?
My Lords, DfID is providing a substantial package of security, development and humanitarian support, including a £6.5 million humanitarian programme and a £5.4 million development portfolio in Yobe state. The funds are used to provide humanitarian support in the protracted food and nutrition crisis. It is important to note that it is not just Nigeria that faces this; it is a matter that reaches across the Sahel.

Lords ChamberMy Lords, on my noble friend’s first point, we are not considering engaging in land warfare and having our Armed Forces within Syria. When the Leader of the House repeated the Prime Minister’s Statement, she set out why that was the case, so we are not planning for that. My noble friend is absolutely right to draw attention to the very serious position in Libya and the growing threat from extremist groups, including Daesh and groups affiliated with it. These groups pose a threat to the stability of Libya and the region itself, and potentially to the UK and our interests and citizens overseas. We are working closely with international partners to develop our understanding of Daesh’s presence in Libya, including in Sirte, to which my noble friend rightly referred. This includes working closely with Libya’s neighbours to enhance their ability to protect themselves against threats from terrorists in Libya and prevent weapons smuggling across the region. We continue to urge all Libyans to unite against these extremists.
My Lords, on the political track, is it the view of the Government that Russia is moving towards accepting that there will be no place for Assad at the end of the transition period? We understand, of course, that oil provides a substantial part of the financing of Daesh/ISIL, but also there are taxes, including taxes on lorries crossing frontiers to go into Syria. What is being done to block those lorry convoys supplying the areas controlled by Daesh? Finally, clearly at the end of the period, any successor regime will inherit a wasteland. There is the very welcome initiative by the Government to host the pledging conference in February, but are we also preparing to mobilise refugees both in the region and in Europe to help to reconstruct their homeland following the terrible devastation caused by the war?
My Lords, we welcome the fact that Russia was prepared to engage in the Vienna talks. Clearly, how its views on the position of Assad may or may not change is a matter of further consideration. That makes negotiations perhaps a little more testing than might otherwise be the case, but clearly it is important that those talks continue. We have made it clear throughout that Assad cannot remain in power because he is a recruiting sergeant for Daesh’s very existence, in that people feel that they have to tolerate Daesh and work with it. With regard to convoys, as I mentioned earlier, air strikes can be used specifically not only to target the oil production facilities but to disrupt the transport of materials—not only oil but things such as weaponry. As regards the border crossing, it is important that we continue to liaise with our colleagues in Turkey as much as possible to maintain the sanctions regime which has been imposed. I confirm that we are looking very closely at how the pledging conference will approach the issue of refugees. When I was in Iraq, I visited a refugee camp and was made aware at first hand of the vast challenge ahead. Those who are not in the camps will also need much assistance from all of us.

Lords ChamberMy Lords, I had the honour this morning to have a discussion with a journalist from PinkNews. I made it clear that I believe it is for Ministers always to raise issues of discrimination against LGBT people when they are under threat and therefore seeking asylum. The Home Office is very clear on the rules it applies to asylum. Being able to show that there is a reasonable threat that one is going to face persecution in the host country is one of the first stages in being able to claim asylum.
My Lords, the presumption must surely be in favour of affording protection to those fleeing war zones such as Syria, but the case is far less strong in respect of countries in west Africa. Will the Minister look at the position adopted by Spain in respect of the Canary Islands and see to what extent that might be relevant to the position of the European Union—the north of the Mediterranean looking at the south?
My Lords, all 28 members of the European Union have different economic drivers and different approaches to economic migration and asylum policy. We always look with interest at how other countries manage to welcome those in need, and I am sure we will continue to do so. We have a rigorous system to ensure that there can be legal migration and that those in need of protection receive it.

Lords ChamberMy Lords, it is right for this House to be apprised of the agenda for discussions further than it has already been—the agenda has, after all, been set out in several speeches by the Prime Minister—but that is separate from the process of having referendum legislation. As I said at Second Reading, this is merely the legislative vehicle for the referendum itself. The noble Lord is right that Parliament should have the opportunity properly to examine the proposals put forward by the Prime Minister and what has happened at the end of that. I am sure that we will discuss that further next week.
At this stage, I would like merely to give the straightforward answer to the noble Lord, Lord Liddle. The Bill currently provides for the referendum on the United Kingdom’s membership of the EU to take place no later than 31 December 2017. His amendment would move that deadline later, to 31 December 2019. As other noble Lords, including the noble Baroness, Lady Smith of Newnham, pointed out, holding this referendum by the end of 2017 was a clear manifesto commitment. It has been repeated by the Government since the election, and as drafted, this Bill will fulfil that commitment and allow the British people to give their view by the end of 2017. That is why I can confidently say that we would not accept the amendment of the noble Lord, Lord Liddle.
However, I was asked one or two questions and perhaps I might try to address those. The noble Lord, Lord Stoddart of Swindon, made the point that there will be other events around the rest of the European Union over the forthcoming couple of years. I would say that when we are holding the presidency of the Council, we will be perfectly competent to carry forward a referendum at that time, given the experience elsewhere in Europe. There are so many examples, but I will try to pick out one or two—I have gone on long enough already so I will not test the House’s patience too much. In 1993, the Danish Government held the presidency for the first six months. On 18 May during that period, they held a referendum on the Edinburgh agreement, setting out arrangements for Denmark. During the Polish presidency of July to December 2011, Poland held a parliamentary election. All seats in both Houses were up for re-election and that brought in Tusk for a second term.
Those are not adequate precedents because, for example, the Danish referendum was on some amendment to Denmark’s relationship with the European Union. What is proposed in this Bill is a possible total reversal. It would be wholly impossible, as the noble Lord, Lord Stoddart, has said, for the UK, in the middle of its presidency of the European Union, to find that it is no longer a member or will shortly not be a member. It would place the UK presidency in an impossible situation.
I know the noble Lord’s experience of these matters so he is probably well ahead of me on this, but perhaps I can remind him that in 2006 and 2007 Germany and Finland swapped presidency dates to avoid national elections in each, so it can be done.

Lords ChamberI can assure the noble Baroness that we will continue our pressure on the human rights record in Iran, which really bears no scrutiny because it is so poor. With regard to the suffering of the Iranian people, she is right to draw attention to the fact that sanctions have not affected medicines over this period.
My Lords, this is historic but risky because of the history of deception by Iran and the linkages between the Revolutionary Guards and arch-proliferators such as North Korea. Do we expect that this agreement will lead to any spillover, for example into Yemen where Iran has had a very malign influence? What reassurances have we given the Gulf states, including more military assistance, to help them over the interim period? The Minister mentioned the embassy. If our businessmen are to take full advantage of the new openings, surely an embassy would help immeasurably?
My Lords, as I mentioned earlier, there are still obstacles in the way of reopening the embassy but we are working very hard on them in discussions with Iran and we hope to reopen it by the end of the year. The noble Lord is right that that will help businesses from around the world, particularly the UK, to operate there. However, businesses are right to be circumspect about how soon they go in and the circumstances under which they can operate. I am sure there will be lot of caution. I think I have already made it clear that we are talking to countries in the area through our posts and also sometimes through ministerial contacts with regard to the implications of this agreement. Clearly, our diplomatic work since last summer with regard to Yemen has been trying to ensure that there is no spillover into what appears at times to be a proxy war.

Lords ChamberMy Lords, first, I recognise the work that my noble friend does so well for all of us as co-chair of the All-Party Group on International Freedom of Religion or Belief. We are extremely concerned about the approach of the Burmese Government to those who wish to express their own religious identity. We are one of the most outspoken countries in the world about not only freedom of religion and belief but freedoms generally. The Burmese Government are left in no doubt. As to those who are prisoners of the regime, we make it clear that there should be proper treatment of prisoners and proper judicial process. It is wrong around the world if people are inhibited from practising their own belief.
To be credible we have to be consistent, as the noble Baroness and her committee have always been. The US Commission on International Religious Freedom puts Burma in the worst category and states that its Government are wholly unwilling to investigate and prosecute those who are guilty of abuses against Muslims. The US puts Burma in its “country of particular concern” category. I am pleased that the Government and the EU are making representations with the US, but is it normal to make this joint démarche when, to be powerful and credible, we always ensure that we work with the EU and the US?
Indeed, yes. We work with both the EU and the US on these matters. With UK support, the issue of Rakhine was discussed at a briefing of the UN Security Council on 28 May, where I raised the matter of Burma with Prince Zeid, the High Commissioner for Human Rights, in Geneva on Monday. I will continue to do so. Later this morning, I meet the US Ambassador-at-Large for International Religious Freedom and I will discuss the matter with him personally.

Lords ChamberMy Lords, I agree with that last statement. Certainly, if a job represents the interests of the world, people cannot exclude half the population. It is high time for a woman to lead the United Nations but of course we need credible candidates and it has to be an appointment on merit as well. With regard to having more than one candidate, a General Assembly resolution in 1946 established that it would be desirable for the Security Council to nominate only one candidate. We are at the start of a process where we look for allies around the United Nations to ensure that the next process is transparent and fair.
My Lords, the Minister, whom we welcome back, has set out an admirable list of objectives. We hope that perhaps FIFA, when it comes to its choice, will have a similar list of objectives. Can she tell us whether the other countries are ready to support those objectives, or will they continue in the old mode of regional rotation?

Lords ChamberMy Lords, we should remember that President Assad as, also, commander-in-chief of the Syrian forces, presided over the deaths of 200,000 of his own people. He has barrel-bombed them and used chemical weapons. Indeed, a recent report of 16 March suggests they have been used in Idlib. Assad is not the person with whom to negotiate for the solution. We are in negotiation with moderates. I agree with the noble Lord, Lord Green, that it is important that negotiations achieve a peaceful transition in line with the Geneva communiqué. It is that work in which we are engaged.
My Lords, however distasteful, should we not recognise that if a long-term solution is to be found to this tragic conflict, we will have to engage with President Assad in some way? In spite of the barrel bombs, the torture and the enormous loss of life, and with all his faults, Assad is marginally less bad than ISIL.
My Lords, I would not like to say that he is a lesser of two evils. He has shown that he is evil in himself. I will not try to calculate percentages of evil—that would be an affront to those whom he has been responsible for killing in Syria. However, the noble Lord has made a very strong point. With whom does one negotiate? I am aware when I go to the Human Rights Council in Geneva that Assad’s people are there. They are part of the furniture. They are part of those who negotiate on whether a human rights Motion on Syria is passed there and at the United Nations. Negotiation with Assad himself is not part of our proposals.

Lords ChamberMy Lords, I have made it clear in this House before that it cannot be business as usual with Russia while it maintains its position over Ukraine, where it has illegally annexed the Crimea and intervened in another state’s sovereign lands. My noble friend refers to a situation in the Republic of Cyprus that I do not recognise. When speaking to Russian media, President Anastasiades explicitly ruled out the use of Limassol port for military purposes. Foreign Minister Kasoulides also said to the press, after the February EU Foreign Affairs Committee meeting in Brussels, that there was no question of Russian air or naval military bases on the soil of Cyprus. It is a continuation of existing agreements.
In the light of this decision, the visit of President Anastasiades to Moscow, the policies of the new Greek Government and the policy of the Government of Hungary, are the Government concerned about the consensus on Ukraine among the EU countries that remain?
My Lords, it is important that the EU maintains the consensus that it has heretofore. We have, as the European Union, shown remarkable unity throughout the crisis in standing up to Russian aggression and protecting the EU’s interests. For example, the UK has supported NATO allies, demonstrating our commitment at last September’s summit by agreeing to the readiness action plan to enhance NATO’s response to a wide range of threats. There will be an opportunity very soon, at the European Council, for the EU to show the maintenance of its unity over sanctions.

Lords ChamberMy Lords, first, with regard to aid, the IMF has indeed been carrying out investigations as to the measure of the gap between what Ukraine has, what it needs and what may need to be provided for it. In fact, the next IMF review reports in the middle of this month and will identify the need for further macroeconomic support. At that stage we will be able to judge what our contribution should continue to be. With regard to defensive materiel, my right honourable friend has made it clear in another place that that is something that every NATO country has the right to consider. At this stage, we are not considering supplying or selling defensive materiel to the Ukrainians, who are defending themselves against Russian-supported assault. It is important that pressure is kept up on Mr Putin to do the right thing.
My Lords, so far the EU consensus has held remarkably well but, for the sanctions package to be renewed, I believe that there has to be unanimous support in the EU Council and that vote will be in July. Given the close relationship between the new Greek Government and the Russian Government, and between Prime Minister Tsipras and President Putin, what are the realistic prospects of that consensus maintaining?
My Lords, since the election of the new Greek Government, there have been two occasions on which sanctions have been discussed at a European level. On each of those occasions, the Greek Government have agreed with the consensus of the EU-wide view that it is important to continue these sanctions. Yesterday, in the European Affairs Council, when the next tranche in ramping up sanctions was discussed further, it was decided to postpone their implementation until 16 February to give the diplomatic discussions this week a chance. There was consensus and it is important for all of us that consensus remains.

Lords ChamberMy Lords, there are quite a few questions there, but important ones, which I shall answer as briefly as I can. The veto is within the format of the constitution—the rules of the game—so there would have to be a change in the rules for the veto to be abandoned. My noble friend refers to the method of selection last time. Last time, of course, Ban Ki-moon was unopposed for a second term, and it is clear that when he was selected at that stage, China had made it known that it would not accept anybody other than an Asian candidate. The method of selection was across the membership, but clearly the P5 have a crucial role to play. My noble friend is right to point out that it is important for women to be considered, too—and with a woman Leader of this House, a woman Leader of the Opposition and a woman on the Woolsack, who would dare think anything else?
My Lords, is it not the case that there are two admirable women in the frame—Helen Clark and Gro Harlem Brundtland? They would not be secretaries; they would be generals.
I always listen with great interest to the noble Lord, Lord Anderson. He enables me to answer another of the several questions that my noble friend Lady Falkner asked with regard to candidates. Names are, indeed, beginning to be floated. If I may change my analogy, it is almost like a susurration—but, as with all susurrations, the names change as well. The noble Lord may have the latest names; there is quite a little list, I think. We do, indeed, need not only secretaries but generals, too.

Lords ChamberMy noble friend is right to draw attention to the fact that it is important that this does not become a sectarian matter. In the past it has been a three-way battle between the three groups of AQAP, the Hadis and the Houthis. It is important that that does not develop into a sectarian matter. We are working closely with the UN on all these matters, and I know that it has been meeting for a discussion of this today. I assure my noble friend that everything is being done by our embassy through the G10 and the Friends of Yemen to ensure that we get back on track with the peace process.
Our key concern must surely be for the safety of the few British nationals who remain in Yemen and, of course, with our own diplomatic staff—and also, of course, for the danger of a boost to al-Qaeda there and in the wider region. Given that the interests of Saudi Arabia are very involved and that it has been intervening at the border in the past, does the Minister see any danger of a wider and possibly military intervention by Saudi Arabia?
As the noble Lord will be readily aware, we are working through the Friends of Yemen with a wide variety of actors to try to get back on track with the peace process. Of course, he is right to point to the security problems in the area. We know that Saudi Arabia is a main actor in trying to protect its own borders. He can be assured that our embassy staff work constantly in negotiations with other countries to ensure that cross-border activity is prevented.
The noble Lord has given me the opportunity, for which I am grateful, to pay great tribute to our ambassador in Sana’a, Jane Marriott, and all those who work with her, along with those who travel out of necessity from the FCO to do work there. We advise others not to travel, but some have to in order to keep us safe.

Lords ChamberMy Lords, we are not picking fights with the Russians; it was the Russians who invaded and took Crimea. We are simply making sure that we hold them to their international obligations. The noble Lord is right to point to the importance of the development of Ukraine, but first, of course, they have a lot to do in addressing reform in their country, in particular corruption.
My Lords, is the Minister confident that the West and the international financial institutions are geared to prevent an imminent collapse of the economy of Ukraine? The conventional figure being bandied around is $27 billion, but she may have noticed in this morning’s Financial Times that George Soros was talking about $50 billion and saying that the defence of the economy of the Ukraine is effectively the defence of the West. Are we geared to respond adequately?
My Lords, we are watching very carefully what will happen when the IMF reports. The noble Lord, Lord Anderson, is absolutely right to draw attention to what could be a very severe development and I am aware of Mr Soros’s article this morning. However, until we see the assessment by the IMF, it would be improper of me to make a guess as to what action we should take. It is clear, however, that we and our allies across Europe and in the United States are determined that Ukraine should be able to continue to receive proper support.

Lords ChamberMy Lords, my noble friend points to her request that deadlines should be imposed. In the past, deadlines have never proved to be the opening of a door to a lasting peace. Clearly, she is right to draw attention to the fact that there are many, both in Israel and in the Arab states, who are working hard to achieve a peaceful outcome. The Arab League and the Arab states have a key role in the peace process, and the Arab peace initiative, through its offer of a normalisation of relations between Arab states and Israel in the event of a comprehensive peace agreement, is an important signal of the benefits that peace would bring to the entire region. It needs to be a comprehensive peace agreement. The advantage of a resolution in the United Nations Security Council, if we are able to achieve it, is that one could achieve a peace that is not only signed but delivered and endures.
My Lords, apart from continued drift and deterioration, does the noble Baroness agree that the only real alternative to a two-state solution is a one-state solution which would, for demographic reasons, mean the end of democratic Israel? In the light of the fact that Secretary Kerry has tried very hard but failed, does she see any prospect of any initiative from the United States over the next few years? Otherwise, the prospects appear very bleak indeed.
My Lords, I hesitate to disagree with the noble Lord’s tenet that Mr Kerry has now failed, but I do disagree with that reading of recent events. I believe that Mr Kerry is determined to continue to take the peace process further. It was regrettable that the United Nations Security Council was unable to achieve a resolution. We continue to believe that negotiations for a two-state solution are the only way forward. We are aware that both Netanyahu and Abbas are ready to continue negotiations. It is important that that process is allowed to continue and that we now have a period where people take stock of what has happened over the past few days and quietly consider how we may constructively move that peace process further.

Surely we should now do our best not to alienate this remarkable woman and go to the point of no return in our relations with the European Union that she has warned us against.

Lords ChamberMy Lords, I am not sure whether my noble friend was in the House when we started the debate—he may well have been—but there has been a lot of reflection throughout it on the relationship between this country and Russia. I am shortly to refer to EU sanctions and their impact on Russia.
There has been much comment during this debate to the effect that, “We’ve got it wrong. We didn’t expect Russia to change its attitude. We expected them to develop in a way that was going to be consensual throughout Europe”, but whatever could or might have been done in the past—but I suggest should not have been done—we are looking now at the situation that persists and I would not want to unpick that.
The noble Lord, Lord Truscott, asked whether we would have engagement with Russia on key international issues. Yes, indeed, we do. Regardless of what it has done, we have made it clear that we will engage on other key international issues, such as Iran, Syria and Islamic extremism—matters that other noble Lords have raised—and it is crucial that we continue those negotiating relationships.
As the noble Lord, Lord Bach, described so graphically, the attack on and illegal annexation of Crimea have caused severe problems to the people of Crimea and Ukraine during the summer. The Russian Federation not only stirred up a conflict that has caused suffering to hundreds of thousands of Ukrainian citizens but it has fuelled that conflict through the supply of troops, armour and sophisticated weaponry. That led to the very sad downing of civilian flight MH17 over Ukrainian soil. Russia has waged a campaign of disinformation and propaganda to mask the true cause of civilian suffering and human rights violations in Ukraine; namely, the actions of the Russian-backed separatists. It has also deployed troops and equipment directly in Ukraine. It says that it has not. Putin makes a joke about what uniforms people may wear; well, you can buy those in any shop. It is clear that Russia has provided not only materiel but troops within Ukraine. Putin plays smoke and mirrors; he is an adept.
We have noted from comments by my noble friend Lady Kishwer—I mean Lady Falkner; she is so much a friend that I use her first name—that families of Russian soldiers are not even allowed to know that their sons are fighting, and dying, in an illegal military operation against a neighbouring country. As she points out, the Committee of Soldiers’ Mothers found out that their sons were dying there and highlighted the fact that they were being secretly buried at home in Russia. For telling the truth, that committee is now on the foreign agents register. I find that absolutely extraordinary.
Noble Lords have spoken about how much we must encourage the ceasefire between Poroshenko and Putin to hold. They are having discussions in Milan this very week, as the noble Lord, Lord Owen, referred to earlier. The plan which was set out and signed in Minsk on 5 September had several points to it. We are still waiting for Russia to complete its commitments. I know that Putin has this week reduced the number of troops on the Ukrainian border, but that commitment must transfer into a commitment to take troops out of Ukraine and to move the tens of thousands of troops away from the border not just while it is ASEM week in Milan but for good.
Several noble Lords, including my noble friend Lord Cormack, the noble Lord, Lord Owen, and the noble Lord, Lord Kerr of Kinlochard, referred to the Budapest memorandum. I say firmly that the UK is willing to engage on the basis of the Budapest memorandum; it is Russia that has refused to do so. But we do not give up. The position at the moment is that we would like to engage, but they will not.
I turn to human rights in the former Soviet Union. Many noble Lords, particularly the noble Earl, Lord Sandwich, my noble friend Lady Hodgson of Abinger and the noble Lord, Lord Anderson, pointed out not only how Russia has run roughshod over fundamental rules that govern relationships between states but that its actions have undermined the principles that govern the relationship between states and their peoples. It has subverted democratic principles and the rule of law both within and outside its borders and put human rights under serious pressure in a number of ways. The noble Lord, Lord Anderson, used that as a lever to refer to issues around a Conservative Party announcement at the Conservative Party conference. We will have plenty of time to engage on that. Work on human rights is in my policy portfolio at the Foreign Office and I am working on it 100%. There will be no let-up in our enforcement as a Government of our duties with regard to human rights and I would expect all our duties on human rights to persist beyond an election whichever Government is in office, because it is part of our society. However, I think that a debate on the European Court of Human Rights really is for another day.
My Lords, I am aware that I am not going to be able to answer half the questions that I had hoped to do so.
Significant points were made on freedom of expression and belief by my noble friends Lady Hodgson of Abinger and Lady Falkner and the noble Lord, Lord Giddens. They spoke of the way in which human rights have been trampled on and how the media have been hindered in Russia. Indeed, we find that there is a foreign agents law, too, which prevents NGOs carrying out their proper function.
Torture remains a concern in many parts of the former Soviet Union—I have just been advised by one noble Lord that I should not say that—including states such as Uzbekistan and Turkmenistan. My noble friend Lady Hodgson appealed for UK influence with regard to human rights and women’s rights in Kazakhstan, which she has recently visited. I will certainly take that back. She can be assured that we have put pressure wherever we possibly can.
Sanctions were referred to by many noble Lords. I shall refer to them briefly at this stage. Sanctions had to be imposed as a way of bringing home to Russia the import of its action in illegally annexing Crimea and its activity in Ukraine. They are having an impact, exacerbating negative trends in Russia’s economy, which shrank by 0.5% in the first quarter of this year. Sanctions of course are always under review—the noble Lord, Lord Kerr, in particular referred to this—as to their effectiveness, but it is important that they remain.
Throughout all this, a rather bleak picture has been painted. As I finish, I simply say that we remain committed to upholding the rule of law, democratic principles and human rights in all the countries, Russia and those that surround it.

Lords ChamberMy noble friend points to a situation in Kobani which deeply concern us all. Naturally, we are watching developments very closely. Turkey is already playing an important role in our coalition effort against ISIL, particularly through its humanitarian support in the region—my noble friend referred to that work, which I am sure will continue and intensify. Turkey is also assisting in providing support to the Syrian moderate opposition. Therefore we welcome Turkey’s support for the air strikes in Syria and Iraq, and the President of Turkey’s affirmation that he and his country are willing to play their part in the military campaign. My noble friend is right to press us to look further at how we might discuss with Turkey where that direction of help may develop. I am grateful to him for raising those issues today.
My Lords, the Foreign Secretary told the Telegraph yesterday that there was a legal basis for air strikes in Syria—not just in Iraq, where there is no doubt—but as there is no Security Council resolution and no question of self-defence, on what doctrine of international law do the Government depend?
My Lords, with regard to Iraq, the position was set out clearly in the recall of Parliament, and my noble friend the Leader of the House repeated that. With regard to Syria, there are arguments that there is a legal basis in international law; namely, where there is a humanitarian disaster, action may have to be taken. What I can say clearly is exactly what the Prime Minister and the Leader of this House have said; that is, if we get to a position where it is felt appropriate to move to further engagement and if there is a knowledge ahead, a premeditation, of taking further action, then nothing will be done unless the Government return to Parliament to have that matter considered.

Lords ChamberMy Lords, I am grateful to my noble friend, and I have of course read his contributions earlier this year to the debate on the crisis in Ukraine. In direct answer to his question, I understand that the Russians are now pulling back some of their troops from the border with Ukraine. There have been some thousands of Russian troops on the Russian side of the border with Ukraine, and we are of course aware that there are hundreds of Russian troops within Ukraine. Unfortunately the Russians are seeking to do a bit of smoke and mirrors and will not admit that they are there, but they are there. My understanding is that those on the Russian side of the border have been told that they will be pulling back, and some have moved; let us see how many. Is this really the end of a summer exercise or are they there just waiting for a return?
My Lords, senior Russians have said that Ukraine is not a real country and have been very ambivalent about the democratically elected President. If that is so, and if there had been negotiations at the outset, what would have been the purpose? Is it the Government’s view that, from the outset, Russia had the intention to annex Crimea and to destabilise those parts of eastern Ukraine that have a Russophone majority?
My Lords, the position of Ukraine is clear, it is a sovereign state, and Russia has sought to undermine that by its illegal annexation of the Crimea. The noble Lord tempts me to try to go into the mind of Mr Putin as regards his ultimate plans not only for Ukraine but for all the other countries that were once within the USSR. Clearly, from the very beginning, we entered into negotiations in good faith to try to ensure that the sovereignty of Ukraine was maintained. It is Russia that has broken the UN declaration. It is in breach of the UN; it is also in breach of international law. In all the discussions that we have carried forward, what we have tried to achieve is to give the Ukrainian people and the Ukrainian Government space within which, in a ceasefire, they can work to have elections. President Poroshenko said that those parliamentary elections will be on 26 October.

Lords ChamberMy Lords, I have made it clear that there would be an apology from me if I had uttered an untruth. I have not uttered an untruth. What I have said is that I am deeply disappointed that anybody should have leaked that letter. The noble Lord, Lord Bassam, has been able to make it clear that it was not he. I am grateful for that because our relationship has been a proper one in the usual channels and will continue to be so.
I want to make a few points. First, I think that my noble friend Lord Foulkes is following a pipe dream if he thinks that there will be a definitive decision. I concede that if there were a substantial majority one way or the other, that would be a definitive decision, but we should remember not just the precedent of the Cunningham amendment but the precedent of 1975, when there was a very clear decision by the electorate to remain within the EEC. However, people such as Tony Benn and others were very quick not to accept the result and they lobbied against it.
In US politics there is a story—probably apocryphal —of a decision which was made by a drunken member of the public who, a minute or so before the polls closed, staggered into a polling station and fell on to a voting machine. His vote was the decisive one on that occasion. That sounds rather absurd but there was a film on that same theme in a key state in a presidential election.
Given the importance of the decision that the electorate will be making in the referendum, if it goes ahead, it is important that we seriously consider a threshold, not at this stage but on Report.
My Lords, I am not seeking to interrupt for bad reasons the progress of the Bill or to prevent the next Peer speaking on the amendment. For the last hour or so, Members of the House have been asking what happens next. When my noble friend Lord Popat was challenged about rising times, he was unaware that amicable discussions were going ahead between myself and the Opposition Chief Whip with regard to today’s business.
The expectation of the Opposition Chief Whip and myself is that the House will rise after the conclusion of Amendment 48, which is shortly ahead of us now. I am saying this now so that those who wish to speak to the amendment after Amendment 48 but may not be involved in the rest of today’s business will have a better certainty about the planes and trains they need to catch.
There is an agreement that we should conclude today’s business at the end of Amendment 48 and I shall not seek to prolong the Committee stage beyond that. At that stage I shall seek to resume the House and shortly after that I shall adjourn the House. I will, in the normal way, as a courtesy to the House indicate formally—I am doing it informally now—that we will continue the Committee stage of this Bill next Friday, 31 January at 10 o’clock. My expectation is that the Committee stage will conclude on that day and, given the progress today, I believe that is a reasonable assumption.
I hope that that is helpful to all concerned who, in different ways, have been working hard on this Bill and for different reasons. I now invite those noble Lords who are taking part in the debate on Amendment 40 to continue to do so. I am grateful to the noble Lord, Lord Bassam, for the helpful discussions we have had today.

The Minister will be well aware that Boko Haram is only part of an Islamist tide sweeping across the Sahel. In northern Nigeria, a particular problem is the atrocities against the Christian community—the attempt, in effect, to cleanse northern Nigeria of Christians. What specifically are the Government doing to assist Nigeria, possibly in co-operation with our French colleagues because of the general nature of the problem, and to what extent do we fear for the unity of Nigeria?
