My Lords, notwithstanding the noble Earl’s answers, is he aware of reports only this morning, from Stepanakert, the capital Nagorno-Karabakh, that street fighting is still going on despite the ceasefire announced yesterday? Does he not agree with the points being made across the House that verification of these things is pretty crucial? Have we set in motion the sending of diplomats or observers to see for ourselves what has been happening in the Lachin corridor and now in Nagorno-Karabakh? As the noble Lords, Lord Collins and Lord Purvis, asked, at the United Nations Security Council later today, will we reinforce the call not for Russian peacekeepers —the noble Earl mentioned their inadequacy—but for an international peacekeeping mission and a mandate to require that to be established?

My Lords, the noble Lord mentioned the ceasefire. I had a call on this half an hour ago from the department and, as I understand the situation, we feel that the ceasefire is holding at the moment, and we hope it continues to do so. He mentioned other factors, which are all really important in the whole scale of things. I will of course bear them in mind and make sure that the department is aware of them.

My Lords, my noble friend Lord Forsyth makes a very important point. The first port of call for individuals in Rhodes at the moment is of course the travel operators, which have the responsibility to get them back. More empty planes were sent yesterday—I gather that more are being sent today—and there is a process of repatriating people from Rhodes.

My Lords, although the noble Lord, Lord Forsyth, is right about the responsibility that falls on the travel companies, the Minister is right to say that they have responded quite speedily and effectively in the circumstances. Does the Minister agree that the number of wildfires, not just in Rhodes but in other places, could reach a point at which it is impossible for the travel companies to deal with the numbers involved? Can he tell the House what contingencies have been put in place in those circumstance for the FCDO to be able to assist in the evacuation of people caught up in the fires?

I thank the noble Lord, Lord Alton; he makes a very important point about the assistance to individuals and families on holidays in these areas. There is always consular assistance. We advise travellers in the areas where there are fires to ask for consular assistance, and so far that has been given to a number of individuals.

My Lords, I am unsure about the answer to that question; I will get further information to my noble friend. The engagement that we continue to have with the Saudi Government is extensive. Over the last six months, my noble friend Lord Ahmad has visited Saudi and has also had a meeting with Saudi Ministers here in London. Those continual engagements enable us to have these serious conversations.

My Lords, do not these executions—there were 67 in 2021, 27 in 2020 and now these 81—demonstrate a horrific and rather brutal pattern? Sometimes these executions are carried out using the sword, and crucifixion has even been used. The mortal remains of those who have been executed are put on public display. As we heard from the noble Lord, Lord Collins, even children have been involved. Will the noble Earl undertake to speak to his colleagues in the Foreign Office about engaging scholars at Al-Azhar Mosque in Cairo to see whether we can engage people who are academics and have a firm belief in civilised values, so that we can hear Muslim voices being raised against this barbarism?

My Lords, I thank my noble friend. Violence against women remains a serious issue, as she said, with gender-based violence prevalent across all parts of society and reports of it increasing during Covid-19, but Her Majesty’s Government’s support for women and civil society has amplified the voice of women’s organisations within the national Covid-19 response. I should also say that the UK continues to lead the way on what works to prevent violence against women and girls through our flagship safe programme, which will test and generate learning on how to prevent gender-based violence, including domestic violence and child marriage.

My Lords, given what the noble Lord, Lord Oates, said to the House about the systematic and considerable attacks that have been made on CCC candidates, can the noble Earl tell us whether election monitors from the international community and the diplomatic corps will be on hand during the forthcoming by-elections but also in the 2023 general election in Zimbabwe? Will he also draw the House’s attention to the admirable statement by the Government of Kenya, which the Government of Zimbabwe should take careful note of, with its condemnation of the occupation of Ukraine by Russian troops?

My Lords, yes, we are concerned about the recent incidents of violence targeting CCC rallies. As I said, our ambassador in Harare tweeted to called on the Government to ensure that perpetrators of violence are brought to justice and that all parties can campaign freely without fear of violence. I am aware that two rallies took place peacefully last weekend. The noble Lord asked about election monitors. I am afraid I do not have that information to hand, but I will write to the noble Lord.

My Lords, the mainland Chinese and Hong Kong authorities have used the national security law to target pro-democracy figures, curtail freedoms and shrink the space for opposition, a free press and civil society. The UK continues to raise its concerns directly with Hong Kong and Chinese authorities. We continue to urge Beijing to uphold its international obligations, including the rights and freedoms protected in the joint declaration.

In thanking the noble Lord, I will put to him a question put to me by a courageous Hong Kong activist, Chung Ching Kwong, about young pro-democracy activists most at risk of arrest. Can we be told, she asked, when the Home Office will introduce the promised and welcome new regulations to include within the BNO scheme young people with a parent who is a BNO passport holder and born after 1997? What are we doing to work with other Commonwealth countries to provide an international lifeboat for young Hong Kongers who do not qualify for the BNO, and what estimate have the Government made of their number?

I thank the noble Lord, Lord Alton of Liverpool, for his question. We are sympathetic to the circumstances of children of BNO parents born on or after 1 July 1997 and are considering what more can be done to support this cohort where they wish to build a permanent life in the United Kingdom. We will continue to bring together our international partners to stand up for the people of Hong Kong, to call out the violation of their freedoms and to hold China to its international obligations.

Yes, I agree with the most reverend Primate. Communities are of prime importance. There has been much movement over the last few years in various areas where there has been large-scale development. Communities have been very much at the forefront in how many of these planning development areas have been established. I know in particular about an area in north Swindon. I declare an interest: I was a landscape contractor there. I did a lot of the planting of trees and the general landscaping. There, it was very important that these developments had a community at their centre. The most reverend Primate also commented on what the noble Baroness said—I cannot remember what she said. I apologise; I will write to the most reverend Primate on that issue.

My Lords, in addition to the eight local authorities being immediately sanctioned, what will happen to the 26 local authorities that have been told they will have to produce action plans? How long will they have to do that for and what sanctions will be applied to them if they fail to comply? After all, as the noble Baroness, Lady Thornhill, put it, we need carrots as well as sticks.

The noble Lord, Lord Alton, makes a very good point. As he said, 26 local authorities have achieved between 85% and 94% of delivery. They need to produce an action plan to remedy this. We look forward to the planning White Paper, but one should remember that we will also be reforming the fees process for planning applications. This is to ensure that local planning authorities are properly resourced.

My Lords, I will be brief because other people no doubt want to get up as well. The noble Lord, Lord Clement-Jones, mentioned that we are in essence supporting the gambling industry on this. Nothing could be further from the truth. We have to take the job losses into account. We are interested not in the profit margins of the gambling industry but in trying to mitigate any job losses that happen in the future. I repeat what I said in the Statement: the Government were urged in an Early Day Motion in June by the FOBT APPG not to wait until April 2020 and we are not doing so. He also mentioned my honourable friend the Minister for Sport. I have had the great pleasure and honour of working with her for a number of years and she is an exceptionally fine Minister.

My Lords, what will the tax yield be from delaying this between now and implementation? What funds will flow into the Treasury which would not otherwise have come and might that money be used to support the voluntary levy, which is inadequate to help charities such as GambleAware to deal with gambling addiction? Does the noble Earl contest these figures from GambleAware: that there are 430,000 problem gamblers; that around 500 suicides annually are linked to gambling; and that 2 million may be at risk from gambling? Will he return to the question that I asked on Tuesday about how advertising is directed unscrupulously at children and young people, especially through things such as virtual games?

My Lords, I will try to be as quick as I can. My noble friend Lord Younger answered the noble Lord’s question earlier this week but it is important that advertising is restricted, particularly when pinpointing younger people. For example, the sports clothes worn by young people are not allowed to have the advertising logos of some of the gambling companies that sponsor sport. The noble Lord also asked a number of questions relating to the tax take and so on. I do not have that information to hand and I will write to him on that issue.

My Lords, the Government welcome the summit as an important first step towards securing a denuclearised North Korea. This is in the interests of regional peace and international security. More needs to be done. We hope that this marks the beginning of a substantive process, leading to concrete actions from North Korea towards complete, verifiable, irreversible denuclearisation. We continue to have grave concerns about human rights in North Korea and expect more discussions and actions to follow.

My Lords, I am grateful to the Minister for that reply. While inevitably remembering broken promises on denuclearisation made in 1994 and 2007, is the noble Earl not right that this is a moment to give a cautious welcome to the Singapore summit and to work with the United States, China, Japan and the vibrant democracy in South Korea to turn hopes into substance? Would not the best memorial to the 1,000 British servicemen who died in the Korean War be the formal ending of the state of war that has continued since 1954? Meanwhile, will the Minister confirm that, in the short term, Security Council sanctions will stay in place until we see real evidence of denuclearisation, and that in due course we will press for human rights, said by the United Nations commission of inquiry to be sui generis—without parallel anywhere in the world—to become part of the negotiations, as they were in the Helsinki process?

My Lords, I thank the noble Lord for that question and I agree with much of what he said. As far as sanctions are concerned, the noble Lord is quite right that UN sanctions will remain in place under 10 UN Security Council resolutions, the most recent of which was adopted in December 2017. But the noble Lord is also right to say that this is a step forward. It was the first meeting between a sitting US President and a North Korean leader, and this is a very important step forward.

My Lords, I shall take the last question first. As the noble Lord is aware, Botswana has a strong record of supporting improved human rights in the DRC. At the Human Rights Council last June, Botswana supported a resolution that, among other things, encouraged the DRC to intensify its efforts to put an end to violence in its territory and underlined the centrality of the agreement of 31 December 2016. The noble Lord mentioned our trade envoy. In fact, at present there is no trade envoy from the United Kingdom in the Congo. As regards anyone trying to carry out work in that part of the world, we have a duty to provide frank advice to any businessmen seeking to operate in the DRC.

My Lords, in a country where 5.4 million people died in the second Congo war, has the Minister seen the United Nations report that agents of the state have murdered more than 1,000 people in the last year, and that the mutilated body of an outspoken critic, Father Florent Tulantshiedi, was found on Friday last, recognised only by his clerical collar? Given that President Kabila is today meeting multinational mining companies to seek increased royalties—in a country where people live on less than 80p a day—is it not time that economic leverage was used to challenge and bring to an end state-sponsored anarchic violence and unspeakable corruption, which lines pockets while children starve and critics are executed?

My Lords, the noble Lord, Lord Alton, paints a pretty grim picture of life in the DRC. There has been some movement in bringing people to account. In the last protest on 25 February, where three people were killed, the authorities identified the officers responsible for the deaths, who are now facing judicial proceedings. This is a change from previous practice. On all occasions when we have contact with the DRC Government, we emphasise the importance of human rights and how, putting it bluntly, they have to clean up their act.

My Lords, the noble Lord makes some very important points from the 2013 report. There are still problems with freedom of expression. Kazakhstan’s legislation on NGOs is of concern and progress on human rights has not been quite as fast or comprehensive as we and others would wish in the 25 years since independence. Significant reforms are under way, however, and important progress has been made on social and women’s rights and prevention of torture.

My Lords, in addition to worrying about human rights violations, which include torture, does the noble Earl agree that the record on the promotion of democracy is also pretty awful? There have been five successive elections: in the most recent the President was elected yet again, but with 97% of the vote. All the outside agencies that have monitored these elections say that they have all been flawed.

My Lords, I agree with much of what the noble Lord has said. The OSCE Office for Democratic Institutions and Human Rights noted that, while the elections were “efficiently organised”, there was still room for much improvement and there needs to be a “genuine political choice” and more media pluralism.

To ask Her Majesty’s Government how they intend to respond to the resolutions of the European Parliament and the Parliamentary Assembly of the Council of Europe condemning the actions of Daesh/ISIS in the Middle East as genocide.

My Lords, the European Parliament and the Parliamentary Assembly of the Council of Europe are right to condemn Daesh abuses in the Middle East and its treatment of minorities. It is a long-standing government policy that any judgments on whether genocide has occurred are a matter for the international judicial system, rather than Governments or other non-judicial bodies. However, let me reassure noble Lords of the Government’s commitment to defeating Daesh and preventing further abuses.

My Lords, what is the point of Britain being a signatory to the 1948 genocide convention if, when compelling evidence emerges of mass graves, systematic executions, abduction, rape, enslavement and the forced conversion of minorities such as Yazidis and Christians—evidence sufficient to convince the European Parliament and the Council of Europe—the United Kingdom declines to name this horrific cruelty for the genocide that it is? Do we intend to ignore these resolutions, or will we take them to the Security Council and seek a referral to the International Criminal Court or a regional tribunal, so that those responsible for these heinous crimes will one day be brought to justice?

The noble Lord, Lord Alton, describes these crimes quite rightly as heinous. He also suggested that we take this matter to the UN Security Council, but it would be for the Security Council as a whole to agree. The UN Security Council has already taken a number of steps against Daesh, for example the binding resolutions against it which seek to reduce its ability to finance its activities and cut the flow of foreign fighters. However, whether or not this is ever designated as genocide does not stop this country’s determination to deliver aid to those people in that situation.

To ask Her Majesty’s Government what representations they are making to the French authorities about the case of Mr Rob Lawrie, arrested in France for attempting to rescue a refugee child and to bring her to her relatives in the United Kingdom.

My Lords, the Foreign and Commonwealth Office has been in contact with the French authorities regarding Mr Lawrie’s arrest. It is ready to provide consular assistance to Mr Lawrie, should he request this. However, we cannot interfere with another country’s police investigation or judicial proceedings.

I thank the Minister for his reply. Rob Lawrie, a former soldier now facing five years in prison, rescued a four year-old girl from the jungle camp at Calais. In the words of the petition now signed by 100,000 people, were these not the actions of

“an ordinary man who was trying to do the right thing in extraordinary circumstances”?

As we recoil in horror at the atrocities committed in Paris, and witness the many shocking consequences of mass migration, what are we doing to prioritise—as he tried to do—the special plight of children, thousands of whom are now reported to have gone missing and who have been caught up in events entirely beyond their control?

My Lords, the noble Lord raises an incredibly important point. I am sure that the thought of all these children who have gone missing is quite appalling to all noble Lords. The noble Lord also refers to the Save the Children proposals. We looked very seriously at them but major international organisations, such as UNHCR, advised caution on relocating unaccompanied children. This is why the Dublin Regulations are so important in relation to the children who have come into Europe. It is important that we register and give identities to these children who find themselves on our shores.

My Lords, I think that the Minister referred to the report from Save the Children when he responded to the noble Lord, Lord Roberts of Llandudno. Will he undertake to meet representatives of Save the Children to discuss that report? As the noble Lord correctly said, it has identified some 10,000 children arriving in Italy in one recent year, 4,000 of whom have gone missing. I know that the noble Lord shares my concern about the actual implications of going missing.

I agree with much of what the noble Lord says. In Bosnia, for example, we provided our local staff with a financial payment on redundancy when their services were no longer required as the campaign drew on. In Iraq there was another scheme. Different countries require different schemes and it was not felt that the same scheme that was available in Iraq would have been suitable in Afghanistan.

Can the noble Earl return to the question that my noble friend raised with him a few moments ago, specifically as to why journalists are covered—as they are by the Geneva Conventions—but translators and interpreters are not? Do we have any plans to seek an amendment to the conventions so that they might be so covered?

My Lords, I do not think there is a great deal I can add to the answer I have already given to the noble Baroness. I am not sure whether the noble Lord is aware that 64 civilian journalists and support staff have been killed so far this year. The whole world grieved at the events in Paris earlier this year. It is important to remember that journalists and bloggers face intimidation and violence around the world as well.

To ask Her Majesty’s Government what assessment they have made of the UN Commission of Inquiry Report that found that crimes against humanity have been committed in Eritrea, and of the impact of such crimes on the exodus of refugees from that country.

My Lords, we are concerned by the commission’s findings that widespread human rights violations are being committed in Eritrea and that these may constitute crimes against humanity. We have made clear to the Government of Eritrea that they must honour their international obligations and that improved respect for human rights is required to stem the flow of irregular migration.

My Lords, does the noble Earl see the connection between crimes against humanity, which include rape, torture and extra-judicial killings, and the 300,000 Eritreans who have fled that country? We see pictures every day on our TV screens of people taking to the high seas and even facing execution by beheading by ISIS as they try to escape via Libya. Given that connection, must we not tackle this problem at the root and ensure that regimes such as that of Afwerki in Eritrea are hauled before the International Criminal Court and held to account for their actions? Will the noble Earl tell us, therefore, why we have agreed a package—via the EU—of £300 million in aid to Eritrea which requires nothing to be done about these human rights violations?

My Lords, I thank the noble Lord for his question. We certainly agree that a comprehensive plan is needed to tackle migration. That means greater engagement with source countries to address why migrants leave in the first place, through development aid addressing human rights abuses and tackling conflict. We have stepped up bilateral engagement with Eritrea to that end. We have also made it clear to the Government of Eritrea that they must honour their international obligations and that improved respect for human rights is needed to stem the flow of irregular migration. We keep the human rights situation in Eritrea under close scrutiny and will discuss the commission’s conclusions at the UN Human Rights Council on 23 June.
